How much do you know about your local and the people that run it. Why they do what they do. What they enjoy about this profession. What they enjoy....less so. Be it core classics or specials and seasonals, the independent on-trade is essential in offering a platform to countless brewery's beers. And for patrons and producers in West London, they're fortunate to have a brilliant pub that does just that. Run by husband and wife duo Tim and Tosh, alongside canine companion Dexter, The Brook is part of the rich beer and brewing fabric of Brentford. After running a wealth of London's best-known pubs, giving a boost and a stage to excellent, independent, beer is a huge part of their raison d'être. The Brook was founded as 'The Royal Oak' beer house in 1787 and it was originally a standard corner property, later expanded into properties in New Road. It belonged to the Royal Brewery of Brentford. The Royal Oak was licensed as a public house by 1894 and it was built in its present form in that year 1894, possibly being partially rebuilt in the 1920s. The Strawberry House beer house was established by 1871 at 33 New Road where a member of the Gomm family (the brewers) was noted as a beer seller there. It was probably named after the large area of market gardens that used to exist in the area between Brook Road and Ealing Road. One of the market gardeners, Thomas William Beach, founded a jam factory in Brentford and he won awards for his strawberries at the Great Exhibition in 1851. The beer house was closed after 1896 by which time it was known as The Patriot. Licensees of The Royal Oak included John Carter (1869), Richard Lewis (1870), Elizabeth Gardner (1894), Boaz Stallwood (1901) and Albert Coles (1914-1937). Stan Johnson was the landlord of The Royal Oak until 1960. By 1957 Stan had decided that he would become a publican and he moved to The Royal Oak after completing his training at The City Barge at Strand on the Green. In 1960 Stan and his wife moved to the Midlands, first in Walsall and then in Bridgnorth. The Royal Oak was closed for some time and re-opened as 'The Brook' in June 2019 with Tim and Tosh Rider as the owners. Tim explains: "My introduction to the pub trade was Godolphin's just near Brentford Lock in 1989. My stint there made me realise I had a genuine love for the hospitality pub trade…so, thank you Brentford for that! I joined Whitbread soon after becoming the manager of The King's Head in Chiswell Street near the Barbican Center. "I met Tosh in The Blue Posts, in Soho, 20+ years ago. We married in 2002 when we were both running Bar Mosko in Holborn, then we spent 10 years at The Tabard in Chiswick followed by 2 years at the Ye Olde Cheshire Cheese in Fleet Street. Between the two of us we have gained strong links and experience within the pub industry. "We took the lease on for The Royal Oak in Brentford in March 2019 and the pub showed real promise plus a chance for both of us to finally put down some roots. The Royal Oak needed some love so after 3 months of getting the pub back into some order, we changed the name to 'The Brook'…it was time for a fresh start. "We are immensely proud of The Brook, how it looks and we are committed to becoming the local “village pub” in Brentford. So come and relax with our great selection of craft ales/beers, great wines, spirits and good food alongside good company and an extensive selection of vinyl and digital music!" In this episode we speak to Tim about the joys, and challenges, of running an independent pub, the importance of connecting with the community, operating in an area synonymous with football but not being defined by it, and the duo's love of pouring brilliant beers from the UK's best.
Nevis Brands CEO John Kueber joined Steve Darling from Proactive to announce the company's financial results for fiscal year 2023 and the fourth quarter ending November 30, 2023. Nevis Brands reported revenues of $671,000 for the year, with Cost of Goods Sold amounting to $278,604. For the fourth quarter alone, Nevis generated revenues of $395,876, primarily derived from royalties received from Licensees in five states, while Cost of Goods Sold stood at $134,223. Kueber expressed satisfaction with the conclusion of the fiscal year, highlighting the significant expenses and charges incurred during the transition from Pascal Biosciences Inc., the company's previous business entity. Notably, Nevis Brands achieved growth in revenues and managed to reduce costs of goods sold in the fourth quarter, signaling positive momentum in its operations. Furthermore, Kueber emphasized the company's ongoing efforts to expand its revenue streams, particularly in states where Nevis is currently operating. He expressed excitement about the additional revenues expected from licensees that have been secured but have yet to contribute to revenues. Notably, revenues for the fourth quarter did not include contributions from Nevada and California, both of which are now revenue-generating states. Additionally, Michigan and Missouri are anticipated to contribute to revenues in 2024, further bolstering Nevis Brands' financial performance. Looking ahead, Nevis Brands sees significant growth opportunities for its major brand, not only through expansion into new markets but also through the introduction of new products. Kueber emphasized the potential for diversification beyond beverages into other edible products, underscoring the company's commitment to innovation and market expansion. [8:15] Peter mentions some issues faced by the Asian and Pacific Islander community, including derogatory terms and stereotyping related to the origin of COVID-19. [9:34] Melinda talks about social awareness. API people are part of the community and did not cause the pandemic. It's important that the anti-Asian hatred not persist. [11:46] Asian Pacific Heritage Month in May increases awareness of the API community for a month. Peter hopes AAIN will amplify API industry voices all year long. There are seven committees within AAIN and each has the goal to become self-sustaining with strategic plans for 2023 and beyond. [27:53] Yakiya and Panda Inn are full-service restaurants in California. Family-owned Panda has over 2,300 locations in the U.S., Japan, Canada, Puerto Rico, and Guam. [28:21] Melinda leads the safety and workers comp managers, she manages the insurance program, which includes a captive. She has a team of 14 people. [28:37] Melinda's team does a lot of things both risk- and non-risk-related to support operations. Being in a family-owned business, they have some latitude. [28:50] Justin's kids love the Hibachi experience! Hibachi-San is a fast-food version of Hibachi. If you watch the cooks at Panda Express, they are very skillful at flipping food! [29:33] Melinda has been trained to do the cooking, but she's not good at it, so she stays in her lane to do risk management! [29:49] Melinda's team of 14 handles claims in-house, all aspects of insurance, and compliance. They have an internal auditor that reports to Risk. [30:03] Executive Director of Risk, Shaun Jackson, Melinda's leader, led the Group skillfully through the pandemic. Melinda appreciates all the support. [30:13] Panda is family-owned. Licensees are in locations at universities, airports, or some locations they can't own and operate. The majority of stores are family-owned. [30:34] This is Panda Restaurant Group's 50th Anniversary, starting in Pasadena, California, with a restaurant called Panda Inn, growing from there. [30:59] Melinda says as a family-owned business, they think of each other as a family, at Panda. They think of their operators as family and do their best because they care. [31:43] Panda is one of the few companies Melinda has worked for where the owners and founders know their team members by name and will talk to them. [32:01] How Shaun and Melinda navigated the challenges of the pandemic when businesses were ordered to shutter. [33:02] They relied heavily on their TPA, Sedgwick, who helped them with COVID-19 claims and reporting. [33:45] They had to take a moment to consider the problems of the pandemic, and then move on. Risk is all about making sure that the business continues despite issues. [34:01] Melinda reviews how a business responds to a fire. Take care of the people, restore the business and associates, serve the customers, and work it out. [34:36] How the drive-through and online ordering options became more used during the pandemic. There were big upgrades that were needed to help the customer experience. [37:31] Melinda enjoys working with the people behind the food. Panda is a company that's looking to inspire better lives. Cooks can move up in the company. [38:40] Melinda talks about how people view each other and relate to each other with care and trust. [38:53] There's a fully-automated McDonald's in Texas. In 2020, she became the lead grant applicant on the Cosmetology Compact, working with the Department of Defense and Council of State Governments to insure true license mobility for cosmetologists. Leslie currently works with the CSG on behalf of FBIC on industry forward legislation. Previously, Leslie worked with cosmetology boards in over 30 states on revision of infection control rules and required curriculums consistent with current science and occupational trends. She has written science content for Milady and currently writes for Pivot Point textbooks. Throughout Covid, she assisted states in developing re-opening guidelines and offered education in all virtual formats to help states re-open. She is a national exam item writer and participates in the Safe Nevada project as well as the Department of Labor Occupational Licensing Consortium.
A Doraville police officer has been arrested in connection with the death of a 16-year-old Norcross teen whose body was found off State Route 316 last week. Gwinnett County police are still investigating how Susana Morales died. She went missing last July while walking home and her body was found near the Gwinnett-Barrow county line on February 6. Gwinnett law enforcement officials have not released details of how Doraville Police Officer Miles Bryant was involved in the Morales case. He has not been charged with killing Morales, but he has been charged with false report of a crime and concealing the death of another. Bryant is a Norcross resident, according to Gwinnett County police. Doraville police said they were notified on Monday afternoon that arrest warrants would be served against Bryant. Doraville officials said Bryant is no longer employed by the city's police department. A new bill would prohibit transgender Georgians under 18 from receiving gender-affirming hormone therapy or surgery. The Bill's main sponsor is Senator Clint Dixon, a Republican from Gwinnett County. The eight-page bill includes a long list of procedures that would be barred, including gender-affirming hormone therapy and surgical procedures. The legislation includes some exceptions, including for people who are “born with a medically verifiable disorder of sex development” and for the treatment of “a physical disorder … injury … or illness that is certified by a physician.” A physician who provides any of the services to a person under 18 would be considered to have committed “unprofessional conduct” and would be subject to discipline by their licensing board. The bill would also require school employees to inform parents if their child is transgender. Medical groups, including the American Academy of Pediatrics, support gender-affirming care for transgender children when the physician and family deem it appropriate. One unintended consequence of the bill could be the prohibition of circumcision, said state Senator Kim Jackson, a Democrat from Stone Mountain. That's because the bill includes a provision that would prohibit the removal of “any healthy or nondiseased body part or tissue.” Circumcision is a common practice and is a required or strongly encouraged in some religions, including Judaism and Islam. A statue of Martin Luther King Jr. that will be featured at the Rodney Cook Sr. Peace Park will reside in Atlanta, but it has major Gwinnett County connections. Local philanthropists Clyde and Sandra Strickland are helping fund the statue — which will depict Dr. King in a pastor's robe and holding an open Bible — and longtime Gwinnett artist Kathy Fincher is one of the sculptors. Fincher and the Stricklands are lifetime friends, and their collaboration on the MLK statue was born out of a mutual desire to depict the civil rights leader in a way he had not been previously shown. Kathy Fincher wanted to emphasize the role faith played in Dr. King's life. That's why she wanted to show him in a pastor's robe, looking upward while delivering his famous "I've Been to the Mountaintop" speech, which was also the wish of the National Monument Foundation. The sculpture, which she is working on with Athens artist Stan Mullin, also shows a Bible open to scripture about Moses. The statue will be unveiled on April 1 followed by a World Peace Revival "Peace Walk." Clyde Strickland said the sculpture will not only make its mark on that day, but for decades to come. Legislation introduced into the Georgia House of Representatives Monday marks the latest effort to legalize sports betting in Georgia. House Bill 380, sponsored by state Representative Marcus Wiedower, a Republican from Watkinsville, is being supported by the Metro Atlanta Chamber. Like sports betting legislation floated in past years in the General Assembly, Wiedower's bill calls for sports betting to be overseen by the Georgia Lottery Corp. Unlike previous sports betting bills, the new measure would allow for two types of sports betting licenses. It calls for awarding up to 16 Type 1 licenses to companies that would provide online sports betting services. A second variety of licenses – known as Type 2 – would go to brick-and-mortar businesses in Georgia that would offer in-person sports betting. Sports betting legislation in past years has been limited strictly to online betting. Licensees would pay 15% of their adjusted gross incomes to the state in the form of a “privilege tax” that would be set aside to help fund education in Georgia. The bill sets out penalties for violators and includes provisions requiring companies involved in sports betting to offer programs to help problem gamblers. North Gwinnett Middle School orchestra teacher Sarah Ball has been honored with the 2023 Elizabeth A. H. Green School Educator Award. According to Gwinnett County Public Schools officials, Ball earned the recognition "for her profound impact on string education in her community, state, and beyond." The honor is a national award presented annually by the American String Teachers Association to one school string teacher with a current and distinguished career in a school orchestral setting. From her award nomination letter, her co-teacher Amy Clement stated, “… she is a passionate music educator who enjoys sharing her love of teaching with others. She has recruited countless numbers of students, mentored many student teachers, inspired hundreds of music educators, and of the highest compliment, she has even had several former students become orchestra teachers to follow in her footsteps.” As a creative mind and innovative advocate for string education, Ball has connected, inspired, taught, coached, and developed current and future generations of string students and teachers. According to GCPS officials, Ball has not only been a leader in Gwinnett County schools "but also shared her light beyond her school district with incomparable engagement and motivational strategies in state, local, regional, and national presentations, and guest clinician performances. Her service to the profession is greatly valued and appreciated." The award reviewers also noted these activities as incredibly influential – including serving as GMEA orchestra division chair, as Georgia ASTA president, and as a member-at-large on the national ASTA board. The impact that she has made in guest conducting roles not only influences those students in the ensembles, but also their teachers and families. Ball will receive the award during a presentation at the national conference in Orlando in March. Cherokee Bluff already knew Seckinger wasn't an ordinary first-year boys basketball program after the regular season meeting between the two teams in December. In case the host Bears had forgotten, however, the Jaguars gave them a reminder during their Region 8-AAAA Tournament quarterfinal Monday night at Cherokee Bluff. Seckinger got balanced scoring and held off multiple Cherokee Bluff attempts at a rally to earn the program's first state tournament bid with a 65-54 victory. Carter Watkins led Seckinger with 15 points, 10 rebounds and three assists, but had plenty of help, with three other players in double figures and a fourth nearly joining them. Dr. Kirti Gupta is the Chief Economist at Qualcomm Inc., where she serves as an in-house economist, specializing on Intellectual Property (IP) and competition policy and strategy. In this role, she is responsible for managing the substantive direction of the global IP policy and advocacy outreach efforts, and for conducting original research on issues related to IP and competition law and economics. She has been involved in various international antitrust and litigation cases. Kirti has also been responsible for developing economic models for determining Qualcomm's optimal IP strategy world-wide and on designing algorithms for IP portfolio valuation. Prior to her role as an economist, Kirti spent over a decade as a wireless systems engineering expert, working on research and development of third and fourth generation (3G and 4G) wireless cellular systems and has represented Qualcomm in various global technology standards bodies. She is a co‐inventor of thirty-five patents in the field of wireless communications. Dr. Gupta holds a Master's degree in Electrical Engineering from Purdue University, and a Ph.D. in Economics from the University of California, San Diego.Kirti starts the podcast with providing insights from her technical knowledge of standards development. She explains that people often forget about the complexity of the technology that we deal with. 4G alone is subject to over 1,400 specifications. Printing these hundred pages documents would fill whole rooms. And thousands of engineers work on various complex technical aspects that are so different that a person working on cellular security aspects would not even understand a person working on location services or coding aspects. This is how rich and complex this tech ecosystem is. This complexity must be considered when economist talk about ex ante and ex post worlds. Kirti goes on and comments about some of the recent policy debates and ideas floating around. In her view a publicly available claim charted database of SEPs would not make any sense. Claim charts are complex and expensive and are typically exchanged in licensing negotiations under NDA. NDAs are requested by both parties. Licensees would e.g. never want to disclose information on future product plans or volumes of sales in certain countries to the public. Kirti also points out that she believes claim charting by third parties may also be difficult because we would need experts with different skill sets – patent examiners from patent offices are not a fit in her view.Kirti also believes that setting an aggregated royalty rate to determine a share of this rate does not reflect the value of SEP portfolios. In Kirti's opinion the top-down approach is a forced central planner approach. She believes you cannot take a price cap and then use simple counts of patents to arrive at a FRAND rate. That to her has no economic foundation. Kirti explains there is some very core and valuable patented technology that must be valued much higher than some incremental technology. Also, Kirti argues that licensing is always about a dynamic patent portfolio, like a leaking bucket. Patents expire and lapse falling out of the bucket while new ones are coming in. So, you will always have a license that covers the bucket no matter what's in it.With regards to where to license in the value chain Kirti confirms that Qualcomm offers licenses on different levels e.g. for automotives on the tier 1 level the DCU (Data Capture Unit) level and also tier 2 level the module makers the telematics. Kirti argues it does not matter where to license in the value chain if the rate does not change. It only matters for where it practically makes most sense to license. Licensors must now deal with the reality of new use cases such as IoT to identify what practically makes sense.
In the law of tort, property, and criminal law a trespasser is a person who commits the act of trespassing on a property, that is, without the permission of the owner. Being present on land as a trespasser thereto creates liability in the trespasser, so long as the trespass is intentional. At the same time, the status of a visitor as a trespasser (as opposed to an invitee or a licensee) defines the legal rights of the visitor if they are injured due to the negligence of the property owner. Trespassing as a tort. The tort of trespass to land requires an intentional physical invasion of the plaintiff's real property by the defendant or a refusal to leave when ordered to leave. Intent required. For example, a person walking in a public park who trips and rolls down a hill will not be liable for trespass just because the bottom of the hill is on private land. A licensee can mean the holder of a license or, in U.S. tort law, a licensee is a person who is on the property of another, despite the fact that the property is not open to the general public, because the owner of the property has allowed the licensee to enter. The status of a visitor as a licensee (as opposed to a trespasser or an invitee) defines the legal rights of the visitor if they are injured due to the negligence of the property possessor (not necessarily the owner). Where licensees are present, activities conducted on the land by or at the behest of the owner of the land must be conducted with the care that a prudent person would show. A duty to warn arises if there is a harmful condition on the land that is hidden from the licensee, so long as the landowner knows of this condition. The licensee falls between the anticipated or discovered trespasser and the invitee on the sliding scale of tort liability assessed to landowners. Whereas the anticipated trespasser needs to be protected from known man made conditions capable of causing death or serious injury, the licensee must be warned of all known dangers. However, unlike an invitee, a licensee has no standing to sue for dangerous conditions that "should have been" discovered by the property owner but were not actually known to the owner. In the law of torts, an invitee is a person who is invited to land by the possessor of the land as a member of the public or one who enters the land of another for the purpose of business dealings with the possessor of the land. The status of a visitor as an invitee (as opposed to a trespasser or a licensee) defines the legal rights of the visitor if they are injured due to the negligence of the property owner. There are generally two types of invitees for example, Business Invitee and Public Invitee. Business Invitee is a person who enters business property to do business with the land occupier. Public Invitee is a person who enters land in the possession of another for the purpose for which the property is held open to the public, even if no business purpose is involved. Even if "invited" onto somebody's premises, a social guest is classified as a licensee. The property owner has a duty to make the property safe for the invitee, which includes conducting a reasonable inspection of the premises to uncover hidden dangers. The property owner also has a duty to warn the invitee of hazardous conditions that cannot be fixed. Furthermore, property owners assume a duty to rescue an invitee who falls into peril while visiting the property. If an independent contractor hired by the landowner injures an invitee (intentionally or through negligence), the owner can be held vicariously liable. Lise Betteridge, Andrew Charnock, and Nancy Spector discuss social media policies and regulating licensees' use of social media. The theme that arose from the conversation is "the changing times," as the speakers consider why it's important to develop a social media policy or guidelines, protecting privacy and confidentiality, and guiding licensees to make the link between standards of practice and their professional judgment around social media use. "Avanci will later this year launch the 5G patent program with a predicted aggregate royalty for 2G, 3G, 4G and 5G in the low $20 numbers." Matthias Schneider has been Chief Licensing Officer (patents) at Audi AG until end of 2021 and has held positions like Vice President for IPR at Siemens Communication Devices and BenQ Mobile, and Global Head of Defensive Licensing at Nokia Corp before that. Matthias knows both sides of the table working for telecommunication companies and for the automotive OEM Audi for several years. He joined Audi to negotiate important SEP licensing deals and was one of the first to negotiate a contract with the license program of Avanci for Audi where some provisions of this contract are still used across the whole automotive sector. However, the price will depend on having most of the major SEP holders join Avanci so that the coverage of 5G SEPs is high enough to justify the price. Matthias believes the problem was that the automotive suppliers did take royalty payments for 2G, 3G and 4G SEPs into account when negotiating the supplier contract years ago, even signing indemnification clauses. Now OEM and the suppliers must negotiate who will pay the royalties and margins in the automotive supply chain are very low. Interestingly, in the past only the high-end brands have joined which may make sense given that royalties for a Fiat are at $15 the same as royalties for a Ferrari. The marginal costs of $15 are therefore much more relevant for certain automotive OEMs. Matthias however points out that it must depend on where in the car the patented technology, in this case the standard, creates value. Is the value higher for expensive cars compared to for cheaper cars? Matthias believes there is no reason why the $15 should not also be applicable to a small low-priced car such as a Fiat or Polo.So where to license in the value chain? Well, Matthias points out that it is almost impossible to understand where the patented technology creates value when you go to the chipset manufacturer level. Here no one will know where the chip may end up because tracing chips through the supply chain is almost impossible and therefore the patent owner cannot verify if certain end products contain licensed chips. But as soon as you e.g. have (in the cellular communicate space) space an International Mobile Equipment Identifier (IMEI) number, the network access component and its license status become traceable. Therefore, licensing on the level of the manufacturer of a network access device (and afterward) is possible. A SEP license for tier 1 suppliers is thus possible and Matthias also sees increasing willingness from SEP holders to go up at least one level in the value chain with their SEP license offers. Finally, Matthias comments on the challenge that local courts establish global portfolio FRAND rates even if they set lower rates for certain jurisdictions (e.g. China) compared to Europe and the US. Licensees often prefer to negotiate and potentially litigate on individual patents in single jurisdictions. He believes that courts such as the UK court set a global FRAND rate for SEP portfolios are stepping a bit out of their comfort zone and he would prefer a WIPO-based arbitration body for FRAND rates. How that is managed remains to be seen. Matthias' take on 5G and SEP licensing for the IoT is that this will have to work very differently as the royalty income per IoT device manufacturer is expected not as high as for smartphone manufacturers. Even the automotive market is far less lucrative than the handset market, because the number of cars sold globally is only around 7% of the number of smartphones. The main target market for SEP owners thus will remain the handset manufacturers.“The litigation situation is not as bad as many people believe it is. 90% of deals are done without litigation and I am not worried that this will change.”

GB2RS NEWS Sunday the 7th of March 2021 The news headlines: 350 days of Covid-19 net Ofcom EMF Notification news NHS lauds Get on the air to care On Thursday the 4th of March, Hambleton ARS passed the 350th consecutive day of a daily net on 2m. It started on day one of the 2020 Covid-19 lockdown. Its aim was to keep members and amateurs in the area in touch and able to summon help or assistance if required. The net starts at 11 am on the calling frequency and usually moves to S18 if clear. The net is now looking forward to a full year of operating, which occurs on the 18th of March. All amateurs are invited to join and topics are wide and varied. So far, over 70 different stations have called in. A Cabin Fever award is available for any station taking part. It’s issued by Tim, G0TYM via email, see QRZ.com for details. On the 1st of March, Ofcom published a General Notification on their website that proposes to vary all amateur radio licences. It requires licensees to comply with the ICNIRP general public limits of EMF. Licensees have until the 18th of April to make any representations to Ofcom. They have also informed us that they are contacting all licensees, either via email or letter, to make them aware of this process. More information on the variation process and EMF conditions can be found on both the Ofcom website at ofcom.org.uk/emf, or the RSGB website at rsgb.org/emf. A report about the hugely successful RSGB and NHS 'Get on the air to care' campaign has been publicised in a blog on the NHS Networks website this week. The RSGB has committed to keeping 'Get on the air to care' running as long as the restrictions exist. The aim is to support radio amateurs and to share the benefits of amateur radio with the general public. The Society is about to launch several new initiatives and resources as part of the campaign. Have you given your views in the RSGB’s consultation on a proposed new, Direct to Full licence exam? Over 1,000 people have responded already so make sure your voice is heard by completing the Society’s survey. The consultation closes on Sunday the 14th of March. Japanese billionaire Yusaku Maezawa is inviting eight members of the public to join him on a trip around the Moon. The journey, planned for 2023, will be the first civilian mission to the Moon, not to mention the first human visit for over 50 years. According to his website, dearmoon.earth, anyone can apply, and the trip will be financed entirely by Maezawa. There is no word about whether amateur radio operation will be possible on the flight, but it is an interesting possibility. Sadly, another rally has been cancelled as a result of the Covid-19 pandemic. The Dartmoor Radio Rally, planned for Monday the 3rd of May Bank Holiday, will not take place this year. US Army researchers have built a so-called quantum sensor. It can analyse the full RF spectrum and real-world signals, a report on Physics.org says. The quantum sensor can sample the RF spectrum from 0 to 20GHz and is able to detect AM and FM radio signals, as well as Bluetooth, Wi-Fi, and other RF communication protocols. The peer-reviewed Physical Review Applied published the researchers’ findings. Now the DX news Bill, K9HZ Dan, W0CN and Kyle, WA4PGM will be active from St Lucia operating as J68HZ, CN and PG respectively. They will be there until the 11th of March. GB2VAX will be operational from the QTH of Andy, G4ISN of the Welland Valley ARS, from the 1st to the 28th of March. Modes will be SSB / FT4 / FT8 on HF bands. The RSGB strongly advises obeying your national and local government’s advice. This weekend it’s the ARRL International DX Contest. It runs for 48 hours until 2359UTC today, the 7th. Using SSB on the 1.8 to 28MHz contest bands, the exchange is signal report and transmit power. American stations will also exchange their State, and Canadian stations their Province. The 144/432MHz contest also takes place this weekend. Its 24-hour run ends at 1400UTC today, the 7th. All modes are permitted. The exchange is signal report, serial number and locator. Today, Sunday the 7th, the UK Microwave Group Low Band Contest runs from 1000 to 1600UTC. Using the 1.3 to 3.4GHz bands, the exchange is signal report, serial number and locator. The Worked All Britain 3.5MHz phone contest takes place today, the 7th from 1800 to 2200UTC. The exchange is signal report, serial number and WAB square. Entries should be with the QSL manager by the 17th of March. Due to Covid-19 restrictions, there will be no mobile or portable categories, and entries will not be accepted from mobile or portable stations. However, there will be a club category, with members operating from their home QTH. On Tuesday the 432MHz FM Activity Contest runs from 1900 to 1955UTC. It is followed by the all-mode Activity Contest from 2000 to 2230UTC. The exchange for both is signal report, serial number and locator. On Wednesday it’s the CW leg of the 80m Club Championships from 2000 to 2130UTC. The exchange is signal report and serial number. Thursday sees the 50MHz UK Activity Contest take place from 2000 to 2230UTC. Using all modes, the exchange is signal report, serial number and locator. Next weekend the longest-running RSGB contest takes place. The Commonwealth Contest runs from 1000UTC on the 13th to 1000UTC on the 14th. It’s CW only and runs on the 3.5 to 28MHz contest bands. The exchange is signal report and serial number. HQ stations around the world will also send the letters HQ. Next Sunday, the 14th, the second 70MHz Cumulative Contest runs from 1000UTC to 1200UTC. Using all modes, the exchange is signal report, serial number and locator. Now the radio propagation report, compiled by G0KYA, G3YLA & G4BAO on Friday the 5th of March. We had another week of geomagnetic disturbances due to high-speed solar wind streams. Although the week started well, with a Kp index of zero to three on Sunday, it went rapidly downhill. Monday saw the Kp index hit six and Tuesday evening saw it hit five after the solar wind speed exceeded 600km per second. The strongly-negative Bz field of the solar wind meant it coupled more easily with the Earth’s magnetic field – and plasma flooded in. It was not all bad news for HF propagation though. Earlier on Tuesday, the 17m band was open simultaneously to the Far East and the Caribbean via FT8. You were able to work both South Korea and Saint Lucia at the same time, which felt novel. This may have been a pre-auroral enhancement. But by Wednesday, with the Kp index at five, conditions had taken a hit. Maximum usable frequencies were struggling to get up above 14MHz, at least in the morning. There has been little to talk about regarding sunspots. We’ve had two groups, 2806 and 2807, but they have been relatively small, generating a solar flux index of 74 and a sunspot number of 30 on Thursday. As such, HF propagation has generally been a little lacklustre, other than the event noted earlier. Next week NOAA predicts the solar flux index will be in the range 70-76. We should start the week with a relatively quiet geomagnetic field and a maximum Kp index of two. But by Friday the 12th, the Kp index is predicted to rise to four due to returning coronal hole activity. As we head towards the Spring equinox we may expect geomagnetic disturbances to increase, due to the Russell-McPherron effect. The tilt of the Earth’s axis means the Sun and Earth’s geomagnetic field and solar winds all come into alignment and therefore encourage an enhanced chance of the particles emitted from the Sun entering our atmosphere. Fingers crossed that we have better HF conditions for the Commonwealth Contest, which takes place across next weekend, the 13th and 14th. And now the VHF and up propagation news. Good to see the return of some tropospheric propagation last week. It certainly perked up the 144MHz UK Activity Contest last Tuesday evening. All is set to change in the coming week though, so make the most of any lingering Tropo this weekend. The high will decline early next week, and thereafter, the week offers a succession of fast-moving weather systems crossing the country, bringing rain and, at times, strong southwesterly winds. At the end of the week, the unsettled weather comes more from the northwest, and it will turn colder again and perhaps wintry in the north. Either way, the main terrestrial mode of interest next week to VHF/UHF operators is likely to be predominantly GHz bands rain scatter. We are in an extended period where the lowest EME path losses coincide with low Moon declination. Declination is minimum today and tomorrow so moon visibility windows and peak Moon elevations will be at a minimum. As we passed perigee last Tuesday, path losses will still be low but increasing. The Gamma Normids meteor shower is just starting, peaking on Sunday the 14th of March with a Zenithal Hourly Rate of six and lasting until the 23rd. Nothing special, so pre-dawn continues to be the best time for random meteor scatter contacts. And that’s all from the propagation team this week.

In the law of tort, property, and criminal law a trespasser is a person who commits the act of trespassing on a property, that is, without the permission of the owner. Being present on land as a trespasser thereto creates liability in the trespasser, so long as the trespass is intentional. At the same time, the status of a visitor as a trespasser (as opposed to an invitee or a licensee) defines the legal rights of the visitor if they are injured due to the negligence of the property owner. A licensee can mean the holder of a license or, in U.S. tort law, a licensee is a person who is on the property of another, despite the fact that the property is not open to the general public, because the owner of the property has allowed the licensee to enter. The status of a visitor as a licensee (as opposed to a trespasser or an invitee) defines the legal rights of the visitor if they are injured due to the negligence of the property possessor (not necessarily the owner). In the law of torts, an invitee is a person who is invited to land by the possessor of the land as a member of the public or one who enters the land of another for the purpose of business dealings with the possessor of the land. The status of a visitor as an invitee (as opposed to a trespasser or a licensee) defines the legal rights of the visitor if they are injured due to the negligence of the property owner. The attractive nuisance doctrine applies to the law of torts in some jurisdictions. It states that a landowner may be held liable for injuries to children trespassing on the land if the injury is caused by an object on the land that is likely to attract children. The doctrine is designed to protect children who are unable to appreciate the risk posed by the object, by imposing a liability on the landowner. The doctrine has been applied to hold landowners liable for injuries caused by abandoned cars, piles of lumber or sand, trampolines, and swimming pools. However, it can be applied to virtually anything on the property of the landowner. There is no set cutoff point that defines youth. The courts will evaluate each "child" on a case-by-case basis to see if the "child" qualifies as a youth. If it is determined that the child was able to understand and appreciate the hazard, the doctrine of attractive nuisance will not likely apply. Under the old common law, the plaintiff (either the child, or a parent suing on the child's behalf) had to show that it was the hazardous condition itself which lured the child onto the landowner's property. The Great American Beer Festival, the BA’s largest consumer-facing event and the largest beer festival and competition in the U.S., is still slated to take place September 24-27 in Denver, Colorado. Popular regional beer festivals have also pulled the plug on their 2020 events, including the Oregon Brewers Festival in Portland, Oregon, Bend Brewfest in Bend, Oregon, and Great Taste of the Midwest in Madison, Wisconsin.Without its annual mid-May Oklahoma Craft Beer Summit — a reliable fundraiser — the Craft Brewers Association of Oklahoma (CBOA) was facing a potential loss of thousands of dollars. How do we make this a beer festival?”The Oklahoma Craft Beer Summit ’20 Quarantine Edition was born and planned in about a week, with the blessing of the Alcoholic Beverage Law Enforcement (ABLE) Commission of Oklahoma, Mossman said.Tickets for the sold-out virtual festival on May 15 came with a plethora of beers to sample and an evening of guided tastings and panel discussions about styles, brewing and the beer industry. Guests purchased tickets that included a kit of 24 beers from breweries across Oklahoma. Kits could be retrieved at designated pickup locations strategically placed across the state, where IDs would be checked against tickets, a provision of the ABLE Commission.With the help of sponsors and “monstrously low overhead,” Mossman said the virtual festival has helped the CBOA raise multiple times more money than a traditional in-person festival.“We’re spending about $3,000 to raise about $50,000, so we’re pretty fortunate,” he said. “This would take us probably three festivals to generate this much revenue. And really, our only real expense as a guild is probably our lobbyists at the Capitol. The race raises funds for the Angel Fund for ALS Research.More than 3,000 runners have signed up, according to director of digital strategy Megan Baker.California ABC Investigation Finds Delivery Apps Allowing Minors to Order AlcoholAn investigation by the California Department of Alcoholic Beverage Control (ABC) found that third-party delivery services are “routinely delivering alcoholic beverages to minors,” according to an industry advisory posted by the regulatory agency and reported on by the the Washington Post and The Verge.The ABC wrote “Most concerning is that minors are routinely able to purchase alcohol through delivery from restaurants,”. “There have been instances in which the licensee’s own employees have done so, but a far greater rate has been evident among third-party delivery services. Licensees are responsible for these unlawful deliveries, and the Department encourages licensees to review the practices of these services and their reliance on them.”The ABC added that it has found that employees of third-party delivery services are “largely” ignoring guidelines setup to prevent the sale of alcohol to minors.In the advisory, the ABC reminded licensees that they are ultimately responsible for the delivery of alcoholic beverages away from their premises, even if those deliveries are made on their behalf by third-party services, and are “subject to arrest and criminal prosecution.” “This is so no matter what assurances the delivery service may have provided to the licensee,” the ABC stated.Idaho-Based Hardware Brewing Company Defies Executive Order, Risks LicenseKendrick, Idaho-based brewpub Hardware Brewing Company is at risk of losing its alcoholic beverage license after reopening in defiance of Gov. Brad Little’s executive order shutting down bars and restaurants, the Lewiston Tribune reported, citing a letter sent to the brewpub by the Idaho State Police.Although Little’s reopening plan would allow Hardware Brewing to open potentially on May 16 as part of a second wave of business reopenings if the state doesn’t record a significant increase in COVID-19 cases, the brewpub reopened to the public on May 1, including Lt. Gov. Janice McGeachin.Hardware co-owners Morgan, Doug and Christine Lohman discussed reopening on Laura Ingraham’s Fox News program Monday night. Let me start with some background and definitions. Of course you know that this is not legal advice!According to RELRA, the Real Estate Licensing and Registration Act of 1980, Chapter 2, the word “agency” is defined as a relationship whereby the broker or licensees in the employ of the broker act as fiduciaries for a consumer of real estate services by the express authority of the consumer of real estate services. The legal definition of agency from merriam-webster.com is “a consensual fiduciary relationship in which one party acts on behalf of and under the control of another in dealing with third parties; the power of one in such a relationship to act on behalf of another.” Dual of course means two. In the NAR Code of Ethics and Standards of Practice, Article 1 requires that REALTORS “protect and promote the interests of their client” and says that this obligation is primary. Further, we have 6 fiduciary duties owed to clients, meaning people with whom we have a formal representation contract. Briefly, the six are obedience, which requires that we obey their lawful instructions, our giving them our undivided loyalty, our disclosing all information concerning the transaction that might affect their decisions, our not revealing their confidential information, our accounting for monies involved in a transaction and using reasonable care and due diligence to protect them from foreseeable risks or harm. In most Real Estate transactions each party has their own exclusive agent making these responsibilities easier to understand although conflicts will still arise. According to the PA Consumer Notice and RELRA, Chapter 2, “dual agency” is defined as occurring when an agent represents both the buyer and seller in the same transaction. In Chapter 6, Duties of Licensees, Section 606d, it states that a licensee may only act as a “dual agent” with the full disclosure and informed consent of both parties to the transaction. Further, it states that an agent may not take any action that is adverse or detrimental to either party's interest. Can you see how this concept may cause a conflict in terms of our properly carrying out our fiduciary duties to both parties in the same transaction? The concept of “dual agency” is inherently complicated when you have two parties trying to do business with each other and perhaps at the expense of the other, meaning that a buyer and seller are not always equally happy with the outcome even though a deed may have transferred from one to the other. A single agent is in the middle of what may well evolve into a “tug-of-war” with either or both sides trying to exert their will on the other party by manipulating the agent. This can happen with two agents as well. This is why many agents question how one agent can properly represent two parties with potentially opposite goals. Some refuse to be “dual agents” even though the practice is perfectly legal in PA. When we represent both parties, how can we make each party's interests primary? Can they be equal? By definition, “dual agency” requires that we adjust our fiduciary duties. Can we obey the lawful instructions of two parties? I think so although there may be some conflict. We may not be able to provide undivided loyalty to more than person unless their combined goals complement each other. Accounting for money would seem easy to accomplish. The two duties that are compromised are disclosure and confidentiality: I cannot disclose to another what one party considers confidential. Frankly, what does confidential even mean? I take it to mean protecting something that could cause harm to another although many people simply demand more privacy than others and want information or details kept private which would n

I respectfully suggest that this is more like “dual agency” than not in terms of its practical application. Most of us will never have an opportunity to confront this and when I discuss it in my classes many agents admit that they never really thought about. Let me explore this. Let's start with my having one buyer interested in a house and assume they have made an offer and heard a “counter-offer” from the seller. It is reasonable to assume that our fiduciary duties preclude us from disclosing their interest, including the amount of their offer, to anyone else (think of the fiduciary duties of loyalty, confidentiality and reasonable care) as well as letting anyone else know how a seller countered their offer as doing that could harm my buyer's position. So, what happens when I either have two buyers interested in the same or similar properties? Let's keep it simple: whether 2 or 200 makes no difference although it gets geometrically more complicated as the number rises. While RELRA may not see this as “dual agency”, I think it in the best interests of all involved to treat it as if it were. Let's look at two general examples. First example. I am working with two buyers, each looking at different price ranges. One is looking up to $200k; the other up to $190k. The $200k buyer makes a $180k offer on a $200k listing which the $190k buyer considered out of their price range. What would happen if I informed the $190k buyer that the $200k seller countered at $195k? From the seller's standpoint, since I have no fiduciary duty to them, I would think they have no recourse for my disclosing their counter-offer although how a seller counters an individual buyer does not establish what they might accept from another and, presumably, it is in the seller's best interests to have

This spring, I launched my Sunday Basket™ Virtual Workshops and I was blown away with their popularity! Not only did their popularity blow me away, but something else really surprised me and that was WHY people were attending my virtual workshops. It wasn’t what I had thought! It wasn’t necessarily to learn what a Sunday Basket™ was, or how to use it, it was more for ACCOUNTABILITY. People were attending because they knew that they’d get the job done… there and then… and feel a lot better for it! This brought me back to 2012 when I ran paper organizing workshops in my home in Cincinnati, Ohio. Similar to the virtual workshops, people usually came to my in-home workshops for accountability and reassurance. Reassurance about their organizing habits and reassurance that it’s okay to get rid of things! In the podcast episode, I share with you a few funny stories about this! The Birth of the Sunday Basket™ Workshop Licensing System I had a light bulb moment. The virtual workshops have many merits and they work, but actually meeting and talking to people in person is much more impactful. So I established the Sunday Basket™ Licensing System, whereby licensees could hold their own Sunday Basket™ Workshops around the country based on lessons and materials that I developed. I’m excited to share that there are currently eleven Sunday Basket™ licensees around the country (actually 10 in the US and 1 in Canada)... and I’m looking for more! Sunday Basket™ licensees hold 90 minute Sunday Basket™ Workshops just like the virtual workshops that I hold, but in the city that they live in and in whatever setting that suits them best... be it at their home, an office, a community center… wherever they see suitable. If you want to join the Sunday Basket™ Licensee team, the next online training sessions will be held during August, 2017. Also included is an online portal of training videos, access to past training, a monthly newsletter with workshop themed ideas, a private Facebook group, and a listing for your business and all of your events on my site, thesundaybasket.com. Making under the poverty line and knowing she couldn't do this alone, Aja Allen set out to find a trusted partner to help make this opportunity a reality.Three years, numerous delays, and Millions later, with the help of a local black-owned startup, Aja finally opened Sixty Four & Hope (La Cienega above the 10Fwy). A dispensary concept explicitly created to build generational wealth for social equity licensees. Aja is the first LGBTQ owner in LA, and one of 21 social equity licensees to open newly "essential" Sixty Four & Hope dispensaries, all at no upfront cost to the licensee."I want Sixty Four & Hope to be a platform to help people from my neighborhood identify and develop their talents. Aja can't believe her day has come, and she didn't spend a dime. Sixty Four & Hope is determined to live their ideals—driving economic parity for people of color. This, coupled with a respect for the plant and culture, opened the door to diverse collaborations that strive for authenticity— Angela Rye, Live Nation's new Cannabis Nation, Alien Labs, and Ball Family Farms. And prominent Black investors, Troy Carter and Marlon Nichols of MaC Venture Capital and Julius “J” Erving III, Executive VP at Sony Music Entertainment, who see their support as a well-spent investment in communities of color.
