UNDP's Financial Centres for Sustainability (FC4S) launched its 1.5° Partnership for Action on Climate Transition (PACT) programme during Finance Day at COP29 today to mobilize financial institutions in supporting Nationally Determined Contributions (NDCs) aligned with the 1.5°C target. In response to the growing urgency of the climate crisis, UNDP's FC4S will work towards driving climate action by mobilizing financial institutions to actively support the development and implementation of NDCs aligned with the 1.5°C target. PACT will work through local financial centres, including FC4S members, by leveraging existing relationships and data to facilitate dialogue between financial institutions and governments. By aligning the strategies of financial institutions with NDC targets, FC4S PACT will reinforce sustainable investment pathways and strengthen national climate action plans. Marcos Neto, UN Assistant Secretary-General and Director of UNDP's Bureau of Policy and Programme Support stated, "With the launch of FC4S 1.5° PACT, we're empowering financial centres to turn ambitious climate commitments into measurable progress. This programme will provide financial institutions with advanced tools and collaborative frameworks essential for impactful and transparent transition finance strategies aligned with national and global climate goals." Core Elements of FC4S PACT: Transition Finance Review: Providing a comprehensive assessment of the current state of transition finance at the financial centre level. The doctrines of Res Judicata and Collateral Estoppel play pivotal roles in the judiciary system, ensuring the finality of judgments and preventing the re-litigation of cases and issues that have already been decided. These principles are not only foundational for the efficient operation of courts but also protect against the injustice of subjecting parties to multiple lawsuits for the same cause. Res Judicata (Claim Preclusion). Res Judicata, also known as claim preclusion, refers to the legal doctrine which bars parties from re-litigating a case that has already been judged on its merits by a competent court. Its application is fundamental to the concept of judicial finality and serves to conserve judicial resources, respect court judgments, and protect litigants from the burden of multiple lawsuits. Core Elements of Res Judicata. Final Judgment on the Merits: For Res Judicata to apply, there must first be a final judgment on the merits of the case. Preliminary rulings or decisions that do not address the substantive issues of the case do not trigger Res Judicata. Same Parties or Their Privies: The doctrine applies to the parties involved in the original lawsuit or their legal successors. This element ensures that only those who were part of the initial judgment are bound by its results. Same Claim or Cause of Action: Res Judicata prevents the litigation of all claims that were brought or could have been brought in the initial lawsuit. This encompasses all rights to relief arising from the same transaction or occurrence, regardless of whether they were presented in the first case. The Effect of Claim Preclusion. When applied, Res Judicata renders a previous judgment absolute and conclusive on the parties involved, barring any future lawsuit on the same claim. This principle not only applies to the substantive issues that were actually decided but also to every other matter that the parties might have raised in the first action. Collateral Estoppel (Issue Preclusion). Collateral Estoppel, known as issue preclusion, prevents the re-litigation of factual or legal issues that were already decided in a previous lawsuit between the same parties. Unlike Res Judicata, which is concerned with claims, Collateral Estoppel focuses on issues. Key Requirements for Collateral Estoppel. Identical Issue: The issue sought to be precluded must be the same as the one involved in the prior action. This means the specific question or element must have been litigated and decided previously. Previously Adjudicated: The issue must have been actually litigated and determined in a prior lawsuit. This requires that the parties had a full and fair opportunity to argue the issue. Necessary to the Judgment: The determination of the issue must have been essential to the final judgment in the first action. If the issue was incidental or not determinative, Collateral Estoppel does not apply. Mutuality: Traditionally, issue preclusion required mutuality, meaning only parties to the previous lawsuit could use or be bound by the determination. However, many jurisdictions have moved towards a more flexible approach, allowing non-parties to benefit from issue preclusion under certain circumstances, such as in cases of non-mutual defensive Collateral Estoppel. Impact and Application. Collateral Estoppel serves to streamline litigation by eliminating the need to reprove facts or legal issues that have already been resolved. It enhances judicial efficiency and consistency by acknowledging the binding nature of prior adjudications on specific matters. Differences Between Res Judicata and Collateral Estoppel. While both doctrines aim to prevent redundant litigation, they operate on different levels. Three core elements of mindfulness is the topic of today's episode. At its simplest level, to be mindful is to pay attention on purpose. To be aware, to breathe, to be still, and to observe. Mindfulness is also to experience what is happening in this very moment in time. Mindfulness is to accept without judgment the thoughts and emotions you experience. Listen & Subscribe on: iTunes / Stitcher / Podbean / Overcast / Spotify 1/ Being Present Mindfulness is about being fully present and aware of what's happening right now. It's like focusing on the present moment on purpose. By doing this, you can learn more about yourself, your thoughts, and your biases. Instead of dwelling on the past or constantly thinking about the future, mindfulness helps us stay in the “now.” When you practice mindfulness, you pay attention to what you're doing or feeling at the moment. This can be as simple as focusing on your breathing. For example, you can say to yourself, “I am breathing in, I am breathing out” as you take slow breaths. By doing this, you become more aware of your thoughts and feelings without getting lost in worries or regrets. Mindfulness can help reduce stress and negative emotions like anxiety and sadness. It's like taking a break from our usual worries and being more present with ourselves and the world around us. You can practice mindfulness through meditation, yoga, or even by doing one thing at a time and giving it your full attention. For instance, right now, I'm writing this without any distractions, like meetings or emails. It's a simple idea, but it can make a big difference in how we feel and understand ourselves. So, focus on the present moment and give it your energy and attention because it's the only moment that truly matters. 2/ Acceptance Mindfulness means accepting things as they are and being open to whatever may come. It's not just about focusing on the present moment; there's also an attitude that goes along with it. This attitude is described as being open, accepting, and curious. To practice mindfulness, people learn to sit quietly and pay attention to what's happening inside them at any given moment. The goal is to let thoughts and emotions flow naturally without trying to control or judge everything that happens. This can be hard for beginners and even experienced practitioners can find it challenging to stay accepting and open for long periods. In our culture, we're often taught that some thoughts and emotions are better than others, and we should try to stop our thoughts or change our emotions. But mindfulness encourages acceptance and openness, which can lead to a sense of stillness. Just being still and observing without trying to change anything might feel strange or uncomfortable, but that's the idea – to simply “be” in the moment. When we're still, thoughts and emotions come and go quickly or slowly, and they can change without us trying to make them change. Becoming aware of these patterns inside us and being curious about them is an important first step in practicing mindfulness. In addition to being present and having the right attitude, there are three more elements of mindfulness that we'll be discussing in this book. These elements help capture the true spirit and essence of mindfulness, and they're important for applying mindfulness in sports and other areas of life. 3/ Being Non-Judgmental Mindfulness includes an important aspect called “Nonjudging,” which means not judging or labeling our thoughts and emotions. In many cognitive behavioral techniques, there is a tendency to judge and label our thoughts and feelings, but mindfulness encourages us to take a different approach. Imagine you're sitting by a river, and your thoughts and emotions are like things floating down the river. Instead of getting caught up in each thought or emotion, you can observe them from a distance. This helps us realize that not all our thoughts are rational, and some emotions aren't connected to what's happening right now. We don't have to believe everything our mind tells us. For example, if athletes often feel anxious about their performance, they might label themselves as “chokers” or “head cases.” Mindfulness can teach them to see that anxiety comes and goes, and it doesn't define who they are. It's the same with feelings like grief or depression; they are part of our experience but don't define us. Having a nonjudgmental attitude allows us to accept the present moment as it is, without categorizing everything as good or bad. It gives us the space to linger in the present and fully experience it without constantly judging and evaluating everything. In mindfulness, the first step is getting to the present moment, but the nonjudging attitude is what allows us to accept and appreciate it fully. By observing our thoughts and emotions from a safe distance, we can better understand our internal patterns and have a more meaningful experience in the present moment. Don't. Be. Boring. Every time you talk to a new client, in the back of your mind, you know you're not the first person to ever pitch to them. You might not even be the first person to pitch to them that day. You need to stand out, and more importantly, be remembered. They talk about the core elements of an amazing pitch, and how to make sure you're not making the same mistakes as everybody else. Jewett's Background Started in account management, with clients like Blue Cross Blue Shield and NinetyNine Restaurants Now works with AMP Agency, overseeing business development and reaching out to potential clients Most Common Pitching Mistakes - and How to Fix Them Don't jump into your pitch immediately, placing the focus on you and your product. Do your homework so that you know your client, ask them questions, and place the focus on them. Don't recite all your great ideas or figures one after the other in a list. Your client won't remember them all! Instead, take them on a journey with a narrative thread. 3 Core Elements of a GREAT Pitch Make the client the main character. It's not about you, or your product. Your client is the hero of the story. Build a profile around who that customer is based on your research. Then, use this to address their needs and aspirations when you make your pitch. Take them on a journey. A story has a beginning, middle, and end. Have one main idea, or “hook” that will be the big takeaway from your pitch meeting. Build to your hook, share what it is, and make sure it threads all the way through. Use a little showmanship. If you recite too many facts and figures, you will put your clients to sleep. Bring your personality, fun, AND facts. Even virtual pitches can have creative elements that help clients remember them. “Look at how storytelling is done, not just in other industries, but even in literature.
