The latest earnings call from Lowe's Companies Inc delivered both expected results and engaged in some surprise revelations. CEO, Marvin Ellison, spoke candidly with investors on the call, acknowledging a larger-than-anticipated dip in consumer spending on non-essential do-it-yourself (DIY) products. But despite this downturn, Ellison expressed a distinct sense of optimism in how they have navigated these choppy financial waters. These sentiments echoed the insights shared by Lowe's at the recent Morgan Stanley Global Consumer & Retail Conference, offering investors and industry analysts a glimpse into the company's forward-thinking strategy and vision. Further, the company's foray into the pro business segment was hailed by Ellison as a notable feat. The executive shared that Lowe's had managed to augment its market share from 18% to over 25%, showing a favourable trend of sales growth within the past three quarters in the pro segment. However, it's not all upward progress. Lowe's acknowledged to investors a steeper-than-predicted reduction in DIY customer spending. While financial indicators such as demand for pro business services and rising operating margins provided a degree of respite, this consumer pullback underlines a clear setback. To offset these challenges, Lowe's has been experimenting with a multitude of strategies. Most notably, their Total Home strategy - aimed at pro customers, refining product choices, launching online installation services, and a more localised approach. Activities like investment in IT infrastructure and supply chain enhancements not only improved productivity but also streamlined delivery to job sites. Furthermore, loyalty and CRM programs are demonstrating measurable growth in the pro segment. As we look to the future, Lowe's has reaffirmed its commitment to keep pushing the Total Home strategy forward, hoping to maintain the upward trajectory in the pro segment. The company aims to boost productivity via further enhancements in IT, supply chain, and digital infrastructure. They also plan to uplift the in-store experience and customer service levels. Recognising the potential short-term hurdles, Lowe's remains steadfast in achieving its long-term objectives, including operating margin targets, capital allocation, and value creation for shareholders. As we saw last year with the Suez Canal sideways ship block, a supply chain disruption can have a ripple effect across different industries that can linger for quite some time. As continuity professionals, we need to be constantly planning for possible disruptions. In order words, how critical are your products? The more critical your product is to the public, the more planned and thought out your continuity plan should be. – Talk to your suppliers about their continuity plans. If their plan is that the government will not let this happen, gently push back on them to come up with another plan. – Consider asking these questions when talking to your suppliers. What are your supply chains? How far away are your direct material suppliers? How many people do you have in a certain region? How many facilities do you have if this facility goes down? Develop a transformational statement of where the business currently stands and where they would like to be in the future. Look at the culture and big picture of an organization and make sure your business continuity program matches that culture. Make sure your purpose is in alignment with what they want. What they say is not always what they want. For example, they may say they want a business resilience plan, when in fact, they want a compliance program. Scope and order. Scope needs to be clearly defined in terms of what comes first and what comes afterwards. Prioritize your timeline and then you'll know where and how to proceed. If, as a CEO, you cannot find the words yourself, you have some work to do. There's a difference between duty of care and duty to care. Duty of care is just a set of procedures to make sure you're compliant in responding to a disaster. Duty to care means you approach your work with compassion and any other core values that are important to your company. Part of our role is to overcommunicate, especially in a world where people are used to instant access to news and information. If we don't tell people what's happening as it's happening, they will take it upon themselves to find out. Some key takeaways from this episode are: - Dynamic risks are what happen when Risk A becomes Risk B. A lot of the disaster plans we have are curated for disasters happening in isolation, but sometimes disasters stack up. How are you preparing for second or third order risks in your plans? - Civil unrest can lead you to need to make decisions not just on government sanctions, but on personal sanctions. The Russia-Ukraine conflict has caused a lot of global companies to question if they should pull out of Russia if that's applicable to them. - Sometimes Risk B is completely unrelated to Risk A. Meaning, you're prepared for one disaster or scenario but then a completely different scenario happens. This demonstrates a need for awareness of all risks in an area including social, political, and geographic risks. - Supply chains are extremely fragile, and we're all becoming more aware of that as we're personally and professionally impacted by supply chain disruptions. So many things, including government action, severe weather, protests, material shortages, and staffing can affect supply chains. It's crucial to monitor supply chain risks at all times to keep operations going. Citizens need a way to provide feedback that's accessible and easy to contribute. It's not about getting any businesses to open in your community, it's about getting the right businesses to open in your community. There should be support and infrastructure for both large and small businesses to succeed. Communities need to invest in corridors of opportunity. That means supporting citizens who have contributed to the growth of a community who have not had an opportunity to benefit from that growth. Private sectors have an opportunity to support community resilience by providing things like computers to underserved groups within the community. Following the prominent events of early 2020, as part of what's often referred to as a national, racial reckoning, countless institutions altered their policies. Large publicly traded corporations (including Coca-Cola Company, Novartis AG, McDonald's Corporation, Starbucks Coffee Company, Lowe's Companies, Inc., NASDAQ, Inc., and much of the financial services industry) rolled out new policies — under banners invoking diversity, equity, and inclusion — concerning matters ranging from their selection of vendors, to hiring and promotions, to election of future directors to (in NASDAQ's case) willingness to list customers at all. Those policies have raised concern among some over their potential violation of civil rights law (both state and federal), including Dan Morenoff, the Executive Director of the American Civil Rights Project. Do officers and directors of publicly traded companies advancing these policies run afoul of existing corporate law, with possible personal liability for breaches of fiduciary duty and for their use of corporate resources pursuing ultra vires actions? Citing the related concerns of shareholders, the ACR Project demanded the public retraction of such policies by Coke last year — Coke acceded in all but name in March, declaring that the policies at issue “have not been and are not policy of the company[.]” The ACR Project has since made demands on behalf of shareholders to the officers and directo rs of Lowe's, Novartis, McDonald's, and Starbucks. America First Legal appears to have taken a related tack this week in publicly demanding on behalf of shareholders that the Walt Disney Company's officers and directors launch investigations into alleged violations of employee's civil rights. Vanessa and Jeff chat about what organizations need to think about in terms of data centers and other infrastructure to make sure their data remains secure. Jeff points out that the considerations for citing data centers can be divided into two buckets—physical/infrastructure and data/virtual—and shares the key considerations for each one. Episode 79: Understanding Ransomware Vanessa is joined by Brian Kirk, director of cybersecurity for Elliott Davis, LLC, a Southeast-based accounting and consulting firm. The subject is ransomware, specifically ransomware, as it impacts small businesses. Ransomware attacks on companies with 100 or fewer employees get little publicity, says Vanessa, and most small business owners underestimate the danger. Brian explains that fully half of the ransomware attacks are against small companies. Brian and Vanessa make the following additional points: • Small business owners should not assume their managed IT service providers will protect them from ransomware attacks or give assistance if attacks occur. • Small businesses are strongly advised to set up offsite data backups, implement audit logging, purchase cyber insurance, and devise an incident response plan. • Obscurity does not equal security. Cybercriminals are proficient at finding vulnerable companies, even ones with few employees and a low profile. Vanessa also points out that small businesses provide most jobs in America and make up the supply chain for the Fortune 500 companies. Brian shares the bizarre story of a doctor's office that was hacked and—after paying the ransom—was coached on how to recover its files by a help desk person working for the hacker. Episode 76: This week Vanessa talks with Justin Pierce, emergency management director at Los Angeles World Airports in L.A., about the challenges involved in finding the right people to fill positions in emergency management. Earlier this year, Justin published an article on his LinkedIn page called “Coffee Shop Thinking: Hiring the Next Emergency Managers.” Vanessa loved the article, and this was the starting point for their conversation. Justin said he was motivated to enter emergency management by the attacks of 9/11. Vanessa interviewed him about some of the issues surrounding hiring new people for emergency management positions that he discussed in his article. • When hiring someone to fill a vacancy, Justin said agencies should not seek to duplicate the skillset of the departing person but instead look for someone who can help them meet their most important goals of the next three to five years. • When he interviews job candidates, Justin looks for the intangibles of critical thinking, problem-solving, and a willingness to take the initiative. • For people trying to get started in emergency management, Justin suggests they get their foot in the door by joining a disaster aid organization, taking a free FEMA Independent Study (I.S.) course, or talking to their local fire or police chief. Rick lays out his seven deadly sins of crisis management exercises. The sins are mistakes organizations commonly make in preparing for and conducting exercises to demonstrate their readiness to respond to a disaster. Vanessa draws Rick out on the details and asks what organizations can do to avoid committing the seven sins. Episode 74: After-Action Reports and the Blameless Postmortem Concept This week on the podcast Vanessa explores a new approach to an old tool with Justin Kates, the head of the Nashua (NH) Emergency Management Agency and president of the International Association of Emergency Managers, Region 1. The tool under discussion is the After-Action Report (AAR). Justin explains that in the past few years a new approach in preparing these reports has arisen as an alternative to the old approach, which was heavy on finger-pointing. He and Vanessa make the following key points: • The blameless postmortem concept, which was pioneered in the tech sector by companies like Google and Microsoft, encourages openness by putting the focus on improving things for the future. • A critical part of conducting a blameless postmortem is identifying the root cause of the emergency, something many emergency managers neglect to do. • Justin's agency in New Hampshire has adopted the new approach as have many other emergency management agencies nationwide. • Two things an organization can do to determine if the blameless postmortem is right for them are: getting better at root-cause analysis and reading some of the resources on the concept prepared by Google and other organizations that are available for free on the Internet. US equity markets settled higher despite a stumble into the close of the session amid reports that several senators may be putting forward some last minute opposition that threatens to slow the passage of a bill proposing a US$2 trillion fiscal stimulus package agreed between White House lawmakers - Dow up +495-points or +2.39%, with Boeing Co (up +24%) the leading index constituent and taking the aerospace giant's gains to almost 70% Vin the past three sessions. Nike Inc (+9.2%) was also among the leading performers in the wake of their strong result after the closing bell of Tuesday's (24 March). At its session high the Dow was up more than >6%. Nonetheless the index built on its biggest one day percentage gain since 1933 (+11.37%) and biggest one-day points increase (+2,113) ever recorded a day earlier, The broader S&P500 gained +1.15%, having traded over >5% higher earlier in the session and building on the previous session's 9.38% advance (and best one day gain since October 2008). Industrials (up +5.29%), Real Estate (+4.50%) and Energy (+4.49%) lead eight of the eleven primary sectors higher. Communication Services (down -1.58%) was the worst performing sector. Home improvement retailer Lowe's Companies (+8.31%) said it will hire 30,000 new workers and committed $100 million "to support the emerging needs" of employees, customers and communities amid the coronavirus pandemic. Both the Dow and S&P 500 logged their first back-to-back gains in seven weeks. Indeed, the Dow has logged its best two gain (2,608-points or +13.67%) since 1987. The technology-centric NASDAQ eased -0.47%, with all of the FAANG complex (Facebook Inc down -3.0%, Amazon.com Inc -2.80%, Apple Inc -0.55%, Netflix Inc -4.18% and Google parent Alphabet Inc -2.82%) closing in the red.

Today's show features Ben Pearlman, Head of State Government Affairs, Northern Region for Lowe's Companies, Inc., where he manages operations in over 25 states. Lowe's started as a small local store, growing to a Fortune 40 company and national retailer of hardware and home appliances, with 2,200 stores across North America and 300,000 employees. Ben grew up in West Lafayette, Indiana. Ben attended American University for his B.A. and obtained his J.D. at Indiana University School of Law-Indianapolis. Growing up in a political family, he became involved very early, attending monthly gatherings of local and county elected officials where he jokes, he was the youngest person attending by 40 years. During college he interned on the Hill in the Senate, before returning to Indiana to work for the Indiana House Democratic Caucus. He returned to D.C. working in the U.S. House of Representatives before spending time working as a Federal Relations Assistant for Indiana University. He then moved to Massachusetts where he worked as a Legislative Attorney at the state capitol, and later as an Attorney/ Contract Lobbyist for Serlin Haley LLP. Prior to his current role, Ben served as the Senior Manager of Government and Regulatory Affairs at Comcast.   “Especially when looking for jobs and internships in government affairs, any opportunity where you get to meet a lot of people very quickly, that is where I point people to go.”    “This is the most challenging role I have been in because there is no shortage of things to do and there is no shortage of things to learn.” Ben breaks down some of the seemingly complicated jargon that lobbyist often use, and offers insight into some of the common trade associations in the retail industry. Working in government affairs for such a large company, Ben works on a range of issues from labor issues, consumer privacy regulation, to tariffs. Ben recommends, “Before you go into government affairs, I suggest learning the business. If you have an interest in politics and you can learn the business, you will be better off.” With that being said, Ben suggests looking into the internships Lowe's offers out of their corporate office, here.
