What happens when a single company dominates a crucial segment of the financial market? In this episode, Michael Volkov explores the Justice Department's recent antitrust lawsuit against Visa, highlighting allegations of monopolization and exclusionary practices in the debit card market. With Visa controlling over 60% of debit transactions in the U.S., the DOJ aims to restore competition and prevent further stifling of innovation in this vital financial sector. Tune in as Michael breaks down the case details, Visa's strategic responses, and the implications for the broader financial landscape.Listen in as Michael discusses:The DOJ has charged Visa with monopolization and exclusionary conduct under Sections 1 and 2 of the Sherman Act.Visa holds over 60% of the U.S. debit transaction market, with MasterCard as its closest competitor at 25%.The complaint alleges Visa engages in exclusionary agreements that penalize banks and merchants for using alternative debit networks. The 2010 Durbin Amendment aimed to increase competition but has had minimal effect on Visa's dominance, leading to ongoing scrutiny.Visa's strategies include partnering with potential competitors while leveraging significant market power to suppress competition.Following successes in technology sector enforcement, the DOJ is now expanding its scrutiny into financial markets, indicating a potential shift in antitrust enforcement dynamics.ResourcesMichael Volkov on LinkedIn | TwitterThe Volkov Law Group

On March 21, 2024, the United States Department of Justice and sixteen Attorneys General sued Apple, alleging that “Apple undermines apps, products, and services that would otherwise make users less reliant on the iPhone, promote interoperability, and lower costs for consumers and developers.” In other words, many of the DOJ and AGs' allegations boil down to lock in - that is that the features chosen by Apple lock in developers and users to stay in Apple's ecosystem by making it harder to switch or jump between platforms. We discuss the case and the claims advanced, and what it might mean for antitrust enforcement, tech, and consumer experiences. She considers not just your pain problem but also your mindset and social situation to treat YOU the whole person--not just a body part. Dr. Stephanie started her career working in a small private practice in rural Minnesota, where providers were so sparse that people traveled across the region to receive care. Many of these patients were new moms, people with pelvic pain, or women suffering from menopausal symptoms who struggled to find a provider who listened to their concerns and addressed the source of their discomfort. When Dr. Stephanie moved to urban Connecticut, she noticed the same problem: People had difficulty accessing the pelvic floor physical therapy they needed--due to a lack of specialist providers, time constraints, and limitations from insurance companies. These experiences influenced Dr. Stephanie to focus her practice on orthopedics and pelvic floor physical therapy and make it convenient for people to access high-quality care. With MovementX, her physical therapy practice is 100% mobile–she provides care in the comfort of your home, gym, or office. She brings a mobile treatment table and helps you decrease pain, increase strength/mobility, prevent injury, restore function, and coordinate your care plan. In September 2023, the Federal Trade Commission and 17 states filed a massive, landmark antitrust lawsuit against Amazon, alleging that Amazon engaged in anti-competitive and unfair practices to expand and maintain an illegal monopoly in two online markets, the market for marketplace services, where sellers buy services from Amazon, and the consumer-facing market for online superstores. The complaint focuses on two main theories: anti-discounting and tying Prime eligibility to Amazon's fulfillment services. Adam Kovacevich, Founder and CEO of Chamber of Progress, speaks about the potential consequences of this suit for antitrust enforcement, consumers, and other companies. In the latest episode of Second Request, Teddy interviews Bob Lande on the impact of textualism on merger analysis. Bob Lande is Venable Professor of Law Emeritus at the University of Baltimore School of Law and a board member for the American Antitrust Institute who has written about the use of textualism in antitrust enforcement and the way it affects statutory interpretation in a recent article for the Utah Law Review and a presentation to the FTC.Due to its emphasis on “precise language,” Bob argues that rather than leading to more conservative antitrust decision making by the courts, textualism should lead to the exact opposite: “Textualism should lead, if anything, to more aggressive antitrust enforcement….This is because the Sherman Act, the FTC Act and the Clayton Act are all products of the progressive era. It's not surprising that their precise language is very pro-consumer and very anti-monopoly.”Listen to the podcast to hear Teddy and Bob discuss:• Section 7 language• The express efficiencies defense• Monopolization
Many sellers on platforms like Etsy often view competition as a detrimental factor, citing it as the primary reason for underperformance in their shops. As an eternal optimist, I'd like to present a different perspective on this issue. Let's talk about why competition is not just beneficial, but essential, and how it can help you improve your Etsy shop's performance. There is a common belief that Etsy is oversaturated and excessively competitive. This sentiment is frequently used as an explanation for poor shop performance. However, we rarely apply the same logic in our offline lives. So why allow it to hinder us in the virtual world? Reflect upon this: did competition deter you from applying for jobs or colleges? If you participated in sports or joined a band, did the existence of competition make you quit before you even started? Does competition deter you from availing yourself of great sales deals during Black Friday or other sales events? Competition is integral to our culture, particularly in America. It is expected and accepted, rarely causing us to abandon our pursuits or to abstain from trying something new. Therefore, why should the narrative be any different when it comes to starting an online business? Anticipating competition should be part of your business strategy. Let's delve into why competition can be advantageous: 1. **A competitive marketplace is a thriving marketplace.** Strong competition is absent in stagnant markets or in niches that aren't lucrative. The presence of competition implies a robust market. With approximately 5 million sellers to 93 million buyers on Etsy, the market is certainly vibrant. 2. **Competition sustains the market.** The revenue that keeps Etsy thriving is largely due to its competitive nature. A reduction in competition might lead to fewer buyers, making it even more challenging to find success. 3. **Competition guides you towards success.** Familiarize yourself with the top players in your niche; their success stories can offer you valuable lessons. Observe their selling techniques, promotional strategies, pricing, and how they've organized their shops and listings. This information can serve as a roadmap for your own venture. Remember, this doesn't mean directly copying their listings or products, but using their ideas as inspiration for your own unique creations. 4. **Competition helps you stand out through value.** Over time, as your business develops, you can establish customer loyalty and differentiate your shop by offering high-quality products and superior customer service. Many sellers who lack passion or dedication may start to cut corners, creating opportunities for you to excel. 5. **Competition exposes you to what to avoid.** You may observe shops making detrimental decisions or experiencing negative consequences, providing you with insights into mistakes to avoid. 6. **Competition inspires improvement.** It ensures that businesses continuously strive to enhance their offerings for a better consumer experience. Monopolization often leads to complacency and a decline in the quality of the consumer experience. Lastly, I'd like to recommend a tool that can help you analyze your competition more effectively – Alura's shop analyzer, product seeker, or keyword finder. These tools can assist you in identifying the most successful shops and listings. Here is the link to this tool: https://www.handmadeandbeyond.com/alura Embrace competition as an opportunity for growth and improvement. Remember, in a thriving marketplace like Etsy, competition is not just inevitable, but it is a sign of a healthy and prosperous ecosystem.

As traditional investors turn their eyes away from esports, Saudi Arabia is continuing its aggressive acquisition of esports companies. In January 2022, Savvy Gaming Group, a subsidiary of the state-backed Public Investment Fund, acquired independent tournament organizers ESL and FACEIT for $1.5 billion, merging the two competitors into one and forming a super group. Now, just over a year later, that company's purchased Vindex, who are the owners of one of their competitors, Esports Engine. With that acquisition, the Saudi government holds a near monopoly on esports that aren't run by the game developers and publishers. This week on the pod, veteran esports journalist Richard Lewis and Washington Post editor Mikhail Klimentov, who've been covering the stories, joined to discuss the dangers a Saudi-backed monopoly on the esports industry. In March 2022, the U.S. DOJ made headlines with the announcement it is considering bringing criminal monopolization cases under Section 2 of the Sherman Act for the first time in nearly fifty years. But is there any precedent that can help us understand what criminal prosecution of monopolization conduct would look like? Tiffany Rider and James Hunsberger of Axinn join John Roberti and Jaclyn Phillips to walk us through the decades-old case law and lay out the challenges DOJ might face trying to bring these cases under the modern antitrust framework. Listen to this episode to learn about whether the past can tell us anything about what DOJ will do in the future. In this episode of ACC, Prof. Harvey asserts that capital is becoming ever more centralized. The monopolization of power is inevitable in capitalism. However, according to Harvey, there are significant barriers to the continuity of capital accumulation. People are growing dissatisfied with the current economic conditions, a political system does not work for the benefit of the population, and are more and more at odds with the ruling ideas. We have a crisis of ideology, a crisis of economy, a crisis in the environment and a crisis of the future in terms of demographic possibilities.

“I can’t breathe” has become a powerful phrase to symbolize the problem of systemic racism and unchecked prejudiced violence in our country. It’s also a powerful metaphor for the weight of how people feel when it comes to the social, economic, and healthcare inequalities that continue to thrive. And in the age of COVID-19, we keep hearing people say they can’t wait to get back to normal. But if this is what normal has looked like, do we really want it? It’s time for us to get more involved than ever before to create a new normal that includes social justice, civil rights, and compassion. On this episode of The Doctor’s Farmacy, I talked with John Grossenbacher about how to begin this reimagining of America and so much more. [YouTube Video Version: https://youtu.be/09PzRJWinOU] NHS is “picking up the pieces” of an epidemic of mental illness among children, fueled by social media and other addictive online outlets, the head of the service has warned. Simon Stevens urged companies like Google and Facebook to take more responsibility for the pressures they place on children. It follows calls for social media and online gaming firms to have a statutory “duty of care” to protect children from mental ill health, abuse and addictive behavior. And now, the World Health Organization has announced “gaming disorder” as a new mental health condition included in the 11th edition of its International Classification of Diseases, released Monday. The WHO defines a “gaming disorder” as having three major characteristics that experts say are similar to substance-use disorders (drug addiction) and gambling disorder. This episode is a whole lot of fun. I hope that those of you with book dreams still have them by the end of it, because I hysterically laugh talking about so many parts of the my book writing process, that kind of play out like a blooper roll. But Joelle is a master. She knows how to escavate the soul of a book and make you a better writer in the process. If you want to write a book, my number one piece of advice is find an incredibly editor and stay with them from start to finish. This episode is like pulling back the curtain of the whole process from idea to publication. What Joelle Shares: The story of how Kimberly and Joelle met and how Joelle’s role in The Fourth Trimester (spoiler alert: she edited my book proposal which got me a publisher) The most successful writers that Joelle works with are the ones who understand where their book fits in their system and their world What you need to write your first book Why you need a book proposal for yourself and to be able to sell your book- your proposal is your road map What You’ll Hear: When Kimberly tells Joelle to leave her job (6:33) Joelle decides to leave her job at a textbook publishing company (7:30) The process of writing a book proposal and editing A LOT (9:40) Dumpster analogy (10:30) Joelle comes to Rio from New York to walk Kimberly through final steps of completing the book proposal (11:20) How you situate a book in a market and why you need to (15:40) When you are not a writer and you are writing a book (16:15) Knowing how your book fits in the world and your world (17:25) False beliefs about what happens when you write a book and how publishing works (18:35) Monopolization of publishing in the big 5 (25:40) What you need to write a book and the investment (27:45) The dream coming true of writing a book (31:40) Getting out of the coma of individual suffering (33:05) Developing an idea, expressing yourself, and taking the reader on a journey (36:10) Birth of an author (36:20) Romantic relationship with your editor (39:50) Joelle’s loyalty is always to the book and what the book wants to be (40:25) The idea has to be in place and the idea has to be true, and then the structure happens (41:30) Why do you need a book proposal (43:30) What a book proposal includes- its purpose for the author and its purpose for an agent or publisher (45:30) The “Who You Slept With” part of the book proposal (48:30) Writing a proposal that someone wants to buy (52:20) Use your drive to make a difference in the world through your book Joelle’s favorite book project, Happier Now
Professor Peter Carstensen has made anti trust law his specialty, particularly as it pertains to the American Dairy Industry. He explains how a co-op model initiated decades ago to help dairy farmers bargain collectively has become the major impediment to their financial success. Consolidation and monopolization in dairy are very similar to the meat industry. The impacts of that consolidation are examined closely in this episode. What Doesn't Kill You is powered by Simplecast

Nonphysical abuse through psychological and emotional means is an integral component of trafficking and slave-like practices. Hosts Seth Daire and JJ Janflone discuss Seth's unpublished paper on the topic that ties together psychological coercive methods used in trafficking, torture, and domestic abuse. The loss of control and identity that can be a part of trafficking are traumatic. To be controlled to the degree required for slavery and trafficking means that even if there are no rapes, threats or bruises, the person has been abused. To effectively prevent and prosecute sex and labor trafficking, and to effectively assist survivors, we need to better recognize and understand the role of psychological coercion within human trafficking. Biderman’s Framework and Trafficking Survivors Method Trafficker Application 1. Isolation Kept away from family and friends so no social support. Social isolation increased the power imbalance to make victims more dependent. This led to depression and loneliness. 2. Monopolization of Perception Limited exposure to and understanding of the outside world. Monopolized their attention, so felt presence of trafficker when gone. Constantly watched. 3. Induced Debilitation and Exhaustion Deprivation of basic human needs such as food, sleep, and health care. Victims worked day after day for long hours. Some victims were forced to consume drugs or alcohol. 4. Threats Threats of arrest or deportation, and against family members. Threats of violence and death. Fostered anxiety and despair. 5. Occasional indulgences Occasion kindness gave victims positive motivation for compliance, as it provided a reprieve from abuse. As it was unknown when indulgences would be given, this created anxiety to please and not make mistakes in hope of an emotional or material reward. 6. Demonstrating "Omnipotence" and "Omniscience" Traffickers claimed influential connections to law enforcement, immigration officials, or deities. This created paranoia, fear, doubt of their sense of reality, and a sense they did not control their fate. 7. Degradation Insulted, humiliated, denied privacy and dignity. Reduced to basic animal-level concerns. 8. Enforcing Trivial Demands Focused on petty concerns developed habits of compliance to keep them entrenched. Also created a need to be perfect, which led to stress and anxiety, especially since work was debilitating due to lack of sleep, food, and social support. Sources: Patterson, Orlando.
