The Houston Peace & Justice Award was posthumously awarded to three outstanding individuals who were leaders in three different faiths and who worked individually and collectively for more than 50 years to make major strides in social justice and more. They are the “Three Amigos of Houston” — Rev. William A. Lawson, Archbishop Joseph A. Fiorenza, and Rabbi Samuel E. Karff. Accepting the award on their behalf will be family members of Rev. Lawson and Rabbi Karff, and one of the Dominican Sisters for Archbishop Fiorenza. The local Peacemaker Awards were awarded to great activists in our community. Dr. John J. Theis, Director of the Center for Civic Engagement for the Lone Star College System and professor of Political Science on the Kingwood Campus, introduced deliberative forums work to college campuses. Death Row Angels of Houston is a 501(c)(3) non-profit organization founded by Dani Allen and Linda Snyder. Their mission is to provide outreach to offenders and their families as well as to educate the public about the death penalty. Barry Klein is a long-time Houston area activist. In 1969 he was a volunteer with the campaign to set up a Pacifica station in Houston and later became a board member. Circa 1972 he stood on a Houston esplanade in front of an office building holding a homemade sign, saying “Dow Shall Not Kill”. Laisha Harris serves as an Assistant Public Defender at the Harris County Public Defender's Office. She is the author of “A Tale of Two Americas” and “Qualified Immunity: The Court's Brain Child and a License to Kill,” published by The Bridge. This episode corresponds with the Bill of Rights issue of The Houston Lawyer magazine.  It addresses several of the rights in the “bright constellation of rights,” including free speech, bearing arms, protection from unlawful search and seizure, and jury trials. Houston lawyers, academics, and a jury consultant tackle issues associated with these rights. Segments One and Two: Second Amendment Professor Josh Blackman of South Texas College of Law Houston and Professor Martin Levy of Thurgood Marshall School of Law provide different academic perspectives on the historical background of the Second Amendment and recent and upcoming cases that interpret the right and the history related to it.  Segment Three: First Amendment Randy Hiroshige of the Texas Civil Rights project discusses a case involving the First Amendment that is currently being played out in Houston: Food Not Bombs v. City of Houston. It is an ongoing case, and this interview provides the plaintiff's perspective.  The City of Houston did not respond to a request for comment.  BTL Interviewer Rachael Thompson is the interviewer on this segment.Segment Four: Fourth AmendmentLaisha Harris, and Assistant Public Defender in the Felony Trial Division of the Harris County Public Defender's Office, discusses how technology and artificial intelligence impact the rights secured by the Fourth Amendment. Segment Five: Jury Trial Dr. Samantha Holmes of Edge Litigation Consulting, LLC, provides insight into the right to a jury trial from a jury consultant, data scientist, and social psychologist's perspective.  Dr. Holmes also provides some data from her ongoing research relating to the public's perception of our judicial system.  This is the final episode of Season Four of Behind the Lines: The Houston Lawyer Podcast. Assita Toure, Staff Litigation Counsel for Florida. Assita Toure has been practicing since 2019 with prior experience handling casualty, product liability, premises liability, trucking litigation cases and criminal matters. Assita began her career as an Assistant Public Defender for the 13th Circuit Office of the Public Defender's office where she represented adults and juveniles accused of committing misdemeanor and felony offenses. After leaving the Public Defender's office, Assita transitioned to a regional insurance defense firm in Tampa, Florida where she represented corporations and small businesses in claims arising from a variety of trucking accidents including wrongful death actions, vehicle/ pedestrian and multiple vehicle collisions. She also represented businesses against premises liability, auto negligence, product liability and various tort claims. Assita received her B.A. in Political Science (cum laude) from the University of South Florida in 2016 and her J. D. with a dual concentration in Social Justice Advocacy from Stetson College of Law in 2019. On many episodes, Hunter likes to explore how states determine if someone should get a Public Defender and if states make those who get a Public Defender reimburse the state for the costs. In Iowa, the state has decided to narrowly define who is too poor to qualify for a Public Defender while also mandating that people reimburse the state for costs. YORM Ama Abledu is an energy professional and a legal academic who teaches energy law among other modules at the University of Professional Studies, Accra (UPSA Law School). She holds a postgraduate degree in oil and gas law (international investment arbitration) from the University of Aberdeen, Scotland, where her outstanding academic performance won her the Ede & Ravenscroft 2014 Prize for Academic Excellence. Within the same period, Yorm attained certification from the Oil and Gas Academy of Scotland as an oil and gas contract negotiator. Over the past 7 years, she has achieved enormous success in oil and gas cases in Ghana. Yorm has a demonstrated history of championing compliance in oil and gas companies, project management, and legal entity management in the oil and gas and power sectors in Africa. She is a senior international attorney at Centurion Law Group, a pan-African law firm headquartered in Johannesburg with offices and partners across Africa, Europe, and the Middle East, focused on energy and tax law practice. She is also a member of the AIEN (Association of Energy Negotiators, formerly formerly Association of Petroleum Negotiators). A Harvard-certified negotiator, she has significant expertise that cuts across diverse sectors such as project finance, energy, infrastructure development, tax, real estate, and other key practice areas. Yorm has provided advice on a variety of high-profile transactions, both domestically and abroad. She has been on various legal panels as a speaker or moderator and has significantly contributed to very important and topical issues in the energy industry, including the recent panel discussion on the role of the youth as drivers of the advancement of the African energy industry, energy transition, and the empowerment of the African people through the sustainable exploration of natural resources at the just-ended African Energy Week in Cape Town and also the panel on "the Future of Energy in the Carbon Era" organized by the British Ghanaian Lawyer's Union (BGLU) in 2021. Yorm is also certified in human rights and oil and gas law from Fordham University. Her passion for human rights law is reflected in how she has so far won a total of 57 human rights cases on behalf of several indigents over a 12-month period in her position as Assistant Public Defender under the Legal Aid Commission, where she continues her pro-bono service. She is a human rights advocate with a particular interest in the diversity and inclusion of women in the energy sector. Her passion for helping others has led to further voluntary work as the Policy and Advocacy Team Lead of the African Women in Energy Development Initiative (AWEDI), where she advocates for the inclusion of female professionals in the energy sector. She recently received a global honor, the 2022 International Bar Association (IBA) Outstanding Young Lawyer Award, in recognition of her work mentoring the next generation of legal minds, her dedication to professional and ethical standards, and her service to the country at large. It's Midday on the Law. On Monday, Adnan Syed was released from prison and allowed to go home, with a GPS monitor, after 23 years behind bars. His conviction for murdering Hae-Min Lee in 1999 was vacated. He was not exonerated of the crime, although that may happen. Mr. Syed's case was chronicled in the podcast, Serial, and in an HBO documentary series. Mr. Syed remains, at this moment, charged with killing Hae-Min Lee, his high school classmate and former girlfriend. The Baltimore City States Attorney's Office has 28 days to decide whether or not to re-try Mr. Syed. Mr. Syed has always maintained he was not the person who murdered Ms. Lee. Tom's guest today is Erica J. Suter, the director of the Innocence Project Clinic at the University of Baltimore School of Law, and Assistant Public Defender in the Maryland Office of the Public Defender. Ms. Suter is the lawyer for Adnan Syed, and it was her advocacy and the work of Becky Feldman, the Chief of the Sentencing Review Unit in the Baltimore City State's Attorney's Office, that persuaded Baltimore Circuit Court Judge Melissa Phinn to overturn Mr. Syed's conviction. Caitlin Shortell was born and raised in Anchorage. She returned home after earning her law degree at Northeastern University in Boston and worked as an Assistant Public Defender at the Alaska Public Defender Agency (2003); as an Assistant Attorney General at the Alaska Attorney General's Office (2004-2008); and as Human Rights Advocate at the Alaska State Commission for Human Rights (2008-2009). Ms. Shortell, along with two other attorneys, was plaintiff's counsel in Hamby v. Parnell (2014), the case that secured same sex couples the right to marry in Alaska.  Five years after winning the lawsuit that secured equal marriage, Ms. Shortell sued to stop the State of Alaska from a discriminatory practice of denial of PFDs to same sex military spouses and kids stationed out of State in Smith v. Dunleavy (2020). We talk about all of that and the potential undoing of landmark supreme court precedents on today's episode.

Disciplinary Actions are likely the most closely read section of each edition of The Florida Bar News. However, total discipline cases are actually on the decline. According to the Bar's website, in a typical year, the Attorney Consumer Assistance Program (ACAP) receives over 16,000 requests for assistance; and only about 25% of those inquiries result in the opening of a disciplinary file. Zachary Durand is a south Florida native, an aide to the mayor of Fort Lauderdale, a volunteer for local democratic organizations, and an amateur astronomer. His interest in the phenomenon has been lifelong but was significantly elevated in 2017 when the New York Times broke the story of the Pentagon's secret UFO program. He has spoken at a variety of institutions, including NYU and Pace University, and strives to lead by example as a face for a younger generation of public servants. David Fry practices law as an Assistant Public Defender and is a former history teacher with absolutely zero formal training in engineering or physics. That said, much of his legal practice exists among more the nebulous concepts of perspective, bias, and intent -- those pesky human attributes that all so often creep into "knowledge" and obscure what would otherwise be universally observable as "truth." His passions have always been directed toward the unknown, wherever it may exist in time or space, with a particular focus as to how humans develop knowledge about ourselves and the universe in which we exist. Honorable Nancy L. Butts is currently the President Judge of Lycoming County. Judge Butts graduated from Lehigh University and California Western School of Law. She began her career in Lycoming County serving as an Assistant Public Defender with the Lycoming County Public Defender's Office. She next served as the Law Clerk for Judge Clinton W. Smith and after her clerkship joined the practice of Charles A. Szybist, Esq. After about a year in private practice she then became an Assistant District Attorney with the Lycoming County District Attorney's Office. Judge Butts was elected to her first term as Common Pleas Judge in 1995 and was retained both in 2005 and 2015. She completed the General Jurisdiction Course at the National Judicial College with distinction in 1996. She became President Judge in 2010. She currently serves as the Lycoming County Drug Court Judge and has continuously since its formation in 1998. Additionally, she currently presides over DUI Court since 2008. She established the County's Juvenile Drug Court and served as its judge from 2004- 2016. She established and worked with the Lycoming County Mental Health Court from 2008 to 2012 and returned to it in 2018. She also presides over the County's newly created Veteran's Court. As President Judge, she is the Chairman of the County's Criminal Justice Advisory Board (CJAB). She also serves on the CJAB's Substance Abuse and Mental Health Subcommittees. Since 2014 as a member of the Substance abuse subcommittee she considers it her responsibility to increase awareness and education of the public through presentations and community meetings and began that effort through the formation of the Heroin Task Force. She recently completed a training with the National Judicial College on “Drugs in America Today: what Every Judge Needs to Know.” Through her participation on the Reentry Coalition subcommittee she assists with programming and policy governing incarcerated individuals returning back to the community. Judge Butts has represented the Courts on the Lycoming County Prison Board since 1999. In 1998, Judge Butts contributed to the creation of a local American Inn of Court. She was the first President of the Charles F. Greevy, Jr. Chapter of the American Inn of Court and currently serves as its Secretary. Judge Butts was appointed by the Pennsylvania Supreme Court to serve on the Criminal Procedural Rules Committee from 2007-2014. In her last year on the Committee she served as Chairperson. Based upon an initiative from the PA Supreme Court examining the accessibility of the Courts of elder citizens, in 2015, Judge Butts called together an Elder Abuse Task Force to identify resources and examine obstacles which exist between the Courts and access of the Lycoming County Elder population. All future work will be a collaboration between the public, Courts and Lycoming College. Judge Butts is an active member of the community. She has been a member of the Community Theatre League for more than 30 years. She currently serves as Vice President and as member of the Board of Directors. She has been an Emergency Medical Technician for more than 25 years and is a Life Member of Old Lycoming Township Volunteer Fire Company along with a former employee of the Susquehanna Health System. In this episode of May it Displease the Court podcast, your hosts appellate attorney Mary Whiteside and rhetorical scholar Lee Pierce are joined by Erik Teifke, 2nd Assistant Public Defender at the Monroe County Public Defender’s Office. Together, they explore the question: do Black lives matter in the courtroom?While overt racism does exist, the vast majority of unequal racial treatment occurs due to implicit bias, which we all harbor to some degree and usually avoid confronting in ourselves. That individual sense of implicit bias is certainly a problem. But it is REALLY a problem when it invades the courtroom, causing Black and Brown defendants to face harsher consequences than White defendants.Mary and Erik were former co-workers at the Public Defender’s Office and throughout this episode they draw on their experiences handling criminal cases to discuss how the courts regularly fail to acknowledge racial bias. Racial bias can permeate and taint every part of a criminal case, from the evidence collected, to the charges filed, to plea bargaining, sentencing, pre-trial motions, all the way up through trial. Erik explores how the current wave of BLM protests have increased awareness of police misconduct and how the groundswell of public attention and support for racial justice can be used to push for the equal treatment. Erik details the practical ideas and strategies to revamp what it means to zealously advocate for your client. Tiffany Baker is an attorney who has devoted her entire legal career to the community in which she was born and raised — the Big Bend area. Tiffany received her Bachelor of Science degree in Business Administration from the University of Miami in 2007, and her Juris Doctorate degree from Howard University School of Law in 2012. Over the years, she has gained vast legal experience in both criminal and civil law. While starting out as an Assistant Public Defender, Tiffany developed her passion for trial advocacy. Since then, she has tried multiple life felonies to verdict, including attempted first-degree murder, capital sexual battery, and homicide. She has been deemed sufficiently qualified to serve as Second Chair in a death penalty case and in that case, she represented a defendant accused of quadruple homicide. She has represented juveniles, the mentally incapacitated, and has provided pro bono service to help Veterans in the Big Bend Community. Michelle is one of the co-founders and Executive Director of Appetite For Change (AFC), a nonprofit social enterprise organization dedicated to using food as a tool to build health, wealth and social change. AFC works with residents to build strong families and healthy, equitable communities around food. They also own and operate Kindred Kitchen, a shared commercial kitchen incubator and Breaking Bread Café and Catering, a youth social enterprise serving North Minneapolis. Michelle graduated from the University of Pennsylvania with a B.A. in Bioethics and Spanish and earned a J.D. from the University of Minnesota Law School. She worked as an Assistant Public Defender in Miami-Dade County before working for James Beard Award winning Chef Michelle Bernstein as a prep cook, line cook and assistant to the pastry chef. After returning to Minneapolis she co-founded Appetite For Change. She is a dedicated leader, passionate about social and racial justice, and serves on the Board of Directors for Jewish Community Action. In this inspiring episode Michelle discusses how eating healthy is tough for everyone, regardless of age, family status, how much time or money you have.  She then explains how living in a community without farmers markets, healthy retail options, limited grocery store availability and reliable transportation make it so much harder. We talk about how people often think that low-income communities just don't know what healthy is, or care about eating well, but it's often the policies systems, and the environment around us that influences our eating habits. Often times communities lack resources to solve their own health issues, but they don't need to be told what the solutions are, or "saved" by people who live outside their communities. It's more about the resources, social networks and assets in a community that prevent people from achieving their wellness goals. We also discuss how health and wellness means different things for different people, but it's often stereotypes and fears of the unknown that keep us from trying new things. For example: black people aren't vegan, eating "healthy" is a white person thing, you have to have a lot of money to eat fresh and local foods, growing your own food is hard and you can't do it if you don't own your own property, etc. We also hear all all about the foundation, the cafe, catering company, community garden and all the other amazing things her organization is working on - including a super cool rap video "Grow Food." Timothy Golden is from, Philadelphia, Pa. He has served as Professor of Philosophy at Walla Walla University in Washington from 2015 to the present. He is a member of the Speakers Bureau at Humanities and an Actor at the Red Door Project. He is a graduate of the Texas Southern University Thurgood Marshall School of Law, where he served on the editorial board of the Thurgood Marshall Law Review. After law school, he was admitted to the Pennsylvania Bar, and was an Assistant Public Defender with the Defender Association of Philadelphia from 1993-1995. From 1995-2006, he practiced law in Philadelphia as a sole practitioner, concentrating primarily on criminal defense (both trial and appellate), and civil litigation, litigating several cases before the Pennsylvania Supreme Court. He also practiced law as a member of the Criminal Justice Act Panel for the United States Court of Appeals for the Sixth Circuit, where he represented indigent criminal defendants who appeal their conviction and sentences. After practicing law, he pursued a career in academic philosophy, returning to graduate school in 2004, earning a M.A. in philosophy in 2006, and a Ph.D in philosophy in 2011 from the University of Memphis. His areas of scholarly research are 19th and 20th Century Continental Philosophy, Philosophy of Religion/Philosophical Theology, Philosophy of Law, Philosophy and Literature, and African-American Philosophy/Critical Race Theory. Laura O’Sullivan is a wonderful criminal defense lawyer who practices in Kansas City, Missouri. She discusses a criminal case for a young man with a tumultuous childhood who was in foster care until the age of 18 and was facing lifelong consequences for allegations of inappropriate behavior. Laura O’Sullivan is a trial and appellate attorney with over 20 years of legal experience. Currently an Assistant Public Defender in the state of Missouri, she previously was an Associate Clinical Professor at the University of Missouri, Kansas City School of Law, and held a variety of other positions including at the Midwest Innocence Project. Laura’s specialties include trials, post convictions, criminal and family law, teaching students, and training attorneys, managers, investigators and support staff. During the young man’s trial, several witnesses helped tell the story of his life. The jury’s decision restored Laura’s confidence in the love and openness of people to really listen and to reach a verdict based not just on the incident at hand, but instead on a person’s whole life. Laura discusses how she doesn’t grow bitter and cynical representing clients who sometimes have done terrible things. She shares that often her clients have had difficult childhoods and are suffering from addiction or mental health issues and are facing a system that has failed. She’s learned from her clients that people have different needs, and sometimes a need is to be heard. Her role is not to control, but instead “to do the best (she) can and to help her clients through what is probably one the most difficult times in their lives.” Laura then turns to her work on constitutional challenges in Missouri.  “Missouri’s public defender system is 49th out of the 50 states in terms of funding. So, we have an underfunded and overworked public defender system. We have more clients than we can handle. What we’ve done in Kansas City is to look at our ethical obligations and the constitutional rights of our clients to have an attorney.”  Clients, attorneys and the ACLU sued various state offices.  An update can be read here. Jessica Yeary Bio: Jessica Yeary has dedicated her career to criminal defense since being admitted to the Florida Bar in 2009. She spent the first nine years of her profession zealously representing the indigent accused as an Assistant Public Defender in Tallahassee. This year, Mrs. Yeary joined an elite group of attorneys when she became a Florida Bar Board Certified Specialist in Criminal Trial Law. She is passionate about criminal justice reform and leadership, currently serving as the President of the Tallahassee Chapter of the Florida Association of Criminal Defense Lawyers. She is also an active member of the Tallahassee Bar Association. Having benefited greatly from mentorship early on in her own career, Mrs. Yeary is committed to supporting young advocates and aspiring attorneys. She mentors law students through FSU Law’s Association of Criminal Justice and through Tallahassee Women Lawyers. Mrs. Yeary uses her trial expertise to coach the trial team at FSU Law School and assists high schoolers through the TWL-sponsored PACE Center for Girls Mock Trial program. Dr. Diana Uchiyama joined the Illinois Lawyers’ Assistance Program in 2018. Prior to joining LAP, she was the Administrator of Psychological Services for DuPage County where she oversaw a DASA licensed substance use treatment program, including a MISA program, and DHS Domestic Batterer Intervention Program for a court mandated population of clients. Dr. Uchiyama has also worked for the Kane County Diagnostic Center, as both a Staff Psychologist and Juvenile Drug Court Coordinator, and has an extensive background doing court ordered psychological, sanity, fitness, and sex offender evaluations and therapy. She has implemented numerous changes to court ordered programs both in Kane and DuPage County and is a certified trauma informed care trainer. Prior to obtaining her masters and doctorate in Clinical Psychology, Dr. Uchiyama was an Assistant Public Defender in Cook County working in various felony courtrooms at 26th and California. She obtained her law degree from Pepperdine University School of Law.

After graduating from University of Georgia, Judge Hope worked as an Assistant Public Defender for the University of Georgia Legal Aid Clinic and then proceeded to serve as the Chief Assistant Solicitor of Athens-Clarke County. He has experience working as a public defender, prosecutor and judge in various accountability courts in Athens.

Prior to her election as State Attorney, she served as an Assistant State Attorney, an Assistant Public Defender, a Civil Litigator, Adjunct Professor of Law, and Legal Analyst. She now manages 4 offices an administrative team, nearly 150 attorneys, sworn police investigators, victim advocates and hundreds of support staff.Aramis has prosecuted and defended a range of criminal cases from Misdemeanors to Capital Felonies, including Sex Crimes, crimes against children, and Homicides. Kim is originally from Vanceboro, North Carolina.  After high school, Kim joined the U.S. Navy where she served 6 1/2 years. While in the Navy, she earned an A.A. degree from University of Maryland College Park. After the Navy, Kim worked at Memorial Regional Hospital as a surgical technologist on the cardio-vascular team. On her days off, Kim attended Florida International University in Miami. She graduated in 2001 with a B.S. in Criminal Justice and certificate in Women's Studies. She enrolled in Regent University School of Law and graduated with her Juris Doctorate in Law in 2006. Kim successfully passed the North Carolina Bar Exam in 2006 and was admitted to practice law in North Carolina. She was immediately hired by the District Attorney's Office as an Assistant Public Defender. In 2014, the District Attorney named Kim as Chief Assistant District Attorney.

Toussaint Romain is a public servant interested in equity and justice. He is a former Assistant Public Defender in the Charlotte-Mecklenburg Public Defender's Office, where he most recently represented indigent clients charged as habitual felons. He conducted over 40 jury trials and many more bench trials over a ten-year period, handling cases ranging from first-degree murder to domestic violence crimes. Toussaint is an adjunct professor teaching courses on criminal justice and criminology at The University of North Carolina at Charlotte. He has received numerous honors and awards, including the Nish Jamgotch, Jr. Humanitarian Award for exceptional service to the Charlotte-Mecklenburg community, the Charlotte magazine Charlottean of the Year award, and the Leadership Charlotte Schley R. An unlikely Gator fan, Judge Tanya Davis Wilson worked her way through law school. After graduation, she served as an Assistant Public Defender, an Assistant Federal Public Defender, and as an Assistant U.S. Attorney for the Middle District of Florida, before being appointed to the Orange County bench. She was recently invested as a Circuit Judge. A Quincy, Florida native and a 16-year cancer survivor, she credits having learned many life lessons under the mentorship of former Judge Scott Polodna, who passed away last December from lung cancer. “It wasn’t as much what he said, as much as what he did,” said Judge Wilson as her eyes welled up during the podcast. Judge Scott Polodna was well regarded for his vast knowledge of the law. He was also a man of incredible faith. During his battle with cancer, he modeled true grace and strength by frequently comforting family members and friends who were concerned with his medical condition. Judge Polodna used his dry sense of humor and gentle teaching style to win over the hearts of those around him. On the one-year anniversary of his passing, we honor the legacy he left us and we remember the great father, husband, and coworker who was Scott Polodna.
