Kelly, a shareholder at Walkup, Melodia, Kelly & Schoenberger and recent Trial Lawyer Hall of Fame inductee, shares how he secured justice for the first of thousands of victims of a defectively designed medical device. On December 5, 2007, U.S. Air Force veteran Loren "Bill" Kransky underwent hip surgery in Montana, receiving a DePuy ASR Acetabular Hip System orthopedic implant. DePuy, a subsidiary of Johnson & Johnson, first put the ASR Acetabular Hip System on the market in Europe in 2004, and soon after began receiving notifications from prominent surgeons that the device was flawed. Despite receiving these notifications, DePuy continued to market the metal implant as a low-wear product that required only one surgery and failed to report product issues to American doctors. On August 4, 2010, a recall was issued and the Depuy ASR Acetabular Hip System was labeled as defective, but the damage was already done for millions of patients, including Loren. Following the recall, Loren underwent revision surgery to have the implant removed because it was shedding metal debris into the tissue of his hip and bloodstream. In March 2013, a Los Angeles jury returned a verdict in favor of Loren, awarding $8,338,136.12 in damages for the pain caused by the defective design and ultimately helping to facilitate a $2.5 billion national settlement for all victims.  Click Here to Read/Download Trial Documents   Guest Bio: Michael A. Kelly Mike Kelly is one of the nation's top personal injury attorneys. Since 2013, Genevieve has served as a court-appointed member of the Plaintiffs' Lead Counsel Committee for MDL 2441: In re Stryker Rejuvenate and ABGII Hip Implant Products Liability Litigation, and is also one of four attorneys appointed to the Settlement Committee for the Stryker MDL, which helped to negotiate a settlement in excess of $1.43 billion. Additionally, in May of 2019, Genevieve was appointed to the Plaintiff's Executive Committee of the 3M Combat earplug litigation MDL. She is one of 14 lawyers appointed by Judge Englehardt to MDL 2740, In re Taxotere, which includes claims brought by women who have suffered permanent baldness as a result of the use of Taxotere. She was court appointed to the PSC for the Biomet MDL in the Northern District of Louisiana, and helps patients suffering from hips made by Smith & Nephew, DePuy, Wright/MicroPort, and Zimmer. Genevieve's past work includes helping heart defibrillator patients after a Guidant recall in 2006. She represented patients who suffered serious injuries and death following the use of the recalled prescription drug Vioxx. She has assisted hundreds of clients in obtaining settlements for defective products including Yaz, transvaginal mesh, hernia mesh, Actos, to name a few. During 2007-2009, Genevieve spent nearly 75% of her time providing pro bono legal services to the survivors and families who lost loved ones as a result of the I-35W Bridge Collapse. Abstract: Accumulation of hyperphosphorylated tau in the locus coeruleus (LC) is a ubiquitous feature of prodromal Alzheimers disease (AD), and LC neurons degenerate as AD progresses. Tau-mediated LC dysfunction may contribute to early neuropsychiatric symptoms, while loss of LC integrity is associated with conversion to cognitive impairment. Hyperphosphorylated tau alters firing rates in other brain regions, but its effects on LC neurons have not been described. The purpose of this study was to characterize changes in firing properties of LC neurons when they are the only cells containing hyperphosphorylated tau, as well as later in disease when {beta}-amyloid (A{beta}) and tau pathology is abundant in the forebrain. Single unit LC activity was recorded from anesthetized wild-type (WT) and TgF344-AD rats, which carry the APP/PS1 transgene. Similar to human AD, these rats develop hyperphosphorylated tau in the LC (at 6 months) prior to A{beta} or tau pathology in forebrain regions (at 12-15 months). At baseline, LC neurons from TgF344-AD rats were hypoactive at both ages compared to WT littermates, but showed elevated spontaneous bursting properties, particularly in younger animals. Differences in footshock-evoked LC firing depended on age, with 6-month TgF344-AD rats demonstrating aspects of hyperactivity, and aged transgenic rats showing hypoactivity relative to WT. Tau-induced alterations in LC firing rates may contribute to the pathophysiology of AD, with early hyperactivity associated with prodromal symptoms, followed by hypoactivity contributing to cognitive impairment. These results support further investigation into disease stage-dependent noradrenergic interventions for AD. Copy rights belong to original authors. Kelly, a shareholder at Walkup, Melodia, Kelly & Schoenberger and recent Trial Lawyer Hall of Fame inductee, shares how he secured justice for the first of thousands of victims of a defectively designed medical device. On December 5, 2007, U.S. Air Force veteran Loren "Bill" Kransky underwent hip surgery in Montana, receiving a DePuy ASR Acetabular Hip System orthopaedic implant. DePuy, a subsidiary of Johnson & Johnson, first put the ASR Acetabular Hip System on the market in Europe in 2004, and soon after began receiving notifications from prominent surgeons that the device was flawed. Despite receiving these notifications, DePuy continued to market the metal implant as a low-wear product that required only one surgery and failed to report product issues to American doctors. On August 4, 2010, a recall was issued and the Depuy ASR Acetabular Hip System was labeled as defective, but the damage was already done for millions of patients, including Loren. Following the recall, Loren underwent revision surgery to have the implant removed because it was shedding metal debris into the tissue of his hip and bloodstream. In March 2013, a Los Angeles jury returned a verdict in favor of Loren, awarding $8,338,136.12 in damages for the pain caused by the defective design and ultimately helping to facilitate a $2.5 billion national settlement for all victims.  Click Here to Read/Download Trial Documents   Guest Bio: Michael A. Metal-on-metal artificial hip devices have been available for more than twenty years. Years ago, product manufacturers thought that metals like titanium, cobalt, and chromium used in the construction of artificial hips would last a lot longer than the regular shelf life of other artificial hips using plastics and ceramic materials, particularly for athletes and active people. Unfortunately, those metals have caused many problems, like metallosis, which happens when metal particles grind away from the artificial hip and leach into the bloodstream and surrounding tissue, causing pseudotumors, high levels of metal in the blood, and other problems. Various manufacturers developed different metal-on-metal artificial hips. In most cases, it did not go well for the thousands of patients who had hip replacement surgery. Hundreds of thousands of those patients have subsequently become plaintiffs in litigation against all those companies.  In this podcast conversation, Attorney Clay Hodges updates on the Smith & Nephew Birmingham hip litigation, which has been going on for several years. The litigation has become quite active lately, with many new cases filed. Stay tuned to hear the details, and find out what it could mean for you if you have had a hip replacement done in the last ten to fifteen years. Show highlights: Smith & Nephew first began to sell the Birmingham Hip Resurfacing device in the United States in 2006.  The different types of surgery required for the two Birmingham hip systems at play in this litigation. With the first type of Birmingham Hip Resurfacing System, Smith & Nephew provided the resurfacing components only. That was approved by the FDA in 2006. Smith & Nephew described the Birmingham Hip Resurfacing System as a good choice for more active patients because the company said it would last longer than other systems. While companies like Zimmer and DePuy were having trouble with their own MoM artificial hips, Smith & Nephew claimed that its Birmingham hip was a different type of metal hip implant that could be distinguished positively from those causing problems. The Birmingham hip components used as part of a total hip replacement were the second type of Smith & Nephew hip that has led to litigation. The S&N Birmingham THA components did not get FDA approval. All brands of metal-on-metal hips have caused problems, injuries, and symptoms. That is why they are mostly no longer in use today. Smith & Nephew lawsuits began for similar problems occurring with the Birmingham hip components soon after Zimmer and DePuy started dealing with litigation for their metal-on-metal hip systems. Why Should We Trust a Vaccine from a Condom Maker?   Richard Gale and Gary Null PhD Progressive Radio Network, March 5, 2021     For decades, according to a Guardian article, “consumers worldwide have named the $347 billion pharmaceutical behemoth Johnson and Johnson (J&J) as one of its most trusted brands.” From its humble beginnings in the 1880s, making cotton gauze dressings and eventually band aids, baby powder and shampoo, J&J  has expanded into one of the most powerful multinational pharmaceutical and medical device companies in the world.  In 1959, it entered the world of Big Pharma as a leading player after succeeding in getting Tylenol approved as an over-the-counter drug.  Shortly thereafter J&J commenced with a flurry of acquisitions to increase its product line, which included Neutrogena, Cordis, DePuy, Janssen Pharmaceutica and Centocor.  Today, in most American home medicine cabinets one will find a popular J&J product:  Listerine, Tylenol and Benadryl, Neutrogena skin cream, Rogaine, Neosporin antibacterial ointment, or Destin to treat diaper rashes.   Now, people are eager for J&J’s “one shot and you’re done” Covid-19 vaccine despite health officials’ fears it may be less effective than Moderna’s and Pfizer’s mRNA competitors. Nevertheless, vaccination centers and pharmacies are racing to get their hands on the new adenovirus-based vaccine.  And as we will further note below, this is from a company that has absolutely no past experience in vaccine development and manufacturing.    However, we need to seriously challenge J&J’s reputation. A 2019 report by the British intelligence firm Alva has noted that J&J’s reputation has sunk dramatically during the past years, from 9th place among 58 major pharmaceutical firms to 57th. Certainly, this is not a company with a clean ethical record.   A review of J&J’s rap sheet over the past three decades presents a dire and contrary image that should lead us to question the company’s claims about its Covid-19 vaccine given the lucrative market the pandemic has created for the most aggressive medical corporations.    Similar to its equally over-sized competitors Glaxo, Merck and Pfizer, J&J too has had to pay out billions of dollars over the decades for civil settlements and criminal activities.  As the pharmaceutical giant receives applause across the mainstream media for the release and FDA emergency approval for its Covid-19 vaccine, Brazil’s Public Prosecution Service started an investigation into J&J’s antitrust activities under the Foreign Corrupt Practices Act (FCPA) for “possible improper payments in its medical device industry.” This was part of an FBI bribery scheme investigation that included Seimens, General Electric and Philips acting as a larger cartel to illegally payoff government officials in return for securing contracts with Brail’s national health programs.  The charges also include price gouging, inflating prices up to 800 percent the market price to cover bribes.    This is not the first time J&J has violated FCPA laws. In 2011, J&J was charged by the Department of Justice with conspiracy for paying off Greek doctors to advance its product sales.  The SEC also charged civil complaints. The company had to pay out a $70 million penalty for buying off officials in Greece, Poland and Romania. In 2010, an executive for J&J’s subsidiary DePuy was sentenced to a year in prison for corrupt payments to physicians within the Greek national healthcare system.     As one of the world’s leading medical device companies, J&J has had its share of recalls for faulty products including contact lenses and hip implants  In 2013, it paid nearly $2.5 billion to compensate 8,000 recipients for its flawed hip implants  Again in 2016, another $1 billion was awarded to plaintiffs injured from this device.   One particular dubious activity the company became involved with in 2008 was to launch a “phantom recall.” When its Motrin IB caplets were discovered to not properly dissolve, it hired outside contractors to buy up store supplies in order to avoid making public declaration. No one would have known of this activity and it would have gotten past the eyes of FDA inspectors had the deception not been exposed during a Congressional investigation.   Other major J&J lawsuits and recalls for faulty products include:   1995 - $7.5 million fine for destroying documents to cover up an investigation into wrongful marketing of its Retin-A acne cream to remove wrinkles   1996 – An undisclosed settlement on false claims over condom protection claims to protect against HIV and other STDs.   2000 – J&J’s subsidiary LifeScan was found guilty for selling defective blood glucose monitors and failed to inform the FDA.  All total, $105 million was paid out.    2001 – Paid out $860 million in a class action lawsuit for misleading customers about prematurely discarding its 1-Day Acuvue soft contact lens.  J&J recommended they should only be worn once although it was discovered the lenses were no different than the regular Acuvue lens that would last for two weeks   2010 - $81 million settlement for misbranding its anti-epileptic drug Topamax to treat psychiatric disorders and hiring outside physicians to join its sales force to promote the drug for unapproved conditions.  The following year, J&J paid $85 million for similar charges against its heart drug Natrecor   2011 – Several of its baby products were discovered to contain carcinogenic ingredients   2013 – The US Justice Department charged the company $2.2 billion in criminal fines for marking its autism and anti-psychotic drug Risperdal for unapproved uses. Forty-five states had filed civil lawsuits against J&J in the scandal   Risperdal is  horrendous drug that contributes to rapid weight gain and a condition known as gynescomastia, irregular enlarged breasts in men. Semmelweis reports that J&J’s subsidiary Janssen also had an aggressive campaign to market its use in children with behavioral challenges.  Other serious adverse effects from Risperdal reported by the FDA include diabetes mellitus, hyperprolactinaemia, somnolence, depression, anxiety, psychotic behavior, suicide and death.    The company’s legal problems over Risperdal do not appear to have ended. In October 2019, a Philadelphia jury awarded a man $8 billion in punitive damages for failing to warn that the drug could cause young men to grow breasts. Other recent suits include litigation over its blood thinner Xarelto risks of internal bleeding, and a $775 million settlement to 25,000 plaintiffs.    2016 -  Two women were awarded $127 million in damages for the talc in its J&J Baby Powder causing ovarian cancer.  Later, over 1,000 similar cases came forward. During the trial it was discovered that J&J suspected a link between talcum and ovarian cancer back in the 1970s.  A Missouri verdict fined the company over $4 billion but it was later reduced to $2.1 billion.  A New York Times investigation into internal J&J memos uncovered evidence that the talcum powder may have contained asbestos. These cases continue. In July 2019, J&J made efforts to dismiss 14,000 lawsuits over the talcum-cancer risk.   More recently, J&J has been in the spotlight for its role in contributing to the deadly opioid crisis.  The company holds the patent for a unique strain of opium poppy commonly named Norman. It is the leading provider of the opioid for Purdue Pharma’s painkiller OxyContin. An Oklahoma court ordered a $465 million fine. This opened the door for other states to follow suit.  To fully realize how insane the system is, the half a billion dollar civil fine was good news on Wall Street, which anticipated the verdict would be in the billions of dollars. Consequently, J&J’s stock rose 2 percent after the judge’s ruling.  And despite J&J being Purdue’s major supplier, and a major contributor in the US’s opioid epidemic, the latter was forced to file for bankruptcy due to mounting lawsuits for overdose deaths.   Finally, we might ask why a 140 year old company, with no history whatsoever in vaccine development, has now become among the heroes in the immunological war against Covid-19?  J&J is not a household name in the vaccine industry. It is utterly absent, let alone ranks among the world’s 20 major vaccine makers. Among the 53 vaccines for other infections approved and licensed by the CDC, not one is manufactured by the nation’s leader in mouthwash and baby powder.  It is therefore no surprise that the company had to partner with Merck to manufacture its Covid vaccine to meet demand. It has no history or expertise in this medical field.    However, the Covid pandemic is a cash cow for the drug industry’s taking. Bernstein market analyst Ronny Gal predicts Covid-19 vaccine sales will reach $40 billion this year.  A more realistic figure is likely higher since together Moderna and Pfizer project their revenues at $32 billion. Then there are the other major vaccines by AstraZeneca, J&J and Novavax entering the competition.  According to the London School of Hygiene and Tropical Medicine’s vaccine research tracker, over 200 vaccines against Covid-19 are in development worldwide. It is an enormous pumpkin pie and everyone in the medical universe wants a slice from it.  So why shouldn’t we expect a non-vaccine player such as J&J to be eager to leap into the frenzy?     Finally, there is a disturbing question that we have no certain answer for.  How is it that a drug and household health product company, with no prior history in vaccine development, can develop and rush to market its first vaccine against a viral strain that was only identified 14 months ago?  Developing a vaccine requires many years and necessitates the establishment of an R&D infrastructure vastly different than conventional drug development.  The other major companies developing Covid-19 vaccines have been in the business for decades. But not J&J. There is something more to this story that demands investigation.  And if the company’s long rap sheet offers any warning, it is that we must be wary of any claims J&J publicly states about the efficacy and safety of its products.  Especially when the pandemic promise to increase the profits of numerous shareholders.

150 pupils from four Cork primary schools recently attended DePuy Ireland Unlimited Company’s (“DePuy Ireland”) first-ever Virtual STEM Academy Programme event. The event marks the completion of DePuy Ireland’s two-year STEM Pilot Outreach Programme and launches the Virtual STEM Academy Programme for the 2020/21 academic year. DePuy Ireland is part of the Johnson & Johnson DePuy Synthes Family. The STEM Academy Programme is designed to inspire and encourage children to engage in future studies and careers in science, technology, engineering, and math-related fields. Over the past year, the programme has reached over 10,000 Irish primary school students, teaching STEM-related subjects including robotics, 3-D printing, sustainability, and virtual reality as part of our Lego Mindstorms, Dash, and Dot Robotics, and 3-D printing programmes. This year, the impact of Covid-19 has seen DePuy Ireland transform its STEM Academy Programme to a virtual format. A dedicated team of DePuy Ireland volunteers lead by Susan Dunlea from DePuy Ireland’s Engineering, Science & Technology Group have prepared a bank of virtual lessons for the outreach programme. In addition, the team has also allocated time for online training and assistance for schools and teachers engaging with the programme. DePuy Ireland has also provided schools with equipment required to run their own STEM Academy Programmes, including 3D printers and consumables, wonder packs for Dash and Dot robotics, and IT equipment. Teachers and pupils of Cork schools, Scoil Bhríde, Rathcormac; Scoil Mhuire, Ballincollig, Watergrasshill National School, and St Paul’s School, Montenotte, attended the Virtual STEM Academy Programme launch event, which included a video event featuring testimonials of past participants, principals, teachers and volunteers. Speaking about the Programme, Mairéad Ní Mhurchú, Principal of Scoil Mhuire, Ballincollig, Co. Cork said “The students are really excited to be involved in the STEM Academy Programme this year. The programme is a great tool that allows our teachers to encourage students to engage in innovative thinking and explore the possibilities associated with a career in STEM.” Speaking about DePuy Ireland’s efforts to continue STEM outreach programmes virtually, Gary Clerkin, Global Leader Manufacturing, Engineering, Science & Technology, DePuy Ireland Unlimited Company, said “At Johnson & Johnson, we recognise the importance of creating future generations of life-changing scientists and engineers. Trinity CathedralEpiscopal Diocese of ArizonaPhoenix, AZAlan Keith DePuy was born in Torrance, California on May 31, 1966 to the late Donald Clinton DePuy and Melva Lynn DePuy. Born with an incredible gift of music, Alan was – at nine years of age – already a guest organist for Crystal Cathedral, in Garden Grove, California, being in the spotlight of national television frequently. He continued to appear on “The Hour of Power” until the age of 18. He continued his formal music education at Chapman University, where he received his Bachelor of Arts degrees in Organ Performance and Piano Accompaniment. He studied with Dr. William Hall, Dr. Ronald Huntington and Dr. Tanya Fleisher while at Chapman University. He continued his education in the graduate Organ Performance program at Arizona State University, where he studied with Dr. Robert Clark and Dr. Kimberly Marshall. As a young organist, Alan played in numerous competitions and received four first-place honors in competitions sponsored by The American Guild of Organists. He also played concerts throughout the United States, Canada, Europe and Asia. Alan was called to make music, but specifically, he was called to make music for the church. He shared his gift with churches across the country that he served, including First Christian Church, Fullerton, California; St. Andrew’s Presbyterian Church, Newport Beach, California; Holy Family Cathedral, Orange, California; Trinity Cathedral, Phoenix, Arizona; St. Mark’s Cathedral, Seattle, Washington; St. Thomas Church, Coral Gables, Florida; and St. George’s Church, Germantown, Tennessee. Alan’s talent and musical ability were tremendous and unparalleled; his passion for great music was always reflected in his willingness to share his incredible musical gifts with everyone – and his desire to awaken the love of music in even the most neutral observer. As tremendous as were his musical gifts, they could not overshadow his love for all humanity: Alan loved unconditionally and cared for everyone around him; wherever he went, his arms were always open in love. Even as we celebrate that Alan has passed into Resurrection light, and into the nearer presence of our God, we grieve the loss of him as a loving friend and supportive colleague, and the loss of his tremendous talent in the Church and in the world. Alan is survived by his brother, Thomas DePuy, his nephew, Dylan DePuy, his sister-in-law, Susanne DePuy and many, many friends, colleagues, choir members and parishioners whose lives he touched in profound ways, whom he loved unconditionally, and who will always remember and love him.

My guest this week is Gove Depuy, sustainability consultant, community-based planner, project leader and an advocate for bio mimicry. What are we talking about? Islands, and the growing idea that islands might serve as learning ecosystems for new ways of communing with the Earth we inhabit. It’s not an entirely new idea. In 1962, legendary author Aldous Huxley, wrote and published the book Island, as a utopian companion to his better known and more dystopian novel, Brave New World. Inspired by time spent in Bali, Huxley described a people living in harmony with nature. Today there’s a lot more traffic and a concerning amount of trash and plastic, but it’s still Bali – an island where animism and Hinduism blend to create a unique pact between humans in rhythm with the environment. I sat with Gove by the banks of one of Bali’s many picture-perfect rivers, adjacent to the Five Elements Retreat. It proved the perfect setting to talk about life in Bali, community-based projects, and ultimately, the promise of islands as a petri dish for exploring new, potentially more sustainable ways of living in the world. Amidst the thick, verdant jungle, cascading waterfalls and buzzing birds and insects, it’s hard to imagine we face a climate crisis of epic proportions. Yet, we do.

Our podcast host today Robert Hossary, General Manager NSW/ACT at The American Chamber of Commerce discusses 'Authentic Leadership' with guest Gavin Fox-Smith, Managing Director at Johnson & Johnson Medical ANZ and AmCham Governor.  Mr Fox-Smith joined Johnson & Johnson Medical Australia/NZ in 1997 as a Regional Business Director and in February 2012 was appointed Managing Director for Global Surgery and Johnson & Johnson Medical ANZ. Over the past 15 years Gavin has held leadership roles in Sales, Marketing and General Management across Ethicon, EES, DePuy and Cordis. The ongoing problems in business leadership in the past has underscored the need for a new kind of leader in the twenty-first century: the authentic leader. You also do not have to be at the top of your organization. Anyone can learn to be an authentic leader. The journey begins with leaders understanding their life stories. Authentic leaders frame their stories in ways that allow them to see themselves not as passive observers but as individuals who learn from their experiences. These leaders make time to examine their experiences and to reflect on them, and in doing so they grow as individuals and as leaders. Authentic leaders also work hard at developing self-awareness through persistent and often courageous self-exploration. Denial can be the greatest hurdle that leaders face in becoming self-aware, but authentic leaders ask for, and listen to, honest feedback. Debbie Jo DePuy just recently finished her first Ironman 70.3 at Ironman Haines City, Florida. Debbie is a wife, a software coordinator and a mom of 2 high-school age boys. Debbie's background is as a swimmer. She started swimming when she was 5 and swam through college. She is a 7 time all-American swimmer. We talk about the decision to choose a race close to home in order to make it affordable. We talk about the resources she used to prepare for the race.  Jenkins house of pain triathlon group, You Tube videos, Lightfront Striders and St. Cloud Mom's Run this Town and Women for Tri on Facebook. Her biggest challenge was time management. We talk about how she got creative to juggle her training and her life. We chat about being nervous to make the jump to clipless pedals and aerobars. Debbie shares that she really thought the race briefing was the most beneficial part of her pre-race check in. We talk about the benefits of being familiar with a race course and how you can never be sure what the weather will be like on race day. We talk about the actual race of Ironman 70.3 Haines City. Since Debbie's background is as a swimmer she swam 1.2 miles without a wetsuit in 35 minutes. Zoom zoom! Debbie shares what it was like to get encouragement from other triathletes on the bike course. Debbie battled IT Band issues while training and she tells us how she managed the run with that lagging injury. Debbie says, "No matter how your race goes always finish as hard as you can." We talk about what she would do differently with her training now that she's completed the race. Her goal is to complete a full Ironman before she turns 45. The day that we recorded the interview Debbie raced St. Anthony's triathlon and won her age group! Congratulations Debbie! Background: Low-contact-stress (LCS) mobile-bearing total knee arthroplasty (TKA) (Johnson & Johnson, New Brunswick, NJ; previously: DePuy, Warsawa, USA) provides excellent functional results and wear rates in long-term follow-up analyses. Radiological analysis shows radiolucent lines (RLL) appearing immediately or two years after primary implantation, indicative of poor seat. Investigations proved RLL to be more frequent in uncemented TKA, resulting in a consensus to cement the tibial plateau, but their association with clinical findings and patients discomfort and knee pain is still unknown. Methods: 553 patients with 566 low-contact-stress (LCS) total knee prostheses were screened for continuous moderate knee pain. We compared tibial stress shielding classified by Ewald in patients suffering from pain with a matched, pain-free control group on blinded X-rays. We hypothesized a positive correlation between pain and radiolucency and higher frequency of such radiolucent lines in the most medial and most lateral zones of the tibial plateau. Results: Twenty-eight patients suffered from knee pain in total. Radiolucencies were detected in 27 of these cases and in six out of 28 matched controls without knee pain. We could demonstrate a significant correlation of knee pain and radiolucencies, which appeared significantly more frequently in the outermost zones of the tibial plateau. Conclusion: Our findings suggest that radiolucent lines, representing poor implant seat, about the tibial plateau are associated with knee pain in LCS patients. Radiolucencies are observed more often in noncemented LCS, and cementing the tibial plateau might improve implant seat and reduce both radiolucent lines and associated knee pain.

Einleitung: In der operativen Versorgung von Frakturen der Tibia ist nach heutigem Standard die Marknagelung Methode der Wahl. Der neu konzipierte Titan US-Nagel Depuy ACE Aim Dynamic weist einige design- und funktionsspezifische Besonderheiten im Vergleich zum vorherigen Modell auf. Hierzu zählen die Bohrung des Nagels für die Verwendung von Führungsdrähten, welche am oberen Ende in eine Schlitzung mündet, und die konische Fräsung der Löcher für die erleichterte Einbringung der Verriegelungsbolzen. Vom Vorgängermodell wurden 220 Nägel eingesetzt, es kam in keinem Fall zu einem Materialversagen. Beantwortet sollte daher für die klinische Anwendung die Frage werden, ob die Änderung des Designs zu sog. Sollbruchstellen am Nagel bzw. im Nagel-Bolzen-System führt. Methode: Geprüft wurden zwei Gruppen á 5 Nägeln auf einer Zwick 010. Zur Untersuchung der maximalen Belastbarkeit (Peak load) von 8mm Nägeln am Übergang Zylinder- in U-Form (Schlitzung im proximalen Bereich) kam eine standartisierte Vier-Punkt-Biegung mit neu konzipierter Probenhalterung gemäß der Empfehlungen der ASTM (American Society for Testing and Materials) für die Prüfung intramedullärer Osteosynthesematerialien (Stützweite L=11,4cm; Last-Stütz-Abstand s=3,8cm; Lastweite c=3,8cm) zum Einsatz. Die Daten dieser Messungen im Schlitzbereich (5) wurden verglichen mit den Ergebnissen einer Belastungsprüfung im weiter distal gelegenen, zylindrischen Bereich des Nagels (5). Für die Prüfung des Nagel-Bolzensystems verwendeten wir auf Grund der zentralen Bohrung für Führungsdrähte eine modifizierte Vier-Punkt-Biegung mit ebenfalls neu konzipierter Probenhalterung. Die Peak load von 36mm Verriegelungsschrauben mit 4,5mm Gewindedurchmesser, eingeschraubt in eine Buchenhartholzhülse mit 19mm Stützweite, bei direkter Kraftübertragung mittels Standard-8mm-Nagels, wurde bestimmt. Ergebnisse: Die Grenze von elastischer zu plastischer Verformung der gepüften Nägel wurde im Schlitzbereich bei einer Last von F = 4.218 N, also einem um 17,68% geringeren Biegemoment erreicht (Rp0.1 bei 80,14 Nm;) als in zylindrischen Abschnitten (F = 5.049,5N). Im physiologischen Bereich kam es zu keinem Nagelbruch. Unter Verwendung des neuen Nagel-Bolzen-Systems kam es zum Bruch der geprüften Verriegelungsbolzen bei einer durchschnittlichen axialen Last von 2.510 N. Dies entspricht einem um 13,12% geringeren Biegemoment (Rp0.1 bei 8,16 Nm;) als unter Verwendung des Vorgängermodels. Zusammenfassung: Der zur operativen Versorgung von Tibiafrakturen neu konzipierte standardmäßig verwandte US-Nagel Depuy ACE Aim Dynamic ist ein außergewöhnlich sicheres System, was aus unseren Testergebnissen abgeleitet werden kann. Zwar zeigt dieser im Vergleich zu seinem Vorgängermodell Schwächen in der Belastbarkeit des Nagel-Bolzen-Systems. Dies erscheint aber unter Berücksichtigung der gängigen postoperativen Belastungssteigerung als unproblematisch.
