In a story that could have been written 200 years ago, independence activists in the French territory of New Caledonia in the Pacific have been sent to mainland France for pre-trial detention, per Al Jazeera. According to this report, these seven detainees include Christian Tein, head of the pro-independence group Field Action Coordination Cell, or CCAT. Tein's lawyer Pierre Ortent said he was “stupefied” that Tein was being being held in France, accusing authorities of “answering to purely political considerations.” A lawyer for another detainee said these actions would only create “martyrs for the independence cause.” Riots broke out in New Caledonia earlier this year when France instituted new rules allowing long-term, non-indigenous residents to participate in independence referenda – which “Indigenous Kanaks feared…would dilute their vote.” France deployed 3,000 soldiers in response. New Caledonia remains on the United Nations list of “non-self-governing territories,” the modern euphemism for imperial colonies.2. Following a decade-long legal battle, the saga of WikiLeaks founder Julian Assange is finally coming to a close. Defending Rights and Dissent reports “On Monday, it was announced that Assange had filed a guilty plea in the US District of Northern Mariana Islands. Assange, who faced 17 counts under the Espionage Act and one count of conspiracy to violate the Computer Fraud And Abuse Act, pled guilty to [a] single count of conspiracy… Assange…will make an appearance in court and be sentenced to time served. He will then return to Australia a free man.” However, Policy Director Chip Gibbons was quick to note “Plea deals…set no legal precedent…the US government's decision to charge Assange under the Espionage Act remains unconstitutional due to the First Amendment's press freedom guarantees.”3. In an interview with Declassified UK, reported by Yahoo News, Independent MP Candidate and former Labour Leader Jeremy Corbyn recounted how he was pressured to give blanket support to military actions by Israel. In the interview, he said “During one extremely hostile meeting of the Parliamentary Labour Party Committee they confronted me and said will you give a blanket undertaking that you, as party leader and potentially prime minister, will automatically support any military action Israel undertakes?” Corbyn responded “no, I will give no such undertaking, because the issue of Palestine has to be resolved and Palestinian people do not deserve to live under occupation…” Corbyn is currently fighting to keep his longtime seat in Islington North after being expelled from the Labour Party by it's reportedly CIA-linked new leader, Keir Starmer.4. British humanitarian group Save the Children has published a new report which finds “Over 20,000 children [are] estimated to be lost, disappeared, detained, buried under the rubble or in mass graves,” in Gaza. A Child Protection Specialist with the group, on the ground in Gaza, is quoted saying “Every day we find more unaccompanied children and every day it is harder to support them…there is no safe place in Gaza… Neighbours and extended family members who have taken in lone children are struggling to meet their basic needs, such as shelter, food, and water. Many are with strangers - or completely alone - increasing the risk of violence, abuse exploitation and neglect.” Jeremy Stoner, the group's regional director for the Middle East, says “Gaza has become a graveyard for children.”5. On Tuesday, a new citizenship law took effect in Germany, allowing new immigrants to obtain a German passport within five years – but only if they declare that the State of Israel has the right to exist, per the Financial Times. This piece notes that the “[German] government…has…sparked anger by…[cracking] down on…criticism of the Israeli government over its conduct in Gaza, fuelling (sic.) a debate over free speech in Germany, particularly among artists and academics. Sabine Döring, Germany's junior minister for higher education, was forced to resign earlier this month after her ministry started exploring legal options to defund the research of German academics who had signed a public letter criticising a police crackdown on anti-Israeli student protests.”6. AP reports Israel's Supreme Court issued a ruling this week that “the military must begin drafting ultra-Orthodox men for compulsory service…[putting] an end to a decades-old system that granted ultra-Orthodox men broad exemptions from military service while maintaining mandatory enlistment for the country's secular Jewish majority.” The exemption from military service for the ultra-Orthodox Haredim has been a long-term flash-point in Israeli society and the issue has only grown more contentious as the recent campaign in Gaza has dragged on. The Netanyahu regime, which rules in coalition with Haredi parties, fought this ruling tooth and nail, claiming that forcing the Haredim to serve would “tear Israeli society apart.” Many speculate that the ruling will cause the ultra-Orthodox parties to leave Netanyahu's coalition, which would precipitate the collapse of his government.7. According to the Pittsburgh Post-Gazette, over 20 elder care facilities in the area have closed in just the last few weeks, which this report ascribes to “The long-term mismanagement of nursing homes by private equity firms,” like the Carlyle Group. Specifically, the paper excoriates how “Private equity firms extract money from nursing homes,” using “sale-leaseback[s]…selling the land out from under the facilities for lump payments…[meaning] Nursing homes are suddenly forced to pay rent or ‘management fees' to occupy facilities they once owned…the same process…that resulted in the bankruptcy of the Red Lobster restaurant chain.” The paper notes that the Biden administration is promulgating a new rule that elder care facilities must disclose their ownership, while acknowledging that “This will hardly solve the problem, but it will allow families to make informed decisions about their loved ones' care.”8. Rumblings suggest Congress may raise the corporate tax rate. POLITICO reports “anti-corporate sentiment is running high among increasingly populist-minded Republicans,” and this article quotes Congressman Chip Roy of Texas saying “There's a bubbling-up concern that we should not be doing the bidding of corporate America.” Roy is reportedly “consider[ing] kicking the corporate rate up to 25 percent, from the current 21 percent, if it means being able to extend breaks for individuals and small businesses.” On the Democratic side, Representative Don Beyer said “Every Democrat thinks the 21 percent corporate rate is far lower than is necessary,” and Senate Finance Chair Ron Wyden added “Western civilization is not going to end if there's some increase.”9. The Guardian reports DC area coffee chain Compass Coffee is “hiring dozens of friends of management, including other local food service executives and an Uber lobbyist, in an effort to defeat a union election.” Compass Coffee United, the union representing these workers, “accused the coffee chain of hiring 124 additional people at cafes that are attempting to unionize…[and] manipulating worker schedules retroactively to try to make the new employees eligible to vote in the union election.” The union has filed an unfair labor practice charge with the NLRB. Senator Bernie Sanders wrote on Twitter “Claiming that a lobbyist from Uber & CEOs from other companies are workers in order to rig a union election is totally absurd & disgusting.”10. Finally, in more labor news, CNN reports Teamsters President Sean O'Brien will speak at the Republican National Convention. Former President Trump wrote on Truth Social “Our GREAT convention will unify Americans and demonstrate to the nation's working families they come first…When I am back in the White House, the hardworking Teamsters, and all working Americans, will once again have a country they can afford to live in and be respected around the world.” Trump and O'Brien previously met at Mar-a-Lago in January. According to Teamsters spokesperson Kara Deniz, “O'Brien's appearance does not represent an endorsement of Trump,” and “O'Brien has requested the opportunity to also speak at the Democratic National Convention…The DNC has yet to accept that request.”This has been Francesco DeSantis, with In Case You Haven't Heard. Sadly, her son is suspected of killing her. Sulaina Nabirye came to Christ in February. One of her relatives told Morning Star News, “During the month of Ramadan, she complained of her son pressuring her to stop attending church and revert back to Islam since he was studying to become an imam. … When she refused to convert back to Islam, he stopped visiting her at her house and threatened to chase or even kill her.” Psalm 116:15 says, “Precious in the sight of the LORD is the death of His saints.” New Zealand eager to deny churches tax-exempt status New Zealand is considering stripping churches of their tax-exempt status. Churches there have enjoyed the status since the 1600s. But now Prime Minister Christopher Luxon is looking to axe it as cultural pressure mounts against churches. Christian identification has been declining in New Zealand in recent decades. Over half of the population now identifies with no religion. And only 37% claim to be Christian. America's deficit spending not fiscally sustainable The International Monetary Fund released its latest world economic outlook report. The global economy is expected to grow 3.2% this year and next year just like it did last year. The U.S. economy is seeing stronger-than-expected growth while Europe is facing weaker-than-expected growth. However, the International Monetary Fund did warn that U.S. growth is driven by deficit spending that is “out of line with long-term fiscal sustainability.” Senate Democrats dismiss charges against Homeland Security Secretary On Tuesday, the U.S. House of Representatives sent two articles of impeachment against Homeland Security Secretary Alejandro Mayorkas to the Senate. He was facing a trial on charges of refusing to enforce U.S. immigration law. However, the Democrat-controlled Senate killed both articles of impeachment yesterday. Republican Senator Ted Cruz of Texas was livid. Listen. CRUZ: “When it comes to the Constitution, the Democrats concluded that Joe Biden and Alejandro Mayorkas defying federal law, ignoring the text of the statute, deliberately releasing criminal illegal aliens over and over and over again, that's just hunky dory. You can't impeach him for that. Every Democrat just voted. “By the way, every Cabinet member, guess what? You've just been given a blank slate: ignore the law. When Democrats are in charge of the Senate, the entire Cabinet could ignore the law. It is no longer impeachable, in Democrat Wonderland, when a member of the Executive branch openly defies the law.” It's the second time in U.S. history that the Senate has received articles of impeachment against a cabinet secretary. Wiliam Belknap, who served as Secretary of War under President Ulysses S. Grant, was impeached on March 2, 1876, for his role in the trader post scandal. However, he was acquitted by the Senate. Supreme Court to take up emergency room abortion case The U.S. Supreme Court plans to hear another abortion case involving emergency rooms. The Emergency Medical Treatment and Active Labor Act requires emergency rooms to provide medical care for patients. The Biden administration is trying to make abortion part of that required medical care even in states where it is banned. A federal appeals court has already ruled that doctors in Texas are not required to perform abortions under the act. 15 states upset with Bank of America's political and religious discrimination On Monday, fifteen states sent a letter to Bank of America CEO Brian Moynihan. Kansas Attorney General Kris Kobach is leading the coalition. Together, they are calling out the bank for religious and political discrimination. The letter stated, “Your discriminatory behavior is a serious threat to free speech and religious freedom, is potentially illegal, and is causing political and regulatory backlash.” Alliance Defending Freedom scores businesses on an index for free speech and religious liberty. Last year, Bank of America tied for the lowest score among commercial banks. Private school students more civically engaged than public school peers A new study in the Educational Psychology Review found that private school students are more likely to be engaged citizens than public school students. The study measured civic outcomes in students through several factors, including political participation, civic knowledge and skills, and voluntarism. The report noted, “Religious schooling seems to play a positive role in shaping civic outcomes. We find positive effects across various definitions of religious private schooling.” Martin Luther: “My conscience is captive to the Word of God” And finally, today is the anniversary of when Martin Luther stood before the Diet of Worms. The Holy Roman Emperor, Charles V, called the imperial diet, a formal deliberative assembly. The assembly called on Luther to recant his teachings of church reform. On April 18, 1521, he uttered these immortal words that would characterize his work and the work of many others during the Reformation: LUTHER (from “Luther” movie): “Unless I am convinced by Scripture and by plain reason, and not by popes and councils who have so often contradicted themselves, my conscience is captive to the Word of God. To go against conscience is neither right nor safe. I cannot, and I will not recant. Here I stand, I can do no other. God help me. Amen.” That audio clip was taken from the 2003 movie “Luther.” Isaiah 8:20 says, “To the law and to the testimony! This week, we're examining the implications of Virginia Governor Glenn Youngkin (R.) vetoing 30 different gun-control bills. Joining us to do that is Cam Edwards of Bearing Arms. He has long been one of the top pro-gun analysts out there. He also happens to live in Virginia, like me. So, he has paid special attention to the fight over guns in Virginia. Not just this year either, but for the last several election cycles. He argued the dynamics at play during this year's legislative session were pretty surprising. Not only did we not know what Youngkin would do with the dozens of gun bills that made it to his desk before he formally announced his vetoes, but the way those proposals got through the legislature was surprising too. Every Democrat in the state house held together to vote for every single proposal, even the more aggressive bans and restrictions. Cam said that was a fascinating development given the large grassroots backlash the party faced after its last attempt to enact sweeping gun reforms in 2020. He also argued the dynamic that has developed in the state's gun politics should be very concerning for gun-rights advocates. On Thursday's Mark Levin Show, all of a sudden President Biden says he has to build parts of the southern border wall because Congress told him he had to and he has to obey the law. Why the change of heart? Last week Mark laid out what the first article of President Biden's impeachment should be - his failure to uphold Article 2 section 3 of the Constitution. Biden is compelled to comply with statutes and laws he may disagree with and he's violated the law by blowing off the wall at the southern border. They moved quickly now because they are nervous. There really is no change in the Biden administration policy. What they are not telling you is that they will spend that money on the wall because not doing so is an impeachable offense. Later, Donald Trump would make a great Speaker of the House, but it's difficult to make the case that he doesn't have time to prepare for trials - yet he would run for Speaker. He needs to run for president and beat back these cases. Rep Jim Jordan should be the next Speaker of the House. By Rep Matt Gaetz's logic, we should thank Rep Hakeem Jeffries. Every Democrat voted to vacate Kevin McCarthy. Gaetz colluded with the Marxist party trying to overthrow the country. Rep Jim Jordan calls in to discuss his race for Speaker of the House. He is ready to bring Republicans together. If they don't come together, we could end up with a coalition government working with the left, which is dangerous. The low point of course was when the police agreed to enforce a police state. There was no national emergency; the country wasn't in danger. Trudeau was embarrassed; that's all. So the police stomped on people with riot horses. And then they had a good laugh about it in their internal WhatsApp group. They talked about their jackboots crushing citizens. Not a single one of those cops was suspended. And that cop who assaulted Alexa Lavoie? His name is Sgt. Jordan Arthur We're suing him. I should tell you that the RCMP says they're investigating him too, which is interesting. Except they're lying. The attack on Alexa was more then a year ago, but they still haven't even interviewed Jordan Arthur yet. Some interview. More like a whitewash and a cover-up. What a disgrace. They tussled with police, and, shockingly, they'll only face two years in jail. The law only seems to go one way now. Antifa is praised by the establishment while the Proud Boys, a drinking fraternity, is on Canada's list of terrorist groups. Not because they are terrorists, but because Trudeau needed something to point to when he wanted to say "right-wing terrorist group." My point is that the rule of law is now malleable, and it all depends on who is holding the stick. The news out of New York City is alarming, with an extremist District Attorney, elected with George Soros money, indicting Trump and calling for his arrest and extradition to New York from Florida. This has nothing to do with him being president, it's the relitigation of Trump paying money to a stripper. I don't even care whether he had sex with her or not; the fact that this is what Trump is being arrested and jailed for is absurd, and the justice system has been twisted to accomplish this for obvious political reasons. You cannot trust the legal system in America anymore — not if there are politics afoot. Here's a member of the grand jury in Georgia who said she voted to prosecute trump because she was excited about meeting him. Yeah, I think things are broken. But they're broken just one way. Have you ever seen a conservative, or a Republican, in the U.S. or Canada use the legal system to fight a battle? And I don't mean to fight unfairly, to twist the law and abuse it. I mean, to fight a crime when the perpetrator is a leftist Well, that's my news today. And it continues to impress me about Ron DeSantis in Florida. He's one of 26 Republican governors. They all have similar powers. But he's the only one using all the tools at his disposal to push his agenda. Every liberal does. Every Democrat does. But Republicans don't. And it's amazing to watch the one guy who does. So the law — the FACE Act — was drafted to target people who committed crimes at abortion centres. But DeSantis is using it to target people who commit crimes are pregnancy centres — which is actually what reproductive health means; it's not an ironic euphemism. But they're right — it is unprecedented. Our side never fights back. It's always prosecutions of Trump — not Clinton or Obama. Not Antifa. And how about here in Canada? Pastor Derek Reimer was assaulted — he didn't assault anyone. He's been charged; but not those who attacked him. Danielle Smith's sovereignty act suggests she might take some steps; her firearms act is an example. But where is the prosecution of Antifa, of eco-terrorists? DeSantis shows the way that we too could fight back in Canada.

Democrats came into office in 2021 and pushed through a $1.9 trillion bill. Then in August 2021, Democrats voted for infrastructure bill spending trillions. On Thursday's Mark Levin Show, in December of 2020, a Republican Congress spent trillions on a COVID bill. Democrats came into office in 2021 and pushed through a $1.9 trillion bill. Then in August 2021, Democrats voted for infrastructure bill spending trillions. Every Democrat voted for these trillions in spending as did 19 Republicans who have all contributed to the inflation we are facing today. Banks are facing loan issues; companies will begin layoffs and the Federal Reserve will likely raise interest rates to slow the economy and the growth of inflation. Then, the degrowth movement is destroying our industries, Biden's open border policy is allowing men that rape 10-year-old girls into the country, and we're still not producing enough domestic energy. Biden has done more to destroy our energy industry than any foreign enemy. According to them, the January 6 hearings will “give Democrats a chance to recast the midterm message.” Think about what they are admitting with that headline. They want to use the hearings as a way to “recast” the midterm message. They are admitting everything Joe Biden touches has turned rotten and they have no winning play heading into November. But, wait! Let's hire a television news director to help us create a primetime special, with all of the reality of professional wrestling. Every Democrat running for office can then use it to remind their voters how all Republicans are seditious white supremacists. Now we know, with these two moves, this committee has nothing substantive to deliver. They already have the legacy media on their side, ready to propagandize whatever grandstanding they were planning. They have Big Tech ready to suppress truth and promote the approved narrative. Why go through all this trouble to turn it into a primetime reality series unless they know they have nothing to run on in the Fall and are hoping this is their Hail Mary pass into the end zone? Eventually we’ll get to the winter part of winter, right?Water coolerAs of this morning, the Virginia Department of Health reports 4,598 new positive cases of the coronavirus in the Commonwealthand 75 new deaths as a result of the virus. VDH reports 455 new cases in and around Richmond (Chesterfield: 153, Henrico: 162, and Richmond: 140). Since this pandemic began, 613 people have died in the Richmond region. That’s three days in a row now with case counts less than 5,000; the mini trend holds! Hospitalizations, however, continue to creep back up to their highest point in the pandemic. The statewide seven-day average of deaths, which typically lag behind hospitalizations, is now at an all-time high. Yesterday and the day before were the second and third worst days for new reported deaths—the only more deadly day, according to the data dashboard (which is not reality), involved a data reporting issue. But! Hard work on distributing the vaccine continues! The Richmond, Henrico, Chesterfield, and Chickahominy Health Districts will begin opening up Phase 1b of their vaccination distribution plans this coming Monday, January 18th. While Phase 1a focused on healthcare workers and residents of long-term care facilities, Phase 1b includes people aged 75 or older, frontline essential workers (defined ultra broadly), and people living in correctional facilities and homeless shelters. Next week, out of that large group of people, the Health Districts will start vaccinating “police, fire, and hazmat; corrections and homeless shelter workers; and childcare/PreK–12 Teachers/Staff.” For whatever reason, moving into Phase 1b and including folks outside of healthcare makes me feel like I really can see through to the end of all this. I know a bunch of teachers! They can start getting vaccinated! That’s awesome! I imagine there’s more news coming about how folks in these Phase 1b categories can actually factually register for their vaccines, but, until then, Phase 1b workers or employers in Richmond and Henrico can fill out this vaccine interest form: vax.rchd.com.The Governor delivered his State of the Commonwealth Address last night, and you can read through the entire thing as prepared here or watch the hour-long speech over on YouTube. Mel Leonor at the Richmond Times-Dispatch watched the speech so you don’t have to. Items of note: Northam promised to follow the new federal guidance to begin vaccinating people aged 65 and older as soon as possible, increase the evictions relief trust fund by $25 million, give teachers a 2% bonus, legalize marijuana, and restore the voting rights of felons. Who knows what on this list he’ll get accomplished over the next couple of months, but it’s a pretty good list!Also on the GA tip, the RTD’s Mel Leonor and Micheal Martz report that House Speaker Eileen Filler-Corn stripped three republicans from their committee assignments because they seditiously supported overturning the results of a democratic election. I say give them the boot entirely, but that’s why I’m not an elected official. Meanwhile, the coronavirus is surging in multiple states, which could mean new lockdowns are coming. And lastly, another huge win for progress in South America, as Chile voted to finally abandon it’s dictator-era constitution that has been in place since a U.S.-backed coup installed right wing mass murderer Augusto Pinochet in power nearly 50 years ago. THESE ARE THE STORIES YOU NEED TO KNOW: We have a new justice on the Supreme Court. After a blitzkreig confirmation process and a hasty swearing-in ceremony, Mitch McConnell and Donald Trump successfully installed Amy Coney Barrett on the Supreme Court on Monday night. The Senate voted 52-48. Every Democrat, Independent, and Republican Susan Collins of Maine voted against Barrett, but it did nothing to Mitch McConnell’s ironclad majority. After the vote, the White House put together a slapdash swearing-in ceremony on the South Lawn to get Barrett on the bench as fast as possible. It’s hard to fully grasp what this news means. Some of the first cases Barrett sees will be related to elections in North Carolina and Pennsylvania, and she could also be part of a ruling if election results next week get challenged. If Trump does try to steal the election with the courts, Brett Kavanaugh and ACB will likely be solid votes in his favor, further bolstering the conservatives’ 6-3 majority even if Chief Justice John Roberts decides to flip and, you know, not do fascism. A strong indication that this is exactly what would go down: earlier today the Supreme Court ruled that Wisconsin would not have to continue counting absentee ballots that were postmarked by election day but arrived late, setting up a strong precedent for throwing out votes all over the place. And even if Biden does manage to take power, Barrett might be able to rule on a case that pertains to Roe V. Wade before he’s even in office. Meanwhile, the Democrats still, STILL seem fully opposed to fighting back in any way or taking steps toward reform. Earlier today, Joe Biden told reporters that he wouldn’t consider term limits for SCOTUS members. Quote “It’s a lifetime appointment. I’m not going to attempt to change that at all.” Endquote. There you have it. Coronavirus Once Again Surging Meanwhile, the coronavirus pandemic is starting to pick up steam again. Yesterday we mentioned that spikes in cases in Utah were so severe hospital administrators were preparing to ration care. Texas’s total cases have now surpassed California, with more than 910,000 total. The number of new cases in those states have increased by 19 percent and 15 percent respectively. Cases elsewhere nationwide are also climbing. In Europe, which is seeing similar spikes, many countries are preparing for a second wave of lockdowns and travel restrictions, which are basically the only way left to get a handle on the increases. But it’s unlikely that the U.S. will enact policies like that with Trump in power, and if we did, the fact that no new aid is on the way from the government means that people are going to suffer massively either way. Some state governors are doing what they can. Idaho, for instance, is preparing to enact new restrictions to grapple with a spike. But if you remember from yesterday, the Trump administration has publicly said it’s not going to try to control the disease anymore, instead focusing on cures and vaccines. The problem is those aren’t going so well either: the drug maker Eli Lily said on Monday that it’s antibody treatment does not work on patients with advanced COVID-19, and that its government sponsored trial would not be giving the drug to new patients. That’s just one treatment, of course, but it seems clear that we’re a lot further from a stable cure or vaccine than the President wants us to think. Chile Chucks Constitution Outside of the country, however, there is some good news. Voters in Chile overwhelmingly rejected the country’s outdated, repressive constitution, which had been in place since a U.S.-backed right-wing coup installed Augusto Pinochet as leader of the country. The fact that Pinochet’s constitution was still the binding legal document of the country 50 years later is surreal, and finally, after months of protests, the Chilean people had their voices heard. They voted by a massive 4 to 1 margin to approve the creation of a new constitution. Catalina Miranda, a Chilean who was among the crowd of thousands celebrating the result in Santiago’s Plaza Italia, told the Guardian quote: “We’ve been living under an illegitimate constitution created by a military regime, that’s only allowed progress to those who have money. There’s been very few times that Chilean people have shared a collective victory like today.” Endquote. Sounds uh... oddly familiar! Perhaps, especially given the travesty of governing that we’ve seen out of the Senate GOP and Trump administration, Americans could take a few notes on throwing out their Constitution and making something better. AND NOW FOR SOME QUICKER QUICKIES: In an interview with Fox and Friends on Monday, Jared Kushner gave the racism dial a good old crank by questioning whether or not Black Americans quote “want to be successful,” after claiming that his father in law had done so much for them. Also on Monday, Trump imposed a new set of sweeping economic sanctions on Iran’s oil sector, seeking to kneecap any future foreign relations a Biden administration would have with the country and ratchet up tension further before the election. Sources told the Washington Post that state and federal antitrust charges against Facebook could come as soon as November, which would be a major step toward breaking the social network’s stranglehold over almost every facet of American life. And finally, Charles Beckham III, a candidate for State Senate in Arkansas, was expelled from high school because he wore a KKK outfit on Halloween. As much as this refrain is obnoxious because we keep having to saying it, but, if the roles were reversed everybody would know about it. If a white man drew a pistol and shouted “I don’t want black people in my neighborhood” we would hear endless coverage from the liberal media, they would have panels discussing how Trump’s tweets encouraged this behavior and there would be a Congressional hearing to discuss “white supremacy” as domestic terrorism. Civil rights leaders would descend upon Cincinnati to help with the healing of the community through such an awful tragedy. Late night comedians would stop their jokes and stare straight into the camera with as serious a face as they could muster and discuss how awful this incident was and how we need to stop dividing America. Allows people diagnosed with a life-threatening diseases or conditions who have exhausted approved treatment options and can’t participate in a clinical trial on an experimental drug that has not been FDA approved to get that drug directly from the drug company, with a doctor’s approval. Allows drug companies to sell their unapproved drugs directly to customers as long as the drugs have to have been through a completed Phase 1 of a clinical trial. This law says the Secretary of HHS can’t use the clinical outcomes of the patient’s use of the drug to delay or adversely affect the review or approval of the drug, unless he/she certifies it’s for safety reasons or the drug company requests that data be used. Gives legal immunity to the drug companies, prescribers, dispensers or an “other individual entity” unless there is willful misconduct, gross negligence, to the intentional breaking of a state law. That area and those workers helped us win World War II, and the site’s nuclear program was instrumental in projecting peace through strength throughout the Cold War. While the community has been a constructive partner in support of our vital national security missions, it did not agree to serve as a perpetual storage site for the resulting nuclear waste. Fifty-six million gallons of toxic waste sitting in decades-old metal tanks at Hanford—these are those tanks that were being constructed to hold this waste. They are now buried in the ground. The only entry point is right here. The amount of waste stored at Hanford would fill this entire House Chamber 20 times over. According to a recent Government Accountability Office report, the oldest of these tanks, some of which date back to the 1940s, have single-layer walls, or shells. They were built to last 20 years. They will be almost 100 years old by the estimated end of their waste treatment. The Department of Energy has reported that 67 of these tanks are assumed or known to have leaked waste into the soil. There is an understandable sense of urgency in the Northwest behind the cleanup efforts that are under way at Hanford. H.R. 3053 will provide the pathway to clean up the contaminated Hanford site. You see, the waste from Hanford will end up in a secure permanent storage site that we believe will be Yucca Mountain. 35:15 Representative Greg Walden (OR): The legislation authorizes the Department of Energy to contract with private companies to store nuclear waste while DOE finishes the rigorous scientific analysis of the repository design and the associated Nuclear Regulatory Commission licensing process. So, an interim storage facility can bring added flexibility to DOE’s disposal program and may provide a more expeditious near-term pathway to consolidate spent nuclear fuel. 41.31 Representative Fred Upton (MI): In my district, we have two nuclear plants. Both of them have run out of room in their storage, so they have dry casks that are literally a John Shimkus baseball throw away from Lake Michigan. Every one of these 100-some sites across the country is in an environmentally sensitive area, and at some point they’re going to run out of room. In Michigan, we’ve got two other sites that also have dry casks in addition to the two in my district. 45:05 Representative Buddy Carter (GA): This legislation is important not only because of what it means to the future of clean-energy opportunities for this country, but also what this means for our communities. Nuclear energy has become a safe and effective way to generate energy, all while not producing greenhouse gas emissions. 53:29 Representative Leonard Lance (NJ): New Jersey is home to four nuclear reactors at three generating stations: Oyster Creek, Hope Creek, and Salem. Oyster Creek will be closing this October. In the congressional district I serve, these plants account for about half of the power generation and 90 percent of the carbon-free electricity. New Jersey’s nuclear plants avoid 14 million tons of carbon emissions each year. Public Service, FirstEnergy, and Exelon are doing their part in storing their station’s spent nuclear fuel on-site, but we need a permanent site. The expertise and know-how of the federal government has a responsibility to my constituents and to the American people. I want the 3,000 metric tons of nuclear waste out of New Jersey and consolidated in a national protected facility. 58:54 Representative Dina Titus (NV): The first ‘‘Screw Nevada’’ bill was passed in 1982, and since that time, Nevada’s residents, elected officials, business leaders, health and environmental groups have steadfastly opposed the Yucca Mountain repository. I ask unanimous consent to enter into the record over 100 letters from those groups in opposition. 59:19 Representative Dina Titus (NV): You’ve heard that the legislation before you now, ‘‘Screw Nevada 2.0,’’ is a work of compromise, a bipartisan effort, not perfect, but a step forward. Well, that, frankly, is an opinion. It’s not the facts. Here are the facts: the legislation overrides environmental laws, allowing the EPA to move the goalposts in terms of radiation limits to ensure that nothing will ever interfere with the agenda of the nuclear industry. It sets up a consent-based process for the establishment of an interim storage facility but imposes a permanent facility at Yucca Mountain. It increases the amount of nuclear waste to be dumped in Nevada by 37 percent, 110 metric tons more that were not considered in any of the environmental or safety studies being used to justify the project. It also removes the prohibition currently in law that prohibits Nevada from being the de facto interim storage facility until a permanent one can be licensed. It was also changed after passing out of committee to address the high scoring costs—is it already three minutes? Chairman: Gentlewoman’s time has expired. Representative Paul Tonko: Mr. Speaker, we grant the gentlelady another minute. Chairman: Gentlelady’s recognized. Rep. Titus: Thank you. —to address the high scoring costs, making it less likely that we get host benefits. Also, contrary to the sponsor’s comments, the area around Yucca Mountain is not some desolate area. It has iconic wildlife, endangered species, and Native American artifacts. Also, the proposed facility sits above the water table and on an active fault and can only be reached by roads that travel through 329 of your congressional districts. 1:03:53 Representative Ruben Kihuen (NV): You know, Mr. Speaker, I find it offensive. I sit here and listen to all my colleagues, and they all want to send nuclear waste to the state of Nevada. They’re all generating this nuclear waste, and they want to send it to my backyard right in the Fourth Congressional District. You know, bottom line is this, Mr. Speaker: if you generate nuclear waste, you should keep it in your own backyard. Don’t be sending it to our backyard. 1:11:27 Representative Joe Courtney (CT): Next to me is a picture of Haddam Neck, Connecticut, which is a pristine part of the state where the Connecticut River and the Salmon River come together. Where the circle is on the photograph, there are 43 casks of spent nuclear power uranium rods that, again, today, pretty much cordon off that whole area. If you drove up in a car, you’d be met by a platoon of heavily armed security guards who, for good reason, have to patrol that area every single day because of the dangerous material that is stored there. That has been the case for over 20 years. It costs Connecticut ratepayers $10 million a year, again, for a site that should be long overdue for renovation and access to folks from all over the world because of its rich archeological and historical area. This bill provides a way out for this area, along with 120 other sites across the country, that host communities have been saddled with storage of spent nuclear fuel because of the fact that this country has been unable to come together with a coherent policy. And this bill provides a way out. 1:15:23 Representative Dana Rohrabacher (CA): This bill authorizes the construction of Yucca Mountain as a nuclear waste storage site, which would alleviate the burden of incredible risk that is now borne by communities throughout the country, such as in my district, where homes are not far located from the closed San Onofre Nuclear Generating Station. That, and many other plants throughout the nation, have closed their doors in decades. Yet, Congress has yet to agree of how to safely store that waste, while—and what’s really important is we must store the waste—but while we develop new nuclear energy technologies, that we are capable of doing, that are safe and produce less of their own waste and can consume the waste of older plants—I reminded Secretary of Energy Perry of that yesterday—but, in the meantime, until that technology—by the way, it is sinful that we have not developed that technology, which we are capable of, that could eat this waste—but until we do, having safe storage at Yucca Mountain makes all the sense to me and is safe for my constituents. 1:17:07 Representative Rick Allen (GA): Mr. Speaker, I have the great honor of representing Georgia’s 12th Congressional District, which is home to every nuclear reactor in our state, and we are leading the way in the new nuclear. At Plant Vogtle, in my district, there are thousands of spent fuel rods being held in spent fuel pools and dry cask storage containers, and in the next few years we’re going to double the number of nuclear reactors online at Vogtle. It’s really the engine of our economy in the Northwest, because what happens on the Colville National Forest determines whether or not we have Vaagen’s lumber or 49 Degrees North ski resort or the biomass facility that Avista runs, converting wood waste into electricity. This is all providing jobs, energy, recreational opportunities. Yet mills have been closed, jobs have been lost. It’s unacceptable. It’s time to pass the Resilient Federal Forests legislation. 5:32:57 Representative Jeff Denham (CA): The Resilient Federal Forests Act gives us the tools to immediately reduce the threat of catastrophic wildfires. It allows us to expedite the removal of dead trees and rapidly mitigate disease-infested areas. 5:41:58 Representative Louie Gohmert (TX): If you want to just leave it to nature, nature will destroy massive numbers of acres of land. So we have a responsibility. House Republicans sent a version to the Senate in the 113th and the 114th Congress, where it languished on the shelf because our colleagues on the other side of the Capitol found it too extreme. Rather than view that experience as an opportunity to seek compromise, this time around, today, we are considering a bill that is even more extreme and polarizing. They doubled the environmental review waivers, added language to undermine the Endangered Species Act, and scaled back protections for national monuments and roadless areas. 6:07:39 Representative Raul Grijalva (AZ): But this bill is not about forest health or wildfire mitigation; it’s about increasing the number of trees removed from our forests. 6:18:24 Representative Tom McClintock (CA): You know, there’s an old adage that excess timber comes out of the forest one way or the other—it’s either carried out or it burns out. When we carried it out, we had resilient, healthy forests and a thriving economy, as excess timber was sold and harvested before it could choke our forests to death. In the years since then, we’ve seen an 80 percent decline in timber sales from our federal lands and a concomitant increase in acreage destroyed by forest fire. I would remind my friend from Oregon that timber sales used to generate us money, not cost us money. The direct revenues and spin-off commerce generated by these sales provided a stream of revenues that we could then use to improve our national forests and share with the local communities affected. 6:22:38 Representative Jared Huffman (CA): Title I of this bill allows intensive logging projects of 10,000 to 30,000 acres each. That’s as big as the entire city of San Francisco. Projects of that size can proceed on federal public lands without any environmental review under NEPA, without any compliance with the Endangered Species Act. Title II of the bill eliminates the requirement that the Forest Service consult with the Fish and Wildlife Service; essentially, lets the Forest Service decide for itself if it wants to follow the Endangered Species Act consultation requirements regarding any of its projects on public lands. Title III further chokes judicial review by prohibiting the recovery of attorneys' fees for any challenges to forest management activity under the Equal Access to Justice Act, including meritorious successful challenges.
