First, we sit down with Senator Ted Cruz to discuss the recent political attacks on the Supreme Court and what conservatives can do about woke corporations. Later in the show, General Sami Sadat of Afghanistan calls in for a no holds barred conversation of the United States' withdrawal from his country. Finally, friend of the show Chris Campbell returns with an update on the negotiations over raising the debt ceiling. -Ted Cruz grew up in Texas. His father, Rafael, fled Cuba after being tortured and imprisoned and came to Texas with just $100 sewn into his underwear. Rafael got a job washing dishes making 50 cents an hour and learned English. He worked hard and attended the University of Texas at Austin, earning a degree in mathematics. He later started a small business in the oil and gas industry. Today, Rafael is a pastor in Dallas.Ted's mother, Eleanor, was born in Delaware to an Irish and Italian working-class family. She became the first in her family to go to college, graduating from Rice University with a degree in mathematics. She broke boundaries at Shell as one of the few women working as a computer programmer at the dawn of the computer age.Ted earned his undergraduate degree from Princeton and his law degree from Harvard Law School. After law school, Ted clerked for Chief Justice Rehnquist and then worked in private practice. In 1999, Ted joined George W. Bush's campaign for president as a domestic policy advisor. The best thing about Ted's experience on the Bush-Cheney campaign, by far, was meeting Heidi Nelson, who also worked on the policy team. Heidi and Ted married after the campaign.After working at the Department of Justice and the Federal Trade Commission during the Bush administration, Ted moved back home to be the Solicitor General of Texas. As Solicitor General, Ted argued eight cases before the Supreme Court of the United States, and defended our freedom of speech, our right to keep and bear arms, and our religious liberty in courts across the nation. Following his service as Solicitor General, Ted returned to private practice, where he continued to litigate high stakes cases and argued his ninth case before the Supreme Court.Ted and Heidi also started their family, welcoming Caroline and Catherine.-General Sami Sadat was born 1986 in Afghanistan. After graduation from school in Kabul, he studied military information operations in NATO school in Germany, he also holds a BBA, he then studied advance command and staff college in UK defense Academy and was graduated with highest distinction and also has finished his MA in Strategic Management and Leadership from UK Charter Management institute.His work experience is mostly visible in security sector, he worked as Deputy Director for Strategic Communications and as Policy Advisor to the Minister of Interior in Afghanistan. Mr. Sadat is a founding member of Afghanistan Analysis and Awareness (A3) a Kabul based Think-tank. A3 is a strong lobby group focusing on Afghan-US and other Afghanistan friend countries to foster better strategic relations.-Prior to Kroll, Chris was unanimously confirmed by the U.S. Senate to serve as the Assistant Secretary of the Treasury for Financial Institutions from 2017 to 2018. In that role, he was responsible for coordinating the Department's efforts regarding financial institutions legislation and regulation, legislation affecting federal agencies that regulate or insure financial institutions and securities markets legislation and regulation. Specific policy and program areas of oversight included government-sponsored enterprises, critical infrastructure protection (cyber security) and compliance policy, the Federal Insurance Office (FIO), small business, community development and affordable housing policy.Chris was the Treasury board representative on the boards of the Pension Benefit Guarantee Corporation (PBGC) and the Financial Industry's Critical Infrastructure Group. He regularly met with the heads of the 15 federal financial regulators. Additionally, he oversaw the Deputy Assistant Secretaries for Financial Institutions Policy and Small Business, Community Development and Affordable Housing, and Cyber Security, in addition to a staff of 200.Prior to his role at the Treasury department, Chris was the majority staff director to the U.S. Senate Committee on Finance. He designed, managed and coordinated the U.S. Senate Republican agenda in the areas of international and domestic taxation, international trade, Medicare, Medicaid, Social Security, the U.S. National Debt, and oversight of three presidential cabinet secretaries. He was named by Roll Call Newspaper as one of the 50 most influential staffers on Capitol Hill, seven years running. Previously, he served as legislative director to Senator Orrin G. Hatch, where he coordinated and managed the senator's legislative activities.Immediately prior to rejoining Senator Hatch's staff, Chris owned a business consulting firm that specialized in business strategy for clients from all-sized companies across the country, and from a variety of industries.Chris is a director of Intrado, Coinstar, WeConnect Health Management, tZERO, and a board advisor at Cross River Bank. Additionally, he is a Professor of Practice at his alma matter, Thunderbird School of Global Management. He also serves as a strategic advisor and consultant to several large national and international organizations. This week on Breaking Battlegrounds, we are honored to be joined by three distinguished guests: Congresswoman Carol Miller of West Virginia, Congressman Josh Brecheen of Oklahoma, and former Assistant Secretary of the Treasury for Financial Institutions Chris Campbell.-Congresswoman Carol Miller represents West Virginia's First Congressional District. Miller serves on the Committee on Ways and Means.Miller's focus in Congress is creating jobs, diversifying the economy, innovating and improving infrastructure, protecting America's borders, and supporting West Virginia's energy industries like coal, oil, and gas.Prior to her election to Congress in 2018, Congresswoman Miller served in the West Virginia House of Delegates from 2006 to 2018 where she rose to become the first female Majority Whip.A mother of two and grandmother of seven, Carol Miller is married to her husband Matt, and lives in Huntington, where she owns and operates Swann Ridge Bison Farm and manages real estate. Miller was born in Columbus, Ohio and is the daughter of Congressman Samuel L. Devine and Betty Devine.-Josh Brecheen (pronounced Bra-keen) is a committed Christian, husband, father, and is a fourth generation rancher in Coal County, Oklahoma. Prior to his time in Congress, he owned and operated a small excavation and trucking business, Rawhide Dirtworks L.L.C. He served as an Oklahoma State Senator from 2010 to 2018, obtaining an overall voting record as the third most conservative senator among those with whom he served. He was the original author of measures that included capping state debt, banning dismemberment abortions, and a true repeal and replace of the common core educational standards—the nation's first. From 2004 to 2010, Brecheen worked for U.S. Senator Tom Coburn, M.D. as a field representative, working directly with Oklahoma constituents and evaluating federal programs for waste and inefficiencies.  Brecheen is a graduate of Oklahoma State University, where he earned a dual degree in agriculture. He served the Oklahoma FFA Association as State President in 1999 and later worked seasonally for the National FFA Organization as an ALD conference presenter. Until 2010, he brought inspirational messages into approximately 500 public schools, universities, and conferences through his motivational speaking business, Brecheen Keynotes and Seminars and also as a free service when employed by Tom Coburn.  Brecheen grew up in the professional cutting horse industry and in his youth was a two-time national qualifier for the National Cutting Horse Association Eastern Championship show. After college, Brecheen started training cutting horse futurity prospects as a “non pro” and has been raising quality cow horses for over 20 years.   As a member of Congress, he is focused on reining in our unsustainable debt and deficit spending, which he is convinced is undermining our national security.-The Honorable Christopher E Campbell is the Chief Strategist at Kroll, based in the New York office. As a Fellow of the Kroll Institute, he is a frequent guest commentator on national news programs on matters involving the economy.Prior to Kroll, Chris was unanimously confirmed by the U.S. Senate to serve as the Assistant Secretary of the Treasury for Financial Institutions from 2017 to 2018. Since then he has focused on the crypto space building the crypto business inside Cross River. Today, he is building a new startup focused on crypto that is still in stealth mode.He talked about one of the silver linings of the this unique time period is that in Congress there is bipartisan support for legislation that will bring crypto into a regulatory framework. That is what the industry needs to move forward.Another positive of the crypto winter is that DeFi has proven itself to be more resilient with the likes of MakerDAO, Compound and Aave performing as expected. This week on Breaking Battlegrounds, Chuck and Sam are joined by Chris Campbell, former Assistant Secretary of the Treasury for Financial Institutions and David Keene, Editor at Large at the Washington Times. The Honorable Christopher E Campbell is the Chief Strategist at Kroll, based in the New York office. As a Fellow of the Kroll Institute, he is a frequent guest commentator on national news programs on matters involving the economy.Prior to Kroll, Chris was unanimously confirmed by the U.S. Senate to serve as the Assistant Secretary of the Treasury for Financial Institutions from 2017 to 2018. In that role, he was responsible for coordinating the Department's efforts regarding financial institutions legislation and regulation, legislation affecting federal agencies that regulate or insure financial institutions and securities markets legislation and regulation. Specific policy and program areas of oversight included government-sponsored enterprises, critical infrastructure protection (cyber security) and compliance policy, the Federal Insurance Office (FIO), small business, community development and affordable housing policy.Chris was the Treasury board representative on the boards of the Pension Benefit Guarantee Corporation (PBGC) and the Financial Industry's Critical Infrastructure Group. He regularly met with the heads of the 15 federal financial regulators. Additionally, he oversaw the Deputy Assistant Secretaries for Financial Institutions Policy and Small Business, Community Development and Affordable Housing, and Cyber Security, in addition to a staff of 200.Prior to his role at the Treasury department, Chris was the majority staff director to the U.S. Senate Committee on Finance. He designed, managed and coordinated the U.S. Senate Republican agenda in the areas of international and domestic taxation, international trade, Medicare, Medicaid, Social Security, the U.S. National Debt, and oversight of three presidential cabinet secretaries. The Paycheck Protection Program (PPP) is back for another go.This revived PPP will run through March 31. If you applied and received PPP aid in the first go-around, you can apply and, hopefully, receive money again. The PPP package contains $285B to eligible small businesses for additional loans even to businesses that received PPP loans before as well as to first-time business applicants. Here are the specifics we know at this point: - Runs through March 31- Program reopened to businesses that have already received help plus “new” small business applicants- Loans are tax-free- Loans guaranteed by the Small Business Administration but made by banks and other lenders- SBA spokesperson – “next round of PPP (to be) launched as quickly as possible”- Funds can be used for payroll, rent, utilities PLUS supplies from vendors, protective equipment for their staff, or to fix property damage - Must have fewer than 300 employees and have had a -25% drop in sales from one year earlier in at least one quarter to qualify for loan up to $2M- Borrowers limited to 2.5 times their payroll – only hotels and food service businesses eligible for 3.5 times payroll- Publicly-traded companies are ineligible for these funds- Most active lenders in first round included Bank of America, JPMorgan Chase, Cross River Bank and Wells Fargo- Allows business owners who received loans in first round to claim deductions for expenses they paid for with loan proceeds- Loans may become grants if and when the program recipient is in compliance with all requirements and reporting documentation thoroughly and completely Thanks to The New York Times. My guest today is pioneering a crucial innovation within the innovation landscape in finance -- by providing banking services to fintechs through a platform-based financial services model known as the sponsor bank, or partner bank. In today’s episode, Gilles Gade tells the story of founding and building one of the leading sponsor banks, Cross River. Most fintech companies are licensed by their states, but are not banks. That means that every one of them has to find a bank through which to clear payments and connect to the payments system (which only banks can do). That’s not easy -- many fintechs struggle with this because banks are required by their regulators to set up complex systems for due diligence and risk management in dealing with any kind of third party that could affect the bank’s soundness or its customers’ wellbeing. Over the last decade or so, this challenge, combined with the enormous potential of the fintech market, prompted a number of banks to focus on meeting this need -- Gilles points to Webbank as leading the way. These banks have to meet a range of specialized needs including, crucially, taking responsibility for the partner fintechs’ compliance with regulatory requirements. Gilles describes founding Cross River in 2008, when the financial crisis had curtailed many kinds of consumer and small business credit, and talks about how new companies emerged to fill the gap, with either new kinds of products, or new ways of creating access to old products. He points to fintech lenders -- like Affirm, Lending Club, and Sofi -- and also to payments-focused companies like Coinbase, Transferwise and ActiveHours, as innovators that are opening up more inclusive finance. Gilles is especially thoughtful on regulatory issues, which he calls “by far” the biggest challenge for the fintech world. He emphasizes that the single biggest difficulty is sheer uncertainty, as technology change outstrips traditional regulatory change mechanisms. Gilles cites the Madden v. Midland litigation, with its controversy over national versus state interest rates, and the “valid when made” doctrine, as issues that need clarity so that lenders can build stable business models. Gilles also has thoughts on the Comptroller of the Currency’s proposal for creating a special fintech charter (note that we recorded this discussion during the tenure of Keith Noreika as Acting Comptroller of the Currency). Gilles laments that we have no fewer than 12 federal regulators involved in these issues (I myself have actually counted twice that many, directly and indirectly involved). Like me, he’s optimistic about the innovation efforts of the regulatory agencies -- he mentions the OCC in particular -- and of congressional leaders like Congressmen Patrick McHenry (R-NC) and Gregory Meeks (D-NY) -- both of whom, I’m delighted to say, are going to be guests on our show. My guest today is Andres Wolberg Stok, Global Head of Policy at Citi Fin Tech. We got to know each other this year on a panel at FinXTech in New York, and something I immediately noticed is that he has a special way of talking about innovation -- a very fresh way with words. It might be because he’s lived all over the world, or because he was once a journalist -- see his biography below for a sampling of his journalism adventures, which sound like plots of action/adventure movies. All large banks have innovation initiatives -- labs, accelerators, incubators and the like. They’re all looking at issues like blockchains, big data, artificial intelligence and human-centered design -- such as, creating a user experience that customers will actually love. Banks have plenty of innovative people, of course -- in our talk, Andres quotes CEO Michael Corbat saying that Citi is actually a technology company with a banking license. However, very few banks of any size have really innovative cultures. This is partly because most are mature organizations, and also because banking has been heavily regulated for so long, which tends to foster conservative, risk-averse cultures and decisionmaking. In today’s world of rapid technological change, banks need innovation (and many innovators need banks as well). It’s important that the big banks are investing in learning how to do this well. Citi Fin Tech was formed in late 2015 to pursue what Andres calls “fintegration.” The impetus was a critical insight: they realized that their customers’ standards had fundamentally changed. Instead of comparing Citi to other banks, there was a new yardstick -- comparison to technology firms. That set a new, high bar. Andres explains how they’re tackling this challenge. He describes the new kinds of skills they hire. He explains their focus on agile methodology and co-creation of products and learning to experiment. He talks about building multidisciplinary teams that work concurrently on initiatives, instead of sequentially in the old waterfall-style process that could divert an innovation from what had originally made it exciting. He talks about obsessing on the consumer experience and doing thousands of focus groups to understand what customers really think. He also talks about how the bank should “feel in the palm of the customer’s hand.” He calls mobile an “exoskeleton” for the human mind, connecting us to all the world’s information, all the time. He talks about the issues ahead in AI, privacy, and data aggregation, including the challenges for regulators. He says the key, for regulators, is to understand the upside benefits of technology, not just the risks. Andres explains how Citi Fin Tech works with innovators, including startups -- note that he invites people to come and work with them using their API’s and data. That site is at https://developer.citi.com. I think my favorite insight is that banks need a new model that’s open, not closed. He says the customer relationship used to be one-to-one between a bank and its customers -- and of course, the regulations are still mostly built for that. Now, though, there are multiple parties -- consumers use apps and “modular” financial relationships. If the bank wants to continue to be at the core of that customer relationship, they will have to build an open model -- and regulators will have to change with it. As you listen, think about how regulators and also community banks could get access to this kind of hands-on experience with financial innovation. The sooner they do, the faster the system and its customers will benefit from, as Andres puts it, “breaking a few windows and letting in fresh air and sunshine.” More on Andres Andres Wolberg-Stok interfaces with regulators and policymakers around the world as the Global Head of Policy for Citi FinTech, a new unit spearheading the transformation of Citi’s Global Consumer Banking business into a mobile-centric “Bank of Tomorrow”. He joined Citi from an international personal finance startup and has served in a variety of digital roles, first for Citi Latin America, then for Citi's U.S. consumer businesses, and now globally. Andres was one of the founders of Citi FinTech from his previous role as Global Head of Emerging Platforms and Services for Citi’s Consumer businesses. In 2015, Andres turned Citi into the world's first bank with an Apple Watch app. Earlier, as Citi Consumer's first global head of mobile banking, he invented Citi Mobile Snapshot, a patented 2014 breakout feature that made Citi the first major U.S. bank to offer no-login account access. Prior to becoming a banker, Andres was an international correspondent and senior news executive. He had tea with mass-murderer military dictators; was driven, blindfolded and at gunpoint, around the capital of Paraguay after midnight; was arrested in Tierra del Fuego on suspicion of being a British spy; and raced in a car at 120 mph along the edge of a minefield in Croatia. He finds most days in banking very manageable. Originators are beginning to look at launching their own captive funds; at LendIt USA 2017 we hosted a panel featuring Cross River Bank, Freedom Financial, Money360, Credibly, UBS and Clifford Chance to discuss this idea; the originators on the panel talked about their current funds, if they have launched one, size, structure and how they currently view the idea of this vehicle in the long term; the panelists focused on diversification of funding sources; in good times it is never hard to get loan purchasers but when markets tighten how can you make sure you are prepared; they also talked about when setting up this funding vehicle should you manage it yourself or should you find a third party fund manager; how do conflicts of interest come into play when the originating company is then investing in the loan and servicing the loan; there are still many questions when it comes to setting up a fund like this; as more firms look to this option we will better understand how to answer these questions in the future.
