Eric Johnson of LogTech Live talks about the new FMC detention and demurrage billing rules - the changes, challenges & what they mean for businesses. IN THIS EPISODE WE DISCUSS: [06.58] The latest from Eric – an update from Home Delivery World, two upcoming events, and how to get involved with the Blended Pledge. “Remember when everyone said ‘when the pandemic is over, everything will slow down' – it didn't, it never slows down!” [11.52] The big industry news of the week. “Now we've had Convoy and Transfix, within 6 months of each other, become defunct as brokerage brands… A lot of people are talking about whether the digital brokerage model worked on its own (as it was pitched to VC's a decade ago).” [17.31] An introduction to Eric's guest, Alexandra Griffon, and her company BlueCargo. “Historically truckers and drayage providers were the ones risking the per diem, detention, and demurrage costs, but this has changed. Shippers want to internalize this cost, and have control… Between 2020 and 2022, US importers, forwarders, and drayage companies paid $15 billion – that's the lack of control they don't want to go back to!” [23.35] The new detention and demurrage rules issued by the FMC – the big changes and what they mean for businesses. “Now it's 30 days to issue an invoice, and another 30 days to issue a dispute or challenge – it's a very strict timeline. And there are new data requirements that have to be on an invoice for it to be deemed valid.” [33.03] From data to the burden of responsibility, the biggest challenges with the new rules and regulations. “It's very hard to make sure your data is accurate. Just something as simple as the start or end date sometimes varies based on the source…. Having the data is a good thing… but there are lots of gray areas.” [47.16] When the new rules took effect, and how the dates impact what you can dispute now. “You need to engage to get your own access to the original source of data.” [50.57] Alexandra's favorite song. Our guest on this week's episode is Evan Dexter, vice president, rental product management at Ryder System, Inc. Tomorrow is Veteran's Day, a day we remember our military families and the important work they do to safeguard all of us. One of the ways our industry helps to support our troops is through programs designed to transition veterans into logistics jobs. We hear how Dexter made that transition himself and how his company works to bring other vets into the logistics industry. New laws in California will require that about half the trucks sold in California must be all-electric by 2035. As a step toward this goal, we report on an effort by the ports of Los Angeles and Long Beach to award $60 million in vouchers for the purchase of new electric trucks for drayage operations within the ports.Facing a host of economic and labor challenges, manufacturers are sharpening their focus on frontline workers as a way to differentiate and propel their organizations forward. That's according to recent research from consultancy PwC and the Manufacturing Institute, which is the workforce and development arm of the National Association of Manufacturers. Matt Soule, CEO and Co-Founder, Parallel Systems joined Grayson Brulte on The Road to Autonomy podcast to discuss how Parallel Systems will act as an economic growth engine for the rail industry. The conversation begins with Matt discussing how Parallel Systems business has evolved since he last joined Grayson Brulte on The Road to Autonomy roughly year ago. During this time, Parallel has been testing their Gen2 vehicle in the United States and has deployed a Gen1 vehicle overseas. As they gear up to deploy their Gen2 vehicle, the company is preparing up to test railworthiness at the Transportation Technology Center (TTC) in Pueblo, Colorado. We will run our vehicle through a series of tests there, to most importantly validate the models that we have already built up to predict how the vehicle will perform. – Matt SouleWhen Parallel begins to commercialize their business, they are going to compliment the traditional rail business by offering the rail industry a solution to expand their freight operations inside of the traditional 500 mile routes. With Parallel's smaller scale we can serve freight lanes that do not require massive volumes to have that daily arrival and departure. That's the core of our strategy. – Matt SouleA pillar of this strategy is replacing trucks on drayage routes. A large opportunity is moving freight on rail from the Ports of Los Angeles, San Pedro and Long Beach to the Inland Empire, one of the largest industrial complexes in the United States with over 4,000 warehouses. Parallel's autonomous and electric vehicles will have a range of roughly 500 miles between charges. The vehicles will be operating in a platoon of 20 and will charge while they are being unloaded and loaded at the terminal.When we go into a terminal, we will have charging nests kind of like a robotic vacuum cleaner going to it's charging dock alongside the rail and the vehicles will go to those locations and automatically dock with the chargers, and while they are charging the freight is unloaded and loaded. – Matt SouleThe next version of the vehicle (Gen3) will be the commercial product that drives up reliability and drives down cost. Looking towards the future when Parallel is operating a commercial business, Matt sees autonomous trucks complimenting the business. The economics get better and better and better the more productive that asset is. So I think that is where there can be a real compliment, where a self-driving truck can handle the complex first and last mile if there is a service that does not require us to go directly to that customer. – Matt SouleWith the current economic backdrop of a slowing global economy, Matt is preparing the business to take advantage of the emerging autonomy economy that will arise out of the economic situation partly due to the global labor shortage. That's the message in a certain way of the very existence of companies like Forum Mobility, around for just a couple years as a vehicle-charging-services and equipment leasing company. Company regional director Ron Hunt leads the podcast with that very notion, sounding like many an owner-operator in wait-and-see mode around electric-drive tech and battery-charging-infrastructure development. Hunt's a veteran of the trucking world who got involved with electric-truck start-up Xos Trucks some time back. Yet what he learned led him to the charging-infrastructure side, in part given absolutely huge barriers that exist to any widespread adoption of electric Class 8s. Hunt and his colleagues at the Forum Mobility company aim to help on the grid front, and well realize any “electric revolution” will be a good long time in coming to trucking, even port drayage where they're specializing. It is certainly growing fast if electric Class 8 tractors running in California still only number in the low three digits, Ron Hunt emphasized. Port drayage in the state is where those units are most prominent, for good reason. The California Air Resources Board has done everything it can to really make the market there, with an end-of-year deadline for dray haulers to register their diesels within CARB's system. And as of the first of the year, if lawsuits don't derail this particular deadline (a little more on that in the podcast, and here: https://www.overdriveonline.com/regulations/article/15636769/california-trucking-association-seeks-injunction-of-diesel-truck-ban ), any truck registered to work California ports must be a “zero emissions vehicle” – we'll use that ZEV shorthand a bit, though no manufactured product in today's world is truly “zero emissions." Forum Mobility is aiming nonetheless to be a power provider with subscription-based charging access to sites in both Southern and Northern California specifically built with drayage trucks in mind. They're also combining electric truck-lease services with those charging-power subscriptions for those who want to pursue that kind of model, as they build a planned six facilities over the next couple years. We heard that one sticking point is a 3-year wage freeze the PMA wants to put on the ILWU - Greg Miller reports that higher pay is an issue for workers that currently make over $200K. - have you heard about any points of contention that are making this drag out even longer? How much of this is hurting the port knowing that ocean shippers have migrated to east coast ports and will continue to do so (despite issues at the Panama Canal for the Panamax ships)? The Biden administration is monitoring the situation - Should they be getting involved here as they had to do in the rail negotiations last year? Given that the three person presidential panel appointed by President Biden essentially sided with management on the sticking points, is the ILWU taking a risk by possibly seeing that same attitude towards management if they want federal mediation? Best guess - how does this play out and how much damage will this drama do to business on the west coast?
Highlights from the May 2023 Global Update from the Global Technical and Regulatory Affairs team at the Almond Board of California. Economic Impact Analysis of Retaliatory Tariffs on Exports of California AlmondsCalifornia almond exporters have been increasingly frustrated about favorable tariff conditions for Australian almonds while U.S almonds continue to suffer under retaliatory tariffs. Australia has a free trade agreement with China, reduced tariff treatment with India, and may soon have a zero tariff going into the E.U. Dr. Steinbach of UC Davis, using demand elasticity analysis, concluded that retaliatory tariffs cost the U.S. almond industry almost $875 million in exports or more than 325 million pounds of shipments between April 2018 and April 2022. He estimated that the withdrawal of retaliatory tariffs imposed by China, India, and Turkey could increase U.S. almond exports by about $175 million or 90 million pounds annually. Recently, ABC analyzed trade data to determine the impacts of retaliatory tariffs in key markets combined with Australian trade advantages. Based on that analysis, it was determined that if US market share had stayed the same before the implementation of retaliatory tariffs in China, India, and Turkey in 2018, and Australia's trade agreements with China and India, the value of US almond exports to those countries from 2018-2022 would have been higher by more than $550 million equating to an additional volume of 155 million pounds. This analysis will be summarized into a white paper that will be shared with policymakers for ABC's annual trip to DC coming up in June. For more info, please contact Keith Schneller.Transportation UpdateThe International Longshore and Warehouse Union negotiations continue with the two sides announcing a tentative agreement on a number of significant issues. However, there are still issues that will need to be resolved before a deal is signed. Additionally, dock workers at the Ports of Los Angeles and Long Beach continue to undertake “job actions”, including those leading to a previous shutdown of the ports for a few shifts. There may also be separate negotiations underway with ILWU Local 13 (LA/LB) with the Local seeking to double the manning on container handling equipment. The uncertainty of the situation continues to cause consternation among importers as more and more shift operations to the East Coast. However, there is optimism that the sides are inching closer to a deal, and many of the imports are expected to return to West Coast ports. The California Air Resources Board unanimously approved a new rule to phase out sales of diesel-powered medium- and heavy-duty vehicles by 2036. This is the first such combustion-truck sales ban in the world. Drayage vehicles with internal combustion engines (ICE) that are on the road now can continue to operate through their “useful life.” Those limits mean that when a drayage truck hits 800,000 miles, it can no longer be listed in the registry of drayage vehicles. The alternative is if it reaches 18 years after its model year, even if it has not reached 800,000 miles. The Advanced Clean Trucks rule aims to reduce California's GHG emissions by 40 percent and reduce petroleum use by 50 percent by 2030. Today's guest is Matt LeDucq, CEO and co-founder of Forum Mobility, which is working on the problem of heavy-duty trucking electrification, starting in California with the drayage sector.There are essentially two types of trucking. The first is long-haul or "over the road" which transports goods over long distances. If you've ever done a cross-country road-trip, the semi trucks on the interstates you see are long-haul trucks. And then there are drayage trucks. These trucks take large cargo containers from sea ports to distribution centers (and back and forth). Their typically short distances and repeatable patterns make them especially good candidates for electrification. Drayage trucks are relatively densely clustered and predictable, which helps when it comes to planning the EV charging infrastructure that can provide the amount of power these trucks command. It also turns out that California has some aggressive emissions reduction regulations coming online that will dramatically escalate the transition of drayage trucks from diesel to electric.Matt and Cody have a great conversation about the pending California regulations at play, as well as the history of clean air regulation around trucking. They also talk about the air quality issues surrounding most ports and the environmental justice issues that these regulations are aiming to address. They cover how the vast majority of drayage truck owners are independent operators and the financial burden that these regulations place on them. In this episode of Resources for the Road, host Gabrielle Bejarano sat down with Paul Gioupis, CEO of ZEEM Solutions. The two discuss how Gioupis got into the trucking industry, as well as where ZEEM fits into the trucking and drayage industry as a whole.“We started focusing on areas that we knew were going to have high concentrations of electric trucks that would run routes between 150 or 200 miles or less,” which includes areas near airports, ports, and distribution centers. ZEEM's first location, which has been up and running since December, is located near LAX in California, where they can house 220 trucks overnight and about 80 vehicles in their fleet.But the battery electric solution is not for over-the-road trucks operating more than 200 miles a day. “Trucking operations have been run the same way for a very long period and they've always been diesel minded. So the moment you come in and try to apply new regulations to a trucking business like this you cause major disruptions.”Gioupis explains that they understood a lot of the large fleets were going to have to start to go electric and they are willing to pay the prices to do so. If a trucking industry or trucking operator was looking to go electric, they would have to time several steps perfectly, which can quickly become incredibly difficult. So instead, ZEEM comes into those areas where they know there is going to be a high density of electric truck operations. “The idea for us is to come into areas, find a plot of land, and set up operations for anywhere between 250-300 trucks to park there overnight,” Gioupis explains, “And for those who want to domicile vehicles at their locations, we provide high power charging throughout the day for those operators that need the ‘juice' as we call it.”

Consider today's Overdrive Radio edition in the context of Overdrive Executive Editor Alex Lockie's reporting on the intermodal niche released a week and a half back, and the system-wide backlogs being experienced all around the container-moving supply chains, particularly evident at the nation's West Coast ports. The feature was another entry in our "Niche Hauls" series of features on freight segments where owner-ops are in high demand: https://www.overdriveonline.com/business/article/15279445/intermodal-haulers-fight-off-a-system-collapse-at-ports What we didn't get in that three-part report was a perspective from among the top volume ports on the East Coast – for that, Overdrive Editor Todd Dills reached back to small fleet owner-operator George Berry, working out of the Port of Virginia principally. He's a uniquely qualified source to voice owner-operators' views on just where congestion issues at the ports originate. For years now he's been a voice in a group called “For Truckers By Truckers” on social media around port and other intermodal drivers' issues, and his small fleet leases with five owner-operators now out of Virginia. For Truckers By Truckers continues today as principally an intermodal informational source for drivers and owner-operators of all types: https://www.facebook.com/ForTruckersbyTruckers Since the President of the United States raised port issues as a national concern almost two weeks ago, there's been no small amount of finger-pointing to just who's to blame among supply chain parties. Yet as George Berry tells it, the backlog issue is multifaceted, stressed by mismanaged sorting, pressure on intermodal haulers to pickup on the "last free day," a generalized, widespread shortage of chassis as they're tied up by various parties, and much, much more. Undue detention issues arise then at the warehouse receiving end more often than not if the hauler's lucky enough to get an open chassis. Yet among it all, there's good news for that common problem even in intermodal work, where "free" detention time is dwindling at receivers, and commonly low intermodal owner-operator revenue levels annually are rising. Berry estimates the current high-demand/relatively-shorter-supply situation could yield as much as a $50K revenue boost annually (or around 50%) for such operators. Berry describes himself as a "California kid," and while his intermodal career has been centered in Virginia since early this century, he feels California's emissions regs and other restrictions have exacerbated ports' overload out West. That traces straight back to the California Air Resources Board's Drayage and wider Truck & Bus rule restricting port operators and then the wider trucking community to running only newer-model-year vehicles. Those restrictions were put in place on pre-2007-emissions-spec engines serving the ports well before trucks running in the rest of the state, furthermore. "They've kind of created this conundrum, in my opinion, on their own," he says in this podcast. "And when they say, 'You make it, you're going to sit in it and stew," and that's basically what's going to happen with Los Angeles/Long Beach."

Tradeshow Preparation Aaron: Let's start by saying every owner and manager in our industry should attend at least one trade show each year. And most every vendor needs to do trade shows either in your region or across the country if you sell nationally. Location Terry: Attendees Driving distance is a real plus, especially if you plan on purchasing equipment or supplies that will fit in your vehicle. Pickup a heat press or even larger equipment can save you real money. Most vendors do not want to take equipment home with them if they don't have to. Traffic and parking expense is something you should figure into your travel and expenses. A destination like Orlando or Vegas gives attendees, spouses and families entertainment outside the show. Aaron: Exhibitors A location with direct flights is a plus. Hotel rates can be a deterrent in a venue like Nashville. A destination like Orlando or Vegas gives attendees a reason to not attend as much of the show as they might. That's why exhibitors prefer the Indy's of the world. Restaurants and bars near the convention center but nothing really to draw away attendees during show hours. The Hall Aaron: Attendees Food onsite other than the $8.00 convention hot dog is always good, but attendees do have the option of going to nearby eateries. Pickup access after the show can be as easy as driving inside the building to waiting in a long line to get close enough to load your recently purchased machine. Terry: Exhibitors I'll list food here too since there's no option of leaving for a bite during a show. The DAX show provides lunch for vendors which is a welcome bonus on a busy show day. NBM provides coffee and essentials like aspirin, airborne, hand sanitizer, etc. And on setup day they wheel in a keg of beer. Drayage, electric, carpet, tables… these are usually ugly expenses no matter what location, but the attitude of those providing the services varies among venues. Exhibitors spend $1,000's at the hall, beyond shipping there and back. Let's list bitter cold or sweltering heat as the ugly side for exhibitors. Only the attendees during regular show hours benefit from heat or A/C. During setup and tear down vendors are left to the elements outside when the bay doors roll up to allow in the forklifts and crates. Atlantic City being the #1 weather extreme with an ISS show in the Winter and a convention center situated to allow ocean breezes to chill the bone. Heavily unionized halls will also “require” exhibitors to employee laborers for anything from turning a screw to climbing a ladder, while you standby and watch. (At time and a half rates most of the time for our shows)
