Eskridge of Yale Law School, a renowned expert on the judicial interpretation of statutory law, delivered the eighth annual Joseph Smith Lecture on Religious Liberty at the University of Virginia on September 22, 2022. His lecture, "LGBTQ+ Equality & Religious Liberty: Statutory Principles & The Golden Rule" responded to President Dallin H. Oaks's 2021 Joseph Smith Lecture, "Going Forward With Religious Freedom and Nondiscrimination." Eskridge praised the 2015 "Utah Compromise" statute and identified principles for co-operation between the LGBTQ+ community and religious institutions based on principles similar to those in the Utah statute.

As I found out, all good ideas come from a martini or two. I thought back to the opportunity that I had at Merrill Lynch to, by virtue of creating a business initiative in a very old-school command and control Irish Catholic investment bank like Merrill to support LGBTQ+ equality from a business perspective, and I thought, "Well, could I do the same thing, but with more companies, not just one?"   So, I looked at Davos World Economic Forum and I thought, "If I could I create that conversation in the LGBTQ+ community?" Because 12 years ago, you did not see businesses speaking up on equality. CEOs were not using their platform and their voice and I wanted to create that, so I used my severance check, started our first summit in March 2011 hosted by the CEO of Deutsche Bank and we had bank of America, Barclays, Citi, Deutsche Goldman Sachs and Morgan Stanley and then grew from there.” Work with Equilar with OutQOURUM   “A key piece of the conversation is having the opportunity for LGBTQ leaders to self-identify, and Out Leadership almost five years ago wrote the first research on self-ID globally in partnership with Ropes & Gray. We found that companies asked their LGBTQ employees to self-identify in 38 countries globally, but at the same point at the board level, it is still completely absent.   David has used that data, the research, and actually the policies that we've written to try to identify more LGBTQ board members in the Equilar database, so that we can start to expand that pool of diversity.”   LGBTQ and the definition of Diversity   “I'm interested right now in particular, AB 979, the California law requiring board diversity. We were a part of, from the drafting perspective, believe it or not, when it was first introduced, the definition of diversity did not include Asian or LGBTQ, and so Ascent Pinnacle and Out Leadership and Quorum worked to have both of those diverse categories added.   But interestingly now, AB 979 is under attack. The State of California is being sued and our leadership is one of the expert witnesses that is testifying to try to protect a law increasing diversity, which is just baffling to me. Every piece of research shown that that shows LGBT and broader diversity bring innovation, de-risk all of the reasons you want diversity on the board, so to be anti-business and sue against the law that seeks to create that, just blows my mind.”   “The United States Congress had three different bills focused on diversity in 2021. Not one of them, when it was introduced into the committee, included LGBTQ and we had to advocate and we were able to get LGBTQ added to all three of them, including a board diversity one and ultimately I testified to Maxine Waters' House Financial Services Committee in November about all of these exclusions and why it matters for LGBTQ people to be included at all these levels of diversity.”   On B Corp and Out Leadership   “Why that matters in my opinion is if I was going to sit with CEOs, and we've worked with over 800 now over the last 12 years, if I was going to sit with a CEO and say that LGBT equality is a business issue, I need to be a business too. It's very different to have the nonprofit warm fuzzies, as we said earlier, conversation. If I'm a business, I pay taxes just like they do. I have to grow just like they do. We reinvest our profits. That's, to me, an important story.”   “the most important piece of the B Corp rating is what are you actually doing, and that's something I think it's really important  and I think it's why so many more companies are looking at the B Corp status. There are a number of companies that are looking to convert to B Corp not just the Ben & Jerry's and Patagonia are B Corp, but there are significant numbers of corporations that are considering it now.”   Out Leadership, Tools and Research   “One of the tools that Out Leadership built almost six years ago was our corporate guidelines for board diversity, and we include in the back of that, an actual matrix that is inclusive of all the elements of diversity that we recommend, both acquired and inherent diversity, skills, background, national origin, all of the pieces, and I encourage private companies to think about that and to use that as they're thinking about diversification of their boards.”   “Our Quorum initiative last year launched our first ever Quorum Summit. Out Leadership has summits annually in New York, London, Hong Kong Paris and Sydney, but with our talent issues, we built a summit as well and last year's summit, we launched the first ever LGBTQ board research called Visibility Counts. This year on March 22nd, we'll be launching the second annual Visibility Counts piece of research.   There are a couple of key pieces that the most important last year and I think this year is that we did map last year of the Fortune 500 on their board diversity policies. That was the first time that it had ever been done in history, by the way, and not just LGBTQ, we mapped across race, gender, ethnicity, orientation, veteran status, disability status, et cetera.   This year's report, we are mapping the Fortune 1000 and the entire NASDAQ so all 5,300 listed companies on the NASDAQ. Now, I will point out that the NASDAQ doesn't even have that data themselves. We went to them first and asked if they had it and they don't. We did it for them and the Fortune 1000 as well.   I can give you a quick little preview. Only about 2.4% of NASDAQ companies include LGBTQ and the definition of diversity and only about 15% even include gender, so they've got an awful lot of work to do, which I think is why Dina wanted to make this an effort and they've put it over time. It's not just a point in time. They have, I think, a four-year lead in, but they've got a long way to go, which I think is going to be surprising when we release the full report.”

Our second podcast is with Dr. Haim Abraham, a lecturer at the University of Essex. He gives us an informative discussion on surrogacy in relation to the LGBTQ+ community in Israel, educating us on the developments being made and the ones needed to ensure they have equal rights to surrogacy. As the LGBTQ+ community in Israel grows so does their advocation of equal rights. Within Israel, the Embryo Carrying Agreement Act is how surrogacy is regulated. However, its requirements discriminate against the LGBTQ+ community, such as only allowing surrogacy to be available for married heterosexual couples. In recent years, there have been achievements; the courts acknowledging LGBTQ+ relationships and recognizing that the law is discriminatory towards same-sex couples as seen in 2010 case of Arad-Pinkas (HCJ 1078/10 Arad-Pinkas v The Surrogacy Agreements Approval Committee) which led to a petition for law reform. Nonetheless, the courts argued that the law was proportionate due to the lack of research on its effect on familial structure regardless of the acceptance of surrogacy undertaken abroad. This led to the financial burden on Israel's LGBTQ+ couples to undertake surrogacy abroad which costs more than $100,000 and thus discriminates against the LGBTQ+ community. Ultra-Orthodox Jewish parties in the Knesset continue to advocate for a fully religious vision of Israel. These religious considerations caused a lack of political support for the LGBTQ+ movement and led to LGBTQ+ rights not seen as legitimate rights as they go against religious belief. This is evident under the Embryo Carrying Agreement Act which is how surrogacy is regulated in Israel. The Act includes legal requirements that discriminate against the LGBTQ+ community and shows the importance of religious attitudes, where particular attention was given to Jewish law. This can be seen in the requirements stated for surrogacy, in particular that the procedure is available for only married heterosexual couples as well as the requirement for the intended parents and surrogate to follow the same religion. Additionally, homophobic attitudes are still present with the communities. Regardless of the enormous pressure for change since 2010, the lack of action shown by the government reveals the long road ahead for the LGBTQ+ community. Hodges holds that 14th Amendment requires states to recognize same-sex marriages  2021: President Biden issues executive order repealing former administration's ban on transgender Americans joining the military    Nonprofit advocates and their work    Recent Developments / Coming Soon...  During the 87th Legislative session, nonprofit advocates in TEXAS successfully defeated SB 29, which would have banned transgender student athletes from competing on sports teams based on their gender identity. Local nonprofits like the Texas Freedom Network and Equality Texas led the charge in advocating against the bill alongside several other incredible nonprofits. While it's possible the bill may be revived during a later legislative session, there is much to celebrate for now.  ARKANSAS recently passed a new law (one of the first of its kind in the nation) that bans gender-affirming healthcare for transgender youth. The ACLU recently filed a lawsuit on behalf of four families and two doctors, who argue that the law is unconstitutional and that it should be struck down so that all children have access to medically necessary care.  Any day now, the United States SUPREME COURT is expected to release a decision in the case of Fulton v. City of Philadelphia, which will decide the constitutionality of a Philadelphia ordinance that bars discrimination based on sexual orientation. A legal challenge against the ordinance was brought by a Catholic foster agency that lost its contract with the city as a result of the nondiscrimination policy. Devin Ibañez is the first openly gay Major League Rugby player and is dedicated to LGBTQ+ advocacy in sport. He hopes to inspire the next generation of LGBTQ+ athletes and make sport an inclusive space for them. Raised in Boston, MA, Devin played for Major League Rugby team, the New England Free Jacks, in their 2019 exhibition season. He won a gold medal while representing Team USA at the 2017 World Maccabiah Games in Israel. He also won the 2018 D1 National Championship with his club team, Mystic River Rugby Club. When not playing, Devin has coached rugby at Westlake Boys High School in New Zealand, his alma mater Brookline High School and most recently with the Northeast Academy. He holds a degree in sport management and education from the University of Massachusetts-Amherst. During his graduate studies, Reynolds pioneered the development of an academic course centered on diversity in health care leadership and also co-founded the health services management and policy diversity committee at The Ohio State University. In that same year, he was published in the Journal of Healthcare Management and won first place in the National Association of Health Services Executives national case competition. Amazin LêThi was born in Saigon where she was left in an orphanage by her mother. Amazin was then adopted by a white Australian family and became a trans racial adoptee and grew up in Australia. As a young adult, she was homeless for a period of time and it was at this lowest point, contemplating suicide, Amazin realized her passion and love for sport could help her survive.    Amazin got into weightlifting as a young age and through this, she gaining physical and mental strength, which in turn helped her with her confidence. Amazin shares more from her personal journey of homelessness and having to fight against all the odds to overcome enormous barriers to become a leading global rainbow (LGBTQ) sports activist and thought leader.    Amazin is a former competitive natural bodybuilder, TV/Film star, entertainment executive and the first Vietnamese internationally published health and fitness author. Currently focusing on the sport of shooting with her goal of reaching the Olympics in this sport.    Amazin is the first Asian ambassador for Athlete Ally, a nonprofit dedicated to champion LGBTQI+ equality, and Stonewall U.K., Europe’s largest LGBTQ charity. Her own Amazin LeThi Foundation uses sports to develop leadership skills for “rainbow youth” and advocates for LGBTQ allyship in the athletic community.   Amazin in her own words:   Sport has always been part of my life but I never saw myself in sports, let alone as an LGBTQ athlete, which made me feel very alone and isolated. He co-authored and led the United Nations Global LGBTI standards of conduct for Business, the largest corporate social responsibility initiative on LGBTI issues in the World. To date, more than 270 of the largest companies in the world have expressed support for the initiative. From 2001 - 2016, Fabrice was Senior Country Officer at the World Bank. At the Bank, he authored economic development analyses on Yemen, Uzbekistan, Tajikistan, and Tunisia and provided contributions to the 2012 Gender World Development Report (WDR) and the 2011 Conflict, Security, and Development WDR. He holds a B.A. in economics and management from Dauphine University in Paris and an MBA from American University in DC. Fabrice volunteers on the Board of Outright Action International, Housing Works, the NYC Gay Men's Chorus, Alturi, the KindRED Pride Foundation, Witness to Mass Incarceration, and the Institute of Current World Affairs (ICWA). In 2019, he received the Golden Gate Business Association Award, the IGLTA Pioneer Award, and the Alan Turing LGTBIQ Award for his work on LGBTI rights. He was ranked 2nd by Yahoo Finance among LGBTI public sector executives globally in their 2019 Outstanding list. He was interviewed by The Economist, quoted in the New York Times, Foreign Policy Magazine, and The Guardian on issues pertaining to the human rights of LGBTIQ people. Shannon Scott grew up in rural Montana doing all the ranch work you would expect. Then in high school, Shannon had an uncle in the Air National Guard that started the interest in the military. With the idea of combining serving the country with achieving an education, Shannon took the military aptitude test and scored high in math and electronics, so took that road with the Montana Air Force recruiters. The basic training was "incredible" according to Shannon, because it was a true melting plot of cultures and viewpoints; a great growth experience. A sobering experience was ahead, however. On a flight, the plane was filled with containers. When asked what they contained, the answer was "HR", or human remains. It got Shannon filled with survivor's remorse, the "Why did I live?" question, and it was then Shannon vowed to live a genuine life from that point forward. Masculine at work and feminine off work, Shannon was seen on a weekend and was forced to sign a dishonorable discharge for secretly being transgender. So Shannon stayed in the closet for the remainder of the military service until a job with the FAA eased the pressure. However it was her breakout role on the CBS hit TV series Cagney and Lacey that won our hearts as over 30 million viewers each week watched Gless as NYPD detective Christine Cagney in the first hour-long drama to feature two females in the leading roles that ran for six Emmy-winning seasons from 1982 until 1988. Due to improved treatments, the number of annual HIV infections in the U.S. declined steadily for years until about 2013, but the latest statistics at HIV.gov show no improvement since. About 39,000 people annually are infected. One of the leading players in the fight to eradicate AIDS has been the M·A·C AIDS Fund, which recently rebranded as the M·A·C Viva Glam Fund, redoubling its efforts to fight AIDS by focusing more on LGBTQ equality. Over the past 25 years, the fund has raised and spent over $500 million. All the money comes from the sale of Viva Glam lipstick products where 100% of proceeds go directly to the fund to fight HIV/AIDS. Nancy Mahon, Estée Lauder’s senior vice president of global corporate citizenship and global executive director for the M·A·C Viva Glam Fund, explains the strategy shift—the theory of change—that motivated the rebranding. What will it take for you to achieve your goals, be it your health, your business, or personal goals?But what if your goals involve LGBTQ equality, human rights, and absolute freedom from oppression and bigotry of any kind?It takes willpower, clarity of vision, determination, steadfastness, the ability to pick yourself right back up and continue when you "fall back", and finally, faith.Yes, faith, but I am not talking about religion or faith in a higher power.Instead I'm talking about faith as an unwavering belief that you will succeed, even if the goal seems inconceivable. The kind of faith that supports you when you don't know how to take the next step - you just do it anyway.Faith is a blindness through which you can see.How do you quantify faith? You can't. There is no measure for faith - you have it or you don't. But it's the quality of your faith that matters. You feed your faith with frequency and quality of practice, i.e. how often you take one more step on the path towards your goal. Your faith is your own, and no one can challenge it except you.I know this might be too metaphorical for some. So be it. When you are ready, you are ready. And when you are ready, you will make it happen.How often do you heard self-defeating statements from people around you like,"I can't do it alone.""I don't know what to do to make a difference.""That would be too hard to organize.""Someone else will do it. ""I don't have enough time to get involved."Every single one of those statements is a horrible excuse.When we make statements like the above we defeat ourselves - we defeat who we can become, who we are meant to be. We allow those, against whom we are fighting, to win. Heteronormative patriarchy is like a fortified wall surrounding a city. All we have at our disposal to bring down the wall are our words, our actions, our visibility, and our bare hands.The quality of your faith will determine how often you make excuses versus how often you take action to improve yourself and the world.Evolution Versus RevolutionRevolution is about change and is very different from evolution. Just as change and personal growth are two very different things. You can change any part of your life, but change alone might not lead to improvement. Personal growth is about the evolution of the self.When we seek to change the world for the better, a revolution will fall short of what we want and need. A revolution is seeking to create change, but to what end? By replacing one leader or one government with another? By enacting or striking down a law that translates into better lives for LGBTQ peoples?If all we do is change something, someone else can come along and change it back, or make it worse. The United States witnessed eight years of improvement under the Obama Administration that bettered the lives, rights, and equality for LGBTQ people.One simple change in government and much of what was changed for the better, is being taken away by Trump and the GOP.Evolution is about change for the better.You become something much more than you were before. It's not about changing clothes, jobs, or your home. This is about evolutionary transformation. The seed becomes a flower. The child becomes an adult. The caterpillar becomes the butterfly. These are visible, evolutionary changes we can observe over time and the type of change that does not go backwards.Time is what it will take for people to evolve.This is why we need faith to keep up our energy. We need to support one another so we can work together to make the kind of evolutionary change needed in this world where difference isn't perceived as a threat, where financial greed doesn't corrupt basic human decency and respect for human lives, and where religious ideologies no longer exist to reinforce exclusion, bigotry, oppression, murder, heteronormativity, and fanaticism.Have faith and get passionate about your rights and freedoms.Make a plan to take action. If you don't know what to do, ask for help. I don't have all the answers, but that’s why I publish my magazine, Th-Ink Queerly to provide a space for LGBTQ+ people to share their passion for improving humanity and eliminating prejudice. What I do on the Living OUT Podcast is to empathetically provoke critical thinking about what we perceive as “normal” to help create evolutionary change in the world. Evolution is a seed waiting to be planted. You have to have faith that the seed will take root, but you also have to water and feed it.

As a proud gay man and photographer of many fantastic same sex weddings, this episode is particularly close to my heart. I chat with the wonderful Ava from LGBTQ Equality Weddings about the incredible work she is doing to help wedding suppliers and businesses in general to develop their language to be more inclusive and help break down some of the barriers that same sex couples face when planning their wedding.  Remember that there are thousands of people out there that will love you and support you to live your life as authentically as you wish to; whether you have yet to come out, are questioning, or are planning your same sex wedding.

I love serendipitous podcast guest recruiting. This one starts over coffee with my longtime blog-turned-IRL friend Rachael King, who recently founded a company called PodPeople to connect new shows with creative teams. When I told her about themes I had been exploring on the Pivot Podcast she said, "You HAVE to talk to Jonathan Parks-Ramage." She had just helped produce a new podcast for Medium where he read his article aloud, Jesus, Mary and Joe Jonas: A Journey Into LA's Hippest Evangelical Church. I was captivated by his story, and by his intention to research and write about topics at the intersection of faith, LGBTQ advocacy and the entertainment industry.
