This Day in Legal History: Plaut v. Spendthrift Farm, Inc.On April 18, 1995, the U.S. Supreme Court delivered its opinion in Plaut v. Spendthrift Farm, Inc., a significant decision reinforcing the constitutional principle of separation of powers. The case arose after Congress enacted legislation requiring federal courts to reopen certain final judgments in securities fraud cases that had been dismissed under an earlier statute of limitations ruling. The plaintiffs, whose claims had already been dismissed with finality, sought to revive their lawsuits under this new provision. In a 7–2 decision, the Court struck down the law, holding that Congress cannot force Article III courts to reopen final judgments. Writing for the majority, Justice Antonin Scalia stressed the importance of finality in judicial decisions and warned against legislative interference with core judicial functions. He argued that once a case is decided, it becomes law of the case and should not be revisited at Congress's whim. The ruling underscored the judiciary's independence from political pressure and reaffirmed that each branch of government must respect the constitutional boundaries of the others. Scalia noted that permitting Congress to override final court decisions would blur the lines between legislative and judicial authority, threatening the rule of law. This decision was not just a technical interpretation of procedural law; it was a firm statement about institutional integrity. Plaut became a cornerstone case for understanding the limits of congressional power over the courts. It continues to be cited in debates over judicial independence and the sanctity of final judgments.A federal appeals court rejected an emergency attempt by the Trump administration to block a judge's order requiring the government to aid in the return of Kilmar Abrego Garcia, a Maryland man deported to El Salvador despite a 2019 court ruling barring his removal. The court condemned the Justice Department's actions, with Judge Harvie Wilkinson calling them a violation of fundamental liberties and due process. He criticized the administration for acting as though it could abandon individuals in foreign prisons without legal recourse. The Supreme Court previously upheld a similar directive from District Judge Paula Xinis, requiring the administration to work toward bringing Abrego Garcia back from Salvadoran custody. The government claims Garcia is affiliated with the MS-13 gang and lacks the right to remain in the U.S., arguing that Xinis overstepped by involving herself in foreign affairs. However, Wilkinson stressed that due process rights apply regardless of alleged affiliations and warned that ignoring court orders could lead to broader abuses of power, including the potential deportation of U.S. citizens.Abrego Garcia, who has no criminal record in either country, was deported alongside 250 alleged gang members to El Salvador's high-security prison. His 2019 immigration court ruling protected him from deportation due to threats of gang-based extortion.Trump Loses Emergency Appeal to Halt Maryland Deportation CaseThe U.S. Supreme Court will hear arguments on May 15 regarding President Donald Trump's attempt to limit birthright citizenship, a constitutional principle rooted in the 14th Amendment. Although the case won't directly determine the legality of Trump's executive order, it will address whether lower court rulings that blocked the policy nationwide should be scaled back to apply only to specific plaintiffs or jurisdictions.Trump's order, signed in January, seeks to deny citizenship to babies born in the U.S. unless at least one parent is a citizen or permanent resident. It directs federal agencies to withhold documents like Social Security cards and passports from newborns who don't meet that criterion. Critics argue this violates well-established legal interpretations of the 14th Amendment, which affirms citizenship for nearly everyone born on U.S. soil. The Justice Department argues that nationwide injunctions—orders that block policies across the country—exceed judicial authority and should be narrowed. The administration also questions whether the states and groups suing have legal standing. Despite these claims, lower courts have uniformly refused to allow the executive order to take effect.Opponents, including 22 Democratic-led states and immigration advocacy groups, argue that Trump's effort seeks to strip citizenship from thousands of children and overturn long-standing legal precedent. Trump maintains that birthright citizenship was originally intended only for formerly enslaved people, not for the children of non-citizens.US Birthright Citizenship: Supreme Court to Hear Arguments in Case - BloombergUS Supreme Court to hear Trump bid to enforce birthright citizenship order | ReutersFifth Circuit Judge James Ho sharply criticized the power of trial-level judges in a recent opinion, focusing on what he sees as overreach in politically sensitive cases. Ho issued a writ of mandamus instructing a district judge in Louisiana to vacate her order reopening a death penalty case years after it had been dismissed. He was joined by fellow Trump appointee Judge Andrew Oldham, while Judge Catharina Haynes dissented, arguing the appellate process should proceed normally. In his concurring opinion, Ho warned against what he called the misuse of judicial power to obstruct democratic outcomes. He connected the Louisiana case to a recent U.S. Supreme Court decision that reversed a nationwide order from Chief Judge James Boasberg in Washington, D.C., which had blocked the deportation of alleged Venezuelan gang members under the Alien Enemies Act. The Supreme Court said the Venezuelan plaintiffs should have filed their suit in Texas, where they were detained, effectively transferring jurisdiction and narrowing Boasberg's reach.Ho used that ruling to reinforce his argument that appellate courts must intervene swiftly when district judges exceed their authority. He accused some judges of rushing to block policies they oppose politically, calling it a threat to the electorate's choices and governmental efficiency. He argued that deferring to the standard appeals timeline enables what he called “district judge supremacy.”Judge Haynes pushed back in dissent, criticizing the majority's allegation that the district court manipulated legal processes, especially since neither party in the case had challenged the judge's integrity. She maintained the threshold for a mandamus was not met and objected to the majority's tone and assumptions.James Ho Knocks Trial Judge Who Blocked Venezuelan DeportationsThis week's closing theme is The Moldau by Bedřich Smetana, a defining work in Czech Romantic nationalism and one of the most evocative tone poems in classical music. Smetana, born in 1824 in what is now the Czech Republic, was a pioneering composer who sought to express the identity, history, and natural beauty of his homeland through music. A contemporary of Liszt and Wagner, he was deeply influenced by the idea of programmatic music—compositions that tell a story or paint a picture without the use of words. The Moldau (or Vltava, in Czech) is the second and most famous piece from Smetana's larger symphonic cycle Má vlast(My Homeland), composed between 1874 and 1879. The piece traces the course of the Vltava River from its source in the Bohemian forest, through the countryside, past villages and castles, and ultimately to its merger with the Elbe River. Through rich orchestration and shifting textures, Smetana portrays everything from bubbling springs and flowing currents to a peasant wedding and moonlit night dances by water nymphs.Composed while Smetana was going completely deaf, The Moldau is as much a feat of imagination as it is of musical skill. The main theme, introduced by the flutes and then carried through the orchestra, is one of the most recognizable and emotionally stirring in classical music. It serves not just as a musical depiction of a river but as a symbol of Czech identity, resilience, and natural beauty.Closing with The Moldau offers a moment to reflect on continuity, movement, and national spirit—fitting themes for a week shaped by legal currents and constitutional debate.Without further ado, The Moldau, by Bedřich Smetana – enjoy! Israeli aircraft developer Air has one rule when it comes to electric aviation: Keep it simple. The startup's Air One electric vertical takeoff and landing (eVTOL) aircraft is simple, comfortable and efficient, with eight motors and a user-friendly control system, Air Chief Executive and co-founder Rani Plaut tells Air Cargo Next in this episode of “On Air with Air Cargo Next.” “The core of the design is trying to keep things as simple as possible,” he said. “We don't have any moving parts. Our solution is based on smart compromises and a little bit of aerodynamic trickery versus high complexity.” Air One, capable of traveling up to 150 miles per hour with a payload of 550 pounds, debuted in 2022, and Air joined the U.S. Air Force's Agility Prime program in 2023 to expand technology transition paths for electric aircraft manufacturers. The eVTOL, which is intended to optimize last-mile cargo deliveries, can also be used recreationally and seats two people, Plaut said. “The cargo unit is the same unit, simply without the seats and the avionics,” he said. “And since we have started testing the aircraft, as all the individual companies are doing by remotely piloting or autonomous piloting, it is already set for cargo use cases. So far, we have $17 million in purchase orders for cargo units.” Air generated more than $1 million in revenue in 2023 and, this year, that number is expected to reach $7 million, Plaut said. In this episode of “On Air with Air Cargo Next,” the CEO discusses how the company was founded, why eVTOL designs should remain simple and Air's next moves.

Link to bioRxiv paper: http://biorxiv.org/cgi/content/short/2023.07.11.548613v1?rss=1 Authors: Vin, R., Blauch, N. M., Plaut, D., Behrmann, M. Abstract: Although the left hemisphere (LH) Visual Word Form Area (VWFA) is considered the pre-eminent cortical region engaged in visual text processing, other regions in both hemispheres have also been implicated. To examine the entire circuit, using functional MRI data, we defined ten regions of interest (ROI) in each hemisphere that, based on functional connectivity measures, naturally grouped into early vision, high-level vision, and language clusters. We analysed univariate and multivariate responses to words, inverted words, and consonant strings for ROIs and clusters, and demonstrated modulation by text condition bihemispherically, albeit more strongly and in a larger number of regions in the LH. Graph theory analysis revealed that the high-level vision cluster and, specifically, the VWFA was equivalently connected with both early visual and language clusters in both hemispheres, reflecting its role as a mediator in the circuit. Our findings reveal bihemispheric, stimulus-mediated ROI response flexibility but circuit-level connectivity stability, reflecting the complex contribution of a distributed system for word processing. They'll also discuss miscommunication and marketing surrounding GMOs, and why proper labeling matters. Dr. Plaut provides insight into the various ways GMOs have contributed to increased yield, crop protection, and how gene editing has impacted the farming industry in positive ways. She also shares how some of the gene editing technology is modifying food to provide even more health benefits. “It's an exciting time to be in the industry and see how these technologies can help us.”
In this episode, Rani talks in more detail about the company's vision for the personal air mobility market and how he thinks this particular area will help the passenger sector take off. We discuss its AIR ONE eVTOL aircraft and the roadmap to-date, as well as the impact of showcasing the technology as huge public events like the Kentucky Derby and Oshkosh.

Actor, writer, and longtime friend of Nicole's, Doug Plaut (Unbreakable Kimmy Schmidt; Hurricane Bianca: From Russia with Hate), had what can only be described as a roughhhhh childhood. When Doug (they/he) began exhibiting non-heteronormative traits at an early age ("I was a four-year-old who loved Barbara Streisand"), his parents sought out medical intervention. By late high school, Doug had seen eleven psychiatrists, and been on a whopping *seventeen* different medications. Doug recounts his struggles with exercise bulimia, his hilarious/enviable desire to identify most as "a strange person who, like, lives in the woods," and the incredible 180 his father did in recent years. Also, his beautiful friendship with Charles Busch, and the life-changing production of The Sound of Music in which he and Nicole played von Trapp siblings!Follow Doug on Instagram at @dougplautperson and on Twitter at @DougPlaut.

Today on the show, Bryan Barletta speaks with Ma'ayan Plaut, who is the growth marketing manager at 3play media. They discuss what it means to create accessible and compliant podcast transcripts. Ma'ayan recently tweeted about the need for transcripts to include non-speech elements. Her tweet was instructive and contained practical information for podcast publishers. We expand upon her thread in this conversation, and go beyond it as well. We are moving towards a world in which we don't simply consume podcasts by listening. Consumers will read podcast content, too; whether that's because they prefer to read it or because they are d/Deaf or hard-of-hearing, or for a variety of other reasons. For those use-cases, and more, we need to find a way to make transcripts for available and accessible. Even if AI gets us halfway there, it's important to have the final version looked over by a real human. Why? In this episode, I'll be chatting with Andre Plaut about LXD and Human-Centered Design principles. Andre Plaut is the founder and owner of Human Machine, a learning design studio. Over the last 10 years, Andre has worked with Apple, Obama for America, General Assembly, and other clients. You'll also find Andre delivering captivating workshops on LXD or the ethics of technology design. Andre gives advice on how to address the whole learner in your design process. A must-listen episode! Connect with Andre here: LinkedIn Company Website
Take a guess... How much time do you invest to learn something during your week? It's a lot. We learn all the time in order to grow as a professional, a team and an organisation. Heck by reading this email you're learning something (hopefully). Most learning happens organically and on the fly. Which is totally fine. But when you deliberately want to bridge a gap in knowledge, skill or experience it's smart to design that journey. That's where learning design comes in. According to Andre Plaut learning should be hard but not confusing, frustrating or painful. As you'll discover in this weeks episode there's a lot more to learning design than just coming up with training material. It's a (strategic) design discipline that very closely related to service design. After the conversation with Andre I got really excited about the potenial of learning design. Hope you will too. --- [ GUIDE ] -— 00:00 Welcome to episode 126 03:50 Who is Andre 05:00 60 second rapid fire 07:45 What is learning design 11:00 The goal of learning design 19:00 Redesigning the way we work 22:30 Learning design in practice 28:30 When to design learning 33:00 Setting teams up for success 40:00 The evolution of learning design 44:00 A better business conversation 46:30 The future of learning design 49:30 Recommended resources 51:00 Final thoughts --- [ LINKS ] --- * https://www.linkedin.com/in/andreplaut/ * https://ahumanmachine.com/ * Workshop by Andre: Learning is Experience Design - https://www.youtube.com/watch?v=UMprxiz5rGM * Square wheels cartoon - https://performancemanagementcompanyblog.com/tag/cartoon-too-busy/ Books: * John Marshall: Definer of a Nation - https://amzn.to/3w1y9mD * Design for How People Learn - https://amzn.to/3y2Y2nJ * Making Conversation - https://amzn.to/3hh1K7f --- [ HOW TO EXPLAIN SERVICE DESIGN ] --- Learn what it takes to get your clients, colleagues, managers, CEOs and even grandmas as excited about service design as you are. https://servicedesignshow.com/free-course

Ma'ayan Plaut (@maayanplaut) is Senior Manager, Audience Development & Engagement at PRX. Plating with Ma'ayan To offer your own advice, call Zak @ 844-935-BEST TRANSCRIPT: ZAK: It's Food Friday and today return contributor, Ma'ayan Plaut is here to talk about sandwiches. Not just any sandwich, though. MA'AYAN: I don't know if it's cause I miss my parents a lot right now but I've been making a lot of what my mom likes to call the two-handed sandwich. And it's actually more of an idea than it is a recipe and it's delicious because it's filled with all sorts of crunchy vegetables...usually lettuce, cucumbers, sprouts, for my mom it has to have avocado in it. If you're me, any type of savory spread, avocado included, also welcome. And the main thing here is that it's piled super-duper high. It's absolutely beautiful to look at and it's the best. First bite, last bite, all of them are great. The only challenge with the two-handed sandwich is that it's really just that. It only works best if you're holding it with two hands and whoa is you if you decide to put it down for any reason whatsoever. So, the thing is with all of those crunchy vegetables and all of the spreads, everything starts sliding in every direction, so the bread might fall off completely because of all the stacked, multiple dimensioned things on top. The vegetables, especially if they're slide-y vegetables like cucumbers or sprouts, they just slide side-ways and you kind of just end up with something I call a miserable tossed salad with bread that just so happens to be on the side or on the bottom. So my solution is actually to self-contain the sandwich and that usually comes from one of two things. It's either a well-places toothpick or you can wrap your sandwich up either in wax paper or aluminum foil and that just gives you some extra, internal stability when all of the slide-y and crinkly and gravity-defying fillings have all these ideas about what a strong, free-standing structure really should look like.

The scope of women's political history is so vast that it can't be covered by one podcast. This week Amended host Laura Free introduces a special episode from And Nothing Less, a seven-part series from the Women's Suffrage Centennial Commission and PRX. This episode is more than a story about women's rights. It's a story about civil rights. And women like Ida B. Wells and Mary Church Terrell understood that the suffrage fight was as much about race as it was gender. Hosts Rosario Dawson and Retta speak with some great guests you'll recognize from Amended—like Martha Jones and Lisa Tetrault—and some you haven't met yet—like Michelle Duster, great-great granddaughter of Ida B. Chantelle Herschberger and attorney Michael Plaut discuss the case of the Freeway 9 in Los Angeles - activists who blocked the highway in 2017 with a banner reading “Trump/Pence Out Now.” The case was finally dismissed this spring after two mistrials. Organizers with Refuse Fascism in LA mounted a political defense, admitting that they were in fact on the highway, but that it was necessary and protected under the first amendment due to the danger posed by this regime. Over the course of the prosecution it was discovered that the LAPD sent undercover informants to spy on protesters. This week, as Trump and acting DHS secretary Chad Wolf have sent federal forces to Portland to suppress protesters and threaten to deploy this secret police to many other cities, there are vital lessons to learn from this case and how to fight police state repression on all fronts. Join me as I chat to Simon Plaut, longevity expert, as she gives us some illuminating insights into the power of detoxification at menopause. After suffering from obesity, crippling knee and back pain and food addiction, Simone knew her days were numbered if she did not get her act together.

Hanukkah Harry is a fictional character on Saturday Night Live played by Jon Lovitz. Hanukkah Harry is portrayed on the show as a variation upon the modern-day image of Santa Claus, with a beard characteristic of a male adherent of Haredi Judaism, and with his hat in blue with white edges (the colors of an Ashkenazi Jewish tallit, or prayer shawl, shared by the flag of Israel). Hanukkah Harry's first appearance on SNL was on Season 15: Episode 9, a show first broadcast on December 16, 1989, with guest host Andie MacDowell, in a sketch titled "The Night Hanukkah Harry Saved Christmas", that viewers are told is sponsored by Hallmark Cards in association with the Jewish Anti-Defamation League. Unable to deliver toys to children due to a stomach virus, Santa calls Hanukkah Harry (Jon Lovitz) at his workshop on Mount Sinai, asking if he could fill in. Hanukkah Harry agrees and flies through the air on a cart pulled by three donkeys, Moische, Herschel and Schlomo. Hanukkah Harry lands on a roof and climbs down the chimney of the home of Scott (Mike Myers) and Christine (Victoria Jackson), offering gifts of slacks and socks respectively, as well as chocolate coins and a dreidel. While the children are initially disappointed at their gifts, their realization that Hanukkah Harry had helped Santa, makes them recognize that "Christians and Jews, deep down, are pretty much the same. Maybe that's the true meaning of Christmas!" With that statement Santa's flu is cured, and Santa comes down the chimney bearing gifts of Barbie make-me-pretty for Christine and a pellet gun for Scott.[1][2] Hanukkah Harry's second appearance on SNL was on Season 15: Episode 17, with guest host Corbin Bernsen, first broadcast on April 14, 1990, in a sketch titled "The Night Hanukkah Harry Saved Easter."[3] The definitive scholarly and popular treatment of Hannukah Harry appears in the book A Kosher Christmas: 'Tis the Season to Be Jewish by Rabbi Joshua Eli Plaut, Ph.D. in the fourth chapter entitled “ `Twas the Night Before Hanukkah: Remaking Christmas Through Parody and Popular Culture.” Plaut details and analyzes how Hannukah Harry becomes an American folk hero as a counterpart to Santa Claus.[4] Building on these two SNL appearances, Hanukkah Harry has been referenced as a personification of Hanukkah to correspond to Santa Claus in various other media, including on National Public Radio, and on the pages of The New York Times in which Jonathan Safran Foer satirically described him as "a real person who drops in on Jewish homes each of the eights nights of Hanukkah to deliver gifts that are in no way dependent on children's good behavior".[5][6] The Baltimore Sun has called Hanukkah Harry one of the best Saturday Night Live sketches of all time.[7]
