Florida v. Department of Education – Accreditation and Quality Control

The recently filed and highly publicized Florida versus the Department of Education lawsuit could change the face of higher education across the US. At stake is the ability of accreditors to set standards in the accreditation versus how much state governments can be involved in accreditation affairs. Essentially the lawsuit is pushing to allow institutions to change their accreditors without being restricted by the Department of Education and that, as the owner of state schools, the state has control over what these institutions can do. In this podcast, Dr. Drumm McNaughton once again speaks with higher ed legal expert Michael Goldstein of Tyton Partners, who returns to Changing Higher Ed to discuss the background behind the lawsuit, its reasons, and its implications for higher education institutions and accreditation. Podcast Highlights Florida's Gov DeSantis directed his attorney general to file a lawsuit against the Department of Education. The case, Florida v. Department of Education, questions the authority of the Department to have a third party certify the quality of education, require independent boards, and a host of other things. Florida's complaint was filed in federal district court on June 21. The US Department of Justice has yet to file a response. Before the lawsuit, Florida passed a law at Gov DeSantis' direction that would require every institution in the State to change its accreditor in a relatively short cycle. The intent was to get Florida institutions out of the purview of SACSCOC and move to more conservative accreditors. This also had the intention of applying pressure on accreditors to back away from protecting the independence of institutional boards to allow states to take a more affirmative role in what they want to do. The legislation basically asked, “Why doesn't the Department of Education have an accreditation process for determining what institutions are qualified for the same way that the federal government decides what drugs are suitable for use in medical treatment through the U.S. Food and Drug Administration?" After a harsh reaction, the state changed its stance to say that within two years, the State required that all public institutions in Florida change their primary institutional accreditor. In the current accreditation process, states authorize institutions to grant degrees by their criteria, and then the school must be accredited by an accrediting agency that the Department has determined to be a reliable arbiter of institutional quality. Then, if the Department of Education determines that the institution has the financial stability and the administrative capability to manage the student aid programs, it could enter into a participation agreement, give Pell Grant loans, and be in the Federal Family Education Loan [FFEL] program, and in the direct loan program, enabling it to access trillions of dollars of student aid. The lawsuit says state governments are the owners of state institutions and that, as creatures of the state, these schools are responsible to the state legislature and the state government. So, if the legislature or the state government directs that these schools should act in a particular way, they should not be prohibited from doing so. This is analogous to an accreditation standard rule that was made to allow for-profit institutions to participate in student aid programs. The rule says that the board must be independent, and a majority of the members of the board are required to be independent of ownership to provide some level of insulation between the financial interests of the parent company, who is the owner, and, by law, the conduct of the institution. This supports the lawsuit's theory that the state owns state institutions. The Florida lawsuit first asks the court to determine that outsourcing institutional assessment of institutional quality to a non-governmental entity is an unconstitutional delegation of governmental authority. If that argument is rejected, the lawsuit asks to prevent the Department of Education from restricting the ability of institutions to change their accreditor. Because institutional accreditors are no longer restricted by region or country, Florida winning the lawsuit could result in the creation of different rules regarding the kinds of issues that the institutions are dealing with in Florida. There are also questions on how this could impact how NACIQI and the Department of Education approve accreditors. This accreditation lawsuit is similar to the ongoing question of whether states have too much authority in SARA. If an institution is accredited, approved by a state, and that state is a participant in NC-SARA, SARA says that the state can offer its online courses anywhere in the US (except California, which is not a signatory to the SARA agreement) without further approval. A recent Dear Colleague letter that addresses the Department of Education's upcoming expansion of a third-party service regulation will likely impact nearly all higher ed institutions that contract with a vendor to use their services and programs. The original rule was designed to monitor contracted companies that provide colleges and universities with services to manage various aspects of Federal Student Aid. In his latest podcast episode,  Dr. Drumm McNaughton discusses the recent Dear Colleague letter and the upcoming regulation expansion with Michael Goldstein, Managing Director of Tyton Partners' Center for Higher Education Transformation.  Mike talks about: Why the Department penned the letter and what it says. What the Department's position is on the regulation it's expanding. What colleges and universities will likely be impacted by the implementation of this expanded rule. How it will likely affect the working relationship between institutions and third-party servicers. How higher ed has been reacting to the letter. What will likely happen as a result.   Podcast Highlights The Dear Colleague says that the Department of Education will have the authority to look at the contracts and economic relationships between institutions and enterprises that provide them with services, including online program managers. This will require them to deliver detailed information about their finances to the Department. Based on laws and regulations, the Department will also be immune from any type of congressional review and from being challenged in the courts. The Department believes it's responsible for ensuring that the Federal financial aid monies is being properly used, and thus are examining transactions between institutions and these enterprises. But it has grabbed hold of a third-party service or regulation, which was intended for entities that actually put their fingers on the federal money. The Department of Education was prompted to publish the Dear Colleague letter because the GAO, the Inspector General, and various congressional oversight committees have said the Department doesn't fully understand this relationship between institutions and the enterprises that provide them with third-party services. The Department issued this Dear Colleague letter on February 28. It initially gave higher ed two weeks to comment on it, but the comment period was extended to March 30. The Department also moved back the implementation date from May 1 to September 1. The Department also published an announcement saying that it is going to initiate a Negotiated Rulemaking process that will include a comprehensive review of multiple regulations, including regulations that involve the oversight of entities that are providing services to institutions. The Department will initiate this over the next six to eight months, starting in late spring. These regulations will likely not go into effect until July 1, 2024, at the earliest. Negotiated Rulemaking enables the Department to implement regulations, whereas a Dear Colleague letter is an opinion that can be rescinded the day after it was issued and by the next administration. The Department is likely attempting a regulatory proceeding because, if there is a change, it will have effectively changed the rules. And by the time there is another administration, it will have triggered a process that cannot easily be reversed if the Department has promulgated a rule, even though it has not necessarily gone into effect. With a few minor exceptions, every higher ed organization, including those usually at odds with each other, like the American Council on Education and the US Chamber of Commerce, have united by saying that the Dear Colleague position is wrong. More than just institutions that use third-party or online services will be affected. Essentially everything short of janitorial services will or may fall under these rules, including LMS or any online program delivery software that is “rented” by an institution. This will also likely prevent institutions and those entities that work with institutions from actually being able to work together. Jason Tuschen enlisted in the Navy in 1990. In 1992, he successfully completed Basic Underwater Demolition / SEAL (BUD/S) training and was assigned to SEAL Team THREE. After multiple deployments, he was selected for assignment to Naval Special Warfare Development Group, where he served as an operator and later a leader of an assault force. In December of 2001, he took an assignment as an instructor at the Naval Special Warfare Center and spent the next two years teaching tactics to future SEAL operators and leaders. Upon completion of that assignment, he transferred to SEAL Team SEVEN where he was the senior enlisted advisor of the task force responsible for leading the team through pre-deployment training and a follow-on deployment to Baghdad, Iraq. Upon return from that deployment, he was promoted to Master Chief Petty Officer and put in charge of First Phase at BUD/S. After a successful tour at BUD/S, he spent the next decade in executive leadership positions throughout Naval Special Warfare. His career culminated at Naval Special Warfare Group ONE (NSWG-1) where he served as the Command Master Chief, responsible for 2000 personnel, four SEAL Teams and five ancillary commands focused on executing National Security Strategy in the Middle East, South East Asia, and the Korean Peninsula. In 2018 Jason retired after a 27-year career in the military. Along with retired SEAL Command Master Chief Jason Torey, they founded Randori INC to help develop the leaders and cultures of organizations. After being an advisor to the CEOs of tech startup Sylabs, in April 2020 he took over as CEO of Sylabs Inc. He holds a Bachelor of Science in Administration and Management from Excelsior College and a Master of Science in Management from the American College of Financial Services. My guest today is the Chief of Minority Business and Workforce (division office of economic impact and diversity) at the US DOE, Shalaya Morissette. Prior to her role at the DOE Shalaya was the Senior Technical Inspector at the Gas Pipeline Safety group for National Grid USA. She holds a Bachelor's degree in Business Administration and a Master's in Education from Cambridge College and is currently pursuing a bachelor's degree in Nuclear Engineering Technology with Excelsior College.On this episode of the Clean Power Hour, Shalaya joins Tim Montague to discuss opportunities that minority groups in the US have when it comes to the clean energy transition through the DOE, how to convince people of color to take up the clean power baton, and much more. We must become more intentional about diversity and inclusion in clean energy and Ms. Morisette's work is at the center of this. Clean energy is still dominated by white men. Blacks represented 8 percent of clean energy while they are 13 percent of the workforce. According to a report by the National Association of State Energy Officials, only 25 percent of energy workers are female, compared to an overall average of 47 percent in the workforce. Given the incredible job growth of the energy sector, and the expected growth thanks to current government policies, the lack of diversity threatens women, Hispanics, and Black workers in particular. As the United States looks to build back a better, cleaner, more equitable economy, a renewed focus on increasing diversity in the clean energy sector should be an economic imperative. Beth and Kate interview Marney Broderick! Marney lives in Columbiana on Lamppost Farm! She was born in Hastings, New Zealand and was raised in a rural community on a farm. After attending Te-Mata Primary School, she went to Napier Girls' Boarding School. Following, she went on to attend Choffin School of Nursing for her LPN and Excelsior College for her RN. Marney traveled to the US and areas of Europe for her OE (Overseas Experience). After coming to Jesus, Marney went with YWAM for her DTS and then was a primary healthcare worker in the Philipines. After being married and having two children in the Philipines, Marney and her family moved to Columbiana! Later, they bought the property that is now Lamppost Farms. Marney loves gardening, raising sheep, spinning wool, weaving, felting, crafting, photography and wandering! After just returning from a long trip to New Zealand last week, we're so happy have her back! Marney came to the Upper Room in 2013. We're so grateful for Marney and how she uses her life, her gifts, her resources, and her love for the people around her. Scott Dolan is a leader and innovator in the development of flexible and affordable online education. He was named dean of the School of Graduate Studies at Excelsior College in May 2019. As dean, he provides strategic academic and administrative leadership to the School of Graduate Studies, and is responsible for all academic matters, including strategic planning, budget oversight, and curriculum development, delivery, and assessment. Currently, he oversees programs in business, human resources, organizational leadership, data analytics, cybersecurity, public administration, health sciences, and criminal justice.  Dr. Dolan joined Excelsior College in 2014, and has served in various roles including: Director of Assessment and Program Evaluation, Executive Director of Accreditation, Assessment and Strategy, Associate Dean of Business and Associate Dean of Graduate Studies. Prior to joining Excelsior College, Dr. Dolan worked in the private sector as a Senior Researcher conducting program evaluations of federally- and foundation-funded programs in the P-20 education and health and human services sectors, including projects on the role of technology in education. His experience also includes nearly 15 years as an instructor at the College of Saint Rose, Siena College, Schenectady County Community College, University at Albany, and Excelsior College. His areas of expertise include assessment, accreditation, strategic planning, and program evaluation, with research interests in complex organizations and political and economic sociology. He is published in his field and has presented widely on current issues in online higher education.  When not pursuing his passion for higher education, he enjoys spending time with his wife and two children, playing golf, and following his favorite sports teams—especially the Yankees. Where ever did those extra hundreds of boxes found in the most recent FBI raids at Trump's Mar-a-Lago estate come from? If in January they had raided and indicated there were no more boxes or document left, why did they find all these volumes? Were they in hiding? I delve into this in the first segment of this episode. In the second segment I provided an audio commentary that Mr. John A. Castro had sent regarding a question I had asked about the Trump raids and his recent filing in D.C. in federal court against Donald Trump and the FEC saying that Donald Trump is ineligible to run as President and should not be allowed to run based on his alleged involvement in the January 6 insurrection. He shares a timeline and some expectations surrounding what next for the filing. In the final segment, I explored the issue of teaching Theology Today as a follow up to the previous episode (season 4:3) on Teaching Theology Today. With over a decade in the KM field, Brett Patron is a Senior Knowledge Management Advisor for the Office of the Chief Knowledge Officer of US Army Training and Doctrine Command.  Previously, he was a Deployable KM Strategist with Joint Enabling Capabilities Command (JECC), based in Norfolk, Virginia.  With JECC he deployed on over 30 missions globally over 4 1/2 years, including twice to Afghanistan.  Brett served in the US Army for over 22 years (enlisted and officer) and then spent over a decade as a Senior Defense Analyst before joining JECC in 2017. Brett was born and raised in Queens, NY but now calls Yorktown, Virginia home. He is married, with two children. He presented KM topics to both KM World (2021) and the ISKO Singapore (2021).  He is also a subject matter contributor to the Association for Talent Development's "Knowledge Sharing and Knowledge Management: Keys to a Culture of Learning" publication (2020). He was the 33rd Regimental of the 2nd Cavalry Regiment and currently serving as 1st Security Forces Assistance Brigade's Command Sgt Major at Fort Benning, GA. Mike has his master's degree in organizational leadership from Excelsior College. She was a Jamaican poet and activist. From Kingston, Jamaica Louise Bennett remains a household name in Jamaica, a “Living Legend” and a cultural icon. She received her education from Ebenezer and Calabar Elementary Schools, St. Simon's College, Excelsior College, Friends College (Highgate). Although she lived in Toronto, Canada for the last decade she still receives the homage of the expatriate West Indian community in the north as well as a large Canadian following. She was described as Jamaica's leading comedienne, as the “only poet who has really hit the truth about her society through its own language”, and as an important contributor to her country of “valid social documents reflecting the way Jamaicans think and feel and live” Through her poems in Jamaican patois, she raised the dialect of the Jamaican folk to an art level which is acceptable to and appreciated by all in Jamaica.

Veteran Returns & RecoveryAudacity is the key to victory in battle.~ Duane FranceDuane K. L. France is a clinical mental health counselor, a veteran, and currently serves as the Director of Veteran Services at The Family Care Center, a private mental health counseling agency specializing in the unique needs of military service members, veterans, and their families. He is also the Executive Director of the Colorado Veterans Health and Wellness Agency, a 501(c)3 Nonprofit affiliated with the Family Care Center. Duane talks more explicitly about the challenges of return, recovery and comprehensive treatment essentials. He's determined to make a difference in the recovery/re-entry process. BackgroundDuane is a retired Army Noncommissioned Officer and combat veteran, having served in deployments to Iraq, Afghanistan, North Africa, and Bosnia-Herzegovina. After retirement, he served as Program Director for the Colorado Veterans Resource Coalition, a 501(c)3 Nonprofit that provides emergency and transitional housing to veterans participating in programs at the local Department of Veterans Affairs clinic. Since transitioning to full-time clinical mental health counseling, Mr. France has provided mental health counseling services to the Colorado Fourth Judicial District Veteran Trauma Court. He earned a Bachelor of Science degree in Psychology from Excelsior College of Albany, New York and a Master of Arts in Clinical Mental Health Counseling from Adams State University of Alamosa, Colorado. In 2015, Mr. France was selected as one of five Military Scholars in the nation by the National Board of Certified Counselors Foundation, and in 2016 was selected as the awardee of the 2016 NBCC Foundation Capacity Building Grant. Featured Guest Melinde Lutz Byrne, CG, FASG Melinde Lutz Byrne, CG, FASG, is immediate past president of the American Society of Genealogists (elected 1993), and has been credentialed by the Board for Certification of Genealogists since 2010 (no. 1001). Trained as a cultural anthropologist (China, pre-Mao), invertebrate paleontologist, and archivist, she has written over fifty books and numerous articles. Her specialties have been identifying women's maiden names and naming the 200 Africans in Massachusetts Bay Colony before 1680. This year is her fortieth as a practicing genealogist. In 1976 she began research on a Midwestern family with a pattern of twins and triplets. In 1985, after a year as a stringer for Blake and Blake, Genealogists, she coined the term “forensic genealogy” research services. She became interested in forensic cold cases in 1990, took on apprentices, and continued historical work with, among other things, Robert Charles Anderson's Great Migration Study Project. In 1992 she submitted research to Mary Claire King and Tom Roderick in early mtDNA lineage studies and through 2015 served on the now quiescent genetic genealogy standards committee. Melinde has been editor of three state journals and president of four societies. She has served as co-chair of NERGC, Genealogy Symposium day for ALA, and a program chair for the Northwest Chapter of American Archivists. She is a graduate of the 2007 NIGR (now Gen-Fed). She teaches forensic genealogy for Boston University and a graduate genealogy practicum for Excelsior College. In 2011 she trained with Betty Pat Gatliff to do forensic facial reconstruction and learn why two artists had created such different images of her 1971 NH Jane Doe. She continues to work with cold case law enforcement on naming the unknown dead. Currently, Melinde is Program Director for Boston University's genealogy offerings in their Center for Professional Education; Program Director for Excelsior College's genealogy offerings in their Center for Professional Development; and co-editor of the National Genealogical Society Quarterly.
