Melvyn Leffler is Emeritus Professor of History at the University of Virginia and one of the world's leading scholars of U.S. foreign relations. Sixteen black and white documents from the Queensland State Archives, dating back to 1866, map out Australia's discriminatory race-based system of citizenship rights. This little recognised year in Australian history witnessed the landmark Mabo Decision, in which the Indigenous Torres Strait Islander Eddie Mabo legally asserted his peoples' pre-colonial rights to their land. Explaining the Need to Gather Evidence to Prove Fraud https://zalma.com/blog Direct evidence is proof that tends to show existence of a fact in question without the intervention of the proof of any fact. It includes testimony that tends to prove or disprove a fact in issue directly, such as eye-witness testimony or a confession. Sometimes, direct evidence may not exist because records have been destroyed in a fire, destroyed by water, stolen, discarded, or eaten by vermin. If direct evidence does not exist for any reason, circumstantial evidence must be produced to prove the fraud. Circumstantial Evidence Circumstantial evidence is all evidence of an indirect nature when the existence of the principal fact is deduced from evidentiary facts by a process of probability reasoning. The investigator takes circumstantial evidence and uses deductive reasoning to reach a conclusion. Circumstantial evidence and the deductions of a professional investigator are often more reliable than direct evidence like eye-witness testimony. Circumstantial evidence is sufficient to establish proof of arson and other criminal activities. Clear and Convincing Evidence The “clear and convincing” standard is a very difficult and stringent standard to establish. In New Jersey, in the case of Italian Fisherman, Inc. v. Commercial Union, 215 N.J. Super. 278, 521 A. 2d 912 (1987), the court refused to accept the clear and convincing evidence standard of proof proposed by the plaintiff in an insurance fraud defense, pointing out that proof of fraud by a preponderance of the evidence (50 percent plus one, which is much easier to establish than the “clear and convincing evidence” standard) renders the insurance policy void from its inception. Preponderance of Evidence An insurer need only prove arson by a preponderance of the evidence. In our view the defense of arson against a fire insurance claim is established if it is proved by a preponderance of the evidence. Scienter In fraud cases, where intent, knowledge, and scienter (evil intent or guilty knowledge) constitute essential elements of the offense, evidence of similar frauds and misrepresentations is admissible at trial. The insurer need only demonstrate the facts elicited during an investigation that support the founded belief that a fraud was attempted. Sometimes a BUNCH of evidence is too much evidence.

As COVID-19 spread throughout the world in the spring of 2020, most scientists accepted the pandemic origin story as told by China and supported by the WHO: the virus jumped from an animal to a human in a Wuhan wet market. Yet after examining how COVID-19 spread among humans and infected its hosts, a few scientists began to question the role of nature in its creation. They found evidence which pointed to the Wuhan Institute of Virology, a research lab where pathogenic viruses were being studied, and enhanced, in their capacity to infect people. In the fall of 2019, they argue, one of these research subject viruses infected a lab worker and escaped, spreading to the nearby population and beyond. After many months of being dismissed as a conspiracy theory, a growing number of scientists and government agencies have begun to warm to this hypothesis, calling for further investigations into the Wuhan lab and more transparency from the Chinese government. Some scientists, however, are not persuaded. A number of virologists who studied the novel SARS-CoV-2 coronavirus genome sequence are steadfast in their belief that the virus is nature borne. Not only do its genetic sequences and protein structures mimic a bat virus, the way it infects humans does not suggest any biological engineering. The suggestion that COVID-19 leaked from a lab is a dangerous conspiracy theory not supported by the facts which could affect the study of other coronaviruses and harm our preparedness for future pandemics. Arguing for the motion is Dr. Steven Quay, an anatomic pathology specialist and the author of “Stay Safe: A Physician's Guide to Survive Coronavirus.” Arguing against the motion is Dr. Daniel Griffin, an infectious disease expert and clinical instructor of medicine at Columbia University. It's not even that I look for certain things in my world as much as they happen to appear. And I know all about the Volkwagon Beetle phenomneon: when you get a new car... in the parlace of this example, a VW Bug... you start to see them EVERYWHERE. It's a trick of the mind and of the fact that people are more suceptible to mass marketing strategy than anyone wants to admit.

Leadership is IMPOSSIBLE without authentic, accurate and clear communication. What happens when others work hard to muddy your communication and intent? From politics and media to parents and kids, from teachers and students to friends and family, there are thousands of voices clambering to be heard. Each voice is constantly shouting louder into the fray stirring up confusion over clarity. Many of these voices are well intentioned but lost in the crowd become nothing more than background noise. Some of these voices are misguided but firmly convinced they are serving a greater good. Some of these voices labor feverishly with malice of forethought to create further confusion, contention and to complicate issues. Mass media, social media and “peer media” all compete for attention and action. Everyday there is a new “tactic to gain customers or followers” and most of them require a new strategic use of social media platforms. Persuasive skills, communication tools and linguistic manipulation have become the norm in business, politics and education. Leaders must learn and master the power of consistent, accurate communication. Repetition, repetition and more repetition will be necessary to combat the voluminous amounts of misinformation and useless information. Brian finds out that cancer or not, he is facing testicle-ectomy in order to stay alive. The prognosis is good, but life with one ball seems to weigh on Brian the most. Hunter struggles to process his first HIV-related death and Michael doesn’t make it any easier on him as he struggles with his own emotions.
