Send us a textCriminal defense usually includes keeping the burden with the prosecution to attempt to prove their case beyond a reasonable doubt. That approach can be turned upside down with activists who broadcast their actions loudly and clearly. Fairfax criminal lawyer Jonathan Katz first faced that situation when teaming with Ramsey Clark to defend four Plowshares activists who hammered on warplanes outfitted to fire depleted uranium missiles. The four defendants' openness about their actions made winning the destruction of property count a challenge to win at their jury trial, while pretrial, Jon still convinced the trial judge to dismiss the sabotage and sabotage conspiracy counts. Early in his criminal defense career, Jon Katz heard Gerald Lefcourt tell about how his client Abby Hoffman sought for Lefcourt to keep him out of jail so that he could pursue his activism. Jon wondered if he had missed the boat for defending activists until he was asked to defend the Plowshares. Ramsey Clark told Jon that the opportunities to defend activists are many, at least when doing so pro bono. When Jon asked about a lawyer(s) to turn to for suggestions for defending activists, Mark Goldstone's name immediately came up. Mark was delighted when he received a court appointment for an activist protesting in the Capitol against Ronald Reagan's policies in supporting anti-communist combatants in Nicaragua, and was even more delighted when the lawyers for the 130 other defendants withdrew their representation, leaving those defendants with Mark. When Jon met Mark, Mark led the demonstrations committee of the local National Lawyers Guild, which Jon Katz first joined because of its work for criminal defendants and immigrants, and its stand for racial justice and gender equality, but left several years later when the group became too doctrinaire, and even issued a call to support Muntadhar al-Zaid -- who in 2008 threw his shoes at George W. Bush in Iraq -- and called to donate shoes for needy people, with not a peep against violence that was part of the shoe throwing. Over the decades, Mark has become a go-to lawyer for political activists -- including supporting their First Amendment free expression rights -- and for judges seeking criminal defense lawyers for appointments for such defense. Mark is a devoted, principled and caring person and attorney. The Internet Watch Foundation has been tracking the increasing trend of perpetrators grooming children online and coercing them into sexually abusing themselves on camera. The foundation has recognised a lot of what they are seeing as Category A, the most severe kind of sexual abuse, due to it including penetration with an object. Some of the child victims of this online sexual abuse are as young as 7 years old. For the first time, a snapshot study out today looks into the objects being used, and how they are everyday domestic items that can be found in the household. We hear from Susie Hargreaves, CEO of the Internet Watch Foundation, and CEO of the Marie Collins Foundation, which supports child victims of online abuse, Vicki Green. The story contains content that some listeners may find distressing. She's been on screen in nearly 2,000 different film and TV appearances and yet she may have completely escaped your notice. Now the woman thought to be Britain's most prolific extra - Jill Goldston - has become the actual star of a short film called "Jill, Uncredited". She joins Anita in the studio to talk about her life lived just out of focus behind some of the world's biggest movie stars. It's Children in Need tonight so we thought we'd look at one of the projects it funds. Getaway Girls is a charity which first opened its doors to women and girls in Leeds 35 years ago initially offering girls a safe space to go to make friends and learn new skills to empower them and help grow their confidence. Over the years it has worked to support girls who have experienced difficulties at home from domestic violence, exploitation or sexual abuse to newly arrived refugees. Getaway Girls has received funding from BBC Children in Need since 2010 and this year in partnership with BBC Radio 2 it has a new home thanks to the DIY SOS the Big Build team. Alia Nessa, Operations Manager at Getaway Girls talks about the project. We speak to Judith Kilshaw who was once seen as Britain's ‘most hated woman'. She caused outrage internationally after she and her husband paid a fee to adopt twin babies in the US. The case led to a change in UK adoption law and now she is speaking out in a new documentary which tells the stories of the three mothers involved. Naomi Angell, head of Adoption, Surrogacy and fertility law unit at Osbornes Law explains how the legal situation has changed. The following is a computer-generated transcription, some grammar and spelling errors may be inherent Hey guys, Anthony Bandiero Here attorney, Senior Legal instructor bringing a roadside chat from an officer in Texas. Now, this officer says, you know, ask basically can we automatically pat down suspected gang members? Right? And to give you a little context here, the officer is talking about, you know, attending some outlaw motorcycle gang training, and, you know, get a lot of bad deals in the area. And then instructors basically saying, hey, look, if you are dealing with a one percenter, right? Michigan versus long, which is a US Supreme Court case, about first can vehicles allows you to essentially, you know, conducted frisk of that motorcycle for for weapons. The officer will first ask, though, this is what they teach, they'll ask for consent to search the motorcycle, if they say no, then they get them off the bike. And they search it anyway. Because of their because they're, it's known that gang members can easily access the saddlebag these game members can access to settle back and potentially grab a weapon. Now, the question is, is does Michigan versus long really hold that that suspect a gang members, you know, essentially can be automatically patted down just with that fact alone. And certainly, Michigan versus long doesn't it's not that fact pattern that's that case involved a drunk driver who crashed into a ditch and the officer saw him trying to go back to the car, it was a knife in the in the mat pocket in the door, if the door is open, you got you know, long back and another partner looked for sees the knife and look for more weapons in the immediate area, and found narcotics in the center console and the Supreme Court upheld it because the logic was, hey, look, he was trying to go back to the vehicle. It's, you know, it's a fluid situation, he's intoxicated, there was only one weapon in there, that could potentially be another weapon in there. And that frisk of the vehicles upheld, but it certainly didn't talk about anything about gang members. Now. All I can tell you is what I teach, right? I don't teach automatics like, you know, automatic searches, you know, for my cops. There's really no automatics out there. There's no free lunch when it comes to the Fourth Amendment, you're going to have to work for it a little bit, you're gonna have to go to court and explain that simply having a 1% patch. You know, that's one factor. It's a very important factor and, and but what else do you got there? I mean, you know, we're gonna have to have something more. And usually there's going to be so that's the good news. Here are some cases that kind of, you know, illustrate what I'm talking about, right. Here's a case out of Kansas, a case called State vs. Goldston. 2009. Now it says here at the time that the officer conducted the pat-down, he knew the following facts about the suspect. He was in a database as a documented gang member. He was with a known gang member who was on supervised release from prison and had been involved in prior stop involving drugs within the last two weeks. He had just come from a city known for drug activity, and were several arrests and or area of town. Actually, I think, I'm sorry, it's not a city. It was a gas station. He just came from a gas station where several rest of them made recently for drug activities and so forth. The officer also articulated he knew that drug dealers that involved in gangs often had weapons to protect the drugs and the money. Right. They're self help, right? They're like their own little police department. And considering all these facts, the court upheld, but do you see what's going on there? It's not just saying Your Honor. The person is a one percenter therefore, I conducted a vehicle suite, you know, or pat down. We need something more than that in mind book, but you're gonna have it usually...

Jackie Goldston talks playing The Secretary on "Doom Patrol", working with Hamish Linklater, living in Atlanta, and the time she fell asleep on the job! About Jackie Goldston:Born and raised in Tustin, California, Jackie got the acting bug in her senior year of high school after she booked a role in a play. With plans to become a doctor, Jackie changed her course and attended Chapman University where she graduated in Communications with an emphasis in Media Performance – Theater, TV, and Film acting. For the past three years, Jackie has played the role of The Secretary on HBO's “Doom Patrol.” Based on comic books, this role gave Jackie and other members of her cast a unique opportunity to create a character from scratch while some other members of the cast referred to their characters' journeys that took place in the “Doom Patrol” comic books. Jackie portrays The Secretary as a professional and efficient minded character who rarely shows emotion and is logical. The Secretary carries reason and in turn, is the influential mother figure that the character of Jane looks up to. Jackie relocated to Atlanta in the late '90s and has been living there ever since. Her first professional role was a national commercial for the mattress company, “Simmons Beautyrest.” Other past credits include guest roles on “Tell Me Your Secrets,” “The Passage,” “Shots Fired,” “Limbo,” and “Ambitions.” Past film roles include “Blended” with Drew Barrymore and Adam Sandler. In “Tell Me Your Secrets,” Jackie had a phenomenal experience with her scene partner Hamish Linklater and is one of her favorite projects to date.In her spare time, Jackie enjoys hikingand adventuring as well as photography, and spending time with family. Jackie is heavily involved in the charity organization “Be Rich” which vets and partners with a variety of charities to provide donors peace of mind that their money is going where it should. A cause particularly close to her heart is awareness to help those who suffer from Myeloproliferative Neoplasms (MPN), a term for several types of blood cancer that her daughter was diagnosed with years ago. Jackie is an advocate for mental health and is on the committee of a local SAG-AFTRA charity to help actors deal with mental health issues in the Atlanta area. Jackie founded a non-profit theatre company, also in Atlanta, that produced comedies, dramas, and musicals in a town that was void of acting opportunities for adults. I was contacted on LinkedIn by Dr Justin Goldston of Penn State university. Molly’s dedicated her life and family farm to rescue animals from surrounding counties and finding homes for them here in Raleigh and even NYC. You can hear the intensity in her voice, as she describes what it’s like driving with animal control to cruelty cases, selecting which dogs can be saved, and even showing love to all the employees at area shelters as they give their all with so little resources. Saving Grace has found homes for over 20,000 dogs and counting. Saving Grace is also growing. They are fundraising for an expansion project and need your support! Turning to domestic and international courts through strategic litigation has been central to global human rights activism for decades. It is a strategy that has been used to create long lasting social change in laws and public policies with the goal of advancing human rights. For some, litigation in the name of human rights has been a great success, making the human rights movement stronger by increasing its judicial power. For others, human rights litigation remains a 'hollow hope'. It brings minimalistic, slow and fragile gains at best or, at worst, gives rise to social and political backlash. The recent decay of the rule of law in many parts of the world further puts the role of litigation and courts as engines of human rights change into question. Can strategic litigation help promote long lasting human rights change or is it merely a hindrance? Can it be done differently to increase effectiveness? What’s does the future hold for strategic litigation for human rights in an age of illiberal democracies and authoritarianism? On 13 June 2019 Wolfgang Kaleck, Founder and Secretary General of the European Center for Constitutional and Human Rights (ECCHR), and Başak Çalı, Professor of International Law at the Hertie School of Governance and Director of the Center for Global Public Law at Koç University, debated the issue at the Hertie School of Governance. In our latest episode of “On Human Rights," we sat down with James A. Goldston. He is the executive director of the Open Society Justice Initiative and a leading practitioner of international human rights and criminal law. He has litigated cases before the European court of Human Rights and United Nations treaty bodies. For example, he has worked on issues of counterterrorism, racial discrimination, and torture. Goldston says the challenges that illiberal movements and leaders pose to human rights is a moment of reckoning for many. He says: “I think it’s a moment for self-reflection perhaps on strategies for things we might have pursued or things we’ve overlooked. And a moment of genuine possibility for us to reimagine what the human rights movement can be, how it can relate not just to the grand architecture and formal laws and institutions which are created, which are important, but also to how people experience rights in practice, or the absence of rights in practice.” In addition, Goldston believes increasing attention to the connection between the formal laws and institutions and the conditions of people on the ground is where parts of the human rights movement are headed. “And I think that’s a positive thing,” he says.
