But when it comes to data security, Peter Baumann, CEO and co founder of ActiveNav, we derive the value of the data because we just can't get through the risk. There are three things always facing businesses whenever there is data involved, and that is the protection of the business's reputation, the costs involved in non-compliance, and then the exponential growth of data within the organization. We are so focused on reacting to these three variables, that we simply cannot do anything on the value of the data itself. Peter talks with us about the number of existing patchwork of regulations around the world, and how it makes it too difficult for business and organizations to comply. And while most experts suggested that regulations like GDPR would only govern those with businesses or people in Europe, it's become the de facto compliance bar for privacy and data security for many businesses. He suggests that the US Government needs to step in an set a clear regulatory path around data privacy and security so that businesses know what the rules are, and the legal industry can better advise their clients on what steps they need to take to be compliant. We dive deep in this episode and talk about what is structured and data. And how the existence of "dark data" within a business is what brings the highest risk of all. While doing data assessments on Terabytes and even Petabytes of data is extremely expensive, data breaches are even more expensive. The goal in Peter's mind is to get to "zero dark data" so that you can stop worrying completely on the risks, and start understanding the value within your data. It is also data that rarely gets thrown out, instead residing indefinitely on devices and services. It includes weblogs, tracking data, surveillance footage, email correspondence, chatroom conversations, presentations and old spreadsheets. This data is typically unstructured, and often it is very opaque. It also carries significant risks including the need to access it during litigation, and it even may create privacy issues. How can you get a handle on this data? Shine a light on it. Determine where it is in your organization and start building a data inventory that classifies the data. Next determine what is worth keeping and what needs to be destroyed. And, for the data worth keeping, take the trouble to classify it. Most of all, treat this as an ongoing issue to manage. Data tends to collect itself, in many ways, and organizations need to be aware of what it has and what it's for. That requires the creation of better policies for collecting and managing data. Those policies need to be pragmatic, reflecting both business needs and the inevitable collection of ever more amounts of data. Peter Baumann is Tom Fox's guest on this week's episode of the Innovation in Compliance Podcast. He is the founder of ActiveNav, a company that helps its customers reduce data risk, make better management decisions and comply with privacy regulations. He has been in the information governance field for 30 years both as a publisher and as a content creator. Peter joins Tom to talk about how the disciplines of information governance, and the data industry, relate to a variety of compliance issues. How Information Governance Has Changed The most significant change in information governance, Peter tells Tom, has been its explosion of growth. Companies used to only operate from a singular network, and via a single machine. There was well managed control, and no-one else was able to have access to the information filtered through those single networks and machines. That is no longer the case. With the rise of the internet and connecting corporate networks with each other, the control has collapsed and sensitive data has become more accessible. Being Compliant Through Data Retention Policies Peter iterates that companies need to have a map of their data and what's actually in it. "Until you get there, you're always gonna fall short of meeting any of these privacy regulations because you can't actually say what you've got, where it is, and whether you should have it," he adds. Companies need a top and bottom approach to their data mapping, which lets companies know how to approach these issues strategically. Peter also stresses that senior management need to treat their data as if it's the best asset in their organizations. "Only when those things become a kind of de facto position will organizations start to manage and govern their data appropriately," he tells Tom. Unstructured Data & Eradicating Dark Data Peter explains that unstructured data is data that sits outside of a database environment. The very idea of a database is based on the concept of structure, so any data existing outside of it is unstructured. To get rid of dark data, companies need to have an understanding of what data they have, its nature, size, and where it is stored. That is the first step. The second step is minimization, that is, doing a system cleanup of redundant files or records that are beyond their natural retention policies. The final step would then be to find your sensitive data, understand what it is, then either encrypt or delete it, or move it somewhere else. This will get you to your government's baseline. The Impact of COVID-19 & Looking To The Future The pandemic has changed how companies approach data as content has become more fragmented now. "The biggest change I'd say, is the shift in both commercial, private, and government towards more collaborative based tools," Peter remarks. He gives the examples of Microsoft Teams and Slack. The downside of these tools however, is that they don't have the appropriate mechanisms built into their platforms to ensure that they are complying with governance. With respect to the future, companies should expect to see penalties and fines start to drift down to mid-market and eventually smaller businesses. "Ignorance and the lack of policy systems and preemptive planning won't be tolerated as an excuse by the courts," Peter warns. The tools and the experience are out there to ensure that companies are aware of what data they have so they will be expected to comply with regulations and face the consequences if they don't. Already we are half way into 2016, time certainly passes us by quickly these days and it’s been another good year for the music we all love, looking forward to what comes in the next half. In 1969, we'd spearheaded student protests that led to a month long strike of the University. Our demands included removing ROTC from campus, creation of an African-American studies program, and reforming Harvard's behavior as a landlord. Twenty years later, I encouraged my classmates to live up to our youthful ideals. I recall focusing on environmental challenges, including the mounting evidence of man-made contributions to climate change. But when asked where we needed to focus our attention to turn things around, I pointed to the environment within our own minds. Now, over twenty years later, my conversations about politics, economics, technology, ecology, etc. focus more and more on the need to tinker with the human software that drives or interprets everything we do. As we use the tools of science to explore the nature of humanity, we are learning more and more about how our brains function and what motivates our behavior, built-in biases and blind spots. Peter began his career as a member of the acclaimed band Tangerine Dream, and went on to found the Baumann Foundation, an interdisciplinary think tank dedicated to exploring what it means to be fully human. Michael has been a professional writer and researcher for more than two decades. With Natural Enlightenment Press, distributed by Sounds True, Peter and Michael have co-written the book Ego: The Fall of the Twin Towers and the Rise of an Enlightened Humanity.
