Episode 508 - A X Foster - GAVEL TO GAVEL and DOUBLE BLIND - THE SENECA COUNTY COURTHOUSE SERIESA. X. Foster was a prosecutor in Maryland for 20 years and then opened up his own law firm where he represented criminal defendants for an additional 15 years.As a prosecutor, he tried approximately 100 jury trials, including homicides, sexual assaults, domestic violence and animal cruelty cases. His work promoting increased protection for animals led to the legislature enacting the first felony animal abuse law in Maryland history.  He also won the first conviction under the new law in 2000.Foster graduated from Bennington College in Vermont with a double major in Literature and Theatre Arts.  He then spent two years as a copywriter at the Madison Avenue advertising agency Ogilvy & Mather.Foster then traveled in Europe while based in Amsterdam, where he performed for two years at the English Speaking Theatre of Amsterdam. After returning to New York, he became a member of the acting unions Actors' Equity, the Screen Actors' Guild, and the American Federation of Television and Radio Artists.  In the 1980s, Foster performed in various TV soap operas, including “Ryan's Hope,” “Search For Tomorrow,” “The Guiding Light,” “Another World,” and “As The World Turns.”Disenchanted with the world of professional acting, Foster entered law school to become an entertainment lawyer, but took a different path once he studied criminal law.At Emory University School of Law in Atlanta, Foster won the school-wide Moot Court tournament and also received the prize for best legal writing, the Best Brief Award, and the prize for best speaker, the Best Oralist Award.  He was then named to represent Emory in the National Moot Court tournament where he competed against other law schools from across the country.Upon graduation from law school, Foster first worked for the Department of Justice in Wilmington, Delaware and then took a position as an Assistant State's Attorney in Maryland.GAVEL TO GAVEL, Foster's first legal thriller, is based on Foster's experiences as a prosecutor.  A life-long fan of murder mysteries and legal thrillers, with Agatha Christie, John Grisham and James Patterson as influences, Foster began writing the novel in 2020, when COVID greatly curtailed activity in the local courthouse.In GAVEL TO GAVEL, a wealthy businessman is murdered by his wife. Alright, this one is straight out of a horror movie—but unfortunately, it's all too real. A 46-year-old Maryland woman, Candace Craig, will be spending the rest of her life in prison for brutally murdering and dismembering her own mother with a chainsaw. And as if that wasn't twisted enough, she then tried to blame the whole thing on her own daughters. Even the prosecutors were left stunned. Assistant State's Attorney Shauna Coleman, clearly at a loss for words, summed it up perfectly: “This happens in movies and books, not in real life.” But here we are. This nightmare unfolded on May 23, 2023, at the family's home near Hyattsville, Maryland. And what was the alleged motive? A credit card dispute. Yeah, you read that right. A fight over money led Candace Craig to commit one of the most gruesome crimes in recent memory. After killing her 71-year-old mother, Margaret Craig, authorities say Candace took things to an unthinkable level—she chopped up her mother's body. And she didn't do it alone. Her 21-year-old daughter, Salia Hardy, was dragged into this mess too. According to prosecutors, the two of them tried burning Margaret's remains on a grill—while also cooking chicken at the same time, apparently thinking the smell of BBQ would somehow cover up the stench of burning human flesh. Because nothing says “totally normal backyard cookout” like gasoline and human remains on the grill. Salia Hardy was later charged as an accessory after the fact. Her defense argued that she has learning disabilities, making her especially vulnerable to manipulation. She ended up taking a plea deal and later testified against her mother. When the case hit the courtroom, it was as disturbing as you'd expect. Judge Karen Mason didn't mince words when she called Craig's actions “something so unimaginable.” Then she handed down the ultimate punishment—life in prison without parole. And while the details of this case could make even the most seasoned crime reporter queasy, the prosecution didn't want to focus on the horror. Instead, they tried to shift attention to Margaret Craig's life rather than just the brutality of her death. “I would instead like to preserve the memory of Margaret Craig,” Coleman said, choosing to honor the victim rather than dwell on the carnage. One of the most damning pieces of evidence came from Salia Hardy herself. She testified that on the night of the murder, she heard her grandmother scream, but her mother brushed it off, saying something just fell in the basement. Oh, and then she casually warned her daughter not to go into grandma's room. The next day, when Hardy was home alone, she made a horrifying discovery—her grandmother's lifeless body, stuffed in a bin with a trash bag covering her head. And if that wasn't disturbing enough, Candace Craig didn't even try to justify what she had done. Instead, she told her daughter that they had to get rid of the DNA. The options she suggested? Acid, burning the body, or dismemberment. You know, just a casual brainstorming session about how to cover up matricide. Prosecutors laid out exactly how methodical Craig was. She went to Home Depot (because of course she did) and bought grilling supplies, including a can of gasoline. But her plan didn't go smoothly. When they tried to burn Margaret Craig's body on the grill, the fire got out of control, prompting neighbors to step in and help put it out. Firefighters were even called—yet somehow, no one discovered the body at that time. By the next morning, with the fire out and the remains "cooled off" (Hardy's words, not mine), they brought Margaret Craig's charred remains back inside the house. That's when Candace allegedly took a chainsaw to what was left, dismembering her mother in the basement. When police eventually arrived for a welfare check on June 2—after a 911 caller reported they hadn't heard from Margaret in days—they were hit with a smell that could only mean one thing. You guessed it—decomposition. Officers found blood and tissue on the floor. They found three white plastic trash bags. One of them? Contained what looked like brain matter. And sitting nearby? A knife and a chainsaw, both covered in human remains. During trial, Assistant Medical Examiner Dr. Pamela Ferreira revealed that investigators recovered 67 pieces of Margaret Craig's remains. But here's the unsettling part—some body parts were never found. The condition of what they did find showed clear signs of both burning and dismemberment with a mechanical saw. While it was clear she was murdered, the exact cause of death? Still undetermined. After sentencing Craig to life without parole, Judge Mason left her with some haunting words: "What we have here is a woman who led a good life and left this world in such a way. And only you know, Ms. Craig, exactly what happened here." And that's the terrifying part. Only Candace Craig knows exactly what happened that night. So, what's left? In today's show we cover the Courtney Clenney Arthur hearing testimony of the lead investigator, Detective Brecino. Specifically, we cover Brecino's direct examination by Assistant State's Attorney Khalil Quinan.Overview:This week we're covering "OnlyFans Killer" Courtney Clenney, who on April 3, 2022 killed her boyfriend Christian Obumseli with a knife in their Miami apartment. Obumseli suffered a single knife wound to the chest.Clenney would tell investigators that the much larger and heavier Obumseli was a domestic abuser, and had pinned her to the wall by her throat and thrown her to the ground. She somehow managed to escape, move 10 feet away, grab a small kitchen knife, and toss it in his direction.That knife managed to penetrate Obumseli's chest, severing carotid arteries, and quickly leading to his death from massive blood loss.Although investigators initially perceived the event as an act of self-defense, they quickly began to suspect otherwise. Much evidence emerged that Clenney had been a violent abuser in the relationship--indeed, it seemed that she had previously stabbed Obumseli on an earlier occasion, simply because she was angry that he had stayed late to watch the overtime of a football game. There also emerged video of Clenney attacking Obumseli with her fists in an elevator.Ultimately Clenney was charged with second degree malice murder by Florida prosecutors, and she is in jail awaiting trial on that charge today.In late 2022 Clenney sought pre-trial release, offering to stay under house arrest with her parents in Texas. Florida prosecutors disagreed, and a motion was filed for an Arthur hearing. This is a Florida-specific hearing that is essentially a mini-trial, in which prosecutors have to prove by a strong presumption that the defendant is likely to be convicted at trial (Phase 1) as well as that the defendant is a flight risk if released (Phase 2).The Arthur hearing was held on Tuesday, November 15, 2022, and Thursday, November 17, 2022, with key testimony primarily from the lead investigator and the medical examiner on those two days, respectively. Spoiler: On December 8, 2022, the hearing judge would ultimately deny pre-trial release. Christian E. Ketter is an Adjunct Professor of Law at University of Illinois Chicago School of Law and a member of the American Association of University Professors. Prior to joining Peterson, Johnson & Murray, Christian practiced municipal law, civil rights defense, and appellate matters in Itasca, Illinois and was an Adjunct Professor of criminal procedure at Morton College. Today's Show:In today's show we cover the Courtney Clenney Arthur hearing testimony of the lead investigator, Detective Brecino. Specifically, we cover Brecino's direct examination by Assistant State's Attorney Khalil Quinan.Overview:This week we're covering "OnlyFans Killer" Courtney Clenney, who on April 3, 2022 killed her boyfriend Christian Obumseli with a knife in their Miami apartment. Obumseli suffered a single knife wound to the chest.Clenney would tell investigators that the much larger and heavier Obumseli was a domestic abuser, and had pinned her to the wall by her throat and thrown her to the ground. She somehow managed to escape, move 10 feet away, grab a small kitchen knife, and toss it in his direction.That knife managed to penetrate Obumseli's chest, severing carotid arteries, and quickly leading to his death from massive blood loss.Although investigators initially perceived the event as an act of self-defense, they quickly began to suspect otherwise. Much evidence emerged that Clenney had been a violent abuser in the relationship--indeed, it seemed that she had previously stabbed Obumseli on an earlier occasion, simply because she was angry that he had stayed late to watch the overtime of a football game. There also emerged video of Clenney attacking Obumseli with her fists in an elevator.Ultimately Clenney was charged with second degree malice murder by Florida prosecutors, and she is in jail awaiting trial on that charge today.In late 2022 Clenney sought pre-trial release, offering to stay under house arrest with her parents in Texas. Florida prosecutors disagreed, and a motion was filed for an Arthur hearing.  This is a Florida-specific hearing that is essentially a mini-trial, in which prosecutors have to prove by a strong presumption that the defendant is likely to be convicted at trial (Phase 1) as well as that the defendant is a flight risk if released (Phase 2).The Arthur hearing was held on Tuesday, November 15, 2022, and Thursday, November 17, 2022, with key testimony primarily from the lead investigator and the medical examiner on those two days, respectively. Spoiler: On December 8, 2022, the hearing judge would ultimately deny pre-trial release. The US Department of Justice Criminal Division has been increasingly vocal about what makes organizations' ethics and compliance programs effective. This input on program effectiveness takes the form of guidance to prosecutors about what questions to ask when companies negotiate to resolve DOJ investigations into corporate wrongdoing on favorable terms. What does this guidance on program effectiveness mean in practice for E&C professionals? In the season 10 premiere of LRN's Principled Podcast, host Susan Divers speaks with John Michelich, who retired last November after 35 years as a federal prosecutor with the Department of Justice's Criminal Division. Listen in as they explore how the DOJ evaluates E&C programs, as well as best practices for companies settling misconduct investigations.  For a full transcript of this podcast, visit the episode page at LRN.com   Guest: John Michelich John Michelich is a retired career prosecutor, who has served at the state, federal, and international levels for 45 years. A native of Illinois, John received his undergraduate education at Illinois Wesleyan University and then attended Drake University Law School in Des Moines, Iowa. For 10 years, John served as Assistant State's Attorney and First Assistant State's Attorney in Springfield, Illinois, where he prosecuted all types of state criminal felony violations including armed robbery, aggravated sexual assault and capital murder.    In 1988, John moved to Washington, DC where he began his 35-year career as a prosecutor with the US Department of Justice, Criminal Division. As a federal prosecutor, John has handled a wide variety of cases including child pornography and obscenity, narcotics distribution and all types of white-collar criminal cases. John served for 30 years as a prosecutor with the Fraud Section of the Criminal Division where he handled numerous cases including health care fraud, bank fraud, telemarketing fraud, commodities and securities fraud and violations of the Foreign Corrupt Practices Act. Because Washington DOJ lawyers are traveling prosecutors, John has handled grand jury proceedings or jury trials in more than two dozen federal districts nationwide from Guam and Hawaii to Puerto Rico, and California to New York. Over his long career, John has tried dozens of jury trials to verdict.   In 1998, the Justice Department sent John on loan to the United Nations' International Criminal Tribunal for the Former Yugoslavia, also known as the War Crimes Tribunal, in the Hague, Netherlands, where he handled investigations and Tribunal proceedings involving crimes against humanity and serious breaches of the Geneva Convention that occurred during the Yugoslavian civil war.    For over 40 years, John has been an active instructor of Trial Advocacy and has appeared regularly on the faculty of the NITA Trial Practice course offered at Georgetown University Law Center. In addition, John has served as an Adjunct Professor at Georgetown, teaching Trial Practice courses to third-year law students. In his retirement, John is available as a legal consultant to trial lawyers to advise them in preparation for jury trials and to consult with corporate counsel concerning internal investigations and to advise them on how to approach the government when there are allegations of wrongdoing, especially foreign bribery.  John is licensed to practice in the states of Illinois and Iowa, and several federal courts, and is a licensed Solicitor of the Senior Courts of England and Wales.      Host: Susan Divers Susan Divers is a senior advisor with LRN Corporation. That's according to an analysis of public employment and Illinois State Board of Elections (ISBE) records. Deborah E. Witzburg-Beidler, 39, worked as an Assistant State's Attorney for Cook County from 2008 to 2016 before leaving to join the Chicago Mayor Inspector General's office. In Fall 2015, Beidler made a maximum, $5,400 donation to Foxx's first campaign for Cook County State's Attorney 2015, while her daughter-in-law worked for the office, ISBE records show. Her husband, Frank, also donated $1,000 to Foxx that fall. A former assistant state's attorney herself who rose to the role of supervisor, Foxx and Witzburg-Beidler worked together for five years, from 2008 - 2013, county records show. ISBE records show Beidler has been a longtime backer of Foxx-sponsor, Cook County Board President Toni Preckwinkle, donating to her campaign 14 times for a total of $9,500. Preckwinkle hired Foxx as her “Chief of Staff” before positioning her to challenge then-incumbent Anita Alvarez for Cook County State's Attorney in 2016. Six promotions Witzburg-Beidler joined then-Chicago Mayor Rahm Emanuel in May 2016 as an assistant inspector general and stayed on when Lightfoot won election three years later. Her mother-in-law has been a campaign supporter of both Chicago mayors. Beidler made campaign donations to Emanuel in 2011 and 2013, totaling $2,500. She backed Lightfoot in Feb. 2019 with $1,000, and then, after she assumed office, gave her $1,000 again in June 2019. According to her LinkedIn page, two months later, Lightfoot promoted Witzburg-Beidler to “acting deputy general counsel for public safety.” Lightfoot promoted her three more times, naming her as the city's Inspector General in March 2022. Last month in an email to supporters, Beidler explained that she made donations to Foxx and Lightfoot because she thought they could "reduce the rate of crime in Chicago." She didn't mention her daughter-in-law's work with either office. "My son, his wife, and their two daughters are Chicago residents. In recent years, my husband and I have become increasingly concerned about their safety and I had hoped that candidates I supported might be able to help reduce the rate of crime in Chicago," Beidler wrote. Beidler is the only Lake Forest resident who has donated for Foxx; she is one of 12 who have backed Lightfoot. Deborah and Jay married in Boston in 2007. They met while attending Brown University in Providence, R.I. Witzburg-Beidler attended Northwestern University Law School in Chicago. Beidler, 77, is challenging Lake Forest Caucus-endorsed Dr. Stanford R. "Randy Tack," 64, in the race for mayor. Election Day is Tues. April 4. Randolph Rice was born in Baton Rouge, Louisiana, and was fortunate to attend the University of Virginia on a track and field scholarship (he ran the 400 and 200). After graduation, he returned to Louisiana to begin his law studies at Loyola University New Orleans. At the start of his third year of law school, hurricane Katrina struck, forcing him to move to Maryland, where his wife is from, and finish his studies at the University of Maryland Law School. While at Maryland, he was able to secure a job with the Baltimore County State's Attorney's Office, ultimately leading to a position as an Assistant State's Attorney. In this episode, Serge and Clarke interview Gary Baynor about an incredible story of injustice: a trial penalty of 70 extra years incarceration after being acquitted of the most serious charges. This case is about racism witnessed by Clarke Ahlers who has defended Gary Baynor from 1995 to 2022, when a courageous Assistant State's Attorney Becky Feldman reviewed the case and agreed to approach the Circuit Court for Baltimore City with a joint request for a re-sentencing.

In May 2011, Irma drove her Ford Focus to Goose Island to pick up her boyfriend from a late-night performance at a nightclub and got lost on a dead-end street bisected by the Chicago River. Due to the City of Chicago's failure to maintain barriers or provide warnings to motorists --despite knowledge of a similar incident that occurred more than a decade earlier -- Irma unknowingly drove her car over the curb and into the water. After an extensive search, her body was discovered nine days later in her vehicle. At trial, the defense attempted to blame Irma for her own wrongful death, insinuating she was drunk, driving impaired, and not paying attention. In May 2016, a Cook County, Illinois jury awarded Irma's family $13,890,000 in damages, delivering the #6 verdict in Illinois in 2016.  View/Download Trial Documents   Guest Bios: Katrina M. Taraska Originally from the East Coast, Katrina M. Taraska grew up in a family of seven in Peoria, Illinois. Her mother was a language teacher proficient in French, Italian and Spanish who devoted her time to the enrichment of the lives of her students while teaching at area schools. Her father, a dedicated pathologist, was one of the four original founders of the Midwest affiliate of St. Jude Children's Hospital, which provides care to children with childhood diseases. Unique to Ms. Taraska's chosen career in personal injury law, she was the victim of a propane gas explosion, in which a commercial building collapsed on her, her mother, her brother, and a close family friend. The explosion left Taraska with extensive second and third-degree burns early in her life. She was hospitalized for 3 months, during which she underwent skin grafting of her arms, legs, hands, and chest. Incredibly, a year prior to the explosion, Ms. Taraska's father and a reconstructive surgeon opened the only downstate burn unit in Peoria where she was successfully treated despite the severity of her burns. It is this life-changing event that has played a significant role in Ms. Taraska's career of representing the injured. After graduating from law school Ms. Taraska has successfully represented clients and their families in complex litigation. In 1995, Katrina Taraska began practicing law in downstate Illinois where she grew up. From an early age, often unbeknownst to his father, Joseph read his father's books authored by prominent trial attorneys including, Gerry Spence, Robert Shapiro, Irving Younger, and Vincent Bugliosi, sparking Joseph's interest in law and justice. ‘World's most extravagant' vibrator among stolen items in Texas sex shop heist   A naughty trio swiped more than $58,000 worth of sex toys from a Texas shop — including “the world's most extravagant” Swarovski crystal-encrusted vibrator, according to the store. The racy, broad-daylight heist happened June 30 at Sexology Institute in San Antonio, with surveillance video catching the creeps breaking into the front door, then filling bags with sex toys, lubricants and lingerie before bolting in a truck. “We came in to empty racks,” Sexology Institute manager Jasper St. James told the San Antonio Express News. “They took the world's most extravagant vibrator and they were done.” The fancy pleasure toy valued at $10,000 was a favorite among customers, who'd take pictures with it, St. James told the paper. The thieves — who took nearly everything in the store, including the cash register, according to St. James — have not yet been nailed. The only items left behind were books and LGBTQ merchandise. The store was forced to close its brick-and-mortar and online shops in order to restock. “We feel incredibly violated and our hearts are broken,” the shop wrote on Instagram. “As a small business this loss not only impacts us financially but emotionally as well. We know it will get better but even re-watching the videos of what happened makes us so anxiety-ridden. We are so glad no one was hurt and we completely understand things could have been worse, but it's still awful.” Donations helped the store reopen its location in San Antonio's King William neighborhood. “Unfortunately, the men are wearing masks, gloves, and there are no clear identifiers,” the Sexology Institute said in a post. “The truck seems to be a 2006 black-primed Chevy Silverado. If y'all recognize these men, the truck, or see any of our stolen items on Facebook Marketplace or local flea markets, please let us know.”     Texas man John Birdwell charged for allegedly headbutting father-in-law to death in bar   A Texas man is facing charges for allegedly killing his father-in-law by headbutting him at a local bar.  According to the incident report, the Fort Worth Police Department was called to Woody's Tavern at approximately midnight after a fight broke out between John Birdwell, 38, and Robert Bearden, 66.  Birdwell was talking to his wife's father at the bar about his troubled marriage and Bearden was trying to convince his son-in-law to sign divorce papers. Birdwell suddenly lost control and allegedly grabbed his father-in-law's head and headbutted him three times, according to a police affidavit obtained by Fox 4. The assault continued until both men fell to the ground, Bearden unconscious from the attack. Other bar patrons were forced to pull Birdwell away, the affidavit states. Birdwell fled the scene after the attack. Bearden was taken to the hospital where he later died from his injuries. The Tarrant County Medical Examiner's Office said the cause of death was blunt head trauma. Birdwell is being held in the Tarrant County jail on a $75,000 bond.   Records show Bearden was a veterinarian at VCA Mercedes Place Animal Hospital in Benbrook, Texas.   Oklahoma woman Rachael Zion Clay slips out of cuffs, shoots cop   Oklahoma authorities have released wild dash and bodycam video that shows a handcuffed woman retrieving a police rifle and firing it out of the back of a patrol car – striking a civilian and a deputy. The Grady County Sheriff's Office responded to a wellness check at a home in Blanchard just before noon on Aug. 12. Deputies took a woman into custody, placed her in handcuffs and into the back of a marked SUV. Video taken inside the vehicle shows her squirming in the backseat, slipping one hand out of her cuffs and fishing out the rifle. She loads it, aims out the window and begins firing. Officers' bodycams recorded the civilian getting shot in the chest. A deputy also suffered a minor injury when a bullet grazed his head, according to authorities. The victims scrambled to take cover behind another law enforcement vehicle as they called in the incident.  The wounded man's son was also nearby and is seen running over and assisting with first aid as officers call for backup and an ambulance. Both victims were hospitalized with injuries that were not considered life-threatening, according to authorities. Police initially described the encounter as a barricade situation and eventually the suspect, Rachael Zion Clay, surrendered to authorities. Jail records show she is being held at the Grady County jail on $1 million bond and a charge of “shooting with intent to kill.”     Off-campus UC Berkeley student housing bans white people from common areas   An off-campus housing co-op for University of California, Berkeley students bans white people from entering common spaces to “avoid white violence” — sparking criticism that the policy inflames racial tensions. The five-story, 30-room “Person of Color Theme House” near the school requires students to declare their race when signing in and to announce when they're bringing white guests in to the building, according to house rules leaked on Reddit.com. “Many POC moved here to be able to avoid white violence and presence, so respect their decision of avoidance if you bring white guests,” the rules declare. “White guests are not allowed in common spaces.”           Woman charged for killing fellow panhandler with stake over turf war   A woman killed a fellow panhandler while they fought over turf along a Chicago expressway last Friday. Mary Normand, 26, and Eriberto Hernandez, 47, had “ongoing issues” about panhandling on the southbound Edens Expressway exit ramp at Wilson Avenue, Assistant State's Attorney Danny Hanichak said during a bail hearing on Monday afternoon. At 2:45 p.m. on Friday, Normand accused Hernandez of panhandling in her territory. The disagreement quickly turned physical.  Normand repeatedly struck Hernandez with a 3-foot-long metal stake and then pushed him under a moving box truck, Hanichak said. After Hernandez was run over by the truck, Normand continued to repeatedly beat him with the stake while he cried for help and attempted to defend himself with his hands. Hernandez was rushed to the hospital with life-threatening injuries, he did not survive the assault. The Cook County medical examiner ruled the death as a homicide. Despite panhandling in the same area as Hernandez, Normand is not homeless, Assistant Public Defender Jennifer Hodel said. Normand lives with her fiancé and has been working at real estate company for the last three years, Hodel said.  Normand ran away from the scene but returned almost five hours later and was arrested, according to Fox 5. Normand was ordered held without bail on a count of first-degree murder by Judge Maryam Ahmad.     False prophet' pastor berates congregation for not buying him pricey new watch   Time for a new preacher! A Missouri pastor was caught on camera berating his “broke” congregation for failing to buy him an expensive Movado watch — sparking criticism that he wants to make a profit, not be a prophet. Pastor Carlton Funderburke of the Church at the Well in Kansas City was giving a fiery sermon about “honoring God's shepherds” when he scolded his followers for being too poor to give him the pricey timepiece he'd requested, according to now-viral TikTok footage. “See that's how I know you still poor, broke, busted, and disgusted because of how you've been honoring me,” Funderburke said during the speech on Aug. 7. “I'm not worth your McDonald's money? I'm not worth your Red Lobster money? I ain't worth your St. John's knit? Y'all can't afford it no-how,” he continues in the clip, as some church-goers amazingly respond with encouragement. “I ain't worth your Louis Vuitton? I ain't worth your Prada? I'm not worth your Gucci?” Funderburke, who founded the church with his wife, then tears into his flock for failing to understand what “God is saying” about how to treat those who deliver his message. ‘”Ooh, you can buy a Movado [watch] at Sam's [Club] and you know I asked for one last year. Today, another in Midday's continuing series of Conversations with the Candidates: 2022. Tom's guest is Baltimore City State's Attorney Marilyn Mosby. Ms. Mosby is standing for re-election to a third term as Baltimore's top prosecutor. She is one of three candidates in the July 19th Democratic primary, a race that pits her against the same two opponents she beat, handily, in 2018: Ivan Bates and Thiru Vignarajah. Marilyn Mosby drew national attention when she indicted the six officers in the Freddie Gray case in 2015. None of those indictments resulted in a conviction, but Ms. Mosby became one of the country's highest-profile progressive prosecutors. Her policies have drawn the ire of those on the political right, including Maryland Governor Larry Hogan, who has been an outspoken critic. That is not to say that those on the left have been completely enamored with Ms. Mosby. Advocates for Keith Davis, Jr., have mounted a highly organized and vocal campaign to pressure Ms. Mosby to drop her plans to try Mr. Davis for murder for the fifth time.But in addition to controversies surrounding her decisions as the State's Attorney, Ms. Mosby has been no stranger to personal controversy as well. She is scheduled to stand trial in federal court in September for perjury and making false statements on a mortgage application. She has called the investigation that led to her indictment politically and racially motivated. Marilyn Mosby is 42 years old. She is a graduate of Boston College Law School and Tuskegee University. She served as Assistant State's Attorney for Baltimore from 2005 to 2012. She became a litigator for Liberty Mutual Insurance in 2012, a position she held until she announced her plans to run for State's Attorney the following year. In October, 2021, she retired after 20 years as a Baltimore District Court judge to run in the Democratic primary for Maryland Attorney General. The incumbent AG, DemocratBrian Frosh, will retire at the end of this term. Judge O'Malley was admitted to the Maryland Bar in 1991, and she began her legal career that year as an Assistant State's Attorney in Baltimore County. She was appointed as a Judge on the Baltimore District Court in 2001 by Gov. Paris Glendening. Her opponent in this year's primary election is Congressman Anthony Brown, who served for eight years as Lt. Governor in the administration of Judge O'Malley's husband, Gov. Martin O'Malley. Judge O'Malley's father, J. Joseph Curran, Jr. also served as Lt. Governor (with MD Governor Harry Hughes) and won election five times to serve as Maryland Attorney General, from 1987 to 2007 — the longest tenure of any Attorney General in the state's history. Katie Curran O'Malley holds an undergraduate degree in international studies from Towson University and a law degree from the University of Baltimore School of Law. She is 59 years old. Eric Vernsten was a kid when the OJ Simpson trial was on TV. He and his older brother would watch it daily and on Friday nights, along with his family, he consumed a lineup of crime programs, such as Dateline. Eric was a talker. He liked to tell jokes and argue with people too. It occurred to him that law school might be in his future, but as he moved through high school, and then college, he turned his attention towards pro sports management. During the summer between his junior and senior college years, he got an unpaid marketing internship with the Austin Toros (now the Austin Spurs) after sending his resume to every NBA minor league team. His parents gave him $500 to get settled in Austin and he jumped into it, as he put it. In the off-hours, he worked as a wine sampler in liquor and grocery stores and waited tables. The following summer, after graduation, he was invited back to Austin to do season ticket sales, a paid role. Within a few weeks, Eric realized he hated the work. He still had law school on his mind and pivoted in that direction, moving back to his college town to live with a friend and study for the LSAT. Like the experience of many 20-somethings, Eric reflects on these decisions as big life lessons. He didn't get into law school the first time–another life lesson. Eric was not easily deterred. He applied again and earned dual JD/MBA degrees. After graduation, he landed in the wealth management field at a subsidiary of Goldman Sachs and while it sounds glamorous, it was not without its bumps and scrapes. He passed the bar exam but he was not getting any legal experience so he started to do volunteer legal work. Then a friend suggested he apply to the Army National Guard for a legal role. Eric got an offer and took a leave from his wealth management job to train with the Army. Once on board, he was one of a few lawyers who was tapped on January 6, 2021, to be on-site in Washington D.C. to deal with the aftermath of the insurrection.  Eric did not return to his corporate role. Today, he is a prosecuting Assistant State's Attorney in Winnebago County, Illinois. His newest job is father to a nine-month-old baby boy. Two brothers have been charged with first-degree murder in the fatal shooting of a WGN security guard during a botched carjacking at a South Shore gas station Monday. Salena Claybourne, a 35-year-old mother of two teen girls, was killed around 3 p.m. Monday afternoon at the Mobil gas station on the 6700 block of South Jeffery Boulevard, police said. Gregory Watson, 22, and his 17-year-old brother tried to steal Claybourne's SUV after she stopped for gas, Assistant State's Attorney James Murphy said at the teen's bond court hearing Wednesday. The 22-year-old is accused of shooting Claybourne, prosecutors said. He was charged Wednesday afternoon and is scheduled to appear in bond court Thursday. Watson and his younger brother approached Claybourne after she filled up her tank and got back into her SUV, Murphy said. Watson leaned into Claybourne's SUV “and within seconds” shot at her multiple times, hitting her in the face and shoulder, Murphy said. Take off the "Beer Goggles" when thinking about Drugged Driving. Driving while impaired is illegal whether it is from alcohol or any other drugs. According to the National Highway Traffic Safety Administration drug use among fatally injured drivers who were tested fro drugs rose fro 25% in 2007 to 42% in 2016, and marijuana presence doubled in that time frame. Marijuana users were about 25% more likely to be involved in a crash than drivers with no marijuana use. Jennifer Cifaldi Jennifer Cifaldi has served as the Illinois Traffic Safety Resource Prosecutor since 2016 and is employed by the Univ. of Illinois, Springfield through a grant provided by the Illinois Department of Transportation.  She is a nationally recognized expert and speaker on impaired driving.  She has served on the Lifesaver's Speaker Proposal Committee and Drug Recognition Expert Conference Speaker Proposal Committee.  She has presented several times at these and other national conferences.  She also serves on the Speaker's Bureau for the National Marijuana Initiative and has trained thousands of officers, prosecutors, probation officers, victim advocates, and judges both in her state of Illinois and nationwide. From 1996-2016, Jennifer served as an Assistant State's Attorney in the Adams County States Attorney's Office prosecuting tens of thousands of impaired driving cases.  In 2007, Jennifer developed a DUI No-Refusal search warrant model that has now been adopted as the standard for law enforcement agencies and prosecutor offices across Illinois.  She authored a manual on how to implement a “No-Refusal” program for prosecutors.  She has conducted numerous training sessions on the topic for law enforcement personnel, as well as other prosecutors.  Additionally, she is a regular instructor at Advanced Roadside Impaired Driving Enforcement programs and at Drug Recognition Expert schools.  During her time in the State's Attorneys Office, she presented to thousands of high school students at assemblies during prom and homecoming and was a regular instructor in the driver's education programs in her area. In the spring of 2018, with support from the Buffett Foundation, Jennifer implemented the Illinois Law Enforcement Phlebotomy Program (ILEPP).  She assembled a team of Drug Recognition Experts and academia from Macon County, Illinois, and they traveled to Phoenix, Arizona to attend the forensic phlebotomy training that Arizona has been utilizing for nearly 25 years.  The Illinois officers have been successfully performing their own venipunctures at their departments since that time.  Jennifer has worked with Richland Community College to assist them in developing the curriculum and has instructed at the forensic phlebotomy course currently offered.  She served as the interim Illinois State Phlebotomy Coordinator from 2018-2020.  She also drafted the ILEPP standards and procedures.  There are now over 25 officers in Illinois who are part of the ILEPP.  This training allows officers to perform blood draws on impaired drivers in a safe and efficient manner and alleviates the need to involve hospitals in their investigations. In 2016, Jennifer was the recipient of the National Traffic Safety Prosecutor of the Year award presented to her by the National Association of Prosecutor Coordinators.  She was also the recipient of the MADD Hero award in 2011 for her work on prosecuting DUI cases.  And in 2014, she was awarded the 2014 Murphy Leadership award for her vision, execution, and relentless effort to eliminate impaired driving and underage drinking.  Additionally, she serves on the Illinois Impaired Driving Task Force Committee and the Illinois Traffic Records Coordinating Committee. Jennifer earned her Bachelor of Arts degree in Law and Society from Purdue University, West Lafayette, Indiana in 1993 and her Juris Doctorate from Valparaiso University, Valparaiso, Indiana in 1996.  She also was an Adjunct Professor at Hannibal LaGrang

A Chicago police officer was denied bail Saturday, charged with murder in the shooting death of the 29-year-old mother of his 9-month-old after they argued about another woman, prosecutors said. Pierre Tyler, 29, appeared before Judge Charles Beach during a hearing that was audio-streamed live on YouTube Saturday afternoon. Tyler was charged with first-degree murder in the death of 29-year-old Andris B. Wofford, who died of a gunshot wound to the chin, according to the Cook County medical examiner's office and the Police Department. The shooting happened between Dec. 7 at 4:30 p.m. and Dec. 9 at 9:49 a.m., Assistant State's Attorney Craig Engebretson said in court. Right Response Consulting works with law enforcement, businesses and educational institutions on training & investigations of sexual assault, harassment & domestic/workplace violence. We had the opportunity to chat with cofounder and legal prosecutor, Kathryn Marsh. She worked for 17 years with Washington DC's SVU as well as with sex abuse survivors prosecuting sex crime cases. One thing is for sure, it pays to know the law. Her stories were heartbreaking but her advice is invaluable for everyone.BiographyKathryn Marsh is the Co-Founder of Right Response Consulting (RRC) and a career prosecutor of seventeen years. She presently serves as Special Counsel, Assistant Chief of the Special Victims Family Violence Unit and the Legislative Co-Chair for the State’s Attorney’s Office in Prince George’s County, Maryland. For the past twelve years Ms. Marsh has specialized in the field of child abuse and sexual assault cases. Mrs. Marsh also functions as professional trainer for Assistant State’s Attorneys and staff, as well as for law enforcement, community organizations, state organizations and other legal professionals. She has served on several National and State Task Forces and has been asked to assist in drafting legislation and has been called on to testify on behalf of criminal legislation before the Maryland legislature for a number of years. Ms. Marsh has also worked as an adjunct professor of Criminal Law for the University of Maryland University Campus from 2009-2019, and is a Current Associate Professor with the National Criminal Justice Training Center of Fox Valley Technical College. In addition to her work with the in the criminal law field, Ms. Marsh also serves on many community boards. She is currently the Treasurer of the Calvert County Commission for Women and sits on the Board of Directors for the Library Foundation of Calvert County, and the Optimists of Calvert County. In May 2011, Irma drove her Ford Focus to Goose Island to pick up her boyfriend from a late-night performance at a nightclub and got lost on a dead end street bisected by the Chicago River. Due to the City of Chicago's failure to maintain barriers or provide warnings to motorists --despite knowledge of a similar incident that occurred more than a decade earlier -- Irma unknowingly drove her car over the curb and into the water. After an extensive search, her body was discovered nine days later in her vehicle. At trial, the defense attempted to blame Irma for her own wrongful death, insinuating she was drunk, driving impaired and not paying attention. Taraska Born Staten Island, New York, 1968; Admitted to bar, 1995, Illinois. Education: University of Illinois, Bradley University (B.S., 1991), Widener University School of Law, Wilmington, DE (J.D., 1995). Originally from the East Coast, Katrina M. Taraska grew up in a family of seven in Peoria, Illinois. Her mother was a language teacher proficient in French, Italian and Spanish who devoted her time to the enrichment of the lives of her students while teaching at area schools. Her father, a dedicated pathologist, was one of the four original founders of the Midwest affiliate of St. Jude Children's Hospital, which provides care to children with childhood diseases. Unique to Ms. Taraska's chosen career in personal injury law, she was the victim of a propane gas explosion, in which a commercial building collapsed on her, her mother, brother and a close family friend. The explosion left Taraska with extensive second and third degree burns early in her life. She was hospitalized for 3 months, during which she underwent skin grafting of her arms, legs, hands, and chest. Incredibly, a year prior to the explosion, Ms. Taraska's father and a reconstructive surgeon opened the only downstate burn unit in Peoria where she was successfully treated despite the severity of her burns. Joseph's father, a personal injury attorney, unintentionally set Joseph on a path toward a career in law. From an early age, often unbeknownst to his father, Joseph read his father's books authored by prominent trial attorneys including, Gerry Spence, Robert Shapiro, Irving Younger, and Vincent Bugliosi, sparking Joseph's interest in law and justice. After graduating from Oak Park-River Forest High School, Joseph attended the University of Illinois in Urbana-Champaign. For the past five years, Carmen R. Johnson, Ph.D., has been fighting for exoneration by judges and the courts. She has gone all the way to the Supreme Court with no remedy and she is now back in the appellate court, continuing to seek justice as of August 24, 2020. Carmen stated, “Even though I am still fighting in their courts, I do not see a remedy for me. I understand the difference between exoneration and a pardon. Based on Article 72, I am asking the President to look into my case and grant me a full pardon. Only the courts can decide to exonerate me and I have no faith in that system. I am not asking for forgiveness, however, I am asking the President of the United States for justice, by way of a full pardon.” * For over twenty years, Carmen had been a successful businesswoman in Maryland. She ran a for-profit business that offered credit restoration, debt negotiations, household budgeting, preparation for bankruptcy and did loans by paying off people's debts. She reported these loans and services to the credit agencies. The non-profit taught financial literacy to the youth. She sat on countless organization boards. With one role as housing chair of the Maryland State Conference, NAACP. Carmen was investigating foreclosures that ravaged through the black community after the financial crisis of 2009. In her campaigns, she requested a moratorium on those illegal foreclosures and she even drafted bills involving lost notes. She received countless phone calls from power brokers in Maryland to stop this narrative. She was ordered to announce publicly that there were no illegal foreclosures in Maryland and she refused. * In March of 2011, her home and businesses were raided. However, when she talked to the prosecutor, she was told that no laws, statutes, or codes were broken and she was relieved. In July of 2014, men with guns appeared at her home in the early morning. They seized all her tax paid assets and called them “substitute assets.” They told her that she was not cooperating and they took her to jail. She was indicted on 24 counts of mortgage, bank, and wire fraud along with 14 other people. She only recognized 2 Real Estate Agents and she had not seen them in over 7 years. She did business with mostly real estate agents, mortgage companies, and major banks for years by offering their clients services and paying off their debts. Carmen was a victim as those banks, mortgage, and title companies were, but they were not implemented, not even the real estate companies those 2 realtors worked for. Her attorneys tried to use coercion, force, and intimidation to obtain compliance with the 3rd Assistant State's Attorney to take a PLEA. Even after suffering a nervous breakdown, Carmen refused to take a PLEA. *

She came home in 2018 and is now serving 5 years probation and paying 2 million dollars in restitution payments on crimes she did not commit nor benefited from. * Carmen now suffers from extreme PTSD with daily nightmares of the raids, trial, and prison. Carmen was a victim and is vehemently innocent. Today, a live debate between the Democratic and Republican candidates for Maryland’s 2nd Congressional District, which includes parts of Baltimore City as well as Baltimore, Anne Arundel, Harford and Howard Counties. Joining Tom on Zoom is the incumbent, Democratic Congressman Dutch Ruppersberger, who has represented the 2nd District in the US House for the past 18 years. A Baltimore native, he earned his law degree at The University of Baltimore Law School Before entering Congress, he served as an Assistant State’s Attorney in Baltimore County, and as Baltimore County Executive. Representative Ruppersberger is a member of the House Committee on Appropriations. He also spent 12 years on the Intelligence Committee. Congressman Ruppersberger is 74 years old. He and his wife of 50 years have two grown children and five grandchildren… Also with us on Zoom: Maryland State Senator Johnny Ray Salling. He is the Republican candidate in the 2nd Congressional District. A native of Dundalk, Mr. Salling is a US Army veteran. Realizing the importance of an education, and in order to break free from his situation, Joe attended Southern Illinois University where he concentrated in the study of Criminal Justice and History, receiving a bachelor's degree in Liberal Arts. The son of a World War II and Korean War veteran, Joe felt compelled to enlist in the United States Marine Corps Reserve during college. He enlisted at the Carbondale, Illinois Office and attended boot camp at the Marine Corps Recruit Depot in San Diego, California. Shortly after the devastating attacks on September 11, 2001, Joe re-enlisted and volunteered to serve as a Marine Infantryman, deploying in 2003, 2004, and again in 2007 and 2008. He honorably served with America's finest as an Infantry Squad Leader, Platoon Sergeant, and Platoon Commander, among other billets, in the Al Anbar Province of Iraq. Joe has been recognized by his superiors for his outstanding service as a Marine including a report when they reported, ” I have seen this Marine against our enemy and his performance was inspirational.” Among other ribbons, medals and awards, Joe was awarded multiple Navy Achievement Medals and a Combat Action Ribbon. Subsequently, Joe accepted a position as a NATO Weapons Advisor and Trainer, traveling extensively through Afghanistan and working closely with U.S. and Afghan troops as well as many other international military and civilian professionals. In 2010, Joe placed a hold on his career and began his legal education at Southern Illinois University School of Law in Carbondale, Illinois.  Joe volunteered as a legal advocate with Domestic Violence Clinic and with the Land of Lincoln in Carbondale, Illinois. After Graduation, Attorney Cervantez was hired by Charles Garnatti, as an Assistant State's Attorney with the Williamson County State's Attorney's Office. He stayed on to work for Williamson County State's Attorney Brandon Zanotti. Later, he was asked to head the juvenile docket for the Saline County State's Attorney's Office. Joe is now a partner at the Law Firm of Tetzlaff, Cervantez & Associates, P.C., a general practice law firm with four attorneys. The group specializes in Criminal Law, DUI, Family, Divorce, and Municipal Law. Joe is a certified and approved Guardian Ad Litem and Mediator in the 1st Circuit and he often does pro bono work for veterans and has been a long standing advocate for Diversion and Veteran Court programs.       My time as a juvenile shaped my life in ways that made me think about criminal justice issues since before I can remember. Later, as a prosecutor, and a defense attorney, I realized that center to true criminal justice reform is the office of the State's Attorney. The state's attorney is not just a prosecutor. The State's Attorney is a community leader and a manager, central to criminal justice policy and ultimately responsible for the safety of the community. The system is meant to be fair and just, but often, policies of the past negatively affect the fundamental fairness of our system. We need to change outdated policies of the past, help build a safer community and advocate for victims, families, and children because they deserve a modern, efficient, and fair criminal justice system. I'd like to use my life experience to lead this discussion in our community I can't wait to get to work for the people of Jackson County to increase safety, support victims and their families, advocate for our children, deliver accountability to violent offenders, and ensure that our justice system is fair, efficient, and just for everyone.

After Illinois passed the Cannabis Regulation and Tax Act which became effective in 2020, can police still search a car when they smell cannabis? The Old “Smell Of Weed Rule” In Illinois Before Decriminalization Of 2020 The warrantless search of a car is authorized “where a trained and experienced police officer detects the odor of cannabis emanating from a defendant’s vehicle.” People v. Stout, 106 Ill.2d 77, 88 (1985) The question today, is if this rule survived the cannabis law change in 2020. Persons under 21 years of age. “(b) Notwithstanding any other provisions of law authorizing the possession of medical cannabis, nothing in this Act authorizes a person who is under 21 years of age to possess cannabis. A person under 21 years of age with cannabis in his or her possession is guilty of a civil law violation as outlined in paragraph (a) of Section 4 of the Cannabis Control Act. (c) If the person under the age of 21 was in a motor vehicle at the time of the offense, the Secretary of State may suspend or revoke the driving privileges of any person for a violation of this Section under Section 6-206 of the Illinois Vehicle Code and the rules adopted under it.” Further Limitations And Prohibition Of Cannabis In Certain Places 410 ILCS 705/1-35. Limitations and penalties. “a) This Act does not permit any person to engage in, and does not prevent the imposition of any civil, criminal, or other penalties for engaging in, any of the following conduct… (2) possessing cannabis: (D) in a vehicle not open to the public unless the cannabis is in a reasonably secured sealed, container and reasonably inaccessible while the vehicle is moving; or… (3) using cannabis: (D) in any motor vehicle; (F)…in any public place; or (G) knowingly in close physical proximity to anyone under 21 years of age who is not a registered medical cannabis patient under the Compassionate Use of Medical Cannabis Program Act… 4) smoking cannabis in any place where smoking is prohibited under the Smoke Free Illinois Act;” The Cannabis Control Act Still Criminalizes Possession Of The Following Amounts Of Cannabis… 720 ILCS 550/4. Cannabis Control Act. “Except as otherwise provided in the Cannabis Regulation and Tax Act and the Industrial Hemp Act, it is unlawful for any person knowingly to possess cannabis. Any person who violates this Section with respect to: (c) more than 30 grams but not more than 100 grams of any substance containing cannabis is guilty of a Class A misdemeanor; provided, that if any offense under this subsection (c) is a subsequent offense, the offender shall be guilty of a Class 4 felony; (d) more than 100 grams but not more than 500 grams of any substance containing cannabis is guilty of a Class 4 felony; provided that if any offense under this subsection (d) is a subsequent offense, the offender shall be guilty of a Class 3 felony; (e) more than 500 grams but not more than 2,000 grams of any substance containing cannabis is guilty of a Class 3 felony; (f) more than 2,000 grams but not more than 5,000 grams of any substance containing cannabis is guilty of a Class 2 felony; (g) more than 5,000 grams of any substance containing cannabis is guilty of a Class 1 felony.” Delivery And Possession With Intent To Deliver Cannabis Remains Illegal 720 ILCS 550/5. Cannabis Control Act. “Except as otherwise provided in the Cannabis Regulation and Tax Act and the Industrial Hemp Act, it is unlawful for any person knowingly to manufacture, deliver, or possess with intent to deliver, or manufacture, cannabis. Any person who violates this Section with respect to: (a) not more than 2.5 grams of any substance containing cannabis is guilty of a Class B misdemeanor; (b) more than 2.5 grams but not more than 10 grams of any substance containing cannabis is guilty of a Class A misdemeanor; (c) more than 10 grams but not more than 30 grams of any substance containing cannabis is guilty of a Class 4 felony; (d) more than 30 grams but not more than 500 grams of any substance containing cannabis is guilty of a Class 3 felony for which a fine not to exceed $50,000 may be imposed; (e) more than 500 grams but not more than 2,000 grams of any substance containing cannabis is guilty of a Class 2 felony for which a fine not to exceed $100,000 may be imposed; (f) more than 2,000 grams but not more than 5,000 grams of any substance containing cannabis is guilty of a Class 1 felony for which a fine not to exceed $150,000 may be imposed; The Illinois Vehicle Code Still Criminalizes Cannabis Related DUI’s 625 ILCS 11-501. Driving while under the influence of alcohol, other drug or drugs, intoxicating compound or compounds or any combination thereof. “(a) A person shall not drive or be in actual physical control of any vehicle within this State while: (4) under the influence of any other drug or combination of drugs to a degree that renders the person incapable of safely driving; (7) the person has, within 2 hours of driving or being in actual physical control of a vehicle, a tetrahydrocannabinol concentration in the person’s whole blood or other bodily substance as defined in paragraph 6 of subsection (a) of Section 11-501.2 of this Code. Subject to all other requirements and provisions under this Section, this paragraph (7) does not apply to the lawful consumption of cannabis by a qualifying patient licensed under the Compassionate Use of Medical Cannabis Program Act who is in possession of a valid registry card issued under that Act, unless that person is impaired by the use of cannabis.” The “Sniff & Search” Law – 625 ILCS 5/11-501.15 625 ILCS 5/11-502.15. Possession of adult use cannabis in a motor vehicle. “(a) No driver may use cannabis within the passenger area of any motor vehicle upon a highway in this State. (b) No driver may possess cannabis within any area of any motor vehicle upon a highway in this State except in a sealed, odor-proof, child-resistant cannabis container. (c) No passenger may possess cannabis within any passenger area of any motor vehicle upon a highway in this State except in a sealed, odor-proof, child-resistant cannabis container. (d) Any person who knowingly violates subsection (a), (b), or (c) of this Section commits a Class A misdemeanor. “Can’t Miss” Moments From Episode 745 ✓ An officer who encounters the odor of cannabis in a car might have to start running through a mental checklist. For more information about upcoming TI events, visit: https://thomisticinstitute.org/events-1/ Speaker Bio: John Durham became the US Attorney for the District of Connecticut in February of 2018 Prior to his appointment as U.S. Attorney, Mr. Durham served as an Assistant U.S. Attorney in various positions in the District of Connecticut for 35 years, prosecuting complex organized crime, violent crime, public corruption and financial fraud matters. From 2008 to 2017, Mr. Durham served as Counsel to the U.S. Attorney; from 1994 to 2008, he served as the Deputy U.S. Attorney, and served as the U.S. Attorney in an acting and interim capacity in 1997 and 1998; from 1989 to 1994, he served as Chief of the Office’s Criminal Division, and from 1982 to 1989, he served as an attorney and then supervisor in the New Haven Field Office of the Boston Strike Force in the Justice Department’s Organized Crime and Racketeering Section. From 2008 to 2012, Mr. Durham also served as the Acting U.S. Attorney for the Eastern District of Virginia, where he investigated matters relating to the destruction of certain videotapes by the CIA and the treatment of detainees by the CIA. From 1998 to 2008, Mr. Durham served as a Special Attorney for the District of Massachusetts and Head of the Justice Task Force, where he reviewed alleged criminal conduct by FBI personnel and other law enforcement corruption in Boston, led the prosecution of a former FBI Supervisory Special Agent and a former Massachusetts State Police Lieutenant, and handled direct appeals and related proceedings following convictions after trial. From 1978 to 1982, Mr. Durham served as an Assistant State’s Attorney in the New Haven State’s Attorney’s Office headed by Arnold Markle, and from 1977 to 1978, he served as a Deputy Assistant State’s Attorney in the Office of the Chief State’s Attorney. From 1975 to 1977, Mr. Durham worked as a Volunteer in Service to America (VISTA) on the Crow Indian Reservation in Montana. Mr. Durham graduated, with honors, from Colgate University in 1972 and the University of Connecticut School of Law in 1975.

Our Conversations with the Candidates series continues now with Craig Wolf, the Republican candiddate for Maryland Attorney Genereal. He is facing incumbent Democrat, Attorney General Brian Frosh, who' held the seat since 2015. In the 1990s, Mr. Wolf served as a federal prosecutor in Justice Department, and as an Assistant State’s Attorney and Senior Circuit prosecutor in Allegany County. He also served as Counsel to the US Senate Judiciary Committee. As a businessman, for ten years, he was the President and CEO of the Wine and Spirits Wholesalers of America, a position he left last June. At the age of 40, in 2003, in the wake of the 9/11 attacks, Mr. Wolf enlisted in the Army. He was awarded the Meritorious Service Medal and the Bronze Star for his service during Operation Enduring Freedom. He currently serves as an International Law Officer with the Civil Affairs Brigade. Craig Wolf is 55 years old. He lives in Howard County. David sits down with candidate for Howard County State’s Attorney Kim Oldham. Kim is a Deputy (Howard County) State’s Attorney, a mother of two beautiful children, a hyper-marathoner, and much much more.  After graduating law school in 1996, Kim began her career as a law clerk to the Honorable Dennis Sweeney in the Circuit Court for Howard County. In 1997, she was hired as an Assistant State’s Attorney for the Howard County State’s Attorney’s Office.  She prosecuted misdemeanors and traffic offenses in the District Court Division for two years before she was promoted to the Circuit Court Division to prosecute all major felonies.  As a senior prosecutor Kim was a trial team leader supervising attorneys while handling every type of major crime from murder to sexual child abuse to kidnapping to armed robbery.  She was also head of the drug unit, working closely with police detectives and overseeing complex wiretap investigations.    In 2011, newly elected State’s Attorney Dario J. Broccolino appointed Kim as Deputy State’s Attorney to supervise the entire District Court Division as well as attorneys in the Circuit Court Division.  In addition to assisting with the administration of the office as Deputy State’s Attorney, Kim maintains a full case load prosecuting the most violent of criminals.  Over the years, Kim has earned a reputation of being thorough, diligent, tough and prepared with her cases.  Kim has proudly served as an advocate for countless victims, fighting to hold offenders accountable.  As State’s Attorney, Kim will continue to directly serve and be accountable to the public by personally prosecuting the most violent offenders in our community.     Kim was named Prosecutor of the Year in 2002 by the Howard County Chamber of Commerce for her outstanding contributions to the community.  She has also received commendation certificates from the Howard County Police Department for her hard work and dedication.  Kim provides prosecutorial support for various law enforcement agencies including the Maryland State Police.  Kim personally reviews all court order and subpoena requests for electronic information in cases such as distribution of child pornography, human trafficking and fraud.  Kim spends countless hours preparing instructional materials and personally teaching police recruits through the Howard County Police Department’s Education and Training Division.  She teaches topics covering constitutional law, search and seizure, search warrants, major crimes and criminal procedure.  Kim also prepares and conducts trainings for the sworn members of the police department in their continuing education.
