Last time we spoke about the first encirclement campaign against the CCP. The Jiangxi Soviet expanded despite opposition, but urban uprisings struggled, with labor union support declining. Li Lisan pushed for urban revolts, while Mao Zedong favored rural expansion. In 1930, failed attacks on Nanchang and Changsha deepened the divide between their strategies. Mao's forces later captured Ji'an, but tensions led to purges, including the Futian Incident. Meanwhile, the Nationalist Army launched an encirclement campaign. Mao's strategy of “luring the enemy in deep” ultimately positioned the CCP for survival and future success. The NRA exploited internal conflict among the Reds, launching attacks on Donggu. Miscommunication led to friendly fire between NRA divisions. Despite capturing towns, overextension weakened the NRA, allowing the Red Army to counterattack. Through guerrilla tactics and local support, the Reds encircled and decimated multiple NRA divisions, capturing thousands of prisoners and weapons. Mao Zedong's strategies proved effective, bolstering Red Army morale and influence. The CCP had just survived 3 brutal encirclement campaigns in 1931, collectively known as the First Encirclement Campaign. The Reds were quite lucky in 1931, for China had major problems requiring Chiang Kai-Sheks attention. Understandably one of those major problems was a full blown Japanese invasion of Manchuria, that rest assured we will tackle in depth in future episodes, but for coherency sake I thought it best to try and get through all the other events before we start talking about the beginning of the 15 year war. The Japanese invasion immediately began influencing the KMT-CCP conflict. The Japanese invasion directly threatened Soviet interests and Moscow looked at the CCP as a potential bulwark against the Japanese. From 1930-1931, the CCP's Red Army was successful in defending their territory against the NRA extermination campaigns, however they still suffered from a lack of discipline, supplies and professionalism. New leadership came from the new Central Committee, now led by the 28 Bolsheviks and a new comintern representative, Otto Braun. The Red Army began adopting a series of initiatives in 1932 to improve. All Red Army units were standardized to establish better command and control. Political indoctrination and military training also became standardized with waves upon waves of manuals distributed to the forces. The Red Army expanded the Red Academy by establishing the Red Army War College for mid-grade and senior officers. Branch schools and speciality schools to increase competency and training. Political mobilization remained cornerstone to the Red Army. Recruitment of new troops also began to see a renewed emphasis on urban proletariats. A large change to the operations for the Red Army was the adoption of Soviet offensive tactics to seek out decisive battles. CCP leaders were under the misbelief that revolutionary fervor would simply have the Red Army victory. What they lacked initially was professionalism, alongside good weaponry and equipment. Couple this with the NRA's adoption of more and more effective counterinsurgency tactics, the Red Army really began to suffer terrible casualties. Now as the Red Army defeated the NRA in the third extermination campaign of 1931 not to be mistaken for the large third extermination campaign later, another intraparty power struggle was brewing in the CCP. After the fall of Li Lisan, a group of students returning from studies in the USSR began a systematic operation to gain control over the CCP. This group became known as the 28 Bolsheviks. 20 or some of them returned to China with the new Comintern adviser, Pavel Mif in 1931. Two key members of the group, Qin Bangxian known colloquially as Bo Gu, and Chen Shaoyu as Wang Ming would seize key positions at the top brass of the CCP. Many of these students attended Moscow's Sun Yat-Sen University, where they became acquainted with Mif, the head rector of said university. This university was a breeding ground for ultra-orthodox Stalinist communist doctrine. It goes without saying the students were indoctrinated with a very Moscow perspective. Mif regarded them as a very well disciplined force and used them to purge out divergent groups within the university. During the third Plenum in September of 1930, Mif attempted to use the forum to denounce Li Lisans plan, but had failed to convince the majority of the Central Committee. After Li Lisan was condemned and recalled to Moscow, Mif saw a major opportunity. At the fourth Plenum in January of 1931, Li Lisan and 11 of his supported were ousted from the Central Committee, with their best positions seized by Moscow aligned CCP members. The next year, the 28 Bolsheviks unleashed a brutal intraparty war with other factions. By late September the Bolsheviks effectively destroyed most of the opposition and incorporated the surviving members into a the Central Committee loyal to Moscow. Bo Gu was appointed head of the Central Committee from Wang Ming who returned to Moscow. Once the 28 Bolsheviks were in control of the CCP at Shanghai, they then set their eyes upon Mao Zedong and the Red Army Soviet areas. During the first All-China Soviet Congress of November 1931, they launched their first attack. Mao Zedong received prior word of their intentions from loyal followers in Shanghai and prepared to face them. Before the Central Committee arrived at Ruijin, Mao had just emerged victorious from the encirclement campaigns, had suppressed dissension amongst his ranks and established a delegation of loyalists within the Soviet Congress. The Bolsheviks failed to gain a majority within the Congress, taking only 2 seats in the Central Executive Committee of the Soviet. Meanwhile Zhu De was appointed Commissar of War and other Mao loyalists took high ranking positions. To try to break Mao Zedongs monopolistic control over the Red Army, the Bolsehviks employed Zhou Enlai.  In early 1932, the CCP urged the Red Army to expand Soviet territory as its forces grew. Successful defenses against encirclement Campaigns brought many NRA soldiers into the Red Army, some willingly, others by force. A key boost came on December 14, 1931, when the NRA's Twenty-sixth Route Army rebelled and joined, forming the Fifth Red Army Corps. With this and other recruits, the First Front Red Army grew to about 70,000, requiring more territory to sustain itself and the revolution. On January 9th of 1932, the CCP Central Committee issued a resolution outlining a new strategy for the party and the Red Army. The resolution assessed the current situation in China, that of a major depression, the effects of the Mukden Incident and the string of CCP successes against the encirclement campaigns. The resolution reasserted the renewed commitment to recruit urban proletariats for the revolution and “expand the territory, link up the separated Soviet areas to form an integrated Soviet area, and take advantage of the present favorable political and military conditions to seize one or two important central cities so as to win an initial victory of the revolution in one or more provinces.” The Red Army would conduct a series of offensive to expand their Soviets and connect them starting in early 1932. They would target southern Jiangxi, such places as Ganzhou, Jiujiang, Nanchang and also Fujian's Fuzhou, Xiamen and Zhangzhou. The resolution also pushed for a “positive and offensive line, rather than the luring of the enemy into the deep strategy, as it was no longer viable”. Furthermore the resolution directly attacked Mao Zedong's strategy as “being right opportunism that underestimated the situation and maintained a pessimistic attitude, and all party and army members should actively guard against its incorrect mindset”. This cemented the divide between the Bolshevik groups adoption of offensive strategy vs Mao Zedong's defensive lure the enemy in deep strategy. The next operation would be against Ganzhou in Jiangxi. The city linked the Hunan-Jiangxi border areas with the Fujian-Jiangxi border areas and provided a nice launching point against Ji'an in the north. During another meeting in 1932 at Ruijin, Mao Zedong expressed his reservations about the operation, stating the Red Army did not have the necessary weapons or supplies to seize a major city. Zhu De backed him up, but the Central Military Committee vetoed them and continued planning the Ganzhou operation. On January 10th orders were handed out for the 1st, 3rd and 5th Red Army corps, along with the Jiangxi Soviet military regional forces to conduct the operation by February. On the other side, the KMT were well prepared to meet an attack against Ganzhou, they were also most likely tipped off.  On February 3rd of 1932 the Red Army arrived at Ganzhou quickly encircling the city. The next day the 5th Red Army Corps, roughly 20,000 men were the first to attack the city. They struck the East Gate, breaching the defenses slightly before being repelled. On the 17th and 23rd the Red Army forces conducted two major assaults, expanding the attacks to the West and South gates, but failed to gain a foothold. During the siege, two NRA brigades reinforced the Ganzhou garrison. Then on March 4th, the Red Army conducted a fourth major attack and was likewise repelled. Three days later the Red army retired to Jiangkou to reorganize after they had suffered 3000 casualties. Despite this the CCP leadership remained undeterred, believing the offensive strategy was still optimal. When Japan began rooting itself permanently in Manchuria, the CCP saw this as the perfect condition for a real revolution to take place. At a meeting on March 18th, Mao Zedong again argued his strategy fit the current conditions much more and that the offensive strategy was too ambiguous. Yet his arguments fell on deaf ears and the CCP leadership had the Red Army reorganized into two route armies. The west route army consisted of the 3rd army corps and was made responsible for expanding the Soviet areas west of the Gan River in Hunan-Jiangxi with a focus built around Zhuchuan, Taihe and Wan'an. The Central Route army consisted of the 1st and 5th Red army corps and would take Mao Zedong's recommendations to perform expansion operations in south Fujian with Xiamen being the final target. On March 26th, the Central route red army occupied Changtin under Mao Zedongs guidance. There they conducted political mobilization of the local populace. Yet seeing little military action taking place, Zhou Enlai pushed Mao Zedong to stop the political mobilization and instead engage the enemy in the direction of Zhangzhou. Thus the Reds headed south and attacked the 49th NRA division. On April 10th the Reds managed to seize Longyan where they annihilated a single brigade of the 49th NRA division. The 5th NRA corps attempted to reinforce the 49th NRA division, but lost two brigades in the process. The Reds then continued marching south and on April 20th seized Zhangzhou where they defeated the 49th NRA division. At Zhangzhou they seized 1675 prisoners, 2000 rifles, some artillery pieces, 13,00 rounds of ammunition, two aircraft and over a million yuan. Alongside that came a lot of provisions, salt, oil and other goods needed to keep their men moving. After the success Mao Zedong telegrammed Zhou Enlai, requesting the Red army move back to Jiangxi with their booty to improve operations in the soviet area. It was Mao Zedong's belief the Reds had made great gains at Zhangzhou but could not hold onto the area. Instead he wanted to expand operations in Fujian using smaller local militia and guerilla groups. The CCP yet again overruled Mao Zedong and on June 5th ordered him to keep up the offensive, now turning towards Guangdong military forces currently occupying southern Jiangxi.  Once that was completed they were to advance north up the Gan River Valley and attack Ganzhou, Zhangshu, Ji'an and Nanchang so as to foster a revolution in Jiangxi. The Red army then reorganized its forces placing the 1st, 3rd and 5th red army corps under the First Front Red Army who advanced into Guangdong. From late june into early July the Reds seized Shuikou, Nanxiong and defeated 15 Guangdong based NRA brigades and expanded the Soviet into the province. Yet even with the string of offensive victories, Mao Zedong still remained vocally in opposition towards the strategy, constantly submitting his recommendation to adjust their footing. On July 25th, Mao Zedong and Zhu De sent a joint communique to the CCP leadership requesting a change of strategy. They argued instead of immediately attacking Ji'an and Zhangshu they could perform clearing operation on the eastern part of the valley, focusing on Yihaung and Le'an. The CCP central committee was initially against the proposals, however Zhou Enlai intervened and gave his support to them. In August the 1st front red army held a conference and confirmed they would attack Yihaung and Le'an. They took Le'an shortly after, defeating the 27th NRA division. With that victory they gained 5000 prisoners, 4000 rifles, 20 machine guns, 20 artillery pieces and 3 wireless communication sets. Afterwards the Reds contemplated attacking Ji'an, however after consideration Mao Zedong argued on September 25th, the NRA presence at Ji'an was too strong. He instead recommended they conduct political mobilization operations around the Le'an Yihuang area. By this point the CCP Central Committee was really pissed off with what they considered insubordination from Mao Zedong. By this time the 28th Bolsheviks had gained enough power and began striping Mao Zedong of key positions with the Red Army. First he was removed from the Military Committee of the Central Bureau of the Soviet Areas. Have I mentioned how much communists love making endless committees? Later in October of 1933 an emergency conference was held at Ningdu to plan future operations on the eve of an impending KMT campaign. Participants included Zhou Enlai, Zhu De, Chen yi, Liu Bocheng and Peng Dehuai who all agreed they should take up offensive actions outside the Soviet. Alongside this the party condemned Mao Zedongs strategy called it inadequate and outdated. Zhou Enlai then argued for “expanding Soviet territory swiftly, engaging the enemy on KMT territory, bringing Jiangxi and its neighboring Soviet areas together by force, taking key cities in the Gan valley, including Nanchang, Ji'an, Ganzhou, and Pingxiang, so as to achieve preliminary successes in one or more provinces.” After the Ningdu conference, the Red Army continued with the offensive operation, now attacking Jianning, Lichuan and Taining in October. By November the 1st front army took the Jiangxi county seats of Zixi and Jinxi. This helped the CCP expand the Soviet in the eastern Gan valley, but it also placed them on a vulnerable footing, just in time for the KMT's 4th major encirclement campaign. During the CCP's expansion activities, the KMT had been performing a communist suppression campaign in Shanghai, driving out the Bolsheviks and other CCP members towards the Jiangxi Soviet by late 1932. Their arrival to the Jiangxi Soviet added further tension to the Red Army who were facing a new encirclement campaign. The presence of high ranking Central Committee members also changed their politics. The Mao Zedong adapted Marxist-Leninist theory was replaced by more orthodox and Moscow leaning theory. Many of 28 Bolsheviks moved to many Soviets sparking a new phase.  Before the start of the 4th major encirclement campaign, the Red Army from the Jiangxi Soviet conducted expansion operations into Fujian and Guangdong. Other Red army units performed similar operations in Hunan, Hubei and Sichuan. All of this red activity was enough to push Chiang Kai-Shek to refocus his military operations against them. On April 9th, 1932, Chiang Kai-Shek created the Bandit Suppression Headquarters in Wuhan with He Yingqin as its commander. Beginning in June 1932 He Yingqin had a force of 500,000 soldiers who unleashed a brutal encirclement and suppression campaign against the Hubei-Henan-Anhui and western Hubei-Hunan Soviet areas. By November of 1932, both soviets collapsed. After this Chiang Kai-Shek ordered He Yingqin to direct his efforts against the Jiangxi Soviet. In December Chiang Kai-Shek shifted over 400,000 troops and 30 divisions to the Central Soviet Operation. He even personally moved down to Nanchang to supervise the operation. The main forces consisted of 3 columns, roughly 150,000 troops in 12 divisions led by Chen Cheng. The KMT plan was to build a series of blockhouses as a means of economically blockading the Soviet. Around 240,000 troops were allocated for the blockade, in addition to the main force which brought the entire figure to 400,000 men. Each flank of the blockade had 70,000 troops, roughly 6 divisions who would conduct blocking operations in the Jiangxi-Guangdong border area and the Fujian-Jiangxi border area. Around 100,000 would be used to conduct anti-guerilla operations in the northwest and northeast of Jiangxi as well as in southeast Hunan and southwest Jiangxi. Was the blockade was set, the NRA would deploy 3 columns along separate routes converging upon the Red Army's rear for a concentrated attack. Over on the other side, the Red Army based near Lichuan had roughly 70,000 men from the 1st, 3rd and 5th Red army corps and the 11th,12th, 21st and 22nd Red Armies. The 4th encirclement campaign coincided with the Red Army's urban offensives. By December of 1932 the Reds had targeted Nancheng. The Central Committee issued the attack orders but due to the large NRA reinforcement efforts had to order the Red Army to withdraw from the outskirts of Nancheng. The next potential target was Nanfeng. The Central Committee again pushed for urban offensive as Nanfeng was attacked beginning in February of 1933. On February 7th the Red Army besieged the city. The NRA quickly dispatched the Central Route Army to reinforce the city and conduct a counterattack. Seeing the large concentration of NRA in the area, on February 13th Zhou Enlai ordered the forces to pull out and head over to Luokou.  The Red Army set up a diversion to cover their withdrawal. Using similar tactics employed during the third encirclement campaign, the 11th Red Army pretended to be the main force and suddenly attacked Lichuan. The NRA took the bait immediately sending 3 columns to Lichuan. While marching the 1st NRA column's 52nd and 59th NRA division became separated. On February 25th the two divisions moved west towards Huangpi along two routes separated by a mountain ridge. As they did so, their distance from the NRA 2nd and 3rd columns increased making mutual support efforts impossible. On the 27th the 1st and 3rd Red Army corps and 21st Red army unleashed a surprise attack against the 52nd NRA division. The next day the 5th Red army corps and 22nd red army attack the 59th NRA division around Huangpi. The division was annihilated with its commander captured. After the victory the Red Army pulled back to Luokou.  After the loss the NRA reorganized its force into 2 columns and changed strategy. Now instead of heading in 3 wide columns they would concentrate as 2 down the center of the Soviet. On March 16th, the two NRA columns began their advance as the Reds deployed their 11th army to perform more deception operations. The 11th Red army made a feint towards Guangchang, attracting the NRA front column. This action separated the two columns by 50 kms and isolated the 11th NRA division near Caotaigang. On March the 20th the 1st front red army attacked the 11th NRA division near Xuzhuang decimating them and severely defeating the 9th NRA division. For the remainder of the 4th encirclement campaign there were no other major battles. During March of 1933 the Reds conducted political operations near Le'an until NRA forces moved there to secure the city.  In April the NRA began to withdraw from the Jiangxi Soviet area, effectively ending their encirclement campaign. The NRA had suffered considerable losses for their efforts. They had lost the equivalent of 3 divisions; over 10,000 prisoners were taken. The Reds and seized 10,000 rifles, 300 German made machine guns and 40 artillery pieces. Another consequence of the failed encirclement campaign was the validation of the Bolshevik led offensive strategy. The CCP then adopted a series of reform measures hoping the Red Army could seize large cities. First the CCP attempted to expand the Red Army's overall strength by launching a large recruitment drive. In addition they incorporated all the local militias in the main Red Army. To fund the expansion the CCP adopted a large land distribution policy to generate revenue. Under the guise of performing a land investigation the CCP distributed 80% of the land within the soviet area. During the distribution the CCP attempted to raise nearly one million yuan. During the summer of 1933 the CCP also focused on suppressing counterrevolutionaries. One of the 28 Bolsheviks greatest critics was Luo Ming, the secretary of the Fujian-Guangdong-Jiangxi soviet committee. A large amount of recruitment and taxation had hurt the morale of the local people in the Soviet. When the Central Committee wanted troops there to deploy for action Luo Ming argued they needed to stay for local defense and that they should scale back offensive operations. However from the perspective of the 28 Bolsheviks it looked very similar to Mao Zedongs lure the enemy in deep strategy. At this point there were still many loyal to Mao Zedong and his strategy, so the Bolsheviks saw an opportunity to hurt him through punishing Luo Ming. They created a new pejorative term “Luo Min Line” to describe any non-offensive strategy and began a purge of the Fujian-Guangdong-Jiangxi Soviets leadership. The “Luo Ming line” became a new slogan to describe any in the CCP opposing the offensive strategy. During the summer of 1933, the Central Committee, emboldened by surviving the fourth encirclement campaign, continued to press on with their offensive strategy. With the Bolshviks and Otto Braun, the Jiangxi Soviet increased the central oversight over the Red Army and gradually seized direct control over military matters. On May 8th, the CCP passed a resolution separating the Central Military council and the Red Army leadership. Zhu De and Zhou Enlai remained in charge of the Red Army, but Bo Gu gained greater control over the military council and now controlled the Red Army's strategy and the employment of its military. Also Otto Braun would play a much larger role in military strategy, leveraging his experience at the Frunze Academy to push for offensive action.  The Red Army also reorganized its units to facilitate the execution of the new offensive strategies. In June the CCP divided the 1st front red army into the eastern front red army and central red army. Bo Gu and Braun believed that the Red Army had grown strong enough, both in firepower and manpower, to no longer require coordinated, mutually supportive operations. Instead, they felt the Red Army units could carry out independent operations in different regions. The Eastern Front Red Army, composed of the Third Red Army Corps, was stationed in western Fujian, while the Central Red Army, formed from the First Red Army Corps, remained in the Central Soviet area. Under the guidance of the new Central Military Committee, the Eastern Front Red Army launched expansion efforts into Fujian after the NRA vacated the region. Peng Dehuai's forces embarked on a three-month campaign in Fujian, expanding Soviet-controlled territory, securing supplies—especially salt—and raising funds, addressing key shortages for both the Red Army and the CCP. Before the Fifth Extermination Campaign, the Central Soviet controlled an impressive 60,000 square kilometers, spanning parts of three provinces. However, as they focused on territorial expansion, the Red Army neglected to monitor the KMT, which was preparing for another encirclement campaign. Now we have primarily focused on one of the major Soviets implicated in the fourth encirclement campaign. In reality the fourth encirclement campaign had been a large scale operation against three major soviets: the Hunan-Western Hubei Soviet also referred to as the Honghu Soviet; the Hubei-Henan-Anhui or Eyuwan Soviet and the Jiangxi Soviet. You would be led to believe and rightfully so because many lets just say, CCP aligned sources like to highlight the Jiangxi Soviet story, that the communists had kind of duped the NRA and stolen their victory from them. It was much more of a mixed bag overall. The campaign against the Hunan–Western Hubei Soviet saw the NRA successfully defeat the local Red Army forces, overrunning their main base in southern Hubei and Hunan. The majority of the fighting occurred around Jingzhou and overall was seen as a loss for the CCP. For the campaign against the Eyuwan Soviet, drought, famine and epidemics severely hurt the CCP forces in 1932. Between July and September, Chiang Kai-Shek had allocated more than 300,000 troops for the operation. The CCP suffered tremendously because of the numerical superiority of the NRA. The NRA General Xia Douyin unleashed a scorched earth campaign, killing countless, burning many villages and destroying to seizing crops. Historians like Chen Yaohuang argue the fourth Red Army who participated in this area were defeated largely because they had adopted conventional warfare tactics. The peasantry were very hostile to the NRA, forcing their forces to depend on unreliable local elites for provisions, creating a very vulnerable supply line. However the CCP failed to exploit this weakness by not committing guerilla warfare. Despite the NRA victory, it was a rather incomplete one and they ended their campaign prematurely celebrating. The fourth red army had successfully retreated into the border region between Shaanxi and Sichuan leaving behind a small force to conduct guerilla warfare. The remaining Communist forces in the Eyuwan Soviet, led by Gao Jingting and Xu Haidong, capitalized on the early Nationalist withdrawal to rebuild a guerrilla movement. They hid in the mountains, survived by foraging, and organized poor peasants to seize grain from landlords and public granaries. The 25th Red Army, under their leadership, managed to maintain a Communist presence in the region for several more years. After all was said and done, as was the case with the previous encirclement campaigns, reports from field commanders were far too optimistic. Many reported to Chiang Kai-Shek exaggerated numbers of casualties inflicted, prisoners taken and areas secured. In reality what the communists were doing was simply moving around to give off the impression of major defeats. Sure the Reds were taken enormous losses, but they were constantly recruiting and spreading. Israel's GDP fell by 19.4 percent in the last quarter of 2023, according to preliminary figures published by the country's Central Bureau of Statistics on Monday. It's the biggest contraction the economy has seen since the early days of the Covid pandemic, and can be attributed to the impact of the war on Gaza following the October 7 Hamas attacks. This is the Catch Up on 3 Things for the Indian Express and I'm Flora Swain.It's the 19th of February and here are the headlines.Calling it an "abuse of power", the Bombay High Court said that the arrest of former ICICI Bank CEO Chanda Kochhar and her husband Deepak by the Central Bureau of Investigation in December 2022 was done "without application of mind". The court made the observation in its order confirming the interim bail granted to the couple. The two were arrested on 23rd of December 2022 in connection with alleged irregularities in loans provided by the bank to the Venugopal Dhoot-led Videocon Group.The Supreme Court today stayed further proceedings on a notice issued by the Lok Sabha Privileges Committee to West Bengal officials, to appear on a complaint by BJP MP Sukanta Majumdar over alleged "misconduct, brutality and life-threatening injuries" to him. Majumdar had complained to the parliamentary committee about a breach of privilege as an MP after he was allegedly injured last week during protests in Sandeshkhali where leaders of the ruling Trinamool Congress have been accused of sexually assaulting women villagers.Following a closed-door meeting between former Madhya Pradesh CM Kamal Nath and his supporters, his loyalists have claimed Nath would stay with the Congress. After emerging from the meeting today, former state home minister Bala Bachan said, quote, "There was no question of (Nath) joining the BJP. Kamal Nath is a national level politician of the Congress and has given his entire life to the party." Unquote.The Enforcement Directorate today said that it has filed a complaint against Delhi CM Arvind Kejriwal for "intentionally disobeying the first three summons issued to him." Sources in the ED said, quote, "The court has taken cognisance of the same, thereby the court has prima facie accepted that Kejriwal has done an offence for which he is liable to be prosecuted. The question in front of the court is not about the validity of the summons rather the illegal act on part of Kejriwal of intentionally disobeying three summons." Unquote.In another setback to the Opposition INDIA alliance in Uttar Pradesh, Samajwadi Party president Akhilesh Yadav is set to give a miss to Rahul Gandhi's Bharat Jodo Nyay Yatra in Amethi and Raebareli. Akhilesh today said that he will join Rahul's Yatra only after the finalisation of seat-sharing between the SP and the Congress for the UP seats for the upcoming Lok Sabha elections.This was the Catch-Up on the 3 Things by The Indian Express.

(Adam@TheWorldview.com) By Jonathan Clark Iranian police have killed 500 protesters; 26 slated for execution Anti-government protests in Iran entered their one hundredth day this week. It's the longest demonstration in the country since the 1979 Islamic revolution. Over 500 protesters have been killed, including two who were executed by authorities. Twenty-six more demonstrators face execution. Iran's security officials have warned Assyrian and Chaldean Christians in the country against joining the popular protests or posting about them online.  International Christian Concern noted, “These groups have been pressured for many years not to go against the regime for fear of being arrested or facing worse persecution.” Israeli Christian population grew by 2% A new report from Israel's Central Bureau of Statistics found the Christian population in the country grew 2% in 2021. Christians now comprise 1.9% of the population in Israel, numbering over 180,000. Seventy-five percent of them are Arab Christians, making up nearly 7% of the Arab population in Israel. Romans 11:25-27 says, “A partial hardening has come upon Israel, until the fullness of the Gentiles has come in. And in this way, all Israel will be saved, as it is written, ‘The Deliverer will come from Zion, He will banish ungodliness from Jacob, and this will be my covenant with them when I take away their sins.'” Texas officials believe Christian foster agencies have right not to place with “gay” couples Texas filed a lawsuit earlier this month, challenging a 2016 federal rule that discriminates against Christian foster care agencies.  Texas is fighting to work with faith-based agencies as they face surges in children needing out-of-home placements in recent years. The 2016 Department of Health and Human Services rule cuts funding to states that partner with agencies that refuse to place children with people living sexually perverted lifestyles. However, Texas argues another HHS rule protects religious organizations from such funding discrimination. 18 Republicans support $1.7 trillion bill with abortion & sexual perversion funding Last Friday, Congress passed a $1.7 trillion government funding bill. President Joe Biden said he will sign it. Eighteen Republicans in the Senate and nine in the House joined Democrats to pass the omnibus spending package. Republican Senate Minority Leader Mitch McConnell said the bill met the party's top priorities.  MCCONNELL: “Providing assistance for Ukrainians to defeat the Russians. That's the number one priority for the United States right now, according to most Republicans. That's sort of how we see the challenges confronting the country at the moment.” However, the spending deal continues to fund abortion with $286 million for the Title X family planning program. Other earmarks in the bill include $477,000 for "anti-racist" training from the Equity Institute, $3 million for the homosexual/bisexual/transgender museum in New York City, and $575 million for so-called “family planning” in areas where population growth “threatens biodiversity.” Exodus 23:2 says, “You shall not fall in with the many to do evil, nor shall you bear witness in a lawsuit, siding with the many, so as to pervert justice.” A third of Americans fallen away from church attendance A new Gallup poll found over a third of U.S. adults have fallen away from attending religious services. Sixty-seven percent of Americans said they attended services regularly while growing up, but only 31% said they still do.  The amount of people who seldom or never attend services has doubled now compared to when respondents were growing up. The study noted that children who grew up in church were more likely to still attend services than those who did not grow up in church.  Florida abortions dropped by 11,000 this year How about some good news? Florida's health department reports abortions in the state are down. Indeed, 11,000 fewer babies were killed by abortion this year compared to last year. Over 79,000 unborn babies were killed in abortion in 2021. That number decreased to just over 68,000 this year. The decrease comes after the state passed a 15-week abortion ban this summer. After the U.S. Supreme Court overturned Roe v. Wade, out-of-state abortions increased in Florida. Despite that, abortions overall are down in the state. Florida is fastest growing state And finally, the U.S. Census Bureau reports that Florida is the country's fastest growing state. The Sunshine State's population grew by 1.9% between 2021 and 2022. Florida's population now stands at 22.2 million, nine times what it was in 1946. In the post-World War II era, Arizona, Idaho, Utah, North Dakota, and Alaska have also been among the fastest-growing states. Israeli housing prices were up nearly 20% over the last year, a new annual record, according to a report released Tuesday by the Central Bureau of Statistics . Housing prices have been climbing steadily since the second half of 2018, and were up 19.8% in August to September 2022 compared to the same period in 2021, the largest year-on-year increase in recent memory. US software maker Oracle on Wednesday agreed to pay $23 million to the Securities and Exchange Commission to settle charges against violation of the Foreign Corrupt Practices Act, or FCPA, between 2014 to 2019. During the period, its subsidiaries in India, UAE and Turkey created and used slush funds to bribe foreign officials. In India, the American markets regulator alleged that Oracle paid bribes to officials of a transportation company owned by the Ministry of Railways. Oracle did not admit or deny wrongdoing in agreeing to settle. This is not the first time that Oracle has been charged with violating the US anti-bribery law over India-related payments.  In 2012, it agreed to pay a $2 million fine to settle SEC charges concerning the creation of millions of dollars of unauthorised side funds by Oracle India from 2005 to 2007. The Indian unit allegedly set aside money outside its books that was eventually used to make unathorised payments to phony vendors, creating a risk that those funds could be used for illicit purposes such as bribery. Several multinationals have time and again fallen afoul of the FCPA including retail giant Walmart, medical device company Stryker, advertising group WPP, aerospace manufacturer Embraer, IT services company Cognizant, spirits companies Beam Suntory, AB InBev and Diageo, locomotive developer Wabtec and Cadbury owner Mondelez International. Enacted in 1977 and enforced by SEC and US Department of Justice, the Foreign Corrupt Practices Act, or FCPA, prohibits the payment of bribes to foreign officials to assist in obtaining or retaining business. It extends to US listed companies and their officers, directors, employees, stockholders, and agents including third party agents, consultants, distributors, joint-venture partners, and others.  It also contains accounting provisions that prohibit individuals and businesses from knowingly falsifying books and records or circumventing or failing to implement a system of internal controls.  Regardless of size, for a gift or other payment to violate the statute, the payer must have corrupt intent. The FCPA resource guide states that bribes are often concealed under the guise of legitimate payments such as consulting fees, commissions, marketing expenses, scientific incentives, travel and entertainment expenses and discounts.  Kunal Gupta, an expert in white-collar crime law, tells us why Indian agencies seldom take up such cases Kunal Gupta, Partner, Trilegal says legal standards in India differ from US. Most FCPA violations are settled, few are tested in court. Transactions involving private officials may violate FCPA not PCA.  Walmart's $282 million payment in 2019 was one of the biggest FCPA settlements involving India-related charges.  US authorities said Walmart's failure to operate a sufficient anti-corruption compliance program led its subsidiaries in Mexico, India, Brazil and China to hire third-party intermediaries and allow these middlemen to make improper payments to government officials to obtain store permits and licenses. In 2019, Cognizant Technology Solutions agreed to pay $25 million to SEC to resolve allegations that it authorised a contractor to pay a $2 million bribe to a senior government official in Tamil Nadu in 2014 to secure planning permits for the construction of its 2.7 million square foot campus in Chennai. Brazilian plane-maker Embraer's $206 million settlement in 2016 to resolve charges of corruption in four foreign contracts is an instance where SEC action has led to investigations in India.  Approximately $5.76 million was allegedly paid to an agent in India in connection with the sale of three highly specialised military aircraft to the Indian Air Force for $208 million. The payments were falsely recorded in Embraer's books and records as part of a consulting agreement that wasn't legitimate.  India's Central Bureau of Investigation is probing the bribery allegations.

Global Policy Watch #1: The Many Transitions In China Global issues and their implications for India— RSJIn a few editions in the past, we have alluded to structural challenges in the Chinese economy and the window of opportunity that it presents India. I thought it would be useful to take a more comprehensive view of this. China reported a GDP growth of 0.4 per cent in the quarter that ended in June 2022. China's National Bureau of Statistics (NBS) isn’t known for its allegiance to truth. It is safe to assume the real GDP would have shrunk in the quarter. The daft ‘zero Covid’ policy led to total lockdowns in major cities during the quarter. The government crackdown on the real estate sector has meant that investment in the sector fell sharply. These contributed to the slowdown. Two other data points are interesting to note. The unemployment rate among the youth aged between 16-24 was at an all-time high of about 20 per cent. Also, retail sales continued to be weak at about 2.7 per cent, much below the 5 per cent forecast. Domestic consumption, the great desire of Chinese policymakers, remained sluggish. The spokesperson for the NBS put up a brave face while spinning these numbers as short-term bumps on the road. He raised the possibility of global stagflation and its negative impact on China to possibly justify weak numbers in the future. But is this slowdown just a blip in the impressive rise of China in the past three decades? I’m not sure. There are three transitions underway in China right now. It is difficult for nations to pull off any one of these in normal times. To attempt three simultaneously is ambitious. It is most likely to fail. Anyway, back to these transitions.The first transition started a few years back. This was forced on it because economics doesn’t bow to the party's diktats. China is finding it difficult to transition from a manufacturing-heavy, investment-led economic model to a consumption-driven one. This couldn’t be avoided. There would always be a limit to the world’s capacity to absorb China’s imports. Also, as China grew richer, it knew its low-cost edge in manufacturing would wither away. So after a few years of structural overinvestment in building capacity - the bridges to nowhere, the ghost cities, empty airports and other excesses - it had to pivot to a consumption-driven economy. It did try to delay the inevitable transition by aiming to export this overcapacity through its belt and road initiative. But after the initial hoopla, most countries have come to see it as what it is. A debt trap. So, this transition was necessary to move away from growth predicated on size and scale of investment to a more sustainable model of higher quality. But this is proving to be difficult. The history of unproductive investments has led to a debt build-up in the system (the debt to GDP ratio in China is over 300 per cent) and a drag on productivity that will continue for a long time. The state-owned enterprises (SOEs) that led this investment-driven growth are in a debt trap, and many continue to stay afloat by evergreening their loans. New productive investments have suffered because of this. People aren’t sure of their future, so instead of consumption, there’s an increase in domestic savings. Also, the pandemic and the recent lockdowns haven’t helped consumption growth. This is going to be a long, painful road.The second transition has been brought upon it because of its confidence in creating a ‘patterned’ society based on a premeditated design of the society. The prime example of ignoring spontaneous order was its plan to control the population through a one-child policy. China is now past the peak of its demographic dividend. The Labour force in China peaked in 2015 at around 800 million. It has now shrunk to 783 million, almost what it was in 2010. In the next 15 years, this is projected to go down to about 650 million. The stupid notion of the population as a liability has meant a rapidly shrinking and ageing workforce. The government has now reversed the one-child policy with a two-child policy without learning that such top-down interventions worsen things. Other similar ideas like patterned migration from villages to specific cities, controlling information flow for its citizens and taking some lofty top-down emission targets that have contributed to a serious energy crisis right now will also turn out the same way. The fault isn’t in their stars but in their ideology.  The final transition is the more perplexing one. This was articulated in a speech by Xi Jinping on August 17, 2021, where he introduced the notion of ‘common prosperity.’ This marked the most cogent articulation of Xi’s shift towards greater ideological rigidity. The days of economic growth based on ideological compromises were coming to an end. As Xi mentioned, ‘common prosperity is the essential requirement of socialism and an important feature of Chinese-style modernization’ and China ‘must resolutely prevent polarization, promote common wealth, and achieve social harmony and stability.’ The crackdown on the consumer tech sector (virtually destroying Jac Ma’s empire) and the ‘three red lines’ drawn for the real estate sector, that has disproportionate weight on its economy, should be viewed in this backdrop. It is unclear whether this is a real commitment to ideology or a way to consolidate his position as dictator-for-life by appealing to the masses. But Xi has doubled down on this, as seen by his remarks at the World Economic Forum:"We will first make the pie bigger and then divide it properly through reasonable institutional arrangements. As a rising tide lifts all boats, everyone will get a fair share from development, and development gains will benefit all our people in a more substantial and equitable way,"In my (very broad) view, Xi has concluded that China might have peaked in economic growth. You start talking about redistribution and ‘dividing it properly’ when you know the pie won’t grow at the same rate as it was earlier. Importantly, I also suspect this is the reason why Xi is acting like a bully in the neighbourhood. If you know you have hit the peak of your geopolitical and geoeconomic leverage, you will be foolish to let the moment pass without maximising your gains.Some might argue furnishing other economic data that this ‘peaking’ theory isn’t true. China is still a global manufacturing engine. Its trade surplus has ballooned in the past year suggesting the world is hungrier for its goods. And so on. There’s this insightful column by Michael Pettis in FT that I will quote, which puts in perspective the record trade surpluses that China has been notching up in recent months while making these three transitions together. Pettis writes:Contrary to what many assume, the country’s burgeoning trade surplus is not a symptom of manufacturing prowess, nor is it evidence of a culture of thrift. It is instead a consequence of the great difficulty China has had in rebalancing its domestic economy and reining in its soaring debt. This is because the very conditions that explain stagnant domestic consumption also explain the rapid growth in Chinese exports relative to imports.Beijing has known the solution to this problem for years. In order to control soaring debt and the non-productive investment it funds, it had to rebalance the distribution of income by enough that growth would be driven mainly by rising consumption, as is the case in most other economies. But this requires a politically-difficult restructuring of the economy in which a larger share of total income — as much as 10-15 percentage points of GDP — is transferred from local governments to Chinese households.This is why the trade surplus matters. In recent years, Beijing has tried to slow the growth in debt by reducing non-productive investment in property and infrastructure. This year, as we saw with Evergrande, Beijing came down hard on the property sector.If a rising share of China’s total income had been going to ordinary households, the resulting reduction in investment by property developers could have been balanced by a rise in consumption. But that’s not what’s happened. In the past two years, partly as a consequence of the Covid pandemic, growth in wages has actually lagged behind growth in GDP. The share Chinese workers have received of what they produce has declined rather than increased, and with it so has the share they are able to consume.Rising exports are usually a good thing, but for countries like China, rising trade surpluses are not. In this case they are symptoms of deep and persistent imbalances in the domestic distribution of income. Until the country is able to reverse these imbalances, something which has proven politically very difficult, these large surpluses are just the obverse of attempts by Beijing to control debt, and so they will persist.For India, all of this is a golden opportunity. China will remain busy with these transitions that it has wrought upon itself. The jury is still out on whether it will have a soft landing on them. Global businesses that started seeking more resilient and cost-effective alternatives to China during COVID-19, are now convinced that they must employ a ‘China + 1’ model to safeguard their long-term interests. There are only that many economies that have the labour pool, capital and a business environment that can take advantage of this shift away from China, however gradual. To me, it might be faster than what we all anticipate. And it will pass India by if it doesn’t stay alert to its possibilities.There is a high likelihood of a golden decade ahead for MSMEs in India if it plays its cards right. A long overdue factor market reforms (possible at the state level), kickstarting a government capex cycle that will instil confidence in the private sector to follow suit, not overdoing aatmanirbhar Bharat beyond the rhetoric and remaining an open and liberal democracy that convinces others that it will have sufficient checks and balances to not lose its way. These are the basic block and tackle moves to capitalise on the opportunity. Visit this link to apply.India Policy Watch #1: A Potent CocktailInsights on burning policy issues in India— Pranay KotasthaneThe ongoing political saga in Delhi over a new (now suspended) excise policy is a heady cocktail for policy analysts. The cocktail’s components include a tussle over alcohol licenses, Maximum Retail Price (MRP), privatisation, regulation, allegations of corruption, rent-seeking, and political contestation.The political motivations behind the current actions are quite clear. But it might be useful to look at the under-discussed policy aspects of the debate. Useful, because it’s not the last time we have seen a stand-off on alcohol policy.The underlying motivation for the Delhi Excise Policy 2021-22 is to increase government revenue. Although we know that the best way to do that is lower the tax rate and broaden the base, India’s poor economic performance over the last decade has made it politically risky to bring additional people under the tax net. Hence, states are opting for the easier—and counterproductive—option instead: raise tax rates and increase non-tax revenue. With the GST taking away the power to raise tax rates on most items unilaterally, state governments are exploring other options. One lucrative option is liquor excise. The Indian State heavily regulates the production, sale, and consumption of alcohol. Streamlining the licensing policies for the production and sale of alcohol can generate non-tax revenue, while higher overboard consumption can result in an increase in tax revenue (excise duty). One reform, two revenue handles. This is why the Aam Aadmi Party (AAP) governments in Delhi and Punjab have set their eyes on this sector. Moreover, raising the fees on government-provided private goods doesn’t fit its existing political persona. To be fair, the Delhi Excise Policy 2021-22 is fairly progressive. It states that the policy's objectives are to augment the state excise duty revenue, simplify liquor pricing, prevent duty evasion, and transform the liquor trade commensurate with Delhi’s position as a city of global importance. To achieve these objectives, the policy aims to award new licenses for alcohol sale, dividing the city into 32 zones, with a fixed number of shops allowed per zone. It aims to end government-run booze shops, distributing those licenses to private players instead. To foster competition, it allows shops to offer discounts below the Maximum Retail Price (MRP), permits shops to stay open till 3 am, and authorises bars to serve alcohol in licensed open spaces. A report in the Business Standard captured the view of a craft beer brand as follows:“The new excise policy is facing teething issues like any other but we find the policy very good since there is now a lot more opportunity to showcase our brand. Earlier, stores were dingy with no proper brand display, but now the stores have a mandated minimum floor area and are women-friendly. This helps with visibility of our brand.” There were quite a few initial hiccups. Some dealers started giving deep discounts to capture the market. That led the government to change the no-MRP policy to a “discount only up to 25% of MRP” policy. After that, retailers started offering “buy one bottle, get another free”. And hence, big dealers could attract more customers, while the smaller ones were finding it difficult to compete. Some licenses didn’t attract any buyers at all. These seem to be transient-state shocks. The steady-state promised to be much better. Alas.Reforming a tightly regulated policy area in which powerful rent-seekers have flourished for decades is not easy. The old status quo has powerful defenders. Like many other reforms, the benefits are widely dispersed while the costs are concentrated. And so, many existing licensees have ganged up on the government. We can be sure that some of these licensees also have political connections, which they have used to oppose the policy. There is also the additional issue specific to alcohol — any policy that is seen to liberalise its sale becomes an easy target for conservative moralisers. Further, the Delhi government made a mistake by pausing the policy implementation amidst the criticism.Then came the political pushback. Despite the government’s revenue increasing by 27 per cent after the policy was put in place, some notional revenue loss of the “2G spectrum allocation” vintage has surfaced. There are also charges of favouritism and corruption in the allocation of new licenses, an issue so sensational that it requires the combined might of the Central Bureau of Investigation (CBI) and the Enforcement Directorate. (Sarcasm is intended.) Many state governments must be eying this Delhi experiment with excise policy reform. Moreover, this case illustrates the difficulty in reforming sub-optimal licensing arrangements. As for the Delhi government, are they reaping what they sowed in the name of anti-corruption?Global Policy Watch #2: Xi Jinping’s Thoughts Global issues and their implications for India— RSJTalking of China (and I’m intruding into Pranay’s area of expertise), I came across this wonderful blog, globalinequality by Branko Milanovic. In his latest post, he writes about what he learnt from reading a translated version of the book, ' Anecdotes and Sayings of Xi Jinping’. Milanovic writes:The undisputable emphasis in the “Chinese” part of the book is on the matters of governance. By giving numerous examples from Chinese history of rulers and their aides who cared about people’s welfare, lived modestly (“One should be the first when taking care of state affairs, the last when taking care of personal affairs”), strove to improve themselves morally and educationally, Xi proposes a theory of governance that is based on virtue of rulers and results achieved, not procedure. While Western theories emphasize the procedural aspect (how is one selected to be the ruler, is it by a well-established democratic process or not), Xi’s concern is with the results. The tacit premise is not to discuss how one is selected to rule….The success is defined in terms of improvement in the well-being and happiness of people whom they govern.…In all cases of a good rule, there is the emphasis on individual characteristics of rulers. What is required, they (the editors) write, is “morality inside and virtue outside”; what is sought is the rule of virtue, and by virtue.  But how to bring about such a rule? Obviously, by having moral rulers. Hence--the reader begins to realize--Xi’s ideological campaign: if Confucian-cum-Communist  ideology is disregarded and everything is simply esteemed in terms of money and economic success, there cannot be a moral and virtuous rule.The key question, unanswered in the book, then becomes: is it possible to achieve an educational and moral “rejuvenation” under the current “normal” conditions of capitalism where money-making is held by the majority of the population to be the highest objective revealing also one’s individual worth?Xi is fighting against the spirit of the times, and while his struggle may be driven by a genuine desire to create a morally superior China, the odds of succeeding in this endeavor are, I am afraid, not particularly high. This is, to put it mildly, a brilliant summary of the ideological battle Xi has picked up and his odds of winning it. I tend to agree with its conclusion.   India Policy Watch #2: Value Addition, Not Import SubstitutionInsights on burning policy issues in India— Pranay Kotasthane“Import Substitution” is still in vogue. One would have thought that the unsuccessful pursuit of this goal since independence would’ve discredited it. That doesn’t seem to be the case.Every few weeks, we come across policies targeting import substitution, implicitly if not explicitly. Just a few days back came the rumour that the government plans to ban Chinese phones priced under Rs 12,000 in order to give a leg up to domestic champions. Thankfully, unnamed sources in the government have denied this story for now. Even so, import tariff hikes and industrial policies continue to chase the illusory target of import substitution. Some policies for display fabs and drones explicitly mention import substitution as the target. Of late, this idea has morphed into targets for maximising value addition per unit of exports. Now, readers of this newsletter know what we think of this idea. In edition #161, we had warned that Atmanirbhar Bharat is approaching a wrong turn. We have also cautioned against the proliferation of Production Linked Incentives (PLIs) beyond a few critical sectors. I will make the case against import substitution in this edition using another example. Look at the chart below, which shows the import profile of a country for the year 2020. This country’s largest import by value is Integrated Circuits (chips) at 18.8%. The total import bill is $259 billion. Can you guess the country? If you need a hint, here’s one: as exports rise, imports also rise. The world’s top two exporters are China and the US. And the world’s top two importers are also the US and China.The answer is neither the US nor China. India can be ruled out because we know that our biggest import is crude oil. Here’s another hint. Look at this country’s export profile for the same year. Its biggest export is again integrated circuits, at 36.9% out of a total exported value of $374 billion. Do you have an answer now? The right answer might surprise you. This is the typical year-wise trade profile of a country that is acclaimed as the world’s semiconductor superpower: Taiwan! We forget that despite its unmatched prowess in contracted chip manufacturing, Taiwan is not even close to being self-sufficient. Some Taiwanese companies import chips, do value addition through packaging and testing, and then export the final commodity. A portion of the imported chips goes into the machines that are used to manufacture chips by the famed Taiwanese chip foundries. The fundamental message is that imports are critical to exports, even in sophisticated economies. PLI scheme began with the aim of promoting India’s exports. But my sense is that import substitution has displaced exports as the primary goal. How else does one explain the simultaneous increase in import tariffs and a phased manufacturing programme (PMP) that aims to increase tariffs on imported components? Atmanirbhar Bharat needs to return to its goal of creating competitive manufacturing capabilities in India by allowing companies to start, grow, and close with considerably less bureaucratic friction. Shielding domestic component makers from international competition on the one hand, and subsidising end-equipment manufacturers on the other will end up helping neither. Equipment manufacturers will merely make expensive, poor-quality products. Some others will use the production subsidies to import components at higher prices, with no net benefit to them or the consumers. As RSJ writes in the first section, this decade is India’s to lose. Imports aren’t evil. Target value maximisation, not import substitution. Counterproductive policies targeting import substitution won’t help. Inflation reared its head once again in July owing to a surprisingly high 1.1% spike in the Consumer Price Index in July, putting Israel on track for the highest year-on-year rise in prices since 2008. The Central Bureau of Statistics published a host of other economic indicators indicating that at the current pace inflation could be as high as 5.2% in 2022, the fastest in well over a decade and almost double the 3% Bank of Israel forecast. Housing prices jumped by almost 18 percent in the last year. KAN's Mark Weiss spoke with Dr Gil Bufman, Bank Leumi's Chief Economist, and asked him why prices are continuing to rise. It's the story of the work of the women who worked in the so-called Central Bureau in Australia during the Second World War. I had never even realized that this bureau existed. How did you come across the story? Alli Sinclair: I had written a book called Burning Fields which came out in 2018, and I had my main character working for the Australian Women's Army service in Brisbane. I didn't really touch much on that because the story was set post-war, but I liked the idea of exploring what it was like for women working for the war effort in Australia. I jumped on the old Google and put in Women World War Two, Australian Women's Army Service Australia, and this very tiny article popped up about Central Bureau. It mentioned that it was Australia's elite signals intelligence organization and had been kept a secret for decades. I had never heard of this. The research went crazy and it took me quite a while to uncover the information, but as soon as I discovered this story, there was no way I was letting go. Jenny Wheeler: That's absolutely right. Facts in Brief In the instant case, the accused had moved an Application seeking discharge under Section 239 of CrPC contending that he has been falsely implicated. However, his application was dismissed by the Trial Court on the ground that the merits of the case can be gone into only at the later stages of trial. The accused moved the High Court under its revisionary jurisdiction of Section 397 of CrPC but the High Court also declined to entertain the Revision Petition observing that interference in the order framing charges or refusing to discharge is called for in rarest of rare case only to correct the patent error of jurisdiction and the present case is not the one. Important Provisions Section 239. When accused shall be discharged.— If, upon considering the police report and the documents sent with it under Section 173 and making such examination, if any, of the accused as the Magistrate thinks necessary and after giving the prosecution and the accused an opportunity of being heard, the Magistrate considers the charge against the accused to be groundless, he shall discharge the accused, and record his reasons for so doing.  Section 397. Calling for records to exercise of powers of revision — (1) The High Court or any Sessions Judge may call for and examine the record of any proceeding before any inferior Criminal Court situate within its or his local jurisdiction for the purpose of satisfying itself or himself as to the correctness, legality or propriety of any finding, sentence or order, recorded or passed, and as to the regularity of any proceedings of such inferior Court, and may, when calling for such record, direct that the execution of any sentence or order be suspended, and if the accused is in confinement, that he be released on bail or on his own bond pending the examination of the record. (2) The powers of revision conferred by sub-section (1) shall not be exercised in relation to any interlocutory order passed in any appeal, inquiry, trial or other proceeding.  Precedents Discussed by the Court  The Court discussed the case of Asian Resurfacing of Road Agency Pvt. Ltd. v. Central Bureau of Investigation, (2018) 16 SCC 299, that was relied upon by the High Court to dismiss the Revision Petition of the accused. The High Court had relied upon the following excerpt: - “37. Thus, we declare the law to be that order framing charge is not purely an interlocutory order nor a final order. Jurisdiction of the High Court is not barred irrespective of the label of a petition, be it under Sections 397 or 482 CrPC or Article 227 of the Constitution. However, the said jurisdiction is to be exercised consistent with the legislative policy to ensure expeditious disposal of a trial without the same being in any manner hampered. Thus considered, the challenge to an order of charge should be entertained in a rarest of rare case only to correct a patent error of jurisdiction and not to reappreciate the matter…..” The Hon'ble Supreme Court of India reconciled the interpretations provided in Asian Resurfacing (supra) and the case of Madhu Limaye v. State of Maharashtra, (1977) 4 SCC 551, and observed that the “orders framing charges or refusing discharge are neither interlocutory nor final in nature and are therefore not affected by the bar of Section 397 (2) of CrPC.” Further, it was observed that the High Court has inherent powers under Section 482 and other provisions of CrPC to prevent abuse of process or to secure ends of justice. According to the Court, though such discretion is to be exercised carefully yet it does not mean that a hyper technical approach is to be adopted.  Held by the Court The Court concluded by stating that: -  “17. Further, it is well settled that the trial court while considering the discharge application is not to act as a mere post office. The Court has to sift through the evidence in order to find out whether there are sufficient grounds to try the suspect. The court has to consider the broad probabilities, total effect of evidence and documents produced and the basic infirmities appearing in the case and so on. [Union of India v. Prafulla Kumar Samal]. Likewise, the Court has sufficient discretion to order further investigation in appropriate cases, if need be.” Therefore, it was held by the Court that the High Court had committed jurisdictional error in the present case by not entertaining the Revision Petition of the accused and “overlooking the fact that ‘discharge' is a valuable right provided to the accused.” Hence, the case was remanded back to the High Court for its reconsideration in accordance with law.  Concluding Remarks Since my college days, I had been reading and hearing about the Madhu Limaye (supra) case from my professors and friends. Even when I joined litigation, this case continued to influence the revision petitions in which I was involved. Madhu Limaye (supra) is a 1977 Judgment and more than 4 decades have passed since then yet the same question relating to the distinction between interlocutory order and final order in relation to Section 397 of CrPC keeps coming up and time and again, the Hon'ble Supreme Court of India has to again reiterate that Madhu Limaye (supra) is still a good law. I think there is a tendency to adopt hyper-technical approach by many judges and advocates. No doubt that Section 397 talks about revisionary powers of the High Court and no doubt that S. 397 (2) seeks to bar its applicability against interlocutory orders, but the fact of the matter is that there are other provisions as well in the Code of Criminal Procedure, 1973. One cannot simply overlook Section 482 of CrPC or the other provisions that provide the entire scheme of Criminal Trials. It is a cardinal principle of interpretation that the provisions of any statute have to be construed harmoniously and cannot be looked at into in complete isolation. A level of exactitude is desirable in the legal process but not at the cost of absurdity.  Without lowering the majesty of the High Courts, I think it is high time that the ratio of Madhu Limaye (supra) is applied in its proper perspective in revision petitions and such disastrous situations wherein the right of the accused to seek discharge is completely annihilated does not ever arise. The closing remarks of the Hon'ble Supreme Court in this case are quite pertinent wherein it said that the High Court committed an error by “overlooking the fact that ‘discharge' is a valuable right provided to the accused.” I sincerely hope that this is the last judgment wherein the Hon'ble Supreme Court of India had to reiterate that Madhu Limaye (supra) still holds the field.

A special Central Bureau of Investigation (CBI) court last month discharged GL Singhal, Tarun Barot, and ASI Anaju Chaudhary – the last of the three police officers who faced charges in the alleged fake encounter case of 19-year-old Ishrat Jahan and three men. Ishrat Jahan, Pranesh Pillai, and two alleged Pakistani men, Jishan Johar and Amjad Ali Rana, were gunned down at dawn on 15 June 2004 by the crime branch of the Ahmedabad Police, led by the then Deputy Commissioner of Police DG Vanzara, who is now retired.It has been 17 years since 19-year-old Ishrat Jahan was killed, and her controversial death has made headlines ever since. Several doubts regarding her death and the encounter have been raised multiple times, from different investigating agencies.But with charges dropped against the seven policemen, one of them now dead, who were accused of murder, kidnapping, criminal conspiracy, and several other offences in the case, this may be the end of the road for the alleged fake encounter case. Who was Jahan and why was her encounter controversial? Introduction In the present case of Paramvir Singh Saini v. Baljit Singh & Others, SLP (Criminal) No. 3543/2020, vide Judgment dated 02.12.2020, it was directed that State Level Oversight Committees and District Level Oversight Committees should be setup to look after the installation of CCTV Cameras in the Police Cameras, its budgetary allocation, continuous monitoring, inspection, grievance redressal and review CCTV footage to check for any human rights violation that may have occurred but not reported.  Backdrop In the judgment of Shafhi Mohammad v. State of Himachal Pradesh, (2018) 5 SCC 311, it was directed that a Central Oversight Body (COB) be setup by the Ministry of Home Affairs to implement the plan of action with respect to the use of videography in the crime scene during the investigation.  Later on, the Court issued notice to the Union of India on the question of audio-video recordings of Section 161 of the Code of Criminal Procedure (in short, “CrPC”) and installation of CCTV Cameras in Police Stations.  It has also been held in the Paramvir Singh Saini (supra) Judgment that the duty for the working, maintenance and recording of CCTVs shall vest with the SHO of the police station concerned and he shall coordinate with the District Level Oversight Committees in this regard. Such CCTVs are to be installed at: - 1. All entry and exit points of the Police Station; 2. Main gate of the Police Station;  3. All lock-ups, corridors, lobby/reception, verandas and outhouses; 4. Inspector, sub-inspector and duty officer's room and areas outside the lock-up room; 5. Station Hall, in front of the Police Station Compound, outside washroom and toilets and back part of the Police Station. The Court further directed that the CCTVs must have night vision, audio-video recording, continuous electricity supply and internet connections. Such recording is to be preserved for a period of 18 months and in any case, not below one year. Taking a step further, it has also been directed that in case, there is complaint of force being used at the Police Stations resulting into serious injury or custodial death, then the persons are free to complaint for redressal of the same. In this regard, the Court also directed the state to setup Human Rights Court in each and every district of the country so that such Court can immediately summon CCTV footage as and when required. Further all the above-stated directions shall also be made applicable to the offices of: - (i) Central Bureau of Investigation (CBI)(ii) National Investigation Agency (NIA)(iii) Enforcement Directorate (ED)(iv) Narcotics Control Bureau (NCB)(v) Department of Revenue Intelligence (DRI)(vi) Serious Fraud Investigation Office (SFIO)(vii) Any other agency which carries out interrogations and has the power of arrest. Further, the Court also directed that all the police stations and the investigating agencies shall prominently display at the entrance and inside their campus about the coverage of the concerned premises by CCTV and also mention that a person has right to complain about human rights violations. The same has to be done by large posters in English, Hindi and Vernacular language. Concluding Remarks I think that it is one of the most important judgments of this decade by the Hon'ble Supreme Court of India. Its importance cannot be overstated since flagrant abuse of rights of the people is very common in the Police Stations across India. Mandatory installation of CCTVs would ensure that the errant Police Officials are not able to get away without any consequences. What remains to be seen is the actual implementation of this Judgment by the concerned states and the Union of India. A common plea that is taken in such matters by the State is that there are not enough funds to carry on such an exercise and implementation is something that cannot be done by the Courts. It is purely the domain of the executive/state. Nevertheless, such directions would increase the pressure upon the states and the Union to carry on this exercise as expeditiously as possible. Further, this Judgment will have long term consequences in protecting the rights of the people as since this judgment has been pronounced by the Court, it is only a matter of time that it will be implemented. The State cannot get away for too long. During the time of Covid-19, we have seen countless uses of disproportionate force being used by the Police on the people of this country. With such directions in place, I hope that use of force at Police Stations will stop in the times to come.

Maharashtra became the fifth state to withdraw its general consent to the CBI – or the Central Bureau of Investigation – to operate within its territory. Why would it do this? Well, the government order doesn't specify any reason. But it does come close on the heels of the CBI starting its own probe into the TRP manipulation scam following a reference from the Uttar Pradesh government. Two months back, the handing over of the Sushant Singh Rajput case to the CBI from Mumbai police had sparked a big row between Maharashtra government and the BJP. Around the world, the tourism industry essentially dried up during the pandemic. But in Israel there was one category of hotels - the so-called “Corona Hotels” - that actually thrived. And depending on whom you ask, they were either a post-apocalyptic heaven or an exit-less hell.  In March 2020, Israel - like many other countries around the world - closed its borders. Since then, according to the country’s Central Bureau of Statistics, international tourism has dropped by some 99%. Hotel rooms emptied out, busy lobbies went silent, and those famous Israeli breakfast buffets remained uneaten. While you might assume this spelled the end for most hospitality establishments in Israel, there were actually some hotels that managed not only to stay open, but indeed to stay full. These were hotels leased by the government to serve as “Corona Hotels” and host two distinct populations: Israelis who had already contracted the virus and were waiting until they were no longer contagious and could safely return home, and Israelis returning from abroad who needed to make sure they weren’t bringing coronavirus into the country.  Corona Hotels brought complete strangers into close, and prolonged, contact. Unsurprisingly, many of the “guests” were from segments of the population that don’t typically mix and mingle. At times this melting-pot-like experiment created friction, but it also allowed for unusual interactions to occur. Forced to cohabitate, people had to learn to get along, and—in some cases at least—even respect each other.  Our episode today examines two different Corona Hotel experiences - one a heartwarming tale of coexistence, the other a dark account of agony.     The episode was mixed by Sela Waisblum and scored by Joel Shupack with music from Blue Dot Sessions and sound-design help from Yochai Maital. The Supreme Court on Wednesday approved for a Central Bureau of Investigation (CBI) probe in the Sushant Singh Rajput death case. The court further directed Mumbai Police to hand over all proof collected so far in the case to the CBI. The supreme court said that the FIR registered in Patna was lawful. The judgment was uttered by a single judge bench of Justice Hrishikesh Roy. The order comes on a plea filed by actor Rhea Chakraborty on the transfer of the First Information Report (FIR) filed. Punjab & Sind Bank on Friday recorded fraud of Rs 112.42 crore in two NPA accounts of Maha Associated Hotels and Edyar Zinc. The bank has recorded the fraud to the RBI and is in the cycle of classifying complaints with the Central Bureau of Investigation, according to regulatory filings. In a different filing, the Punjab & Sind Bank said that the NPA account of Edyar Zinc with outstanding dues of Rs 41.24 crore. From now onwards, all the core operations, including commercial, finance, training and operations of AirAsia India will be directed independently by Tata Sons, not its Malaysian parent, AirAsia Berhad, holding 51 and 49 per cent shares respectively.  This happened after both companies agreed to amend a controversial brand licensing agreement, which was signed in 2013, and handed power and rights to use the AirAsia brand. However, it was mired in controversy as key decisions needed approval from the parent. Besides, this also raised concerns that the daily management was being handled by foreign nationals. India’s civil aviation regulations mandate the effective control of airlines jointly owned by Indian and foreign entities lie with the Indian firm. People in the know said both entities were finalising the revised agreement. A draft agreement submitted to the Ministry of Civil Aviation and reviewed by Business Standard says that sales and distribution, revenue management, network planning, catering and in-flight services, finance and corporate finance, customer experience, engineering, and leasing contracts will now be under the sole discretion of AirAsia India. These require approval from the parent under the present agreement. A spokesperson of AirAsia Berhad directed the queries to the Indian unit, but the AirAsia India spokesperson refused to comment. In case you don’t know, AirAsia Berhad has similar agreements with the other three affiliates — Thai AirAsia, Philippines AirAsia, and Indonesia AirAsia. These, along with AirAsia India, pay annual fees for using the AirAsia brand. In view of this recent move, a Tata group executive said and I quote “Earlier, a lot of core functions such as revenue management, sales, and leasing needed expertise of the joint venture partner, but now the airline is fully capable of handling the functions.” The Tatas have already appointed key executives from its group firms in Air Asia India. In 2018, it appointed Tata lifer Sunil Bhaskaran as chief executive. Last month, it appointed Titan’s Vikas Agarwal as chief financial officer. And has appointed Tata Steel executive Ranganathan R advisor to the CEO, recently.  The commercial unit now has a full-fledged office at Gurugram and has established a crew training unit at Bengaluru. Recently, it appointed former IndiGo executive Ankur Garg as chief commercial officer. However, people in the know said the Tatas sought the amendment after being nudged by the aviation ministry, which is yet to give its nod for the airline’s foreign operations. The Delhi High Court had also ordered an investigation by the Directorate General of Civil Aviation (DGCA) in 2017, following which the DGCA had given it a clean chit. The Central Bureau of Investigation (CBI) had, on May 29, raided the offices of AirAsia India. This was after it had filed a complaint against Tony Fernandes and others on May 28 for allegedly lobbying with the government for overseas flight permits and violating rules preventing foreign airlines from controlling Indian operators.  Despite having more than 20 aircraft, the carrier is waiting for permission to fly abroad as government officials remain cautious... Corporate results and stock-specific action will be the top factors guiding investor sentiment today.  Exide Industries, Cipla, Voltas, Tata Steel, and 75 other companies are scheduled to announce their September quarter results today.  Yesterday, Titan reported a muted performance for the September quarter (Q2) on Tuesday after market hours because of higher gold prices and weakness in overall consumption. The stock will react today. Realty stocks may be in focus to Union Finance Minister Nirmala Sitharaman's comment that the sector needs the government’s attention and the Centre is working with the Reserve Bank of India (RBI) towards tweaking the existing laws to make them conducive for the sector. Besides, news agency Reuters said the Central Bureau of Investigation (CBI) had registered 42 new cases of bank fraud amounting to about Rs 7200 crore after conducting searches in 187 places across the country. These apart, market participants will also watch out for foreign fund flow, the rupee's trajectory against the US dollar, and movement in oil prices. Domestic indices yesterday snapped their seven-day gaining streak. The S&P BSE Sensex slipped 54 points to end at 40,248, while the broader Nifty50 ended at 11,917, down 24 points.  According to analysts, Nifty has been consolidating for the last few sessions, and with the bullish “Cup and Handle” formation on the daily charts, the upside target of Nifty this month is 12,300 with support seen at 11800 level. On the global front, Asian shares were little changed on Wednesday. MSCI's broadest index of Asia-Pacific shares outside Japan was unchanged. Australian shares were up 0.14 per cent, while Japan's Nikkei stock index rose 0.35 per cent. US stocks paused in the overnight trade after the recent rally with the Dow Jones Industrial Average, the S&P 500, and the Nasdaq Composite all ending flat for the day. SGX Nifty, on the other hand, was trading lower indicating a negative start to the day for domestic indices. In commodities, oil prices rose more than 1 per cent on Tuesday on hopes for a U.S.-China trade agreement and optimism that Washington could roll back some tariffs on Chinese imports. Brent crude futures rose 83 cents to settle at $62.96 a barrel. And before we wrap up, here's a trading idea. HDFC Securities recommend buying Jubilant Foodworks at Rs 1,582 for the target of Rs 1,700 with stop loss at Rs 1,550

A premier investigating agency of world’s largest democracy entangled with an ugly, out-in-public fight between the two topmost officials, both trying to discredit each other while the leadership looks over- seems like a perfect flimsy story. The fact is, it is happening right now in India’s leading investigative agency Central Bureau of the investigation. The public fallout between the No.1 of CBI i.e. CBI director Alok Verma and No.2 i.e. Special Director Rakesh Asthana has now reached to a point where the agency seems to be having an unprecedented face-off. This CBI vs CBI infight reached its zenith when the agency filed an FIR against its own Special Director Rakesh Asthana and even raided its own officer in connection with the case. Rakesh Asthana however, levelled same charges of corruption and misconduct against the CBI director Alok Verma. Asthana even said that there is a conspiracy being hatched to malign him. Rakesh Asthana's first shot to fame came with the arrest of former Bihar CM Lalu Prasad Yadav in the fodder scam. Asthana was only 36 when he sent Lalu Yadav, the then CM of Bihar to jail in the fodder scam case. After this, he was considered one of the boldest officers on the block. He also handled Asaram Case and 2008 Ahmedabad blast case. But as much as he is hailed for his cases, there is his share of controversies too. He was named in the infamous 2011 diary scandal. He has several accusations of bribery on him. However, the most consistent allegation on him is being a pawn at the hands of PM Modi and Shah since his Gujarat days. He was part of the Supreme Court-monitored SIT which gave Narendra Modi clean chit in the Godhra kaand. Since then, he is said to be close to the duo. His appointment as the Special director of CBI despite the opposition from Alok Verma is also said to be because of his proximity to the Prime Minister. The CBI vs CBI fight is no more internal. The PMO stepped in but it is already too late. The ugly side of the bureaucracy tainted by political infiltration is for all to see. It is not that the previous government didn't play with the CBI. Indeed, Supreme Court once called it a caged parrot. But for this unprecedented case, the dots are in front of us, how to connect them to see the larger picture is up to all of us.

In this episode of NL Hafta, our in-house team of Manisha Pande and Raman Kirpal is joined by two guest panelists -- Saikat Dutta, Asiatimes South Asia Editor and Saif Ullah Khan, Deputy Editor of DailyO.The discussion kicks off with the ‘plot to assassinate the PM’. Manisha asks Saikat, “Are there really ‘urban Naxals’ out there? What is the sense in this term?”Elaborating on the term, Saikat says, “If you look at Maoist literature...they have a lot of literature on urban warfare but they look at it from a military terminology, where they look at how to conduct urban operations, both, which will include psychological operations, information operations as well as military operations but they look at it from a very military perspective and that kind of literature is available.”  He further says, “Even the Naxals themselves or the Maoists have never talked about anything called ‘urban Maoist’ as a separate phenomenon because for them, class warfare is across -- whether rural or urban.” He adds, “This is a deliberate political term which some people of the Right have brought to discredit just about anybody who challenges their narrative.”Saif speaks of two writers, Arun Ferriera and Vernon Gonsalves, being arrested in 2007 on similar grounds. "Again, some letters were leaked and Arun was supposed to be, according to Maharashtra Police, one of the Communications experts. So he was arrested. And the trial went on for four years. And these leaked letters never even made it to the trial. So it was just about painting a certain narrative of a certain individual. Vernon was arrested in August 2007. And again, the trial went on for seven years. And he was supposed to be one of the people handling the finances of the Maoists.”He further adds, “Interestingly, there was a Narco analysis that was done on Arun Ferreira in which according to the leaks he had said it was the Shiv Sena and ABVP that had paid them...At that time it was the Congress and 2009 General Elections. Right now, you’re looking at 2019.”Raman says, “I think it was completely a plant! And 2019 elections, this was more for persecuting people rather than prosecuting.”Saikat says, “Here you have a plot allegedly to kill the Prime Minister, forget about the NIA, even the Central Bureau of Investigation has not been brought in.”  He adds, “Nobody’s talking about bringing in the Intelligence Bureau, nobody’s talking about bringing in the NIA or the CBI. That itself is a great indicator of what this plot is all about.”Manisha puts across a question to panelists on whether the ‘plot to kill Modi’ news makes up for a propaganda problem or a genuine lacuna in beat reporting.The discussion then proceeds to AAP’s protest against LG Anil Baijal. Saif assesses the situation from a political prism of how AAP perceives 2019 elections and its role in it. He says, “AAP is trying to use this ploy to gain some headline, to gain some sympathy in the run-up. It is very much a political thing they’re doing keeping 2019 in mind.”Saikat says, “Their first instinct is to become a victim and play that victim card and seek sympathy.” Expressing serious concern he says, “If the bureaucracy can cook a snook at an elected government with such an overwhelming majority, I think that’s dangerous for democracy. And it shows that the central government can go to any lengths to undermine the opposition.” Raman says that the BJP feared Kejriwal the most when he came in. “So they started building up a narrative around him that this man is chaotic,” he said.Listen up!
