Faircloth is an enrolled member of the Coharie Tribe, and a professor of education at Colorado State University. She has spent her career working on Native issues, and brings a wealth of historical knowledge, as well as family history that brings to light the challenges facing Native people, especially students, today. The 2021 National Lawyers Convention took place November 11-13, 2021 at the Mayflower Hotel in Washington, DC. The topic of the conference was "Public and Private Power: Preserving Freedom or Preventing Harm?" This panel covered "Administrative Inquisitions? How Agencies Initiate, Conduct, and Conclude Investigations."In addition to formal rulemaking and case-by-case adjudication and enforcement, federal agencies have long employed a myriad of mechanisms to influence and punish private behavior. Their civil administrative investigations are unbounded by the procedural constraints of the Administrative Procedure Act, traditional transparency protections, or the redress afforded by timely judicial review. Civil administrative investigations can be not only onerous but also financially catastrophic, especially when the targets are small businesses and individuals. The abuse of agency investigative authority raises significant constitutional and statutory questions. Agencies have compelled information from investigative targets without the warrant the Fourth Amendment would require, and then converted the investigation from civil to criminal. Federal agencies have been imposing draconian conditions to end administrative investigations, like imposing "gag" orders that prohibit the target from disclosing the terms of the settlement, and requiring the target to make payments to agency-designated third parties in lieu of paying the statutorily prescribed fine into the Federal Treasury. These conditions are imposed without affording the investigative target the opportunity to meaningfully challenge the agency’s underlying authority to act or the tactics by which it acts.This panel will explore the under-researched civil investigative and related activities of federal agencies and engage on their underlying legal authority to so act.Featuring:Mr. Tyler S. Cindy's stage credits include, among other productions, the national tour of GREASE playing Miss Lynch, the national tour of DEATHTRAP with Elliot Gould, THE FEMALE ODD COUPLE with Joanne Worley, STEEL MAGNOLIAS as Ouiser Boudreaux and, in 2007, she made her Broadway debut in the role of Mrs. Tottendale in the award-winning musical THE DROWSY CHAPERONE. She also appeared as Rev. Mother Mary Regina in NUNSENSE and NUNSET BOULEVARD; THE NUNSENSE HOLLYWOOD BOWL SHOW. Cindy appeared in MENOPAUSE: THE MUSICAL in Las Vegas for three years, then reprising her role at the Ogunquit Playhouse in Maine. She also co-starred in the premiere of MIDDLETOWN with Don Most, Didi Conn and Adrien Zmed at The Smith Center for the Performing Arts in Las Vegas as well reprising her role with Most, Conn and Zmed at The Bucks County Playhouse in New Hope, Pennsylvania. Cindy has enjoyed the privilege of working with extraordinary directors in great films. Her first film was for Roger Corman in GAS-S-S-S with Talia Shire and Ben Vereen. She appeared in TRAVELS WITH MY AUNT with Maggie Smith, directed by George Cukor, and THE CONVERSATION with Gene Hackman, directed by Francis Ford Coppola. Next she co-starred with Ron Howard, Richard Dreyfuss and Harrison Ford in AMERICAN GRAFFITI directed by George Lucas, a low-budget film that went on to become a box office smash and film classic. Among her favorite honors are her star on the Hollywood Walk of Fame, her TV Land award for Fan Favorite as well as winning Best Actress at the L. A. Comedy Film Festival for the Indy film STEALING ROSES. Cindy also garnered a BAFTA (British Academy of Film and Television Arts) nomination for best supporting actress in AMERICAN GRAFFITI. Unfortunately, she was beat out by Ingrid Bergman. Cindy still wonders how the heck that happened. Her book “Shirley, I Jest!: A Storied Life” was released to much critical acclaim and is now available in paperback. Cindy shares her memories and hilarious backstage tales in her one-woman show, ME, MYSELF & SHRILEY, covering a lifetime in entertainment. Judge Michael Corriero (Ret.) serves as one of three judges on CBS Media Ventures' Emmy-nominated syndicated court program HOT BENCH, created by Judge Judy Sheindlin. The show returned for its eighth season on September 13, 2021. During the 2020-21 season, HOT BENCH was once again the #2 court program in daytime television in household ratings and all major demographics. It has been # 2 across-the-board in all those categories since 2015. Prior to joining HOT BENCH, Judge Corriero served as a prosecutor in the office of Manhattan District Attorney Frank Hogan, a criminal defense attorney and a judge for 28 years in the criminal courts of New York State. For 16 years, he presided over Manhattan's Youth Part, a special court he created in the Supreme Court of New York State designed to focus attention and scarce resources on young offenders prosecuted as adults pursuant to New York State's Juvenile Offender Law. Under Judge Corriero's innovative leadership, the Youth Part became a model for mobilization and coordination of treatment and social services for children prosecuted in adult courts. He retired from the bench in 2008 to become the Executive Director of Big Brothers Big Sisters of New York City. In 2010, he left Big Brothers Big Sisters to establish the New York Center for Juvenile Justice. The Center promoted a comprehensive model of justice for minors that treats children as children and responds to their misconduct with strategies designed to improve their chances of becoming constructive members of society. An important element of the Center's advocacy was recognized in the enactment of New York State's 2017 Raise The Age Legislation which incorporated and institutionalized the Youth Part Model. In 2012, Judge Corriero founded, along with the New York Foundling, one of New York's oldest and respected social service agencies run by the Sisters of Charity, the Families Rising Project - an alternative-to-incarceration program that works not only with a young offender but with his/her entire family. Judge Corriero is an alumnus of St. John's University School of Law and St. John's University. He was a member of the Law Review and served as an associate editor. He graduated from St. John's University College with a Bachelor of Arts degree majoring in social science. He is the author of a book titled, “Judging Children as Children: A Proposal for a Juvenile Justice System,” which is a blueprint for juvenile justice reform. He is regarded nationally and internationally as an expert in juvenile justice. He has traveled extensively, lecturing and advising legal institutions in numerous countries, including Israel, South Africa, Sierra Leone, Kazakhstan and Peru. Judge Corriero is the recipient of numerous honors and awards, including: The New York Foundling's Lifetime Achievement Award (2015); Advocate of the Decade (2014) presented by Families on the Move of New York City, Inc.; The Eleanor Roosevelt Award (2011), presented by Citizens Committee for Children; Asian Pacific American Advocates (OCA – New York) Community Service Award (2011); Excellence in Juvenile Justice, Juvenile Detention Association of New York State (2007); Frank S. Mattox, Jr. Commonwealth Debate Winner (University of Richmond 1996); The Charles A. Rapallo Award (Colombian Lawyers Association 1994); and he participated as a Polsky Judicial Fellow at the Aspen Institute's Justice and Society Seminar (2003). Judge Corriero served at the request of the former Chief Judge of New York State, Judith Kaye, on the New York State Permanent Commission on Justice for Children. He also served on Mayor Michael Bloomberg's Committee on the Judiciary. He has previously served on the New York State Probation Commission Task Force and former New York Governor David Patterson's Task Force on Transforming Juvenile Justice. Judge Corriero also served as Chairperson of the Committee on Juvenile Justice of the Association of the Bar of the City of New York. He was Co-chair of the American Bar Association's Juvenile Justice Committee. He is a member of the New York State Bar Association's Committee on Children and the Law. He served as a trustee of Big Brothers Big Sisters of New York City; a member of the Advisory Committee of Citizens' Committee for Children; a member of the Professional Committee of ELEM (Youth at Risk in Israel); and a board member of Transfiguration Grammar School Education Association. Justice Patricia M. DiMango serves as one of three judges on CBS Television Distribution’s syndicated court show HOT BENCH, created by Judge Judy Sheindlin. Justice DiMango was first appointed to serve as a judge in the criminal courts for the city of New York by Mayor Rudolph Giuliani. She became the first Italian-American woman ever appointed to that position. Thereafter, she was elected to the New York State Supreme Court bench in the 2nd and 11th Judicial Districts, and again was the first Italian-American woman elected to that position. Soon after, she was elevated to the position of First Deputy Administrative Judge for criminal matters, 2nd Judicial District. Justice DiMango’s reputation was that of a stern but fair judge combined with a balance of street smarts and legal knowledge. These qualities assisted her in handling a large volume of serious felony cases from their arraignment through trial. She was also known for her efficiency in closing a vast numbers of cases in a fair and timely fashion. Her judicial acumens came to the attention of the Chief Judge of the State of New York and he selected her to spearhead his initiative to reduce the backlog of felony matters in the Bronx. Hence, Justice Di Mango was named Supervising Justice of the Bronx Felony Project from January 2013-Januarary 2014. In the course of her judicial career she also gained public recognition for handling high-profile trials, particularly those involving murders of young children, other crimes against children and hate crime murders. Ultimately, these assignments resulted in Justice DiMango’s appointment as the Administrative Judge of the New York State Supreme Court Criminal Term in Brooklyn, Kings County. After a special assignment in the Bronx, she was brought back to Brooklyn where she was elevated to the position of Administrative Judge for Criminal Matters Kings County Supreme Court. Justice DiMango received her law degree from St. John’s University where she graduated in the top 10 percent of her class, and received awards and scholarships in recognition for her other academic achievements. In addition to her Juris Doctorate, Justice DiMango holds a Master’s Degree from Columbia University in Developmental Psychology and a Bachelor’s Degree cum laude from Brooklyn College in both Psychology and Education. Justice DiMango has appeared on numerous television programs including “Wendy Williams,” “Rachael Ray” and “Steve Harvey” and can be heard on many talk radio shows. She has also been featured giving legal insight on stories on “Entertainment Tonight,” Fox News, “Inside Edition” and “The Insider,” among others. While pursuing her Master’s Degree, Justice DiMango was a school teacher for the New York City Public Schools, focusing on special education of children with emotional and intellectual deficiencies. Dermatology residents must be knowledgeable about dermatologic conditions presenting in patients of various ethnic backgrounds. Dr. Vincent DeLeo talks to Drs. Abigail Cline, Susan Taylor, and Amy McMichael about improving and expanding multiethnic training in dermatology residency. “Now that I’m in residency, it has become very clear how different presentations in skin of color can be, and I can really see the importance of proper training in a racially diverse population,” says Dr. Cline. Results from a recent survey revealed that dermatology residents in the Midwest and Northwest were not seeing a diverse patient population: “[Residents] in the Northeast, Southeast, and Southwest tended to see more diverse patients, and so they didn’t feel the need for continued lectures or skin of color clinics, but the respondents within the Midwest and the Northwest really wanted to see these patients and really wanted to see what these dermatoses look like in skin of color,” Dr. Cline explains. To ensure dermatology trainees get adequate exposure to diverse populations, home programs can allow residents to travel and rotate to other programs where they can get firsthand experience diagnosing skin of color patients. The Skin of Color Society aims to reduce racial disparities in dermatology through a variety of programs, including its annual scientific symposium, mentorship program, and research grants. Skin of color centers throughout the United States allow dermatology residents to rotate through and work with large numbers of skin of color patients. “[They also provide] an opportunity for trainees to see patients who are very satisfied with race-concordant visits—that is, the patient and the provider are of the same racial group—so they can observe what goes into making that type of interaction very successful and rewarding for the patient,” says Dr. Taylor. Practicing dermatologists can make a positive impact by mentoring high school, college, or medical students who do not have social capital as well as contributing a gift to societies with mentorship programs that provide opportunities for residents. Dermatologists can create diversity within their own practices to improve patient access to care. “You can be great at what you do, you can be a fantastic dermatologist but still not be culturally competent, so looking at what that really means—how to understand populations that are different from you culturally, how to look at perhaps having individuals in your practice that can make those patients more comfortable . . . whether they may be your nurses or your intake people . . . just sort of looking around and seeing how you can diversify your own space so that when others come they feel like you know what you’re talking about, and I think that’s really the goal overall,” explains Dr. McMichael. Dr. Lynn McKinley-Grant, president of the Skin of Color Society, talks to Dr. Susan C. Taylor about hair care products these patients can use so that dermatologists can help African American women take care of their hair and manage dermatologic conditions. “With COVID-19, many women are at home -- me included -- and it’s important for women to understand that they have to continue to groom their hair. Just because no one sees you doesn’t mean that you don’t regularly shampoo and condition as well as comb and style your hair,” says Dr. Taylor. * * * Key takeaways from this episode: Dermatologists should know how to recognize and differentiate between natural, processed, and synthetic hair in women of African descent to inform diagnosis and treatment recommendations. Regardless of hairstyle, it is important for all African American patients to shampoo, condition, detangle, and style their hair with products that contain appropriate ingredients. Shampoos with sodium lauryl sulfate contain the harshest detergents that can dry out the hair and scalp. “For our skin of color patients, or African American patients, we suggest shampoos that contain sodium laureth sulfate, which is a much milder detergent to clean the hair, and it helps to leave the hair moisturized,” Dr. Taylor explains. Social distancing provides an opportunity for African American women to concentrate on conditioning the hair while taking a break from damaging hair care practices. “I personally think this is a great time to minimize what you do to your hair in regard to heat from blow-dryers and flat irons and curling irons. I also think it’s a great time if you have a weave or braids and extensions to take them out to really give your hair a rest,” Dr. Taylor recommends. Many patients seek to avoid products containing controversial ingredients such as parabens, mineral oil, and tetrasodium EDTA because of concerns that they may be carcinogens or endocrine disruptors. “I think the jury is still out. There are a whole host of products that do not contain those particular ingredients, so I think our patients have to have choices,” Dr. Taylor says. Prescription shampoos for seborrheic dermatitis in people of African descent can dry out the scalp. “What I suggest to my patients is that they apply the shampoo directly to the scalp with a 4- to 5-minute contact time and then rinse the shampoo out of the scalp, followed by the use of a conditioning shampoo to actually shampoo their strands of hair. That way they’re minimizing the contact time with the prescription shampoo,” Dr. Taylor advises. Although daily shampooing typically is not recommended for individuals of African descent, health care workers and first responders will need to wash their hair more frequently during the coronavirus pandemic. “I think rinsing the hair with water, not necessarily doing a full shampoo every day, could be helpful. [Also] putting in a leave-in conditioner and reapplying the leave-in conditioner every day I think can really help combat potential dryness they can experience,” Dr. Taylor suggests. In this edition of the “Peer to Peer” audiocast series, Dr. Vincent DeLeo speaks with Dr. Susan C. Taylor about hair and scalp disorders in patients with skin of color. Dr. Taylor discusses the causes of common conditions that dermatologists may see in patients with skin of color, including central centrifugal cicatricial alopecia and pseudofolliculitis barbae, and offers tips for management and treatment. Fast forward to today and Susan publishes two different mystery series – one set in the glitzy San Francisco art world, and the other in an out-of-the-way French village. Jenny: But now, here's Susan. . Hello there Susan and welcome to the show, it's great to have you with us. Beginning at the beginning - was there a “Once Upon A time moment when you decided you wanted to write fiction? And if there was a catalyst for this, what was it? Susan: Yes there was a catalyst, actually. I won a writing contest a long time ago and the prize was a year's membership in the Mystery Writers of America. I was living in San Francisco, and I started going to the San Francisco meetings and I met all these wonderful people! Lively, curious, bright and a little off beat, who were published mystery writers. And I would go every month to the dinner, and became friends with some of those people who are still my friends. I thought, I'd like to do this too! Susan C Shea - mystery author Jenny: Fantastic! So you just sat down and started writing? Susan: Well, sure I did. But I was also raising kids and working full time. That's easier said then done, to sit down and start writing. I had a lot of false starts, but I kept being encouraged by the members of Mystery Writers and the local chapter who said "persevere, don't give up, keep writing, keep reading". It sorted of gestated in me for a long time before I actually decided to take the plunge - to quit my day job and start writing full time. Jenny: Great. And so you were naturally drawn to the mystery genre it sounds like, right from the beginning? Susan: Yes, I really was. I think one of the things I like about mysteries is that there's a structure and there's an expectation. It's sort of like listening to a piece of music where you know where the bridges are, you know where the verses, you know where the choruses are. There's a kind of pleasure in the rhythm of that. That appealed to me both as a reader and a writer. Jenny: That's a great analogy. I'd never thought of it that way before. It is a very good way to look at it. You've currently got two different mystery series on the go – one set in a picturesque French village, and the other in a prestigious San Francisco art and antiquities museum . . How did you get going on these? Susan: Well the Dani O'Rourke series set in a museum in San Francisco was the first one I did, and I had for a long time been debating how to structure a story and who the protagonist was going to be.
