He was born in Reno, Nevada and made his childhood home in Sparks, Nevada. He always made friends easily. When he was young, our neighborhood had a lot of children – he was always the oldest, and the neighborhood kids looked up to him. He was an avid UNR (University of Reno) Wolfpack fan and attended as many games as he could. He was a father of 5, but his struggle with PTSD was hard on his relationships and ended in either divorce or just a split up. He has 3 other brothers that served in the Navy also. His youngest brother is currently a lieutenant serving as an air traffic controller. David loved to hunt and fish and would take his eldest to hunt also. After retiring from the Navy, David struggled with mental issues and at one time turned away from me as he felt I was prying too much into his business. I only wanted him to get help. He never felt he had a problem. He estranged himself from quite a few people and didn't realize it was due to the issues he was struggling with. He had just gotten remarried 1 ½ years ago and had a new baby that just turned a year old in November. She will never know her dad which is sad because when he was having good days, he could be the best dad ever. n 1993, an experiment was done in Washington, DC, a city known for having a very high crime rate. The experiment was carried out to prove the hypothesis that if the square root of 1% of a population meditated at the same time, with the same intent, crime would drop. It did.Significantly. For approximately 8 weeks, 4000 members of a Transcendental Meditation group arrived in Washington and meditated. Sometimes there were more of them, sometimes less. They came when they could and stayed as long as they could to conduct the experiment. The results shocked everyone (except the meditators). All types of crime, violent and non-violent, dropped 15% - 24% during that period. Civic records were scanned as far back as possible to see if the massive drop had ever happened before, or if there could be any other explanation. It hadn't and there wasn't.Imagine what the world would be like if One Mind Live got enough people meditating together all over the globe...

Despite lithium prices halving in 2023, Battery Materials Review Managing Editor Matt Fernley is optimistic about the metal.   On Friday Fernley recorded Kitco Roundtable with mining audiences manager Michael McCrae.   This decade lithium went on a stellar run, trading up 10x versus historical levels, but in 2023 the metal took it on the chin. In 2023 Benchmark Mineral Intelligence estimates that lithium prices have been cut in half. Fernley is sanguine.   "It is just a reasonable cyclical downturn," said Fernley, noting that there have been production cuts in Asia that should help the metal. "We're already below the marginal cost of production for a number of assets in China. That's going to continue in April. I believe that lithium prices will pick up over the next couple of months."   Other news weighing on the metal is Tesla's price cuts. Growth is still strong, noted Fernley, who expects 25% to 30% year-on-year growth in European EV demand.   Lastly, CATL said it is making advances in sodium-ion batteries. Fernley said the technology still needs to scale, and the material has to be sourced in large quantities. Lithium ion will not be substituted by the new technology.   "It would be quite difficult for the sodium ion supply chain to ramp up capacity. The problem is getting pure enough sodium hydroxide or sodium carbonate to use in your batteries."

The man accused of kidnapping and killing 18-year-old Naomi Irion will stand trial. Troy Drive has been found competent to face charges.  Driver is accused of abducting Irion from a Walmart parking lot. Police find the body of missing teen Naomi Irion after receiving a tip that leds them to her gravesite. 18-year-old Naomi Irion was last seen on security footage, sitting in her vehicle while waiting for the shuttle she takes to work at Panasonic in the Reno-Sparks area. The footage also shows a man walking from the direction of a homeless camp and lurking among the parked vehicles. Naomi's brother, Casey Valley, says that security footage seemed to show the suspect saying or doing something that made Naomi move from the driver's seat to the passenger seat. Irion was in the passenger's seat as the man drove away. Investigators later found Naomi's blue 1992 Mercury Sable at the Fernley industrial park. An autopsy revealed Irion was shot  multiple times. Driver faces six charges in addition to first-degree murder, including sexual assault, robbery and destroying evidence. Usually, we go about our daily routines without a care in the world.  Wake up, get ready and drive to work.  Naomi Irion (18) did exactly this on March 12, 2022 in Fernley, Nevada.  She got ready for work at Panasonic, stopped to buy a drink and drove her vehicle to the Walmart parking lot like she did daily.  She sat in her car and waited for the shuttle bus that would ferry her to work. Naomi would not make it to work on March 12.  She would never be seen alive again.   A man was captured on CCTV loitering in the parking lot where Naomi was waiting.  He can be seen going up to her vehicle and forcing her into the passenger seat.  He then drove off in her vehicle, taking her captive. The search for Naomi spanned over two weeks.  On March 29, authorities found her body dumped in a shallow grave in a remote area of Nevada.  Troy Driver (41) has since been arrested and charged with kidnapping and murder in Naomi's case.  Police have been very tightlipped about the investigation.  Was this a random abduction?  Had Naomi come across Troy Driver in some capacity before she disappeared? Naomi Irion updated charges revealed. #NaomiIrion #TroyDriver #InvestigationAn amended criminal complaint filed Tuesday charges the suspect in Naomi Irion's kidnapping and killing with First Degree Murder and alleges he killed her by shooting her before burying her body in the desert. The complaint also alleges Troy Driver buried her body between March 12 and March 25 in an attempt to conceal the murder. According to the Churchill County Sheriff's Office, Irion died from gunshot wounds to the head and chest. Driver is also accused of destroying Irion's cell phone and also allegedly disposed of the tires on his truck in an effort to cover up the crime. According to the complaint, the crime started March 12 at 1550 E. Newlands Drive, the Walmart in Fernley where Irion was abducted. Driver is also charged with robbery and burglary, accused of driving off in Irion's car with her inside on March 12. Naomi Irion body recovered Authorities discovered the remains of an 18-year-old northern Nevada woman who was kidnapped over two weeks ago, officials said. The Lyon County sheriff's office said late Wednesday that investigators acting on a tip about the disappearance of Naomi Irion found a gravesite in a remote part of northern Nevada on Tuesday. An autopsy on Wednesday confirmed the body was Irion, the sheriff said in a statement. Earlier Wednesday, a 41-year-old man with a violent criminal record was charged with first-degree kidnapping. A judge in rural Lyon County left Troy Driver's bail unchanged during a brief court hearing Wednesday. It had been set at $750,000 after his Friday arrest. Driver, of Fernley, has yet to enter a plea. He was arraigned from jail Wednesday via Zoom. Justice of the Peace Lori Matheus said Driver will have to wear a GPS monitoring device if he posts a bond. Driver has been held at the Lyon County Jail in Yerington as a suspect in what authorities say was Irion's kidnapping. She was last seen around 5:25 a.m. March 12 in her car in a Walmart parking lot in Fernley about 30 miles (48 kilometers) east of Reno. Security video showed a masked man wearing a hooded sweatshirt get into her car. Driver abducted her "on or about March 12" and "did hold or detain her for the purpose of committing sexual assault and/or purpose of killing her," according to the two-page criminal complaint filed Wednesday in Lyon County's Canal Township Justice Court. The FBI offered a $10,000 reward for information to locate Irion. Hundreds of volunteers have joined searches during the past two weeks, looking for clues in a vast desert area. Irion lived in Fernley with her older brother, Casey Valley, who told reporters after the hearing that the family was "all in shock" that any bail was set. Irion's vehicle was found three days after she went missing near a paint manufacturing facility in an industrial park along Interstate 80 not far from the store. Valley said earlier his sister usually catches a bus from the Walmart lot to work at a Reno-area Panasonic facility. Valley said she never arrived at work and he contacted family members and authorities when Irion didn't return home that weekend. Matheus set a court date for Driver next Tuesday, and a preliminary hearing April 12 to decide if there is evidence for Driver to be tried in state court. He could face life in prison without parole if he is convicted. His defense lawyer, Mario Walther, did not immediately respond to requests for comment following the hearing. Several news outlets have reported that Driver was sentenced to 15 years in prison for his role in a 1997 murder case in Northern California. Mendocino County Court records show he pleaded guilty that summer to robbery, burglary and firearms charges as well as to being an accessory to a felony after the fact. California Department of Corrections and Rehabilitation spokeswoman Dana Simas said in an email to The Associated Press he was sentenced to 15 years on those charges on Aug. 19, 1997, was released to state parole supervision in 2012 and discharged from parole supervision in 2014. Before authorities announced that her body had been identified, Valley told reporters Wednesday that family members appreciate the support from the community and praised efforts by sheriff's deputies and federal agents to find his sister. The body of a Nevada teenager who was allegedly kidnapped from a Walmart parking lot over two weeks ago has been found, authorities said. Naomi Irion, 18, was last seen inside her car outside a Walmart in Fernley, Nevada, outside Reno, on March 12, according to the Lyon County Sheriff's Office. Surveillance video captured a man getting into the driver's seat of her car and leaving in an unknown direction with Irion in the passenger seat. A tip regarding her disappearance led investigators to a remote part of neighboring Churchill County on Tuesday, where they found a "possible gravesite" and recovered the body of a woman from the scene, authorities said. On Wednesday, the remains were identified as Irion's by the Washoe County Medical Examiners Office. No further information is being released at this time due to the ongoing investigation, authorities said. On the morning on Saturday, March 12, 2022, 18-year-old Naomi Irion drove her car to the Walmart parking lot in Fernley, Nevada. While Naomi was sitting in her car waiting for a shuttle to arrive that would take her to work, a man approached her car, said or did something that made her slide over to the passenger seat, then this man entered the driver's seat and abducted Naomi. 41-year-old Troy Driver has since been arrested on kidnapping charges. However, Naomi remains missing. Naomi Irion is 5'11” and weighs 240lbs. Her hair is dyed black, and she has green eyes with one eye having a bit of brown in it. She has a smiley face tattoo on her right ankle, her septum is pierced as are both of her nostrils. She was last seen wearing a blue Panasonic t-shirt, a grey cardigan, grey pants, and dark colored off brand Ugg style boots. She was also carrying a black purse and an iPhone XR. None of Naomi's clothing or belongings have been located as of recording this episode. Her abductor was driving her 1992 sun faded blue Mercury Sable. Though a new dark colored Chevy 2500 High Country Silverado truck has been impounded in relation to the abduction as well. Authorities are looking for witnesses who may have seen either vehicle on or around March 12, 2022. Missing Persons Alert: Naomi Irion18 Year old Naomi Irion is missing and was presumably abducted from a Walmart parking lot in Fernley, Nevada at close to 5:30am on March 12, 2022. Surveillance footage led to an arrest of a 41 year old man named Troy Driver of Fallon, NV in connection with Naomi's abduction. He is apparently not talking, and Naomi remains missing and time may be of the essence. Naomi is described as 5ft11, 230-250 pounds, with dyed Black, but naturally Brown hair. She has a septum piercing and the tattoo of a smiley face on her right ankle.She was last seen wearing a Blue Panasonic shirt, a Gray cardigan sweater, and Brown boots. She was carrying a Black purse, and her Iphone is missing.Her car was found 3 days later next to the Sherwin Williams Western Emulsion Plant.If you have any information, please contact your local FBI office. 18-year-old Naomi Irion was last seen on security footage, sitting in her vehicle while waiting for the shuttle she takes to work at Panasonic in the Reno-Sparks area. The footage also shows a man walking from the direction of a homeless camp and lurking among the parked vehicles. Naomi's brother, Casey Valley, says that security footage seemed to show the suspect saying or doing something that made Naomi move from the driver's seat to the passenger seat. Irion was in the passenger's seat as the man drove away. Investigators found Naomi's blue 1992 Mercury Sable on March 15 at the Fernley industrial park. They said evidence inside the car suggests that a crime was committed. Naomi is described as a white female who stands 5-feet-11-inches tall with green eyes (one eye is green and brown). She has dyed black hair, according to her family, who created a GoFundMe page to help with search costs. On Saturday March 12, 2022 Naomi Irion was in the driver's seat of her car in the Fernley, NV Walmart parking lot at about 5:09 a.m. getting ready to get out to get onto a shuttle bus. This shuttle bus would then transport employees of the Panasonic company to the Panasonic plant in Sparks, NV, about a 20 min drive away. She's in her car and in an unreleased surveillance video from the sheriff's office a man is seen walking up to Irion's car from the direction of a nearby homeless camp (not necessarily that he IS homeless, but he was coming from that direction). The video shows him getting into the driver's seat of Irion's car at 5:24 am and then driving off, with her in the passenger seat. He somehow managed to coerce Naomi into the passenger side of the vehicle. Irion's car, a 1992 Mercury Sable, was found behind the Sherwin Williams in Fernley. The store is located at 1891 Duffy Road, less than a mile away from the Walmart at 1550 West Newlands Drive East, where she was abducted. The Lyon County Sheriff's Office said “The vehicle has since been retrieved, searched and forensically analyzed. Forensic evidence has been recovered and is being expedited for testing through the Washoe County Forensic Investigation Section.” The vehicle was found March 15th, 3 days after she went missing. Officials are now looking into the possibility the suspect in her disappearance may be driving a dark-colored 2020 or newer Chevrolet 2500 High Country four-door pickup truck. The driver of the truck is believed to have “a direct connection to her disappearance and her current whereabouts,” sheriff's officials say. Naomi Irion is 5'11” and has dyed black hair and green eyes. She also has a septum piercing in her nose. She was last seen wearing a blue Panasonic T-shirt, a gray cardigan sweater, gray pants and brown boots. She was carrying a black purse. The possible suspect was wearing a gray hoodie and blue jeans or pants. Tom welcomes Matt Fernley to the show. Matt is the managing editor of Battery Metals Review and Head of Research for Westbeck Capital's Volta Fund. Matt discusses how the green energy transition is impacting inflation due to moratoriums on oil and gas exploration. There is a general public impression that we won't need as much oil due to electric vehicles. However, ICE vehicles will continue to be the majority for some time. Europe is very dependent on Russian gas for electricity and heating. A lot of analysts are predicting that oil could go much higher. There are two issues with EVs. The first is their current cost and the underinvestment in raw materials. We're going to see higher prices for all the battery metals much as we have seen with lithium. The rise in energy prices is also having an impact on the cost of "refilling" electric vehicles. Renewables are not a panacea because they do not provide baseload power. They only work when the sun is shining or the wind is blowing. To fix this problem you need large energy storage solutions and nuclear. For the last twenty years, the western world has shifted its manufacturing base to China. China has now clearly shown that they have little interest in making low-cost materials for the West. Therefore, huge increases in operating costs are coming as we will need to build back our manufacturing industries. Copper demand may be overstated as the world has already gone through significant structural changes in demand. Today's consumer requires less in the way of products than in the past. Just consider all the functionality in a smartphone. He gives a breakdown of the nickel market, the classes of metal, and the price movements in recent years. Lithium is currently in very short supply and that is the cause of recent price action. He has reduced his EV production forecast because of the lack of available raw materials. He says, "If you want to de-carbonize you have to invest in primary metal production." The shortage of battery metals is driving up the costs of electric vehicles to the point where car ownership may transition to various types of rental models, said Matt Fernley, editor of Battery Materials Review and Head of Research for Westbeck Capital's Volta Energy Transition fund.On Friday Fernley recorded Kitco Roundtable with Mining Audiences Manager Michael McCrae, Editor Neils Christensen and Kitco correspondent Paul Harris.Demand for electric vehicles is up sharply due to a big worldwide regulatory push and swiftly changing consumer sentiment. However, battery metals costs are rising quickly due to supply disruptions and just not enough mines online to meet the rising demand. This week nickel hit a 10-year high.  "I think there is a risk that EV prices will have to stay outside the mass market," said Fernley "And that then raises the question: how do you sell EVs if they're double the price of internal combustion engines."Perhaps the auto companies will have to look at different ownership structures. Currently there are eight (8) books, developed these books from his Children's Safety Program which he taught as a D.A.R.E. Officer with a County Sheriff's Department. "Over my sixteen (16) year career" he says, "this program saved 44+ children from abduction." He goes on, "I was a 6th Grade Teacher and a Reserve Deputy Sheriff. I became concerned with the problems plaguing young people. I was offered the D.A.R.E. (Drug Abuse Resistance Education) position in the county I taught in. I was driven to prevent children from making the wrong choices, so I changed careers from teaching to law enforcement." It was a wise decision. In February, the House passed a package of ten bills that give away or sell Federal land, most of them so that private interests can use our land for profit.     To contribute to Congressional Dish, please use the PayPal link below. Thank you.   HR 2954: Public Access & Lands Improvement Act The Congressional Budget Office analysis of HR 2954 RAUL GRIJALVA (AZ):" Let's be clear: we are talking here about Federal property, that is, property owned by all Americans. The land in question in Escambia County, Florida; Anchorage, Alaska; Fernley, Nevada; Cape Hatteras, North Carolina; Yellowstone and Grand Teton and the land on which Federal grazing occurs, the land impacted by this package is Federal land, owned by each and every American taxpayer. In the case of these land transfers, the Federal Government gave the land, gave it to a local community as a means of Federal support, and the only requirement, in most cases, was that the land always be used for public purposes. As long as it is a park or a school or a fire station, it is yours, for free. What these bills do is end those public purpose requirements. The communities want to use these lands for private profit. They want to close them to the public, in many cases. This is not a land grab by Uncle Sam. This is not some silly scheme by the Feds to harm local communities and to use their power to hold down the tax-payers and keep the public out. This is a community asking to make money off land that was owned by all Americans, and it is the job of Congress to decide if that is a good idea or not. TITLE I: Florida land transfer Allows Escambia County, FL to give away it's title, right, and/or interest in Santa Rosa Island "to any person or entity", without restrictions. Escambia County has 2 years to transfer its rights, title, and interest in its property that falls within Santa Rosa Country to Santa Rosa County. The transfer is final and "shall terminate" "any regulation of Santa Rosa County by Escambia County" RAUL GRIJALVA (AZ): "This is public land, not land to give away and, as stated before, over and over again, be dredged and used for a harbor for potential windfall profit." The concern raised by Raul Grijalva is over the possible dredging of Navarre Pass. A pass was dredged for boats in 1965 but was almost immediately destroyed by Hurricane Betsy. In 1968, a permit to re-dredge the pass was denied. The fighting over this has continued ever since. From what I can gather, Santa Rosa county wants to dredge the pass again but Escambia County does not. Both counties currently get a vote on this issue. Terminating any regulation of Santa Rosa County by Escambia County could potentially take Escambia's vote away and allow the pass to be dredged. TITLE II: Transfer of Federal land rights to the City of Anchorage Section 203: Secretary of the Interior will give all rights to land it currently leases to the City of Anchorage "to enable economic development" of that land. City of Anchorage will pay all costs. TITLE III: Sale of Federal land to Fernley, Nevada Introduced by Mark Amodei (NV-2) Section 302: Forces the Secretary of Interior to process a sale of 9,407 acres of Federal land to the City of Fernley in Nevada. Secretary of Interior will determine the "fair market price" CBO estimate's that to be $3,500 per acre = almost $33 million worth of land The map of the land will be available for public inspection, but it doesn't say it has to be available before the sale is completed. The land transfer will not be considered a "major Federal action", which exempts it from evaluation under the National Environmental Policy Act Section 303: Releases the Federal government from any liability from "the presence, release, or threat of release of any hazardous substance, pollutant, contaminant, petroleum product (or derivative of a petroleum product of any kind), solid waste, mine materials… on the Federal land in existence on or before the date of conveyance." Section 304: Appears to exempt the land from public land, mineral leasing, mining, and geothermal leasing laws. *confusing - not sure* "Current uses of these lands include grazing, mining, a public airport lease, and a geothermal lease... The Federal government owns both the surface and mineral estate in much of the parcels and the value of the mineral estate may be substantial." "The city has said possible uses could include parks, an airport, hospital, convention center and other businesses." TITLE IV: Prevents Federal land purchases Introduced by Rob Bishop of Utah RAUL GRIJALVA (AZ): "Let's put one other misleading claim to rest. While Republicans claim the Federal Government owns too much land, the historic trend has been one of divestiture and fragmentation. As recently as the late 1860s, the Fed-eral Government owned 1.8 billion of the 2.3 billion acres in the contiguous United States. Grants to States, home-steaders, land-grant colleges, railroads and others settling in the Alaska and the West have reduced Federal land ownership by roughly 640 million acres to date."* Section 401: No land can be purchased, donated, or transferred to the Federal government until a database of land-for-sale is created and made "easily accessible to the public" Section 401: No land can be purchased, donated, or transferred to the Federal government until a database of land-for-sale is created and made "easily accessible to the public." TITLE V: Bush Administration Rules for Cape Hatteras National Seashore Introduced by Rep. Walter Jones of North Carolina Section 502: Management of Cape Hatteras National Seashore Recreational Area will be managed according to a Bush Administration era environmental assessment, issued June 13, 2007. In October 2007, a lawsuit was filed against the Bush Administration rules by Defenders of Wildlife an the National Audubon Society, claiming that they Bush Administration rules didn't restrict off-road vehicles enough to protect the animals and land - including land nesting birds, whose populations were declining - and sea turtles. A "consent decree" - basically a settlement- was agreed to in April of 2008. This consent decree is what is currently governing the seashore. After the consent decree was agreed to, the National Park Service created the rules - which included a public comment period - and their final rule went into effect on February 15, 2013. This bill nullifies the consent decree, prevents enforcement of the final rule, and puts the Bush Administration rules back in charge. The Secretary of Interior can not restrict pedestrian or motorize vehicle traffic in order to protect animals beyond the restrictions enacted by the Bush Administration. Protections for endangered species at Cape Hatteras can not be greater than the restrictions placed for that species at any other National Seashore. Section 504: Prohibits enforcement of a final rule regulating off-road vehicles at the seashore that went into effect on February 15, 2012. TITLE VI: Green Mountain Lookout Can't be Moved [caption id="" align="aligncenter" width="412"] The Green Mountain Lookout in 2010[/caption] March 2012: A federal court ordered the Forest Service to remove a lookout structure from Green Mountain wilderness area. The lookout was constructed in 1933 and had been rehabilitated in 2009. Susan DELBENE (WA) "Green Mountain Lookout, located in the Glacier Peak Wilderness, was built in 1933 as a Civilian Conservation Corps project to detect fires and spot enemy aircraft during World War II. The look-out is an important, historic and unique part of the Pacific Northwest. It is a popular destination for hikers, and it is listed on the National Register of Historic Places. Unfortunately, severe weather caused the Green Mountain Lookout to fall into disrepair in 2001, and the U.S. Forest Service began taking steps to preserve the historic…structure for future generations. How-ever, an out-of-State group filed a law-suit against the Forest Service for using machinery to conduct these repairs, and a U.S. District Court ordered the Forest Service to remove the look-out. My bill would allow critical and routine maintenance while keeping this iconic structure where it is meant to be—in its original home. Local governments in the area, my constituents, as well as a number of environmental and historic preservation groups support my bill to keep the Green Mountain Lookout where it is. The Natural Re-sources Committee agrees. They passed this bill unanimously last year, and why wouldn't they? This bill is common sense. It saves us money because it would actually cost more to remove the lookout than to keep it where it is. There is absolutely no doubt in my mind that, if this bill had been brought up on its own, by its own merits, it would have passed with overwhelming bipartisan support. Unfortunately, that is not what is happening here today. Instead, this bill has gotten wrapped up in a series of very controversial and divisive bills" Section 603: Green Mountain Lookout can't be moved except for safety reasons. TITLE VII: River Paddling in Yellowstone & Grand Teton Introduced by Rep. Cynthia Loomis (WY) Prohibits the enforcement of two regulations that all rivers to be closed to hand paddlers in Yellowstone and Grand Teton National Parks. Would take effect 3 years after the bill becomes law. Existing regulations prohibit boating on rivers and on five of Yellowstone's 168 lakes and a 1,000 foot section of the Snake River in Grand Teton National Park.  The ban was put in place sixty years ago to prevent overfishing. TITLE VIII: Longer permits and no environmental studies for grazing Introduced by Rep. Raul Labrador (ID) Section 802: Increases the term for new permits on Federal land from 10 to 20 years. Anyone who sues to stop grazing and lose in court will pay the legal fees and other expenses of the winner, unless the court rules otherwise. Section 803: An expired or transferred permit will remain in effect, under the original terms, until the government finishes processing a new permit or lease, which will be valid for twenty years. "The renewal, resistance, or transfer of a grazing permit or lease by the Secretary concerned shall be categorically excluded from the requirement to prepare an environmental assessment or environmental impact statement". Crossing and trail authorizations for livestock will be exempt from environmental regulations. Temporary crossing or trailing authorizations "shall not be subject to protest or appeal" TITLE IX: Sell Dead Wood from the Rim Fire Introduced by Rep. Tom McClintock (CA) TOM MCCLINTOCK (CA): The fire also left behind hundreds of millions of board feet of dead timber that is on Federal land that could be sold to raise millions of dollars, money that could then be used to replant and reforest our devastated lands. In addition, processing that timber would help to revive the economy of a stricken region. Section 902: Secretary of Agriculture "shall conduct a timber salvage and restoration pilot program. Automatically deemed to comply with NEPA, the Endangered Species Act, and three other forest management laws. Is not subject to "judicial review by any court of the United States." Specifically prohibits a temporary restraining order. The pilot program will be conducted according to an proposed alternative in a draft environmental impact statement. The "proposed alternative", which would govern the pilot program, has no details: "In addition to the Proposed Action, the EIS will evaluate the required No Action alternative and will likely consider other alternatives identified through the inderdisciplinary process and public participation." Sierra Pacific is already collecting fallen trees on private land A fascinating article in the Modesto Bee is in favor of opening some additional land to logging but is pissed at Tom McClintock for going so far and not trying to find a sensible compromise: "McClintock has called for immediate salvage logging of 1 billion board feet of timber. To understand the magnitude of what McClintock envisions, a billion board feet is equal to all the timber logged in California in a year. Much of it is in steep, remote areas. To get to it, loggers would need to cut roads and scale steep mountains, causing yet more erosion on slopes with no ability to stop runoff. The damage – environmental and to whatever is below – could be enormous. McClintock believes that such a massive operation should be exempt from federal environmental laws, public comment and court review. That is nonsensical. There is no scientific basis for the scale of removal that McClintock advocates. Besides, the logging industry doesn’t have enough trucks, crews, equipment and processing capacity for it. For instance, there are only 11 logging crews and 165 trucks working in the area of the Sierra hit by the fire, and they will be busy through the summer simply removing the timber from private lands. And even if more crews and trucks could be brought into the area, the mills would have no place to store that much timber. The congressman from Elk Grove ought to drop his ill-conceived idea and concentrate on helping the timber companies acquire the areas they target." Tom McClintock statement on Rim Fire timber TITLE X: Chesapeake Bay Orders a report on past and future restoration funding levels for activities over $100,000. Develop a restoration plan that will be updated every two years .Create an independent evaluator for the restoration programs. TITLE XI: Issues a patent for 80 acres of Alaska land for surface rights United States keeps all mineral rights. Additional Information The government recently seized the cows of Cliven Bundy, a rancher in Nevada who has refused to pay his grazing permitting fees for over 20 years, which lead to armed standoff between Federal agents and 100 man hillbilly militia. This started in 1993 when the Federal government revoked Bundy's permit for grazing on 600,000 acres of federal land for lack of payment. In 1998, a Las Vegas federal judge ordered Bundy to remove his cows from our land. He has refused.  Since then, Bundy has racked up a bill of over $1 million in unpaid fees and has refused to move his cows onto his own land. Bundy says he doesn't have to pay because he no longer has a contract with the Federal government, as it was revoked in 1993. Bundy also says that the land in dispute belongs to Nevada, not the Federal government. The Bureau of Land Management removed his cows from the Federal land - impounding them instead of putting them on Bundy's undisputed land - and Bundy and his hillbilly supported showed up pissed off with guns. The BLM last week backed down.
