For most of the second half of 20th century, the Supreme Court has wrestled with finding a balance between the Free Exercise of religion and the Establishment Clause, offering several tests to test the limits of permissible accommodation without the undue appearance of government endorsement. Among those tests has been a little-thing called the “play in the joints,” famously introduced in Walz v. Tax Commissioner of New York (1970). In this episode, I explore this concept with Falco Anthony Muscante II, whose paper in the Ave Marie Law Review is called “Play in the Joints” Among the Religion Clauses: Rebuilding the Strong Joints the Framers Formed. In our conversation, we discuss the history of the religious clause and what the framers intended, how the concept emerged and became weaponized in Locke v. Davey (2003), why the Court has latched on to the idea of state neutrality and how that impacts religion, and more. All while getting some laughs along the way. Rewind to 2013, two years into my pharmacy career and there I was, struggling to adapt to the unscripted world of pharmacy and healthcare. But then I realized something was missing - the ability to create meaningful connections in the moment with those I cared for, and the ability to adapt and remain flexible. 2013 was the year I went to my first improv class and two simple words changed everything for me: "Yes, and." _____________ The Pennsylvania Pharmacists Care Network (PPCN) is pleased to announce that Dr. Rob Maher has been selected to serve as its new President and Chief Operating Officer (COO). Dr. Maher brings over 30 years of experience working in independent community pharmacy practice, ambulatory care pharmacy, long-term care pharmacy and hospital pharmacy. Dr. Maher has an extensive history with PPCN, since its formation in 2015. Dr. Maher has been actively involved in PPCN since by serving as a PPCN luminary, PPCN trainer and technology solution support lead for PioneerRX. Dr. Maher has also represented PPCN nationally, serving for the past three years as Chair of the Community Pharmacy Enhanced Services Network's (CPESN) Quality Assurance Committee. Most recently he has served as Director of Pharmacy Services for Klingensmith's Drugstore, a seven-store independent, family-owned chain of PPCN-member pharmacies located in Armstrong and Clarion counties. In this role, Dr. Maher lead the development, implementation, and growth of enhanced community pharmacy services across multiple locations. Through use of key performance indicators (KPIs), careful workflow considerations and by leaning into technology, Dr. Maher was able to position Klingensmith's to serve their communities while growing new business revenue. In addition to his practice experience, Dr. Maher has spent the past 25 years serving as a faculty member and administrative pharmacist at the Duquesne University School of Pharmacy. During this time, Dr. Maher has taught and inspired countless student pharmacists through didactic courses related to the fundamentals of pharmacy practice management, implementation of pharmacy services and business planning/entrepreneurship. Dr. Maher earned both his B.S. in Pharmacy ('93) and PharmD from the University of Pittsburgh ('97). In 1998, Dr Maher completed a Geriatric pharmacy specialized residency at Duke University's Center for the Study of Aging and the Durham Veteran's Affairs Geriatric Research Education Center. Growing up, Dr. Rob Maher worked in his family's community pharmacy in Patton, Pa. (Cambria County) that his father owned and operated for 47 years. In 2021, the business was sold to another independent pharmacy owner. Dr. Maher also was a pharmacy owner partner for Mission Pharmacy Services, a long-term care pharmacy. Dr. Maher will be taking over for Dr. Brandon Antinopoulos, the network's first President and COO. Dr. Antinopoulos is embarking on a new career path as an independent pharmacy owner. Current PPCN Executive Director, Stephanie McGrath, will remain in her role leading the network's program design, implementation, and evaluation efforts to advocate for the quality care provided by PPCN pharmacies. They delve into their respective cancer centers' primary donor sources for match unrelated donors and the breakdown of conditioning intensity within their hematologic patients. They delve into the future of PTCy discussing the potential for earlier de-escalation of immunosuppressants to limit drug-related toxicities and optimize patient outcomes as well as important supportive care considerations. Despite the exciting prospects, the need for robust prospective data before implementation is emphasized. About Dr. Rebecca Gonzalez Dr. Rebecca Gonzalez (@xnyerin) received her Doctor of Pharmacy degree from the University of Florida College of Pharmacy. She completed her PGY2 Oncology residency at West Virginia University in Morgantown, West Virginia. Following post-doctoral training, Dr. Gonzalez was a Hematology Clinical Pharmacist at the Roswell Park Cancer Institute prior to transitioning to Moffitt Cancer Center in 2015. She is Board Certified in Oncology Pharmacy and currently practices as a Clinical Pharmacist in Blood and Marrow Transplant/Cellular Immunotherapy at Moffitt in Tampa, Florida. Each month, our Carrier Connections program features a different X-linked condition with the goal to increase awareness and education of X-linked conditions and how they impact females. This month, we are featuring Fragile X syndrome. Fragile X syndrome is a heritable X-linked disorder caused by an abnormality in the FMR1 gene. This gene makes the protein, FMRP, which plays a critical role in the development of nerve cells and the production of other cellular proteins. An issue in this FMR1 gene causes an absence or severe deficiency of the FMRP protein, resulting in a range of developmental problems and distinctive physical features. It typically results from a specific mutation, or alteration of DNA, that causes a CGG base repeat to occur over 200 times in the damaged FMR1 gene. Molecular genetic testing can be used to diagnose this condition by identifying the 200 CGG repeats in the FMR1 gene. Women with a fragile X premutation, or 55 to 200 repeats of the FMR1 gene, have an increased risk of having a child with fragile X syndrome. Additionally, female fragile X premutation carriers may experience menstrual and menopausal abnormalities, infertility, diminished ovarian reserve, and chronic hypoestrogenism. Such chronic hypoestrogenism has been associated with impaired bone health and an increased risk of cardiovascular disease. Furthermore, female carriers of a fragile X premutation have been found to have neuropsychiatric issues including neuropathy, increased anxiety and depression, and tremor/ataxia syndrome. Some studies have also associated thyroid abnormalities and hypertension to fragile X syndrome in women. Today, we are joined by Rebecca Kronk, PhD, MSN, CRNP, ANEF, FAAN, CNE. Dr. Rebecca Kronk joined Duquesne University School of Nursing as an Assistant Professor in August 2010, earned tenure in 2016 and was promoted to Full Professor in 2022. She is a board certified pediatric nurse practitioner. Dr. Kronk earned her MSN from the University of Pittsburgh School of Nursing and a PhD in Applied Development Psychology at the University of Pittsburgh, School of Education. Dr. Kronk was a fellow in the Maternal and Child Health Training program providing leadership and education in neurodevelopmental disabilities and autism (LEND) at the University of Pittsburgh. Dr. Kronk has been in the field of pediatric nursing for over 40 years and she is experienced in helping children and families with a range of developmental issues. She has enjoyed combining clinical work with teaching and research. The theoretical framework of her research has been based on the International Classification of Functioning, Disability, and Health published by the World Health Organization. Dr. Kronk has conducted several research studies on the sleep patterns of children with Fragile X syndrome and developmental functioning of children in the FXS gray zone alleles. The SonRise Project creator Kelli Richardson Lawson introduces Dr. Marie Smith-East, PhD, who is the director of the Psychiatric Mental Health Nurse Practitioner Program and is a clinical assistant professor at the Duquesne University School of Nursing. In this episode, Dr. Smith-East helps parents consider treatment options for children. She says recognizing your teen or young adult needs help with mental health and or substance abuse may feel overwhelming. While there is no one-size-fits-all approach, Dr. Smith-East provides helpful information to parents navigating options from a nursing perspective. Those options might include residential treatment programs, wilderness programs, partial hospitalization or intensive outpatient programs. She urges parents to get to know their child's treatment team, ask questions and take a comprehensive holistic view of care. Most of all Dr. Smith-East encourages parents to have hope. Guest Bios: Kathryn (Kat) Pruss Zeltwanger ‘98 Lib is the Deputy General Counsel at the Armstrong Group in Butler, Pennsylvania. In that role she oversees all of the legal work for four of the company's eight operating groups, handles the employment work for all of the operating groups, manages the litigation for six of the operating groups, and manages the legal group. Before joining the Armstrong Group in 2009, Kat clerked for a Common Pleas judge in Fayette County and worked as an associate attorney in the Pittsburgh office of Fox Rothschild. Kat earned a B.A. in Letters, Arts, and Sciences, with Honors from Penn State's College of the Liberal Arts in 1998. She also earned her JD from Pitt Law in 2004. Kat currently serves as the Vice-President of the Scholar Alumni Society. Kathryn (Kate) Czekalski ‘17 Eng is a 3L at Duquesne University School of Law in Pittsburgh, where she spent the Summer of 2021 in Dinsmore & Shohl's intellectual property practice group learning the ins and outs of patent prosecution. She will be returning to Dinsmore after graduation and the Pennsylvania bar exam. Before attending law school, she previously worked in the oil and gas industry as an engineer servicing various refineries in the Northeast US and Canada. Bill Cosby's sexual assault conviction was thrown out Wednesday by Pennsylvania's highest court in a ruling that swiftly freed the actor from prison more than three years after he was found guilty of drugging and molesting Temple University employee Andrea Constand at his suburban Philadelphia mansion.Cosby, 83, was the first celebrity tried and convicted in the #MeToo era, and his conviction was seen as a turning point in the movement to hold powerful men accountable for sexual misconduct.Here's a look at the case against Cosby and the court's decision:WHY DID THE COURT TOSS HIS CONVICTION?The split court found that Cosby was unfairly prosecuted because the previous district attorney had promised the comedian once known as "America's Dad" that he wouldn't be charged over Constand's accusations. Cosby was charged by another prosecutor who claimed he wasn't bound by that agreement.The court said that's not the case. The justices found that Cosby relied on that promise when he agreed to testify without invoking his Fifth Amendment right against self-incrimination in a lawsuit brought against him by Constand.The court concluded that prosecutor who later brought the charges was obligated to stick to the nonprosecution agreement, so the conviction cannot stand. The justices wrote that "denying the defendant the benefit of that decision is an affront to fundamental fairness, particularly when it results in a criminal prosecution that was foregone for more than a decade."WHAT'S THE DEAL WITH THE NONPROSECUTION AGREEMENT?The promise not to prosecute Cosby was made in 2005 by Bruce Castor, who was then the top prosecutor for Montgomery County. Castor was also on the legal team that defended former President Donald Trump during his historic second impeachment trial over the Jan. 6 insurrection at the U.S. Capitol by his supporters.During a court hearing weeks after Cosby's 2015 arrest, Castor testified that he promised Cosby he wouldn't be prosecuted in the hopes that it would persuade the actor to testify in a civil case brought by Constand and allow her to win damages. Castor acknowledged the only place the matter was put in writing was in the 2005 press release announcing his decision not to prosecute, but said his decision was meant to shield Cosby from prosecution "for all time."His successor noted, during the appeal arguments, that Castor went on to say in the press release that he could revisit the decision in the future.Castor had said that Constand's case would be difficult to prove in court because she waited a year to come forward and stayed in contact with Cosby.The first jurors who heard the case may have agreed with him, as they could not reach a verdict in 2017. But a second jury empaneled after the #MeToo movement exploded found him guilty at his 2018 retrial. Introduction to themes in Martin Luther King’s concept that the arc of the moral universe bends toward justice. Bruce Ledewitz is a professor of law at Duquesne University School of law. He specializes in constitutional law, law and religion and law and the secular. He is the author of American Religious Democracy: Coming to Terms with the End of Secular Politics (Praeger 2007), Hallowed Secularism: Theory, Belief, and Practice (Palgrave Macmillan 2009) and Church, State, and the Crisis in American Secularism (Indiana University Press 2011). Ledewitz received his undergraduate degree from Georgetown University School of Foreign Service and his J.D. from Yale Law School For Ledewitz, America is a society fallen into nihilism. For many Americans, there are no objective sources of meaning and history has no shape. But nihilism has arisen almost accidentally, out of a failure of the culture to defend truth. This podcast is a first step in challenging our nihilism. Jesse Francis, who interviews Ledewitz in Episode 1, is a graduate of Duquesne Law School, where he and Ledewitz had an opportunity to explore the implications of nihilism. Francis is an associate in the Dickie McCamey law firm in Pittsburgh.
Tracey McCants Lewis has made numerous contributions to Pittsburgh and the region. She has been a tenured professor of law at Duquesne University School of Law, she is Deputy General Counsel to the Pittsburgh Penguins and serves on the Board of Directors of the August Wilson African-American Cultural Center. McCants Lewis is a leader in the movement for social justice, in recognition of which the Urban League awarded her the Ron Brown Community Leadership Award in 2017. Part of that leadership is her current work at Duquesne Law School’s Civil Rights Clinic where, among other things, students provide advice and represent individuals pursuing expungements and pardons. For Tracey McCants Lewis, Dr. Martin Luther King, Jr., is not just a hero out of history, but a constant and contemporary source of inspiration. When Dr. King taught about the arc of the moral universe, it gave people at that time a sense of optimism and hope. Many of the things Dr. King looked for have come true, though much remains to be done. Some of those good things have even happened in hockey. In his plays, August Wilson exemplifies the seeking of justice that Dr. King was pointing to.
Kristi Gedid is the Senior Director of Global Legal Operations at Mylan, a global healthcare company based in Pennsylvania. She has extensive experience in the areas of complex commercial litigation, mergers and acquisitions, private equity and transactional law. Prior to joining Mylan, Kristi worked for two Am Law 100 firms as well as a large Pittsburgh-based bank. Drawing on her legal education at Duquesne University School of Law and the Paralegal Institute, as well as an MBA from Duquesne, Kristi has a particular appreciation for the complexities of the intersection of business and law, and enjoys using her education and experience on a daily basis. Kristi is a member of the Corporate Legal Operations Consortium (CLOC) and founded the Pittsburgh regional group, which has grown to more than 75 members. She also teaches at Duquesne University School of Law as an adjunct professor. She attended her dream school, Grove City College, a college that values both faith and freedom. During her 4 years, Allison was the president of her sorority, honor student, named on the dean’s list, was recommended by her peers to be on the homecoming court and received her Bachelor of Science degree in Business Marketing Management with a focus on Communication Studies. She was immediately hired to work for a prime contractor for the United States Naval Nuclear Propulsion Program (NNPP). During those years, Allison married the man of her dreams, a United States Marine and now, firefighter. They bought a house, adopted a pit bull and, together, they realized that they had a passion to live a life that they designed. They quit their jobs and moved to live by the ocean in sunny Charleston, South Carolina. Allison competed and placed in her first bodybuilding bikini competition. A year later, they adopted a second pit bull, and she enlisted into the Air Force National Guard. A few months before heading to basic training, Allison found out that she was pregnant with her first child; her sweet, baby boy Micah. Allison currently works for the Town of Mount Pleasant full-time, while operating IEPPal, an education platform. She also started a non-profit, Networking4Moms, with co-founder and twin sister, Emily Seelman, which is designed to provide the resources for stay-at- home moms to be able to re-enter the workforce. Allison also operates a social media platform with her sister called Emily and Allison: an Instagram account and a YouTube channel. They are also currently in the process of developing a dating app for single parents. She is currently training post-partum to compete in her second bodybuilding bikini competition. Allison has a desire to contribute to her community and improve the lives of those around her by living fully, employing her talents, working hard and loving deeply. Her mission is to uphold the good, the true, and the beautiful while impacting the world. At the same time, she strives to do the little-noticed disciplines well, like growing in the knowledge of her Creator and raising and training her children in His nurture and Word. She believes in living with deep gratitude and joy. Emily Seelman, co-founder of N4M, brings with her experience in the start-up industry as well as a legal background. Emily went to Grove City College,a Christian Conservative school located in Grove City, Pennsylvania, where she received her Bachelor of Science degree in Business Marketing, graduating with high honors in Marketing Management and Dean’s List with Distinction. Her most distinguished honor was being elected sorority president. After college, Emily attended Duquesne University School of Law and graduated Cum Laude with an award for the highest grade in Expert Evidence. During her time in law school, Emily was an Associate Editor for the Duquesne Law Review Journal and received the Distinguished Junior Staff Editor Award. She served as the law school representative for the Pennsylvania Bar Association and Allegheny County Bar Association-Women in Law Division, Vice President of the Christian Legal Society and worked as a student-representative for the Barbri Bar Preparation Company. She was a three-year Merit Scholarship recipient for high levels of achievement. Upon passing the bar exam, Emily practiced as an Associate Attorney in the Civil Litigation and Employment law sections of Leech Tishman Fuscaldo & Lampl, LLC, the 13th largest law firm in the City of Pittsburgh. She also worked with the firm’s legal cannabis team in preparing applications for individuals applying for Pennsylvania medical marijuana permits. In this episode, Agnieszka McPeak, Associate Professor of Law at Duquesne University School of Law, discusses her article "Disappearing Data," which was published in the Wisconsin Law Review. McPeak describes the civil discovery process, which imposes certain obligations on parties to civil actions to preserve and produce documents and other data to opposing parties. She observes that the trend toward application that produce "ephemeral data" and the concept of "privacy by design" are in tension with the traditional expectations of civil discovery. And she argues that courts should take a fact-specific approach to evaluating how to resolve that tension. In this episode, Ann Schiavone, Assistant Professor of Law at Duquesne University School of Law, discusses her article "K-9 Catch-22: The Impossible Dilemma of Using Police Dogs in Apprehension of Suspects," which will appear in the University of Pittsburg Law Review. Schiavone discusses the history of the use of K-9 units by police forces, particularly in relation to the apprehension of suspects. She describes the standards used by courts in evaluating whether the use of a dog to apprehend a suspect is reasonable, and argues that courts should encourage officers to attempt to de-escalate before using a dog. Hazel completed her Bachelor of Pharmacy from Duquesne University in 1979. Donna has held many positions with Rite Aid Corporation and currently is a Regional Recruiter. She has been a member of PPA since 2005 when she moved back to Pittsburgh. She is a previous President and Chair of the Allegheny County Association. Hazel completed her Bachelor of Pharmacy from Duquesne University in 1979. Donna has held many positions with Rite Aid Corporation and currently is a Regional Recruiter. She has been a member of PPA since 2005 when she moved back to Pittsburgh. She is a previous President and Chair of the Allegheny County Association. Previously she served as Southwest Director of PPA.
