As a legal nurse consultant, when you go through medical records, you may see indications that an ethics consult was called or that ethical issues were considered. You may also find yourself struggling with aspects of the decisions made regarding the patient and feel the need of advice from an expert in medical ethics. Camille Renella opens the door to this little-understood aspect of medicine. She begins by pointing out that ethics has lower regard than the law in terms of application simply because legal violations generate so many more repercussions. At an earlier time, doctors and administrative personnel didn't even want to deal with issues like setting up ethics committees in their institutions. Today no formal qualifications exist for sitting on such a committee. In contrast, medical ethicists receive formal, usually post-doctoral, education in their field. They look at those who are working around the patient and consider the standard of care and code of ethics of each group of practitioners and how their application of these values can benefit the patient. The need for a clinical medical ethicist particularly arises in continuation of life issues. This can involve conflicts between family members and clinical staff, issues around advanced directives, and other considerations. Camille raises important ethical and practical issues in this informative podcast. It will broaden your perspective about what is involved in medical decisions. Join me in this episode of Ethical Dilemmas in Healthcare: Insights from a Medical Ethicist with Camille Renella What does a medical ethicist do? What are the requirements for sitting on an ethics committee? How do issues of life support get involved with ethics? How do hospital and medical costs impact ethics decisions? We have increasing awareness of the multiple deficiencies in the U.S. medical system, particularly in hospitals. Here with an inside look at efforts to solve this, is Dianna Goodwin, a registered nurse with 28 years of varied experience. Speaking as a manager, she shares her experience in providing the best possible support for nurses in terms of training on all levels. Dianna emphasizes the importance of having a mix of new and experienced nurses. New nurses need mentoring, and too many in need of this assistance place a burden on available resources. Nurses especially need training in high-risk, low-frequency procedures, which can occur in any area of the hospital. Dianne explains that any nurse who hasn't done such procedures in a long time may need supervision. Dianne pays particular attention to the need for nurses to understand the chain of command and how to work within it when they feel a doctor has given them an inappropriate instruction. She illustrates this principle with a detailed and fascinating story about an incident where she had to intervene to support a nurse who needed to challenge a doctor's instruction. LNCs and clinical nurses alike will appreciate this opportunity from the point of both professional conduct and the liability issues that arise with incorrect instructions. Join me in this episode of Nursing administration risks Dianna Goodwin Why is staffing currently such a big problem in hospitals? What challenges are involved in hiring new nursing graduates? What is a high-risk, low-frequency situation? How do issues of liability play into the necessity for thorough training of new nurses? How can a nurse effectively challenge a doctor's order that sounds wrong? Nena was able to grow the census in her own region from 700 to over 1500 patients and opened 10 denovo locations, all in under 3 years. She is a certified ACHC and CHAP accreditation consultant in Home Care, Palliative Care, Hospice, and Home Health. As the area vice president of operations, she led her region to the largest single-parent provider survey in the nation at that time. She is a Certified Lean Healthcare Professional (CLHP) and is the Owner of Hart Healthcare Solutions, which helps post-acute care organizations take back the operational health of their organization, improve efficiency, stop the vicious cycle of critical staffing, enhance survey outcomes, and ultimately improve patient care. She worked her way up the corporate ladder for over 10 years and was finally recruited to her "dream job" as a CEO in Hawaii, only to be fired five weeks later. Left with a huge new lease and no income, she started her own consulting and coaching company, working from home, matching her CEO salary in half the hours, in her leggings. “Work culture is really how people work together. But in my opinion, there are three major components: it's the employer, it's the leadership, and it's the staff—all staff, we're not only talking nurses. We know that it takes a village to really make clinical care happen. All three of those components are critical in creating a healthy work environment. The staff component, including the clinical nurses, is key to that,” Linda Laskowski-Jones, MS, APRN, ACNS-BC, CEN, NEA-BC, FAWM, FAAN, editor-in-chief of Nursing 2022: The Peer-Reviewed Journal of Clinical Excellence, told Jaime Weimer, MSN, RN, AGCNS-BC, AOCNS®, oncology clinical specialist at ONS. But in my opinion, there are three major components: it's the employer, it's the leadership, and it's the staff—all staff, we're not only talking nurses. We know that it takes a village to really make clinical care happen. All three of those components are critical in creating a healthy work environment. The staff component, including the clinical nurses, is key to that. When you look at how the nurses work together and the environment that they are working in, their teamwork, camaraderie, and connections to each other can actually help those staff make it through when perhaps there may be some challenges with employers or leaders as they work through whatever changes they need to make.” Timestamp (TS) 04:12 “It's important to recognize that when you motivate and influence people, whether it's positively or negatively, you're behaving as a leader. There may be people who have some personal need to feel like they can be the judge of others and that they have a very tight group, and unless you're looked at favorably by that group, then you don't have value. So, in this particular type of case, you can have a nursing leader show all the value in the world to that staff, but if you have these cliques where people come in and they feel like, ‘Oh my gosh, I'm working with so-and-so on this particular shift.' Or ‘I've been assigned to this shift permanently. How will I survive?,' that is a big driver of turnover.” TS 10:40 “Watching someone working with a family or a patient, and when the person comes out when they least expect it, saying something like, ‘That was really an amazing interaction, and a very tough situation, and you handled that beautifully.' That can go a long way, and it's all part of value and recognition. . . . Let's show value where value needs to be shown.” TS 21:24 “That value is a 360-degree type of value where really everyone that you're working with in the physician-nurse relationship is critical. Recognizing the role that nurses play and looking at the nurses as colleagues is absolutely critical.” TS 22:56 “Right now, in many places still across the country, nurses feel that they don't have the tools they need to do their job. That of course leads to this negative culture where nurses are very upset, they're coming in extremely unhappy, and they're communicating that unhappiness to everybody, and they have very real concerns. And management has taken different approaches to that, in health or not health as the case may be, and now we have to focus on: How do we fix it? And I think those are the factors that led to where we are. We have a lot of work to do, but at the same time, organizations have to also make fundamental changes.” TS 26:45 “Ultimately, I don't think people on the front line realize how much power they actually have. And the power is in creating effective working relationships, and that includes the nurse-patient interaction, but it also includes working with people.” TS 39:15

Dr. Jennifer Ducko has been sharing her passion for nursing for nearly 40 years. She is a graduate of the Florence Nightingale school of nursing in London, England, and received her Masters of Science in Nursing Administration from Walden University and her Doctor of Nursing Practice from Aspen University. In this episode,  we discuss her journey and the transformational nature of the doctoral degree. Highlights:1.    Even if you are great at what you do, formal education can significantly and positively impact you and your work.2.    Adopt an open mindset when considering a doctoral program – Is it possible that you just don't know what you don't know?3.    Do your research! Make sure your program fits your long-term goals.4.    If you let it, formal education can transform you on a personal level – why not get as much out of the experience as you can and use it as a mechanism to go from GOOD to GREAT!5.    Support is critical – you will need a tribe (see episode: https://www.buzzsprout.com/1547113/9727132 and https://www.buzzsprout.com/1547113/8234175) 6.    Breaks can be a good thing – know yourself and do what you need to take care of YOU! (and listen to: https://www.buzzsprout.com/1547113/6988105)7.    Communication is imperative – if something seems off or isn't going as planned communicate this to your faculty. 8.    You must be able to advocate for yourself – a doctoral program often presents with unique challenges, and you must be able to advocate for yourself, when needed.9.    Know your WHY and keep your eyes on the prize. This is a marathon, not a sprint. If your why changes and it's in your best interest to stop your program, listen to this episode: https://www.buzzsprout.com/1547113/8016142.10. As an LNC, you may have encountered the medical/legal issues that arise when a hospital's chain of command and also nursing administration isn't clearly defined. These problems can especially affect a nurse who sees a problem with a medical or pharmaceutical order or with a patient's condition and is unable to get anyone to address the situation. For these and other reasons, nursing administration can be of tremendous assistance to an attorney trying to discern where a breakdown may have occurred that caused a potential malpractice issue. Lisa Ortega, experienced nursing administrator and LNC, shares these and other issues that can cause issues that are dangerous and may lead to liability. A key issue in these pandemic times has to do with rises in drug abuse, domestic violence, and mental health conditions. Patients with psychiatric conditions have been increasingly injuring nurses. This danger causes the need for extra alertness on the part of hospital personnel. Another medical liability issue has to do with the degree to which those in personnel check the employment records of staff. Lisa cites frequent job changes—or in the case of traveling nurses—agency changes as red-flag situations. She advocates that hospitals run the most thorough checks possible before hiring new employees. She also strongly urges that drug supplies be checked carefully. Both LNCs and those in supervisory and administrative positions in hospitals will find Lisa's podcast an invaluable source of information. https://youtu.be/HhDejC7x_EY Join me in this episode of Legal Nurse Podcast to hear how nursing administration can be of tremendous assistance to an attorney trying to discern where a breakdown may have occurred. Gerri shares a story of pregnancy loss while working on a labor and delivery unit. This episode features a poem by Walt Whitman entitled Whispers of Heavenly Death WHISPERS of heavenly death murmur'd I hear, Labial gossip of night, sibilant chorals, Footsteps gently ascending, mystical breezes wafted soft and low, Ripples of unseen rivers, tides of a current flowing, forever flowing, (Or is it the plashing of tears? the measureless waters of human tears?) I see, just see skyward, great cloud-masses, Mournfully slowly they roll, silently swelling and mixing, With at times a half-dimm'd sadden'd far-off star, Appearing and disappearing. (Some parturition rather, some solemn immortal birth; On the frontiers to eyes impenetrable, Some soul is passing over.) Gerri Sainte is a board-certified RN with over 20 years of nursing experience. She is a lifelong North Dakota native, and has 3 children and 5 grandchildren.Advance care planning definition: formerly known as healthcare directive. Process of defining your goals and wishes for healthcare, especially if you’re unable to make those wishes known at some time in the future.Barriers include- Good health (feeling it doesn’t apply)- Feeling their families already know wishes- Misconception that it’s only for elderly- Fear of facing mortality- Mistrust of others’ ability to follow directiveSteps of completing an advance care directive- Who do you want as an agent to speak on your behalf?- Document your wishes- Communicate with your family about your wishes so they can advocate for you- Communicate with your PCP about your wishes. Your PCP can help maintain perspective and advocate for youIt’s important and can be helpful to think about how you want the end of your life to look.Questions in advance care planning can include:Where you want to die and how you would want that to lookWhat matters most to you? What makes life worth living?Specific medical treatments that you would or would not want (including cost of certain treatments) - CPR, artificial nutrition, respiration, etcBurial vs cremation vs donationOrgan donationAutopsyOnce completed, advance care plans should be updated every 10 years or sooner if there are other major changes in health (new diagnoses, decline in health, death or change in the agent)End of life can be a beautiful experience rather than something to fear.Consults can be arranged with an advance care planning team.
