THREE ESTATE PLANNING MISTAKES

JOHANNA DAVID, Adjunct Faculty Member at Hofstra Law School is with us to talk about three estate planning mistakes and how to avoid them. Johanna is a Trusts and Estates lawyer, and a partner at Forchelli, Deegan, and Terrana. She's also the adjunct professor of law at Hofstra University. We're going to talk a little bit about mistakes that we see in estate planning and the simple things you can do to keep them away from your situation. Enjoy. https://youtu.be/gD_d9J609Vg Three Estate Planning Mistakes Chapters 00:00 The Importance of Estate Planning09:47 Common Mistakes in Estate Planning19:54 Understanding Trusts and Their Benefits24:00 Navigating Elder Care and Estate Planning Outline of "Three Estate Planning Mistakes" Frazer Rice (00:01)Welcome aboard, Joanna. Johanna C. David (00:03) -Three Difficult Planning Stories and What Can We Learn? Hi, thank you. Thank you so much for having me. I appreciate it. Frazer Rice (00:06)Well, happy to have you on because we are now, most people sort of put their estate planning off toward the end of the year, but I have a feeling given where the legislation is going, et cetera, that the crush is going to happen earlier than we think. In the meantime, you and I were talking beforehand about some mistakes that people make from an estate planning perspective and that they're very avoidable. I thought we'd take this opportunity to go into that a little bit. In your practice, maybe let's start with a couple of, or sort of the big ones that you see, ⁓ give us some ideas of some mistakes that people make that really should be avoidable. https://open.spotify.com/episode/57MMskGgp1P3fOVklGt090?si=ISap3Z_YSdqK_zg4-Dlevw Johanna C. David (00:48) - Structure and Other Planning Tactics Sure, absolutely. So the number one mistake that I think that people make is not having the proper estate planning documents. I see this happen time and time again. I don't know if it's because of the stigma. People are afraid to approach estate planning, right? Sometimes it makes your mortality very real. But the biggest estate planning mistake is not having the right documents. Everyone, everyone, I cannot stress, everyone needs to have at least a will, a power of attorney, and a healthcare proxy. And there are people that say, well, you know, I don't really have much, I don't need to do that, or ⁓ everything's gonna go directly to my husband and my children anyway. You know, that's how it works. But that's not exactly the case, right? You and I both know. So, especially if you have young children, young couples definitely want to have those things in place. You want to think about who is going to be the guardian for your child or your children if both of you pass away. And a lot of people don't think about that. And those only cause problems in the long run. I'll give you a quick example if we have time. But ⁓ Frazer Rice (02:02)⁓ please do. Johanna C. David (02:03) - Long Term Planning Issues and Avoiding Problems I remember, this was several years ago. I must have just started practicing and I had been a young attorney. So it was about 15 years ago and a woman came into the office and she and the decedent had been living together for about 30 years. They held themselves out to be married. Now, Frazer, you and I both know that New York does not recognize common law marriage. Frazer Rice (02:30)This is true. Johanna C. David (02:32) - Correcting a Big Will Mistake She was not aware of that. And so they were married for 30 years. Everything was in his name or excuse me, they were not married. They were together for 30 years, held themselves out to be married, not legally married. He owned the co-op apartment. Everything was in his name. Now he had a daughter from a previous marriage, legal marriage that was a strange. And you guessed it, our client did not get along with the daughter. So the father dies and guess who inherits the co-op that ...

In this episode of the First Day Podcast, host Bill Stanczykiewicz, Ed.D. is joined by Anna Pruitt, Managing Editor for Giving USA and Adjunct Faculty Member from the Indiana University Lilly Family School of Philanthropy. They discuss the 2023 findings from the Giving USA report. The total charitable giving in the United States reached a record high of $557 billion in current dollars, showcasing a 2% increase from the previous year. However, when adjusted for inflation, there was a slight decline, highlighting the impact of economic factors on philanthropic trends. The breakdown of charitable sources revealed a significant milestone as foundations surpassed $100 billion in donations for the second consecutive year, representing a steady increase in their share of total giving. Despite this growth, individual giving, which remains the largest segment at $374 billion, saw fluctuations influenced by economic conditions and personal income levels. Corporate giving also showed resilience, closely tied to GDP growth and corporate profits, although it did not keep pace with inflation-adjusted terms. Among the nine sub-sectors of charitable recipients, seven sectors experienced growth even after adjusting for inflation, with notable increases in areas linked to stock market performance and high-net-worth giving. Looking back at multi-year trends, the data indicated that charitable giving in 2023 surpassed pre-pandemic levels, reflecting ongoing support despite global uncertainties. The episode underscored the importance of strategic fundraising planning based on these insights, emphasizing the role of Giving USA data in guiding nonprofit strategies for donor engagement and sustainability.

The Inquiry
Can Mexico win its battle with US gun companies?

The Inquiry

The Mexican government has won its appeal to bring a civil lawsuit against a number of American gun companies. Mexico, which has extremely restrictive gun laws, claims that the ‘deliberate' business practices of these US firms results in the illegal flow of firearms into Mexico, contributing to the gun crime violence in the country. They are now seeking as much as ten billion dollars in compensation. The gun companies, which include some of America's oldest established names in the firearms business, deny any wrongdoing. Since 2005, these companies have being granted immunity from prosecution under the ‘Protection of Lawful Commerce in Arms Act'. This law protects the firearms manufacturers and dealers from being held liable when crimes have been committed with their products. But Mexico's argument is that PLCAA, as it's also known, only applies within the United States and therefore doesn't protect the companies from liability. It's a case which is also resonating with other Latin American countries who have been impacted by illegal gun trafficking from the United States. Some of these countries have supported Mexico's claims in the courts. And they will be watching closely to see if Mexico's lawsuit, the first by a sovereign state, can set a precedent. So on this week's Inquiry, we're asking ‘Can Mexico win its battle with US gun companies?'Contributors: Ioan Grillo, journalist and author focusing on Organised Crime, Mexico Adam Winkler, Cornell Professor of Law, UCLA School of Law, California, USA Robert Spitzer, Distinguished Service Professor Emeritus of Political Science, SUNY Cortland; Adjunct Faculty Member, College of William and Mary School of Law, USA Dr. León Castellanos-Jankiewicz, Senior Researcher, Asser Institute for International and European Law; Academic Supervisor, International Law Clinic on Access to Justice for Gun Violence, University of Amsterdam, The Netherlands. One of the things that's on the verge of excitement and annoyance for me is the way that Artificial Intelligence work has all kind of converged around deep learning. Deep learning is amazing and super powerful, and we've gotten a lot out of it, but what it has done is, both attracted a lot of people to Artificial Intelligence, but also, steered all the research efforts away from other approaches into deep learning. And you could say that makes some sense, because for a long time, we weren't making a lot of advancement with these other approaches. But the truth is, most of the advancement in artificial intelligence really comes from the growth in computation and our ability to wrangle a lot of computation. If you took that same approach, with other algorithms, you may well get interesting results. If you could apply as much computation to them, the way we have for the large language models. And so what really excites me is when I find people who are working on other approaches to artificial intelligence. My buddy, Dr. Ryad Benosman, has been working on different approaches to processing data for a long time, primarily in vision. And his worldview is highly neuromorphic. It's about trying to understand. What is the brain doing with this data? How do I get a computer to do the things that the brain would do? And that's hard because we don't know exactly what a brain does, but one of the things we know is the way that eyeballs incorporate the signal that they get, and then try to turn that into something that the brain can put to use and that's It's obviously not done the way that deep learning works. A lot of what Ryad has worked on has been time series machine learning, those are my words, not his, but basically what it means is, trying to process this data in real time in the order that you receive it and piece together, something meaningful. That's very applicable to computer vision. I think Ryad has been responsible for spinning about four companies out of labs, to develop these technologies. Probably the most well-known is called, the Prophesee Camera, which, they developed and then sold to Sony. This is a camera is an event camera. Instead of just taking frames 30 times a second, aggregating all the signal on every pixel and sticking it into a frame, what an event camera can do is look at the signal that's changing in any pixel , in the sensor, and this is very important for things like sensor fusion going forward. The work he's done on algorithms to make that possible is super exciting. Ryad was a professor in France for a long time. Most recently in Pittsburgh and at Carnegie Mellon. He's been all over the place, on skunkworks at Meta, and now is doing exciting things we can't talk about, but look, most people never get a chance to hang out with Ryad. I'm so thrilled that I got to, get him on the podcast and share him with you. Important Links Prophesee UPMC Carnegie Mellon University RD About Chris Young Dr. Ryad Benosman is professor of Ophthalmology in the University of Pittsburgh School of Medicine. He is also an Adjunct Faculty Member in the Robotics Institute of Carnegie Mellon University. Prior to this appointment, Dr. Benosman was a full professor at Université Pierre et Marie Curie, Institut de la Vision, in France. He is curently Director of Research at Meta (Neuromorphic and Event based Sensing and Computation) He has worked on Event-based (Neuromorphic) Sensing and Computation, applied to develop novel Brain Inspired Machine Learning. His lab used to be the home of the event-based neuromorphic silicon retina ATIS and several other neuromorphic AI related platforms. "The fact that music is so important for our constitution - that music is almost how we move in the world, that our own bodies are played through by musical forms, that the way we relate to our own way of being in the world is sort of mediated by music - this is powerful stuff. But it's not always very fitting to us. We hear a lot of music in our lives, we don't always choose what we hear. We don't choose our analyst's musicality, we don't first check what kind of musicality an analyst has. We are bombarded by music; music can be imposed upon us, it can make us feel within ourselves in a way that doesn't feel right to us. There is a lot of complexity here as we think about this matter of music being so central to us. But we can find the music that works for us, but we don't create the music. It belongs to the realm of collective cultural life. There is a lot of struggle in music, and in the analytic setting there is a lot of struggle - because for many patients a lot of the work rests on whether there can be any shared sensory experience or not.”     Episode Description: We begin with recognizing that the process of human musicalization begins in utero and forms the basis of much of psycho-somatic-social life. Peter, Michael and Adam's written collaboration, Here I'm Alive - The Spirit of Music in Psychoanalysis is intended to be a musical book about psychoanalysis - a representation of how music binds us to the individual and cultural domains of life. We discuss rhythmizing consciousness, atavistic vs enhancing music, and the blues as a companion soundtrack for loss and tribulation. We take up the relationship between Freud's dream book and his joke book, how present analytic melodies contain aspects of the past, and how dissociation requires a remusicalization of the psychoanalytic situation. We close with Adam reading a paragraph which includes "The capacity of the sexual drive to propel the body back into musical movement and transmute the seizure of trauma into conducted energy to ground the current."   Our Guests:   Peter Goldberg, Ph.D., is a Personal and Supervising Analyst at the Psychoanalytic Institute of Northern California, Chair of Faculty at the San Francisco Center for Psychoanalysis, and on the faculty of the Wright Institute in Berkeley. He has presented widely and written on a range of clinical and theoretical topics, including the evolution of clinical theory in psychoanalysis, sensory experience in analysis, the concept of the analytic frame, the theory and treatment of dissociative states, non-representational states; and the impact of social trauma on individual psychology. He is in private practice in Albany, CA.   Michael Levin, Psy.D. is a Training Analyst and Faculty Member at the San Francisco Center for Psychoanalysis. He has taught and presented on topics including the work of Laplanche, phenomenology, and psychoanalysis, and the place of psychoanalysis in cultural and intellectual history. He is in private practice in San Francisco.   Adam Blum, Psy.D. is an Adjunct Faculty Member at the San Francisco Center for Psychoanalysis. To learn how he continues to find happiness in life, listen to Episode 460 of The Best Practices Show! Main Takeaways: Find your core values and essentials of your life. Surround yourself with the people you love. Keep your mind and your body sharp. Balance time, money, and health. Don't be limited by your thinking. Embrace the struggle. Stay humble. Quotes: “It's all about your perspective on things. Your positive outlook creates positive results.” (5:40—5:45) “It's important, for anybody listening, to find fulfillment in their life.” (6:47—6:50) “Everyone strives for happiness right now. And it seems like it's a constant theme of, ‘I'm not happy with my job. I'm not happy with my life. I'm not happy with my marriage. I'm not happy with my kids,' whatever it is. Well, you can control that. Dictate it. And ultimately, what it comes down to is, if you can identify, ‘These are the things that make me happy,' then do it.” (7:13—7:30) “A person is limited only to the thoughts he or she chooses.” (12:05—12:09) “I think dentistry can spin you to [negativity] so quickly. You have a bad patient experience, bad patient, things didn't go that well in the operative realm of things, or whatever it may be, and you start being like, ‘I'm tired. I'm tired. I'm tired. I'm done. I don't want to do this anymore,' and you start getting negative. But then, those negative thoughts turn into negative outcomes. And negative experiences shape everything about your environment. And to me, I'm just like, ‘I'm done. I am done with negative thinking.' As a Man Thinketh [says] the power of your thoughts shapes you. And I said, ‘No more of these negative thoughts. Positive thinking only.' And I've had the best couple weeks now.” (12:23—12:59) “I control the things around me. Enough of the external life scenarios dictating what I am and who I am. It's all about what I do based on my thoughts. And those thoughts drive the results that come out of the chair, come out of my life, come out of my experiences with people, my relationship with others. I come home happier because I am the one that's in control of my life. You push positive thoughts, and you're going to have positive results.” (13:01—13:27) “You don't want to die with a bunch of money in the bank, because you then become something that, ‘I worked for this much time. And this much energy I put into this, and it didn't relate to anything at the end of it all because I wasted five, 10, 20 years of my life, because it just sat in a bank account when I'm in a coffin in the ground.'” (15:22—15:41) “There are three things in life. You have time, money, and health. And in each segment of life, you have a deficiency. So, when you're in your 20s or so, you have your health and you have time, but you have no money. And then, in your middle life, you have your health, hopefully, you have your money, hopefully, but you don't have time because we're running around like crazy, taking care of family. But then, when we retire, you have your time, you have money, but you don't have health, necessarily. So, ultimately, the whole secret of life is trying to navigate the deficiency.” (17:15—17:51) “In our phase of life, time is our most valuable possession we can have. So, why am I wasting time at work doing things that aren't allowing me to fulfill my time with my family? Cut the hours, cut the days.” (18:03—18:16) “The other thing is that we've got to take care of ourselves. Because if you take care of yourselves at an early age, it's going to delay the health component later on in...

A Just Energy Transition for Africa

This episode discusses the challenges associated with the transition to a net-zero future in Africa. Presently, more than 600 million people across the continent lack access to electricity, and many African countries are reliant on fossil fuels for economic development. At the same time, Africa only accounts for 2-3% of global carbon emissions. This reality means that the transition to a cleaner economy may impose an acute burden on people living in Africa.  Our host, Ujunwa Ojemeni, is joined by Professor Sir Dieter Helm of the University of Oxford and Fatma Lucy Nyambura of the Extractive Industries Transparency Initiative to discuss how to ensure this energy transition is inclusive and just for all Africans.  Professor Helm is a Professor of Economic Policy at the University of Oxford, a Fellow in Economics at New College, and an Adjunct Faculty Member at the Blavatnik School of Government. Previously, Professor Helm was a member of the Economics Advisory Group to the British Secretary of State for Energy and Climate Change and is the author of acclaimed books The Carbon Crunch (2012) and Natural Capital: Valuing The Planet (2016), Burn Out (2017), and Net Zero (2021), among others.  Fatma Lucy Nyambura is a Policy Officer at the Extractive Industries Transparency Initiative (EITI), focusing on commodity trading and state-owned enterprises transparency. Her work entails development and implementation of policies to increase the disclosure of oil, gas, and minerals sales and purchases. Prior to joining the EITI, Nyambura worked in development consulting in Ghana, Georgia, Liberia, Kenya, Rwanda, Sierra Leone, Somalia, Uganda, Zambia, and Zimbabwe. Nyambura is an Advocate of the High Court of Kenya and a Certified Public Secretary.  This episode is hosted by Ujunwa Ojemeni and produced by Read Leask. It was the winter of 2019, life was going great, and 2020 was looking bright! After finishing his doctoral program, Deazell Johnson felt at the top of his game, ready to move into his first teaching experience and satisfied with the opportunities he had manifested. Then, life happened! The pandemic hit, and soon after, in a span of only two weeks, he lost two family members to non-COVID-related deaths. Deazell felt himself slipping back into a dark place he thought he had overcome; where financial, racial, & homophobic hardships left him anxious and depressed. At this point, feeling stuck inside all of this loss, Deazell's accomplishments didn't mean anything to him. Life was tough, it was difficult to manage his mind, he was going in circles, and making little progress. With 2021 right around the corner, Deazell decided it was time to make changes in his life. The following day, he discovered The Right Questions Podcast for the first time... That was the turning point! We are thrilled to bring servant leader Deazell Johnson Ed.D to the show; he is an Adjunct Faculty Member at California State University, Northridge (CSUN), and California Lutheran University. Deazell is also an Academic Advisor & Mentor at California State University, Northridge. He holds a BA in Screenwriting, an MA in Educational Administration in Higher Education, and an EdD in Educational Leadership and Policy Studies from California State University, Northridge. In this episode, Deazell helps us answer today's question, How Do I Go From Ideas to Action? We talk about intersectionality, the power of habits, consistency, self-value, and the importance of being open-minded and receptive to people's thoughts and guidance. Deazell also talks about his identity, his experiences with intersectionality as a queer black male, and the pressure of finding a role model. The way Deazell has absorbed, repurposed, and consistently applied our content and suggestions to improve his mind and life has been deeply moving for us to hear about. His story is uniquely inspiring and demonstrates, in concrete ways, how to take our ideas and put them into action. Deazell provides so much raw honesty and value, this episode is definitely a must-listen! In fact, behind phishing, it is most often ranked as one of the top cybersecurity challenges by CISOs and CIOs. According to PwC's Audit Committee Update on Insider Threat, 44 percent of data breaches are attributable to insiders and 80 percent of attacks are committed during work hours on company-issued software. Insider threats can impact a company's operational capabilities, cause significant financial damages, and harm brand equity. The mean cost of a cybersecurity breach involving employees or others within an organization is $8.7 million, according to a Ponemon Institute report, “2018 Cost of Insider Threats: Global”. Some insider breaches are intentional and some are non-malicious, just the result of negligence. There have been a variety of recent malicious incidents that have included employees stealing hard drives of data, leaking information, and even inserting malware into networks.
