We didn't notice the problem for several weeks, which delayed payments and almost caused us to have to dip into our savings account so we had money to operate. It was a good reminder that in business invoicing clients and staying on top of your receivables is extremely important. So here you go, I hope you like it. Vanuit de camper namen we volledig ontstaan uit flow weer een nieuwe podcastaflevering op. Het begon over onze shoot van gisteren en hoe we precies de visagiste en fotograaf aantrokken die klopten, waarna we verder gingen over hoe mam vaak dromen heeft die werkelijkheid worden (onder andere over mijn bevalling), en we eindigden over de betekenis van woorden als 'egoïstisch' en 'eigenwijs'. Ik introduceer een nieuw woord voor in het woordenboek: LiefdeCentrisch.

Her var cirka 200 borgere og en god portion byrådspolitikere fra Skanderborg Kommune mødt op for at takke nej til den linjeføring af motortrafikvej A26 - også kendt som Viborgvej - der er udset til at gå syd om Lading Sø.Vejret var fantastisk, og det var arrangementet også. Landsbyrådet stod bag demonstrationen, som de på mindre end en uge har fået planlagt og realiseret. Aljosja Beije is co-founder of BlockLab of the Port of Rotterdam, and in the lead for the 2Tokens use case EBL. We see the digitization of the Bill of Lading as an important step towards making ports around the world, safer, faster, more efficient and sustainable. We are therefore actively reaching out to carriers, shippers, banks and logistics service providers in the Netherlands and beyond, to work with them on setting an open standard for transfer of title. The e-BL project envisions the creation of a secure environment in which the first legally binding, interoperable, paperless transfer of ownership of an EBL can be conducted on live shipments. TradeTrust allows for the creation of assets wrapped in a token, which can therefore be owned by an entity. On the 8th of September (4pm - 6pm CEST/UTC+2), 2Tokens, together with Blocklab and the InterWork Alliance, will host a webinar on the use-case Electronic Bill-of-Lading (EBL).

En gremio logístico el Agente de Carga es el prestador de servicios especializados que, actuando como tercero entre el usuario y el transportista, desarrolla y coordina actividades logísticas para la transportación de mercancías de un punto a otro. Los medios de transporte utilizados para el movimiento de mercancía a diversos puntos geográficos principalmente son avión, barco, camión y ferrocarril. Sin embargo, durante la operatividad diaria pueden existir problemas en la transportación y flujo físico de las mercancías, generándose gastos extraordinarios para el Agente de Carga o cliente. Un costo extraordinario o adicional que es muy frecuente en el gremio son las DEMORAS, que es el cobro que realizan las navieras por el tiempo en exceso del uso del contenedor para amortizar el daño generado por la falta de entrega oportuna. Incluso se podría considerar una práctica de cobro abusiva y lucrativa que realizan las navieras por los retrasos en las entregas de contenedores. Es válido cuestionarse siendo Agente de Carga, si son procedentes los cobros por demoras o bien se deberán poner en disputa con la naviera. A continuación, se ejemplifica y se plantea un caso improcedente de cobro de demoras: · El Agente de Carga solicita a la naviera la prestación de servicio multimodal bajo un servicio DOOR-CY. · Es una operación de exportación directa donde en el documento de transporte máster no figura el Agente de Carga, un servicio prestado por la naviera directo al shipper y consignatario, y por consiguiente sin una responsabilidad directa al Agente. Durante la aceptación y prestación de servicio, la naviera tiene conocimiento previo del bloqueo de las vías ferroviarias donde se transportará la mercancía para su llegada al puerto y posterior embarque. La situación del bloqueo no fue considerada por la naviera, sabiendo el riesgo y bajo su responsabilidad siguió con las debidas gestiones de toma de vacío, posicionamiento, carga a plataforma, fecha estimada de salida, llegada a terminal y embarque de la mercancía. El bloqueo de las vías ferroviarias ocasionó que las mercancías llegaran 20 días después a terminal y no se embarcaran en tiempo y forma, por lo consiguiente se generaron demoras que solicita la naviera sean pagadas. En primera instancia se recomienda analizar los términos y condiciones del documento de transporte y legislación aplicable de acuerdo con el modo de transporte, con la finalidad de interpretar los preceptos legales y verificar si existe alguna manera de defensa o improcedencia por el cobro de demoras. Para el planteamiento de este caso en específico, las cláusulas a verificar por mencionar algunas son: responsabilidad del transportista, límites de responsabilidad, suceso de fuerza mayor, legislación aplicable en caso de alguna controversia con la naviera, entre otras. Asimismo, es importante considerar y tomar en cuenta para una respuesta justificada a la naviera los siguientes puntos: · El Master Bill of Lading es directo, por lo cual la responsabilidad de pago en caso de un presunto cobro de demoras de la naviera deberá ser notificado al shipper/consignatario del documento de transporte, responsable directo y a quien se le prestó el servicio de transportación. · Es una operación multimodal efectuada por la naviera y un servicio ofertado Door-CY, por lo que dicho servicio comprende desde la toma de los vacíos, posicionamiento, ingreso, transportación terrestre por ferrocarril hasta el flete marítimo. · El bloqueo de las vías ferroviarias es un asunto de fuerza mayor, una causal de incumplimiento de las obligaciones debido a acontecimientos imprevisibles e irresistibles que impiden llevar algo a cabo. Un apego al precepto legal “A lo imposible, nadie está obligado” · La naviera tuvo conocimiento del bloqueo de las vías de transportación terrestre, con posibilidad de rescindir el contrato y aun así bajo su responsabilidad siguió con el contrato de transporte y embarque de la mercancía. Con estas consideraciones se podría indicar a la naviera la improcedencia y disputa de las demoras, bajo los argumentos de no responsabilidad directa del Agente de Carga al no intervenir de ninguna manera en la contratación ni en la asignación del transporte terrestre, y que dicho suceso es considerado un asunto de fuerza mayor y por consiguiente no existe la posibilidad de exigir el cumplimiento y obligación de pago por las demoras Finalmente, con base en los criterios señalados y al ser una operación directa, el Agente de Carga en México se apega a las Condiciones Estándares de Comercio STC, por lo que puede trasmitir su responsabilidad al cliente; ya que el cliente será el único responsable por todos los gastos en que se incurra ya sea por multas, demoras, almacenajes, daños, perjuicios y demás gastos que se generen.
