Seit 2006 gilt in Deutschland ein damals für revolutionär gehaltenes Prinzip: Jeder Mensch darf beim Staat Informationen anfordern, ohne dafür einen bestimmten Grund nennen zu müssen. Das Informationsfreiheitsgesetz (IFG) drehte die alte Logik des Amtsgeheimnisses um. Nun plant die schwarz-rote Koalition, dieses Recht drastisch einzuschränken. In Episode 164 des c't-Datenschutz-Podcasts diskutieren Holger und Joerg mit einem der prominentesten Kämpfer für Transparenz, was die Pläne bedeuten würden. Zu Gast ist Arne Semsrott, Projektleiter der Plattform "FragDenStaat" bei der Open Knowledge Foundation. Über das Portal wurden in 15 Jahren mehr als 330.000 Anfragen an Behörden gestellt und die Antworten unter Wahrung des Datenschutzes veröffentlicht. Skandale wie die Maskenaffäre von Jens Spahn oder Ungerimtheiten rund um die Plagiatsaffäre von Franziska Giffey kamen erst durch solche Anfragen ans Licht. Arne erinnert daran, dass das erste Informationsfreiheitsgesetz der Welt bereits 1766 in Schweden entstand und heute weltweit fast alle Staaten ein solches Recht kennen - in Europa fehlt es nur in Belarus. Genau dieses Recht steht nun zur Disposition. Die Koalition will den Kreis der Anspruchsberechtigten stark einschränken: Nur noch natürliche Personen mit einem "berechtigten Interesse" sollen Anfragen stellen dürfen, beschränkt auf in Deutschland lebende Deutsche und Unionsbürger. Damit fielen Organisationen wie FragDenStaat oder Verlage heraus. Auch Journalisten wären betroffen, wenn sie auf andere Auskunftsansprüche verwiesen werden. Arne, Holger und Joerg zeigen im Gespräch auf, dass das voraussetzungslose Recht auf Information damit ausgehöhlt würde. Wer sein Interesse offenlegen müsste, gefährdete als Journalist bereits seine Recherche. Hinzu kommen weitere geplante Einschränkungen: mehr Ausnahmetatbestände etwa mit Verweis auf Sicherheit und kritische Infrastruktur, das Schwärzen sämtlicher Mitarbeiternamen und die Abschaffung des Gebührendeckels von derzeit 500 Euro. Arne betont, dass für die vorgebrachten Begründungen jeder Beleg fehlt: Weder gebe es dokumentierte Fälle bedrohter Beamter noch Missbrauch durch ausländische Anfragen. Er vermutet, dass sich die Verantwortlichen schlicht eines lästigen Kontrollinstruments entledigen wollen. Als besonders brisant nennt er interne Pläne des Innenministeriums, der beziehungsweise bald dem Bundesdatenschutzbeauftragten die Zuständigkeit für Informationsfreiheit ganz zu entziehen. Trotz der ernüchternden Analyse endet die Episode kämpferisch. Holger und Joerg legen offen, dass sie eine Petition gegen die De-Facto-Beschneidung des IFG unterzeichnet haben. Diese Petition gegen die Pläne hat bereits rund 600.000 Unterschriften gesammelt und sorgt vor allem innerhalb der SPD für Unruhe. Arne ruft dazu auf, Abgeordnete freundlich, aber bestimmt anzusprechen, und sieht durchaus Chancen, das Vorhaben zu stoppen. Sein Fazit: Hier drohe ein Frontalangriff auf die Bürgerrechte. Und das gerade in Zeiten, in denen autoritäre Kräfte erstarken.
Fractional Fiction, for those of you new to the series, is a discipline as much as a name. Every novel in it grows from a small fraction of documented reality, real texts, real law, real science, real ground, and the fiction rises around that fraction without ever falsifying it. Each book carries exactly one invention, one thing that does not exist, and the notes in the back declare it openly so you always know where the ground ends. Everything else holds. The permits in this book are real permits. A treaty really was signed on the sand at Point No Point in 1855. The six words are the real six words. And the three sources this novel is built on are named in the back matter like load-bearing walls. The first is a real book from 1922 called The Wild Heart, eleven animal sketches of Puget Sound country by a writer named Emma-Lindsay Squier, with an introduction by Gene Stratton-Porter that carries an idea this novel takes as law: a wild thing that stops being afraid of us cannot go home. The second is the oldest family record in Greek literature, Hesiod's Theogony, a list of who was born to whom, in which every generation of gods, warned about its children, devours them, and is replaced anyway. And the third is Dante, read in the English Longfellow made in the years after his wife died, when translating the Inferno was the only room of his grief he could stand in. From Dante the book takes its shape, a teller walking a silent listener down through the rings, and it takes a plea. In the sixth canto, a shade stops the pilgrim and asks for the only afterlife that is real: when you are back in the sweet world, carry me into the minds of other people.

This is Part 12 in a series celebrating the 40th Anniversary of Harvard University Press' 1985 publication of Richard A. Epstein's "Takings: Private Property and the Power of Eminent Domain." We continue our celebration of this anniversary with a fair use and transformative reading, taking a close look at ch. 7 continuing in the same section which Richard calls ""Takings Prima Facia," which takes a look at selling Eagle feathers when mere possession is a crime, as well as rights to disposition in leasehold renewals. He titles chapter 7, "Rights of Disposition and Contract" because he's taking a look at what the judiciary often misses in the panoply of takings reached by the Eminent Domain Clause and the American constitutional order, how these things interact and hang together, ensconced as it is in the purpose of the Constitution. That moral purpose is the protection of individual liberty against claims by a simple majority in a democracy, or judicial or executive fiat, or by the government in any other way in a taking of private property. It's also a good reflection on nature of property per se, whether public or private. For governments are owners as well as takers of property. Today we discuss his chapter 7 from pp. 74 to the top of p. 80. At the end, this episode concludes with a Chaplain's corner, with a reading of Psalm 142 in the KJV and January 31st in Streams in the Desert (Cowman Publications, Lost Feliz Station Lost Angeles, Calif. 1925 original non-woke edition). Excellent stuff here. Excellent. Every college student should read this book. It's a superb introduction to the political philosophy of the American regime. Praise the Lord. Vik and I sat down to talk through 11th now that we've got most of the rules, even if points are still the missing piece. Dave is about 35 games in, while Vik is coming at it from the “read the rules, built lists, haven't played yet” angle.Short version: we're pretty positive. Not in a “GW nailed everything” way, but this is a much stronger launch state than we expected. It feels like there's already a real game here.1. Scoring feels very differentThe old 10th edition plan of “hold my expansion, deny yours, win on primary” doesn't really work the same way anymore.Because missions are asymmetric, throwing a unit away to deny points can also give your opponent points somewhere else. Games seem higher scoring overall, and pushing big differential feels harder unless you properly run someone over.2. Dispositions are a big win gameplay wiseThe disposition system feels like one of the best parts of the edition. It gives list building more texture again.Purge pushes you toward killing and aggression. Recon feels the most like normal 40k. Priority Assets seems solid for singles. Disruption is the one we're least sold on right now, because it often asks you to kill something and do actions, which can get awkward.That said, we don't think you should pick a bad detachment just because it has a better disposition. The detachment is still the main thing, but disposition definitely changes how you build the last part of your list.3. Hidden is better than expected (now that is 12" - go to ground)At first, 15" hidden didn't sound that impactful. But with Go to Ground bringing it to 12", it matters a lot more.It changes how units stage, how objectives are held, and how you force your opponent to come closer before they can interact. That's good.It doesn't solve everything though. Slow six-inch melee infantry still looks rough unless it has real delivery, advance and charge, miracle dice, ingress, transports, or some other trick.Move blocking has changed shapeOld-style move blocking is much weaker. You can't just put five models an inch in front of a tank and expect it to be stuck forever. Vehicles and monsters moving through infantry is a good change overall.But move blocking isn't gone. It's now more about:using 2" engagement range properlyblocking where models can enddenying access to terraintagging things awkwardlyusing the fight phase and pivot wellTwo-inch engagement range feels huge, and good players are going to get a lot out of it.Vehicles and transportsVehicles are better, but we don't think the edition is just “fast gun wins.” Cover matters, minus one to hit is strong, hidden matters, and shooting without ignore cover can feel rough.Transports are one of the areas we're less positive on. Base-to-base disembarking is a massive change (when destroyed), and losing a transport in the wrong place can expose the unit inside immediately. Drukhari especially feel like they need to relearn a lot of old staging patterns.OverallWe're genuinely impressed. There are still worries around slow melee, map balance, transports, and whatever points end up doing, but the foundation feels strong.Most factions seem to have something playable, games feel less deterministic, list building is more interesting, and universal terrain is a huge win.For a launch state, this is probably the best 40k has felt in a long time.
