Whether it be local elections or picking a new president, election season seems to always be lurking around the corner, so on today's episode we're unpacking what it means for 501(c)(3)s to remain nonpartisan and how these nonprofits can safely engage in several different types of advocacy during election season. Attorneys for this episode Monika Graham Melissa Marichal Zayas Sarah Efthymiou Remaining Nonpartisan: The rule is clear: 501(c)(3) organizations cannot engage in any activity or make statements that suggest support or opposition to political parties, candidates, or groups of candidates running for public office, including those not affiliated with a specific political party. However, the definition of what counts as "nonpartisan" remains somewhat unclear. The IRS uses a "facts and circumstances" test to determine whether a charity's communication and/or activity is truly nonpartisan or a disguised attempt to influence an election. The IRS considers whether the communication and/or activity: identifies candidates compares a candidate's position on issues important to the organization with the organization's positions on those same issues expresses approval or disapproval of a candidate's position or actions is delivered close to an election, references voting, focuses on issues that distinguish candidates is part of an ongoing series of communications independent of election timing or coincides with non-electoral events like legislative hearings on pending bills DO: Keep your focus on issues, not elections. Continue mission-related issue advocacy but avoid suggesting how people should vote. Educate voters. Provide nonpartisan facts, resources, and information about voting without mentioning or implying support for candidates or parties Host candidate forums or publish questionnaires: Invite all viable candidates and give each candidate an equal opportunity to participate Ensure questions are neutral, related to your charitable purpose, and cover a broad range of issues Share responses verbatim and without commentary Register voters and encourage turnout (GOTV) in a nonpartisan manner — serve everyone equally, regardless of political affiliation. Remember, there are special rules for private foundations Document everything. Keep records showing how you designed and implemented your activities to avoid partisanship. Develop a track record of similar advocacy in non-election years Train staff and volunteers they understand what's allowed and what's off-limits during election season Separate personal and organizational activities. Staff and board members may support candidates on their own time, but not using organizational resources (e.g., name, email, office space, social media) Engage in ballot measure advocacy but remember to track and report this activity as lobbying if expressing a view on the measure and trying to influence the vote Meet with the candidates, educate them about your organization's work, and try to influence their platforms, while ensuring that you provide the same or equivalent information to every candidate DON'T: Endorse, oppose, or rate candidates — directly or indirectly Use "code words" (e.g., "vote pro-life," "support progressive values," "throw out the incumbents") that imply candidate support or opposition Time issue advocacy communications to coincide with elections if the message could be seen as favoring one candidate's position. Publish or share candidate statements selectively or with commentary that signals approval or disapproval Use organization funds, staff time, or materials for any partisan campaign activity Let candidates use your events, publications, or platforms for campaign purposes. Hundreds of commuters rely on SEPTA, but it's been battling challenges at every turn. The transit agency faces a federal deadline to inspect its fleet of Regional Rail cars, which have repeatedly caught fire. The labor contract with its largest employees union has expired. And long-term funding needs are still unfilled by the state legislature. But Scott Sauer, general manager of SEPTA, tells host Trenae Nuri that the transit agency is “going to be okay.” Sauer explains the latest with the inspections, shares his plans for 2026 tourism, and offers a vision for the agency going forward. Speakers: Judge Sandra Engel retired from the bench in September of 2022. She served as a Bernalillo County Metropolitan Court Judge for over 16 years. She currently sits on the bench as a senior judge. She received her B.S. in Marketing from the University of Alabama and received her J.D. from the University of Alabama School of Law in 1993. After moving to New Mexico, she spent a few years in private practice handling both civil and criminal cases, acting as a guardian ad litem, CASA and respondent's attorney in child abuse cases. She was an Assistant City Attorney for the City of Rio Rancho, handling primarily DWI cases, and served as Assistant District Attorney for the Second Judicial District, Bernalillo County for 10 years prosecuting misdemeanor and felony cases.As a judge, she presided over a large misdemeanor criminal docket. In addition to the duties of her regular criminal docket, she also had been heavily involved in specialty courts. She created, implemented, and presided over the Community Veterans Court; a specialty treatment court designed to help effectuate treatment for Veterans coming through Metropolitan Court. She created and implemented the Courts to School Program where Defendants are sentenced in front of high school and college students with the purpose of educating and deterring the students from drinking and driving. She also served as Presiding Judge of the Domestic Violence Early Intervention Program (EIP). She served as presiding judge over the criminal division of the Metropolitan Court and served as chief judge as well, managing a C-Suite and staff of over 300 employees. In 2021, Judge Engel became an executive leadership coach, working with law students, judges, attorneys, and business leaders. She completed her coach training and received her certification from ICF as an Associate Certified Coach (ACC) and is currently pursuing her PCC. She has completed the Train the Trainer Program through the Justice Coaching Center and now trains and supports the implementation of coaching programs in judiciaries around the nation. She specializes in leadership/ performance coaching and transformational transition coaching. She regularly presents at legal conferences in the areas of leadership and well-being.Pamela Moore, LPCC, CCTP currently serves as a Licensed Professional Clinical Counselor, Certified Clinical Trauma Professional and Director of the State Bar of New Mexico's Legal Well Being Department where she educates the legal community on positive health and well-being and assists in providing resources and services to any legal professional struggling with mental, emotional or behavioral issues. Ms. Moore served as an advisory member to the National Commission on Lawyer Assistance Programs in 2019, 2020, and again in 2026 and is the current New Mexico representative for the Institute for Well Being In Law. Eduardo Ramirez is an Assistant Public Defender with the Law Offices of the Public Defender in the Hobbs Office. Eduardo joined the LOPD family in February of 2021 after relocating to New Mexico at the end of 2020. Eduardo earned his law school degree from the University of Colorado Law School, graduating in May 2019. He is the first in his family to not only graduate from college, but also law school. Since as far back as he can remember, Eduardo has always had a passion for helping individuals who are underprivileged and impoverished. Growing up in poverty himself, he saw many people struggle with the criminal justice system and just how important effective representation is. As an adult, Eduardo has learned the importance of self-care, to continue representing clients to the best of his ability. He helps with their criminal case but also makes efforts to better their lives. Eduardo is a zealous advocate, and his goal is to eventually rid the notion of a “public pretender.” Luckily, he has amazing mentorship and colleagues down in Hobbs who help him, and he would not be the attorney he is, without them! How long you rest between sets is an important factor to consider, as longer rest times often lead to better training results since you can perform more reps in each set at any given weight compared to shorter rests. But what if you compensate for shorter rest times by doing more sets, until you've reached the same number of reps you would have been able to hit with longer rest between your sets? Today, we're discussing a study that compared a traditional 2-minute rest between sets with resting for just 20 seconds, but doing additional sets until the participants had completed the same number of reps as the longer rest group.
