This distracted driving case marks the first time Amazon has tested with a jury the issue of whether the online retail and global logistics giant will be held responsible for injuries caused by one of its 285,000 Amazon Delivery Associates (drivers) it calls independent contractors. Yarborough Applegate attorneys David Yarborough, Alexandra Heaton, and William Applegate, working alongside Nick Clekis of the Clekis Law Firm in Charleston, represented a motorcyclist who sustained a traumatic brain injury and numerous orthopedic injuries in September 2021 when an Amazon Delivery Associate failed to yield to the right of way and turned left directly into his path. We filed suit against the driver, the local delivery company MJV Logistics, and Amazon, Amazon Services, and Amazon Logistics Inc. Source. David has collected jury verdicts and settlements totaling hundreds of millions of dollars for his catastrophically injured clients in cases involving bad faith against insurance companies; industrial plant injuries resulting in worker deaths; product liability from automobile rollovers and industrial machine injuries; toxic chemical spills by railroad companies; pool drownings; trucking and auto accidents; nursing home and daycare negligence; dram shop and alcohol liability negligence by bars and restaurants; and negligence by retail stores, energy companies, apartment complexes, hotels, and construction contractors for job-site, balcony collapse and premises injuries. He is a member of the Charleston Chapter of the American Board of Trial Advocates (ABOTA), the South Carolina Association of Justice, the American Association for Justice, the Charleston County Bar's Mental Wellness Committee, Lawyers Helping Lawyers, and the Board of Regents of TriCounty Family Ministries. Beyond having had numerous trial victories, he has also achieved two record-breaking verdicts, been recognized by his peers as one of the top litigators in the state, won numerous awards as a leader in the law, and has been consistently given Martindale-Hubbell's highest ranking as an AV lawyer. Beyond his experience and hard work, he is a passionate advocate for his clients, who are defined by determination and perseverance. William understands that his clients, many of whom find themselves in desperate situations following serious trauma, such as the death of a loved one or experiencing life-altering injuries, are relying on him, and he takes this responsibility personally. In 2014, William and his team represented 28-year-old paralyzed construction worker Hugo Hernandez against PEPCO (Potomac Energy and Power Company). After a two-week trial against PEPCO in Montgomery County, Maryland, the jury awarded Mr. Hernandez $35.9 million in damages in compensation for the overwhelming cost of Mr. Hernandez's future medical care as a young, C4 paraplegic as well as for his pain and suffering and loss of income. This was the largest verdict in Montgomery County history and was one of the largest verdicts in American history for an undocumented worker. In 2019, William represented an undocumented worker who was killed when electrocuted by a power line that was hidden by vegetation, which Dominion Energy had failed to maintain, and a jury returned a $21 million dollar verdict, the largest verdict in the history of Colleton County, SC. In 2021, William represented a Claflin College student who suffered a traumatic brain injury as a result of a car crash caused by a road construction defect. After a two-week trial, the jury returned a $13.1 million dollar verdict against the road contractor Archer Western and the Department of Transportation, also awarding punitive damages against Archer Western. In all three of these cases, William refused offers of millions of dollars to ensure his clients were fully compensated by a jury. William was born in Charleston, SC, and with the exception of studying abroad to become fluent in Spanish, he has remained in SC his entire life. He is a graduate of the College of Charleston and the University of South Carolina School of Law. As a law student, he received the Public Interest Law Society Grant to work in Washington, D.C., served as vice-president of the Pro Bono Board, and was a student member of the John Belton O'Neal Inn of Court. Following law school, he served as law clerk to the Honorable James R. Barber, III, of the Fifth Judicial Circuit of the State of South Carolina before starting in private practice with Motley Rice, one of the largest plaintiff's firms in the country. Dr. Julie Jones is an Associate Professor at Converse University, where she also received her BA degree. An innovative educational development professional, Dr. Jones has had an exceptional journey since starting her teaching career in 1999 and has taught various grades, both in general and special education. When I was two years old, my parents were divorced and I was reared by my grandparents who faithfully sent me to church. At twelve years of age, I accepted Christ as my Savior; however, it was not until I was sixteen that I became serious about serving the Lord. While I was attending a funeral, God called me to preach—a decision I made public in the next church service. I began to study my Bible and to listen to Oliver B. Green, Harold Sightler, Dr. M. R. DeHaan and other great preachers on the radio. I also began to read books by Dr. John R. Rice, R. A. Torrey and other great preachers. The Lord revolutionized my life! At age seventeen I joined the United States Marine Corps as an opportunity to serve my country and be a witness to my fellow Marines. I married Linda Burrell in 1969 and we set out to serve the Lord together. In 1970 we moved to Chattanooga, Tennessee, to attend Tennessee Temple University. Before I took my first class, God used a small article in the Baptist Bible Trumpet, published by Dr. John Waters, to burden my heart about reaching Muslims in the Sahara. The article was written by Dr. Dan Truax, who became my Director for many years. I graduated from Tennessee Temple with a Bachelor's degree in Missions. In December 1973 we joined Baptist International Missions, Inc. (BIMI). After a year of deputation, we arrived in Albertville, France, to study the French language. We spent a year and a half in France and then took a ship down to the country of Senegal, where we worked until 1990. God blessed our years there. Two of our five children were born in Senegal. While there we learned the Wolof language and had the privilege of seeing Muslims come to know Christ. At the request of BIMI, we moved to the country of Zaire in 1991 to reopen the work of missionary Anton Andersen. Just two weeks after our arrival in the village of Tshene, serious fighting broke out in the country. The next eighteen months were filled with many dangers, culminating in our family being airlifted from the country in 1993. During the time we spent in Zaire, we learned another language (Kikongo), saw many people saved, and worked with the many believers who were there. When we arrived back in America, we were going to take a year's medical leave; however, God had other plans for us. Our home church, Grace Baptist Church of Landrum, South Carolina, called me to be their pastor. At the same time, Ambassador Baptist College was in need of an experienced missionary to add to their teaching faculty. For the next nine years I pastored a growing church, taught at Ambassador two days a week, and served on the Executive Board or as an officer of the South Carolina Association of Christian Schools. In August 2001 Dr. Les Frazier asked if I would pray about becoming Far East Director with BIMI. After seven months of prayer and much heart searching, I accepted this position. I resigned as pastor of my church and as instructor at Ambassador in May 2002. For ten years I served as Far East Director. In the summer of 2011, I was asked to serve as Vice President and Executive Director at BIMI. I took that position in January 2012. My tasks are many. We spend time out on the mission fields assisting our missionaries. I do the “Moments for Missions” radio broadcasts. Most weeks I preach in a missions conference or on a college campus. There are also many projects on which I work for Dr. David Snyder at the World Missions Center. We spent a year and a half in France and then took a ship down to the country of Senegal, where we worked until 1990. God blessed our years there. Two of our five children were born in Senegal. While there we learned the Wolof language and had the privilege of seeing Muslims come to know Christ. At the request of BIMI, we moved to the country of Zaire in 1991 to reopen the work of missionary Anton Andersen. Just two weeks after our arrival in the village of Tshene, serious fighting broke out in the country. The next eighteen months were filled with many dangers, culminating in our family being airlifted from the country in 1993. During the time we spent in Zaire, we learned another language (Kikongo), saw many people saved, and worked with the many believers who were there. When we arrived back in America, we were going to take a year's medical leave; however, God had other plans for us. Our home church, Grace Baptist Church of Landrum, South Carolina, called me to be their pastor. At the same time, Ambassador Baptist College was in need of an experienced missionary to add to their teaching faculty. For the next nine years I pastored a growing church, taught at Ambassador two days a week, and served on the Executive Board or as an officer of the South Carolina Association of Christian Schools. In August 2001 Dr. Les Frazier asked if I would pray about becoming Far East Director with BIMI. After seven months of prayer and much heart searching, I accepted this position. I resigned as pastor of my church and as instructor at Ambassador in May 2002. For ten years I served as Far East Director. In the summer of 2011, I was asked to serve as Vice President and Executive Director at BIMI. I took that position in January 2012. My tasks are many. We spend time out on the mission fields assisting our missionaries. I do the “Moments for Missions” radio broadcasts. Most weeks I preach in a missions conference or on a college campus. There are also many projects on which I work for Dr. David Snyder at the World Missions Center. When I was two years old, my parents were divorced and I was reared by my grandparents who faithfully sent me to church. At twelve years of age, I accepted Christ as my Savior; however, it was not until I was sixteen that I became serious about serving the Lord. While I was attending a funeral, God called me to preach—a decision I made public in the next church service. I began to study my Bible and to listen to Oliver B. Green, Harold Sightler, Dr. M. R. DeHaan and other great preachers on the radio. I also began to read books by Dr. John R. Rice, R. A. Torrey and other great preachers. The Lord revolutionized my life! At age seventeen I joined the United States Marine Corps as an opportunity to serve my country and be a witness to my fellow Marines. I married Linda Burrell in 1969 and we set out to serve the Lord together. In 1970 we moved to Chattanooga, Tennessee, to attend Tennessee Temple University. Before I took my first class, God used a small article in the Baptist Bible Trumpet, published by Dr. John Waters, to burden my heart about reaching Muslims in the Sahara. The article was written by Dr. Dan Truax, who became my Director for many years. I graduated from Tennessee Temple with a Bachelor's degree in Missions. In December 1973 we joined Baptist International Missions, Inc. (BIMI). After a year of deputation, we arrived in Albertville, France, to study the French language. We spent a year and a half in France and then took a ship down to the country of Senegal, where we worked until 1990. God blessed our years there. Two of our five children were born in Senegal. While there we learned the Wolof language and had the privilege of seeing Muslims come to know Christ. At the request of BIMI, we moved to the country of Zaire in 1991 to reopen the work of missionary Anton Andersen. Just two weeks after our arrival in the village of Tshene, serious fighting broke out in the country. The next eighteen months were filled with many dangers, culminating in our family being airlifted from the country in 1993. During the time we spent in Zaire, we learned another language (Kikongo), saw many people saved, and worked with the many believers who were there. When we arrived back in America, we were going to take a year's medical leave; however, God had other plans for us. Our home church, Grace Baptist Church of Landrum, South Carolina, called me to be their pastor. At the same time, Ambassador Baptist College was in need of an experienced missionary to add to their teaching faculty. For the next nine years I pastored a growing church, taught at Ambassador two days a week, and served on the Executive Board or as an officer of the South Carolina Association of Christian Schools. In August 2001 Dr. Les Frazier asked if I would pray about becoming Far East Director with BIMI. After seven months of prayer and much heart searching, I accepted this position. I resigned as pastor of my church and as instructor at Ambassador in May 2002. For ten years I served as Far East Director. In the summer of 2011, I was asked to serve as Vice President and Executive Director at BIMI. I took that position in January 2012. My tasks are many. We spend time out on the mission fields assisting our missionaries. I do the “Moments for Missions” radio broadcasts. Most weeks I preach in a missions conference or on a college campus. There are also many projects on which I work for Dr. David Snyder at the World Missions Center. The standard contract used in most residential real estate transactions in the Upstate may be about to see massive changes to the inspection/repairs language. The South Carolina Association of Realtors is discussing removing the "Repair Procedure" section from the contract, meaning that, unless they came up with another solution, contracts would either be very skewed towards a seller or a buyer, since Repair Procedure was intended to be the middle ground. If this happens, it will cause major tremors throughout local real estate, with massive ramifications to how offers are made and what repairs a seller may be liable for during a transaction. In this episode of Selling Greenville, we discuss some of that and what it could mean for the future of real estate dealings in Greenville. Dr. V. Biography for Paula G The Reverend Dr. Virginia Ann Scott Singleton was born to the late Mr. Lewis Scott and late Mrs. Minder Henicks Scott Lee on December 2, 1953. She is the eleventh child of 12 children, and the ONLY one to receive a college degree. She married her high school sweetheart, Ernest Singleton, Sr., of almost 51 years, they have 2 sons, 1 daughter, 9 grandchildren, and 5 great grandchildren. She graduated High School in 1972, approximately 22 years later enrolled in Limestone College for almost 2 years seeking Associates Administration Degree, maintained a 4.0 GPA, received the President's Letter. Later enrolled online with Almeda University, Boise, Idaho, receiving a Bachelor of Social Work in 2002. In August 2013 received Bachelors of Biblical Studies; September 2016 received Masters of Christian Education; and September 2019 received Doctor of Christian Education. Was converted and baptized at age of 11 years old and accepted Jesus Christ as her personal Savior. Dr. V. was very active in the work of the Church: sang on the Children's Sunbeam Choir; completed the Church Discipleship Training Classes; served as a Junior Usher; throughout teen years, served in the Junior Missionary Ministry, the Junior Choir and taught Youth Sunday School Class and Youth Vacation Bible School Class; represented the Church at Oratorical Contests; participated on programs with other area youth reading Scriptures, doing the prayer, introducing speakers, or whatever task was asked of her to do on program; graduated to the Church Young Adult Choir; continued to serve on the Usher Board Ministry; and became the Church assistant recording/correspondence secretary. Under the leadership of the late Reverend James Johnson, Jr., was appointed President of the Young Women's Auxiliary (YWA) Ministry and instructed to pray asking God to direct other women in the Church to work in this newly formed ministry. This Ministry grew and was connected through the Pee Dee Baptist Association with the local YWA ministries as well as participated on State and National levels. Dr. V. was elected as Chaplain of the combined local YWA Ministries and served a four-year tenure. Keynoted YWA Conference in Myrtle Beach, SC, with approximately 700+ women attending with State and National Leadership present. Served as President of the YWA for fifteen years; taught Adult Sunday School, Adult Bible Study, Adult Vacation Bible School Class, discipleship training classes, Youth Vacation Bible School Teacher. Pastor Johnson licensed Dr. V. as a Missionary because of receiving invitations to speak at local churches; received numerous invitations to bring the Word of God at local churches, was well received and respected by the people. Worked on the Senior Missionary Society, Women's Guild Ministry, and Willing Workers Ministry at her church. Attended the Annual Pee Dee Baptist Association Conferences regularly participating in workshops on ministry and leadership, pulpit etiquette, basic Bible knowledge, many various topics of training/education tracts. Received Divine call to ministry at the age of 29 years old and was licensed to preach the Gospel in 1986 by her pastor the late Reverend James Johnson, Jr.; was appointed and began to serve as associate minister to the pastor and church, and served in various capacities within the Pee Dee Baptist Association. Following his death, under the leadership of new pastor, the Reverend Rufus Garvin, was appointed as assistant minister to the pastor and church; was catechized on August 5, 1990, and ordained on August 19, 1990, historically becoming ONLYthe second female to be ordained into the Gospel Ministry by the Pee Dee Baptist Association. Dr. V. continued her loyal ministry works to the fullest being careful to complete all tasks as assigned by her leadership unto the glory of God. One task was to instruct the Church on role and responsibilities of Church Administration (to include all offices in the Body of the Church); also taught the Book of Revelations in its entirety. Following Pastor Garvin's departure, served as Interim Pastor while the Church was in search of a full-time Pastor; served as Interim Pastor for six months, and with the help of the Holy Spirit, membership increased, there was increase in tithes and offering, and the flow of the anointing filled the house. At the end of six months the Church elected a new pastor. Under his leadership, Dr. V. continued to labor faithfully in the vineyard serving within the church, as well as the Association, until God spoke two months prior to calling her out of the denominational Baptist Church to the pastorate of the Divine Church of Deliverance in 2000, where she has been and continues to be a faithful servant. Provided instruction on Spirituality in a group setting daily, five days per week, 1½ every morning for eight years when working as a clinician at the Chrysalis Center; Attended the Assembly of the Eagles Prophetic Ministry Training and meeting all requirements, received her Certificate of Completion from the School of the Prophets International Prophetic Network, Apostle Lance Jeter, Instructor, Certificate received; Attended Church Growth Institute for Pastors, Preachers and Teachers-2016; In Co-training with Pastor Chuck Singleton: provide annual leadership training classes at church (required); provide Church Protocol Institute for new membership (required); provide church training on Christian Accountability, 3 hrs.; Is a published author "Inspirational Encouragement and Spiritual Journal" with Kingdom Builders Publications, LLC. In May 2016, was the featured pastor interviewed by a very prominent inspirational magazine founder and owner, Kimmie Robinson, of eLation Magazine, article was featured in the magazine. Pastor Singleton is host of Transforming Lives Bible Radio ministry since February 2016 with very high ratings according to her broadcaster, Jerry Royce of Jerry Royce Live Worldwide Christian Media, Owings Mills, Maryland. He studied practice management continuously and was involved with veterinary politics at every level, serving on many committees. He chaired Veterinary Economics Committees for 12 years, overseeing extensive economic surveys of the profession and implementation of fee guides. He has worked with most of the multinational pharmaceutical companies either as a key opinion leader or as a small contractor. He has lectured to veterinary students all over the world and coached over 100 hours in the veterinary student communication labs. Twenty-five years of clinical practice culminated in the formation of a 12 hospital partnership and the directorship of an ultramodern 15,000 square foot hospital in Nova Scotia. He started one of the first emergency clinics in Canada and was chairman of the board for 7 years. Steve has worked with dozens of clients as a management consultant involving on-going dialogue with veterinarians about their concerns and issues. In 2008 Noonan ‘burned out'. Suffering from a severe physical and mental breakdown, he left active practice. He sought strategies and tools to heal himself permanently and immersed himself in their study. He studied stress management extensively through Mindfulness-Based Stress Reduction (MBSR) courses,completing 2 x 8 week courses and attending multiple workshops with other medical professionals in the US. Dr. Brian Herrin is an assistant professor at the Kansas State University College of Veterinary Medicine. He graduated from Oklahoma State University for both his DVM and PhD. His current research focus is on the control of ticks and fleas on companion animals. Some of his recent interests are on surveillance of ticks and tick-borne diseases of horses and the surveillance of Spotted Fever Group Rickettsia in the US. Although his research focus is on ticks, Dr. Herrin enjoys working with all parasites of veterinary importance through the diagnostic service and teaching/outreach opportunities. Since joining South Carolina AHPERD in 1996, Kym has held many elected and appointed positions, including president, parliamentarian, and adviser for the South Carolina Association of Future Professionals. Lisa Phillips entered the hospital for the induced labor of her second child by Dr. Lynette Iles, a family physician who physically checked on Lisa only a few times throughout the day and relied mostly on continuous external fetal monitoring to inform her about the baby's health. As the delivery drew closer, Dr. Iles chose to move to intermittent external fetal monitoring, despite the lack of consistent heartbeat readings and missed key indications that the baby was struggling. Taylor was delivered through cesarean section by a different doctor and airlifted to a neonatal intensive care unit for the brain damage she sustained during the period of intermittent fetal monitoring. Due to her traumatic birth, Taylor is a locked-in quadriplegic who cannot speak and who cannot live independently. A Washington County, Iowa jury returned a landmark verdict of $18,126,000 against Dr. Iles and her medical practice for violating the standard of care. Happy New Year, everyone! As I thought about 2019, I wanted to get off on the right foot – and I wanted to try something a little different. So today, I interview three wonderful guests at the same time. And you know what? It was a blast! Our guests are Allen Lloyd, CEO of the Montana Society of CPAs; Boyd Search, CEO of the Georgia Society of CPAs; and Chris Jenkins, CEO of the South Carolina Association of CPAs. All three are CEOs who used to work for the Ohio Society and are now running other state societies, so naturally, our discussion centers around the state of the CPA associations and the issues that members are facing in the accounting profession, both current and in the future. This isn’t a one-size-fits-all solution, which is why this isn’t a one-on-one conversation. These three highlight that each association needs the ability to recognize the idiosyncrasies or uniqueness of their membership and try to tailor their offerings to meet the membership’s needs. For example, Chris Jenkins and the South Carolina Association of CPAs recently overhauled their membership model to create something completely new: an all-inclusive membership. And this was a pretty radical move! “It's about bringing the association back to what it originally was, and the association was a community,” Chris says. “We spend a lot of time talking about CPE, and we spend a lot of time marketing CPE, but there are a lot of CPE vendors out there. What we were trying to do is deliver the maximum value for the minimum price. So, we wanted to roll CPE in as a member benefit.” That’s right – SCACPA isn’t trying to upsell their members to purchase additional CPE credits anymore! The conversation around CPE is so often competence versus compliance, and when you take the price point out of the CPE, it becomes more of a competency-based system. The world is changing rapidly, and as the world changes, associations need to change too. Allen Lloyd and the Montana Association face a very different problem than our other two guests: they’re a state with just a million people that's three-and-a-half times the size of Ohio. CPE is difficult for them because it's difficult to get everyone together – then, even when you accomplish that, none of the cities in Montana are that big, and they're spread out so far from one another, making it difficult to get teaching talent to come. So the MSCPA got rid of their eight-hour seminars and switched to cluster events. Instead of getting people together for an afternoon, everyone gets together for two or three days. None of the classes are longer than four hours and members can pick and choose what they want to do. Georgia, on the other hand, is a much more populated state. There are over 21,000 CPAs licensed in the state, and 85% of their members are actually in Metro Atlanta. This creates both opportunity and challenges because, while they are compressed in this space, traffic is terrible and it's not going to get any better. So Boyd and the GSCPA have made significant investments in their live stream technology, and they’re doing it all themselves. “We have our own equipment, our own staff, and we do it for ourselves,” Boyd says. “And in an age when a lot of people are partnering with outside companies, or with other states, or whatever, we have moved in the opposite direction where we are entirely reliant on ourselves.” So the society owns the process, owns the technology, and hires the people beginning to end – and that has paid huge dividends for them financially. Although they have not experienced tremendous growth in their margins, they have offset losses that you can see in other states and other providers. Change is scary. Change is necessary. People in associations have a fear, and not an entirely irrational fear, that if they create too much change, the people who have supported the associations for the last 30+ years won't like them anymore.“But we also have to recognize that if we don't change, if we don't do something different, the people who are going to support us for the next 30 years are not going to find us relevant. They're not going to find value in us,” Chris says. So, each association, and really each firm, has to have a method of controlled change, in which you try to balance the needs of both without making either one 100% happy... and no matter what you do, you’re never going to make everyone happy. But if people can find the value, they will want to be part of your association or work with your firm. Following the death of Pastor Johnson, under the leadership of their new pastor, the Reverend Rufus Garvin, she served as assistant minister and was ordained on August 19, 1990, at Savannah Grove Baptist Church; making her the second female to be ordained into the gospel ministry by t! he Pee Dee Baptist Association.
