How can one comp plan mistake sabotage your sales team before they even start? That's the challenge facing Adam and Laura from the Rossen Law Firm in Florida. After attending one of our Dallas workshops, they made the bold decision to transition to a non-attorney sales team. Six weeks later, they're all in on the strategy but hitting a wall on one critical issue: compensation structure. The problem? Like most law firms making this transition, they're stuck in the traditional legal mindset when it comes to paying salespeople. They can't pay direct commissions because of fee-splitting regulations, but they're struggling to create a compensation plan that motivates high performance. If you're nodding your head right now, you're not alone. This is the No. 1 stumbling block I see when law firms try to build professional sales teams, and it's costing them their best talent before they even get started. The Legal Industry's Compensation Conundrum Most law firms approach sales compensation like they're hiring another paralegal instead of recognizing they're building a revenue-generating machine. The traditional legal industry operates on billable hours, retainers, and partnership tracks. But sales? Sales is about results, motivation, and creating an environment where top performers want to stay and mediocre performers either level up or leave. When you try to force a square peg (sales compensation) into a round hole (traditional legal compensation), you get exactly what Adam and Laura discovered: confusion, frustration, and the risk of incentivizing the wrong behaviors. Why Fee-Splitting Regulations Actually Work in Your Favor Before you start cursing the legal profession's restrictions on fee-splitting, let me share something that might surprise you: This limitation can force you to build a better compensation structure than most sales organizations. Here's why: Instead of lazy commission-based thinking, you're forced to get creative with performance bonuses tied to specific outcomes. This means you can build a compensation plan that rewards the behaviors you actually want, not just the easy stuff. The key is shifting from a commission mindset to a performance bonus mindset. This isn't just semantic; it's a fundamental change in how you think about motivating your sales team. This approach requires strong leadership fundamentals, which is why understanding how to create a sales accountability culture becomes critical to your success. The Three-Layer Compensation Framework That Actually Works When I work with law firms on this challenge, I recommend a three-layer approach that satisfies legal requirements while creating real motivation: Layer 1: Competitive Base Salary This is your foundation. Pay a competitive salary that attracts superstar talent. Why? Because when you pay superstar wages, you can hold people accountable for superstar performance without them saying "you're not incentivizing me for that." If most of your comp is salary, you can explain expectations clearly and apply leadership, motivation, and inspiration to get people to do the hard things without getting paid extra for everything. Layer 2: Individual Performance Bonuses (Monthly) Focus on activity-based goals that drive results: Follow-up completion rates Number of qualified calls taken Conversion rates from initial contact to consultation Client onboarding task completion These should be measured monthly because salespeople need tighter timelines to stay motivated. The fundamentals of effective follow-up and systematic prospecting become crucial here. This is where mastering fanatical prospecting principles makes the difference between good and great performance. Layer 3: Team and Firm-Level Bonuses (Quarterly/Annual) This is where you create real ownership mentality: Quarterly team goals: Total new clients signed above baseline Annual firm goals: Overall revenue growth and profitability targets

With a career that began in retail management and a decade spent as a touring musician, Michael brings a diverse background to his leadership role at one of the most celebrated aquariums in the country. His journey at the Tennessee Aquarium began as an admissions assistant manager and progressed to the executive team, overseeing guest experience across a sprawling, multi-building campus in Chattanooga. In this interview, Michael talks about starting with respect, connecting employees to the mission, and lessons from being a touring musician. Starting with Respect “You're never going to get in trouble for trying to do your job. If you are doing what in your mind is best for the guest… we can go back later, we can talk through that, we can make adjustments.” Respect is a foundational value for Michael, both in his personal leadership style and within the Tennessee Aquarium's culture. He shared how early experiences in management—starting at just 18—taught him the challenges of leading peers and the importance of transitioning from being a peer to being a leader. Over time, he distinguished between managing tasks and truly leading people. As a leader now, he empowers his team by ensuring they don't fear making decisions in the moment for the benefit of the guest. Mistakes are viewed as opportunities for learning, not punishment. Michael's approach promotes psychological safety and trust. By removing fear from the equation, he allows team members to take initiative, try new approaches, and build confidence. This empowerment leads to stronger team performance and, ultimately, better guest experiences. Connecting Employees to the Mission “If we expect our employees to connect people to water and wildlife, first we need to connect our employees to water and wildlife.” At the Tennessee Aquarium, conservation and education are central to the mission. Michael emphasized the importance of immersing employees in the organization's purpose—not just through training but by giving them firsthand experiences. Team members visit the Conservation Institute, participate in programs like sturgeon releases, and develop a personal connection to the stories they're telling guests. This connection transforms the guest interaction. Rather than reciting facts from a script, employees share genuine excitement and passion. Michael explained that this authenticity helps the Aquarium consistently rank in the top 1% for hospitality among global cultural organizations. By investing in the employee experience, they amplify the guest experience in return. Lessons from Being a Touring Musician “There's always something positive that you can go through and focus on and kind of talk through… and really being there and showing that type of respect—people, you start to get that back.” Before his time at the aquarium, Michael spent years on the road as a guitarist in a band. He credits that experience with shaping his values around community, branding, and respect. Touring taught him to build relationships with promoters, support other bands, and find creative ways to engage with audiences—like offering CDs to fans who beat the band in a game of Mortal Kombat. These grassroots, DIY (or as Michael prefers, DIT—do it together) experiences taught him how to build loyalty, communicate a brand, and foster belonging. These same principles now guide his work in the attraction space. Just like a band earns its fan base one person at a time, Michael believes in creating meaningful guest experiences by investing in the little things—hospitality, enthusiasm, and consistency. Today, we'll discuss how to break bad breakfast habits with 9 healthy breakfast tips!1. Some people drink too much coffee in the morning, but that's not always the problem. Coffee beans are one of the most sprayed crops behind cotton and tobacco. Adding sugar and non-dairy creamer with seed oils worsens the problem. The simple solution is to always choose organic coffee.2. Most orange juice is pasteurized, which destroys the vitamin C. If you're drinking orange juice for breakfast, it's likely that you're just drinking sugar water. 3. Carb-heavy breakfast foods significantly spike blood sugar. Your body produces insulin to lower the spike, causing low blood sugar, leaving you feeling tired after breakfast. Switch to a protein breakfast! Opt for eggs, bacon, cheese, whole-fat yogurt without sugar, steak, or burger patties rather than the typical muffins, pancakes, cereals, etc. 4. Consuming fruit and nuts for breakfast will likely leave you feeling hungry midmorning. This leads to snacking, which raises blood glucose and spikes insulin throughout the day. 5. Peanut butter is often consumed for breakfast, but many contain sugar and hydrogenated oils. Always check the label!6. Avoid cooking with seed oils for breakfast. Opt for healthy cooking oils such as butter, olive oil, coconut oil, or lard. 7. Check the labels on your breakfast meats. There are many hidden sugars in breakfast foods, especially breakfast meats!8. I used to recommend drinking kale shakes with fruit for breakfast, but this is a mistake. A healthy breakfast should always contain high-quality protein. 9. Eating when you're not hungry is the #1 worst breakfast mistake! We're often taught that breakfast is the most important meal of the day, but this isn't true. You're fasting while you sleep, so most people aren't hungry when they wake up. Try pushing your first meal to lunchtime to increase the duration of your fast. This can help you tap into fat-burning, boost weight loss, reverse insulin resistance, improve mood, and decrease appetite. The GitHub page operated by GSA and its digital government group Technology Transformation Services references the Grok AI model as one it is testing and that the team is actively discussing as part of its 10x AI Sandbox. A GSA spokesperson told FedScoop in a response to an inquiry about the agency's work with Grok “GSA is evaluating the use of several top-tier AI solutions to empower agencies and our public servants to best achieve their goals. We welcome all American companies and models who abide by our terms and conditions.”A post from Tuesday shows what appears to be one GSA employee trying to access Grok 3 for testing, but struggling to do so. Several names of the people active on the GitHub page match those of workers affiliated with GSA. The 10x AI Sandbox project is described on GitHub as “a venture studio in collaboration with the General Services Administration (GSA). Its primary goal is to enable federal agencies to experiment with artificial intelligence (AI) in a secure, FedRAMP-compliant environment.” It continues: “By providing access to base models from leading AI companies and offering advanced UI features, the sandbox empowers agencies to test and validate new AI use cases efficiently.” The public version of the 10x AI Sandbox project page on GitHub was taken down after the publication of this story, redirecting now to a 404 error page. Interest in testing Grok comes as GSA continues to work on GSAi, an artificial intelligence tool built by the agency and meant to help employees access multiple AI models. At launch, the GSAi tool included access to several systems, including tools from Anthropic and Meta. Notably, Grok came under fire last week after promoting various antisemitic statements on the Musk-owned social media platform X. A top digital rights group is pushing back on the IRS's data-sharing agreement with the Department of Homeland Security, writing in a new court filing that the pact violates federal tax code and fails to take into account the real-world consequences of bulk data disclosure. In an amicus brief filed in the U.S. Court of Appeals for the D.C. Circuit, the Electronic Frontier Foundation argued that the “historical context” of the tax code section that ensures confidentiality of returns and return information “favors a narrow interpretation of disclosure provisions.” EFF also made the case for why the bulk disclosure of taxpayer information — in this case to Immigration and Customs Enforcement — is especially harmful due to “record linkage errors” that set the stage for “an increase in mistaken and dangerous ICE enforcement actions against taxpayers.” Nonprofit groups sued the Trump administration in March, shortly after the data-sharing deal between the IRS and ICE was announced. Soon after, the tax agency's then-acting commissioner resigned, reportedly in protest. In May, a Trump-appointed federal judge refused to block the agreement, allowing the IRS to continue delivering taxpayer data to ICE. The ruling, DHS said in a statement, was “a victory for the American people and for common sense.” As the D.C. Circuit Court considers the appeal, the Electronic Frontier Foundation wants to make sure that the “historical context” of tax and privacy law is taken into account. My guest, Steven Lewis, broke one my big rules. It is ok, to make mistakes, you just don't want to make the same mistake twice. And he did. Yep, Steven started not one, but two businesses that were—how shall I say this?—a bit too far ahead of their time. And in this candid chat, we unpack what he learned, how it shaped the work he does today, and what you, as a business owner, can take away without having to make the same mistakes. Key Ideas Timing is Everything (But Not Everything) Steven launched a web business in 1994 and a social media agency in 2004—both solid ideas, just way too early. He found himself selling websites before people knew what the internet was, and social media services before anyone knew what a tweet was. The market wasn't ready, and he learned the hard way that even the best ideas need the right audience at the right time. Sell the Symptom, Not the Cure Like a podiatrist treating knee pain, Steven learned that people don't buy solutions to problems they don't know they have. If your audience thinks they have a sore knee, don't talk about fixing their feet. Speak to the symptoms they're experiencing, not the root cause you see. Then gently guide them to the solution. Your Cool Idea Isn't Enough Steven built those early businesses around what he thought was cool—websites, podcasting, blogging—but he wasn't solving a problem his audience recognized. Today, he's flipped the script and focuses first on his audience's pain points. It's not about what you can do—it's about what your audience needs right now. Use Tools That Think Like You—Or Smarter Now Steven helps clients build their own AI-powered CMO, trained on their business to give them advice they can actually use. Essentially, he created the strategic brain he wished he had back then—and now he shares it with others. Steven Lewis Steven runs the Sydney-based marketing agency, Taleist, which specializes in direct-response copywriting, and the agency has been using AI copywriting tools to do that since February 2021. Why Your Clients Might Not Love You (Even if You're Getting Results) Ever feel like you're crushing it for clients, but then they ghost you or churn unexpectedly? There are several reasons why this could be happening and ways to stop it before it kills your momentum. Here's the truth: buyers remorse sets in immediately after a client signs. It's your job to kill that remorse with rock-solid communication and a frictionless onboarding experience. Most agencies think they're good communicators because they answer emails. But clients want more than tasks checked off. They want to feel seen, understood, and confident they made the right decision. If you're not proactively communicating wins (and misses), or if you let your PMs control the narrative without your oversight, you're setting yourself up for churn, no matter how “good” your delivery is. Your Onboarding Might Be Pushing Clients Away As Jason knows from recent experiences as a client, most agencies' onboarding is just an exhausting homework dump on clients who already told you their goals in the sales calls you recorded. Why are you making them repeat themselves, fill out giant forms, or wait for your scattered follow-ups? Your clients didn't hire you to do more work. They hired you to get results while saving them time. Break your onboarding into clear, easy phases, Reset expectations, Use the data you already have (like call transcripts and AI sorting) to fill in the blanks yourself. If you set clear timelines, communication rhythms, and how success will be measured in that first meeting, you'll position yourself as a trusted advisor, not another vendor barking for “assets” they've already shared. This is what makes clients relieved to work with you instead of stressed. Communication: Simple, But Rarely Done Right It's so important for any business to show that you're trustworthy, and you'll show that by doing what you say you'll do, when you say you'll do it. Too many agencies fail to communicate delays, let tasks slip, and think a monthly dashboard is enough. It's not. Dashboards alone mean nothing to most clients. Some need a quick Loom, some need Slack check-ins, others need a simple “Here's what we did, what's next, and why it matters.” Customizing your communication style shows your clients you're paying attention to them, not just copy-pasting your agency SOPs onto their business. This is how you become a trusted advisor, the person they call with challenges (not just tasks). That's how you become irreplaceable. So, which measures are you implementing at your agency to ensure - not just assume - that you know your clients are happy, not only with the results presented but also the overall experience? Want Clients to Stick Around? Be Human When was the last time you called a client you didn't personally sell or deliver on, just to check in and say, “Hey, I'm the CEO, here's my number if you need anything”? Most agencies never do this, but it's one of the simplest ways to build relationships that survive budget cuts and economic slowdowns. If clients only see you as a transaction, you're the first thing to get cut. If they see you as a partner, they'll fight to keep you. Want to take it further? Fly out and have dinner with your top clients once a year. Exchange stories, show them you care, and watch how your retention and upsells climb. Stop Leaving Money on the Table by Ignoring Current Clients Agencies love to yell, “We need more leads!” But often, your easiest growth is sitting right in front of you. If your clients trust you, they'll come to you with new problems—many of which you can solve or connect them with someone who can. This positions you as a problem solver, not an order taker. Instances like this are a great opportunity to be strategic, guide them, and reinforce how much you value the relationship. Results are awesome, but that value is what will take from being transactional to being a value relationship they'll fight to keep in times of economic uncertainty. Why Ongoing Discovery Is Your Secret Retention Weapon If you're selling to clients you can't grow with, you're setting yourself up for frustration. Too many agencies say “yes” to clients who aren't ready, don't want help, or can't commit to scaling. It's like hiring a personal trainer while refusing to stop eating cake every night. They might pay you, but they won't get results—and they'll blame you when they don't. And what about after you've found the right clients? Darby believes too many agencies forget that discovery isn't just for the sales process. Every client interaction should be a sort of ongoing discovery. Agencies that retain and grow accounts are constantly in ongoing discovery mode. As you bring success to clients their needs will evolve, their businesses shift, and what worked four months ago might be irrelevant today. If you're not in tune with those shifts, your agency becomes stale, and you'll get replaced. A challenge for agency owners: How are you staying aware of what's changing in your clients' businesses? Are you proactively checking in, asking about priorities, and aligning your services to what's happening right now? Or are you stuck on autopilot, delivering what they hired you for while missing what they actually need today? Stay curious, stay in discovery, and you'll stay essential. Communication Clarity: 411 vs. 911 To prevent the typical disconnect when clients are unsure of who to reach out to and for what, Darby and Jason recommend this simple but powerful tactic brought by Agency Mastery member, Travis. He tells clients exactly who to reach out to for “411” (info & updates) vs. “911” (emergencies). This eliminates confusion, speeds up communication, and prevents small issues from turning into big frustrations. And when you mess up—and you will—own it fast. Clients don't want spin or silence. They want the truth — fast. One agency Jason used messed up an ad so badly it was embarrassing, and instead of calling to own it, they hid behind Slack messages. Don't be that agency. Mistakes happen. What matters is how quickly and humanly you fix them. Be Human. Clients Crave It. At the heart of retention and growth is human connection. If your agency relationships feel like sterile transactions, you're replaceable. Clients want to feel seen and understood. If everything you share sounds like sugarcoated wins while their results lag, they'll start doubting you. Long-term, high-value clients come from humanizing your interactions—having real conversations, admitting mistakes, sharing wins, and being upfront about challenges. Clients don't want perfect robots; they want partners they trust. Don't Fear AI - Use It to Win Do clients want their agencies to use AI? Overwhelmingly, yes. They just don't what you to use it just to write articles and create crappy images, brands want their agencies using AI to get better results. According to a survey conducted by Audience Audit, 77% of brands are more likely to hire an agency seen as an AI expert, yet only 32% think their current agency is. This is a massive opportunity. But here's the key: don't use AI as a crutch to replace human strategy. Use it to collect, analyze, and interpret data faster so you can bring clients valuable insights and make micro-adjustments that drive real results. Clients want done-for-you solutions that leverage AI under the hood while preserving a human relationship on the front end. Just remember that clients don't care about your systems, your dashboards, or your internal processes if they don't lead to results. They want outcomes with as little friction as possible. AI can help you cut busywork, speed up insights, and refine strategy—but it's your human understanding and relationship that keeps clients paying, referring, and expanding their contracts.
