EPISODE TITLE:"EVP Messages from Beyond: Gary Arnold's Tracfone Phenomenon – Typical Skeptic #1950"
Join our poetry Salon and Open Mic: https://parallax-media-network.mn.co/share/5hSLvQW7bNszFGEo?utm_source=manual About David Herz: Hello. My names are David Salzmann Herz. I was born in Boston 70 years ago when McCarthy was getting his comeuppance. I lived with my family somewhere in Massachusetts before moving to Belo Horizonte, Brazil , as part of the Department of the Interior's Punto Quatro program where my father was instrumental in mapping the geology and training a generation of Brazilian geologists. I began writing aged ten at the American school of Sao Paolo which had scorpions in the sandbox. I won a turtle for my prose. Then we lived in Chevy Chase, Maryland before moving to Athens, Ga. Where I met the poet Colman Barks and other luminaries. I moved to Chicago and studied briefly under Del Close at Second City and David Mamet who was then directing the Goodman Theater. As well as Richard McKeon at the University of Chicago who taught Susan Sontag among others. Then I returned home and drove a car from Selma, Alabama to Warminster Pennsylvania, possibly damaging the transmission while accelerating against the snow and ice. The next three years in a bankrupt New York City were richness incarnate. I worked at the Oh Ho So restaurant in SoHo and as a busboy served Harry Belafonte, one of the reasons God created humans, a glass of water. I had Alice Notley, poetess supreme, for a teacher and read my prose work at the Saint Marks in the Bowery Poetry Project. Those were wild times, buildings burning, trash uncollected, rapes a'plenty, and great generosity from compassionate lawyers, doctors and dentists for the impoverished lot we were. You could easily meet people such as John Cage, Merce Cunningham, John Giorno, Ted Berrigan, David Byrne, Patti Smith, Fred Sherry, Nam June Paik, Allen Ginsberg, Gregory Corso, Charles Bernstein, Tony Towle, Bill Berkson, Eileen Myles, Ted Greenwald, John Cale, Lydia Lunch, Alan Vega, and avoid others such as Valerie Solanas. And then just as I was about to join a rock and roll band I moved to Paris. It's been 45 years. Odd jobs subtitling movies and Sipa Photopress Agency photographs. Doing journalism for English language papers, interviewing the B- 52's, Peter Brook, Zouc, Herbert Achternbusch, Paul Lederman, Boris Bergman and then working for Bull and Alcatel two fine French corporations employing hundreds of thousands who equally vanished into the capitalist sunset. Thanks to a flutist friend in Ircam I got to meet Karlheinz Stockhausen and Pierre Boulez but I don't think they remember me. I did a translation for Sophie Calle before she became Sophie Calle. Also some work for the Royal family of Afghanistan. Back when there was one. At Paris VIII University still in the Bois de Vincennes with the whores whom we did not try to lead to culture I got to attend classes by Lyotard & Deleuze and the Miller Brothers, Lacan's son in laws? Noam Chosmky spoke. I thought to become a consultant in a moment of delusion and ended up teaching for the last 24 years: Polytechnique, SciencesPo, ENST, INT, Supelec, Ecole Centrale, ENPC, ENSTA, Paris V, ICP, ESIEE, ECE, Ecole du Louvre. Before that I was a technical translator, a field I am happy to report that has been almost entirely taken over by machines, bless their soulless bodies. I also got married and my wife and I had two children. But we hadn't really grown up much to the needless suffering of the children and so that marriage went painfully bust...Then I married again and we had a daughter. She's on the phone right now, de rigueur for all 16 year olds. I am a loving observer of the human experiment of which I am inextricably a part, how so ever much I would like to be apart. As we advance, not necessarily progress, into the numbing, memory erasing age of AI, already sinking its canines deep into our pranic jugulars, lose ourselves in our beloved electronic devices, we must look to our hands, our analog writing devices such as pencils and pens and give them a try. Along with all the rest.
Our episode this week features a woman who has one of the most unique backgrounds and skill sets we've come across. Elizabeth Eastland is a full time artist these days, however her career prior to the last few years centred around leadership roles in global corporates and academia focussed on technology, innovation and entrepreneurship. Liz is a Canadian Australian now based in Sydney, however her career has taken her from North America to Australia and Paris and back to Sydney. She's been a CEO of a telco startup, held a global role at telco giant Alcatel, and she's headed up innovation and entrepreneurship programs for two universities, the University of Wollongong and the University of NSW. What's so fascinating about Liz is that right from the start she embraced and studied two disciplines: art (initially creative writing) and science, and she's continued this duality right throughout her executive career. It's not surprising to learn her father was a rocket scientist and her mother an artist and designer. Plus Liz herself has at least 3 degrees. In this intriguing conversation you'll hear: Liz's reaction when she was transferred to Australia at age 28How Liz's multi disciplinary background has given her unique perspectives on what it takes to be truly innovativeHow a planned nine month, mid career break turned into a four year voyage sailing around the MediterraneanHow Liz was effectively responsible for the innovation strategy of a whole nation in one of her roles; and Liz's surprising, yet super refreshing, definition of success for herself. Enjoy this fascinating conversation with the creative and uber-disciplined Elizabeth Eastland.

Nicolas explains how the law builds on France's pioneering 2017 Duty of Care legislation and its impact on corporate accountability for both EU and non-EU multinationals. Nicolas Tollet is a Partner at Hughes Hubbard. He previously served as Vice President for Compliance at Technip, an oil and gas service firm. With over 20 years of experience in compliance and internal investigations, he has worked on significant cases like Alcatel, TSKJ, and Lava Jato. Nicolas has expertise in monitorships, having been involved in the first one imposed on a French company by the DOJ and the SEC. He helps companies worldwide with compliance programs, audits, and M&A due diligence. You'll hear Tom and Nicolas discuss: The new EU Directive on Corporate Sustainability Due Diligence will require companies above certain revenue thresholds to implement human rights and environmental compliance programs, not just for their operations but across their entire value chain. France has been at the forefront of such legislation with its 2017 Duty of Care law. The EU directive builds on this, with more expansive requirements and penalties of up to 5% of worldwide turnover for non-compliance. The directive explicitly links human rights risks to corruption risks, recognizing their interconnection. It has the potential to drive even broader risk coverage than typical anti-bribery programs. By mandating due diligence across the value chain, the directive will necessitate contract terms like audit rights as standard procedure. Financial institutions may also need to evaluate the human rights impacts of clients they fund. The directive allows each EU country to determine how to specifically transpose and enforce the law's obligations. This could lead to a complex web of overlapping inspection regimes applied to multinationals. Even companies not based in the EU will fall under the law if they meet certain revenue thresholds in Europe. Non-EU companies should tap French expertise since France is about 6 years ahead in implementing similar mandates. Required public sustainability reporting adds another layer reinforcing the need for concrete compliance actions. While the US led historically on anti-corruption compliance, the EU is now at the vanguard of expanding into human rights, environment, and sustainability. France in particular has established itself as a leader in advancing corporate compliance expectations. KEY QUOTES: “There is a direct link within the directive between human rights compliance and anti-corruption compliance, which the compliance community in the world has been seeing for years now.” - Nicolas Tollet “So we shouldn't expect one member state to be reluctant to enforce the legislation. The EU will make sure that every member state issue and then enforce the legislation in each country.” - Nicolas Tollet “Fortunately, we are still linked in how we work in the business field, and we have to take both into account. So there is a certain pride indeed, because there is real expertise in France now on compliance, but it's mixed between the French and the American compliance community, I would say. So it's working together that we've managed to improve compliance.” - Nicolas Tollet Resources: Hughes Hubbard & Reed website Nicolas Tollet on LinkedIn EU Directive on Corporate Sustainability Due Diligence: Navigating the New Landscape of Corporate Accountability
Vienna-based Waterdrop, best known for its pressed tablets that make flavored water, has ambitions to become a global beverage giant. The brand launched seven years ago in Austria and slowly expanded into other European markets like Germany and France. Now, the company has expanded in the U.S. and is working to become more of a household name. In 2021, Waterdrop said it brought in over $100 million in sales in Europe alone. "There are very few European innovations that make it in the U.S.," said founder and CEO Martin Murray. "Typically, the innovations come from the United States." But Waterdrop is trying to buck this trend -- and on this week's Modern Retail Podcast, Murray explained how. Waterdrop is Murray's big vision to make what he calls a "micro-drink" brand. That is, it's a beverage sans water -- meaning it has less of a carbon footprint and requires much less packaging and plastic. Murray wanted it to be cube shaped and he wanted it to be made with real plant and fruit extracts. For months, Murray flew between Europe and Asia meeting with technicians to try and figure out how to make such a product. "Out of 20 meetings, 19 told me it's stupid and it doesn't work," he said. But while in these meetings, Murray was able to get a crash course in product manufacturing and formulation. Through this, he was able to figure out how to ask the right questions and fine-tune his pitch. He finally hit on a manufacturing partner who agreed to give him an R&D budget to try and make the product. From there, Waterdrop was able to build a minimum viable product and bring it to market. Part of Murray's ethos has been to test and iterate. "To be honest, the prototype was really bad -- like, it didn't dissolve, it didn't taste [the right way], you couldn't open the packaging," he said. "But it was a prototype." "We started the company, we started the product then we iterated [while it was on] the market -- got a lot of feedback and since then have been really changing based on what consumers are telling us," he said. When it first launched, Waterdrop was predominately online. But in each country it launches in, it has been expanding more and more into retail -- both wholesale and its own stores. And while retail is becoming a much bigger part of its business, Murray isn't going to pull the plug on DTC anytime soon. "Our e-commerce will always exist because it allows us to test products very quickly," he said. For now, the focus is on continuing to expand as well as refining its product. "We started [like] a semi-broken Alcatel phone," Murray said. "Now we're looking at the iPhone 5 or 6 -- we went through a progression of iterations. We know how to build the iPhone 10+, but we're on a journey of continuously making those improvements."

Timestamps: 1:52 - From fossil fuels to clean energy 7:55 - Idealab and Energy Vault 14:20 - Hardware and software 29:03- Saying no to customers 43:50 - The intense schedule of going public About Robert Piconi: Robert Piconi is the co-founder and CEO at Energy Vault, a global energy storage company based in Ticino and publicly listed at NYSE. He previously worked at companies like BP, Alcatel and Spirent Communications. Despite his past in the oil business, Robert is currently dedicated to taking an active role in the transition to renewals. That's why he co-founded Energy Vault in 2017, after having validated the idea at Idealab, the longest running technology incubator in the US, with a very impressive track record: almost half of its companies have either gone public or been acquired. Energy Vault aims to tackle the complicated issue of energy storage, i.e. electron storage. This storage is made difficult by the electrons' limited “shelf-life”, by the costliness of the infrastructure, and by the fact that it is rather hard to find sustainable ways of doing it. Energy Vault combines innovative design, advanced materials science, and proprietary machine-vision software to orchestrate the storage and dispatch of electrical power by lifting and lowering composite bricks, made from eco-friendly materials. Energy Vault's commitment to sustainability is reflected in a unique approach to the circular economy which utilizes local industrial and energy waste, including remediated coal ash and recycled wind blades converted to recyclable materials, to build the system's composite bricks. They run their infrastructure and acquire their raw materials locally, so as to avoid greenhouse gas emissions and reinvest in the communities where they're located. One major customer segment of theirs are utilities companies that distribute to a grid infrastructure, and which are currently in the process of shutting down their fossil fuel plants and making the switch to renewables. Energy Vault went public on the NYSE in 2022, through a merger with Novus Capital Corporation II (NYSE: NXU). The transaction raised approximately $235 million in gross proceeds, additive to its recently announced Series C of $107M and the $50M license fee from Atlas Renewable, to fund the execution of its growth strategy. Reflecting on the going public process, Robert advises founders to not go public before they've reached a scale which allows them to reliably predict the company's future, or before they've hired enough people to maintain operational excellence during the IPO process. Memorable Quotes: "I felt like my potential could reach greater heights if it weren't held back by corporate constraints." "Countries have no walls: greenhouse gasses go all over the world. It is imperative that we cooperate." "An IPO process takes months. I would caution founders to structure their business in a way that makes sure things run on time even if they're away." The global smartphone market has been through a bumpy ride during the last couple of years — US sanctions on Huawei, COVID-19, ongoing component shortages and LG's exit to name a few. Some smartphone makers, such as Huawei, LG and Samsung, have been impacted more than others by these events. At the same time, Chinese smartphone makers like Xiaomi, OPPO, vivo and OnePlus have benefited from the events by filling the void. The US postpaid market is heavily dominated by Apple and Samsung, whereas the prepaid market has players like Nokia HMD, Motorola and Alcatel. LG's exit from the market has opened opportunities for others. Similarly, in the absence of Huawei, Xiaomi has been dominating in Europe, driven by CIS markets. It also briefly surpassed Samsung to become the top smartphone vendor globally. OPPO, realme and vivo are also gaining share in Europe, China, India and the SEA. The MEA market is also getting interesting where Transsion Group's TECNO, itel and Infinix are gaining share. In the latest episode of ‘The Counterpoint Podcast', host Maurice Klaehne is joined by senior analysts Harmeet Singhwalia and Aman Chaudhary to discuss the changing dynamics of the global smartphone market. The discussion deep-dives into different regions, from the US to Europe, Asia, SEA and MEA, to highlight the top smartphone vendors and their strategies.Follow us on social media platforms –Twitter – https://twitter.com/counterpointtrLinkedIn – https://www.linkedin.com/company/counterpoint-technology-market-research/YouTube - https://www.youtube.com/channel/UCMg5uHXDVM71UTF-lE_e--g/
The beginning of 2020 was quite challenging for the smartphone market after the COVID-19 outbreak, which resulted in lockdowns across several countries. However, things eased in the second half with pent-up demand driving smartphone sales. The momentum continued through Q1 2021, with the iPhone 12 and Samsung Galaxy S21 series doing well in the premium segment. Even the telecom operators offered great deals and trade-in offers that helped in ensuring better sales. Prices of prepaid 5G smartphones in the US have come down in just under two years. With promotional offers from operators, we are even seeing these devices available under $150. So, operators are going all out with their marketing budget to push sales. Talking about this mid-range segment, LG has announced its formal exit from the smartphone market, which will leave a void to be filled in. It creates an opportunity for other smartphone makers such as Samsung, Motorola, Alcatel and TCL to increase their share. In the latest episode of ‘The Counterpoint Podcast', host Maurice Klaehne is joined by Research Director Jeff Fieldhack to talk about the US smartphone market, refurb channel, smartphone spec upgrades and more. The discussion highlights how the smartphone market is recovering after the COVID-19 impact, and touches upon the ongoing semiconductor chip shortage and its implications. Jeff also offers insights on how the prepaid and postpaid channels are performing, how 5G mobile broadband and home broadband are shaping up to ease work-from-home, and much more.
