Der Fall landet vor Gericht.In dieser Folge geht es deshalb nicht nur um das aktuelle Urteil des LAG Köln, sondern um die Grundfrage:Wann muss ein Arbeitgeber ein Zwischenzeugnis wirklich ausstellen – und wann darf er es verweigern?In der Folge erklärt Sandro Wulf:warum es keinen allgemeinen gesetzlichen Anspruch auf ein Zwischenzeugnis gibt,weshalb § 109 GewO nur das Endzeugnis regelt,wie der Anspruch auf ein Zwischenzeugnis über § 242 BGB begründet werden kann,was die Rechtsprechung unter einem triftigen Grund versteht,welche Fallgruppen Arbeitgeber und HR kennen sollten,warum ein Zwischenzeugnis nicht zur reinen Prozessvorbereitung verlangt werden kann,was das LAG Köln zur beruflichen Neuorientierung entschieden hat,warum ein pauschales Bestreiten des Arbeitgebers nicht genügt,und weshalb die zugelassene Revision zum BAG spannend werden kann.Maßgeblich ist der Grundsatz von Treu und Glauben nach § 242 BGB. Das BAG verlangt dafür einen triftigen Grund. Typische Gründe für ein Zwischenzeugnis können sein:bevorstehende Beendigung des Arbeitsverhältnisses,laufender Kündigungsschutzprozess oder sonstiger Beendigungsrechtsstreit,Wechsel des Vorgesetzten,Versetzung,erhebliche Änderung der Tätigkeit,längere Abwesenheit, etwa Elternzeit oder längere Erkrankung,Betriebsübergang,Bewerbung oder berufliche Neuorientierung.Die Grundsätze zum Zwischenzeugnis sind durch das BAG seit Jahren geprägt. Spannend bleibt aber, wie konkret eine berufliche Neuorientierung künftig dargelegt werden muss. Das Lied "Nun gehören unsre Herzen ganz dem Mann von Golgatha" von Friedrich von Bodelschwingh von 1938 fasst das Ereignis des Todes Jesu auf Golgatha unvergleichlich zusammen. In this Movie Show Digital Extra, Blair Treu, writer/director/producer for the new documentary film Sharing Aloha joins Andy Farnsworth to talk about the movie and the people involved in creating the magic of Hawaii’s #1 attraction, the Polynesian Cultural Center.  Treu's film tells the story of how Pacific Rim students come as strangers to the PCC and earn their living, as well as college scholarships, leaving school debt-free. They are the Life and Heart of the PCC and perform and host the 90,000 monthly visitors from around the world Treu describes this film as THEIR true story and culture that they learned from the feet of their ancestors. There are 8,000 students each semester that come as complete strangers and leave as one Ohana. This has continued for 60 years with no end in sight. What makes this film different than many is that all proceeds from the movie directly fund additional scholarships for students gathered from around the Pacific Rim. Blair Treu is an award-winning director whose work includes a variety of feature films, television shows, documentaries, and commercials for over 30 years—from The Power Rangers to Chicken Soup for the Soul. The writer and director of Sharing Aloha and Meet the Mormons, he graduated from Brigham Young University with a bachelor's degree in Theatre and began his career at the Walt Disney Company. More recently, Blair worked with BYUtv to create the series Real Families, Real Answers, and was a co-director of Granite Flats.
