Learn how the mode of selecting the President was the result of a hard fought and contentious Constitutional Convention debate, resulting in the adoption of Article II, Section 1 of the United States Constitution. Review that the idea of a popular, nationwide election was rejected because, among other things, there were serious concerns that the public would not have sufficient information, and the public would be swayed by bias to local candidates, passion, and celebrity. Understand that the idea of a Congressional election of the President was rejected because, among other things, of grave concerns about the independence of the President, as well as formation of cabals and corruption. The electoral college was intended to mediate the passions of the people as well as the dangers of elections by Congress by creating an independent body, whose sole function was to select the best candidate. Review how electors are chosen is determined by the Legislature of each state. Each State has the number of electors equal to the number of representatives in the House of Representatives and Senators. Learn the mistakes the Founding Fathers made in connection with the Presidential Election (for example, having the runner-up become Vice President) - and how paralyzed the nation during the election of 1800. The President and Vice President now run as a slate, and electors cast one vote for each. A person receiving an outright majority of electors becomes President and Vice President respectively. Otherwise, the House of Representatives chooses the President, selecting from the top three vote getters. Each State has one vote, chosen by a majority of its representatives. A similar process works for the Vice President, but he or she is chosen by the Senate out of the top two vote getters. Originally, most electors were chosen directly by the legislatures of the States. Over time, States determined to select their electors by popular election, with 48 of the 50 States choosing a winner takes all system. In Ep#24 we speak about the differences between harassment and bullying and in what circumstances, and exactly how, the legislation applies. Do customers and clients come under the definition of workplace? Yes they do. Does the workplace include after work drinks at the pub? Yes it does. Brent talks about the strategies and approach managers can take to protect employees. He also talks about how sexual harassment can evolve into sexual assault. An assessment of human rights forms an important part of our investment process. A workplace free of harassment and bullying is a basic human right for everyone. But to recognise it and assess it, first you need to understand it. Examples. 52.52 Each State and Territory has legislation that deals with unlawful sexual assault. For the 2023 Super Bowl alone, an estimated $16 billion was spent on legalized gambling, including mobile apps, live casinos and other technologies. With 21 states now allowing gambling on sports, the activity is in its infancy in the U.S. The next big sporting event-NCAA March Madness, promises to add to the amount of money changing hands between sports books and fans, leading to positive tax revenues directed to State treasuries. Each State is different, with some taxing video terminals at a much higher rate than mobile apps. In West Virginia, the legislature decided to tax mobile betting at a much lower rate than in person casino betting, leaving a massive gap between them and other States like New York. This revenue gap is likely to have a significant impact on funding for education, including higher education, once the Covid relief funds from Congress expire. My guest today has studied the revenues and tax implications for higher education from all forms of gambling for most of his academic career. Brad Humphreys is a professor of economics at West Virginia University. His research on the economics and financing of professional sports, and the economics of gambling has been published in academic journals in economics and policy analysis. He twice testified before the United States Congress on the economic impact of professional sports teams and facilities. He has also testified before the Massachusetts legislature and Washington DC City Council on the financing of sports facilities. Brad joins me for a conversation that crystalizes the challenges gambling, gaming, media and technology bring to college athletics and higher education. This is an important topic for senior leaders to get their arms around.

ABUJA – In receipt of reports from judicial panels regarding EndSARS protests set up in 28 States across the country and in the FCT, the National Economic Council have resolved that payment of compensation to victims should proceed with each State, in collaboration with the Federal Government, establishing the modalities for the settlement of all monetary compensations awarded by the panels.According to a release e-signed and made available to StarTrend Int'l & online – www.startrendinternational.com by ‘Laolu Akande, Senior Special Assistant to the President on Media & Publicity, Office of the Vice President, equally, NEC, which is composed of all State Governors in the Federation and representatives of the FG, Chaired by Vice President Yemi Osinbajo, SAN, also unanimously resolved on Friday, October 15, 2021, to ensure the prosecution of persons indicted by the panels. The Council specifically directed States “to immediately forward copies of final reports of the panels to their Attorneys-General for prompt arraignment and prosecution of all indicted persons.“Where incidents in the reports relate to matters of discipline, in addition to prosecution, NEC urged the Nigeria Police Force to take disciplinary action on the affected officers in line with the provisions of the Police Act 2020.”Also rising from today's NEC meeting, members strongly advised those planning protests to mark the anniversary of the ENDSARS to reconsider the option in view of “current security situation across the country and the possibility of such protests being hijacked by armed hoodlums and other opportunistic criminals to cause mayhem at such protest events and venues.”Below are the NEC resolutions on the panels and an advisory on the planned protests:NATIONAL ECONOMIC COUNCIL RESOLUTIONS ON “ENDSARS” PANELS' REPORTS ACROSS THE COUNTRY – 15TH OCTOBER 2021At its meeting today, 15th October 2021, the National Economic Council (NEC/Council) received an update on the Reports of Judicial Panels of Inquiry into Allegations of Human Rights Violations against Members of Nigeria Police Force and other Security Agencies.2. It may be recalled that following the October 2020 #EndSARS protests, which later transformed into violent demonstrations, in furtherance of resolution of NEC, twenty-eight (28) States and the Federal Capital Territory (FCT) (under the auspices of the National Human Rights Commission) had set up Judicial Panels/Commissions of Inquiry (Panels) to investigate allegations of violations of human rights levied against members of the Nigeria Police Force and other security agencies, especially members of the disbanded Special Anti-Robbery Squad (SARS).3. The 28 States that set up these Panels were Abia, Adamawa, Akwa Ibom, Anambra, Bauchi, Bayelsa, Benue, Cross River, Delta, Ebonyi, Edo, Ekiti, Enugu, Gombe, Imo, Kaduna, Katsina, Kogi, Kwara, Lagos, Nasarawa, Ogun, Ondo, Osun, Oyo, Plateau, Rivers, and Taraba.4. Out of the 28 States, 11 States (Abia, Ekiti, Enugu, Gombe, Kwara, Nasarawa, Ogun, Ondo, Osun, Plateau, and Rivers) have submitted their final reports to Council; with Lagos, set to finalise its sittings on 19th October 2021, submitting an interim report. Governors of other States including Delta and Ebonyi at today's meeting also indicated that their reports would be submitted soon.5. Following deliberations on the recommendations of the panels, NEC agreed/resolved as follows, (and this applies to all the States and FCT that set up the panels):PAYMENT OF COMPENSATION TO VICTIMS6. Each State, in collaboration with the Federal Government, shall establish modalities for the settlement of all monetary compensations awarded by the Panels. Already, as resolved by NEC, a number of States have set up Victims Compensation Funds, from which several victims have already received payments of sums awarded to them by the panels.PROSECUTION OF INDICTED PERSONS (SECURITY PERSONNEL AND CIVILIANS)7. Council directed State Governors to immediately forward copies of final reports of the panels to their Attorneys-General for prompt arraignment and prosecution of all indicted persons.8. Where incidents in the reports relate to matters of discipline, in addition to prosecution, NEC urged the Nigeria Police Force to take disciplinary action on the affected officers in line with the provisions of the Police Act 2020.IMPROVED EFFICIENCY OF NIGERIA POLICE FORCE AND OTHER SECURITY AGENCIES' ARCHITECTURE9. NEC called on the leadership of the security agencies to ensure that –a. Persons recruited into arms-bearing security agencies undergo psychiatric evaluations and drug tests before enlistment and periodically after enlistment to ensure that the personnel are psychologically fit to carry live weapons and to identify behavioural tendencies that may require psycho-social interventions.b. Personnel of the agencies dutifully observes Rules of Engagement in the discharge of their functions/duties around and within the civilian populace.c. While acknowledging the various initiatives introduced by the Federal Government to:*strengthen police accountability through the Police Service Commission,*sustain improved funding and budgetary allocation to the Nigeria Police Force and other securities agencies,*and the lifting of the ban on recruitment of police officers,Council urged the Federal Government to give priority to the general welfare of police officers and personnel of other security agencies.In particular, it advocated the review of pension and gratuity of retired police officers and attainment of parity of remuneration by police officers with sister security agencies.d. Undertake a comprehensive assessment of all police stations across the country with a view to ensuring that they are fit for purpose.e. Nigeria Police Force and other security agencies should deploy cutting-edge technology in the fight against crimes.f. Nigeria Police Force to, in line with the mandatory training provisions of the Police Act 2020, prioritize training of Police Officers on procedures for the entrenchment of Human Rights Provisions guaranteed by the Constitution and on the professional handling of weapons.g. All those detained by the Police as a result of the EndSars protests are expeditiously processed with due regard to the principles of fair hearing.h. The system established within the Nigeria Police Force for receipt and handling of complaints or petitions is strengthened, and all police officers on duty should be in police-approved uniform with their full names and force numbers boldly written for easy identification.i. The States should, as resolved by NEC:i)Properly utilize and support the community policing programme of the Federal Government, with active collaborative efforts and participation of traditional rulers, elders, youths, vigilante groups, etc.;ii)Establish standing committees under States Ministries of Justice to address human rights violations on a continuous basis; andiii)Take measures aimed at flushing out miscreants squatting in uncompleted buildings, and other blackout spots that serve as hideouts for criminals.THE NATIONAL ECONOMIC COUNCIL ALSO ISSUED AN ADVISORY ON PUBLIC PROTESTS AT THIS TIME AS FOLLOWS:While appreciating the role of lawful peaceful protests in the advancement of public discourse under democratic governance, the National Economic Council (NEC) strongly advises those planning public protests across the country to mark the anniversary of the #EndSARS, to consider other lawful alternative means of engagement.This is because of the current security situation across the country and the possibility of such protests being hijacked by armed hoodlums and other opportunistic criminals to cause mayhem at such protest events and venues. Council, therefore, urges the organizers to reconsider their plan.NEC would also like to point out the various actions already taken by Federal and State Governments to address the grievances that led to the 2020 protests, including:* the disbandment of SARS;*broad police reforms;*establishment of judicial panels of inquiries to investigate allegations of human rights violations by members of the Nigeria Police Force and other security agencies;* recommendations of which panels are already at various stages of implementation including the setup of Victims Compensation Funds from which several victims have received payments of sums awarded to them by the panels;*and prosecution of police personnel indicted by the panels.These are commendable actions that ought to be taken to a logical conclusion in a peaceful atmosphere.Organizers of the planned protests should explore the various channels of communication with governments at various levels to advance their positions and avert the breakdown of law and order that may result from such public protests.Credit- Startrend International

The TL;DW is that the United States of America was founded as a federal republic whose sole purpose was and is/should be the representation of the citizens of the distinct States that united in 1776... just the representation, though. Not the direct input. It was never designed as a democracy, and never has been. It was agreed among most of the "Framers" of the Constitution that a direct, popular vote for President meant that 51% of citizens could be cajoled into voting for a great showman but incompetent leader. In 1776, the States had essentially evolved into their own countries, but had to form a federation (now the oldest extant one in the world) or be conquered by the 18th century European superpowers (England, Spain, and France). Because of their colonial origins though, they demanded to retain their sovereign right to make laws that represented the will of their people. So, the electoral college was created and cemented into the U.S. Constitution as a way for each State's directly-elected officials (representing the voice of the people, and liable to be voted out of office if failing to do so) to personally vet and select "Electors" from their State whose sole task was to deliberate and vote for a President. Each State would receive a number of Electors equal to the number of representatives they have in the U.S. Congress. (This is 2 senators for every State, and a number of Representatives proportional to the State's population.) Which ever Presidential Candidate wins the majority (greater than 50%) of electoral votes wins. Most of the time we don’t think about in-home care for our loved one until a major event happens, such as a fall, a stroke, or some other serious injury or condition. When we are in crisis mode, we tend to rush onto a partnership with the first available Home Care Agency, even if they may not meet our loved ones wants and needs. Finding the best agency for your loved one can take time, careful research and conversations about home care preferences. The best option can look different for each family. The first thing I suggest is talking with your loved one and deciding what is most important to them when it comes to hiring an agency to come into their home. Opening up the conversation with your loved one and having their input will make them feel in control of their own care and make them feel heard. That normal makes the transition into getting help a lot easier. Then the conversation will give you a starting point when looking into local agencies. Each State has their own laws and regulations for Home Care agency to follow. Make sure that all agencies are up to date on their license’s and training. Hiring an unlicensed agencies or persons can be very dangerous for your loved ones. I always encourage families to not hiring an individual caregiver, because of the dangers that could be involved. They do not have any workers comp insurance on themselves, so if an injury were to happen in your loved one’s home, they could sue your loved one or their homeowner’s insurance. There is no back up if they need a day off or vacation. There is no supervising of the care from a care manager or care coordinator. They could be providing care wrong and not even know that they are doing anything wrong. When we are hiring an individual ourselves, we are also not able to vet the caregiver as an agency can. The safety of our loved ones is always our main priority When looking for agencies we can use our resources to help find a reputable and experienced in-home care agency. Look online for reviews, ask friends and family about recommendations or ask your loved ones primary Doctor for recommendations. Then you will be able to call the agency and ask questions and set up an in home assessment with your loved one, so you and your loved one will know what that agency offers and how they can help your loved one. Here are the things I would suggest asking during your home assessment. 1. What is the vetting process for staff? Background check? Drug testing?2. Is the agency licensed and bonded?3. Agency minimum of hours? Most common is 3-4hours per shift. 4. Can the level of care change as the need changes?5. Do they offer any other services? Fall sensors? Medication management?6. How will the care be managed?7. Who is the contact person within the agency?8. Can the office be reached just during office hours?9. How is this paid for? Out of Pocket? long term ins? Medicare/ medicaid Thats my top 9 questions while having your in home assessment.

CDBG or otherwise known as Community Development Block Grants.  Most communities have it but what exactly is it?  Most people might know it because either their community uses those funds for sidewalk improvements or use them to help low-to-moderate income homes with improvements.  Better yet, your community might use them for both.  In this week's episode, we'll take a look at what CDBG is, why was it established, does reform need to happen?, and what we feel communities should be using these funds for.  Each State administers this block grant to local communities differently and can have different or the same programs as other states, depending on their needs.  Although we have only started the dig on what CDBG really is, the three of us can agree that there are small and large needs that communities can use these funds for but do you know what those projects are?  Do you know that you have a voice in those projects or better yet, do you know what programs your community offers?

Article 2Section 1The executive Power shall be vested in a President of the United States of America.He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows:Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves.And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate. The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted. The Person having the greatest Number of Votes shall be the President, if such Number be a Majority of the whole Number of Electors appointed; and if there be more than one who have such Majority, and have an equal Number of Votes, then the House ofRepresentatives shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President. But in chusing the President, the Votes shall be taken by States, the Representatives from each State having one Vote; a quorum for this Purpose shall consist of a Member or Members from two thirds of the States, and a Majority of all the States shall be necessary to a Choice. In every Case, after the Choice of the President, the Person having the greatest Number of Votes of the Electors shall be the Vice President. There is no consistent law or ideas on how midwives should operate on a federal level. Each State has it's own idea and law either for or against who can attend. Today, I'm focusing on my home State of Nebraska. We have been in a fight, especially during this Corona season, for midwives to openly attend the many women looking to have a homebirth and avoid the hospital. Julie's resilience has been boosted with daily exercise, including yoga, to help keep calm. There has been a lot of information to take in and review on what the best approach should be. Hey Medicare Nation! We're smack in the middle of a Corona Virus Pandemic! The Medicare Nation I wanted to give you an episode that is full of USEFULL information. I know you've been hammered by the news, internet and newspapers about the Corona Virus. Let's start with a very important fact: Human coronaviruses were first identified in the mid-1960s. The 1960's people! the coronavirus gets its name from a distinctive corona or in a scientists world…a “Crown of Sugary Proteins,” that projects from the surface of the virus. There are four main types of Human Corona Viruses Alphacoronavirus,  Betacoronavirus,  Gammacoronavirus, and  Deltacoronavirus. The first two only infect mammals, including bats, pigs, cats, and humans.   Gammacoronavirus mostly infects birds such as poultry (chickens) and Deltacoronavirus can infect both birds and mammals. Do you recognize the Virus named SARS? Severe acute respiratory syndrome abbreviated as …. (SARS-CoV) SARS-CoV (the beta coronavirus.  Guess what it causes?  It causes severe… acute…..respiratory syndrome, SARS was first recognized as a distinct strain of coronavirus in 2002. The source of the virus has never been clear, though the first human infections can be traced back to the Chinese province of Guangdong in November of 2002. The virus then became a pandemic, causing more than 8,000 infections of an influenza-like disease in 26 countries with close to 800 deaths. In the United States, only eight persons were laboratory-confirmed as SARS cases. There were NO  SARS-related deaths in the United States. All of the eight persons with laboratory-confirmed SARS had traveled to areas where SARS-CoV transmission was occurring. By July of 2003….. the World Health Organization declared the outbreak over. On February 11, 2020 the World Health Organization announced an official name for the disease that is causing the 2019 novel coronavirus outbreak, first identified in Wuhan China. The new name of this disease is….SARS-COV-2 aka coronavirus disease 2019, abbreviated as COVID-19.  ‘CO’ stands for ‘corona,’ ‘VI’ for ‘virus,’ and ‘D’ for disease. The Medicare Nation COVID-19 is a new disease, caused by a novel (or new) “coronavirus” or strain of “Corona Virus” that has not previously been seen in humans. What are the Symptoms of COVID-19?  The CDC (Centers of Disease Control) have listed these as the most common symptoms of COVID-19: Fever Cough Shortness of breath Symptoms may appear 2-14 days after exposure. Reported illnesses have ranged from mild symptoms….like a dry cough…. to severe illness, with high fever and shortness of breath, requiring hospitalization and there have been deaths reported for confirmed coronavirus disease 2019 (COVID-19) cases.   Currently……according to the WHO… as of March 13th….there are over 132, 758 reported cases of    COVID-19 …. Worldwide. Of those cases….. there are 4,955 Deaths worldwide. Over 80% of the reported cases are recovering. In the U.S…… there are currently 1,629 reported cases…… in 47 of the 50 States. No reported cases yet….in Idaho, Alabama and West Virginia. There have been 41 Deaths reported in the U.S. ….. with 37 Deaths coming from the State of Washington. The deaths mainly being reported from a nursing facility, with those being elderly and having underlying medical conditions prior to contracting the CoronaVirus. What do we mean by Underlying medical conditions????  If you have a blood disorder.... like sickle cell disease... or ... you have chronic kidney disease.... you're currently receiving chemotherapy or radiation. You may have congestive heart failure or coronary artery disease. You may have chronic asthma or chronic obstructive pulmonary disease or you may need oxygen at home. All of these conditions..... as well as many more..... may raise your risk of contracting COVID-19. You may NOT contract the virus. Just be more cognizant of your surroundings and who you are in contact with. What do you do if you believe you have symptoms of the COVID-19? NUMBER 1…. Call your Primary Doctor. Speak with the Nurse or Physician’s Assistant. Tell them your symptoms and they will advise you of what to do.  IF You CANT get Through to your Doctor……. If you have a Medicare Advantage Plan…… the Plan most likely has a 24 hr. Nurse’s Line.  CALL THEM!!  Tell the nurse  your symptoms. They will advise you. Call your STATE Health Department for Advise. Each State has an information line dedicated to the COVID-19 Crisis and will be able to assist you with answering question. If you have any severe symptoms….. as in Difficulty Breathing, fluid in your lungs, High fever of over 104 degrees…. CALL 911!   If you do have symptoms, and your doctor wants you to have the test to confirm COVID-19…. Where do you go?? According to the FDA….. here is the current list of laboratories across the U.S. that will be offering testing for the COVID-19 very soon  Advent Health Laboratories  Lab Corp Quest Laboratories As well as many other public health, university and private labs will be available on the FDA list of laboratories to test for the COVID-19. Medicare IS Covering the Test for COVID-19 as a Preventative Diagnostic Test….and therefore ….. you will have NO COPAY when you take the test. There are currently  TWO Testing Codes for the COVID-19 Test Is for having the Test at a Public Health Lab ( your local community Health Department) which is U0001 The 2nd is for having the test at a commercial or private lab (like Lab Corp) which is U0002.   If you are diagnosed with COVID-19, self-quarantine yourself in your home, away from your family members and pets, until you have tested negative. We ALL need to SELF-Police ourselves and HELP STOP the Spread of COVID-19….. so we can curtail the spread and help stop the pandemic.  Remember to Drink lots of fluids….. eat plenty of chicken soup and crackers ….. and get lots of REST!! The Medicare Nation You can go to the Center for Disease Control website for daily updates on the Corona Virus 19 situation ….. go to….. www.CDC.gov   You can also go to the World Health Organization website…. Go to …. www.who.int   AND…. PLEASE go to your STATE”S Health Department website for local information by “Googling” your State.  That’s all for today Nation. Call your Parents….. SOUTH PADRE ISLAND, RGV - The Texas Border Coalition held its 2019 annual meeting on Thursday, Oct. 24, in the Blue Marlin Room at Pearl South Padre Resort on South Padre Island.The meeting included a wide-ranging panel discussion on the innovative ways border communities are preparing for the 2020 Census. The panel discussion was titled “Counting the Whole Number of Persons in Each State: 2020 Census Preparations in the Border Region.” Cynthia Garza-Reyes, representing the City of Pharr, said her city would be utilizing the technology skills of high school students to ensure a thorough census count.“We are in a different environment to what we were ten years ago. As a city we acknowledge the value of our students in terms of how they are equipped when it comes to technology,” Garza-Reyes said.“We are assuming that a lot of the count will be done through our student population. We are working with each school district to come up with collaborative ways to make sure that each family is counted through the student.”In addition to Garza-Reyes, the panel consisted of Cameron County Clerk Sylvia Garza-Perez, Nestor Lopez, representing Hidalgo County, and Albert Morales, representing the U.S. Census Bureau. LeRoy Cavazos, senior manager of public affairs and communication at Coca Cola Southwest, moderated the panel discussion.
