Today we welcome Bill Marler Meet William Marler An accomplished attorney and national expert in food safety, William (Bill) Marler has become the most prominent foodborne illness lawyer in America and a major force in food policy in the U.S. and around the world. Marler Clark, The Food Safety Law Firm, has represented thousands of individuals in claims against food companies whose contaminated products have caused life-altering injury and even death. He began litigating foodborne illness cases in 1993 when he represented Brianne Kiner, the most seriously injured survivor of the historic Jack in the Box E. coli O157:H7 outbreak, in her landmark $15.6 million settlement with the company. The 2011 book, Poisoned: The True Story of the Deadly E. coli Outbreak that Changed the Way Americans Eat, by best-selling author Jeff Benedict, chronicles the Jack in the Box outbreak and the rise of Bill Marler as a food safety attorney. For the last 26 years, he has represented victims of nearly every large foodborne illness outbreak in the United States. He has filed lawsuits against such companies as Chili's, Chi-Chi's, Cargill, ConAgra, Dole, Excel, Golden Corral, KFC, McDonald's, Odwalla, Peanut Corporation of America, Sheetz, Sizzler, Supervalu, Taco Bell, and Wendy's, securing over $700,000,000 for victims of E. coli, Salmonella, Listeria, and other foodborne illnesses. Among the most notable cases he has litigated, Bill counts those of nineteen-year-old dancer Stephanie Smith, who was sickened by an E. coli-contaminated hamburger that left her brain-damaged and paralyzed, and Linda Rivera, a fifty-seven-year-old mother of six from Nevada, who was hospitalized for over 2 years after she was stricken with what her doctor described as “the most severe multi-organ [bowel, kidney, brain, lung, gall bladder, and pancreas] case of E. coli mediated HUS I have seen in my extensive experience.” New York Times reporter Michael Moss won a Pulitzer Prize for his coverage of Smith's case, which was settled by Cargill in 2010 for an amount “to care for her throughout her life.” Linda's story hit the front page of the Washington Post and became Senate Majority Leader Harry Reid's touchstone for successfully moving forward the Food Safety Modernization Act in 2010. This week, we’re joined by Brandon Schwartz and Lawrence Cisneros, the co-founders of DRNXMYTH, a brand of ready-to-pour fresh cocktails whose proprietary bottle and ultra-high quality ingredients have made its products among the most unique -- and sought after -- offerings in the spirits industry. Amid a rapidly expanding market for ready-to-drink cocktails, DRNXMYTH has differentiated itself via an innovative package that keeps the spirit and a cold-pressed juice-based mixer separate until the time of consumption. A twist of the bottle and a quick shake and the result is a fresh craft cocktail. Dave is a star in the ticketing and entertainment industry, and he's the guy that American Express referred to as The King of Tickets. Dave has a fascinating story to share! In today's show, he talks to us about creating revenue, how to deal with change, and reinventing yourself. He also tells some amazing stories that are sure to inspire you! Dave Wakeman's bio Dave Wakeman is “The Revenue Architect.” His consulting work has attracted clients such as American Express, Manhattan Construction Company, Volunteers of America, Yahoo!, the United States Department of State, the Seattle Seahawks, and over 100 other leading companies from around the globe.  Dave is widely known for his work in modernizing the secondary ticket market and partnering with American Express and Circles on their Black Card ticketing program that revolutionized the way that people buy tickets and view the secondary market.  With his consulting firm, the Wakeman Consulting Group, Dave has turned his focus to helping organizations around the globe maximize their profitable revenue.  Dave is a powerful advocate for the need for businesses to tell stronger brand stories and that explosive growth isn't a miracle. It is a product of having a great strategy combined with the right marketing and sales efforts.  You can see Dave regularly writing and being interviewed about marketing and revenue in the pages of SEAT Magazine, The Seattle Times, The New York Post, and US News and World Report. Nightclubs Dave started his career opening nightclubs in the mid-1990s, and he opened nightclubs all over the country. The club that he opened in St. Louis did not do very well, and that led Dave to one of the best opportunities of his career. A great career opportunity Dave moved to Seattle, knowing no one there, and with about $600 in his pocket. He landed a job working for Paul Allen, who helped start Microsoft with Bill Gates.  A talent for marketing Dave helped Paul to open the Experience Music Project, which is on the grounds of the Seattle Center and is now called the Museum of Pop Culture (MoPOP). That was where Dave discovered that he had a marketing talent. Dave Wakeman's move to New York    Dave Wakeman's marketing ability led him to many different places. He moved to New York and worked with a company called Americana Tickets. That was where he worked with American Express and the Centurion Card, helping them to figure out how to buy and distribute tickets for their clients all over the world. Dave worked on many different projects Together with the ad agency for Yellowtail Wines, Dave threw Tailgate parties in 36 cities. That was one of the key ingredients that helped Yellowtail to grow and get into Costco. He worked with Coca-Cola on the launch of their Odwalla product, the efforts to support the Affordable Care Act in America and to get President Obama re-elected in 2012. He also did a lot of work in Australia.  Generating money Dave Wakeman grew up in very modest circumstances. He realized very early on that the way to make something of himself would be through his ability to generate money and to market and sell effectively. Over the years, he developed an eye for the things in which people look for and find value. Dave Wakeman's thoughts on creating value Dave understands that if you can create enough value for the people you're aiming to serve, then you should also be able to collect some of that for yourself. Unique experiences in LA Dave helps people get registered to vote through #iVoted, which also invites people to attend virtual concerts with some great artists.  Helping non-profits Dave loves to give back, so he often uses his expertise to help non-profits. Creating revenue  If you want to create revenue or have the most impact, you consistently need to ask three questions: What is the value you're trying to create?     Who is the customer that will pay you?     How do you reach those people? You need to focus on the value that you're trying to create for people, you need to find the specific person who you can help, and you need to communicate effectively. Strategy and tactics Strategy is where you're trying to get to, and tactics are how you get there. Lack of precision Dave believes that when people lack precision when they speak, it leads to poor outcomes. The King of Tickets Dave Wakeman attributes becoming known as The King of Tickets to luck, his excellent relationship-building skills, and technology. You are not replaceable Dave points out that your ability to be you is not replaceable. So, you need to invest in having a point of view, relationships, and finding ways to create value for the people you serve because none of those are replaceable. Coping with change We need to embrace change. So, although we are going through a terrible time right now, you should not give up because people will come back.   Recognizing and embracing the power of change Change will come, no matter what. Many years ago, Dave learned that change is the only thing in life that is certain. And when change rears her beautiful face, you must embrace her because change is the only thing that you have.  Reinventing yourself, coming out of the pandemic Coming out of the pandemic, you don't have to be the same person you were going into it. The key to reinventing yourself lies in looking at what you want to do and who you want to become going forward. “I’m starting a new category.” It’s a familiar refrain often heard in the food and beverage industry, even if most times what’s spoken isn’t necessarily true. But in the rare cases in which an entrepreneur is indeed breaking new ground, the challenges are plentiful. GT Dave, the founder of GT’s Living Foods and a pioneer in packaged kombucha, has experienced  firsthand the difficulties of introducing an entirely new category to the market after launching his brandin 1995. For years, GT’s was the singular bottled kombucha brand and paved the way for what is now a thriving category that includes dozens of players. Reflecting on the first few years of his business in an interview included in this episode, Dave said that entrepreneurs should carefully consider consumer needs before launching a product that sits outside the lines of traditional food and beverage categories. “To me, looking back, the questions that need to be answered to define and determine if you’re creating a new category [are], ‘What is it that the consumer needs and wants?’ and ‘Why are they not getting it?’ and ‘How am I, the company, the brand owner, the pioneer… going to satisfy that need?’ he said.” Dave also discussed why being an “artistic sponge” supported GT’s development,spoke about his approach to working with competitors and emphasized the importance of authenticity in and around the bottle. Bill Marler is the most prominent foodborne illness lawyer in America, and a major force in food policy in the U.S. and around the world. Bill’s firm—Marler Clark: The Food Safety Law Firm— (https://marlerclark.com/) has represented thousands of individuals in claims against food companies whose contaminated products have caused life-altering injuries and even death. Bill began litigating foodborne illness cases in 1993, when he represented Brianne Kiner, the most seriously injured survivor of the historic Jack in the Box Escherichia coli O157:H7 outbreak, in her landmark $15.6 million settlement with the fast food company. For the last 25 years, Bill has represented victims of nearly every large foodborne illness outbreak in the U.S. He has filed lawsuits and class actions against Cargill, Chili’s, Chi-Chi’s, Chipotle, ConAgra, Dole, Excel, Golden Corral, KFC, McDonald’s, Odwalla, Peanut Corporation of America, Sheetz, Sizzler, Supervalu, Taco Bell, and Wendy’s. Through his work, he has secured over $650 million for victims of E. coli, Salmonella, Listeria, and other foodborne illnesses. Bill Marler’s advocacy for a safer food supply includes petitioning the U.S. Department of Agriculture to better regulate pathogenic E. coli, working with nonprofit food safety and foodborne illness victims’ organizations, and helping spur the passage of the Food Safety Modernization Act. His work has led to invitations to address local, national, and international gatherings on food safety, including testimony before the U.S. House of Representatives Committee on Energy and Commerce, and the British House of Lords. Bill travels widely and frequently to speak to law schools, food industry groups, fair associations, and public health groups about the litigation of claims resulting from outbreaks of pathogenic bacteria and viruses, and the issues surrounding it. He gives frequent donations to industry groups for the promotion of improved food safety and has established numerous collegiate science scholarships across the nation. He is a frequent writer on topics related to foodborne illness. Among other accolades, Bill was awarded the NSF Food Safety Leadership Award for Education in 2010. Greg Steltenpohl, the CEO of Califia Farms and a beverage entrepreneur for nearly four decades, is constantly thinking about innovation. For Steltenpohl, who cut his teeth in the beverage business in 1980 with the launch of super-premium juice brand Odwalla, meeting the evolving needs of a growing base of young, educated and health-conscious consumers has made new product development a cornerstone focus for Califia. Since launching in 2010 the company has embraced several fast-growing beverage trends, including dairy alternatives and cold brew coffee, and introduced a steady stream of new brand and line extensions. But Steltenpohl is pushing for more. The podcast team recently met with Steltenpohl at Califia Farms headquarters in downtown Los Angeles, and as part of a wide-ranging discussion he offered insight into how the company identifies opportunities to innovate and executes from concept to product launch. Steltenpohl also discussed the role of package design and technology and predicts how each will evolve in the coming years, particularly as it relates to consumer education and marketing. Additionally, Steltenpohl revealed Califia’s plans to launch a line of organic products as part of its overall innovation philosophy.

Two beverage empires came from humble beginnings. Greg Steltenpohl realized that playing saxophone in an avante garde punk jazz band wasn't going to pay the bills, so in 1980 he and his buddies decided to start a juice business. They would hand-squeeze oranges out of the back of his VW van and deliver the product& to nearby restaurants in Half Moon Bay. More than two decades later, the company called Odwalla had pioneered a fresh juice craze and was acquired by Coca-Cola for $181 million--much to his chagrin, because they lost the vision in the process. He is seeking redemption through his current business, Califia Farms. He is rethinking food to make agriculture more sustainable, and he is driven to change our love affair with cattle. His entrepreneurial drive isn't always healthy, though. At one point he needed a liver transplant and he was so single-minded he ignored the very real threat to his life and continued to launch his company. Greg recounts many of the challenges he faced over the years building his businesses, from draughts to e. coli. His story reminds us of the unglamorous moments and the often long slog it takes to build something big. And he shares what it feels like to have a boardroom full of suits sell his company out from under him—and his determination to give it another go through Califia Farms. Since gaining a reputation through his litigation during the infamous 1993 Jack-in-the-Box E.coli outbreak, Marler has worked on cases involving companies like McDonald’s, Odwalla, and most recently, Chipotle. He’s also a major force in food safety policy and runs a website called Food Safety News. During our conversation, he traces the rise of illnesses like E.coli and salmonella (“We have to keep up with these bugs”), gives us some tips on avoiding them, and reveals the real scoop on thrice-washed-spinach. She was previously the Regional Director of Community Relations for Citibank in Greater Southern California. Prior to Citibank she operated a small consulting practice in corporate social responsibility. The work focused on building strategic partnerships between nonprofit organizations and corporations, strategic planning, communications and marketing. She has worked in myriad areas ranging from telecommunications policy, disability access to multimedia projects. Examples of her work include designing a highly successful technology job training program for low income adults and youth, creating a brand strategy for a buy local food campaign and marketing programs to reach emerging markets. Her firm's clients included: AOL, Verizon, Microsoft, Independent Television Service (ITVS), San Francisco Giants, Freddie Mac Foundation, W. K. Kellogg Foundation and the FoodRoutes Network. Susan has held senior positions in Communications and Marketing with Odwalla and Pacific Bell. Prior to her work in the private sector Susan served as a senior staff member to Willie L. Brown, Jr. during his tenure as Speaker of the California Assembly. She is an alumna of the Coro Fellows Program, and received a Bachelor of Science degree from the University of California at Berkeley and a Masters of Public Policy degree from Claremont University. Small business is about doing what needs to be done for the customer in front of the counter. It’s the model of innovation, efficiency, and customer service. So when Intuit, which serves small businesses with its tax and accounting software, and eBay, arguably the largest small business incubator in the world, wanted to talk to small businesses about green initiatives, they had a lot to say. Now both Intuit and eBay have sites for the small businesses they serve to ‘talk green.’ They’ve picked up a lot of insight. In September, eBay launched the reuseable eBay box. The green revolution comes from the far ends of individual thinking, lab science, and it can lead to legislation that sometimes vindicates and sometimes blindsides small businesses. Some small businesses already have solutions. Everyone could use a little more information-sharing. The information is difficult to aggregate, but it’s out there. Amy Skoczlas Cole, of eBay says in 2007 the eBay Green Team assembled forty-strong, grew to 24,000 employees, and when they opened it to eBay users, 300,000 signed on. eBay Green Team members had to learn it was a two-way conversation. Better ideas from their sellers led them to change strategy from “providing information” to “asking questions to provoke conversation.” eBay customers were particularly interested in reducing package waste. One outcome is the reuseable, trackable, eBay Box, launched in September 2010. Intuit has a very successful site for sharing small business tax tips. Now, through IntuitGreen.com, small businesses can share green ideas, too. Rupesh Shah of Intuit has found small businesses have practiced ‘corporate responsibility’ as a matter of course, long before it had a name. They’re concerned about waste, especially of time and money, yet they’re very focused on keeping good relationships in the community around them. But sometimes shear lack of time isolates small businesses from information that can keep them in synch with the times. Amy Skoczlas Cole’s passion for the natural world started in kindergarten, when she first wrote an essay on her love for koala bears. After studying environmental policy in college, she joined the staff of Conservation International (CI), where she turned her passion into a career. At eBay, she leads all the different aspects of the company’s environmental strategy. What excites her most, though, is tapping into the collective power of the 90-95 million people who use eBay to make a real difference in world. That’s why she loves running the eBay Green Team, building a movement to help consumer save money and the planet at the same time – by using products that already exist in the world. Rupesh D. Shah is the Director of Corporate Sustainability at Intuit, a leading software solutions provider and the makers of TurboTax and QuickBooks. Rupesh has led a wide-variety of initiatives including new products and partnerships, conducting detailed environmental assessments, developing corporate-wide sustainability goals, and increasing the transparency of Intuit’s efforts. Prior to that, Shah was Director of Product Management for TurboTax Business products and previously he helped to create and launch new industry-specific versions of QuickBooks. Shah has also served as Manager of Learning and Development at Odwalla and Training Manager at Earth Train, an environmental nonprofit organization dedicated to providing youth leaders the skills, resources, and network to make a difference in their local communities. He has also consulted for AmeriCorps, the Presidio Leadership Center, the Corporation for National Service, Gorbachev Foundation, the United Nations and various other leading social organizations around the world.
