In this episode, Lotte Rubæk, MSc, who leads the Self-Injury Team in Child and Adolescent Psychiatry in the Capital Region of Denmark, talks about why interaction on image-based social media platforms like Instagram can be particularly appealing to young people who self-harm. Seit heuer ist der ORF verpflichtet, die Allgemeinheit alljährlich über die Verwendung seiner finanziellen Mitteln zu informieren. Die Debatte über den Anfang April erstmals veröffentlichten Transparenzbericht hat sich auf die Liste der Spitzen-Verdiener beschränkt. Für die Frage, inwieweit der ORF bei der Mittelverwendung die Interessen der Allgemeinheit wahrt, ist damit jedoch wenig gewonnen. Entscheidend für die Beurteilung ist die strukturelle Mittelverwendung in Bezug auf die Erfüllung des öffentlich-rechtlichen Auftrags. Deshalb umfassen die Transparenzpflichten auch Kosten aus Produktionen, Beratungs-, Beschaffungs- oder Werkverträgen. Diese Daten müssen aber nur sehr grob und nicht umfassend offen gelegt werden. Die Zuordnung von Budgetposten zu konkreten Inhalten ist dadurch nicht möglich. In seinem Impuls für den ORF bewertet der Anti-Korruptions-Experte Martin Kreutner die neuen Transparenzpflichten des ORF und erklärt, wie ein umfassender Transparenzbericht eines öffentlich-rechtlichen Mediums idealerweise aussehen sollte.Der Jurist Martin Kreutner ist ein führender Experte in der nationalen und internationalen Korruptionsbekämpfung. Er war Dekan der International Anti-Corruption Academy in Laxenburg und Leiter des Büros für interne Angelegenheiten im österreichischen Innenministerium sowie Berater für die Vereinten Nationen, den Europarat, die OSZE, Transparency International und die Weltbank. Aktuell leitet er die Untersuchungskommission zur Aufklärung des Verdachts der politischen Einflussnahme auf die österreichische Justiz.Der Verfassungsgerichtshof hat den übermäßigen Regierungseinfluss bei der Bestellung der beiden ORF-Gremien Stiftungs- und Publikumsrat für verfassungswidrig erklärt. Bis März 2025 muss die gesetzliche Regelung angepasst werden. Die Reform bietet eine einmalige Chance für die umfassende Sicherung der Unabhängigkeit des ORF. Im Jahr 2010 veranlasste die Regierung von Viktor Orbán eine weitreichende Reform des öffentlich-rechtlichen Rundfunks in Ungarn. Hunderte Mitarbeiter:innen wurden entlassen und Berichterstattung ist seitdem streng auf Regierungslinie. Krisztina Rozgonyi ist Juristin und Kommunikationswissenschafterin und war lange im Aufsichtsrat der ungarischen Medien-Regulierungsbehörde tätig. Im siebenten Kapitel unserer Veranstaltungsreihe IMPULSE FÜR DEN ORF spricht sie über die strukturellen Schwächen, die Orbáns Demontage des öffentlich-rechtlichen Mediums ermöglichten – und die Lektionen, die daraus für den ORF zu ziehen sind. Krisztina Rozgonyi, geboren 1972 in Budapest, ist Senior Scientist am Institute for Comparative Media and Communication Studies (CMC) der ÖAW und der Universität Klagenfurt. In seinen jüngsten Entscheidungen zum ORF hat der Verfassungsgerichtshof unter anderem eine Bestands- und Finanzierungsgarantie für den öffentlich-rechtlichen Rundfunk herausgearbeitet. Der rechtspolitische Gestaltungsspielraum des nationalen Gesetzgebers in Bezug auf das ORF-Gesetz wird  durch verfassungs- und auch europarechtlichen Vorgaben eingehegt. Im Rahmen dieser Grenzen, von der Finanzierung über die Gremiengestaltung bis zum gesetzlichen Auftrag, hat die Politik dem Recht zu folgen und nicht umgekehrt. Wo diese Grenzen verlaufen, was geht und was nicht geht, beleuchtet Markus Vašek.Markus Vašek ist Vorstand des Instituts für Verwaltungsrecht und Verwaltungslehre an der Johannes Kepler Universität Linz. In seiner Habilitation hat er sich mit Fragen der demokratischen Legitimation (in der Gerichtsbarkeit) auseinander gesetzt. Private Meinungsäußerungen von öffentlich-rechtlichen Journalist:innen in sozialen Medien sorgen regelmäßig für Diskussionen, wie sie mit dem Objektivitätsgebot vereinbar seien. Um mit dieser Problematik umzugehen haben öffentlich-rechtliche Medien wie der ORF, die BBC, der WDR und das SRF Social-Media-Richtlinien eingeführt, die in die Meinungsfreiheit der Journalist:innen eingreifen und ihre Äußerungen regulieren sollen. Lorenz Tripp analysiert diese Richtlinien aus rechtlicher Sicht und zeigt anhand mehrerer Beispiele, wie schwierig es ist, eine adäquate Regelung im Spannungsverhältnis zwischen Meinungsfreiheit und dem öffentlich-rechtlichen Objektivitätsgebot zu finden.Lorenz Tripp hat in Graz Jus studiert und arbeitet seit August 2023 als Universitätsassistent am Institut für Öffentliches Recht und Politikwissenschaft der Universität Graz.Der Verfassungsgerichtshof hat den übermäßigen Regierungseinfluss bei der Bestellung der beiden ORF-Gremien Stiftungs- und Publikumsrat für verfassungswidrig erklärt. „Herzlich willkommen zu einer neuen Folge Gegenwartsgeplapper“, hieß es heute für Marcel Bohnert. Er ist Oberstleutnant im Generalstabsdienst der Bundeswehr und stellvertretender Vorsitzender des Deutschen BundeswehrVerband. Der Berufsoffizier studierte Erziehungswissenschaften an der Universität der Bundeswehr in Hamburg und der Central Connecticut State University in den USA. Aber ein Abschluss ist kein Abschluss, also hat Marcel noch einen postgraduierten Master in Internationaler Sicherheit erworben. Auslandsmissionen führten ihn 1999 für sechs Monate in den Kosovo und 2011 für sieben Monate nach Afghanistan. Über seine Erfahrungen dabei hat er zahlreiche Publikationen veröffentlicht, wie z.B, das Buch „Innere Führung auf dem Prüfstand. Lehren aus dem Afghanistan-Einsatz der Bundeswehr“, über das wir sich gesprochen haben. Heute engagiert er sich insbesondere die Belange von EinsatzVeteranen, Verwundeten und Hinterbliebenen. Oberstleutnant Marcel Bohnert gilt in der Bundeswehr als Social-Media-Spezialist und war u.a. mitverantwortlich für die YouTube-Serien wie #DieRekrutinnen und die Etablierung der Social Media Guidelines für Soldatinnen und Soldaten (#SocialMediaDivision). This episode explores how the courts should be preparing for life after pandemic conditions. What will be the effect of the unprecedented rate of suspended and delayed cases? What new cases can the courts expect to emerge as a result of the pandemic and the measures taken to control it? Many courts were already struggling with delivering justice in a timely fashion – how should they be preparing for an even worse backlog?  Should some of the measures that have been taken during the pandemic, such as the use of remote trials, be continued as a tool to expedite proceedings?  What lessons have we learned? What is the exit strategy? In this episode, we talk to Judge Vera Doborjginidze from Georgia about some of these questions, as well as Andrea Huber from the OSCE Office for Democratic Institutions and Human Rights, who has been supporting post-pandemic planning for European judiciaries.
