AI has been part of our culture for a long time. Think about the movies that have predicted where we are now. Although this is Hollywood and entertainment, we have realized most of this already: 2001 = Self-Driving Vehicles Matrix = VR Games and Headsets Her = ChatGPT, Siri, Alexa, and more impressive versions coming soon The biggest thing holding AI back or impeding it's progress is it knowing who it's talking to. Personalization will need to go way beyond what information is available on the Internet. What it will need (and what you want to do with your marketing) is called Hyper-Personalization. The problem with data is that it constantly changes. A real-life example is trying to do something very old-school: sending US Mail to customers. Chances are, you have a database or CRM where the records are old. In no way, shape, or form am I saying that digital marketing (social and email) wastes time and money? I can tell you that human-to-human interaction will increase interactions with your digital presence. Humans are complex, fickle, and emotionally charged beings. It takes just being there as another human being to build that trust again and again, as needed.

This week on Ring of Fire! Donald Trump had a major meltdown early Sunday morning about mail-in voting. He immediately got on Truth Social to complain about the US Mail service admitting that they are running way behind on getting mail-in ballots delivered, which Trump immediately claimed was election interference. The irony is that HE created this mess four years ago on purpose, and he seems to have forgotten about that. Rudy Giuliani got blasted by a federal judge in New Hampshire on Monday when the judge dismissed Giuliani's defamation lawsuit against President Biden. Giuliani was suing the president for claiming that Giuliani was pushing out talking points from Russia last year, and he sued in New Hampshire because he thought it would be a friendlier jurisdiction. The judge saw right through it, and said in the ruling that Giuliani “utterly failed” to prove that the case should take place in that state. The “affidavit” from an alleged ABC staffer has been released, and it is filled with problems related to its credibility. But while the media and politicians attempt to determine what's real and what isn't, they are all missing the biggest point: The conspiracy theory itself makes no sense. ABC stood to gain absolutely nothing, but potentially lose millions, by helping Kamala Harris. All that, and more, on this week's Ring of Fire podcast!

My guest this week is Harry Clark, a recipient of the 2022 IBMA Momentum Instrumentalist of the Year award.Harry plays mandolin with East Nash Grass as well as in Dan Tyminski's band, both of which have new records due out in 2023.  He also played in the band for Bronwyn Keith-Hynes' fabulous record 'Fiddler's Pastime.' There, the Justice Department has been asked by the local Democratic machine to intervene in the November election by sending federal monitors. First, a little history. Because of Harris County's sloppiness in administering its elections, Texas's secretary of state announced last September that it would conduct a “full forensic audit of 2020 General Election in four Texas counties.” The 2020 election, marred by the bending and breaking of election law to accommodate fears over Covid-19, saw Harris County fumble the chain of custody for 14 polling locations and their electronic mobile ballot boxes. The number of votes in question totals 184,999. With regards to government, we shouldn't ascribe to malice that which is more easily explained by incompetence. In fact, Harris County's election administrator was so inept that she resigned under pressure in the wake of irregularities during the March 1, 2022, primary election. Thus, the Texas Secretary of State's Office and the Texas Attorney General's Office announced on Oct. 18 that they would send inspectors, security trainers, and legal advisers to Harris County to try to ensure the giant county runs its November election competently and fairly. But in a letter to the Biden Justice Department dated Oct. 20, Houston Mayor Sylvester Turner and Harris County Judge Lina Hidalgo claim the state of Texas's plan to send in election inspectors amounts to an effort to “disrupt and intimidate local election workers.” Further, they claim, the state intends to “chill voters' trust in the election process.”This is the closing argument of the FigureHead? We must believe elections in American are safe and secure? [AUDIO] - Biden Chief of Staff Ron Klain says Biden's speech last night was "one final warning."No, I agree with Bad Cat. If you want us to believe elections are secure, make them secure. I don't necessarily agree with this approach, but it's far better than the leaky, fraud prone method of today. Accusations of electoral fraud; if you want trust, stop posturing and solve the problemWhy is this allowed? Has the US Mail stopped picking up at nursing homes? [AUDIO] - Yesterday, Democrat Commissioner and Board of Elections chair @BobHarvie_PA stated “You can go to a senior center or nursing home and get 100 ballots and as long as you have 100 designated agent forms, your allowed to bring a 100 ballots.” This is illegal ballot harvestingIf the CIA will meddle in Brazil's elections and run coups in Ukraine, why would the CIA not do that in America? [AUDIO] - Tucker: “What's happening here is a version of what's happening in Brazil right now. Instead of giving a speech about how his policies have made your life better, or making a pitch for your vote, Biden commanded you to accept the election results.”

US Mail Not for Sale: The Fight for the USPS

This is how intertwined the Medicare for All and public mail movements are: if we had a national single payer system in place for the last decade, the USPS would be running a surplus. Steve DeMatteo of the American Postal Workers Union joins us to discuss the surprising connections between the postal service and our healthcare system, the political and financial obstacles that the USPS has faced under the Trump administration, and also how you can fight to protect this vital public service. Show Notes This week we welcome to the podcast Steve DeMatteo from the American Postal Workers Union (APWU)! The postal service has become crucial for our democracy during the COVID pandemic, as many voters shift to using mail ballots for safety concerns. TOTALLY COINCIDENTALLY, the Trump administration has also attempted to undermine and privatize the postal service in the run-up to the November elections. We invited Steve on to talk about the important and, for most people, surprising ways in which protecting our public postal service and establishing healthcare as a right are intertwined. The APWU and its President Mark Dimondstein are among the leading advocates for Medicare for All in the labor movement. Why? As Steve says, postal workers are in a similar position to many workers. Although the APWU has won fairly good health benefits for their members, the rapidly rising costs of healthcare are brought to the table by their employers (the postal service) every contract, and used as a counterweight for winning decent wages and other important benefits for postal workers. What is the scale of the United States Postal Service (USPS), and how is it different from private mail companies like UPS or FedEx? The postal service employs more than 600,000 workers across the country (second only to Amazon as a national employer!), at 30,000+ post offices around the country. The USPS is also the largest civilian employer of veterans in the country. It is the only service explicitly mentioned in the U.S. Constitution, and the USPS actually predates the Constitution - in 1775, Benjamin Franklin served as the first Postmaster General. In contrast to this history, in which the USPS has served as an integral part of American life since the country's founding, for-profit mailing companies like UPS or FedEx operate on a very different model. USPS service is universal, and does not charge discriminatory rates depending on whether you're rich or poor, or whether you live in an urban or rural area. For-profit mailing companies, like healthcare corporations, will not mail to unprofitable areas, and will charge every consumer as much as they can. In fact, about 25% of mail sent by UPS and FedEx are dropped off to a public post office for the final leg of your delivery - since for-profit mailing companies won't service the final address! (See this IPS study on how 70 million Americans are up-charged by UPS and FedEx because they don't live in a major city.) Now that we understand what the postal service is, how do we explain the fact that the USPS has struggled financially in recent years - even before coronavirus? Most people will never hear about it, but almost all of the USPS's losses stem from a 2006 law called the "Postal Accountability and Enhancement Act," which required the postal service to pre-fund retiree health benefits 75 years in advance (!!!). That means the USPS has to pay, right now, for the health benefits of future USPS retirees who haven't even been born yet. No other government agency, and certainly no private corporation, has to pre-fund their healthcare benefits three generations in advance, and it created an impossible financial situation. If you read or watch mainstream news on why the postal service has struggled financially, though, you will never hear about this 2006 law. The reason the press overlooks the reality of the postal service's struggles is due to a concerted effort to demonize the USPS...

There is the notion that rest is for the lazy, rest is for the entitled, and rest is unnecessary.   As if all of our waking hours should be allocated to productivity and “getting shit done.”   But rest is vital, and I consider it to be a human right- to have the time and space to rest. Rest is essential for the body and for the mind. Most importantly it allow us to just “be.”   Also, if you listened to last week's ‘behind the scenes episode', I am also sharing some details on how I felt AFTER recording the episode (spoiler alert- there were some moments of doubt & uncertainty, but I had a community of people that rallied around me). As the nation celebrates the 100th anniversary of women winning the right to vote, Secretary of State Maggie Toulouse Oliver and Valencia County Peggy Carabajal are working to ensure New Mexicans will have confidence in the November election. NMiF’s senior producer Matt Grubs talks with them about the national controversy over the role the U.S. mail will play in November’s election. It’s part of the Your NM Government Project, a partnership with KUNM Radio and the Santa Fe Reporter newspaper. Controversial statues, such as those of confederate leaders or, especially here in New Mexico, of Spanish conquistadors, have sparked protests for years - and especially now. In Albuquerque, the issue came to a head back in June after a protest at La Jornada, a sculpture in Old Town that features conquistador Juan de Oñate, turned violent. The city ended up pulling that statue down temporarily in the hope of avoiding more demonstrations. NMiF correspondent Gwyneth Doland got an update this week on Albuquerque’s new approach and how they are seeking input on what to do with La Jornadagoing forward. Gene Grant and The Line opinion panel respond to the interview on voting and give their insights and opinions on the expected avalanche of mail-in ballots for the November elections. They also discuss holding major events, like the State Fair and the burning of Zozobra, virtually. They wrap up their turn at the virtual Line table with a discussion on the benchmarks in the COVID fight here in New Mexico, and what it might mean for reopenings, especially of schools.

Reports show millions of families in the richest country in the world aren’t getting enough food and clean water. Meanwhile, as hospitals were scrambling for supplies, the Transportation Security Administration hoarded well over a million N-95 masks. And TSA officials still won’t explain why they aren’t sharing their stockpile where it’s needed – which is not at the airport. And lastly, I guess we’re lucky that rich people also use the US Postal Service. A few companies with a lot of money on the line have joined the fight to save the Constitutionally protected US Mail from Donald Trump’s plan to destroy it. THESE ARE THE STORIES YOU NEED TO KNOW: The European Union’s top economists are predicting the worst economic recession there since the end of the Second World War. The worst effects will be felt in countries that depend on tourism – Europe, Spain, Greece, and Italy. But even though many EU countries will fare worse than the United States on paper, economists say they will still do better in terms of saving jobs. The US unemployment rate is already worse than what’s predicted for the EU. Most European governments have chosen to cover the cost of people’s salaries during the pandemic. America is now the place where rulers say let them eat cake. A new survey by the Brookings Institution shows that childhood hunger in the US has tripled from its worst point during the 2008 recession. One in five American mothers today say their children aren’t getting enough to eat. Families are skipping meals and reducing portions. Democrats in Congress want to increase food stamp benefits by fifteen percent, as they did in that prior recession. Republicans say nah. Access to clean water is also an urgent problem for more and more people. More than two million Americans lack indoor plumbing. Millions more don’t trust their water. The Washington Post says stores are restricting purchases for rural people who rely on bottled water for cooking and drinking – not to mention hand-washing. Prices are going up, and some say the rationed amount isn’t enough. It’s a real bad scene out there. As always, some are facing greater risks. New research by the Associated Press confirms that people of color are faring worse, not only from COVID-19 but from the economic fallout. Black and Hispanic Americans were twice as likely as whites to have lost work, or to report trouble making rent and paying bills, since the pandemic. All of this is fixable, but we need people in power who care. TSA hoarding deprives hospitals Air travel is down ninety-five percent at US airports since the pandemic. So it doesn’t make a lot of sense why the Transportation Security Administration has decided to hoard more than 1.3 million N-95 respirator masks. This is at a time when doctors around the country were literally begging for donations of that exact piece of equipment. ProPublica broke this story yesterday, but there aren’t good answers as to how and why it happened. A TSA attorney, Charles Kielkopf (KYLE-COUGH), filed a whistleblower complaint over the stockpiling this week. Kielkopf first raised the matter last month after TSA got the masks from Customs and Border Patrol, which found them in a warehouse in Indiana. The whistleblower and other officials repeatedly told higher-ups that the masks should be given to hospitals, where they were – and are – desperately needed. Instead, management decided to hold on to their hoard, even as it cut the schedules for most of its workers – because, remember, the airports are like ghost towns. Then TSA field offices started getting thousands of masks for workers who weren’t there. As state governors started pleading for donations, TSA management refused suggestions to give the masks to hospitals. Bad call! Separately, the Department of Justice has opened an investigation into a fake medical supply company founded by two Republican political operatives that conned its way into hundreds of millions of dollars in public contracts. The company, called Blue Flame Medical, was founded just six weeks ago. But as the Washington Post reported, its founders used their connections with former federal officials to land government contracts – including a $457 million contract with California for 100 million masks. The consultants, Michael Gula and John Thomas, claimed to have a solid connection with a Chinese government supplier. Guess who they blamed when they couldn’t deliver? China, of course. Retailers demand USPS rescue A few big corporations are doing something useful with their money for a change, and asking the government to save the US Postal Service. Last night a group of online retailers including Amazon and CVS launched a multimillion-dollar ad campaign to pressure Republican lawmakers to reject Donald Trump’s plan to jack up postal rates. Democrats have a different proposal to make up for stretched budgets at the Postal Service as a result of the pandemic: give it more money in the budget. According to the New York Times, Democrats want to allocate $25 billion to make up the Postal Service shortfall. No, no. Definitely not. That would be too simple. Trump is reportedly refusing to sign off on any USPS funding that doesn’t quadruple rates for packages. So wherever you see Shipping and Handling charges, multiply that by four. The retailers hired a former Army secretary, John McHugh, to make the case for the Democrats’ plan. McHugh says Trump’s plan is dangerous, especially with people relying more and more on deliveries. The pressure ads by the retail lobby started airing last night on Sean Hannity’s show on Fox News – so Trump definitely saw it. They’re calling themselves the Package Coalition. And they say Trump’s plan is QUOTE a massive package tax ENDQUOTE. Listen. They’re spending $2 million on this ad campaign. You’d think they could come up a way to avoid making everyone say the word package so much_._ AND NOW FOR SOME QUICKER QUICKIES: Guess what, some of the people at the pro-Trump “re-opening” rallies have been stockpiling explosives as well as guns. In at least one case, a white supremacist involved in recent open-carry rallies prompted Homeland Security to issue an alert over threats to law enforcement. The subject, Bradley Bunn of Loveland, Colorado, was arrested before a May 1 lockdown protest. Bunn bragged to an undercover about killing FBI agents with the pipe bombs he’d built. At least they are stupid terrorists... One in seven humans live in a place that will endure unbearable, Sahara-like temperatures within fifty years. That’s the most optimistic scenario in a new study in the Proceedings of the National Academy of Sciences. The authors examined migration patterns and found that 1.2 billion people live outside the so-called climate niche of our species. The pessimistic scenario has one in three people dealing with unbearable heat in the pretty-near future. Either way, these scientists say we should expect more change in the next fifty years than in the previous six thousand. Fingers crossed! The ignorant billionaire Education Secretary, Betsy DeVos, laid out new rules yesterday for how schools deal with allegations of sexual assault and harassment. The new rules narrow the definition of harrassment, and require that it be severe and pervasive. They also give abusers the right to cross-examine accusers in campus hearings. DeVos claimed it’s about due process, but feminist critics said the changes are really about silencing survivors. US military recruiters say the coronavirus is changing the way they do business. Instead of stalking campuses and high school hangouts, the main focus of their efforts is moving to online games like Call of Duty and Fortnite. The McClatchy news service says the Army and Navy are sponsoring gaming tournaments and e-sports teams to engage in what they call prospecting activity. Giver or Taker, Producer or Depleter: We All Know Who We Are. (EP. 214)

Introduction We may pretend that either we don’t know which sort we are, or that we just know that we are in the good groups--but we all know the truth, whatever that is. One way to determine the truth is to take a look at the five people we spend the most time with, and ask the Giver or Taker and Producer or Depleter questions about them. And be honest; don’t try to skew the answers, knowing where this questioning is going. Once we have the answers about them, we have the answers about ourselves. That is the subject of today’s 10-minute episode.  Continuing Very early in my Silicon Valley career, I became the department head of two combined departments in a publicly held software company, totalling about 45 people. The company was shuddering its way through layoffs, and the other department head had been sacked. In my third week in this position, I was given the order to lay off 40% of the combined department. I was told that it needed to be done at the close of business that Friday, and that the laid off personnel would be given severance packets. There were no other instructions.   Even though everyone was expecting a serious round of layoffs, I rejected the idea of telling the 20 people one-by-one starting Friday at 5, with the rumors about who was next spreading like wildfire after the second or third firing. I decided to put each group in separate meeting rooms, with those to be laid off in one room, and the others in another. I first went to the room with the survivors, made a quick announcement saying that they were safe, and that I would be back in a moment to answer questions. The second I walked into the room with those to be laid off, I knew that they knew. Each person had been looking around the room to see who else was there. And that’s all they needed to know to determine which group they were in. Before I made my announcement, before I even walked into the room, everyone there had already come to grips with what was happening to them.  All of us know which group we are in. All we have to do is look around. Today’s Key Point: If we don’t like where we are, we can fix it. Okay, Will, I believe that. How? Make a decision. There is real power in making a decision. Charles Lindbergh, one of the greatest aviation heroes of his time, made the decision that he was going to be the first to fly non-stop across the Atlantic. When he awoke the next morning, he was filled with aggressive doubts. I am a broke US Mail pilot, flying WWI vintage biplanes. There are well-funded organizations already underway with multi-engine aircraft with experienced crews already training to compete for the prestigious Orteig Award and $25K cash prize. (Fancy money then.) Am I nuts? So, did he quit? Did he say that he would go forward if he was miraculously given a huge sum of money and a new Ford Trimotor aircraft? No. He settled down as soon as he remembered that he had made a decision to be the first. And in 1927, he was. When he landed in Paris, he was greeted by a crowd of 200K; in New York City, he was celebrated by 4M. The lesson here is the power of making a decision and sticking to it.  Lindberg’s decision was easy. Implementing it, making it happen, was hard. As it is with anything at all worthwhile in life. Life, correctly, is hard.  Now to specifics, first make a decision to be more of a giver, to be more of a producer. That part is simple. Implementing this decision will be hard. The rules of life are simple. Implementing them is hard.  This bears repeating: The rules of life are simple. Implementing them is hard.  We all learn more from the hard times than we do from the easy times. I don’t know anyone for whom that is not true. Do you? And with those hard times, we can grow and strengthen ourselves to lead stronger, happier and better lives. Yes, I did say “happier.” There is no conflict between hard and happy, is there?  We all know that to make a muscle stronger,

Welcome to Episode 15:  Drones – Capturing Fantastic Videography for your Business Customers & Prospects Today is another solo-cast – just me y’all and we’re going to talk Drones.  But I wanted to give you a teaser that NEXT week on ep. 16 I have a professor of social media and dig marketing from UGA – University of Georgia talk about considering and crafting a social media Intern rolling program so don’t miss it. But back to drones…..One of the 2020 Marketing trends is capturing incredible video content going aerial.  Once drone videographers started creating works that consider creative patterns and frames of thought in a visual aspect, it broadened the field of aerial photography and videography.  Previously, drones were used in the commercial space for documentary purposes.  As I sought out to prepare this episode for you, I realized that the large majority of our perception of the earth and all it’s offerings is from our view here ON earth, not above it.  I mean, unless you are an astronaut.  Or, if you are spiritual – which I am.  But for the most part how we relate primarily to what is here – we relate to it from here. So integrating drone footage into your video content strategy has huge opportunities!  I’m going to give you some examples for a few common brand types in a bit to illustrate how you don’t have to be a travel company or a movie production company to get memorable, super engaging imagery related to your product or services.  Also, to help evoke emotion of some type. Not a ton of brands are using aerial footage in the video works yet.  While the drone market place is rapidly growing as more applications are discovered, the commercial/civil use is around 15% of the total market; while 65% being military and 20% consumer or hobbyists.  Emergence of use cases in fields such as real estate, construction, oil and gas exploration, utility inspections, agriculture, logistics, government, insurance, law enforcement, and retail.  The impact of commercial drones could be $82 billion and a 100,000 job boost to the U.S. economy by 2025, according to AUVSI. Drones are also known as Unmanned Aerial Vehicles (UAVs).  They require a license to fly.  If you pass the licensing test, you are a pilot!  I had heard that oh, the licensing isn’t really enforced for these new weird machines flying around overhead - if you’re just a small company flying it in either a residential or small community level setting the license isn’t necessary and a big time-suck to get it, I might add.  Well, we live adjacent to a Live/Work/Play under construction currently, what’s been dubbed as “Mini Avalon” in Alpharetta Georgia, just outside of Atlanta.  There are large grassy fields awaiting retail contracts and construction builds as one Hyatt Hotel is going up on the peripheral. Every weekend at least 1 person, more often 2, come and park their cars, get out and start flying their drones!  Walking my dog one Sun morning, I struck up a conversation with one who brought it to my attention how important it is that since I own a drone and I want to help brands capture aerial videography, I need to get my license!  There are strict laws and hefty fines I wouldn’t want to have attached to my name or my business. So I have set out to get my drone pilot license.  Another part of my drive here is that my daughter, Taylor, who is 22, about to be 23, science major at GA State Univ. and scuba diver, is starting her own YouTube channel on ocean and sea life conservation to help the spread of awareness of key initiatives she is involved in such as coral restoration and the human group projects surrounding those efforts.  I want her to be able to affordably include ocean and beach aerial footage – which imagine – how beautiful the views and how much closer and much more emotional the viewer will FEEL while watching that imagery with either music or her voiceover! I decided to take you – anyone interested – on this licensing and pilot learning journey with me – starting today.  I have signed up for an online course to get prepared for the test and I then will take the test and do all the steps.  And I will practice driving this quite intimidating medium size flying ship! The license is called FAA Part 107 test.  FAA stands for US Federal Aviation Authority. The requirements to attain it are Be at least 16 years old. Pass the Aeronautical Knowledge Test. You can register to take the test at any FAA-approved knowledge testing center. Apply for and obtain a Remote Pilot Certificate. You can apply using the FAA’s online IACRA system48 hours after taking the Aeronautical Knowledge Test. Pass a background check by the Transportation Security Administration (this process happens automatically during your application process). The test fee is a hundred and fifty bucks. There’s also a $5 registration fee for your drone. Then you must insure operation; A popular way of insuring drone operations is through companies which offer it in small, predetermined periods of time such as AI. Most students report spending between 15 and 20 hours of study time to prepare for the exam. Once you’ve taken the Aeronautical Knowledge Test, the FAA anticipates that it will takesix to eight weeks to issue a permanent remote pilot certificate via US mail. An expedited temporary remote pilot certificate can be issued upon request in about 10 business days.  Because I have a feeling I am going to want to get out there and start using my drone, instead of waiting, what – eight weeks, via US Mail?  Phhhtt sheesh – hahaha – my husband always imitates me when I do that haha Then you must retake an exam every 2 years or Keep your license up to date by passing a recurrent aeronautical knowledge test every 24 months. Four owners of a Welcome Inn located in Quincy, Illinois are being sued for allegations of violating that state’s Fair Labor Standards Act (FLSA) in a complex case that has spanned nearly two years. Plaintiffs April R. Brashier, Richard M. Orencia, and Chad Lebow filed a lawsuit against Quincy Property LLC, doing business as “Welcome Inn,” and Brett Burge, Kenneth Logan, Quentin Kearney and Joe Wimberly under FLSA and Illinois Wage Laws. The lawsuit, filed Jan. 28, 2017, alleges the plaintiffs worked at the defendants’ hotels and weren’t paid overtime due under FLSA. The plaintiffs further allege they were misclassified as salaried employees exempt from FLSA, and that the defendants illegally deducted amounts from their pay in violation of FLSA. Under FLSA, employees may bring a collective action against an employer to recover unpaid overtime or minimum wages. Unlike class actions under Federal Rule of Civil Procedure whereby potential plaintiffs are included in the class unless they opt out, potential plaintiffs in FLSA collective actions must affirmatively opt in to the suit, according to Cornell Law School. Brashier claims in court documents she was unjustly terminated at Welcome Inn for complaining about a lack of overtime pay, and threatened with illegal wage deductions. Lebow alleges the defendants also retaliated against him. He claims they reduced his wages and/or tried to intimidate him by “strictly scrutinizing his work because he requested overtime pay.” Allegations and court documents have flown back and forth since the case’s filing. Points of contention The first disagreement between the parties concerns the definition of Collective. This affects to whom the notice is sent. The plaintiffs assert the Collective should be defined as “all salaried employees” while the defendants contend it should be limited to individuals at Welcome Inn holding the title of housekeeper, maintenance staff, front desk personnel, and skilled trade construction employees, or those performing similar tasks, according to league.com. The plaintiffs also allege the defendants improperly took deductions from salaried employees, therefore, a class of all salaried employees is appropriate. The court found that notice must be sent to those employees, classified as exempt, who were paid less than $455 weekly. One of the requirements for classifying employees as exempt from overtime and minimum-wage requirements is that they are paid at least $455 per week. Plaintiff Orencia asserts he was classified as exempt, but was paid less than $455 per week, court documents show. The parties also disagree on whether the notice can be transmitted by text message in addition to US Mail and email. Plaintiffs propose providing an abbreviated notice to potential opt-ins by text message. This could help potential opt-ins further inquire about the case. The case is being heard by U.S. Magistrate Judge Tom Schanzle-Haskins.

Garcia has a couple of really nice solos on the amazing 'Death Don't Have No Mercy' that I really like.. there is a crackling energy throughout this tape that is well worth experiencing, despite the occasional flaw in this tape the sonic quality is really quite remarkable. 'New Potato Caboose' simply takes off into the cosmos.. experience it .. This week on Episode 72 of Bobby Pickles' Podcast (Dying Scene Radio #17), the Bobs’ digital smoke signals to Ben Weaselfinally pays off, as the Screeching Weaselfounder and frontman guest hosts the show, joining Bob Noxious and Bobby Pickles in studio to discuss everything under the sun, from bums to farming to fat, middle-aged punk rock stereotypes - the three blather back and forth about a slew of interesting, unconventional topics. Weasel’s epic punk rock opus - Baby Fat Act 1 - is out now on Recess Records. Episode 17’s recurring theme: Performance Art. SYNOPSIS OF BANTER The show wouldn’t be the same without a local weather report, so right off the bat, Bobby the meteorologist asks for an oral account on the state of precipitation in the area encompassing Ben’s hometown of Madison, Wisconsin. Ben responds that he is enjoying a nice sunny day overlooking his cattle grazing in the Alfalfa fields. Who knew that Ben Weasel was a farmer!? Ben interrogates Bobby about his decision to employ a homeless person as a model for his T-shirt company. Bobby reveals how he first met “the bum”, who was living inside of Penn Station, when Bobby first moved to NYC. Bobby, who was managing a cell phone kiosk, thought it rather ironic that a bum would have a cell phone, so he struck up a friendship with the man. Ben commends Bobby on his humanitarian efforts, when Bobby admits to housing and employing “the bum”. Ben concedes to feeling like “a heel” for trying to make a joke about it. Intrigued by the new-found thought of employing bums as T-shirt models, Bob suggests to Bobby that maybe he should consider publishing a calendar as a way to support the homeless on a more regular basis, which Ben wholeheartedly agrees upon. While on the subject of T-shirts, Bobby bounces an idea off of Bob and Ben: “What about a “mash-up” tee, depicting the recently deceased B.B. King as G.G. Allin (B.B. Allin) - complete with poo and tattoos?” In unison, Ben and Bob both agree that it is way too soon for that much poor taste, but that King’s heirs should be entitled to some of the profits if that were to happen. Like a kid at Disney World, Bobby cannot contain his excitement as he gleefully tells Ben that not only did he purchase Baby Fat Act 1 from iTunes on the day of its release, but that he has listened to the entire offering three times already. Ben explains the general concept behind his punk rock opera, which is played out by many singers and complete with a libretto - but for a more comprehensive breakdown of the characters and plot, please read Ben’s exclusive interview with the Italian magazine, Tempi. Baby Fat is based on the opera, Rigoletto, which Bobby admits to watching the Luciano Pavarotti version online earlier in the afternoon after not being able to find a cassette deck to play his Italian grandfather's audio version. The conversation turns to crowdfunding. There’s a common misconception in the “record business” about artists who “beg” for money from their fans, but Ben justifies his use of crowdfunding to finance his operatic masterpiece by comparing it to nothing more than a glorified pre-order, but without the recoupable advance from the record company. He also states that crowdfunding is really a tool in-line with the old standby D.I.Y. ethics of yesteryear. The artist maintains control by doing everything for his or herself; therefore, cutting out the middle-man, which benefits the artist in terms of receiving larger royalty percentages as well. After nearly 30 years of playing punk music, Ben proclaims that punk bands will always shoot themselves in the foot, based on their misguided principles. He goes on to point out that most of them spend too much time, himself included, apologizing for their actions and what they say; meanwhile, Bob is preparing to play a new track from Chicago’s The Copyrights, who Ben declares “complete douchebags” who “can certainly dish it out, but [they] can’t take it”. Ben continues by stating sarcastically that ska/punk music died out in the 90’s. Bob mentions that musical styles tend to run in cycles and that maybe there will be a resurgence in the genre sometime in the near future, which Ben is quick to dismiss. Ben inquires about the origins and operations of Dying Scene, asking if it is corporately owned, or indeed run by a team of fans and writers. Bobby compares it to a grass roots operation. Ben goes on to say that if it was corporately owned, he wouldn’t necessarily have a problem with it, reminding everyone that, after all, Screeching Weasel is incorporated too. Weasel continues by telling a story about another popular online news gathering website, leveraged by investors and bought out without informing their staff of contributors, the result of which being one person walking away with a huge cash-grab and then going into seclusion. Ben tells the story of how he met Bob’s mutual friend, ex-Pink Lincolns frontman, Chris Barrows. The two used to trade their respective bands’ cassettes through the legendary punk periodical, Maximum Rock and Roll, and the US Mail. Ben explains how he had Chris in mind when coming up with the Zannoni character on Baby Fat, elaborating further about what a great job Chris did on the record, singing “God Damn You” in a key that is normally not in Chris’ wheelhouse. Ben discloses that Chris is his oldest friend, not in age, but in longevity. Bob deadpans that Chris is his oldest friend, not in longevity, but in age... On a sidenote, Bob played all of the guitars on Chris Barrows’ 2014 debut solo album Human Being. One notable track on the record is “Not It”, which happens to feature vocals by none other than Mr. Ben Weasel himself. Go find it on iTunes! Honestly, this synopsis could go on forever. The three blather back and forth relentlessly for over an hour about woman-punching, the current state of the music industry, Ben’s jaded self-interested in his own music, his predilection for Taylor Swift and the Frozen soundtrack, which is a clear indication that Weasel either has a daughter (or really bad taste in music), how PEARS were more than likely manufactured in a corporate board room by guys in suits with pie charts, the political predispositions of a fat, drug-riddled record executive who should stick to writing songs about “boobs and doing blow”, and how Rancid’s Tim Armstrong, who Ben remembers as “Lint”, finally found his voice. Ben commends Bobby on his humanitarian efforts, when Bobby admits to housing and employing “the bum”. Ben concedes to feeling like “a heel” for trying to make a joke about it. Intrigued by the new-found thought of employing bums as T-shirt models, Bob suggests to Bobby that maybe he should consider publishing a calendar as a way to support the homeless on a more regular basis, which Ben wholeheartedly agrees upon.While on the subject of T-shirts, Bobby bounces an idea off of Bob and Ben: “What about a “mash-up” tee, depicting the recently deceased B.B. King as G.G. Allin (B.B. Allin) - complete with poo and tattoos?” In unison, Ben and Bob both agree that it is way too soon for that much poor taste, but that King’s heirs should be entitled to some of the profits if that were to happen.Like a kid at Disney World, Bobby cannot contain his excitement as he gleefully tells Ben that not only did he purchase Baby Fat Act 1 from iTunes on the day of its release, but that he has listened to the entire offering three times already. Ben explains the general concept behind his punk rock opera, which is played out by many singers and complete with a libretto - but for a more comprehensive breakdown of the characters and plot, please read Ben’s exclusive interview with the Italian magazine, Tempi. Baby Fat is based on the opera, Rigoletto, which Bobby admits to watching the Luciano Pavarotti version online earlier in the afternoon after not being able to find a cassette deck to play his Italian grandfather's audio version.The conversation turns to crowdfunding. There’s a common misconception in the “record business” about artists who “beg” for money from their fans, but Ben justifies his use of crowdfunding to finance his operatic masterpiece by comparing it to nothing more than a glorified pre-order, but without the recoupable advance from the record company. He also states that crowdfunding is really a tool in-line with the old standby D.I.Y. ethics of yesteryear. The artist maintains control by doing everything for his or herself; therefore, cutting out the middle-man, which benefits the artist in terms of receiving larger royalty percentages as well.After nearly 30 years of playing punk music, Ben proclaims that punk bands will always shoot themselves in the foot, based on their misguided principles. He goes on to point out that most of them spend too much time, himself included, apologizing for their actions and what they say; meanwhile, Bob is preparing to play a new track from Chicago’s The Copyrights, who Ben declares “complete douchebags” who “can certainly dish it out, but [they] can’t take it”. Ben continues by stating sarcastically that ska/punk music died out in the 90’s. Bob mentions that musical styles tend to run in cycles and that maybe there will be a resurgence in the genre sometime in the near future, which Ben is quick to dismiss.Ben inquires about the origins and operations of Dying Scene, asking if it is corporately owned, or indeed run by a team of fans and writers. Bobby compares it to a grass roots operation. Ben goes on to say that if it was corporately owned, he wouldn’t necessarily have a problem with it, reminding everyone that, after all, Screeching Weasel is incorporated too. Weasel continues by telling a story about another popular online news gathering website, leveraged by investors and bought out without informing their staff of contributors, the result of which being one person walking away with a huge cash-grab and then going into seclusion.Ben tells the story of how he met Bob’s mutual friend, ex-Pink Lincolns frontman, Chris Barrows. The two used to trade their respective bands’ cassettes through the legendary punk periodical, Maximum Rock and Roll, and the US Mail. Ben explains how he had Chris in mind when coming up with the Zannoni character on Baby Fat, elaborating further about what a great job Chris did on the record, singing “God Damn You” in a key that is normally not in Chris’ wheelhouse. Ben discloses that Chris is his oldest friend, not in age, but in longevity. Bob deadpans that Chris is his oldest friend, not in longevity, but in age... On a sidenote, Bob played all of the guitars on Chris Barrows’ 2014 debut solo album Human Being. The three blather back and forth relentlessly for over an hour about woman-punching, the current state of the music industry, Ben’s jaded self-interested in his own music, his predilection for Taylor Swift and the Frozen soundtrack, which is a clear indication that Weasel either has a daughter (or really bad taste in music), how PEARS were more than likely manufactured in a corporate board room by guys in suits with pie charts, the political predispositions of a fat, drug-riddled record executive who should stick to writing songs about “boobs and doing blow”, and how Rancid’s Tim Armstrong, who Ben remembers as “Lint”, finally found his voice.
