Moreover, there is no video game development industry in the region to speak of, and the underpinning ecosystem remains underdeveloped. However, by 2023, the size of the global video games industry is expected by valued at half a trillion US Dollars! That's right, video games. Over 227 million people in the U.S. play video games for at least one to a few hours per week, which equals out to about 70% of all Americans are video game fans. But what I'd bet most gamers don't know, is the role that operations research (O.R.) plays in nearly every aspect of video game development, from design to production to selling. Joining me today to dive into the world of O.R. and video games is Xiao Lei, assistant professor with the University of Hong Kong, a self-confessed lover of video games who is also lucky enough to get to help advance the role of O.R. in gaming.

And, civil rights attorneys in Mississippi are trying to strike a provision from the state constitution that dates back more than one hundred years to 1890. They say it is a discriminatory law that blocks some Black Americans from voting. Rob McDuff, an attorney with the Mississippi Center for Justice who brought the case, joins us.

Out of Play Area is a bi-weekly podcast series where video game developers open up about their craft, themselves, and their motivations, for the benefit of other game devs both veteran and aspiring. Hosted by Game Designer John R. Diaz. I come from humble beginnings from 2 parents who emigrated from the Dominican Republic and gave birth to me in 1983. Being raised with lots of love, I nerded out on comic books, action figures, collecting cards, and playing NES, SNES, Genesis, N64, Gamecube, Xbox, and Playstation, and thought Computer Engineering was the way to do what I love.  I had nobody to talk to or show me that video game development could be a career and where to even start. I burned 3 years in college before I found Full Sail University in FL in 2004 and transferred and got my Game Design & Development degree. From then on a good friend Rob Coble helped put me on at Midway Austin in 2007 and I've never looked back. Since then I worked on some of the biggest games of our time including Red Dead Redemption, Grand Theft Auto V, Red Dead Redemption 2, Gotham Knights and more. It was a hard road getting here that could've saved me time & money if I had someone to talk to. That's why I put this podcast together. Helen Andrzejowska is one of the three founders of Ocean Spark Studios, a video game development company formed in late 2016, and based in Huddersfield, Yorkshire. Helen came from an art background, going on to study Video Game Development at the University of Huddersfield, where she met her two now business partners, Zach and Ellie. As we’ve heard so far in this series, some game development studios prefer to focus on a niche market, focusing on one particular area of making games, whilst others prefer to take a more all-rounder approach. So, did Helen herself decide to stick purely to the artistic side of things? Special Guest Ben Siders, an IP attorney at Lewis Rice in St. Louis, joins the podcast to speak about the unauthorized use of trademarks in films, TV and video games.   A former software engineer, Ben routinely counsels businesses, entrepreneurs, and startups on IP, technology licensing and compliance as well as how to develop and protect their IP assets. He also assists clients with licensing their technology and licensing third party technologies. Ben is also a co-author of the American Bar Association's Legal Guide to Video Game Development and has published an article on board games in the American Bar Association's Landslide journal on IP law. He is the secretary of the St. Louis Game Developer Cooperative, a member of the International Game Developer Association, and holds a patent on a geogaming technology for creating "parallel reality" games.   Movies, television programs, and video games often exploit trademarks within their content. In particular, various media often attempt to use the logos of professional sports teams within artistic works. Courts have utilized different methods to balance the constitutional protections of the First Amendment with the property interests granted to the owner of a trademark. Ultimately, many courts utilize the framework presented in the seminal Rogers v. Grimaldi decision. This test analyzes the artistic relevance of the trademark’s use in the allegedly infringing work, while also protecting against explicitly misleading uses. Currently, federal circuits apply the Rogers test inconsistently, particularly in the Second, Sixth, Seventh, and Ninth Circuits. This podcast focuses in on the feedback loop created by blurring out trademarks in films, when not legally required to do so. Performing this action entices studio gatekeepers to always clear trademarks before utilizing them, in effect, chilling the artistic vision of the director and/or producer.
