From March 8, 2024: The practice of surveillance capitalism—the widespread private collection and commodification of personal data—is well understood. Less well understood is the extent to which the U.S. government purchases this data in the commercial marketplace to use it for intelligence and law enforcement purposes. Byron Tau, when he was a reporter with The Wall Street Journal, did more than anyone to bring this practice to public light. Jack Goldsmith sat down recently with Tau to discuss his new book on the topic, “Means of Control: How the Hidden Alliance of Tech and Government is Creating a New American Surveillance State.” They discussed how the private broker market works, why the government is able to purchase bulk private data with relatively few legal restrictions, and the threat to privacy and civil liberties that inheres in the practice. They also discussed why this form of data is so important to the government and the prospects for reform of the relatively unregulated practice. To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare. The percentage of depressed people who smoke is higher than the general population. Way higher. When you dig a little deeper, it turns out there is an interesting connection between depression and smoking that you'll find interesting. This episode starts with a brief explanation. https://www.oprah.com/health/quitting-smoking-and-depression Companies are constantly collecting data on you. Everything from what you watch online to what you buy, where you go, your affiliations – all sorts of things. Often that information is sold to data brokers who can then sell that data to other marketers. However, it appears they are also selling it to governments. Government agencies in the U.S and in other countries are acquiring data about you from data brokers. Why would they do that? Should you be worried. That is what Byron Tau is here to discuss. Byron is a journalist based in Washington, D.C., where he writes about law, courts and national security and he is author of the book Means of Control: How the Hidden Alliance of Tech and Government Is Creating a New American Surveillance State (https://amzn.to/49gEf5v). In the digital world, there is an enduring tension between privacy and security. What is our right to privacy from the government or the companies whose services we use? What rights does our government have to surveil us in the name of national security? Most of us have a general understanding of the basic tradeoff in the Internet era—you give up some data in exchange for free or freemium services like Gmail or social media apps like Instagram. But the data marketplace goes well beyond the Big Tech players we're most familiar with, and the depth and breadth of these processes, and the players involved, are often much harder to pin down. What role do data brokers play and what sorts of data do they have access to? Is our data simply for sale to the highest bidder? Can even the chips in car tires be used to spy on people?Joining us to discuss all of this is Byron Tau, whose investigative work has shone a light on the connections between tech companies and government surveillance. His latest book, "Means of Control: How the Hidden Alliance of Tech and Government Is Creating a New American Surveillance State," uncovers the extensive ways our data are used to watch and influence us as the American public. Byron is also a reporter at NOTUS, a new publication covering politics and policy from the Albritton Journalism Institute, and an adjunct lecturer at Georgetown University.

We all know that advertisers are snapping up our digital data: what we buy, the websites we visit, the content we consume – even where we are at any given moment. But fewer people know that this data isn't just being bought by companies trying to sell us things. It's also being bought by the government and intelligence agencies. These mass data purchases (often via shadowy middlemen) is what investigative journalist Byron Tau set out to investigate in his new book, Means of Control: How the hidden alliance of tech and government is creating a new American surveillance state. This week on Whale Hunting, host Bradley Hope talks to Byron about how the US government dispensed with the need for warrants and secret court orders – opting to buy personal information from private companies instead. We cover the role of privacy engineers in ensuring compliance with data privacy laws; why 'browsing data' is 'sensitive data;' the challenges companies face regarding data deletion; and the need for clear consent mechanisms, especially with the collection and use of location data. We also discuss the need to audit the privacy posture of products and services - which includes a requirement to document who made certain decisions - and how to prioritize risk analysis to proactively address risks to privacy.Topics Covered: Heidi's journey into privacy law and advocacy for privacy by design and defaultHow the FTC brings enforcement actions, the effect of their settlements, and why privacy engineers should pay closer attentionCase 1: FTC v. The Rich Zeoli Show- Hour 2: During Tuesday's House Judiciary Committee hearing on Joe Biden's mishandling of classified documents, Rep. Adam Schiff (D-CA) accused Special Counsel Robert Hur of using “pejorative” language in his report to the Department of Justice as part of an attempt to “ignite a political firestorm.” On Sunday, Rep. Nancy Mace (R-SC) appeared on ABC's This Week with George Stephanopoulos. During the interview, Stephanopoulos questioned Mace's endorsement of Republican presidential candidate Donald Trump—saying Mace is endorsing a candidate accused of sexual assault. Mace responded by correctly noting that Trump has never been criminally convicted of assault. She continued, “you're asking me a question about my political choices—trying to shame me as a rape victim. And I find it disgusting.” Byron Tau—Investigative Journalist for The Wall Street Journal and Politico—joins The Rich Zeoli Show to discuss his new book, “Means of Control: How the Hidden Alliance of Tech and Government is Creating a New American Surveillance State.” Tau explains that, disturbingly, elements of the American government—including police agencies—have been purchasing user data from little known data brokers. This methodology of data acquisition allows these government agents and agencies to bypass the Constitution's Fourth Amendment, which prohibits “unreasonable searches and seizures.” Should TikTok be banned? Last week, the House Energy and Commerce Committee voted 50-0 to advance a bill that would ban TikTok or force ByteDance (TikTok's parent company) to sell the social media platform to an entity removed from Chinese influence. The full House of Representatives is expected to vote on the bill this Wednesday and, according to The Wall Street Journal, it is likely to pass with majority approval. According to reports, President Joe Biden has vowed to sign the bill into law if the bill ultimately passes the House and Senate and arrives at his desk. Shouldn't individuals be allowed to choose which products they use? Or is the risk of Chinese leadership gaining access to American user data too great to respect individual autonomy and free markets? Senator Elizabeth Warren has suggested that the proposed bill doesn't go far enough to prevent social media's influence, explaining that she wants “curbs in place on social media across the board,” according to Politico.

The Rich Zeoli Show- Full Episode (03/12/2024): 3:05pm- On Tuesday, the House Judiciary Committee held a hearing on Department of Justice (DOJ) Special Counsel Robert Hur's investigation into then-Vice President Joe Biden's mishandling of classified documents when he left office. During one notable exchange, Rep. Pramila Jayapal (D-WA) vociferously stated that Hur's report “exonerated” Biden of all wrongdoing—Hur then interjected that his report to the DOJ did not amount to an exoneration, nor was “exoneration” used at any point in the report. While being questioned by Rep. Kevin Kiley (R-CA), Hur reiterated that “the report is not an exoneration” and confirmed that a reasonable jury could have voted to convict Biden if the case had ever been brought to trial. Hurr also confirmed that the Biden Administration did, in fact, recommend “edits” to an initial draft of the report prior to its public release. 3:30pm- On Tuesday, transcripts of Special Counsel Robert Hur's interview with President Joe Biden over his mishandling of classified documents were released. Leif Le Mathieu of The Daily Wire writes: “Hur's February report concluded that Biden willfully retained classified documents but recommended no criminal charges in part because it said that Biden had a faulty memory and would appear as a sympathetic old man to a jury. One of the key details included in the report was that Biden did not remember the year his son Beau died. Biden said that he was taken aback by a question about his son, claiming that it was Hur who brought up the death… The transcripts, obtained by ABC, show that it was actually Biden who brought up his son… Biden also discussed moving boxes, which were full of classified documents, out of the way in his garage to park his car. He said he did not know what was in the boxes. ‘I remember moving boxes, literally physically moving them, with help, one side to the other so I could get the Corvette in that garage on the left,' Biden said. Kelly Armstrong (R-ND), Special Counsel Robert Hur said that there is an audio recording from February 2017 featuring Joe Biden speaking with his ghostwriter and explicitly referencing “classified” documents that he found in his house. At another point, Hur told committee Chairman Jim Jordan (R-OH) that Biden's ghostwriter appeared to attempt to delete the audio file but failed. 4:05pm- During Tuesday's House Judiciary Committee hearing on Joe Biden's mishandling of classified documents, Rep. Adam Schiff (D-CA) accused Special Counsel Robert Hur of using “pejorative” language in his report to the Department of Justice as part of an attempt to “ignite a political firestorm.” 4:20pm- On Sunday, Rep. And I find it disgusting.” 4:30pm- Byron Tau—Investigative Journalist for The Wall Street Journal and Politico—joins The Rich Zeoli Show to discuss his new book, “Means of Control: How the Hidden Alliance of Tech and Government is Creating a New American Surveillance State.” Tau explains that, disturbingly, elements of the American government—including police agencies—have been purchasing user data from little known data brokers. This methodology of data acquisition allows these government agents and agencies to bypass the Constitution's Fourth Amendment, which prohibits “unreasonable searches and seizures.” 4:50pm- Should TikTok be banned? 5:05pm- Jimmy Quinn of National Review writes: “Warner Bros. Discovery distanced itself from its recent partnership with a Chinese Communist Party propaganda organ after several GOP members of Congress wrote to the company's CEO demanding answers, National Review has exclusively learned. The entertainment giant had worked with the China Global Television Network (CGTN) to produce a documentary series, called ‘World's Ultimate Frontier,' about the Xinjiang region. The series conspicuously declined to mention Beijing's ongoing atrocities against Uyghurs and other minority groups and instead portrayed the area as a thriving cultural and industrial hub, leading Representative Jim Banks to accuse Warner Bros. of ‘whitewashing' the abuses.” You can read Quinn's full report here: https://www.nationalreview.com/2024/03/warner-bros-distances-itself-from-partnership-with-chinese-propaganda-outlet/ 5:10pm- In a post on the social media platform X, Tucker Carlson wrote: “In a classified briefing this afternoon, attended by officials from the Biden Justice Department, Alexandria Ocasio-Cortez claimed that Elon committed ‘election interference' in 2022 by ‘changing the algorithms' on X to alter the results of the midterms that year. Not coincidentally, the anti-TikTok legislation now being debated on the Hill would allow the federal government to force the sale of any social media platform that interferes in elections. Just so you know what's coming in 2025.” 5:15pm- Should TikTok be banned? Senator Elizabeth Warren has suggested that the proposed bill doesn't go far enough to prevent social media's influence, explaining that she wants “curbs in place on social media across the board,” according to Politico.   5:20pm- While appearing on MSNBC with Katy Tur, Vaughn Hillyard claimed that Republican presidential candidate Donald Trump's campaign is so cash strapped that they may not be able to afford to host rallies moving forward. 5:30pm- Rebecca Davis O'Brien of The New York Times reports: “Robert F. Kennedy Jr. has recently approached the N.F.L. quarterback Aaron Rodgers and the former Minnesota governor and professional wrestler Jesse Ventura about serving as his running mate on an independent presidential ticket, and both have welcomed the overtures, two people familiar with the discussions said. Mr. Kennedy confirmed on Tuesday that the two men were at the top of his list. It is not clear if either has been formally offered the post, however, and Mr. Kennedy is still considering a shortlist of potential candidates, the people familiar with the discussions said. In the days before his death, he had been giving evidence in a whistleblower lawsuit against the company. Boeing said it was saddened to hear of Mr. Barnett's passing. The Charleston County coroner confirmed his death to the BBC on Monday. It said the 62-year-old had died from a ‘self-inflicted' wound on 9 March and police were investigating.” You can read the full article here: https://www.bbc.com/news/business-68534703 5:50pm- Lead singer of the Raspberries Eric Carmen has died at age 74. While listening to “All By Myself,” Rich reveals that a girlfriend once broke up with him over voicemail. 6:05pm- On Tuesday, the House Judiciary Committee held a hearing on Department of Justice (DOJ) Special Counsel Robert Hur's investigation into then-Vice President Joe Biden's mishandling of classified documents when he left office. 6:15pm- During Tuesday's House Judiciary Committee hearing, while being questioned by Rep. 6:40pm- While briefly speaking with reporters in New Hampshire, President Joe Biden was asked if he is considering executive action to address the chaos at the U.S. Southern border. Biden said, “I'm counting on the border action happening by itself.” 6:50pm- While speaking with Manu Raju of CNN, Sen. John Fetterman (D-PA) referred to Sen. Bob Menendez (D-NJ) as a “sleazeball.” Menendez has been charged with obstruction of justice, conspiring to act as an agent of Egypt, and accepting bribes.

The practice of surveillance capitalism—the widespread private collection and commodification of personal data—is well understood. They also discussed why this form of data is so important to the government and the prospects for reform of the relatively unregulated practice.Support this show http://supporter.acast.com/lawfare. Embarking on a more senior executive role in your career can be very rewarding, yet it also poses several challenges. In this episode, we delve into the intricate dynamics of leadership transitions, uncovering strategies to make a profound impact in your new leadership position from the get-go.[3:10]  Understanding the nuances of your new role compared to your previous one is pivotal. Letting go of familiar tasks and delegating these can prove challenging, especially if you excelled in those tasks and now must entrust them to individuals with less experience or lower skill sets.[7:15] Moreover, grasping the unspoken expectations beyond your job description is crucial. 'Stakeholder mapping' emerges as a valuable exercise. Begin by identifying internal and external stakeholders and discern their expectations. Delve into understanding their concerns and how you can alleviate them.[12:34]  As leaders ascend within an organisation, the focus inevitably shifts towards strategy and people development. Unlike 'individual contributors,' leaders navigate success by empowering and enabling others. "Leadership is creating the conditions for people to be their best."[15:36] Even in high-ranking positions, wielding direct decision-making power may be limited. Leadership pivots towards influence rather than authority. It commences with attentive listening and empathetic understanding of others' challenges. The key lies in making interactions with you enriching, demonstrating how your contributions add value, thereby enticing others to engage with you. (For more on influence, see also our episodes Out of Control — How to Lead Through Uncertainty? and The Charms and Challenges of Leading Sustainability.)[19:10] Balancing the urge to swiftly deliver results with the imperative to build robust relationships and understanding the intricacies of your new role. While seeking to showcase your capabilities after a promotion, hastiness can lead to errors. It's prudent to take ample time to thoroughly comprehend your new terrain before taking decisive action. [26:02] Leadership training programs offer an avenue to accelerate leadership transitions. However, their effectiveness relies heavily on catering to the needs of the individual leaders. Often, theoretical knowledge from such programs proves challenging to implement in everyday scenarios, making them most effective when complemented by personalised executive coaching.[28:46] Reflection Questions for LeadersHow can I strike a balance between my drive to achieve immediate wins and the time required to nurture relationships and comprehend various stakeholders' perspectives? When comparing my new role to my previous position, what practices should I retain, what do I need to let go of, and what do I need to add on?Considering 'What Got You Here Won't Get You There,' which traits and behaviours that previously propelled my success might now serve as obstacles?"More info about us and our work is also on our website: secondcrackleadership.com.Do you have any feedback, questions, or comments? A lot of the behavioral sciences can feel intimidating. However, it doesn't have to be. The Five Rules Podcast Series is our attempt at giving you an easy entry point into the complex and messy world of Behavioral Science.   In my 20 years as a consultant for Customer Experience, I have been involved in several successful implementations. The Maersk Line project that I worked on with Michél Patterson, a continuous improvement expert in Lean Six Sigma was one of the most, with an improvement of 40 points for their Net Promoter Score® (NPS) over 30 months. What's more is they also experienced a 10 percent increase in shipping volumes.   Implementation was a big part of that success. To that end, in this episode we share the five rules of a successful customer experience implementation. Patterson takes the lead on this one, as a career-long believer in continuous improvement providing the following five rules she used in her first, and very successful, project with customer experience improvement:     Define: What are you trying to accomplish? Measure: How will you know if what you do is working? Analyze: What changes are possible that might improve experiences? Improve: How can you roll these changes out on a larger basis? Control: How can you keep things moving in the right direction?   In this episode, we cover these five rules and how they played out in our highly successful Customer Experience implementation for the world's largest shipping container company.      Key Ideas to Improve your Customer Experience   If you know anything about Lean Six Sigma, you probably recognize the five rules. These phases of the implementation serve as excellent guideposts in a customer experience project like this one. Patterson says that for her first project in the implementation area, these five areas were the natural inclination for organizing their efforts with Maersk.    Here are a few key moments in the discussion:   06:44  Patterson explains how she didn't have a lot of experience with handling customer experience improvement projects, so she relied on her Lean Six Sigma background and project management structure, starting with Define. 14:43  Patterson explains the concept about putting Measure second in the list and why it is essential it is there. 22:04  We discuss the third in the list, Analyze and how the changes you make are going to improve the experience and move the metric identified in the second step, Measure.    25:00  Colin brings up the Ambassadors, how they were chosen, and the role they played in the implementation.  26:52 After you improve your experience in a bigger way based on the first three steps, you land at Control, which is where you keep things going and improving continuously.   30:58  Colin adds in some details he remembers from the implementation and how they played into the success of the overall project.     Please tell us how we are doing! Today's episode (or 2-part series) is quite heavy - we are going to be talking about sexual harassment in fundraising. There is explicit content and potentially triggering storytelling so I want to make sure you listen to today's show in the right place - mentally, physically, and emotionally.   For this series, I have the incredible honor of interviewing Dr. Ann Olivarius who is recognized around the world for her pioneering work in representing victims of sexual violence, sexual harassment, and discrimination. Her firms in the US and UK have achieved landmark settlements for survivors of abuse and have successfully coordinated international efforts to bring perpetrators to justice.  In this episode, we hear about Ann's coming of age and the background stories that led her to birth the legal case for sexual harassment and coin the term date rape. You will learn about Dr. Olivarius' experience as a philanthropist as a part of Women Moving Millions, and how that experience has led to additional awareness about the different money stories we hold, and how deep they go.  In this conversation, we talk about some of the gender dynamics and historical foundational elements of the funder/fundraiser relationship that make it particularly vulnerable for sexual harassment situations. And we talk about some of the other forms of violence and racism in the sector because, as we know, sexual harassment is not the only form of harassment and abuse. At the same time, we also know that sexual harassment is a huge issue in our sector and one that needs to be talked about in a bigger way.  Dr. Olivarius shares a wide perspective on the issue; she shares some cases she's worked on through her successful career and explains why we urgently need to change fundraising norms in the sector to break the cycle of toxic power dynamics.  Episode Highlights Part 1:  (04:42) - Who is Dr. Ann Olivarius? The sexual abuse and power dynamics during her coming of age and how that led to the work she does today. (08:53) - How the legal basis for sexual harassment came to be what we know today (17:07) - Dr. Olivarius' experience with Women Moving Millions and how it impacts the way she looks at the movement of money and fundraising   (20:23) - Drawing the Line: The importance of holding people accountable for sexual harassment even if other problems arise as a result (22:29) - Money and Control: How theories on money and the movement of money is used to reinforce and protect power  (23:43) - Sexual harassment in philanthropy: the gender dynamics and historical foundational elements of the funder/fundraiser relationship that make it particularly vulnerable for sexual harassment  (27:06) - How do you know when it's sexual harrassment? Inspiration for this week's episode comes from one of Nicole's clients: There are no prince charmings. Yet, too many women are acting like the professional version of sleeping beauty, waiting for the professional knight in shining armour or the prince charming to swoop in for their career. It is an enormous mistake. Nicole shares personal stories about how she co-created bad working situations that held her back: staying at a job with a crappy manager who accused her of not being a team player (when he actually meant ‘masculine'), staying in a gendered situation that held her back, accepting poor behavior as part of the experience of getting a promotion.  How you can stop being a sleeping beauty and become your own knight with control and joy in your career.   Related Episodes: Are you Underpaid, Overworked or Underinvested as a Women in Tech? Why Marketability and Social Media is Altering the Playing Field for College Athletes

For years, college athletes have racked up Twitter and Instagram followers due to their on-the-field fame, but despite these large followings, a quarterback known for slinging touchdowns was prohibited from slinging endorsements thanks to a system that prohibited athletes from profiting off of their image or performance. But this summer that changed, and with college athletes now able to profit off their name, image, and likeness, it's left companies such as Captiv8, an influencer marketing platform, ready to hit the ground running with a new pool of talent. “Scale for creators or athletes within specific verticals is pretty tough. It's hard to snap your fingers and get a hundred college athletes activated in minutes. Platforms like Captiv8 have made it easier to do that in the digital creator space. With creators that have been around for a while, you can go through specific verticals. With college athletes, it's a green field right now.”Krishna Subramanian, is the Co-founder of Captiv8, and on this episode of Marketing Trends, Krishna goes deep into the weeds of influencer marketing and how these new opportunities with college athletes can help brands. Plus Krishna provides some dos and don't for brands that are looking to partner with influences. Enjoy!Main TakeawaysInfluencers are an Extension of the Brand: Over the last year, brands have leaned more and more on influencer marketing. But despite how loyal an influencer's audience might be, that audience might not be a match with your brand. Make sure the values of your brand align with that of the creator and with the people who make up their pool of followers.Fighting for Control: How much creative control the brand and the creator requires is one of the main things to consider when partnering with an influencer. If a brand wants more control, don't partner with top influencers. Instead, partner with lower-level creators that are looking to grow their audience.Going Further Down the Funnel: Right now, influencer marketing is specifically focused on branding and building awareness, but there are far more areas for marketers to derive value from it, including measuring a product viability and the ability to scale content across multiple channels.---Marketing Trends podcast is brought to you by Salesforce. Our relationships with other people are some of our greatest joys and challenges ... they stretch us in so many different ways... they are teachers, catalysts, and initiators. And by nature, they change over time. When we are in relationship to our relationships, we gain the power to make shifts in them before they become sources of drama, distress, and dis-ease. But let's be honest, most of us spent more time in our education learning math and memorizing facts we will never us, and not enough time on what it looks like to be a human who knows how to maintain, nurture and grow healthy relationships. Let alone how to have the kinds of courageous and compassionate connections and conversations that are needed to navigate the emotional terrain of our relationships with each other.  While I could do a whole separate podcast on relationships, and maybe I will someday, I decided to focus this episode of Feminine Power Time #149 of "How to Shift Your Relationships so They Work For You."  And I invited the man who taught me about 85% of what I know about relationship and who often has saved me from relationship landmines. This is #2 of 3 in our series of Redefining Our Relations. Join me, Christine Arylo, feminine leadership advisor and my partner in life, love and business Noah Martin. Together, we dive into: Where the power lives to make shifts in the relationship that are not working for you How to tell when a relationship is not working for you Where NOT to focus trying to do things differently And  How to identify your triggers and the ways you are creating the reality you don’t want How to see what’s happening with the other person which empowers you to change things vs. blame things We’ll share some practical tools you can use in real time such as: The power distortions to beware of : Co-signing and Control How to tell if you have a potential thriving partnership or a relationship its time to let go How to ask for what you need to create harmony What to do when conversations start to go sideways And then send you into the world to try this and see what happens - brave, courageous soul! Relationships are one of the ways we can create a better world for ourselves and the planet. It’s not for the faint at heart … but it’s where the gold is. See you there. Christine ** Resources 1. To be successful in most organizations, it's important to understand the underlying conversations and reactions that people in the room are having. But if you aren't picking up on those subtle cues, how can you learn to do so? What signals should you be looking for? And what can you do to influence the unspoken dynamics? Some of the tips from the article are: Observation - The best way to read a room is to pay close attention to people — and not just what they're saying. Upon entering a meeting, a quick scan of the individuals, noting who's next to whom, who's smiling, who's not, who's standing, who's sitting, and how much space is between people. Government Taxes Replace Theocratic Tithes (Romans 13:1-7) Paul is speaking specifically about governmental authorities, directing that taxes be paid to the state. In this case, Rome had replaced the theocracy in the governing of Israel. Though the Law of Moses was respected as tradition by the Romans, and the Israelites were allowed to follow the commandments, Israel was no longer a theocracy, and was not free to worship God the way God had commanded them to. Summary of Tithing Under Grace Throughout the New Testament, Paul's vocabulary and teaching suggest that giving is voluntary and that there is no set percentage. In fact, nowhere in the New Testament are believers told to tithe by anyone! Or even how much to give, when or to whom. They are only encouraged to provide for those who are in need, their ministers, and for the stranger. WHERE ARE WE NOW? Under Law? Under the Law, relationship with God is defined by how well you fulfill His commandments. Anyone can attempt do this; you don't have to know God to tithe. Tithing doesn't bring anyone into a closer relationship with God or with others, and it doesn't contribute to a relationship that already exists. Grace Full Relationship! We still find it so hard to comprehend that the God of the universe loves us so much that there is nothing He requires of us but to accept His love. He provides for us because He loves us. CONSEQUENCES (Why Is This So Important?) Matter of Control How much, when and to whom we give of our resources, our time and our money, is often one of the ways we gain or maintain control.
