EPISODE 106 | Suffer the Children – Pizzagate, Wayfair & the Seeds of QAnon "Without a clear indication of the author's intent, it is difficult or impossible to tell the difference between an expression of sincere extremism and a parody of extremism." In the world of the internet, this is known as Poe's Law, and it's especially applicable to the weird narrative Gordian Knot known as Pizzagate. The adage applies not just to how absurd some beliefs are, but also to the arguments made by people who hold these beliefs. First formulated in 2005 by Nathan Poe, it builds on a 2001 quote by Alan Morgan called Alan's 2nd Law of Newsgroups, which states, “Any sufficiently advanced troll is indistinguishable from a genuine kook.” And that is certainly the case for the wild story that “a hipster-heavy pizza parlor” (as they put it on their website) in the Chevy Chase neighborhood of Washington D.C. is not just a fun family place with pizza, ping pong and live music, but the nerve center for an diabolical child trafficking ring that operates out in the open because they are protected by highly-placed pedophiles in the Democratic party. As an article on Cracked.com puts it, “This is supported by lots of very stupid evidence”. The stakes of the fake narrative are so high that it's become more than just true believers review bombing the place. Workers have been harassed and, on December 4, 2016, a heavily armed man entered the restaurant and started firing guns. The story of Pizzagate is the story of how the conspirasphere went from harmless kookery to being actually, physically dangerous. DuCharme, Acting U.S. Attorney for the Eastern District of New York. “With Mackey's arrest, we serve notice that those who would subvert the democratic process in this manner cannot rely on the cloak of Internet anonymity to evade responsibility for their crimes. They will be investigated, caught and prosecuted to the full extent of the law.”“Protecting every American citizen's right to cast a legitimate vote is a key to the success of our republic,” said William F. Sweeney Jr., Assistant Director in Charge of the FBI's New York Field Office. “What Mackey allegedly did to interfere with this process – by soliciting voters to cast their ballots via text – amounted to nothing short of vote theft. It is illegal behavior and contributes to the erosion of the public's trust in our electoral processes. He may have been a powerful social media influencer at the time, but a quick Internet search of his name today will reveal an entirely different story.”The complaint alleges that in 2016, Mackey established an audience on Twitter with approximately 58,000 followers. A February 2016 analysis by the MIT Media Lab ranked Mackey as the 107th most important influencer of the then-upcoming Election, ranking his account above outlets and individuals such as NBC News (#114), Stephen Colbert (#119) and Newt Gingrich (#141).Luke O'Brien's story revealing "Ricky Vaughn's" identity as Douglass Mackey“During Gamergate, a 2014 online harassment campaign waged by misogynists and racists online against women and minorities in the video game industry, Ricky Vaughn linked up with Yiannopoulos and Cernovich, who were ringleaders in the harassment and would both go on to even greater notoriety with their attempts to contaminate American political discourse with conspiracy theories.“I owe a lot to them,” Ricky Vaughn said on a recent podcast.By the beginning of 2016, he was clearly an open “alt-right” white nationalist. He talked about how “the good people are siding with nationalism and the Shabbos goyim shills and the neocohens are siding with the globalists.” He talked about how he wanted to “introduce ideas of racial consciousness into the mix so that patriotic American conservatives don't feel bad about creating all-White communities and shunning mixed-marriages and that sort of thing, because we need racial separatism in order to maintain our unique culture and racial heritage.”Michael Edison Hayden on the Douglass Mackey trial - SPLCMackey's Ricky Vaughn persona seemed to disappear from the web until the DOJ produced these charges in January 2021. After the DOJ charged Mackey, he emerged as a cause célèbre among anti-democracy, radical-right figures, who have depicted him as a victim of state oppression. Daily Stormer and other racist websites raised money for his defense. Fox News' Tucker Carlson inaccurately described Mackey as a “conservative journalist” on his show in January 2021. Following Carlson's segment, an anonymous person dropped $60,000 to Mackey in Bitcoin, buoying his defense, as Hatewatch previously reported."Microchip" interviewed by Jack PosobiecJack Posobiec, a correspondent for One America News Network (OANN), brought a pseudonymous disinformation poster onto the air without providing context of that person's hateful and terroristic beliefs, Hatewatch found.Posobiec produced a segment for OANN in September 2018 in which he interviewed “Microchip,” who was at that time a pseudonymous contributor to the white-supremacist-friendly website Gab. Videos garnered millions of views claiming that on April 24, 2021, large groups of men planned to sexually assault women en masse. Now, the same hoax is reemerging on the very same social media platform, which seems unable or unwilling to curtail the spread of viral misinformation.While the “National Rape Day” hoax had been previously floating around the collective consciousness as an urban legend, it found new levels of virality through TikTok's recommendation algorithm in 2021. The earliest mention of “National Rape Day” on social media that Media Matters could identify was a tweet from April 11, 2021, that read, “Please if you are in the uk, be safe, the boys have made a ‘national rape' day and that's tomorrow.” A screenshot of the tweet was circulating on 4chan's /pol message board the next day.It seems that shortly after this tweet, the hoax started to spread on TikTok, where it went viral. At the time, a Media Matters study found that 48 of the top 50 TikTok videos under the “#April24” hashtag contained misinformation and none of the videos provided a debunk or any factual information. The hoax gained further legitimacy through poor media coverage, which amplified the panic, as well as participation in the trend from some members of law enforcement on TikTok.TikTok's algorithm leads users from transphobic videos to far-right rabbit holes - Media MattersSeveral of the videos fed to our FYP featured audio called “Teddy” which says, “The industrial revolution and its consequences have been a disaster for the human race,” a quote taken from the first line of “Unabomber” Ted Kaczynski's manifesto, “Industrial Society and Its Future.” Kaczynski killed three people and injured 23 others in 1978 with homemade bombs. The audio, which already has been used in over 1,200 unique videos, has become popular on right-wing TikTok and particularly in anti-LGBTQ content, based on the frequency with which it emerged during our study. In the videos we reviewed, it was frequently paired with montages of screenshots of LGBTQ people livestreaming on TikTok. It's hard to build out a D2C product if you're not willing to commit.” -Patrick O'Keefe The magic of the unexpected in media products (13:04): “I think there is something magical that can happen when you take some of the expected nature of television or media, of what we expect is going to happen, and you throw the consumer, the community, the members, the subscribers into that. You give them the freedom to make other things happen.” -Patrick O'Keefe Operators drive moderator tool development more than platforms (22:24): “[When it comes to moderator tools], it's often the community of people who need something driving it more so than the platforms themselves.” -Patrick O'Keefe Developers still focus on the frontend more than the administrative backend (23:35): “It's a cliché to say that software developers focus on the frontend and the user experience and not so much the admin and moderation experience. That's a cliché in our business. I think that is largely the case with some exceptions. Those exceptions tend to be people who have run communities themselves or who have a really good foundational understanding of the web from being in it for so long.” -Patrick O'Keefe If you want to make a difference in moderator tooling, start with the communities that don't have money (23:58): “I get pitched by developers, and I always tell them that the way to make change in this industry is to make your product available to the people who don't have anything. The Fortune 500s of the world are always going to have money, and they're always going to have engineers. They can figure their way around problems and pay for solutions. Most communities, 99.9% of people, don't have any money. That's where you make change.” -Patrick O'Keefe Artificial intelligence isn't a moderation panacea (24:36): “If you think about it [going back 25 years], forums are not dead and the mod tools are basically the same that we had. Remove user, close thread, things like that, a lot of that stuff. It's the same. I also don't think it's a bad thing. If it ain't broke, don't fix it. One of the things about these AIs is sometimes they get it really, really wrong in really offensive ways. You still need that human element to counter that.” -Jared Smith Banning Andrew Anglin is not brave, it's obvious (27:09): “When [Elon Musk decides] to unban Andrew Anglin, who's arguably the most prominent real nazi on the internet, the founder of The Daily Stormer, the most prominent nazi publication on the internet [that makes Twitter a place I am less likely to engage]. … Andrew Anglin can join any platform I own and he'll be banned. That's not a brave thing. That's not a talking point or like, ‘Wow, that's amazing.' It's obvious. It's not an amazing thing.” -Patrick O'Keefe Hyping the chief community officer role isn't helpful (39:46): “We've seen these tweets that are like, ‘Half of the Fortune 500 will have chief community officers in the next 10 years,' or ‘10% of this or all big companies or all the Fortune 100 or the future of companies will be a chief community officer.' It's all hype. It's all nonsense. For the most part, it's to encourage hype in our industry. I don't see it as healthy. I don't see it as good. I don't see it as aspirational. I don't see those people as friends or allies of the work.” -Patrick O'Keefe Be wary of the hype (41:42): “I don't trust anyone who says chief community officers are the future of community, that there's going to be one at every big company. It's always hype. It's always because they have some financially-vested interest in community work proliferating in that way or at least sounding like your friend. From September 3, 2020: This week on Lawfare's Arbiters of Truth series on disinformation, Evelyn Douek and Quinta Jurecic spoke with Alissa Starzak, the head of public policy at Cloudflare—a company that provides key components of the infrastructure that helps websites stay online. They talked about two high-profile incidents in which Cloudflare decided to pull its services from websites publishing or hosting extremist, violent content. In August 2017, after the white nationalist rally in Charlottesville, Cloudflare's CEO Matthew Prince announced that he would no longer be providing service to the Neo-Nazi website the Daily Stormer. Parker Molloy: So you've been writing this awesome newsletter over on Substack, called The Sword and the Sandwich. Can you tell me a little bit about that?Tal Lavin: Yeah, so I launched, actually, this month, October 4th, and it's a really odd... It is an odd mix. Like, I recognize it's an odd mix. The sword is first of all, because I own a bunch of swords, and love them, but also, it sort of symbolizes like I'm writing about the American right and far-right, and then the sandwiches are very literal. Like, for a really long time, I have been obsessed with Wikipedia's list of notable sandwiches, which has hundreds of sandwiches on it, from all over the world, and I have wanted to address this in some systematic way. I love projects that have structure that I can f**k around within, like a sonnet.So the premise is I'm going through every sandwich on that list. It's very arbitrary, you know? Obviously a Wikipedia thing, so it's... But I'm treating it almost like a sacred text, and then going through it and writing essays, or interviews, or recipes, or stories about each sandwich. We've covered the American hero, the bacon sandwich, and bacon, egg, and cheese, and now this week, we're on to bagels, which is exciting for me, so yeah, this week's content is harrowing tales of child abuse and bagels.That's just such an interesting combo. And just to be... Like, those are separate posts. They're not-Oh, yeah, it's not-They're not one in the same.Yeah, so it's like Monday is the s**t that will horrify you, and then Friday, we're riding into the weekend--is the stuff about the American right.No, Friday is the-Horrifying bagels.No, I really aim not to traumatize anyone with my sandwich posts. These are nonviolent sandwiches. It's like I need the break, psychically. Maybe readers do too. Sometimes, it's really hard to shift moods, when... Like, the current series is about corporal punishment in evangelical households, and the sort of ways it impacts people as adults. So it's really hard for me sometimes, to switch modes. I almost resent it. I'm like, "Ugh, now I have to write about bagels," but then I spend an hour researching and writing about bagels, and I feel better, and then dive back into hell.Yeah. Well, as you mentioned, you published the first of a three-part series on corporal punishment, evangelicals, and the "doctrine of obedience," as you write in the piece. I found it fascinating because I honestly didn't... I've never really thought about the history involved in all of that. I'm used to people on Twitter being like, "I don't think it's wrong to hit kids. I got hit, and I'm fine," and then you look at them, and you're like... They're not fine.No. Yeah.No, it's like, "Oh, you think you're fine. But are any of us, really?"I'm not.I'm definitely not.I'm so not fine, and I wasn't raised evangelical. I'm a Jew, and I'm a childless Jew even, so it's not... I can keep some distance from the material. Well, obviously so many people shared their pain with me for this series, lots of different facets of their pain, their stories, how they're coming to terms with it, how they're healing, and to me, not to be melodramatic, but it felt like, "Oh, this is why I became a journalist," and like, I have to hold this pain gently, and treat it well, and treat it as the sacred trust it is. I mean, I don't believe in any god, but whatever. Sometimes I think of things as holy or sacred, as just a stronger word for like really important. Feels necessary.I've been astounded at the response. I mean, I tried to... I have a tic about historical research. Like, almost every piece I've ever written has some element of history in it. I also dove a ton into primary sources for this piece, which in this case was Christian parenting guides, of which I read big swaths or the entirety of like three or four books, and then tons of people's testimony about how these doctrines affected them.And then, I looked at what's the historical context? Like, why did all these books start getting written in the '70s and updated in the '90s? I mean, corporal punishment obviously has been around forever, but like, corporal punishment as sort of a political necessity and as a theological doctrine really arose as like... and the evidence is pretty clear, in the books themselves, and also in like the historical record, that they arose as basically a backlash, both to the work of Dr. Spock, who wrote Baby and Child Care, and he was super popular, and everyone loved him, and he was also an antiwar activist in his later years, and got arrested protesting Vietnam. And he said don't hit your kids, right?It's hard to overstate how much these authors hate Dr. Spock. Like, they hate him. They think he sucks, and he's the reason everything's wrong, but anyway, you have this Dr. Spock influence telling you not to hit your kids, and then essentially what these books posit, or what they feel they're reacting to is like, a lot of the movements in the '60s were student-led. The antiwar movement, the gay rights movement was a youth-led thing in many cases, or perceived as a youth-led movement, the feminist movement was really led by young women, and the sort of curative, the corrective force is writing these books.James Dobson, of Focus on the Family fame, his first book was called Dare to Discipline, like he's like, "We're fighting against this godless heathens that tell us not to hit our kids." So basically, they're saying chaos and social disorder starts in the home, and you have to hit your kids to get them in line.I cannot wait to read the second and third piece of this, because the first one is great. It really starts to get into Dobson, and The Pearls, and all of that stuff, and the responses have been heartbreaking, that I've seen from people, where they are talking about how it affected them on a personal level, and on one hand, it's amazing that the story has resonated with that many people, and that that's clearly captured what they're feeling and what they're going through, and I mean, that's just you being a great writer, and interviewer, and researcher. I mean, beyond that, it's just so profoundly sad that there are so many people in this world who have been hurt in that sort of way. They haven't felt able to express these ideas themselves, for fear of backlash or for fear of coming off as weak. That was another thing that I saw in some of the replies here, but-Or because they were taught that it was holy, that it was ordained by God, and a lot of the people, the people who spoke to me, have left evangelicalism. There's a process, it's like a very common term, and sort of ex-evangelicals. Basically, it's just calling it deconstruction, sort of tearing down the doctrines you were raised up with and figuring out a new way forward, and I really applaud people who are doing that work. It's very difficult. It's very painful.My Substack's really new. Like, I have 3,000 subscribers. It's small. The post, as of now, it's been out for less than two days, and it's gotten 50,000 views almost. I think to me, that's just an indicator of how it resonates, how people... I mean, first of all, I think there are a lot of outsiders who are sort of horrified, and then there are a lot of people who are like, "This was my childhood. I've never heard it discussed this way. I've never connected these dots." And the heartbreaking thing is like people are so grateful, grateful, that someone cares, anyone, about what happened to them. Generations of kids, generations. Like, the people who talked to me ranged from 22 to 65. It's very much a live issue, and it's still happening, although spanking is, thankfully...I hate the term spanking, actually, because spanking, I think has a lovely place in kink, but when you're talking about it in child-rearing, you are talking about hitting kids, so I've actually sort of very consciously, in my public speech about this stuff, stopped using that term, because it feels like a euphemism to me. You're talking about hitting children with the intent of causing pain.That's exactly it. I made the mistake of not writing down any questions, because I was like, "I know you. We're going to just-"We're just going to vibe about-Yeah, and it's like, "Oh, man. This is so dark and hard," you know? But that's what I love about your writing. You wrote this amazing book, Culture Warlords.And yeah, it was about basically me f*****g immersing myself in online Nazi life for like 18 months, and it was hard. It was a hard thing to do, as a Jew, as a person, who doesn't like seeing clips of murders on my phone all the time, presented as just and right. But I guess yeah, my beat is like looking into darkness and coming back out with a report.It feels weird to be like, "You're so good at this," you know? This thing that involves hate, and darkness, and pain, but your book was my favorite book of last year, and it's one of those books that I recommend to anyone who's at all curious about what's happening in the world, because I don't think you could talk about any current event without talking about how so much of our lives is affected by the far right, and white supremacist groups, and antisemitic people, and it's really kind of scary how much all of that overlaps, you know? You have the white supremacist groups.They tend to overlap in their beliefs with a lot of the evangelical groups, which tend to overlap with a lot of the anti-LGBTQ groups, these sorts of things where there's a very powerful and strong coalition of people that, I don't know, they just make the world a worse place by what they do and what they say, not by existing. I mean, I'm all for people existing. I want to make that clear, but I think that their actions and what they do just makes things so much harder. Is there anything in going into writing that, or in just your work generally, that surprised you? Were there any ideas that you had, that you had to challenge and rethink along the process?Well, so one of the big... How do I put this? Okay. I will answer your question after, but this is something that... Culture Warlords was my first book. I had never written one before, and it has some first book syndrome, which is like I put too much of myself in it, you know? Where it at points bordered on the memoiristic in ways that I now look back on with a little bit of regret, just in the sense that it feels a bit self-indulgent sometimes, like we didn't need a chapter on my childhood.The other major regret I have is not including... I did address transphobia in these contexts. I didn't address it as much as it deserved. Like, it should have had its own chapter, and I'm working on a second book right now, called Lone Wolves Run in Packs, which is about sort of debunking the sort of Lone Wolf theorem that people radicalize in isolation, that sort of white supremacist terror arises because individuals make choices. It's much more about the communities that these kinds of extremism arise from.And I know transphobia is going to be at the center of a lot of what I write, because it is, at the moment, as Judith Butler very eloquently articulated recently in The Guardian, at the forefront and center of all of these rising fascist movements. And I mean, it is all interconnected. Like, that's what makes it sort of endlessly fascinating and sometimes a bit overwhelming, is like you don't know when to stop researching.For example, part two of this series is about basically how child corporal punishment affects romantic relationships in the future. Essentially, it's like if you grow up in an environment where you're told... where you accept pain as your due, and specifically in an environment where God is invoked constantly, your sinful nature is evoked constantly, and one of the more terrifying aspects of this whole Christian corporal punishment thing is like, there's a very strong recommendation in all of these parenting books. It's like, "After your kid gets spanked, first of all, if they cry too much from spanking, they're trying to manipulate you, so spank them again. And then also, like hold them, and tell them you love them, and explain, like whisper to them gently about obedience."It's creepy as f**k, to me, but it also is like, this is trauma bonding. Trauma bonding is a concept in psychology. It's a big way of how abusive relationships work, where basically, you're traumatized by someone. They hit you, they belittle you, whatever, and then they make up with you afterwards, and hold you, and comfort you from the trauma that they inflicted. So, these parental doctrines are essentially... And they're not unique to evangelicalism. I think the unique part here is that sort of theologically mandates in some circles and some biblical interpretations, but like it is pretty common, and the people that I see, who are defending hitting kids in my mentions, are like, "My parents always apologized after, and told me they loved me, and I turned out great," and like, "Did you? Because you're defending hitting kids to me. Like, you're pro-child assault, so I don't know how fine you turned out."But at any rate, at any rate, basically my A thesis of the second part, and this absolutely bears out in the 150 people that talked to me, many of them, and most of the people who responded to my questionnaire, which is a smaller subset, said like, "I was primed for abusive relationships. Like, I was primed. I knew how to pretend. I knew how to conceal my emotions. I was taught that I was worthless. I was taught that I deserve violence, and I could expect it from the people that loved me. Like, that was the lesson of my childhood, and of course, it went on to affect what I accepted as proper treatment in romantic contexts." And there's tons of other s**t. I mean, sorry. I'm babbling at this point, but it's like...You know, now I'm like reading a whole new set of primary sources, with Christian homeschooling materials, and these doctrines about patriarchy and submission, and like specifically it affects girls very strongly. Men are also affected, boys and men are also affected for sure, in slightly different ways. And I mean, of course it's all connected, right? If the people that I talked to did some really brave work in moving away from the ways they were raised with this kind of brutality, many people don't do that work, for many reasons, and go on to reproduce it in their lives.Like, it's really, really hard to say, like, "My parents, who loved me and who I love, hurt me, and did wrong," or like, "I hit my kids, and I was wrong to do that." It's like really, really, really hard, to make those moral distinctions, to assess your past and present critically, and a lot of people are neither inclined nor able to do that. And with all the empathy and respect that I can muster, I think one of the roots of authoritarianism in our country, and especially among the Christian right, is...And this is a nascent understanding. It's not backed with science. It's more just like what I've been researching lately. I think there is a current of tremendous violence that undergirds this culture. It's like, because hierarchies of sex, of gender, of spouses and children as property, you know, are at the core of this doctrine, and enforced by often brutal, often daily physical violence. So it's a self-reproducing ideology in that sense.Right. Yeah. And yeah, I mean, that's a great point. You know, one other thing I wanted to kind of touch on here, not to change gears too sharply, but one thing that I think that both... Because we both worked at Media Matters for a little bit, and one of the things there is just sort of examining the right-wing media ecosystem, which exists on big and small scales. You have Fox News, which is large, but you also have weird little networks of right-wing bloggers, that coordinate very closely, and that's not something you see on the left as much, or at all. That's why there's this ability of people on the right to really get people who oppose them to be quiet, to shut up, to go away, to not bother them because it becomes not worth it.And I know that there have been times where I've seen something, and I'm like, "I want to write about this," and then I have to think, is it worth it? And when you wrote your book, that was after you had already not only been targeted by randos online, but you had ICE giving you s**t. You had DHS upset, because you tweeted about an ICE agent's tattoo, which you were not the first person to tweet that, and you were really one of the few people who actually said, "Oh no, I mistook that tattoo. I am sorry. My mistake."But it was clear that there was this idea that you were influential in a certain sense, and they wanted to just make your life kind of hell. What was that like, and how does that affect what you write about and how you write about it? I mean, in the sense that there has to be sort of this fear that every time you go into writing these stories that you're going to get targeted. And I know that it can take a major toll on you, and I think that... I don't know. Just any time I see something like that happen, it just breaks my heart, because you do such great work, and yet you've had the federal government giving you a hard time, and trying to push you out of your job.Yeah. I mean, it sucked. That was back in 2018. But it recurs daily, in this very warped way. I got Ken Klippenstein in The Nation, to kind of tell my story through... We sued ICE under FOIA to be like, "What do you actually have?" And they didn't have my tweet, because I had deleted my f*****g tweet, which by the way, didn't say, "This guy's a Nazi." It was just a picture of the tattoo that ICE had tweeted out, without the guy's name, and it looked like an Iron Cross, and then like a picture of an Iron Cross. It was sort of like a question mark. Whatever. It was a late-night thing. I'd seen it tossed around in different circles already online.And I deleted it after 15 minutes. I was like, "I made a mistake," you know? People pointed out it might be a Maltese Cross. And the next morning, ICE issued a press release, blaming me. We FOIA'd their emails, and they were like, "Ah, we don't have her original tweet." No one had it. Like, given all the people that picked over every aspect of my life, you think someone would have screenshotted that original tweet if it truly virally influenced a trend. It didn't. It straight up didn't. That's not factual. But at the time, I mean, I was very young. I mean, not very young. I was younger, and naïve.You're like, "It was three years ago."I've aged 40 million years in the interim because that was my first... I had written a bit about the right. I'd started writing about it. I wrote my first piece about the far right in 2017, so I was pretty new in that realm. I'd had a couple of Daily Stormer pieces about me or whatever, but... It sucks, it hurts, it's weird, but when you are public, you kind of expect it. I was public on a much smaller scale than I am now, and I was employed. I was a fact-checker at The New Yorker.Oh, god. It was just like we were getting so much... The fact-checking department was getting hate mail, and at the time, right? I was very earnest. I loved my job. I loved my coworkers. It's still the best job I've ever had, probably ever will, because it was fascinating. I was learning something new every week. Like, I got to do research all the time, and it was great. Great. I called fascinating people constantly. But like, I really was like, this is... I was very like, this is impacting poorly on the company. This is impacting poorly on my peers. Like, I must sacrifice myself, because I just don't belong here anymore.And of course, like I was getting so much hate mail, and segments on Fox about it, because ICE painted a giant target on my back over a lie, because I was a convenient target. I mean, it's like The New Yorker. She's a Harvard graduate. She's Jewish. She's fat. She's the media. Whatever. Like, I was a very convenient culture war proxy. It was also at a time of very intense outrage at the whole babies in cages thing, so it's like let's throw some meat to the lions or whatever, and the meat was me.I mean, so it's like, I was so naïve, and so traumatized frankly, that I was... It was an awful week. Like, I self-harmed for the first time in ages. Like, you know? And it still comes up constantly. Any time I say anything, someone will be like, "Didn't you accuse a veteran of being a Nazi?" I'm like, "No, I didn't." Anyway. But like then you sound all tinfoily, when you're like, "The government was lying." Like, it's hard to... And I was stupid. I was stupid to resign, and thus cement a narrative that I'd done something wrong. I have so many regrets about how I handled all that s**t, like now, now that I've been through the fire a bunch more times.I will say, though, it severed me from traditional journalism, at least staffed traditional journalism. Like, I've written in a lot of publications, from The New Republic, to Vice, and whatever. I've had freelance bylines all over, but I've basically, besides a brief stint at Media Matters, which I got laid off for pay, for like money reasons, like they were trimming down their extremism department, which seems like a weird decision in retrospect.Yeah.Like, I haven't had a staff job since, and now I'm Substacking. I appreciate the stability of Substack. I also am like, obviously there's TERF ambivalence. Like, the first Substack experience I had was like Glenn Greenwald being like, "How dare you tweet," you know? And saying like I think Substack shouldn't have these outspoken TERFs on it anymore. Which f**k Glenn Greenwald. He's just like a troll all the time. I call him “Glerb” in my head.Glerb.Anyway. Whatever. It's not so interesting. I've written about... One piece that kind of goes into my reflections, and what I'd learned from that whole shitty, depressing incident, and its various ripple effects, like Laura Ingraham calling me a terrorist and stuff. I had a conversation with Lyz Lenz, who writes the Men Yell at Me newsletter, where we talked about kind of what it feels like to get these kinds of mobbings. They are absolutely techniques to silence. They are very frequently employed by the right, because the right has a much stronger villain of the day kind of methodology. That's what they do. That's like... We've studied right wing ecologies of information, and like, essentially it's like, yeah, a villain of the day can go through so many iterations, from all of these ideologically completely uniform, like punitively distinct media brands. It's a little like the five minutes of hate thing from 1984, and when you're the subject of it, it's very... And I've talked to a lot of women particularly, and transwomen, women through queer women, just women, basically, through... I'm sorry to make that... I didn't mean to make that as a distinction. It's just more like the different loci of vulnerability.We're good.It's like been almost exclusively women, through the process of like, "How do I get my information offline? How do I deal?" I have some practical tips, mostly just sign up for DeleteMe. It's a useful service. Anyone who's a journalist, frankly I think should be signed up for it, because you'll have... Chances are, you'll have your time in the hopper, especially if you are not a conservative white man. But like, a lot of it is emotional guidance. Like, the way I describe it sometimes is like having the roof ripped off your life. Like, you feel like you're just toddling along, a relatively insignificant figure, and suddenly, you're in a national spotlight as villain of the day. It's a f*****g traumatizing experience, really. I feel like this podcast is you asking reasonable questions, and then me like just rambling.No. I mean, it's all very fascinating, because it's hard to explain to people who haven't gone through anything like this, because on a smaller scale, I've gone through this. Like, there was one time, I was at home, and I was just sitting there, and Andy Ngo posted a thing that was... It was like a photo that showed his backpack, with white dots on it, and I said that it looked like a pigeon pooped on him. I thought that was just kind of funny, and I closed Twitter, and I took a nap. Then when I woke up, I had people who were like, "Wow, you were cheering for him to be poisoned with cement milkshakes and beaten to death," and I'm like, "What the f**k?"So then I delete my tweet, and I say, "I'm sorry. I didn't mean for it to be taken that way," et cetera, et cetera, and one thing I've learned is if you publicly acknowledge something and if you publicly apologize for it, they go, "Ha, we've got you." And that happened with... I remember there was one time, there was a trump rally, where David Weigel at The Washington Post tweeted out a photo that showed the rally kind of half empty, but he took it from a weird angle. It was an accident. He accidentally showed the rally looking small, and Trump himself, who at the time was the president of the United States, tweeted out a demand for an apology, so Dave responds by saying like, "Yeah, sure. I'm sorry. That was a mistake. Here. Here are some other photos from the event. We're good, right?"And then the response to that was Trump then said, "You should be fired," you know? It's this whole thing where if you ever acknowledge that maybe you got something wrong, that is what they just cling onto and create their narrative around.Yeah, I mean-That's why it's so frustrating.... it's “don't show the whites of your eyes” kind of vibe.Yeah.Oh, Andy Ngo is such a putrid f**k. I really hate him. I called him a... I think I called him a fascism-adjacent dipshit in my book, like down on paper. I wish it was in the index as like, "Ngo Andy, fascism-adjacent dipshittery of,"See also.Like, yeah. Right? He sucks, and he's so deeply transphobic and racist. Like, all of his... It's interesting. Like, he's a very big purveyor of the five minutes of hate format, and he always highlights gender-nonconforming protestors. He highlights black protestors. It's very calculated. It is very... obviously comes from very deep-seated bigotry on his part, and to me, that is just factual. It's the way he works, and he knows who his audience is, and he is who he is. We met once, because I was covering this conference. It was like him and-Oh, I remember that.It was in the book, yeah. It was like him and Tim Pool, like organized this conference to prove how tolerant they were, and I wound up being chased out.Yep.Which to me was pretty... And then they were like, "You were chased out? You just walked away, while being followed by people." And like, okay.Well, and also you were live-tweeting it at the time, so it was very clear what was happening, you know? It's like anyone who was reading your tweets saw that you were... they were... There were people there who were treating you horribly, and then you-Well, Ngo said I look like a pigeon, and that I'd waddled away, which like, pigeons are very noble birds. They can eat garbage without any adverse effects, and they successfully hide their young offspring such as I've never seen a baby pigeon. So, I admire the pigeon as an urban bird, and I don't find it offensive. And you know what? But whether I waddled, or sauntered, or whatever, people were screaming at me, and I would describe that as being chased... It's so surreal. You wind up in... I think I opened the chapter on that rally by just being like, "I'm sitting at home, arguing about whether I was chased or not." Like, you wind up in these obscene, stupid semantic scenarios, and they were like, "We're going to get security footage from the casino." It was held at a casino, "Like to prove that you weren't chased." And they never produced the security footage. They found like one security chief guy who was like, "No one was chased, probably." Because of course he would say that, right?Yeah. They're not going to be like, "Yeah, someone was chased, and we just kind of sat back and were like, huh."Like, "Yeah, people routinely get ideologically run out of our casino." Like, you know? And they're so enamored of gotchas. They also love choosing the most unflattering pictures of me online. I think also when you're a woman, and like, so they inherently see you in this sexualized way, the sheer amount of fucked up s**t that's happened with my photos... Someone posed as me on 4chan, and it was like, "I'm Talia Lavin, a journalist, and here's a bikini photo of me to prove it," and three separate times. I had posted one bikini photo in the history of time on the internet, and like, it's just weird s**t, like saying, "You look like a neanderthal," or weird Photoshops. You know what I'm talking about.Oh, absolutely.Like, it's very sexualized, and it's also this mix of like, "You're disgusting, and I'm going to sexually demean you, and..." Like, I will say, that's one of the things that I know has left some residual psychic s**t. Like, I've had periods of my life where I look in the mirror, and I'm like, "Am I the monster they think I am?" You know? And it really depends. It's like, if I'm having a good day, mentally, it all just slides off my back. If I'm having a bad day, it can sink in. And this, "Don't feed the trolls" s**t, like they're not going to go away.No.If you feed them or not.Yeah.Like, you know? It's not... You can't blame people who are targeted for how they react.Right. Yeah, and that's the thing. It's like, I still don't know what the right way to respond to-There isn't like-... harassment is, because there's not, yeah. It's just a bad situation, and it's... I mean, that's part of the reason... I don't know. I felt there came a time where I couldn't just mentally commit to having a full-time job, if that makes sense. I mean, I kind of got to this point where my mental health had just deteriorated from a lot of the same stuff that you were just kind of talking about, where-Also Media Matters specifically is like, look at horrifying and traumatic s**t all f*****g day.Yeah. It's like, I love the-Write it up in these little bulletins that no one reads. Like, I mean, it's great, and they do great work, but like-Great work, but-... it is a tough organization to work in.Yeah. I mean, and I feel like it's only gotten harder over the years, because it used to be like, "Hey, look, Bill O'Reilly said something that wasn't true." And now it's like, "Oh, Tucker Carlson invited the grand wizard of the KKK to..." You know, and you're just like, "How did we get here?" And especially the people there who have to do so much of the research on 4chan and all the online stuff. That is-Well, I mean, that was my job.Yeah, that was you.Every time I talked to... Every time someone would say to me like, "Oh wow, I can't believe that you have to do..." I'm like, "At least I don't have to watch NRATV every day. I don't have to go through 4chan." I mean, people would point out to me whenever something I tweeted would end up being screen-capped and posted to 4chan, which was sometimes helpful, and sometimes I was like, "I don't need to know this," you know? And it's just-It's like, "Just FYI, they're posting pictures of you on 4chan."It's like, "Oh, cool, cool, cool." But yeah, I mean, it's tough, and it takes a toll on you that I don't... I don't know. And it's hard to just go, "Well, it's only a few people. It's only 10 people or 100 people out of millions out there," you know? Or something like that. But I mean, if 100 people are tweeting about you nonstop, or messaging you, or trying to start a harassment campaign, it feels like it's the whole world. It really does, and it eats away at... It was eating away at my ability to stay focused on work, and doing what I wanted to do, so I mean, that is personally why I was like...You know, it's like I had a lot of reservations when it came to making a jump to trying to do a newsletter, and especially with Substack, but ultimately, I was like, I think this is the better option for me personally, because it provided a certain level of stability, a certain level of just me being able to write a bunch of things in advance, and if for two days, I can't work or can't function, essentially, then I'm okay, you know? That's kind of one of the plus-sides there.Yeah, I mean, freelancing is super “publish or perish.” It's like, if I don't write, I don't get paid, and sometimes it's hard. I mean, yeah. I mean, that resonates so much, and I think like, I mean, people have asked me, or concerned family members have been like, "Why don't you write a cookbook? Like, why don't you do something different?" I'm like, "Yeah, no I will." Like, my third book is definitely going to be like a food-focused memoir. That's the plan. But I have... And when I'm talking about my current work, I'm...Oh. Oh, now I remember what I was going to say, about why it feels so powerful when even a relatively small number of people are coming after you. My therapist, not to be like, "My therapist," but my therapist, who I started seeing just before the whole ICE thing, and he's lovely, and we've been in this therapeutic relationship for years, he's like, "It's evolutionary." There's a reason why we selectively remember bad things, selectively prize, or sort of focus and obsess on bad voices about us. It's because there is an evolutionary mandate to be aware of criticism, so you don't get kicked out of the tribe and lose your security and your food. Like, there is an evolutionary mandate to keep an eye on criticism, and it's a self-preservation mechanic in its way.It only becomes maladaptive in this completely unprecedented context, of like within a minute, a million people can see your stupid thing. Like, Twitter I think in particular, is very the sort of, "I'm talking to my sphere, and then suddenly it gets catapulted into a much larger one." Like, that's a unique feature of the platform. It's part of what makes it fun, is being able to see voices that you never would have heard, and people from all over the world, and all that stuff, but it can entail this relatively traumatic leap from like, "I'm just talking to my buddies," to like, "Now everyone's criticizing me for something," and sometimes, it's from people who are leftier than me, and sometimes that can be more painful, because I'm like, "I probably agree with you. I just wish you weren't being such a dick about it."Yeah.Or, "Am I wrong? Should I retire and become a Benedictine monk?" And then it's from the right, and to be honest, that's less painful for me most of the time, because I'm just like, "Ah, I'm used to genocidal f*****s being horrible, because I'm anti-genocide."Whoa, bold position, anti-genocide.I mean, like I don't... Yeah, and like, I... Ugh, whatever. So, context collapse is a major thing, but also, there is an evolutionary... Not that I'm so into evolutionary biology, because I think it's a lot of b******t sometimes, but there is a survival value in looking at critique. It's just the level, and ubiquity, and immediacy of that critique. Like, these are not your tribe. They're not going to imperil your food, but you're still wired to be like... You know?Yeah.To keep it in mind, because they also might kill you, or whatever.Yeah. I mean, it is good to... There is that line, of is it good to be aware of criticism or not? There are obviously things, you know, threats to your life, and those are important to know, and to be aware of, because you don't want to be harmed by someone, you know?Or your family.Yeah, or that is another one. I mean, I've had situations where it's been... I've gotten messages from people who were talking about my family, and where they live, and stuff like that. It's like, "What is wrong with you? Why would you do this? Because you disagree with something I wrote online? Because you disagree with me?" Those sorts of things, it's... A lot of it's-It's very... Yeah.Yeah, it's a product of this time of hyper-connectedness that we live in, you know? And the way we communicate, which is kind of... I mean, that's kind of the angle that I'm trying to think about a lot of things. I mean, that's kind of the premise of my newsletter, is just-The present age.Yeah, it's like here we are, and everything is insane, and I don't know what to do, you know? But we're trying to get through it. I mean, with the pandemic especially, so much of our communication has shifted to the internet, that might not have been before, but I mean, in my case, and maybe yours, it's like, yeah, it was already on the internet, but you know? It's like, I was already spending way too much time on social media before the pandemic, before it was cool.It's like, I'm a weird recluse.Yeah, exactly.Like, half my friends are online. Like, yeah.Yeah.I mean, I think it just helps me to reframe. I think a lot of people who are in this experience, especially in the first time or first several times, are like, you know, "Am I weak for feeling bad?" I'm like, "No." It's human nature, you know? You're not weak. Like, please don't beat yourself up about having feelings about people saying terrible things about you. Like, you know? That's part of my like Talia's pep talk for traumatized victims of the right-wing hate complex thing. You know, and there's also the like, "Am I wrong for seeking it out?" I'm like, you know, it can be a discipline thing, to try to not seek it out all the time. Well, yeah, it's also human nature. Forgive yourself for that, for wanting to know. That is also a very natural impulse.In my case, I mean, stuff does happen that I need to be aware of. You know, when literally the organizer of Unite the Right, Jason Kessler, posted my mom's office address on a Nazi blog. S**t like that, like I need to know. I need to warn, and I feel so f*****g guilty that my family has to suffer for my choice to traumatize myself every day. I mean, it is interesting. I do feel like the evangelical series that I'm working on now is like... is interconnected with a lot of this stuff, in ways that are maybe less explicit, maybe less overt, but I think it is interconnected. I also think these are just stories of pain that deserve honor and telling, and careful telling.But I do think it's interconnected. I also think like, you know? In my experience, if you deep dive and learn a lot about one thing, you see the way it shows up in lots of other places. I've rarely regretted learning a lot about a subject in my time. Like, could I be focusing on the Charlottesville trial? Could I be focusing on militias? Could I be focusing on what are the Oath Keepers up to lately? Like, could I be focusing on the antivax white nationalist nexus? Of course. There's so many topics. There's like-Yeah, there's no shortage.Yeah, I had to explain to someone, when I'm talking about like I study the far right, there's a massive range of topics, covering tens of millions of people. It's not like, "How could you have such a narrow beat?" It's not narrow.No.And it almost mirrors in that sense, like my experience of academics. I was very serious as a student, and I didn't do a PhD. I thought about it, but it was like I was studying one poet, and all their works, and how they came to translate things the way they did, and the deeper you dive into one topic, the more of a world it encompasses. Like, you learn one thing, and you learn the history of it, and something else, and something else, and something else, so I rarely regret my sort of history-based and deep dive model of things.It's sometimes very intensive. It requires a lot. I think I've bought, for this project, I have bought eight or nine books already, including some that are only available on paperback, so I'm going to get a copy of God, The Rod, and Your Child's Bod in the mail, which I then... Once I read it and use it, I plan to publicly burn it.Yeah. I mean, that's going to... I feel like buying that is something that ends up getting you on a watchlist or something.You'd think, but you know what? Like, corporal punishment is legal in public schools in 19 states.Yeah. I mean-It's legal in private schools in 48 states. My home state of New Jersey is one of the two that's banned it in private schools.There you go. See? “New Jersey. We've banned something.”Jersey pride.Yeah.Jersey pride. And I feel conflict when I'm talking about should it be... Like, many countries have outright banned corporal punishment, of any kind, even by parents. You know, even by parents, whatever, including by parents. Sweden was the first, in 1979, and like, is that what I'm advocating for in the US? If we had a less s**t justice system, and a less racist justice system, and whatever, it's such a punitive and carceral society, maybe. That's not what I'm advocating for when I'm just saying like, "Don't hit your kids" on social media a lot lately. I do think it's a very reasonable demand to say like, ban it in schools. Like, because people get paddled in schools every day, and it's disproportionately black students that get paddled.And that's-By paddled, I mean struck with a board to cause pain.Oh yeah. Yeah. Well, and I mean, that's another issue in itself, is that you know, with any policy, with any sort of action, it's the enforcement of said action or policy tends to affect marginalized groups more than everyone else basically, but I really appreciate you taking the time to talk to me. You are one of the smartest people I know, one of the best writers I know, and I cannot recommend enough that people subscribe to The Sword and the Sandwich for both sword and sandwich posts, because-Yeah.... you will learn something in both.Yeah, I'm like looking at all this stuff about the history of the bagel right now. Dr. Huong Le Thu and Dr. Robert Glasser discuss the initial results of the congress, and what the future of politics looks like in Vietnam. The President-elect last night previewed his first major policy package, targeting the pandemic and the economic crisis that has come with it. Meanwhile, dozens of white supremacist on a federal terrorism watch list were present for the storming of the Capitol last week. Investigators are looking into possible foreign financing behind the insurrection. And lastly, Donald Trump is having a hard time finding lawyers to defend him in his second impeachment trial. I guess Rudy can fail, after all. THESE ARE THE STORIES YOU NEED TO KNOW: They’re calling it the American Rescue Plan. President-elect Joe Biden, who will take over the pandemic response in five days, gave a speech last night on his plans to combat the coronavirus and address its economic consequences, the Washington Post reports. His remarks came as more than four thousand Covid-19 deaths were reported in the United States for the second day in a row. The plan is divided into three major areas, according to the Post: $400 billion for provisions to fight the coronavirus, while reopening schools; more than $1 trillion in direct relief to families, including through stimulus payments and increased unemployment benefits; and $440 billion for aid to communities and businesses. The legislation includes a number of priorities sought by top congressional Democrats, from increasing the federal minimum wage to $15 an hour to adding billions in funding for childcare. Biden said QUOTE We need more action, more bipartisanship, and we need to move fast ENDQUOTE. The measures are narrowly tailored in an effort to garner GOP support, Biden’s team told the Post. The overall price tag is below $2 trillion. It will be followed by a broader recovery plan with more expansive Democratic priorities. But after campaigning as a bipartisan dealmaker, Biden wants to give Republicans the opportunity to get behind his first legislative effort as president. You might say he’s offering them an off-ramp from the road to insurrection. That part sounds like a longshot, frankly, but this is Joe Biden we’re talking about. Foreign Insurrection Financing Investigated Don’t call them patriots. The Washington Post reports that dozens of people on a terrorist watch list were in Washington for pro-Trump events on January 6th, when a violent mob stormed the US Capitol. The majority of the watchlisted individuals in Washington that day are suspected white supremacists. Their past conduct so alarmed investigators that their names had been previously entered into the national Terrorist Screening Database, a massive set of names flagged as potential security risks, the Post’s sources said. The watch list is larger and separate from the no-fly list the government maintains, and those listed are not automatically barred from any public or commercial spaces. While the FBI is hunting hundreds of rioting suspects who have dispersed back to their hometowns, the Post reports, federal agents are increasingly focused on the Proud Boys. Privately, some federal law enforcement officials have described the group as roughly equivalent to a nascent street gang. But other officials have expressed concern that the group may be growing rapidly into something more dangerous and directed. Separately, Yahoo News reports that law enforcement is investigating whether a series of large Bitcoin donations were linked to the assault on the Capitol. On December 8th, someone made a simultaneous transfer of Bitcoins worth more than $500,000 to twenty-two different virtual wallets, most of them belonging to prominent right-wing organizations and personalities. Right-wing figures and websites, including VDARE, the Daily Stormer and Nick Fuentes, received generous donations from a bitcoin account linked to a French cryptocurrency exchange. The suspicious December transaction, along with other intelligence, has prompted law enforcement and intelligence agencies to investigate the sources of funding for individuals who participated in the Capitol insurrection. The government is hoping to prevent future attacks but also to uncover potential foreign involvement in or support of right-wing activities, Yahoo’s source said. The plot thickens! Trump Lacks Impeachment Defense Donald Trump, on the eve of facing a second impeachment trial, is having trouble finding a legal team to defend him, Bloomberg News reports. Allies of the outgoing president have been looking for representation but so far are coming up short. Lawyers who defended him in the previous impeachment trial, including Jay Sekulow, have said no this time. Other lawyers who have defended Trump, including Pam Bondi, aren’t interested. Some of the lawyers have privately said what Trump did was indefensible. Alan Dershowitz also defended Trump the first time around. He isn’t planning to represent the president now, Bloomberg reports. Rudy Giuliani is also unlikely to be on the president’s defense team, an administration official said. His conduct at the rally preceding the Capitol raid could be examined during an impeachment trial. Separately, ABC News reports that the Trump family is pulling up stakes. Donald and Melania Trump have made no secret of their impending move to Florida after January 20, but they won't be alone. The president's eldest son, Donald Trump Junior, and his girlfriend Kimberly Guilfoyle have been house-hunting in the Palm Beach area. Ivanka Trump and her husband, Jared Kushner, also plan to relocate to the Sunshine State in the coming weeks, having recently purchased a plot of land in the Miami area. In related real estate news, the Washington Post reports that the Secret Service detail assigned to Jared and Ivanka spent months searching for a restroom to use on the job. After resorting to a porta-potty, the agents finally found a toilet to call their own. But it came at a cost to US taxpayers. Since September 2017, the federal government has been spending $3,000 a month – more than $100,000 to date – to rent a basement studio, with a bathroom, from a neighbor of the Kushners. All this because agents were banned from using any the six point five bathrooms in Javanka’s mansion. Charming. AND NOW FOR SOME QUICKER QUICKIES: The New York State attorney general sued the New York City Police Department yesterday over widespread abuses in how officers handled Black Lives Matter protests last summer, the New York Times reports. The AG, Letitia James, wants a federal monitor to oversee the department’s policing tactics at future protests. She also wants a court to declare that the practices the department used during the protests were unlawful. Get ’em Letitia! Rick Snyder, the former governor of Michigan, was arraigned on misdemeanor charges yesterday in connection with his role in the Flint water crisis. The Times reports thatnhe was charged with two counts of willful neglect of duty. If he is convicted, he faces imprisonment of up to one year or a maximum fine of $1,000. It ain’t much but it’s something. Joe Biden plans to name Jaime Harrison as his pick to lead the Democratic National Committee, the Washington Post reports. A former chairman of the South Carolina Democratic Party, Harrison last year raised $130 million in his losing race against Senator Lindsey Graham. Harrison is not expected to face a challenger, and his candidacy was promoted by Congressman James Clyburn, a close Biden ally. Puerto Rican police are investigating the death of a transgender man found with multiple gunshot wounds, NBC News reports. Samuel Edmund Damián Valentín, shot January 9, is the seventh known transgender person to die by violence in Puerto Rico since last February. Advocates say the police aren’t doing enough. Hopefully more awareness on the case will cause them to pick up the pace. This week on Lawfare's Arbiters of Truth series on disinformation, Evelyn Douek and Quinta Jurecic spoke with Alissa Starzak, the head of public policy at Cloudflare—a company that provides key components of the infrastructure that helps websites stay online. They talked about two high-profile incidents in which Cloudflare decided to pull its services from websites publishing or hosting extremist, violent content. In August 2017, after the white nationalist rally in Charlottesville, Cloudflare’s CEO Matthew Prince announced that he would no longer be providing service to the Neo-Nazi website the Daily Stormer. Two years later, Cloudflare also pulled service from the forum 8chan after the forum was linked to a string of violent attacks. They talked about what Cloudflare actually does and why blocking a website from using its services has such a big effect. They also discussed how Cloudflare—which isn’t a social media platform like Facebook or Twitter—thinks about its role in deciding what content should and shouldn’t stay up.

Our guest for this episode, Attorney Heidi Burich, a lawyer for The Southern Poverty Law Center (SPLC), is an expert on White Supremacy. Founded in 1971 by Civil Rights lawyers Morris Dees and Joseph Levin Jr., the SPLC, a nonprofit organization, has been fighting White Supremacy since 1971 and has successfully challenged and defeated White Supremacist in many infamous cases. Dr.’s Marvin and Raymond Dunn take advantage of the opportunity to address specific questions with Attorney Burich that listeners want answered. How can the law be used to hold perpetrators of racial violence and hate crimes accountable?   Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast, Good Law | Bad Law, is joined by Kristen Clarke, President and Executive Director of the Lawyers’ Committee for Civil Rights Under Law, to address the recent rise in hate crimes, discrimination and the intensifying activities of white-supremacist and other hate groups responsible. In today’s episode, Aaron and Kristen also talk about the ground-breaking case Kristen won recently in which she took on a neo-Nazi group for violently targeting a college student in Washington, D.C.   After being elected American University’s first African American female student body president, Taylor Dumpson was met with extreme racism, specifically from a neo-Nazi group and its website, the Daily Stormer.  Students were encouraged and incited to target and harass Taylor. She was sent threatening and racist messages online and she was harassed on campus.  For example, led on by the neo-Nazi group, students hung bananas with racist messages from nooses around the campus.   Taylor suffered PTSD (post-traumatic stress disorder) but persevered, graduated and now attends law school.  She also fought back, bringing in Kristen and the Lawyers’ Committee to file suit in D.C. against the neo-Nazi group and two students who were found to have committed hate crimes.  The Lawyers’ Committee and Kristen recently won a precedent-setting victory in court, along with an award of $725,000.  Kristen explains the novel way in which she used the law to argue on Taylor’s behalf and the impact that Taylor’s win has had and likely will continue to have as other, similar cases are brought in other jurisdictions.   A nonpartisan, nonprofit national civil rights organization, the Lawyers’ Committee for Civil Rights Under Law pursues equal justice for all through the rule of law, targeting in particular the inequities confronting African Americans and other racial and ethnic minorities. Formed at the request of President John F. Kennedy in 1963, the Committee seeks to promote fair housing and community development, economic justice, voting rights, equal educational opportunity, criminal justice, judicial diversity and more. Dabei handelt es sich um einen Vertrag in Höhe von über 400.000 Euro für fünf Jahre. Darauf angesprochen, beförderte Voxility nicht nur 8chan wieder aus dem Netz, sondern auch „The Daily Stormer“.   5G Broadband Beyond Faster Speeds with Lauren McCarty (Ep. 194) Nokia's Lauren McCarty joined Joe Miller to discuss the potential for 5G beyond faster speeds on Ep. 194 of the WashingTECH Tech Policy Podcast.   News Roundup    FaceApp Terms of Service Prompt Angst Among Lawmakers   FaceApp, a viral app created by Russian firm Wireless Lab sparked privacy concerns and angst among law makers last week. Faceapp allows users to upload selfies and lets users see what they’d look like if they swapped genders or what they’re likely to look like 50 years from now.   The app’s terms of service, though, which few of us actually reads, leaves it within Faceapp’s sole discretion to terminate your access to its services, even if losing access causes you loss or harm. The terms also reserve FaceApp’s right to store your pictures, even after you remove them, to “including and without limitation” comply with certain U.S. and foreign regulations, which could be those of any government in the world, including the Russian government.  The terms acknowledge that Faceapp uses an artificial intelligence algorithm that enables its ability to alter your photos.   Senator Chuck Schumer called for the FBI and FTC to investigate, saying in a letter to the agencies that the app could pose “national security and privacy risks for millions of U.S. citizens”.   Senate passes bill to criminalize voting systems hacking   Partially in response to the domestic hacking of election systems, and partially in response to Russia’s hacking of the 2016 presidential election that was alleged in the Mueller report, the Senate has passed a bill which would criminalize the hacking of voter machines to gain access to voter data. The Defending the Integrity of Voting Systems Act passed by unanimous consent on Wednesday night. Senators Whitehouse,  Blumenthal, and Graham introduced the legislation earlier this year.       President’s plea to Trump supporters on the fence: download the app   The Washington Post reported last week that Trump’s re-election campaign is trying to shore up support via a new app that campaign officials say will be released in the coming weeks. The mobile will allow Trump supports to organize in their local communities and register to vote.   Feinstein targets social media bots spreading misinformation Social media bots are widely seen to have played a decisive role in spreading misinformation in advance of the 2016 U.S. presidential election. In fact Symantec released a report in June showing that Russia’s propaganda program in that election cycle was even more extensive than was originally thought. So Senator Dianne Feinstein has introduced legislation to prohibit campaigns from using these spam bots to “subvert future elections”.  It’s called the Bot Disclosure and Accountability Act.   Maxine Waters, Senate Banking Committee, Trump, Mnuchin all highly skeptical of Facebook’s Libra Powerful lawmakers including Maxine Waters and most of the Senate Banking Committee, as well as administration officials including the president and Treasury Secretary Steven Mnuchin, are all highly skeptical of Facebook’s new cryptocurrency, Libra. Senator Sherrod Brown on the Senate Banking Committee was especially vocal in his opposition to the currency during a hearing in which Facebook’s lead for the project, David Marcus, testified. Brown was incredulous that after Facebook which “moved fast and broke our political discourse … broke journalism,  helped incite a genocide and … undermin[ed] our democracy” now wants to have a global cryptocurrency available to its 2 billion+ users that would be a global, commercial version of the Federal Reserve. Republicans on the panel also expressed opposition including Banking Commission Chairman Mike Crapo, who suggested the creation of a separate regulatory agency to deal with cryptocurrency.   In the House, Maxine Waters announced that she will be calling Facebook CEO Mark Zuckerberg in to testify.   Amazon hires Trump ally to bolster lobbying on Pentagon contract Amazon has hired Trump ally Jeff Miller to lobby on behalf of the company to win approval to work on a $10 billion “war cloud” contract for the Pentagon. Earlier in the week, Trump had expressed opposition to the contract. Republicans are also urging the president not to thwart the contract.   Sanders, Omar urge investigation into working conditions at Amazon warehouse   Vermont Senator Bernie Sanders and Minnesota Representative Ilhan Omar were joined by 10 other members of Congress in a letter to the Department of Labor asking the agency to investigate working conditions at an Amazon warehouse in Minnesota where workers protested about working conditions.   Real Estate Agent Tanya Gersh scores $14m victory against Daily Stormer Founder Andrew Anglin A magistrate judge in the Federal District of Montana, Missoula Division recommended that Chief Judge Dana Christensen enter a default judgement of $14 million in damages against the founder of a neo-Nazi website. Daily Stormer founder Andrew Anglin had twice failed to appear for his deposition in the case brought by the Southern Poverty Law Center on behalf of Ms. Gersh back in 2017. The suit contends that Anglin initiated a “troll storm” against real estate agent Tanya Gersh after Gersh advised the mother of alt-right figure Richard Spencer to denounce her sons views in order to sell her property. The threat was mentioned during a telephonic hearing Tuesday in federal court in Charlottesville, where lawyers discussed the snail’s pace of the discovery process in the lawsuit that alleges organizers and key participants in the Aug. 12, 2017, white supremacist rally planned and promoted violence against protected groups. Cantwell has posted derogatory statements about Kaplan before, the plaintiffs’ lawyers wrote in a motion filed Tuesday, but his recent statement is a “thinly-veiled threat” that impairs the lawyers’ ability to carry out their work. The lawyers asked the court to enjoin Cantwell to refrain from any future threats. Cantwell already has been found guilty of assaulting and pepper-spraying activists on Aug. 11, 2017, and of violating conditions of his bond. He remains a defendant in another civil suit filed by people injured during the Unite the Right rally. Spencer, who fancies himself white nationalism’s leading intellectual, cloaks his racism in highbrow arguments. Anglin prefers the gutter, reveling in the vile language common on the worst internet message boards. But Spencer and Anglin had appeared together on a podcast the day before Sherry’s Medium post was published and expressed their mutual admiration. Anglin declared it a “historic” occasion, a step toward greater unity on the extreme right. It was in this spirit that Anglin “doxed” Gersh and her husband, Judah, as well as other Jews in Whitefish, by publishing their contact information and other personal details on his website. He plastered their photographs with yellow stars emblazoned with jude and posted a picture of the Gershes’ 12-year-old son superimposed on the gates at Auschwitz. He claimed that his violent rhetoric was never sincere but simply a way to mock those who slap a Nazi label on anyone who “stands up for white people’s rights” or “refuses to believe the stupid lies about Hitler” or rejects the “alleged Holocaust” narrative. Anglin now shared what he said had been his true editorial approach all along: “Ironic Nazism disguised as real Nazism disguised as ironic Nazism.” Five days later, he posted about “the world being ruled either by reptiles from another dimension or some other type of reptilian or insectoid race of aliens.” Where the irony started and stopped was hard to know. I emailed Anglin one more time asking for an interview. He didn’t answer. The next day, he wrote a post calling for the mass execution of journalists. “I want to see pieces of journalist brains splattered across walls,” he wrote."

Faith Goldy has endorsed by the alt-right neo-Nazis, many are volunteering for her, and she's trying to drag hate into the mainstream. Goldy has said the infamous Fourteen Words on air, a neo-Nazi slogan coined by the neo-Nazi group The Order, which murdered a Jewish radio host. She appeared on a neo-Nazi podcast associated with the Daily Stormer after Charlottesville. She said that the alt-right Charlottesville manifesto, including its position on the JQ (Jewish Question; that Jews don’t count as white people to the alt-right neo-Nazi movement), was well thought out. She's called for Canada to return to being a "96% white, European country". She's already been banned from the fundraising site Patreon and a number of other platforms for spreading hate. This is not someone that I think Bell Media should be endorsing through allowing her to run advertising. I appreciate your consideration.

Let's get to the show. Mighty Mike: What's up, Server Nation? You are listening to Process Server Daily, and I am your host, Mighty Mike the Podcast Server. Our guest today has recently appeared on Vice TV where he has been on the hunt for the most notorious Neo-Nazi of our time. He has been in business for 25 years and he owns and operates Encore Delivery Systems located in Columbus, Ohio. Mighty Mike: Jeff Cremeans, welcome to the show. Jeff C.: Pleasure to be here, Mike. Mighty Mike: Awesome, Jeff. I want to hear from you, Jeff! Tell us a little bit about yourself that wasn't in the intro. Take it away. Jeff C.: Sure. My name is Jeff Cremeans. I've been a process server for about 25 years. I started off, giving my age here, back in 1989 working for a law firm in Columbus, Ohio. Started off as a messenger working in the mail room. Did filings at the court house. Started to do the subpoenas, that type of thing. I'll make a long story short. I had an attorney, of the many duties I did in the mail room, wanted me to go get him a hotdog. So I went and got him a hotdog, I brought it back and he yelled at me, he said, "Why wasn't there mustard on it?" I thought, "You know, I'm gonna start my own business and I'm gonna charge this guy 25 bucks to go get his hotdog." Jeff C.: So I started a company out of law firm called City Wide Legal Messenger Service. Took off really well in Columbus, Ohio. There's a need for that type of thing here. I owned that for a few years. I sold that company to another company. I worked there for 11 years and then I've owned Encore since then. So I've had Encore for about 14 years. So ... Mighty Mike: That's awesome. Yeah, when I was watching the show, it's really cool, your office looks really cool. It looks like you got a pretty good size operation going on there. Jeff C.: Yeah, doing good. In any given time, we'll have eight or nine servers out, serving anything from child support papers to foreclosures. I don't get out as much and serve, certainly on this big case I'm helping out on, the Andrew Anglin case. But, yeah, I have a great group of servers. Very hard workers and do a great job. So ... Mighty Mike: Jeff, one of the most important things as process servers, for anybody, actually, is family. You got a family? Jeff C.: Sure do. I have a daughter at Ken State. Freshman at Ken State University. I've a son that's a sophomore. Yeah, they're pretty much my world, so ... Yeah. Mighty Mike: That's awesome. Jeff, there's a reason why you're on my show. You have a lot going on right now. Full of great experiences. But first, tell me about your worst experience working in the field. Jeff C.: You know, I think a lot of the process servers cross and that start talking about bad stories. Everybody's got a lot of bad stories. I think the one that really stood out to me was one, believe it or not, where I wasn't out in the field. Long story short, I'm sitting in my office, I had let everybody go early. I'm in the office by myself, just doing paperwork and in walks four people. I won't put their description out, but they were not very nice-looking people. I said, "Can I help you?" They said, "Yeah. One of your servers have been pounding on the door at my grandmother's house. We're here to see what's going on." Course, they were not so nice about it. I thought, "Well," I looked up and I saw these four guys. They meant business and they were there to do some damage or something. I thought, "Well, gosh, here we go." I can hold my own, but not with four guys. They were really upset that the server ... Now, how they go to where we were, they did some diligence on finding who we were and our address and everything. I got to give 'em that. Jeff C.: Anyway, I'll be honest with you, I was scared for my life. I thought if these guys want to start one me, there's not a whole lot I can do, but I explained to them. I calmed 'em down, I said, "Look, I'm sorry. This is not the way we do business and I apologize that your grandmother was scared," and all this stuff. Turns out that the server that went out, he was a newbie. He was trained and everything, but he had it to where he thought he could pound on doors and maybe even intimidate people, scare people to come to the door. Boy, did I have a long talk with after him that. I told him, "Hey, look, you're gonna go out, you're gonna go looking for trouble. You're gonna get it." Jeff C.: Fortunately, the trouble came to the office and it affected me. Nothing ended up happening. I talked to these guys and they end up not hurting me, which is a good thing. So the moral of the story, and for everybody out there, whether you're training a server or you're serving yourself, you don't have to ... there's times you have to get creative and aggressive. We can talk about that later in the podcast, but the big thing is, I explained to the server, "There was an old lady in there. You were scaring her to death. She had her grandkids come here and threaten me and want to know what's going on. Take it easy, man. You don't have to do that. If they don't answer the door, you don't have to pound on it." The lady wasn't even avoiding servers, so he learned a big lesson. He learned from that and turned out to be a great server. Not so aggressive anymore after that. Mighty Mike: I've recounted an experience that I've had too in a previous podcast about knocking on a door and being really gung-ho, and then realizing it was a 14 year old girl in there, terrified! She's told not to answer the door and it really helped correct my perspective that you never know ... I just had one yesterday. They told me she's an elderly lady and I've been there at all different times during the day. So I decided to come at night. Sure enough, her car was there, but she wasn't answering the door. The neighbors said, "Oh, she's in there." But I thought, "Man, I'm just gonna come back again at night and maybe she won't be in the shower or in the back room or wherever. Whatever she's doing to keep her from answering the door, giving her the benefit of the doubt- Jeff C.: Right. Mighty Mike: That she might actually answer the door if I come in a different time. Jeff C.: Yeah. Mighty Mike: Yeah, what I take from your story is prudence. Have a little bit of prudence when you come to the door. It's one of the most valuable asset in any industry. Mighty Mike: Jeff, tell us about your greatest experience working in the field. Jeff C.: Well, as many as there are bad, there are some good experiences out there. I think one that stands out to me is, and this is back in my City Wide Legal Messenger Service days, I was young and I was just new to the industry and learning, and doing stuff. I got a job to serve a wealthy person in a domestic case. Long story short, I had attempted many times. Pulled out all the tricks. I dressed up for Halloween, did the whole pizza delivery thing. Nothing worked. This guy, he was a dodger and he knew the game. He had been served before. Jeff C.: I pulled up one day, I just happened to be around the neighborhood. I thought, "Let me go try this guy again." I got there and he was out back, washing one of his expensive cars with his brother. I pulled up and he looked at me and started to run. Then he stopped and he's like, "You got me." He put out his hand and he shook my hand. He's like, "Congratulations, man. You played a good game." He was serious, very nice. We ended up talking there for a minute, so it was kind of ... never had that happen before, but it was nice to know that old game of hide and seek, he was not a sore loser, you know? So, yeah, that's kind of a good story. Mighty Mike: That's cool when they're like that. Some people just have a habit of dodging and ducking and hiding under couches, and things like that. Every once in a while, you'll get that guy that's probably like you would be when you're retired or something like that, or if someone else was trying to serve you. Ultimately, you're gonna accept the responsibility for your own problems, but you don't mind giving 'em a little run for his money. Jeff C.: Sure. Mighty Mike: That's a great experience. Mighty Mike: Jeff, tell me what you're working on right now that you're most excited about. Jeff C.: Well, in the past few years, we've gotten accounts with the Children's Services and the child support. It's a lot of work. It's lucrative, but dodging has increased with the child support papers as everybody knows, especially at that end of the stuff that we serve. So I've been able to hire more servers, it's broadened our horizons as far as learning more about the industry and finding people, the skip tracing, that type of thing. Jeff C.: Then, of course, there's the case we're trying to serve, the famous neo-Nazi. That has been the most challenging serve in my career in 25 plus years. So the reason why this case is so challenging to serve, this guy, he's a national, if not worldly-known neo-Nazi. He's got his own website, the Daily Stormer, that's been very controversial, but he has so much help hiding out. I've never seen anybody have so much support in hiding out. Anything from his father with all his property he owns, and people putting him up in places, this type of thing. But, yeah, it's been a very challenging serve. Worked very hard and done all the skip tracing. Done everything we possibly can to this point. Right now, we're relying on tips from a lot of different people that have maybe spotted him or know where he's at. We had a pretty good tip, as you saw in the Vice show. That's probably our best tip and missed him there. But, so, yeah. Jeff C.: There's a lot of things going on, a lot of good things. Growing at a steady pace and, again, I think any processor out there will tell you each case is different, each server's different. You don't want to get too emotionally involved, especially when someone's dodging, but there comes a time where, "Ask us for help," you know. One person can't do everything. If you feel like you've exhausted all your efforts in getting the serve, get somebody else on it. Get a fresh face, that type of thing. So ... Mighty Mike: Yeah, that's good, Jeff. I'll tell you, when I was watching the video, and you were going over the footage in the store where you were watching him with his protein powder, I got this feeling, almost like that's happened to me before where I've seen someone I was hunting for three months. He was a pot farmer up in [inaudible 00:09:36] Creek. Anyone knows you go up there, you gotta go up there with the AKs and [inaudible 00:09:40] dogs, and ready to go. Mighty Mike: I saw him in a park. He was apparently getting visitation with his kids, and I didn't have the papers, so I ran back, I drove back to my house. By the time I got there, he wasn't there. I was so mad at myself. How did you feel when that- Jeff C.: First, it was just shock and awe seeing him there. My son and I were just walking through the store and it was one of those things, when I first saw him, I thought, "Oh, man. That guy looks familiar," and I got closer. As I got closer, I thought, "Oh my gosh, that's him." No doubt in my mind whatsoever. In fact, I submitted a declaration to the court for the attorney's request to explain that I saw him. I got up, I was watching him. I was standing there as you could see in the video, watching him. Very nervous. He was kind of looking behind his shoulders and just kind of looked really, really paranoid, that type of thing. I thought, "You know, I don't have the papers. They're not even in my car. They're at home. By the time I get it and do that, it's not gonna happen." Plus, I had my son with me. It was really not a whole lot I could have done, like I couldn't leave him there. Jeff C.: As he was checking out, I proceeded to go through the store, past self check out lines. I looked over and I just thought, "You know, I gotta say something to him. I gotta go talk to him. I just can't" ... So as he was walking out, I pulled up right in front of him with my car. My exact words to him was like, "You know, you look like somebody I know. Is your name Andrew?" "Nope." He was gone. He was not gonna hang around. It was him, it was definitely him. Now- Jeff: He was not going to hang around, and it was him. It was definitely him. Now, people, especially his attorney ... What are the odds? What are the odds of tracking somebody down for almost a year and you see them at a grocery store? I don't know, but it happened and it was ... Needless to say, I have the papers with me every time. I have them in my briefcase, I have them in my car, I have them at work. I have other people that have them. All my servers have a copy of this stuff [inaudible 00:11:24] just in case something like that were to happen again. Don't think I'll ever get that opportunity again, but you never know. Mighty Mike: Yeah, I actually keep a bucket now, because of that experience that I had. I'll tell you one fun experience. I was in the courthouse and I'd been hunting this ... trying to serve this professor of Chico State University. He was retired. And so, I had served him like three times before and then he moved. We go to court every day to file papers at the courthouse. And so, I was in line at the courthouse and I heard this voice, and I was like, "I know that voice." And I listened and I heard it. He's just shooting it with a couple guys, "Yeah, no, I'm a professor down over at Chico State." And I thought, "That's him." And I didn't have the documents, but I was at the courthouse. So I said ... I looked it up on my phone, and I bought a copy of the paperwork at the courthouse. I checked the box individual and said, "Here you go." Jeff: Oh, nice. Very nice. Mighty Mike: I felt like such a ninja when I did that. It was cool. Jeff: Yeah. Mighty Mike: So I mean, if I would have saw him at the store I would have been in trouble. What I wanted to know, and I'm sure other servers are the same, is what's the next step? You can only skip trace them so much, right? Jeff: Yeah. Mighty Mike: You can only- Jeff: Yeah, there's a lot of people looking for this guy for one reason or another. It's not just to serve him papers. As you can imagine, he's made a lot of people upset with his comments and his viewpoints. Hey, you know, I believe in the first amendment. I think everybody can believe in whatever they want to believe in. You believe clowns should make more money when they go to parties? Fine. Just the fact that threaten violence and harass people I don't think bodes well. Jeff: So anyway, with that being said, a lot of people look for him. We're all trying to put feelers out there and we're all going off tips, whether it be the media, reporters, and other process servers. And from here, where do we go? Waiting on a tip. There's been rumor that he claims he's in Cambodia, then he was in Nigeria, then he was in Russia. Personally, my opinion, I think he's right here, whether it be in town or the state of Ohio, at least in the United States. He's not overseas. So it's going to be off a tip. It's going to get lucky. Somebody's going to see him, he's going to show his self somewhere. That's pretty much all we can do right now, just sit back and wait. Mighty Mike: Yeah, you just have got to post somebody up over by the protein powder. That's what you have got to do. Jeff: Yeah. Yeah. Mighty Mike: Okay. Jeff: I think Road Warrior's a good app. I'm not a humongous app fan. I kind of do a lot of things old school. I think if you're diligent enough and you really want it bad, you can find the right app and it'll get you where you need to be. Mighty Mike: Very good. Road Warrior is ... I swear by the Road Warrior. Jeff: Yeah. Mighty Mike: I mean, if another one came out I would try it, but I haven't found any other app like that. Jeff: Yeah, it's a good app. Mighty Mike: And if you have it set to go straight into the Waze app, it works really good in the city. You can pick different navigators, but yeah, Road Warrior's a great one. What case tracking software would you recommend as the best? I would take you as a Process Server Toolbox guy. Jeff: Yeah, yeah, Process Server's Toolbox or like Serve Manager. Again, I don't even ... To be honest with you, I don't use them. Again, I'm- Mighty Mike: Really? Jeff: Yeah, I'm a firm believer in the old fashioned way of doing things, and my customers seem to like it. I've tried to offer them the different softwares and the Process Server's Tool and everything, and my customers like, you know, "Just use the court's return. We don't want this. We don't want that." And I've just kind of been doing that for years, and it works for me so far. Mighty Mike: No, I'm intrigued, Jeff, because, let me tell you something, there's a beauty in simplicity. So I'm just curious, we don't have to go too far into it, but you have like a service request form? Jeff: Yes. Mighty Mike: And they fill that out. And is your return or your field sheet, if you were, is that a part of the same form? Jeff: No, that's a different form in fact. And that's the thing, we kind of create our own affidavits and our own returns of service if they want. For anybody that has just your federal district return of service, we'll start off with that. If somebody wants something different, we've created so many different types of affidavits and non-serve affidavits and returns of service. We've had people say, "Yep, we don't want this notarized. You don't have to notarize it," so we'll just make it a simple proof of service. Mighty Mike: Yeah. Jeff: Of course, as you know, in California they have their own and New York wants certain things. A lot of the different states and people want different things. Mighty Mike: Definitely. Jeff: So we kind of have a variety of affidavits and stuff we use. Mighty Mike: That's cool. Yeah, that's cheaper. Jeff: Yeah, it is. It is. Mighty Mike: I tell you, there's beauty in simplicity. When I first started out, I had a form and I thought I was a genius because I had my service request area on top where I gave the customer's info and special instructions, and then at the bottom it had four spots for first attempt, second attempt, third attempt. And I only did four attempts because most of my customers were for unlawful detainers. In our local area, you had to get three attempts for diligence before you could post or subserve. So yeah, there's beauty in simplicity. I appreciate that. Mighty Mike: What is your favorite skip trace tactic? Jeff: I think what's worked for us over the years are the neighbors. Knocking on the doors next to it. I tell you, there's ... We have had more nosy neighbors help us get people served than anything. It's a simple skip tracing tool. There's a lot of ways of skip tracing, but, boy, just I don't know how many times ... And I'm sure a lot of servers have experienced this. The neighbor's out washing the car, you go over, "Hey, is so-and-so here?" "Oh, you know what? No, they're down the street at this park at the baseball game." "Oh, really? Which park is that?" "You know, blah, blah, blah park." You go down there. Now, if somebody's been dodging for a few weeks and you really want to get them served, I don't mind going to a park at a ballgame and getting them served. It may be the only opportunity to get them. So yeah, I think neighbors are very informative, and can be very helpful for getting somebody. Mighty Mike: Yeah, and actually, you can skip trace a specific address, not a person, and it'll give you the people that live in that general area. Or you can go on Google and find out what the nextdoor neighbor's address is and skip trace them and get the phone number. And then call them up, say, "Hi, is this ..." So if you're looking for Jill, you call up the neighbor and say, "Hi, is this Jill?" And then she's going to go, "Oh no, Jill lives nextdoor." "Okay. Oh, sorry about that." You know? Jeff: Right. Yeah, yeah, yeah, yeah, yeah. Mighty Mike: That's a good one that works a lot. Jeff: Yeah. Mighty Mike: Jeff, what is your favorite tool for defense? Jeff: I think there's weapons and there's this and there's that. I firmly believe in being human with people, talking to them. One thing that taught me about that bad experience, I think if you're there and you're calm and you hear them, and you're honest with them, say, "Hey, look, I got these papers," well I think that's worked more than anything. To be, for lack of a better word, aggressive or cocky or pushy and doing too much, I don't think that's going to help you out. I think really trying to talk to people. And there's a lot of different ways of doing that. Jeff: My biggest thing is somebody that's wanting to avoid service, I try to tell them, "Hey, look, I'm going to come back. I'm going to keep coming back. I'm not going to go away and this is not going to go away." I'm not a lawyer, I can't give them legal advice, but I try to tell them, "Hey, look, you're best off taking this now." So things like that and that nature, that to be me has been the best tool. Call it a tool. Call it whatever you want. I think it's a really good tool to use. Mighty Mike: Yeah, I did a poll on Facebook and, "What was the best tool for defense?" And people came back ... And actually, I gave some options and I gave like a gun, and a knife, and all these things. And then, I gave a few options. It was like common sense ... Jeff: Yes. Mighty Mike: Those things that are inside of you, like in your brain and in your habits, and the way that you treat people, the way that you talk to people, those are the things that had the most hits. I think one of them had like 64. Common sense had like 64, and the next one had 30. And the actual gun I think only had like 16. We all like to talk about the guns that we own, but the truth is, when you're out there serving, using your gift of gab or your ability to control a situation with your words is way more powerful than a gun. Jeff: Absolutely Mighty Mike: A gun is an immediate ... It's not an answer. It's not a resolution. It's a tragedy if you did have to pull it out. Now, don't get me wrong, I'm not anti-gun. I'm just saying I agree with you. That's absolutely correct. Jeff: And yeah, guns can be dangerous and they can promote ... get you into a situation where somebody could get hurt or killed. Again, I'm totally not anti-gun either. I totally believe in that, and a lot of people should have one for their protection. I've never been a really big badge guy. Again, I'm just kind of human, old fashioned way of doing things. Mighty Mike: Yeah, in California it's actually become quite a ... most of the server companies, it's quite anti-badge, because a lot of people are getting convicted and charged, and potentially convicted for impersonating an officer. Jeff: Yes. Mighty Mike: Throwing around words like, "Officer of the court," and things like that. Jeff: Mm-hmm Mighty Mike: You know, I used to do it when I first started because that's what they said in my training class, and really we're not. Joe down the street could serve papers, but he can't serve more than 10 in California. I know it's different in every state, but ... Jeff: Mm-hmm Mighty Mike: Jeff, what book would you recommend? Jeff: Anything John Grisham. I'm a huge John Grisham fan. In fact, the older I get, I'm doing a lot more reading. And I love to read, it's just like a lot of people, you just don't have the time. But John Grisham, really just the fact ... You know, he's mentioned process servers in his stories and subpoenas being served. I always kind of liked that part of it, but just his work is just I think is amazing. And the legal aspect of it, I'm really interested in that part of it. http://www.jgrisham.com/books/ Mighty Mike: That's really cool. I'm going to have to check it out, John Grisham. I'm actually writing a book. It's going to be done here in about 90 days is my goal. And it's going to be on process server safety and best business practices. It's going to be great! Jeff: I started off at a young age. I’m the second youngest of 10 children. Growing up, it was one of those things where, as you can imagine, you either go off to college or go get a job. You're not going to hang around the house, that type of thing. My mentor was no doubt about it my father. He was a hard-working man, raising 10 kids, him and my mother. To me, they’re the most awesome people in the planet, but nevertheless, he said, “Work hard and be nice and don’t ever give up.” He was always supportive of all my brothers and sisters, whatever road they took. He was so excited for me when I started City Wide Legal Messenger Service. He loaned me $1,000, which I had to pay him back by the way. He wasn’t that nice! Jeff: He was truly my mentor. Did he know anything about filing stuff at the courthouses, doing certain papers? Absolutely not. Just his life lessons taught me, even to this day, I still use them. It has really taught me a lot and just got me far. Mighty Mike: That’s great. You answered one of the questions. What’s the greatest advice you’ve ever received? Jeff: The greatest advice I’ve ever received is definitely from my father. Be humbler. Be nice. Work hard. I taught my own kids that. I’d tell you. If you're nice … Don’t be too nice. You're going to be taken advantage of. I’m not saying that, but I’d say being nice, being compassionate, being humble will get so you much further in life. I truly believe that, and that’s the way I try to live my life and do my work. Mighty Mike: To provide an abundance of value without expectation just as a business practice, but also just as a person. There are many examples of that, whether it’s in your love life or with your family. If you provide value without expectation, it will come back to you. Like you said, don’t be taken advantage of, but sometimes it might feel like it and then the next day, you're like, wow, I didn’t expect you to do all these nice things for me. Jeff: Right. Mighty Mike: That’s the idea. Jeff, what would you do if you woke up today, had all the same skills and knowledge, had no clients, a smartphone, a car and only $100? What would you do in the next week? Jeff: I would definitely do some work reaching out to other people, advertising to a certain extent. I’d tell you. The best thing that I would do is to get out there and do a good job for folks. I think word of mouth advertisement has been a key for me to my success. It’s one thing to go out and say you're a process server or say you're going to do this and do that, but if you do it, it takes that one paralegal that you do a great job for. You communicate the whole time. You're doing everything you need to be doing. That paralegal could be involved in a group that tells another paralegal and so on and so forth. Jeff: I think part of doing that good job is communicating. Somebody sends you a paper. Don’t take three days to get back to them if it’s a rush and what’s going on. Certainly don’t take another week to send them back to return a service, that type of thing because again, that word of mouth could also hurt you too. It could be a very valuable factor. It could also hurt your business. I would pound the pavement and get out there and try to talk to as many people as I could, talk to paralegal groups, bar association, that type of thing. Mighty Mike: That’s good. One of the things that I take from your story is that, from your methods, is that be diligent. Get out there. Sometimes it’s nice to have a little hand-up, not a hand-out, but the truth is in this example, you only have $100. You have a car. You have the knowledge that you already have, and you have a smartphone so you can give the internet … You can search things. Guys, anybody can do this. You get out there and go after it. I say anybody can do it, like anybody who wants to build a business. Some people, they’re not cut out for serving papers, and if that’s the case, build the business; have someone else serve the papers. There’s a lot of really good husband and wife teams out there. Jeff, what is a parting piece of guidance you want to give to the servers out there? Jeff: Again, what we’ve talked about previously. Stay humble. Treat people with kindness. You have a job to do and certainly do it. In doing so, just remember this thing is bigger than you. Don’t go out there thinking you're Captain Bob, the process server and think that you're better than everybody, that type of thing. Just go out and communicate with your customer. Take good care of your customer. Communication is key. Jeff: I touched base on it earlier. I don't know how times I’ve used servers across the nation where they do 75% of the job. What I mean by that is, hey man, I got this rush. I need to serve right away. This is a big customer, blah, blah, blah. By gosh. They went out and they got it served right away, did a great job. A week later, hey, where is my return of service? I got to get this filed. The attorney is screaming at me. They got to get this filed. Follow through on your job. Do what it all right, not just half of it. Definitely get in the network groups. Meeting new guys and get involved with this and NAPPS members and stuff, a great, great tool. It’s great to get advice to people. Jeff: Again, I’ve been doing this for a lot of years. I still seek advice. I’ll call a server that I’ve been dealing with for 20 years and say, “Hey, man. How would you do this? What’s your viewpoint on this?” Never stop learning because I’d tell you. There’s a lot to learn in this industry. Mighty Mike: You're right, Jeff. There is. A big part of the industry for process servers, what I find most often is that they find themselves in a chasm alone by themselves and the way that they think that every other processor is their competition. The truth is that many process servers out there have too much work and they would be more than glad to give you the work if you can give them a discount. Jeff: Absolutely. Mighty Mike: If that’s what you need to get off the ground and to get your business rolling so you can raise your prices and have some more customers, more attorney clients come in, then that’s what you got to do. Jeff: Absolutely. Mighty Mike: I started out making $20 a paper. How about you? Jeff: When I worked at the law firm, I think I made about $4 an hour. Whether that’d be filing at the courthouse or serve a paper even add to that, yeah, it’s … I think then after that, as time went on, I think I was getting $20 a paper at that point. It’s been a long road. I certainly charge more for that these days. Mighty Mike: Jeff, I appreciate your story. I want to personally thank you for being on the show. On Friday, a left-leaning Jewish magazine, the Forward, published an article by Ari Feldman titled “Is Jordan Peterson Enabling Jew Hatred?” accompanied by a picture of Adolf Hitler giving the Nazi salute next to Peterson. The Forward explains Vox-style: “Jordan Peterson is a public intellectual adored by neo-Nazis, white supremacists and conspiracy theorists. The neo-Nazi website the Daily Stormer called [him] ‘The Savior of Western Civilization.’” What did Peterson do to become, according to the Forward, comparable to Hitler? In a recent blog post addressing anti-Semitism in the alt-right, Peterson “attributed [Jewish] influence to Jewish intelligence—an old anti-Semitic dog whistle”– Lipstadt said that Peterson’s statements on Jewish intelligence reminded her of Kevin MacDonald, a professor of psychology who the Southern Poverty Law Center has described as “the neo-Nazi movement’s favorite academic.” MacDonald has written several books criticizing Jewish intellectual culture. (Peterson links to a critique of one of MacDonald’s books at the end of his blog post on Jewish intelligence.) The FCC is currently considering whether it will overturn the long-fought net neutrality rules enacted under the Wheeler FCC. The U.S. Court of Appeals for the District of Columbia subsequently upheld the rules. If the Ajit Pai FCC undoes the rules, as it is likely to do, there will be, as always, winners and losers. Who will they be? Further, ISPs are arguing that they too believe in net neutrality principles. But does their purported support of net neutrality principles align with the original definition of net neutrality that was first advanced by their opponents? Bio Christopher Lewis (@ChrisJ_Lewis) is Vice President at Public Knowledge. He leads the organization's advocacy on Capitol Hill and other government agencies. Prior to joining Public Knowledge in 2012, Chris served at the Federal Communications Commission as Deputy Director of the Office of Legislative Affairs. At the FCC, Chris advised the FCC Chairman on legislative and political strategy. He is a former U.S. Senate staffer for the late Sen. Edward M. Kennedy. Chris also has over 15 years' worth of advocacy experience. Previously, Chris worked as the North Carolina Field Director for Barack Obama's 2008 Presidential Campaign. Several CEOs had decided to resign from the council after Trump failed to denounce the KKK and White Nationalists, saying instead that there had been "hatred, bigotry and violence on many sides." He then backtracked reading a prepared statement, only to go back to saying all sides were at fault for the violence.  Intel CEO Brian Krzanich was among the CEOs to resign from the council.  Steven Musil reports in CNET.  But the American Tech Council remains intact, although the CEOS of Google, Apple and Microsoft wrote internal memos distancing themselves from the administration. That's in next.gov. Tech companies ban extremist websites and causes Both Google and GoDaddy last week announced that they would not host sites like Daily Stormer that espouse white supremacist ideology. First Amendment advocacy groups, however, like the Electronic Frontier Foundation, argue that the move could backfire and set a bad precedent for civil rights groups. Andrew Morse reports for CNET. Sites like GoFundMe and Paypal are also banning white supremacists from raising funds on their platforms. Abbey White reports in Vox. But the LA Times reports that these groups are forming their own corporate ecosystem in defiance of Silicon Valley. DOJ seeks user info from Anti-Trump website Dreamhost wrote a blog post last week disclosing that the Justice Department has been demanding, for months, site visitor information from the anti-Trump website distruptj20.org. The warrant seeks all files from the site. Colin Lecher reports in the Verge. Trump bolsters U.S. Cyber Command President Trump is bolstering the U.S. Cyber Command making it a full combatant command. Now, administration officials will need to decide whether to spin out Cyber Command from the NSA. Jordan Fabian reports in The Hill. The cozy relationship between Sinclair Broadcasting and FCC Chairman Ajit Pai The New York Times reported last week on Sinclair Broadcasting's enormous influence on current FCC Chairman Ajit Pai. Sinclair, known for its right-leaning content, currently owns or operates 175 television stations nationwide. But it has also proposed to merge with Tribune Media, which would bring that number up to 215 stations. The deal would also give Sinclair a much larger presence in cities, including New York City, where it would own WPIX Channel 11.  When he was an FCC Commissioner, Pai even ripped language, almost verbatim, from Sinclair's own filings. Pai used the language to bolster his official legal arguments in support of Sinclair's opposition to the Wheeler FCC's crackdown on joint sales agreements. Then, just 10 days after he became FCC Chairman, Pai relaxed those restrictions. Since becoming Chairman, Pai has also relaxed some TV ownership limits.  Cecilia Kang, Eric Lipton and and Sydney Ember report in The New York Times. Trump orders China IP practices investigation President Trump has ordered an investigation into China's alleged theft of U.S. intellectual property. The administration estimates the alleged theft may have cost U.S. businesses some $600 billion. You can find the story in Fortune. Federal Judge: LinkedIn must allow startup access to data--for now U.S. District Judge Edward M. Chen in San Francisco has ordered Microsoft's LinkedIn to open up its public data to a third-party startup. The startup, hiQ Labs, scrapes data LinkedIn users post publicly and uses it to predict which employees are likely to leave their jobs. Microsoft argues that hiQ's practices violate the 1986 Computer Fraud and Abuse Act. But Judge Chen isn't buying it. He says that law doesn't apply to publicly available data. Jacob Gershman reports for the Wall Street Journal. Ninth Circuit says Spokeo is liable for posting wrong info In a 3-0 decision, the Ninth Circuit U.S. Court of Appeals ruled in favor of a man who sued Spokeo for posting the wrong picture and saying he was a married father, affluent, employed, in his 50s and with a graduate degree. The central issue was whether publishing this wrong information carried some particular harm. The Court ruled that it did . The case had already been up to the Supreme Court, which sent it back down to determine the degree of harm caused by the wrong information. While the damages in this case are minor, only around $1,000, it is seen as having significant implications for large tech companies like Facebook and Google that publish a variety of different types of consumer information. Uber agrees to FTC privacy audits Finally, Uber will now be subject to FTC privacy audits for the next 20 years. The company settled with the FTC last week after failing, in 2014, to prevent the theft of over 100,000 names and drivers license numbers. Anita Balakrishnan reports for CNBC.

The white supremacist site The Daily Stormer has taken a nomadic journey around the web this week, searching for a permanent home after being booted by the hosting and domain registry company GoDaddy. Throughout its bizarre odyssey, though, the infrastructure and web services company Cloudflare has defended the site against cyber attacks, particularly DDoS attacks. Wednesday, Cloudflare finally pulled the plug. Without its protection, The Daily Stormer promptly crashed.

Hundreds of homes have been swept away by a mudslide on the outskirts of Sierra Leone's capital Freetown, killing at least 350 people, including 100 children. Many people were asleep when the disaster hit. Rescue work is ongoing and hundredds of people remain missing. North Korean leader Kim Jong Un has been briefed on a proposal to launch missiles near the U.S. territory of Guam in a show of force, according to state-run media. The leader stopped short of issuing an order to go ahead with the plan, saying instead that he would monitor U.S. actions a little longer. Protesters in Durham, North Carolina, have toppled a Confederate statue that stood outside the county's old courthouse for nearly 100 years. It comes just days after a white supremacist rally in Charlottesville, Virginia ended in violence. Internet hosting provider GoDaddy has banned The Daily Stormer after the prominent neo-Nazi website published an article that attacked a 32-year-old woman who was killed in Saturday's car-ramming attack at the Charlottesville protest. The site later tried to move to Google, but they too have decided to ban the website. And in France, a car has plowed into a pizza restaurant near the French capital of Paris, killing a 13-year-old girl and injuring a dozen others, local officials say. The suspect later told police that he was trying to commit suicide. Investigators say there is no link to terrorism. A jury in Denver has sided with Taylor Swift in her sexual assault case against radio DJ David Mueller, who was fired after he grabbed the singer's bottom during a photo shoot. At the singer's request, Mueller was ordered to pay a symbolic figure of $1 in damages. The number of cholera cases in war-torn Yemen has surpassed half a million. An update from the World Health Organization says at least 503,000 people have fallen ill, including nearly 2,000 people who have died of the disease. Following the election of Donald Trump, the alt-right has come to play a significant role in American political discourse. They are an upstart political movement that rejects traditional conservatism and championed Trump and his opposition to political correctness. But how did a movement rooted in online and video game culture come to be so influential? Angela Nagle (@angnagle) is an Irish writer and academic who has written extensively on the rise of anti-feminism and the revitalised culture wars. She’s recently written a new book called Kill All Normies, in it she documents how fringe online politics and discussion boards have become mainstream.   Alex Burd spoke to Angela to discuss the book. He started by asking when the alt-right became a mainstream force. Angela Nagle: It has to be the election of Donald Trump. I know that's very recent. Maybe you could say something like Gamergate brought a lot of different right leaning movements and forums and things that weren't very overtly political ended up much more closely mingling over Gamergate. Those are the younger ones. The more serious people like American Renaissance and Richard Spencer and people like that, they're a bit older and have been around for years. They've been taking things much more seriously and have been for a long time. But it's only when all these geeky online sub cultures started to come together that it started to be more legitimate to call them the Alt-Right rather than just the far right. Alex Burd You reference the Gamergate movement. How is that it went from something that was about 'ethics in games journalism' to a political ideology built around the twin pillars of misogyny and white supremacy? AN: Well essentially, depending on who you ask. Gamergate - the gamers say it's about 'ethics in games journalism', the people on the other side say they were merely pointing out sexism in gaming and ended up getting viciously attacked. The people involved in it love endlessly having these competing stories about the precise details of particular attacks which I don't find remotely interesting. Even if you take the most conservative estimate of the levels of attack that were going on they were really bad. Even the ones that are out there for the public to see. And you know a critic should be able to argue that gaming is dominated by sexist attitudes, but essentially it was viewed by gamers - where they got the 'ethics in games journalism' line from is a very long, boring story - essentially it was over political correctness. What they perceived to be feminists and anti-racists and liberals trying to change the culture and take away their fun hobby and destroy everything through liberal censorship. One of the reasons I'm not very sympathetic to that is I just think that, as in film, there's room for different viewpoints. These people were not saying games containing sexism should be banned. They were just saying that the kind of style that dominates has an attitude towards women that they had an issue with. It became basically, for whatever reason, it brought together all these different groups from the Daily Stormer, which is a Nazi website, through to apolitical vaguely sort of pro-free speech types. It brought together a whole range of people that saw themselves in different ways as opposing political correctness. AB: And they were politicised by the fact that a largely white male space was becoming invaded leftist politics and women in particular? AN: Yeah, definitely. Leftist cultural politics, yeah. AB: How did it go from a misogynist reaction to that to something that has become heavily based around white supremacy and racial politics? AN: Well when I started looking at reactionary forums of different types, I started my PHD about seven years ago, I finished about two years ago, I was looking at anti-feminist forums and at that time opposition to feminism was the main issue that really animated these kind of forums.
