Episode 12 - Doctor Makere Stewart Harawira speaks on Environmental Personhood What - The "environmental personhood", or legal personhood, movement is a result of successive governments around the world failing to adequately protect the environment, as well as to the growing recognition of Indigenous Peoples' rights and Indigenous legal concepts (Lowrie, 2021; Westerman, 2019). The movement acknowledges that environmental personhood exceeds the value to humanity. It is not that the people have a right to clean air, but that the air has a right to be clean (Parish, 2021). Rivers have become a central focus in the Rights of Nature movement. Who - In episode 12 we hear from Makere Stewart-Harawira, a Professor in Indigenous, Environmental, and Global Studies in the College of Social Sciences and Humanities, Faculty of Education, University of Alberta. In an interview with Newsroom, Jones claimed the aquaculture sector faced fewer barriers and offered more opportunities than other primary industries- including wool, dairy and meat. Mark Hopper from Federated Farmers says there's opportunity in aquaculture, but we shouldn't give up on the dairy sector. "We really want to get back into a position where we can see some positive growth happening across all the primary sub-sectors - they're critical for our economy." Plaintiff Dawn Kali was diagnosed with treatable Stage 1 breast cancer and rejected traditional treatment options in favor of the "Father of the Alkaline Diet" Robert O. Young's "pH Miracle" approach, which focused on making the body less acidic and more alkaline. This process involved costly extended stays at Young's Rancho del Sol in Valley Center, California and expensive intravenous treatments that consisted of little more than baking soda. Unable to pay, Dawn worked for Young in exchange for treatments that were ultimately ineffective. After much time had passed, Dawn went to an oncologist and was diagnosed with terminal Stage 4 cancer that had spread to her spine and femur. At trial, Bibi Fell demonstrated that Young's "pH Miracle" treatment was neither scientifically nor medically sound. In spite of the defense's claims that Dawn was aware that Young was not a licensed medical doctor and that she was not prevented from seeking conventional medical treatment, a San Diego jury found in favor of Dawn for her claims against Young of intentional misrepresentation, negligent misrepresentation, false promise and negligence. In October 2018, the jury awarded Dawn a $105,356,000 verdict, including $15 million in punitive damages. Federated Farmers are requesting a Government inquiry into the flooding and destroyed infrastructure left by Cyclone Hale. They claim that farmers located in the Gisbourne area are dealing with extra damage from slash and residual materials from forestry harvesting after Cyclone Hale hit earlier in the month. Federated Farmers national board member Toby Williams says the slash from harvesting is being washed onto farmland in heavy rain events, and they need Government action to prevent it from happening. Toby Williams suggests some policy changes need to be implemented into harvesting practices so the leftover branches and debris are chipped instead of being left to wash down into farmland. Plaintiff Dawn Kali was diagnosed with treatable Stage 1 breast cancer and rejected traditional treatment options in favor of the "Father of the Alkaline Diet" Robert O. Young's "pH Miracle" approach, which focused on making the body less acidic and more alkaline. This process involved costly extended stays at Young's Rancho del Sol in Valley Center, California and expensive intravenous treatments that consisted of little more than baking soda. Unable to pay, Dawn worked for Young in exchange for treatments that were ultimately ineffective. After much time had passed, Dawn went to an oncologist and was diagnosed with terminal Stage 4 cancer that had spread to her spine and femur. At trial, Bibi Fell demonstrated that Young's "pH Miracle" treatment was neither scientifically nor medically sound. In spite of the defense's claims that Dawn was aware that Young was not a licensed medical doctor and that she was not prevented from seeking conventional medical treatment, a San Diego jury found in favor of Dawn for her claims against Young of intentional misrepresentation, negligent misrepresentation, false promise and negligence. In October 2018, the jury awarded Dawn a $105,356,000 verdict, including $15 million in punitive damages. Donita is the Associate Executive Director at the Center for Constitutional Rights, where she has responsibility for the organization’s operational planning and provides leadership in the implementation of its strategic vision and goals. Prior to joining the Center for Constitutional Rights, she was co-director of Advancement Project Nationals’ Power and Democracy Program in Washington, D.C. and served in several management roles and strategic planning sessions focused on sharpening the organization’s program goals. She was co-counsel in multiple national voting rights cases, including the 2016 landmark North Carolina voter suppression case, NAACP v. McCrory. In 2008, she successfully challenged the lack of due process for 600,000 Ohio voters in advance of the 2008 general election and prevented their removal from the voter rolls. She has a law degree from Rutgers University Law School in Newark, NJ and is a Kinoy/Stavis Fellow. She graduated Phi Beta Kappa from Rutgers University in Newark.
