In einer Zeit, in der wir überall das Versagen etablierter Strukturen erleben, scheint es mir umso wichtiger zu sein, über neue Ideen nachzudenken und — im Rückgriff auf die letzte Episode mit Johan Norberg — viel offener und experimentierfreudiger zu sein. Mit »mehr vom selben« werden wir diese tiefe Krise, die Europa erfasst hat, nicht bewältigen können. Eine solche Idee, die international stetig an Zuspruch gewinnt, ist das Thema der heutigen Episode: Freie Privatstädte, Teil 2. Im Gespräch wieder Titus Gebel. Denn es gab vor über einem Jahr die erste Episode zu diesem Thema (Episode 77). Ich habe viel Feedback und Nachfragen zu der ersten Episode bekommen, daher freue ich mich darauf dieses spannende Thema nochmals aufgreifen zu können und neue Entwicklungen mit Dr. Gebel zu sprechen. Titus Gebel ist ein promovierter Völkerrechtler und Unternehmer mit einem weltweiten Netzwerk. Unter anderem war er Mitgründer und langjähriger CEO der an der Frankfurter Börse notierten Deutsche Rohstoff AG. Heute ist Titus Gebel der CEO von Tipolis, einem Singapurer Unternehmen, das neue Modelle des Zusammenlebens durch innovative Regierungskonzepte entwickelt. Er ist Autor des Buches "Freie Privatstädte – Mehr Wettbewerb im wichtigsten Markt der Welt", in dem er den Rahmen für die Gründung autonomer, privat verwalteter Rechtsräume darlegt. Dr. Gebel spielte eine wichtige Rolle bei der Gründung der bisher fortschrittlichsten Sonderzone, Próspera in Honduras. Er berät auch andere Länder bei der Innovation von Sonderwirtschaftszonen und ist Präsident der Free Cities Foundation, welche weltweit die Entwicklung von freien Städten fördert. Es hat noch einen weiteren Grund, warum diese Episode gerade jetzt aufgenommen wird. Einmal im Jahr findet die Liberty in our Lifetime Konferenz in Prag statt, dieses Jahr vom 1. - 3. Nov. Eine Konferenz, die sich mit dem Thema Freie Privatstädte beschäftigt und Interessenten aus der ganzen Welt anlockt. Ich werde an dieser Konferenz teilnehmen und auch versuchen, ein wenig von der Stimmung und von den Themen, die dort diskutiert werden, mitzunehmen und daraus eine Podcast-Episode zu machen. Daher können wir diese Episode auch als Einstimmung verstehen.  Wir beginnen mit einem »Elevator Pitch«, in der Dr. Gebel das Konzept der freien Privatstädte kurz vorstellt. Regierung als Dienstleistung — was sind diese Dienstleistungen, was sind die Kosten? Was sind wesentliche Probleme in der öffentlichen Verwaltung? Was ist das Principal Agent Problem? Was ist die Public Choice Problematik? Wie gehen wir mit Regeländerungen um?  Ist der Bürger zunehmend machtlos in den heutigen westlichen Nationen? Was ist die Idee des klassisch liberalen Minimalstaats, kann das funktionieren? Warum sollte das wünschenswert sein? Ist das vielleicht überhaupt eine unerhörte Idee? Es stellt sich die elementare Frage, worum sich der Staat kümmern soll, genauer gesagt, wozu er überhaupt die Kompetenz hat, sich zu kümmern. Wollen wir in Deutschland den »Übervater Staat«? Fallen wir gar in voraufklärerische Zeiten zurück? Mit welchen Makrotrends oder großen Fragen, die heute zum Glück langsam wieder thematisiert werden, überschneiden sich diese Konzepte? Konzepte von Freiheit, Verhältnis Bürger / Staat; wer muss sich vor wem rechtfertigen? Wie sind Unterschiede im Blickwinkel auf diese Fragen zwischen den USA und Europa?  Welche Probleme kann man zentralisieren und welche muss man dezentral lösen oder jedenfalls angehen? Kann Planwirtschaft, auch wenn sie in der Vergangenheit immer gescheitert ist, in der Zukunft dennoch erfolgreich sein, z. B. durch die Nutzung von »künstlicher Intelligenz«? Zieht jede Zentralisierung immer mehr Macht an sich? Aus Konzentration von Macht folgt keineswegs eine Konzentration von Wissen. Wie groß ist der Unterschied zwischen common law/case law gegenüber civil law in der »Philosophie« und in der Praxis? Sind die FPS nur eine »Meta-Idee«, die verschiedenste Ausprägungen erlauben? Sind in Wahrheit Experiment und Wettbewerb eines der führenden Prinzipien? Ist das aktuelle System reformierbar? »Der Staat soll nur Schiedsrichter sein und nicht mitspielen« Warum gibt es so viel Gegenwind gegen neue und unkonventionelle Ideen? »Wenn ich fremde Produkte verbieten muss, aus Angst, dass sie meine besten Leute abziehen, dann ist mit mir etwas nicht in Ordnung.« Wie ist der Umgang der früheren Leitmedien mit solchen neuen Vorschlägen? »Die Idee, dass die Menschen ihre Probleme selber lösen, ist nicht verbreitet.« Unter welchen Rahmenbedingungen funktioniert Demokratie überhaupt? Glauben die heutigen »Progressiven« überhaupt noch an die Demokratie, die sie angeblich ständig verteidigen müssen? Wird gerade die Majestätsbeleidigung wieder eingeführt?  Was sollten wir über Skalierung wissen? Ist die Stadt möglicherweise die beste politisch/organisatorische Größe? Wie unterscheiden sich die unterschiedlichen Konzepte, von der Sonderwirtschaftszone bis zur Freien Privatstadt? Was ist Seasteading — am Beispiel von Ocean Builders? Was macht Tipolis als Unternehmen, und wie geht es dem Vorzeigeprojekt Próspera? Sind diese Konzepte möglicherweise geeignet, um zu helfen, Afrika aus der Armut zu führen, nachdem die Ansätze der letzten Jahrzehnte keine wesentliche Verbesserung gebracht haben? In der heutigen Episode freue ich mich Dr. Titus Gebel begrüßen zu dürfen. Wir sprechen über sein Konzept der »Freien Privatstädte«. Titus Gebel ist Unternehmer und promovierter Jurist. Er war Mitgründer der Deutsche Rohstoff Gruppe  sowie des Startups Dual Fluid, deren CFO Björn Peters, in Episode 73 zu Gast war. Dr. Gebel spielt auch eine wesentliche Rolle in der Etablierung einer ambitionierten Sonderentwicklungszone mit dem Namen Prospera in Honduras und berät andere Sonderwirtschaftszonen weltweit. Aber das Thema des Gesprächs ist breiter: wir beginnen mit der Frage, was modernes Staatswesen ausmacht, was Freiheit bedeutet, was die Rolle von Bürger und Staat sind, wo die Ursprünge und philosophischen Ideen liegen und was bis zum heutigen Zeitpunkt in verschiedenen Nationen daraus geworden ist. Wir beginnen mit einem Blick in die Geschichte, was ist die Rolle des Staates nach Thomas Hobbes und John Stuart Mill? Was ist der Begriff der Freiheit?  »Struggle between Liberty and Authority« »By liberty, was meant protection against the tyranny of the political rulers.«, John Stuart Mill Wie hat sich die Rolle des Staates verändert?  »Der moderne Staat hat sich etabliert, um seinen Bürgern vor allem zwei Grundpfeiler des Lebens zu garantieren: Freiheit und Sicherheit.«, K. P. Liessmann Wie kommt es zu einem Mehr an Freiheit? Aus philosophischen Überlegungen und Ideen, oder aus pragmatischeren Aspekten? Führt der Weg von der göttlichen Bestimmung zur Freiheit? Wie wird der Wille des Volkes überhaupt bestimmt und was bedeutet dies für Minderheiten? Wir beide stimmen darin überein, dass wir eine beginnende, schwere Krise in den westlichen Demokratien, beziehungsweise Verwaltung erkennen. Die Frage ist: wie ist diese zu erklären und wie könnten Wege heraus aussehen?  »Heute haben wir es mit einer Überdehnung des modernen Staates zu tun, und zwar sowohl wohlfahrtsstaatlich wie ökologisch. Mit dem Wohlfahrtsstaat, der eigentlich schon in der traditionellen Gemeinwohlformel angelegt ist, kehrt das summum bonum zurück: das größte Glück der größten Zahl; der gehobene Lebensstandard wird als politisches Recht definiert.«, Norbert Bolz Bismarck gilt als Erfinder des Sozialstaats, was war die damalige Motivation? Wie hat sich der Sozialstaat seit damals entwickelt? Führen falsche Anreizsysteme für Politiker in die Krise, denn Gratisleistungen des Staates erscheinen nur gratis, sind es aber natürlich nicht? »Es gibt in westlichen Demokratien keine klassisch liberalen Parteien mehr, das sind alles Umverteilungsparteien geworden«  »Die Gruppe der Menschen, die tatsächlich produktiv und wertschöpfend tätig ist, wird immer kleiner.« Dazu passt auch der Gedanke des mittlerweile 93 jährigen Thomas Sowell: »You have people making [political] decisions, for which they pay no price when they are wrong. No matter how high a price other people pay.« Dr. Gebel hat ein Konzept entwickelt, das er Freie Privatstädte nennt und wir diskutieren über das Konzept, welche Rolle Verwaltung und Regierung einnehmen sollen, wie Anreizsysteme verbessert werden können und vergleichbare andere Ansätze, die in eine ähnliche Richtung gehen. Kann es so etwas wie Verwaltung als Dienstleistung geben? » Der Staat sollte aus meiner Sicht theoretisch kein Monopol auf das Staatsgebiet haben. In Liechtenstein haben wir das verwirklicht. So zwingt man den Staat, ein guter Dienstleister zu sein.«, Hans Adam II von Liechtenstein Wir sprechen dann über die zwiespältige Entwicklungen des 19. Jahrhundert, Engels und den Manchester-Kapitalismus. Welche Rolle spielt Solidarität, Menschwenwürde? Wer soll diese Gewährleisten, und in welcher Form? Welche Rolle spielt Selbstorganisation (bottom up) im Gegensatz zu staatlichen Top Down Mechanismen?  Ab wann gleitet ein Sozialstaat in einen »Nanny-State« ab, ganz nach dem alten sozialistischen Motto »Von der Wiege bis zur Bahre« in der Hand des Staates? Gibt es in Deutschland nur mehr vier Grüne und eine rechte Partei, und sind letztlich alle auf dem Pfad des »Rent Seeking«? »Aus dem Recht der Bürger, nach ihrem Glück zu streben, wurde längst die Pflicht des Staates, für dieses Glück zu sorgen. Dass in einer Demokratie die Bürger diesen Staat ausmachen und deshalb solche Forderungen an sich selbst adressieren müssten, wird gerne vergessen«, Konrad Paul Liessmann Machen wir den Fehler einen vermeintlichen Idealzustand mit dem Ist-Zustand zu vergleichen? Warum gelingt es auch nicht mehr — nach Cicero — dass die Begabtesten in die Politik gehen, sondern wir heute eher eine negative Auslese erleben? »Wenn man merkt, dass man ein totes Pferd reitet, sollte man absteigen.« Titus Gebel erklärt dann sein Konzept der freien Privatstädte genauer, auch die Abgrenzungen zu Charter Cities und Sonderwirtschaftszonen im Allgemeinen. Warum sind seiner Ansicht nach die Anreizsysteme in diesen Konzepten besser? Welche Rolle spielt der Markt — als Entdeckungsverfahren — und wie können wir evolutionäre Prinzipien auch in Verwaltung und Staatswesen etablieren mit Mutation, Nachahmung, Reproduktion, beziehungsweise dem »Seed, Select, Amplify« (Meyer, Davis) Prinzip? Probieren und Scheitern sollte wieder möglich werden, sonst gibt es auch weiterhin keinen Fortschritt. »Es wäre besser, wir würden in einer Welt von 2.000 Liechtensteins leben, die alle ein veschiedenes System haben als in 200 Staaten.« Aber ist es realistisch, dass sich Koordination von viele kleine Einheiten global bei wesentlichen Fragen umsetzen lässt? Wie könnte ein solches System überhaupt umgesetzt werden, wo doch alle Landflächen von existierenden Nationen kontrolliert werden? Gibt es eine reale Chance der Umsetzung? Oder gibt es schon exisitierende Beispiele? Dr. Gebel spricht über Beispiele in China, dem Nahen Osten, Saudi Arabien und Südamerika? Sind diese Ansätze nicht nur Gated Communities für die Elite? Was macht ein Gemeinwesen? Ich fühle ja auch keine Gemeinschaft zu anderen Gästen in einem Hotel? »Es gibt zwei Arten von Menschen: die einen, die ihre Meinungen anderen aufzwingen wollen, und die anderen, die das nicht wollen und die sagen, Leben und Leben lassen. Our guest on the Mobility Standard podcast this week is Mr. Titus Gebel, a German-born lawyer and entrepreneur who is now dedicating his life to the development of Free Private Cities, jurisdictions embedded within conventional states but operated by private companies for profit; a peaceful and voluntary alternative to the coercion-based systems of government we have today. "The defining feature of a Free Private City is that it's run by a for-profit company that acts as a government service provider, so to speak," says Gebel. In this capacity, he explains, the private company - the "operator" - offers citizens "the protection of life, liberty, and property, services that include both internal and external security, a pre-defined legal and regulatory framework, and independent dispute resolution."Interested individuals and companies enter into a citizen's contract with the operator and pay a fixed annual fee for the operator's services, instead of paying taxes."Within that framework, which is relatively limited," continues Gebel, "a spontaneous order can develop, which emerges from the voluntary activities of the citizens."Crucially, the operator cannot later unilaterally make any changes to the citizen's contract but would need the permission of the individual citizen concerned.A citizen's contract, he explains, gives the individual far better legal protections than, say, a constitution, because "there is no third-party like a majority or a parliament or a government that could infringe upon your contract."In the podcast, we also went into detail about:The latest developments in the field, with an emphasis on the ZEDE projects in Honduras;The historical precedents for Free Private Cities;The long-term ramifications of successful Free Private Cities;Technology's role in the decentralization of political power and the rise of sovereign individuals; andWhy the European Union, which is totally opposed to special economic zones, is unlikely to survive the next three decades.Listen to this illuminating and heartening episode in its entirety by clicking the player below, or find the Mobility Standard on Spotify or Apple Podcasts.

Am 7. August durfte die Podiumsdiskussion alphaTrio nach langer Pause erstmals wieder vor Ort stattfinden. Unser Stargast Dr. Titus Gebel ist u.a. Gründer der Deutschen Rohstoff AG und der Tipolis Corporation. Erstere ist an der Börse gelistet und mit letzterer möchte er ein völlig neues Produkt auf den Markt des Zusammenlebens bringen. Er ist aus Monaco eingeflogen und kann die deutsche Medienlandschaft so als Aussenstehender beurteilen. Herr Dr. Krall zieht nach 16 Jahren Merkel gnadenlos Bilanz und Herr Dr. Elsässer meint, dass wir diesbezüglich viel zu viel hinnehmen würden. Unser Stargast begründet gekonnt, warum er nicht nach Deutschland zurückkehren möchte. Alle drei sind überraschend optimistisch, was die mittelfristige Zukunft angeht. Es wird einen «Reset» geben und die Politik müsse wieder zum Dienstleister degradiert werden. Es folgt eine Diskussion darüber, wie der Staat überhaupt entstanden ist und wie sich die EZB in vielen Belangen übernommen hat. Inflation trifft die Ruheständler am härtesten. Im zweiten Teil erklärt Herr Dr. Gebel das Konzept Freier Privatstädte. Es setzt eine hohe Messlatte für Staaten und Politiker, ein besseres Produkt anzubieten. Es ist keineswegs utopisch. Simplistisch betrachtet, handelt es sich um eine «Sonderwirtschaftszone Plus», in welcher bilaterale Verträge zwischen der Stadt, dem Dienstleister, und dessen Bewohnern geschlossen werden. Gerade Deutschland habe eine sehr dezentrale Tradition und es könnten viele Menschen das Zepter wieder selbst in die Hand nehmen. Dr. Titus Gebel stellt aber auch unmissverständlich klar, dass ein solches Konzept niemals mehrheitsfähig sein wird. Dr. Markus Krall sieht das angrenzende Imperium als Erzfeind einer solchen kleinen, freiheitlichen Einheit. Es ist eine hochspannende und lehrreiche Diskussionsrunde und die Diskutanten blühten während der einstündigen Q&A-Runde richtig auf. Im Anschluss fand ein Meet & Greet aller Gäste und Teilnehmer statt. So mancher unterhielt sich noch bis in die späten Abendstunden.

Der Staat missbraucht sein Gewaltmonopol, um eigene politische Ziele zu verfolgen. Problem: Ge- und Verbote repräsentieren niemals die Ziele von allen, sondern immer nur die einer bestimmten Gruppe von Leuten. Besonders derer, die gerade an der Macht sind. Titus Gebel sieht es so: „Politik heißt, Partei zu ergreifen und die Wünsche einiger zum Maßstab für alle zu machen. Und zwar notfalls mit Gewalt.“ Das kann doch irgendwie nicht legitim sein… Also hat Titus das Konzept der freien Privatstädte entwickelt. Eine freie Privatstadt ist ein (teil)autonomes Verwaltungsgebiet mit eigenem Recht und Ordnung. Sie wird von einer privaten, gewinnorientierten Gesellschaft betrieben. Für einen Jahresbeitrag von etwa 1000€ bietet sie den Einwohnern Schutz von Leben, Freiheit und Eigentum. There are always trade offs If you are not providing effective security, you will go out of business People come to Monaco because the cameras are there, keeping them safe A cruise ship captain can legally abuse his passengers - but he treats them like customers How would disputes between a citizen and the operator be adjudicated? Third party arbitration, special courts No different than any major construction contract Minimum payment to arbitrators is $1,200 - not feasible for small claims Small claims tribunals a potential solution Easier in theory than in practice Other means of citizen involvement in city management It's not so important who owns the city operator, as long as the contracts are enforced Some cities might require citizens to purchase a share of ownership Cooperatives are possible Various councils can be formed, but cannot violate citizen contracts or force changes to the contract Public space is one service offered by the operator Kicking someone out of a city means preventing them from using public space. Nach seiner Zeit als CEO bei der Deutsche Rohstoff AG widmet sich Titus Gebel einem ganz anderem Projekt. Eine Idee reift heran und nimmt nun immer konkretere Formen an: Eine freie, private Stadt, in der die Bewohner die Kunden sind, und anstelle eines Staates gibt es nur Dienstleister. Mit dem Wunsch, ein grundsätzlich libertäres Projekt Realität werden zu lassen, ist Titus Gebel nicht allein. So gibt es beispielsweise schon das Seasteading-Institut. Titus Gebel geht unternehmerisch vor und konnte das Modell erfolgreich bewerben. In der heutigen Episode stellt Titus Gebel die Idee vor.
