Guest post by David Ross is an international corporate peacemaker, strategist, and author of Confronting the Storm: Regenerating Leadership and Hope in the Age of Uncertainty Who would want to be the CEO of a large company, when finding yourself knee-deep in a highly visible corporate scandal? Imagine the pressure trying to remove your organization as quickly as possible from being a front-of-mind concern for your teams, the media, regulators, shareholders, affected communities, and politicians. Confronting the Storm: Regenerating Leadership Maybe that pressure explains the all-too common tactics CEOs employ to get off the front pages such as doubling down on their beliefs that their organization is innocent, that that the harm caused is less than perceived and ridiculing those who have highlighted the organization's toxic practices. And the most obvious tactic of them all, relying on an expensive communications firm to help ride out the scandal. So how does this usually work out? Responsibility is Yours There are numerous high-profile examples of notable corporate scandals, and it is hard to think of one where the CEO has come out of it with their reputation intact or rebuilt Take Enron's CEO, Kenneth Lay, who was convicted of six counts of securities and wire fraud and after the Deep Horizon oil spill scandal, BP's CEO, Tony Hayward, was dismissed. Similarly, Volkswagen CEO, Martin Winterkorn, resigned from his post and is about to go on trial for his part in the "emissionsgate" scandal. However, it is possible for leaders to "unfail," rebuild trust and get things back on track provided they are fully prepared to really confront the issue. From Outrage to Integrity: The Big Picture Scandals, if managed proactively and sensitively, can be an opportunity for organizations. But leaders shouldn't expect them to be resolved quickly, as they often occur because stakeholders feel that something adverse has been imposed on them, or that there has been a collision where the values and goals of the affected are adversely at odds with those of the organization. Something must give. The sooner CEOs appreciate that the affected are, generally, reasonable people with important insights, the better. They should never underestimate their stakeholders. Five Steps to UnFail Stem the bleeding It is critical to reduce the intensity of the outrage directed at your organization: listen deeply - to representatives of the affected on their turf, not yours don't be defensive or disagreeable no matter how hard that feels set expectations that you and your organization take the concerns raised seriously. Intend to do something about it and maintain lines of communication. Understand the 'why' and act Appreciate that there may be a myriad of concerns raised by the affected, search for patterns in the data. Plan your response and strategy, accordingly: identify which concerns are legitimate and should be responded to, and which are illegitimate, those that violate human needs, and should not be progressed any further reflect, as an organisation and personally, on what you are hearing - particularly what needs to be confronted about obvious problems, past behaviours or practices. develop a strategy embedded with dignity, valuing the worth of those affected, their groups or communities, and where relevant, the natural environment. Proactively and sensitively communicate Managing perceptions, outside and inside your organization, from the get-go is critical: Sincerely acknowledging the pain caused or poor behaviour exhibited on the part of the organization is essential. Don't ever blame someone else. don't underplay the impact. keep the affected updated. Vacuums, otherwise, will be filled with misinformation. communicate how seriously the organization takes the issue, and how it will, humbly, start to improve the situation (hint: with the help of the affected). Be disciplined in following through Conflict doesn't disappear after carrying out the above s...

Mein heutiger Gast ist vielleicht eines der bekanntesten Gesichter rund um den VW Abgasskandal, der die Autoindustrie in seinen Grundfesten erschüttert hat, wie kaum ein Ereignis zuvor. Im Januar 2017 wurde Oliver Schmidt nach dem Weihnachtsurlaub in Florida verhaftet und das Häftlingsfoto ging um die Welt. Was ich bisher allerdings in allen Berichten vermisst habe, ist mehr über sein Leben vor diesem Tag, der alles verändert hat, zu erfahren. Denn auch Oliver Schmidt hat viel zu erzählen, begann seine Karriere doch bei VW Motorsport, von wo aus er an den großen W-Motoren des Konzerns arbeiten durfte und so handelt diese Folge nicht etwa nur davon, wie man sich mit der amerikanischen Umweltbehörde und irgendwelchen Mithäftlingen herumschlägt, sondern von Kurbelwellen für den Bugatti, seine Arbeit bei Bentley in Crewe, davon, wie er vergeblich versucht hat, in einem Phaeton dem damaligen Vorstand Dr. Wolfgang Bernhard im 700-PS-Golf auf einem amerikanischen Highway zu verfolgen und wie es zu den Treffen mit Jay Leno gekommen ist! Gut drei Jahre lang hielt Volkswagens These, der Konzern habe sich in Deutschland eigentlich nichts zu Schaden kommen lassen. Dann hagelte es Urteile mit allerdeutlichsten Worten. Es waren halb Urteile, halb Moralpredigten. Wenn die Anwälte der Volkswagen AG im Jahr Drei der Dieselaffäre ihre Post öffneten, mussten sie tief durchatmen. Der Konzern habe seine Kunden betrogen, hieß es vom Landgericht Nürnberg. Volkswagens „Gewinnstreben um den Preis der bewussten Täuschung von Verbrauchern und Behörden ist als verwerflich zu betrachten“, schallte es aus Düsseldorf. Ein Richter in Stuttgart tadelte, Volkswagen verstoße „gegen das Anstandsgefühl aller billig und gerecht Denkenden“. Volkswagen, einst Stolz der deutschen Automobilwirtschaft, war in den Augen der Richter zum Sündenpfuhl geworden. Die Dieselfahrzeuge des Konzerns wären schadhaft, seine Führung moralisch untauglich und juristisch verantwortlich, lautete das Credo zahlreicher Urteile. Volkswagen konterte, man erachte die Urteile als rechtsfehlerhaft und rechne mit einer Korrektur. Dann strebte man lieber einen Vergleich an. In dieser Folge von Handelsblatt Crime berichten unsere Reporter, wie aus dem größten Skandal der deutschen Autoindustrie der größte Vergleich der deutschen Rechtsgeschichte wurde. Mehr als eine Viertel Million Kunden schlossen sich einer so genannten Musterfeststellungsklage an, um Volkswagen zur Korrektur eines gewaltigen Betrugs zu zwingen: den millionenfachen Verkauf von angeblich umweltfreundlichen Fahrzeugen, die in Wahrheit umweltschädlich waren. Es kostete mehr als 800 Millionen Euro. Weitere, weit höhere Rechnungen stehen noch aus. In Braunschweig läuft ein Anlegerprozess. Neben der Musterklägerin Deka Investment sind diverse weitere institutionelle Investoren dabei. Ihre Forderung: fast zehn Milliarden Euro. Der Richter muss entscheiden, ob Volkswagen die Anleger rechtzeitig über den Skandal um Millionen von manipulierten Dieselmotoren informierte. Vieles spricht dafür, dass dies nicht geschah. Wenn es einen Mann gab, der dafür hätte sorgen können, dann er: Martin Winterkorn. Seit vielen Jahren allmächtiger Chef von Volkswagen, viel gerühmt und hoch bezahlt. Im Dieselskandal von Volkswagen gingen viele Mythen zu Bruch. Die Mär von der allwissenden Compliance und wegweisender Fehlerkultur sind nur zwei traurige Beispiele. Zwei Inder und ein Schweizer Student kamen Volkswagen als Erste auf die Schliche. Alle drei waren an der West Virginia University eingeschrieben und beschäftigten sich am Institut für Emissionsforschung damit, wie Fahrzeuge umweltfreundlicher werden konnten. Die deutschen Hersteller schienen führend bei diesem Thema. Die Studenten wollten wissen, wie die überlegene Technologie aus Good Old Germany genau funktionierte. So nahm das Schicksal seinen Lauf. Die Studenten bastelten sich ein mobiles Testgerät für Abgase. Damit konnten sie die Werte im Straßenverkehr messen und mussten sich nicht auf die Zahlen aus den Testlabors verlassen. Und siehe da: die echten Abgaswerte waren um ein Vielfaches höher als angepriesen. In der zweiten Folge von Handelsblatt Crime zum Dieselgate zeichnen wir nach, wie die Ergebnisse der Studenten die Umweltbehörde erreichten. Ebenso stellen wie die Compliance Abteilung von Volkswagen vor. 550 Mitarbeiter, die den ganzen Tag nichts andere taten, als für die Einhaltung der unternehmenseigenen Regeln zu sorgen – und trotzdem keinen Schimmer vom größten Betrug der deutschen Autogeschichte hatten. Das galt angeblich auch für Martin Winterkorn. Der allmächtige Vorstandsvorsitzende von Volkswagen ließ sich zwar jeden Freitag einen sogenannten Wochenendkoffer mitgeben. Darin enthalten: die wichtigsten Themen im Konzern, die der detailversessene Workaholic Winterkorn bis Montagfrüh durchgearbeitet haben wollte. Ausgerechnet im August 2014 allerdings, als Informationen über viel zu hohe Abgaswerte in Dieselmotoren im Winterkorns Koffer lagen, passte der bestbezahlte Automanager Deutschland offenbar nicht richtig auf. Und selbst am Schadenstisch, der für die Problemanalyse eingerichtet worden war, wollten hochrangige Manager von Volkswagen die Probleme im Juli 2015 nicht lösen, sondern vertuschen. Mehr als zehn Millionen manipulierte Fahrzeuge, mehr als 30 Milliarden Euro Schaden. Kein Skandal hat den Ruf der Autoindustrie so beschmutzt. Der 18. September 2015 war ein Schicksalstag für Volkswagen. Kurz vor dem Wochenende verschickte die amerikanische Umweltbehörde EPA eine „Benachrichtigung über einen Verstoß“, so das Amtsenglisch. Volkswagen sollte in den USA 500.000 „regelwidrige Kraftfahrzeuge“ verkauft haben. Für jedes einzelne davon wäre eine Strafe von 37.500 Dollar möglich. Noch auf ihren Sofas konnten die 600.000 Mitarbeiter von Volkswagen das Risiko ausrechnen: 18,5 Milliarden Dollar. Fünf Tage später trat Martin Winterkorn zurück. Der einst allmächtige Vorstandsvorsitzende von Volkswagen beteuerte, nichts gewusst zu haben von dem Skandal, der seinen Konzern ins Wanken brachte. Manipulierte Dieselmotoren, Betrugssoftware, gefälschte Abgaswerte? Winterkorn gab sich komplett ahnungslos. In dieser Folge von Handelsblatt Crime sprechen Ina Karabasz, Investigativ-Chef Sönke Iwersen und Auto-Reporter Stefan Menzel über die Hintergründe des größten Skandals der deutschen Fahrzeugindustrie. Wolfsburg. Einen solchen Auftritt hatte man von Martin Winterkorn noch nie erlebt. Der sonst so selbstbewusste VW-Manager, der ein halbes Jahr zuvor noch im Führungsstreit mit Ferdinand Piëch die Oberhand behalten konnte, trat am 20. September 2015 vor die Kamera. Zweite Tage zuvor hatte die US-Umweltbehörde EPA mitgeteilt, dass VW in Diesel-Motoren eine Software einsetzt, mit deren Hilfe bei Testmessungen die Schadstoffemissionen künstlich verringert werden. Winterkorn las ein vorbereitetes Statement vor, das so begann: „Die Unregelmäßigkeiten bei Dieselmotoren unseres Konzerns widersprechen allem, für was Volkswagen steht. Auch ich habe zum jetzigen Zeitpunkt noch nicht die Antworten auf alle Fragen. Aber wir sind dabei, die Hintergründe schonungslos aufzuklären.“ Es tue ihm unendlich leid, dass VW das Vertrauen der Kunden enttäuscht habe. „Es wäre falsch, wenn wegen der schlimmen Fehler einiger weniger die harte und ehrliche Arbeit von 600.000 Menschen unter Generalverdacht gerät. Das hat unsere Mannschaft nicht verdient.“ Drei Tage später trat er zurück und der VW-Konzern geriet in die schlimmste – andere sagen schmutzigste - Krise der Unternehmensgeschichte. Es geht um Dieselgate und um mehr als 32 Milliarden Euro Schaden für den Weltkonzern vom Mittellandkanal. Vier VW-Manager stehen seit dem 16. September 2021 als Angeklagte vor der 6. großen Strafkammer des Landgerichts Braunschweig. Sie müssen sich verantworten wegen des Vorwurfs des gewerbs- und bandenmäßigen Betrugs in einem besonders schweren Fall. Sind sie diese „einigen wenigen“, von denen Winterkorn sechs Jahre zuvor sprach? Auch gegen ihn selbst hat die Staatsanwaltschaft Braunschweig Anklage erhoben. Sein Verfahren wurde aber aus gesundheitlichen Gründen ausgesetzt. Der einzige Journalist, der seit dem Auftakt alle Prozesstage verfolgt hat, ist der Leiter des Wirtschaftsressorts unserer Zeitung, Andreas Schweiger. Als VW-Experte berichtet er seit 2015 über den Abgas-Skandal. Ein Diesel-Auto, das auf dem Prüfstand sauber ist, im Straßenverkehr aber die Abgasreinigung weitgehend abschaltet und somit ein Vielfaches an Dreck aus dem Auspuff bläst: Diese Betrugsmasche bei einigen Modellen von Volkswagen war technisch raffiniert, um die strengen Umweltauflagen in den USA scheinbar erfüllen zu können. Trotzdem flog sie auf - und VW hatte sein "Dieselgate". Jetzt stehen einige der Verantwortlichen in Braunschweig vor Gericht, Corona-bedingt in der Stadthalle. Wie konnte es sein, dass so eine offensichtliche Manipulation vom Management offenbar wissentlich im Kauf genommen wurde? Wird das schlechte Gewissen dabei abgeschaltet, wie damals die Abgasreinigung? Und welche Lehren können Wirtschaft und Politik daraus ziehen, um so etwas in Zukunft zu vermeiden? Volkswagen has taken the unusual step of going after the firm's former board members involved in the diesel emissions scandal. Several key figures, led by former chief executive Martin Winterkorn, will pay millions of euros to Volkswagen to settle claims around their involvement in the emissions cheating scheme. In an aviation first, a Boeing MQ – 25 Stingray drone has operated in an air-to-air refuelling role, offloading fuel to a manned F/A-18 Hornet. The buddy tanking procedure used standard Navy equipment and the transfer was made at what Boeing calls “operationally relevant altitudes and speeds”. The on-again, off-again Keystone XL pipeline project, intended to carry Canadian oil sands derived crude to American refineries, has been officially cancelled by the Canadian firm spearheading the project. The formal cancellation comes after the January revocation of Pres. Biden's presidential permit, reversing Pres. Trump's prior reversal of Pres. Obama's 2016 cancellation. Is Keystone dead? It would appear so, but the project has been through this before. To date, Volkswagen has paid more than 30 billion Euros (which is about $50 billion in Shitsvillian micro-pesos) in penalties and settlements for being such fine, outstanding citizens and paragons of global virtue, etc. They dropped their reputation in the sewer, as a consequence of these careful decisions approved at the highest level, which remains a real ‘surprise and delight’ event for a reporter such as me. Epicurus could have had a field day with that, except of course he’s been dead for 2360-ish years... The court in Bratwurst found a (quote) “predominant likelihood” of conviction in the fraud charge. Ze Chermans are quite precise like that. Look at how well they run their railways. It’s amazing. They’re good at predicting the foreseeable future. Just saying. The three wise Cherman judges said four other defendants would face trial on fraud charges connected to aggravated tax evasion and illegal advertising. Dates for a trial are yet to be set. They hate tax evasion. Courts, and governments. Just ask Wesley Snipes. They have no sense of humour whatsoever, on this stuff. To regulators, tax evasion is worse than murder. Public trials are always fun, too, which Big Marty’s is apparently set to be. There’s really nothing a former corporate rockstar loves more than having his dirty laundry oxygenated on the nightly news.

There’s a lot of Jeep apologists. Dozens of people suggested this was just a ‘rogue dealer’. Keep watching because I’ve got the smoking gun on that - it’s not a rogue dealer. It’s an entrenched rip-off strategy with Jeep. Smoking gun coming up: the evidence - shocking. This suggestion that $47,500 is just a rogue dealer, and Fiat Chrysler head office had no knowledge of such abhorrent practices: What a load of shit, in my view. Here’s the smoking gun. Two years ago, a guy named Michael e-mailed me, upset. His cup over-ran when his diesel Jeep shat itself at 58,412 kilometres, in an eerie prequel to the Lawrence’s recent meltdown. The Caroline Springs Jeep shitheap dealer dealt with that. The two dealerships (Newcastle and Caroline Springs) are separated by 1000 kilometres. These events are also separated by almost two years in time. Those shitheads in Sunshine quoted the following: $8900 for the high pressure pump. Six injectors at $2500 apiece - that’s $15,000. Left and right fuel rails at $2163 each. That’s $4326. Fuel injector lines $1267. Sundry parts: $1970. The total is a staggering $31,464. The Sunshine dealership was far more reasonable about the labour - at just $1820, which (I imagine) is around 15 hours at about $120 per hour. That’s only 50 per cent higher than it should be. Those pricks in Newcastle were proposing to fillet the Lawrences to the tune of $7000 for labour. An epic touch-up. But the parts … $31-and-a-half grand in Victoria, two years ago, versus $39-and-a-half in Newcastle, today. They’re similarly blown-out, I think you’d agree. And there’s no way head office could not know. Like, no way. Not that I can see. These are just two ripoffs we know about. How many poor bastards just copped it on the chin and coughed up because they needed to get their Jeep shithawk back on the road? This ‘rogue dealer’ suggestion is about as likely as the alleged ‘rogue engineers’ mooted at one point by those arseholes at Volkswagen, when all the time, the fish was rotting from Martin Winterkorn’s head down. There is no way senior people at Fiat Chrysler Australia can be unaware of dealings such as this. Consumers would be arcing right up to head office about repair cost, don’t you think? I’d love to see the AFP knock on Fiat Chrysler’s door with a warrant and test this hypothesis. Before I let you go: FCA did intervene a couple of days ago. They bowed to the media pressure and they turned the Lawrence’s $50k frown upside down by offering to repair the shitheap for free. In other words, they agreed to do somewhat less than obey the consumer law. Because make no mistake: Had they rolled the dice in court and lost, it could well be Princess of Poshtovia 2.0 - they get their $50 grand purchase refunded and make an application for costs. FCA is getting out of this one for about $10 grand - minus the media fallout, which I sincerely hope is unpleasant, and costs them sales. They deserve that. To Kevin Flynn, who runs FCA in Australia I’d suggest: you did try very hard to spin this up in the news to appear as if you were bending over backwards to be magnanimous, but in fact you do not deserve a standing friggin’ ovation, any more than the rest of us deserve pats on the back for no knocking over the National Australia Bank again today. You arseholes did less than the law requires for a breach of the ‘acceptable quality’ guarantee. And in that sense, you’re still getting away with it.

In einer neuen Folge von "Lauer und Wehner" sprechen Ulrich und Christopher über die Themen der letzten Woche. Zunächst geht es um den Brand der letzten Woche: Den von Notre Dame in Paris. Ulrich und Christopher diskutieren über die Reaktionen in den Sozialen Netzwerken und die Reaktionen der Milliardäre, die in kürzester Zeit 700 Millionen Euro zu spenden bereit waren. Wobei Ulrich und Christopher auch darüber diskutieren, ob es sich bei den 700 Millionen Euro tatsächlich um Geldspenden handeln wird, oder um die Spende von Sachleistungen in dieser Höhe, die dann steuerlich geltend gemacht werden können. Dazwischen reden die beiden darüber, dass Greta Thunberg den Papst traf und dieser die Klimaaktivistin aufforderte, weiter zu kämpfen.Danach geht es um die Plakate zur Europawahl, die in einem Monat stattfinden wird. Insbesondere bei der SPD fragen sich Ulrich und Christopher, was da genau los ist und wer die Kampagne für eine gute Idee hielt. Im Anschluss reden die beiden über das sogenannte Geordnete-Rückkehr-Gesetz, das in dieser Woche vom Bundeskabinett verabschiedet wurde. In diesem Zusammenhang stellt Ulrich die Frage, inwiefern die Bundesregierung angesichts der aktuellen Probleme Deutschlands die richtigen Prioritäten setzt. Um Schulnoten geht es danach, denn eine bereits im letzten Jahr veröffentliche Studie der Universität Mannheim kam zu dem Ergebnis, dass Schüler mit exakt gleichen Fehlern in einem Diktat schlechter bewertet werden, sobald sie Murat und nicht Max heißen. Die Lösung hierfür, da ist man sich schnell einig, kann eigentlich nur sein, dass Tests und Klassenarbeiten in Zukunft anonymisiert benotet werden. Zum Schluss führt uns Ulrich durch die Anklage der Staatsanwaltschaft Braunschweig, die sie in der letzten Woche gegen Martin Winterkorn und andere VW-Manager erhob.
