Introduction: The Problem We Can't Ignore We live in a world where the food we eat is supposed to nourish us, but what if it's actually making us sick? Pesticides, soil degradation, and nutrient-depleted crops are all part of our modern food system, contributing to rising cases of neurological disorders, metabolic diseases, and immune dysfunction. The research is clear: exposure to certain pesticides has been linked to cognitive decline, Parkinson's disease, and an increased cancer risk. At the same time, the way we farm today is stripping our food of the vital nutrients our ancestors took for granted. So, the question isn't just about avoiding chemicals—it's about finding food that truly fuels life. The solution? Organic, regenerative, and locally grown produce. Let's break down the science and give you real reasons why it's never been more important to care about where your food comes from.     The Science Behind Pesticides and Health Risks  The Hidden Dangers of Conventional Farming Pesticide residues in conventional food contribute to long-term health risks, including cognitive decline and neurodevelopmental disorders in children. According to Holzman (2012) in Organic Food Conclusions Don't Tell the Whole Story, "Pesticide dietary risk is a function of many factors, including the number of residues, their levels, and pesticide toxicity." (Holzman, 2012).  Organophosphate pesticides, commonly used in industrial agriculture, have been directly linked to Parkinson's disease. As Mie et al. (2017) state in Human Health Implications of Organic Food and Organic Agriculture, "Epidemiological studies have reported adverse effects of certain pesticides on children's cognitive development at current levels of exposure." (Mie et al., 2017).  Pregnant women consuming conventional produce showed higher levels of pyrethroid insecticides in their bodies compared to those eating organic. Curl et al. (2019) in Effect of a 24-week Randomized Trial of an Organic Produce Intervention found that "3-Phenoxybenzoic acid (3-PBA, a biomarker for pyrethroids) concentrations were significantly higher in conventional produce consumers compared to organic consumers." (Curl et al., 2019).      The Cancer Connection The International Agency for Research on Cancer has classified several pesticides used in conventional farming—such as glyphosate and malathion—as likely carcinogens. Hemler et al. (2018) in Organic Foods for Cancer Prevention—Worth the Investment? found that "Participants with the highest frequency of organic food consumption had a 25% lower risk of being diagnosed with cancer during follow-up compared with those with the lowest frequency." (Hemler et al., 2018).     The Nutrient Density Solution: More Than Just Pesticide-Free  Higher Nutrients in Organic & Regenerative Foods  Organic fruits and vegetables contain higher levels of vitamin C, essential minerals like magnesium and iron, and more powerful antioxidants. Maloney (2014) in Comparative Study on Nutritional Quality and Detection of Pesticide Residues states, "Organic foods are better in taste, appearance, firmness, and nutrient content when compared to conventional foods." (Maloney, 2014). Organically grown produce has 20-40% higher levels of antioxidants than conventionally grown produce, which help protect against inflammation and chronic diseases. According to Mie et al. (2017), "Differences in the composition between organic and conventional crops include a modestly higher content of phenolic compounds in organic fruit and vegetables." (Mie et al., 2017).     The Simple Steps to Better Food Go Organic Whenever Possible – Reduce your pesticide exposure and increase the nutrient density of your food.  Support Local & Regenerative Farms – Look for farmers using soil-restoring practices that make food healthier.  Grow Your Own – Even a small backyard garden or balcony pot can produce pesticide-free, nutrient-rich food.  Buy Seasonal Produce – Seasonal food is fresher, richer in nutrients, and often grown closer to home. Prioritize the Dirty Dozen – If you can't go 100% organic, at least choose organic versions of the most pesticide-laden produce, like strawberries, spinach, and apples.     Conclusion: Take Back Control of Your Health  Our food choices today impact our health for decades to come. Science shows that organic, regenerative, and locally grown food isn't just a trendy choice—it's a necessity. There are innumerable ways to be wrong and only one to be correct. Yet, speculating the future is the first step towards creating things that doesn't exist.Technology has taken great leaps in the last couple of decades. But, the foundation of everything amazing and almost ‘miraculous' that we take for granted today has been laid more centuries ago. The earliest scientific development of wireless communication would go back to late nineteenth century, but in human imagination it has existed for millennia. Thus, it can be a good exercise to let your mind go on a wild goose chase every nor or then. Worst case, you will be a goose short.Over last couple of years, I have made it a practice to maintain a list of technology that I believe will become commonplace in my lifetime. It is part wishful thinking, and part extrapolation of existing technology. I can be massively off on a few things, and some of the technology might not even exist yet. But we definitely are moving in that direction.Universal AutomationThis is the lowest hanging fruit. We are already deep into it for workspace assistance, technology development etc. My proposition is memoized cronjobs will become available as a service for everyone for pretty much everything which is mundane and repetitive. Voice assistants like Alexa, Siri or Google Home are continually moving in that direction.I believe soon we will just be performing a trigger action or set objectives and from there on automation will follow through on associated processes. This can be done for everything that we do in life, whether it is daily activities or life decisions. Take an example of daily routine activity you might follow when you get back home from work. As you start from work for home, a sequence of heating your coffee, preparing your bath, warming your food etc can be set in motion. Similarly for life decisions, as you select a learning objective, it will triggers a sequence to select the right tutorials or academic institutions, prepare the schedule, seek appointment with the right people to learn from or process admission application of universities, summarizes books and articles, evaluate the career prospects that open up once objective is met and accordingly apply for those roles as you progress through your learning based on your performance. A similar sequence can be triggered when you set a relationship objective or even a holiday. The idea is you will just take decisions, and never have to go through the process of planning.   Embeddables & LifeOSDevices are an inseparable part of our lives. So much so that they are now object of addiction and abuse. Yet, we do not seem to get enough of it. Wearables are commonplace enough and growing continually. Embedded device is well out of its testing and beta phase. Rumours were apace during Covid-19 about vaccine having nanodevices. While they were baseless and unfounded, the fundamental idea is not ridiculous. In fact, embedded device in healthcare has a been a reality for long. Think stents, pacemakers etc. It is just that so far, they had not been connected.The popular culture has effectively normalized the idea of half human, half machine. And, truth to be told we are already some sort of Cyborg with wearables and hand held devices almost an extension of ourselves. So, embeddables will not come as a surprise. It is, in fact, the next obvious step.The point here is, how soon and how far can we go with it? I believe, we will soon be able to turn thoughts in to commands, reinforce skeletal structure and use our own biological hardware – eyes, ears, nose, tongue, limbs – instead of external devices to perform tasks. A common operating system – LifeOS – will run our bodies and all the external machines. It will also enable us to effectively stay connected to every other living being. A convergence to singularity.Sentient AI CompanionLast week much got written about the sentience of LaMDA. Google sent its engineer Blake Lemoine who claimed that, on forced leave and completely rejected his assertions. I am, to be honest, also highly sceptical about the sentience of AI, though do not completely rule out the possibility. But one thing that I believe in with full certainty is the ability of artificial intelligence to pretend to be sentient. One can argue, as far as interactions among human are concerned, pretence is probably the most exercised token.AI is our companion in much part of our life, as we are dealing with chatbots to accomplish many tasks. But I imagine of a near future, where we will have personal companions – friends & family – who will be AI, if not sentient then at least pretending to be. Enhanced graphic capabilities and true AR can bring metaverse to life, where an AI can get its form – human, humanoid or animal – whatever we fancy. It will be completely capable of having conversation which would make anyone believe that they are real human being. I mean, it has made a Google engineer working on AI believe that. And then between audio-visual stimulation and embeddables running on LifeOS, we will be able to make those experience quite a livid memory to the extent to trigger emotional and involuntary bodily responses.Space LogisticsOrdering online although seems a very trivial action to most of us, the eCommerce has been the mover of many technological development that we have come across in the last couple of decades. We do not appreciate it much, but logistics sits at the core of the global civilization that we have developed in to. Be it war or trade, both method of expansion was enabled by our ability to move huge amount of supplies from one place to another. It is a process which have been refined since the dawn of the civilization. Arrival of eCommerce put it on steroid.Awareness generates demand. We are now in an age where consumer expects that products from any corner of the world should be available to them for minimal or no additional price burden. The investment in improving end to end logistics is huge. Amazon alone have spent billions of dollars in developing every aspect of logistics including warehousing technology, freight fleet build up, process optimization, last mile etc.A few recent developments make me believe that we might very soon move logistics operations to the space. They are advanced drones, reusable rockets and Elon Musk's mission to become interplanetary species. While consumer need on Earth might not be able to justify the cost of developing technology for space logistics, the mission to populate Mars will. For his mission to build civilization on Mars, Elon will have to move a lot of material from Earth to Mars for an extended period of time. It would make sense to have series of warehouses and delivery system between the two planet. Like it often happens, the consumer technology will piggyback on space technology. Between our air space and lower earth orbit, the vast space – stratosphere is largely unutilized. We may be able to build super warehouses is this space and then floating delivery balloons ready to ship out consignments using drones closer to earth.  I have other things on my list which I believe will happen sooner than later, and also of intriguing complexities that would come with that. For example, if and when Elon Musk does set out to establish civilization on Mars, will it be completely populated by transfer of people, animals and plants from Earth, or will we be artificially creating some on Mars itself? Do give it a read!Global Policy Watch: Fukuyama (et al) And The ‘Middleware’ Solution To Social Media Monopolies — RSJTwitter India did a first last week. It labelled a tweet by BJP IT cell head as ‘manipulated media’. It claimed the label was based on its Synthetic and Manipulated Media policy. This was a policy launched by it in February this year. The rule for its user states:“You may not deceptively share synthetic or manipulated media that are likely to cause harm. In addition, we may label Tweets containing synthetic and manipulated media to help people understand their authenticity and to provide context.”Curbing Digital ColonialismIt is unclear if Twitter found no such tweets in India since February that satisfied the criteria for manipulate media. Surely, this wasn’t the first instance of false information shared by a blue-tick user in India. In any case, a beginning has been made and it will be interesting to see where and how far it will go with this. These steps are part of similar efforts by other social medial platforms to self-regulate themselves as they come under increasing government and regulatory scrutiny. There is a greater urgency among regulators around the world to curb the abuse of the dominant positions of the big tech platforms. EU pursued antitrust charges against Google for over a decade. In 2018, it fined it nearly $10 billion. But not much has come out of it. Google was left to devise its own measures to offer a level playing field to its rivals. Google continues to dominate the search-engine market in Europe with over 90 per cent market share. The U.S. Justice Department last month sued Google for violating federal antitrust laws in running its search and advertising business. Also, the US Congressional investigation into the power of Big Tech (Amazon, Apple, Facebook and Google) concluded in September this year with a voluminous 450-page report. The report indicts them in no uncertain terms:"These firms have too much power, and that power must be reined in and subject to appropriate oversight and enforcement. Our economy and democracy are at stake.”India hasn’t yet taken a concrete view about the dominance of Big Tech but there are rumblings. Last month, India’s antitrust regulator (CCI) opened an investigation against Google based on complaints from the start-up ecosystem. The practices of ‘forcing’ the app makers to exclusively use its billing system for in-app purchases and for bundling its payments app with Android smartphones sold in the country are under the regulatory lens. Last month, India brought all OTT platforms under the purview of its Information and Broadcasting ministry by changing the GoI (Allocation of Business) Roles, 1961. And it has been considering regulating the social media platforms and their content for a while now.Not The Usual Lens There are three key points that we have made about regulating Big Tech and social media platforms:Antitrust regulators take the old Chicago school view to monopolies. This looks at monopolies through the economic lens of consumers and checks if they are being harmed by the dominance of monopolies. This is difficult to prove in case of Big Tech monopolies who provide most of their services for free and have deep customer loyalty.The nature of these monopolies is quite different from those of the past. These players have appropriated huge amounts of data, run 2-sided platforms, have asymmetrical knowledge and power over their users, and can easily move into newer businesses based on these strengths. The traditional measures to curb the monopolies like breaking them up or stopping a line of business are difficult to implement.    Economic dominance is only one part of their power. It is the political dominance or the dominance of thought that can be more insidious. Like we wrote in edition #74, “the data and attention appropriation done through these platforms constrain our choices: we live in echo chamber of our opinions, we buy things that are suggested to us and we see a version of reality that’s tailor-made for us and that no one else is seeing. Often the term ‘digital colonialism’ is bandied about when talking about Big Tech. This lack of freedom to be oneself, discover things on our own and not be dispossessed of our right to choose is what colonialism is about.” The current antitrust laws have nothing to manage this.In short, our view was the minimum acceptable price of Big Tech businesses to exist wasn’t zero. It was you. Your data and your liberty. In the normal course of events, politics would be about contestation of ideas and narratives in the political marketplace. And the best or the most acceptable idea would surface from this that would guide the polity. But social media platforms engineer a failure in these markets. The ideas that get pushed to your timelines haven’t won their duels in the marketplace of ideas. They have been programmatically fed to you. That program can be gamed. And Big Tech isn’t willing to solve this problem on its own. It took a long time to even acknowledge it is a problem. We had concluded edition #74 with these lines:“These are early days of policymaking in this area. There’s a need for deeper philosophical and sociological work in this space that will enable our thinking in how to legislate this.”A Novel But Half-formed Approach As if on cue this week we had Francis Fukuyama, Barak Richman, and Ashish Goel publish an article in Foreign Affairs titled How to Save Democracy From Technology: Ending Big Tech’s Information Monopoly. The article picks up the core point made by us. The antitrust regulations are using old tools to solve the economic problem. They may or may not be enough. But they don’t even begin to address the political costs of the Big Tech monopolies. The solution offered is not exactly fleshed out in the article, but it is important because it goes beyond the conventional thinking that has dominated this space.They write:“The economic case for reining in Big Tech is complicated. But there is a much more convincing political case. Internet platforms cause political harms that are far more alarming than any economic damage they create. Their real danger is not that they distort markets; it is that they threaten democracy.”It is remarkably similar to the points made by us in the past. The article then picks up the usual solution to break monopoly power – more regulations, breakup, data probability and privacy laws – and dismisses them all before proposing a solution:“If regulation, breakup, data portability, and privacy law all fall short, then what remains to be done about concentrated platform power? One of the most promising solutions has received little attention: middleware. Middleware is generally defined as software that rides on top of an existing platform and can modify the presentation of underlying data. Added to current technology platforms’ services, middleware could allow users to choose how information is curated and filtered for them. Users would select middleware services that would determine the importance and veracity of political content, and the platforms would use those determinations to curate what those users saw. In other words, a competitive layer of new companies with transparent algorithms would step in and take over the editorial gateway functions currently filled by dominant technology platforms whose algorithms are opaque.”The solution comes with its own set of problems. The authors acknowledge it and posit this as the start of a conversation to find a solution:“Many details would have to be worked out. The first question is how much curation power to transfer to the new companies. At one extreme, middleware providers could completely transform the information presented by the underlying platform to the user, with the platform serving as little more than a neutral pipe. Under this model, middleware alone would determine the substance and priority of Amazon or Google searches, with those platforms merely offering access to their servers. At the other extreme, the platform could continue to curate and rank the content entirely with its own algorithms, and the middleware would serve only as a supplemental filter. Under this model, for example, a Facebook or Twitter interface would remain largely unchanged. Middleware would just fact-check or label content without assigning importance to content or providing more fine-tuned recommendations. The best approach probably lies somewhere in between. Handing middleware companies too much power could mean the underlying technology platforms would lose their direct connection to the consumer. With their business models undermined, the technology companies would fight back. On the other hand, handing middleware companies too little control would fail to curb the platforms’ power to curate and disseminate content. But regardless of where exactly the line were drawn, government intervention would be necessary. Congress would likely have to pass a law requiring platforms to use open and uniform application programming interfaces, or APIs, which would allow middleware companies to work seamlessly with different technology platforms. Congress would also have to carefully regulate the middleware providers themselves, so that they met clear minimum standards of reliability, transparency, and consistency.”As a new approach to deal with the problem of fake news and lies circulating on social media platforms and making it sit well with the notion of free speech, this is a useful starting point. The control of what kind of content we want to see should lie with us. Like it has always been in media, the content consumer has to be active while engaging with it and the provider passive. Not the other way around.Matsyanyaaya: The Strategic Consequences of India’s Low Economic GrowthBig fish eating small fish = Foreign Policy in action— Pranay KotasthaneLast week I came across a data story in The Business Standard and I haven’t been able to erase off my mind. Krishna Kant writes:“Over the past 10 years, India’s per capita GDP is up 35 per cent cumulatively from $1,384 in 2010 to $1,877 now. In the same period, per capita GDP in China rose 141 per cent from $4,500 to $10,839, while it doubled in East Asian countries (excluding Japan, South Korea, Taiwan and Hong Kong) from $4,006 to $8,195.Bangladesh saw the fastest growth with its per capita up nearly two-and-a-half times from $763 in 2010 to around $1,900 at the end of this year. And, Vietnam’s per capita rose 115 per cent from $1,628 to around $3,500.”There’s a nice chart showing how the India growth story lost its way over the last full decade. I won’t bring them up here. The questions I have are concerned with India’s engagement with the world: what would be the strategic consequences of this poor economic performance? Does a decade of slow growth foreclose some options for India? Would India’s position on RCEP have been different had the last decade’s performance been at par with other peers? Would the PRC have been just as aggressive against a more prosperous India? The search for answers took me back to Sanjaya Baru’s 2002 landmark paper titled Strategic Consequences of India’s Economic Performance. The paper captures what scholars were thinking nearly twenty years ago, just before the golden growth years between 2004 and 2009. “For India, there is no doubt that the first and most important challenge is that of accelerating the rate of economic growth and development. Economic performance and capability certainly constitute the foundation of national security and power even more so for a developing nation like India. It will define the limits to military capability and alter the relationship between India and its neighbourhood, especially its two major adversaries, namely, China and Pakistan.The paper’s observations on Pakistan have broadly stood the test of time. The Pakistani military-jihadi complex’s self-defeating policies have strangled the economy in ways that even a nuclear weapons status and use of terrorism as a state policy haven’t been able to offset. The dehyphenation between India and Pakistan in international affairs is now self-evident. However, the story of this last decade is humbling. The gap between the two has increased not because India has done well but because Pakistan has done far worse. On China, the paper argued:“The strategic consequences of the economic competition with China are, there- fore, fundamental to India’s future role within Asia and the global system. If India can sustain above average growth (over 7 per cent per annum in the next decade) and if China experiences a deceleration of growth, coupled with domestic political uncertainty, the widening gap between the two civilisational neighbours can be reversed to an extent. If not, China will emerge as the pre-eminent Asian power and force India into accepting its strategic leadership even within south Asia. The key to this strategic rivalry will be the relative economic performance of the two countries. The main strategic challenge for India in the medium term is, therefore, its relative economic performance vis-à-vis China.”Remarkably prescient. Eighteen years on, the gap between the two countries has only widened. China has been able to forge strong economic ties with all countries in the Indian subcontinent. Economic Reforms NeededThe paper identified these macroeconomic targets essential from a national security perspective:Elimination of the revenue deficit, a manageable fiscal deficit, elimination of wasteful subsidies not targeted to the poor;Low and manageable current account deficit; Low internal and external debt, low short-term debt in overall external debt; Profit-generation by public enterprises; privatisation of non-strategic public enterprises; Self-financing public utilities like power, irrigation water and public transport; An increase in the tax/GDP ratio to levels reached by rapidly industrialising developing countries of around 15 per cent of GDP from the current low of 9 per cent of GDP. What struck me was that eighteen years since, many of these targets still remain aspirations. Lessons for the FutureIt is clear now that China’s rapid and sustained economic development over three decades played a fundamental role in transforming its international stature. The bad news for India is that not only did it start on the same path ten years later than China but it also seems to have fizzled out much earlier.Going ahead as well, India’s economic development will underscore its international role. India’s economic trajectory will decide whether it can play the role of a swing power between the US and China or whether it gets relegated to a weak partner of the US, much like Pakistan is to China. Feldstein warned about the adverse consequences of large budget deficits thus:“Unfortunately, it is easy to ignore budget deficits and postpone dealing with them because the adverse effects of budget deficits are rarely immediate. Fiscal deficits are like obesity. You can see your weight rising on the scale and notice that your clothing size is increasing, but there is no sense of urgency in dealing with the problem. That is so even though the long-term consequences of being overweight include an increased risk of a sudden heart attack as well as of various chronic conditions like diabetes. Like obesity, government deficits are the result of too much self-indulgent living as the government spends more than it collects in taxes. Our guest, Workplace Technology Strategist at Cisco, Mark Miller, works with global customers to find the #workplacestrategies that work best for them and their workforces. He and his team of Cisco engineers develop the winning technology innovations that suit customers needs. In this episode (which is a bit longer than the 20 minutes we promised when we started this podcast, but only because the discussion was too good), Mark and Kevin discuss: The 4 main trends when it comes to workplace and corporate real estate technology. Here’s an excerpt from the transcript: Kevin: I do have to say I love a good sound bite. I love a good short, sweet quote that resonates with the research I'm doing, the conference, the speakers and the content that we see at these iterations. Last time we spoke you said every workplace has its own fingerprint and needs to be treated like it does. That was awesome and I think I had mentioned, I'm going to steal that at some point and put that into one of our sessions, or think-tank discussions, or something unless you trademark it after this podcast episode, but can you explain what this means in relation to the changing workspace? Mark: Yes, Kevin, if you think back just 10 years ago, the workplace was dominated by a monolithic, uninspiring and I’d say much maligned cubicle, and the cubicle has been around for years. It was actually conceived back in the mid-60s by a gentleman named Robert Propst, from Herman Miller, as a way to address what he saw at the time was a shift to a more information centric work that was happening in the 60s, and for a generation, the cubicle was the foundation of every workplace. It was truly a one-size-fits-all model. Something that facilities teams could quickly roll out very efficiently with very limited technology enablement. Then about 10 years ago, the winds began to shift. Organizations started to realize that changing nature of work, what I referenced before around that process oriented work evaporating, and realizing that cubicle bays, that traditional workplace environment, was not designed for the type of work that was really going on, and this led to a wave of workplace design called activity based working, or ABW, where organizations focused on the various activities that were going on within the workplace and they created spaces for people to collaborate, concentrate, learn, and largely socialize. Four big trends. And then balanced not only that workplace design, but also technology and policy to allow a lot more movement within the workplace, allow people to gravitate to the places they needed that were best suited for the type of work they were going on. And this is where this concept around every workplace has its own fingerprint came to be. Now the workplace was designed around the specific activities of your organization, of the functional group that was in that space, or even as discreet as the team that was occupying a neighborhood. This next wave of workplace transformation that's happening, it's ABW or activity based working, tends to be working its way out. A lot of people have gone through that wave already. What this next phase, what we're calling the cognitive workplace, we're really focused on the employee experiences and using data and cognitive tools, such as artificial intelligence and machine learning, to increase productivity, to create a more personalized experience, and reduce friction in the workplace and that's going to drive even a stronger sense around very customized work environment, hence the analogies to a human fingerprint. Kevin: It's a phenomenal quote and it resonates a lot even with all of these podcast episodes, a lot of our upcoming content around that human experience touch point, and it's become very important and where I've mentioned in the past a lot of our content was around more so the physical design specifically only of the workplace has now transformed into understanding your culture and understanding the employees within your workspace first, before necessarily implementing anything, especially on the digital side, especially when it comes to digital transformation. So, phenomenal quote, kudos again. Now, you are a very demanded speaker when it comes to what we're talking about. You attend a lot of conferences, you hear a lot of these buzzwords and industry terms when you speak. I want to know if you have any pet peeves when it comes to the topic of the future of work, or digital workplace transformation, or technology in the workplace? Is there anything that maybe has become a trend or buzzword in this space that would be considered a pet peeve or not necessarily accurate at this point? Mark: I don't know if there's a pet peeve. I think this is a very broad topic and I sat one day at home looking at my home office and I saw on the bottom shelf, a bunch of books on business process re-engineering, and it was when I came out of college that was the big rave. Everybody was into business process re-engineering and then the next shelf was filled with a bunch of books on total quality management. What I realized was that was yet another wave. And then for years I used to do a lot of work designing customer relationship management strategies, some contact center technology in real life. That was a wave, and then globalization hit. I think this is just the next big wave of corporate innovation around the workplace itself and I think it's going to happen for a very long time. It's going to be a lot of solution providers are going to enter this space and everybody's going to try to hook onto it. You leave it up to the clients to help at least understand where you fit and know that we're not going to do this individually. There's no one company that's going to have the magic pill to redesign, or reinvent work, or create the future workplace environment. It's going to take clients and customers to sit down and understand which parts are relevant and how to stitch all those together, and I think as the solution providers in that space, it's our job to be able to work well with others in the ecosystem and be very clear about the areas that we play and the strengths that we have, and the areas that we can help them. Kevin: No, exactly. I'm thinking back to what you just said about finding the books on business process re-engineering. So, nowadays it's pretty much business process re-engineering on steroids, especially when it comes down to obviously the analysis of not only the workflows now, or design, it's of the people as well. Mark: So I had this conversation with a client a couple of months back and they said, "Look, Mark, is this really going to take off? Is this really going to be a sustainable trend?" And I said to them, "Hey, remember back 10 or 15 years? All the talk was around E-business." E-business, it was all the talk about Amazon and everything was going on in that space with eBay and everybody else. I said, "You know what we call E-business now? Business." It's a mature trend, and the workplace is going to be a lot like that too. We're going to look back at the time of cubicle-based work, and just think that's when the dinosaurs roamed the earth. Everybody's going to move in this direction where technology and space design and policy are seamlessly integrated together, and we're going to really quickly forget about the worlds that we came from. Kevin: No, exactly. People are already telling me, "Hey, that concept of the open office, man, that's ancient at this point," and I'm thinking this is some of the hottest news about the workplace and office design only a year and a half ago, so things are moving so quickly. Mark: I think there’s an opportunity here, too. As I said in my intro, everything revolves around an unintended consequence. When people went and built these open office environments, they thought they were solving for the right problem. The great thing about a workplace design effort is, if you get it right, you know right away and if you get it wrong, you know right away. So people are not bashful about telling you how they feel about their new work environments, but largely when we moved from traditional to that activity based model, it was really good for the balance sheet. Companies were allowed to consolidate and optimize a lot of their real estate portfolio. In fact, at Cisco, we optimized almost 25 percent of our real estate portfolio, moving to this new way of working. People just needed less space and you've got better efficiencies, but what was necessarily good for the balance sheet, wasn't always good for the employee. As people started moving within the workplace, there was a lot of friction that happened. There was a loss of sense of community. I think this next wave around the cognitive workplace is going to fix a lot of that. When you start dealing with the individual experiences, this idea of journey mapping an employee's movement around the workplace, you're really going to understand how you can create much better workplace experiences. As the world wades further and further into the Information Age, the definition of a journalist has continued morphing at a faster rate than ever. So what is a journalist? Is it a person acting as a watchdog of the government, or a spokesman for it? Is it a member of age-old institutions that have been respected for years, or is it a lone speaker trying to be heard above the din of voices? Did he or she study some form of writing, or is he an accountant with a hobby? Does it matter? These are questions that no longer only plague discussions of credibility, but also the laws of the land. In recent months the discussion surrounding the implantation of a federal shield law has significantly increased, with cases like Jana Winter’s and James Rosen’s garnering mass media coverage. But smaller cases have been surfacing as well, such as the Crystal Cox defamation suit.   What Is a Journalist? Merriam Webster defines a journalist firstly as a “writer or editor for a news medium,” and secondly as a “writer who aims at a mass audience.” While the first definition may be reserved for employees of institutional news organizations, the second could easily apply to any blogger. Most citizen journalists know they’ll never reach more than a few readers, but it doesn’t mean that they don’t hope to go viral. Most people don’t write in a public forum just for themselves. The complication comes when you consider the rights of a journalist, and how broadly those rights should apply. Last summer the Senate Judiciary Committee spent time debating the definition of a journalist as it constructed the language for a federal shield law, which is any law that gives a reporter privilege, much like a priest or doctor has, that prevents a judge from compelling him or her to produce information for a subpoena. Sen. Diane Feinstein wanted to ensure that any definition did not cover entities such as WikiLeaks, who she feels aren’t journalists, just leakers. One proposal she put forward was a salary requirement. Sen. Chuck Schumer fought that requirement because in the Internet Age it’s not just writers who earn a living for it who are disseminating important public information. Consider Sohaib Athar, also known by his Twitter handle “Really Virtual,” who unknowingly live-tweeted the military operation that killed Osama bin Laden. He may live in Pakistan, but had he lived in the United States that type of citizen reporting likely would, and should, have been covered as journalistic in nature. Another prime example is the work of the members of the Arab Spring who helped forward the goals of freedom. TIME even awarded the protesters from that movement, as well as others such as Occupy Wall Street, with its “Person of the Year” award in 2011.   The Need For a Shield Law Currently 40 states have enacted specifically tailored shield laws. The rest of the states, less Wyoming, protect a reporter’s privilege through case law, the state constitution, or other legal means. The federal shield law, which would likely trump state laws and render them obsolete, is slowly making its way through Congress. The language, as it stands, states that a party searching for information in a trial must have exhausted all other means of obtaining the information; that there is a reasonable belief that a crime has been committed; and that the information is critical to the party winning its suit (criminal or civil). Other situations under which a journalist could be compelled to testify include cases of future national security threats; if the information could prevent imminent bodily harm or death; if trade secrets are being disseminated; or if the public interest of the information being revealed outweighs the public interest of the information being withheld. A judge has the final say on a case by case basis. The law also does not protect defamation, slander, and libel, which have case law as precedents. A last provision in the federal law state that the subpoena can’t be overly broad, unreasonable, or oppressive, and it must be “narrowly tailored” in subject matter and time so that other documents aren’t unnecessarily revealed. So why is this type of law necessary? Take a look at our current administration. Many say that it is the worst for ever for going after reporters. New York Times Executive Editor Jill Abramson told Al Jazeera America last year that the Obama administration “is the most secretive White House that I have ever been involved in covering” in 22 years; James Goodale, one of the lawyers who fought for publication of the Pentagon Papers and defended the Times’ right to publish them in front of the Supreme Court, wrote an editorial for The Daily Beast last May that the Obama administration is worse than Nixon’s in terms national security press freedom. In fact, this administration has prosecuted eight individuals for felonious crimes of leaking classified information to the press under the 1917 Espionage Act, compared with a total of three prosecutions for all previous administrations. First, it was uncovered that the Department of Justice had seized two months of incoming and outgoing phone records from Associated Press reporters and editors without notifying the publication to allow an appeal. The seizure came after The AP printed a story in May 2012 about the government’s actions to stop a bomb from Al Qaeda in Yemen. The AP says they consulted with the government to make sure no national security information was divulged, but the publication was still secretly monitored. It was soon revealed that in 2009 the DOJ used a search warrant to monitor Fox News reporter James Rosen. Rosen, a beat reporter in Washington, had his movements monitored via his State Department security badge. The warrant, which also permitted monitoring of Rosen’s email, was issued after the DOJ argued that he was a criminal co-conspirator with Stephen Jin-Woo Kim in leaking classified information that North Korea may test a nuclear bomb. These leaks led to reforms in the DOJ, but a federal shield law would theoretically, and hopefully, further limit the government from overstepping its power. Confidential sources are the most vital tool an investigative reporter has; without them, there would not be a free dissemination of information because there would be very little information to report. The monitoring of Rosen led to a conviction of his source, Kim, likely keeping other possible sources from approaching Rosen in the future.   A Federal Definition for “Journalist” But the most important part of the federal law, and the part that judges, journalists, and citizens will focus on, is how a journalist was ultimately defined. The final language protects those who publish news or information for any news information service whether it’s in print, electronic, or another format. The person must also act like a journalist, meaning he or she must gather information and materials with the prior intention of publishing. Other parameters do outline a type of salary requirement—you’re covered if you worked for a news organization for at least one year in the previous 20 or three months in the previous five years—but it also protects student journalists. And lastly, what pleased many in the media was the addition of a clause granting a judge the authority to extend coverage under the shield law to any person if the judge felt doing so was “necessary to protect lawful and legitimate news-gathering activities,” meaning that a citizen journalist doing true reporting could be covered.   Historical Setbacks The main legal barrier to a federal shield law is the Supreme Court Case Branzenburg v. Hayes. The court was deeply divided, siding 5-4 against the journalists claim that the press clause in the First Amendment constituted a privilege similar to that of a doctor’s, spouse’s, religious overseer’s, or lawyer’s protecting them from testifying before a grand jury. The court held that the burden to report the news doesn’t outweigh the public’s need for a law enforcement system and the absence of such a privilege had not held back the press from flourishing since America was birthed. While the case has been a set back for journalists since 1972, there were bright spots in the decisions. Justice Byron White, writing for the majority, wrote that though the court declined to recognize a privilege for journalists, it did see the importance of a free press and that the government should have to show “a substantial relation between the information sought and a subject of overriding and compelling state interest.” Justice Lewis Powell concurred, writing “The asserted claim to privilege should be judged on its facts by the striking of a proper balance between freedom of the press and the obligation of all citizens to give relevant testimony with respect to criminal conduct. The balance of these vital constitutional and societal interests on a case-by-case basis accords with the tried and traditional way of adjudicating such questions.”   Is A Shield Law a Good Idea? Despite the obvious need for some type of protection for journalists to protect their sources, there are concerns with the actuality of a federal shield law. Is it a good idea for the government to define a journalist? Many think this may lead to licensing for journalists, which is an enormous hindrance on free speech and a form of censorship, and thusly unconstitutional. Syracuse University Professor Roy Gutterman—an expert on communications law and the First Amendment, as well as the director for the renowned Tully Center for Free Speech at Syracuse—prefers that the “news gathering function” be defined instead of a “journalist.” Gutterman told Veritas News that “The analogy to licensing is obvious and it’s a long standing concern with shield law, whether it’s federal or state, it gets into this question of who gets to qualify,” so language that asks questions like “do you engage in news gathering and reporting and editing” would be preferable. Another concern is the government overriding any law put in place. As Gutterman pointed out, the Department of Justice already has guidelines for subpoenaing reporters. “They can’t just willy-nilly call up a reporter and ask for information or subpoena them. There is a sort of checklist they have to engage in, but it’s easy to overcome.” It’s certainly easy enough to find a claim for national security or an imminent threat, especially if those claims are considered top secret. In those cases the information doesn’t have to be conveyed in open court, and so a journalist can’t contest the veracity of the claim. The Attorney General Eric Holder even called James Rosen a “flight risk” so that the DOJ didn’t have to notify him that he was being surveilled.   The Future It’s quite possible that, not only will a federal shield law finally be put in place, but that the Supreme Court will soon rule on the matter of a reporter’s privilege. New York Times reporter James Risen faces prison for refusing to testify in the criminal trial of former CIA agent Jeffrey Sterling. Risen wrote in his book, State of War, about a failed operation to sabotage Iran’s nuclear research, and the DOJ thinks Sterling was the source. A three judge panel from the 4th US Circuit Court of Appeals ruled that Risen must testify, but in January he appealed the ruling to the Supreme Court. As the current administration fights tooth and nail to stem its leaky faucet, it’s more important than ever that journalists are protected. The United States contends its position as the world’s policemen because it is a democracy, and citizens are granted personal freedoms. The US condemns other countries, like Egypt, for jailing reporters. So why is this condemnation not reflected on the United States’ legal system? “You talk about making an international statement, it was very hard for the US to condemn other countries where reporters are…harassed, beat, and so on,” Gutterman said to Veritas News. “And now we have the federal government going after reporters who are going after the highest forms of government and it doesn’t look good and isn’t American tradition.” No one disagrees that the government has a difficult job to do protecting state secrets, but maybe it should spend less time fighting reporters and more time acting morally and within the boundaries of the law so that employees don’t feel the need to blow the whistle.
