We first discuss the ⁠alarming rise in cargo theft incidents linked to insider information⁠, a trend highlighted by Tony Pelli of BSI Consulting, with Miami and Los Angeles identified as major hotspots in the U.S.. Criminals are increasingly using methods such as phishing emails, bribing employees, and targeting facilities near logistics hubs to facilitate these thefts. The ⁠Federal Maritime Commission's (FMC) has launched an investigation into Terminal Service Agreements (TSAs) between Port Houston and several major container lines⁠. This probe aims to determine if clauses within these agreements compel carriers, including Maersk and Evergreen Line Joint Service, to route a certain percentage of their loaded containers through Port Houston, potentially disadvantaging competing Gulf ports.  Additionally, BNSF Railway has launched a ⁠new expedited intermodal service connecting Los Angeles to Houston⁠, which significantly cuts transit times by two days. Public defenders working in the federal system representing indigent defendants aren't getting paid. The federal government ran out of money, as my colleague April Baumgarten reported recently. That's a big problem. Every American accused of a crime has a right to counsel, and while you might think that public defenders are just for poor people, they actually represent most people accused of a crime. In North Dakota, the precentage of criminal defendants represented by a public defender is north of 80%. In the federal system, nationwide, it's around 90% Jason Tupman said on this episode of Plain Talk. Tupman is the top federal public defender for the North Dakota and South Dakota district (full disclosure: my sister works as an investigator for Tupman's office). "There will be consequences," he said of this lack of funding. "I think they are not just short-term, either." The federal employees in Tupman's offices cover about 2/3's of the cases in North and South Dakota, with the rest going to private sector attorneys who participate in what's called the Criminal Justice Act Panel. Right now, those panel lawyers won't be getting a check until October 1, though given the chaos in Washington D.C. right now, there's not a lot that's certain. Tupman, and Mark Friese, a prominent defense attorney from the Vogel Law Firm who is a representative on the CJA Panel, say that lawyers are beginning to turn down these cases. That means delays in the criminal justice process for defendants, which in turn means more costs associated with things like pre-trial detention. Also, it may also mean that they're assigned by lawyers from other areas, who may struggle to provide adequate counsel, which in turn may result in more appeals and procedural delays. We are currently having a rollicking debate about the federal debt and deficits, but delays or cuts in funding for federal public defenders could actually end up costing the taxpayers more. Tupman points out that the work of his office isn't political. "This office and this panel has represented George Floyd protesters and they have represented January 6 defendants," he said. "This is a non-political group...who represent individuals, treat them with dignity, and do so every day pretty quietly. To not pay them for the work they've already done can be crippling. Crippling to them and crippling to our future functioning." Friese, meanwhile, pointed out that even when the feds are paying the bills, they're far below what private sector attorneys can otherwise earn. "A lot of your listeners are going to say, $175 an hour, that's crazy," he said referring to the rate at which panel attorneys are compensated. "That's less than half the market rate. That's less than half the prevailing rate if you were to come to me in my private practice to hire me for representation." "When I take my car in the mechanic shop, the prevailing rate in in North Dakota is 150 bucks an hour," he continued. "So, we're paid $25 more an hour than a mechanic shop, essentially." Meanwhile, a right-wing Cuban exile group operating independently of the Kennedys was looking to assassinate JFK, which they believed would be a catalyst to compel the United States to invade Cuba with its military in retaliation. The plan could have worked because of Lee Harvey Oswald. He was a Marxist and Castro supporter who had defected to the Soviet Union in 1959, had renounced his citizenship, and had revealed military secrets to the Russians. He allegedly tried to shoot right-wing General Edwin Walker, was a member of the pro-Castro Fair Play for Cuba Committee, and in the summer of 1963, he was arrested in New Orleans for handing out pro-Castro literature in public. He traveled to Mexico City and tried to reach Havana two months before the JFK assassination. He wrote a letter to the Russian Embassy in Washington D.C. upon his return, saying he used an alias while he was in Mexico. He was measured as 5'-9" tall during his autopsy, which was two inches shorter than when he left the Marines four years before. All this made him the perfect patsy to be used to justify a second invasion of Cuba. So, why didn't the United States invade Cuba after the JFK assassination when they had the opportunity to do so once and for all? The answer to that question is West Berlin, the gateway to Western Europe and a city President Kennedy was determined to protect at all costs, even if it meant sacrificing Cuba to the Communists. And a second invasion of Cuba placed Berlin in jeopardy, so it could not be allowed to happen. Another group came together in the spring of 1963, made up of CIA right-wing Cold War veterans like Allen Dulles, James Angleton, Henry Hecksher, William Harvey, and Tracy Barnes. These men had fought the Nazis during World War but came to consider them the lesser of two evils compared to the Soviet Union when the war was over. And they were hell-bent on keeping communism out of Europe by any means possible. For over a decade leading up to JFK's Presidency, they had collaborated with ex-Nazis, European Monarchists, and French military Fascists in the war against communism to keep Europe safe. So, it was not surprising that they all came together once again to assassinate President Kennedy – not to justify an invasion of Cuba but to prevent that from occurring. They knew that if a second invasion of Cuba were to happen, the Soviets would take West Berlin, which would almost certainly have led to World War III. So, as a Last Resort Beyond Last Resort, this group inevitably concluded that the only choice they had was to remove JFK from power before it was too late. Martha was on the phone to talk about her husband's arrest by the FBI in 2020, which she is still fighting in Washington D.C. this week. (22:33)  Pigs were a surprise guest at the company picnic last week, but things took a dark turn when they started biting employees. Ruth got it the worst, after the biggest pig nearly took off the tip of her finger. (39:45) Two baseball coaches lost their jobs for stripping and streaking on the field in front of children.
