Wie ergeht es Menschen, die Opfer einer Straftat geworden sind? Wie kann man sie unterstützen, wenn sie vor Gericht ihrem Peiniger begegnen müssen? Und was half der jungen Frau, die 2021 am Mainufer in Mainaschaff (Kreis Aschaffenburg) vergewaltigt wurde, nach der Tat? Diesen Fragen gehen wir in dieser Podcast-Folge nach. Dazu haben Podcast-Host Mara Pitz und Blaulichtreporterin Katrin Filthaus mit Wolfgang Schwarz gesprochen. Er war früher Polizist, ist mittlerweile in der Opferhilfe tätig und leitet seit elf Jahren den Weißen Ring in Aschaffenburg. Dort kümmern sich rund zehn ehrenamtliche Helferinnen und Helfer um Menschen, die mit den Folgen einer Straftat zu kämpfen haben - viele davon Frauen, die sexualisierte Gewalt erfahren haben. Wolfgang Schwarz spricht darüber, wie der Weiße Ring diese Frauen konkret unterstützt, wie er als Mann damit umgeht und welche Fälle ihm in den vergangenen elf Jahren besonders unter die Haut gegangen sind. Dabei geht es auch um den Fall von Upskirting, über den wir in Folge 11 von Tatort Mainviereck gesprochen haben (mehr dazu lest ihr hier). Außerdem kommt die junge Frau zu Wort, die im Alter von 18 Jahren am Main von einem Fremden überfallen und vergewaltigt wurde. Gina Martin is best known as the driving force behind the Voyeurism Act, which made upskirting, or the taking of pictures under a person's clothing without permission, a criminal offence in England and Wales, after she was assaulted at a music festival. The gender equality activist is now working to teach people how to challenge problematic statements such as ‘boys will be boys' and ‘not all men', and have constructive conversations on social justice issues. Today on Ways to Change the World, Gina Martin tells Krishnan Guru-Murthy about the lessons she has learnt since changing the law on upskirting, the importance of trans voices, the online abuse she has received and why the conversation around masculinity needs to change. Upskirting, as defined by the UK government, is a highly intrusive practice which typically involves someone taking a picture under another person's clothing without their knowledge, with the intention of viewing their genitals or buttocks (with or without underwear). Shockingly, it wasn't a specific criminal offence until 2019 – but had been in Scotland for over 10 years. On the podcast this week, we talk to the woman responsible for introducing the 2019 Voyeurism Act, Gina Martin.Gina, charged by what happened at British Summertime, aimed to change the law around voyeurism, starting and spearheading a social media movement that grew rapidly. Gina's campaign eventually resulted in a petition that amassed over 110,000 signatures, and after an 18-month battle to illegalise upskirting, she finally won The Voyeurism (Offences) Act, commonly known as the Upskirting Bill. Three other countries have since followed suit. In 2020, alongside Black plus size model Nyome Nicholas Williams and photographer Alex Cameron, Gina helped change Instagram's Nudity policy, which previously censored larger Black women's bodies. Gina's first book Be The Change, is a practical guide for activists starting out. Gegen diese Diskriminierung im Abstammungsrecht klagt ein lesbisches Ehepaar. Das heimliche Fotografieren unter den Rock oder in den Ausschnitt ist künftig eine Straftat. Für "Upskirting" sieht ein neues Gesetz bis zu zwei Jahren Haft vor. Mit diesem Erfolg habe sie nicht gerechnet, sagt Petitionsinitiatorin Ida Marie Sassenberger.

Upskirting, das Fotografieren unter den Rock, soll unter Strafe gestellt werden. Damit wird das Phänomen unbefugter Bildaufnahmen, wie sie beispielsweise auch im vergangenen Jahr bei den Festivals Fusion und Monis Rache angefertigt wurden, strafgesetzlich angegangen. In der zweiten Folge von „Justitias Töchter – Der Podcast zu feministischer Rechtspolitik“ sprechen die beiden Moderatorinnen Selma Gather und Dana Valentiner mit Dr. Leonie Steinl, LL.M., über die aktuellen Gesetzesentwürfe. Sexuelle Belästigung - leider gibt es auch immer wieder Fälle an unserer Uni. Letztes Semester wurde Nele, eine Studentin der UDE, Opfer von Upskirting - und das mitten in einer Vorlesung. Upskirting beschreibt das ungewollte Fotografieren oder Filmen unter den Rock einer Frau. Obwohl es ein schwerer Eingriff in die Privatsphäre der Betroffenen ist, steht Upskirting aktuell nicht im Strafgesetzbuch und ist somit keine Straftat. Am 30. Mai hat sich unsere Redakteurin Catha mit Nele getroffen und mit ihr über den Vorfall gesprochen. Das Gespräch und die Erzählungen lassen einen nicht nur erschrecken, sondern machen auch fassungslos, dass Upskirting keine Straftat ist.

Gina Martin is an activist, campaigner, author, and law-changer. In the summer of 2017, Martin was at a music festival when she was upskirted by a man in the crowd. The term upskirting refers to the violating act of taking photos or videos under a person's clothes without consent in an effort to capture a person's crotch area, underwear, and genitals. When Martin reported what happened to the police, she was told there wasn't much they could do. What she later learned was that upskirting was not a criminal offence in England and Wales. Martin launched a campaign called #StopSkirtingTheIssue, initially setting out to raise awareness of the prevalence of upskirting, but after two years of hard work, determination, and lobbying the government, Martin successfully changed the law in England and Wales.Martin made upskirting illegal, and under the new legislation those convicted of the crime face up to two years in prison. In the year since the law change, four men have been jailed and 16 men have been convicted of the crime, according to figures from the Crown Prosecution Service. In this episode of History Becomes Her, Martin speaks to host Rachel Thompson about how she brought about tangible change through activism, as well as the challenges and hurdles she faced in her campaign. Das geht aus einer Eurobarometer-Sonderumfrage der EU-Kommission hervor.Für Deutschland sind die Werte meist noch höher. Hierzulande geben 71 Prozent an, ihr Verhalten aufgrund des Klimawandels bereits angepasst zu haben. Unter anderem nutzen 56 Prozent regelmäßig umweltfreundliche Alternativen zum eigenen Auto. Hat Volkswagen auch in den Dieselmotor mit der Bezeichnung EA288 mit der Abgasnorm Euro 6 eine Abschaltvorrichtung eingebaut? Der Südwestrundfunk hat darüber mit dem Hinweis auf interne Unterlagen von Volkswagen berichtet. Demnach werde eine Software mit dieser Funktion in den technischen VW-Dokumenten, die dem SWR vorliegen, beschrieben. Der Konzern bestreitet das vehement. Auch wolle sie die Gesetzeslage ändern, nach der bislang zwar an Unfallorten das Fotografieren von Verletzten, nicht aber das von toten Menschen verboten sei. Diese Lücke müsse geschlossen werden. Als Data Residency bezeichnet der Team-Kommunikationsdienst Slack eine neue Funktion, mit der Unternehmen ihre bei dem Anbieter gespeicherten Daten in einem von ihnen gewählten Land oder einer von ihnen gewählten Region hinterlegen können. Gina is a writer and campaigner who is working to have ‘Upskirting’, the practise of taking pictures up a person’s skirt without their consent, made a sexual offence.Gina picks fashion designer Mary Quant, the subject of a forthcoming V&A Exhibition, as her inspirational woman from history. Period: 1950s, 1960s to the present day.Mary Quant: “I created clothes that worked and moved and allowed people to run, to jump, to leap, to retain their precious freedom."Gina tells us how the moment she was waiting to watch her favourite band at a festival became a life-changing incident, when some men began to harass her and photograph her underwear up her skirt. She explains how the scuffle escalated into a scene, the police became involved but the case was ultimately closed.Gina explains how she felt let down by the authorities when she discovered that the law was not on her side. When she shared a picture of the perpetrators on Facebook she was accused of harassment. She used her anger to drive her campaign for change.Gina talks about the media circus, finding herself pitted against caricatures on TV, and tackling online abuse and victim-blaming. She had to become an early bird to juggle a full-time job in advertising with her campaign work and discovered just how resilient she could be.She explains how a community of supporters have grown out of her work, and the moment she realised she had the power and drive to change the law as an individual. As an average 9-5er a bit of hard work and research has made her realise how we all have the power to participate in law - our democracy isn’t a matter purely for politicians. This is a message she is keen to share.Gina has picked the designer Mary Quant, often credited for the miniskirt, whose 1960s fashions typified women’s self-expression and liberation through clothing. Gina Martin is a writer and activist in London and currently campaigning to change the law around "upskirting", the act of someone taking a photo up someone's skirt.Gina recently partnered with Refinery 29 UK and created the hashtag #stopskirtingtheissue. In a nutshell, Gina was watching The Killers perform at a music festival last summer, when two guys kept hitting on her and wouldn't take no for an answer. After this happened and after she told the police, she later learned that taking pictures up skirts is not legally classed as a sexual offence under UK law.Taken from Refinery29UK: "Martin threw herself into research and found out that there is no specific legislation against upskirting. Upskirting is already illegal in Scotland after the law was changed by the Sexual Offences (Scotland) Act 2009.
