This Day in Legal History: President Lincoln Offers Amnesty to Confederates On this day in legal history, December 8 marks a significant moment during the American Civil War era. In 1863, President Abraham Lincoln initiated a groundbreaking approach towards reconciliation and reconstruction of the nation torn by civil strife. He issued a Proclamation of Amnesty and Reconstruction, extending an olive branch to those who had participated in the Confederate cause. This proclamation invited all Confederate citizens, except for certain excluded classes, to swear allegiance to the United States and its Constitution, thereby offering them a chance to reintegrate into the Union.However, the initial rollout of this amnesty program encountered logistical and administrative challenges, particularly regarding the process of administering the oath of allegiance. To address these complications, President Lincoln released a subsequent proclamation on March 26, 1864. This second directive expanded the authority to administer the oath, allowing any commissioned officer, whether civil, military, or naval, in the service of the United States to do so. Furthermore, it extended this authority to officials in territories not actively involved in the insurrection, provided they were legally qualified to administer oaths.It's noteworthy that while these proclamations opened the door for many Confederates to rejoin the Union, they explicitly excluded certain groups. These included military prisoners and individuals detained for offenses against the United States. However, an interesting exception was made for Confederate deserters, who were permitted to volunteer for the oath and thus become eligible for amnesty.This dual-proclamation strategy by Lincoln was a pivotal step in the United States' journey towards healing and unification after the Civil War, reflecting a balance between justice and mercy in a period marked by deep national divisions.Seven states, led by Ohio, have filed a lawsuit against the National Collegiate Athletic Association (NCAA) challenging its Transfer Eligibility Rule as anti-competitive. This rule restricts student athletes from competing for a year if they transfer between Division I schools. The lawsuit, filed in the US District Court for the Northern District of West Virginia, alleges that the rule violates Section 1 of the Sherman Act, which prohibits trade restraints. West Virginia Attorney General Patrick Morrisey, one of the participants in the lawsuit, criticizes the rule for its minimal connection to academic or athletic amateurism and argues that it harms both college athletes and consumers.The lawsuit was prompted, in part, by the NCAA's denial of a transfer waiver for athlete RaeQuan Battle, who sought to play basketball for West Virginia University after transferring from Montana State University. This initiative, led by Accenture PLC, involves using AI to identify and remove sensitive data such as social security numbers, addresses, and medical information from minors' case files. This is part of an effort to enhance privacy and efficiency in handling court documents.Los Angeles Superior Court Presiding Judge Samantha Jessner supports the use of AI for good, believing that this tool can improve efficiency in managing similar tasks. Currently, the court employs software akin to Microsoft Word's find-and-replace feature, requiring manual input by court staff.Fordham University School of Law Associate Professor Chinmayi Sharma sees potential in this AI tool to alleviate long wait times and backlogs, particularly in family court proceedings. However, the tool is still in development, and it's uncertain whether the Los Angeles Superior Court will ultimately implement it.The Court Technology Services division plans to manage access to the tool. Clerks will feed documents into the system for redaction, and logged-in users will be able to view the redacted documents. The staff will review these redactions to ensure accuracy.Sharma notes that human oversight is crucial, as the tool's suggestions are subject to final approval by a person. If errors are identified, documents can be taken down, corrected, and republished.Concerns exist regarding potential AI biases, especially since AI models often perform better with data associated with more represented demographics like white people. This highlights the need for careful checks even as AI assists in the redaction process.AI Tool to Redact Minors' Info in Testing for Los Angeles CourtDonald Trump is launching an appeal that could reach the Supreme Court, representing his best chance to avoid a trial next year over criminal charges related to his attempts to overturn the 2020 election. Legal experts suggest that the appeal might not succeed on its merits but could delay the trial, allowing Trump to continue his campaign against President Joe Biden. His lawyers are appealing a ruling by a federal judge in Washington, D.C., which rejected Trump's claim of immunity from prosecution for actions taken while president.The trial is scheduled to begin in March, but this appeal could significantly postpone it. Nintendo is closing the Wii U and 3DS eShops in 2023, with payment methods going away in the middle of 2022. This means that up to 1000 digital only games will no longer be available to legally acquire in any way. Various libraries and museums are commencing preservation efforts, however the Entertainment Software Association, who represents publishers like Nintendo, continually take them to court to stop them from doing so - even though they keep losing horribly. The Society of Composers, Authors and Music Publishers of Canada (“SOCAN”) administers the right to “communicate” musical works on behalf of copyright owners. It filed proposed tariffs for the communication to the public by telecommunication of work in its repertoire through an online music service. However, before the Board considered the proposed tariffs, the Copyright Modernization Act, S.C. 2012, c. 20, amended the Copyright Act, R.S.C. 1985, c. C-42. In particular, it added three “making available” provisions in ss. 2.4(1.1), 15(1.1)(d) and 18(1.1)(a). Section 2.4(1.1) provides that, for the purposes of the Copyright Act, “communication of a work or other subject-matter to the public by telecommunication includes making it available to the public by telecommunication in a way that allows a member of the public to have access to it from a place and at a time individually chosen by that member of the public”. A few days after the Copyright Modernization Act was enacted but before it came into force, Entertainment Software Association v. Society of Composers, Authors and Music Publishers of Canada, 2012 SCC 34 (“ESA”), was released. It held that the transmission of a musical work over the Internet that results in a download of that work is not a communication by telecommunication, so royalties were not available for those downloads. In relation to SOCAN's proposed tariffs, the Board decided to consider the interpretation of the “making available” provisions separately from the tariff. It invited written submissions from anyone with an interest in the interpretation of the “making available” provisions and received submissions from more than 30 organizations. It found that s. 2.4(1.1) of the Copyright Act deems the act of making a work available to the public a “communication to the public” within s. 3(1)(f) of that Act and, thus, an act that triggers a tariff entitlement. The Federal Court of Appeal quashed the Board's decision regarding the meaning of the “making available” provisions. ABOUT OUR GUEST: Geoff Keighley Keighley's foray into video game reporting and presentation had been through Cybermania '94: The Ultimate Games Awards, the first video game awards show broadcast on television. Keighley was fourteen at the time but was brought in to help write lines for the celebrity hosts to read. The show was not considered successful, aimed more for comedy than celebration, but from it, Keighley was inspired to develop some type of equivalent of the Academy Awards for video games in his career. In addition to GTTV, Keighley has been involved in many other video game-related projects on television. On Comcast's G4 network, he appeared as the network's lead anchor for its E3 press conference coverage, interviewing CEOs from companies like Sony and Electronic Arts. For MTV he created the concept and produced (with LivePlanet) "Gears of War: Race to E3" and "Gears of War: Race to Launch", two specials that took viewers inside the development of the hit Xbox 360 game from Microsoft. And in 2007, the Discovery Channel aired a five-hour documentary on releases including those of such companies as World of Wonder Productions, based on a treatment by Keighley, who also served as consulting producer. Geoff has also hosted and co-produced a number of video game launch specials for Spike TV, including "Madden NFL 08 Kickoff" featuring a performance by Ozzy Osbourne and "Halo 3: Launched!" featuring a performance by Linkin Park. He was also interviewed on what became a controversial Fox News' segment on Mass Effect and was later praised by gamers online for being the only one on the show who had actually played the game. Keighley was invited by the producers of Spike's Video Game Awards program to help with the programming from 2006 onward. In 2013, Spike changed the format of the show and rebranded the awards as the VGX Awards. To Keighley, the format became more commercial and promotional rather than a celebration of video game achievements, and subsequently left the show. Through 2014, he funded his own efforts to put together a new awards show, gaining the support of Microsoft, Sony, and Nintendo as well as major publications and industry leaders. Keighley thus established The Game Awards which were first presented in December 2014, and which Keighley remains the primary host. Keighley is known for writing reviews and previews and going behind the scenes of the game industry for in-depth business profiles and lengthy feature pieces. While initially a writer at GameSpot from around 1998, Keighley wrote the site's column "Behind the Games". This column evolved into a series of articles "The Final Hours", where he has in-depth access to the various studios near the end of a development period and write in depth about the process as the game is nearing completion. In more recent years, these articles are released as mobile apps. In a July 2008 interview on The Jace Hall Show, Keighley spoke about the importance of this process, stating "There's such a lack of investigative journalism. I wish I had more time to do more, sort of, investigation. Really dig into some of these bigger issues, so I could look at like, the 'Red Ring of Death' problem. That's never really been properly reported about, like what really happens." However, he has faced criticism from some quarters for his willingness to positively present games to maintain exclusives, regardless of their actual quality, and to accept industry PR at face value in an October 2012 column published in Eurogamer.[12] In December 2016, Keighley was picked as a judge for the Viveport Developer Awards (VDAs). Keighley had been a participant of E3, the annual video game trade show, since its start, and starting in E3 2017, Keighley had arranged and hosted the E3 Coliseum, a live-streaming event running over the course of E3 that brought in developers and publishers at E3 for interviews and other discussions. However, with the Entertainment Software Association making significant changes to the format of E3 2020 (prior to its cancellation due to the COVID-19 pandemic), Keighley stated he will not be organizing an E3 Coliseum event nor attending the show for the first time in 25 years. With E3's cancellation among other several other trade shows and events like Gamescom from the pandemic, Keighley worked with several major publishers and video game industry leaders to launch the Summer Game Fest from May to August 2020. During this period, Keighley will help developers and publishers present game announcements and other presentations, along with Steam and Xbox to provide game demos during this period.

I was surprised to learn that the video game industry earned approximately $160B in 2019. It has out-earned the movie and music industries COMBINED for the last 10 years. It is estimated that there are over 2B gamers worldwide. Most telling, and maybe the most surprising to the uninitiated, women represent almost 50% of the gaming community. (The industry is made up of Publishers, Distributors, Retailers, Hardware Manufacturers, the Gamers themselves, and many other constituencies. And if you weren't sure if the female gaming community was ready to "cross-over", Congresswomen, Alexandria Ocasio-Cortez and Ilhan Omar, played the video game "Among Us" on Twitch. With 12 hours notice, the event drew 440,000 concurrent viewers and represents one of the high-water marks in female gaming so far. Superstars like Pokimane (24yrs old) have gigantic followings (Twitter 2.5mm, IG 5.3mm, YouTube 5.8mm, Twitch 6.6mm). The major talent agencies like CAA, WME and UTA have divisions to represent these people. I wanted to find out more about this phenomenon, so I spoke with REBECCA DIXON one of the Co-Founders and Chief Marketing Officer at TheGAMEHERS. Video gaming is a pastime which keeps growing and growing with no signs that it's ever going to stop. According to the Entertainment Software Association of Canada in a 2018 report, 23 million people in Canada play video games. They say that makes Canada one of the biggest per capita populations of gamers in the world. They also have another surprising figure -- half of those gamers are women. For people not into gaming, that's surprising because the gaming world also has a reputation for being an exclusive club for young men. The 2014 Gamergate controversy happened recently enough that people still remember it. Gamergate was a harassment campaign targeting female game developers, specifically naming feminists as the kind of people they didn't want in gaming. And their contempt extended to anyone who was trying to bring diversity of any kind into the culture. It can be a tough place for anybody who is trying to work with games which counter these values and work towards inclusion, not exclusion. Jean Leggett is a feminist video gamer and game developer from Oakville, Ontario, who actively resists the people she calls "the angry toxic dude bros" by fostering an environment which is accepting of all. In her role as CEO with One More Story Games, she's a frequent speaker at gaming conferences where she talks about gaming and inclusion. She has just received a scholarship from the International Game Developers Association Next Gen Leaders Program. The goal of the scholarship is to bring diversity into the gaming world by supporting participants with personal and professional development opportunities. During that time 3 of the top 10 live streams were showing the game with 14k, 33k, and 53k viewers respectively.c.  Twitch has recently been sued buy a Russian television provider over the streaming of English premier league matches. Online streaming piracy of sports programming seems to be a growing issue.2. Streamer gives roommate the ban hammer https://www.dexerto.com/entertainment/twitch-streamer-kicks-freeloader-roommate-out-of-apartment-on-stream-1313904a. 'tehsyntax' went live on Twitch, with his stream titled "Kicking a freeloader out of my apartment. Not clickbait shes on her way here now from work."b. Shortly after she arrived the streamer told her he would be taking his space back and asked her to leave immediately.c.  He explained he hadn't had a roommate in years and was not a fan of it then.d. As for why he streamed the eviction, he explained in a chat comment, "I let a friend crash at my place for free but she thinks she owns the f**king place. She also locked me out of my own apartment and fed my dog popcorn making him very sick. Wanted to record this for the record so she [doesn't] claim some crazy sh*t but figured [why] not stream it."Twitch has guidelines about privacy, do you feel like because it was his house this violated her privacy?3. The Twitch channel FFTBattleground has set up tournaments of AI bots playing Final Fantasy Tactics against one another that viewers can bet fake Gs on. Similar to other bot-run channels on Twitch, and specifically modeled after SaltyBet where viewers use fake currency to bet on fighting game matches, there are a ton of chat commands you can use to interact with the tournament.b. To start with, you'll have 1000 Gil in your pocket to bet. You'll want to turn that thousand into more by placing bets on a team and earn XP by aligning yourself with a winning group.Gaming News4. On August 2, 2019, independent reporter Sophia Narwitz broke the story that the Entertainment Software Association (ESA), leading trade association of the video game industry, had made publicly available the personal information of more than 2,000 media members that had attended June 2019's Electronic Entertainment Exposition (E3). Despite having waited for the ESA to disable access to the data before publishing, after Ms. Narwitz' posting it quickly became apparent that the ESA had not removed the data and that the same was still accessible to those inclined to search for it by other means. The fallout was immediate and wide-ranging. How did this happen and what was the nature of the leak on the ESA's website? Girls Make VR started by using virtual reality to solve TWO social problems. The first?  The underrepresentation of women in the tech field. And the second: the "divide" among us, in terms of education and future opportunities. Then, along the way, the program took on additional issues, such as poverty and homelessness. Georgia Van Cuylenburg is the Founder and Executive Director of  Los Angeles nonprofit Arts Bridging the Gap.  Arts Bridging the Gap's mission: the creation of top-quality arts programs for underserved youth. And one of those programs is Girls Make VR, for which Robyn Janz is Program Director. Girls Make VR, created in 2016 to educate young women from low-income areas, prepares them to be leaders in the tech field.  The program partners with top companies, including Samsung and the Entertainment Software Association. Since its inception as a workshop during VRLA 2016, Girls Make VR has expanded.  At the time of our interview, their after-school program was just about to wind up for the semester.   Robyn and Georgia had just taken some of their young students to VRLA 2018, for their third VRLA onsite workshop --and counting. And for Fall semester 2018, they're reaching out to other schools, to see where else their classes can get young women working on their future tech skills. During Day Two of VRLA 2018, Robyn and Georgia talked about Girls Make VR, their experiences as innovators and educators, and their goals for the future. Joe Jerome: An overview of GDPR requirements (Ep. 130) Bio  Joseph Jerome (@joejerome) is a Policy Counsel on CDT's Privacy & Data Project. His work focuses on the legal and ethical questions posed by smart technologies and big data, and he is interested in developing transparency and accountability mechanisms and procedures around novel uses of data. Prior to joining CDT, Joe was an associate in the cybersecurity and privacy practice of a major law firm. His practice focused on advertising technologies and privacy compliance in the health and financial sectors. Additionally, he worked on a wide range of consumer privacy issues at the Future of Privacy Forum and has written articles about data ethics, trust in the online gig economy, and emerging technologies in video games. This is despite reports last week of Russia's deepening efforts to interfere with American politics. For example, the House Committee on Science, Space and Technology released a report saying that between 2015 and 2017, accounts on social media that were linked to Russian propagandists, tried to influence policies that would undermine U.S. efforts to sell natural gas in Europe where Russia has considerable market share. Also, Reddit reported that thousands shared Russian propaganda on its site, prompting demands for more answers from the Senate Intelligence Committee, which is also investigating Tumblr. Special Counsel Robert Mueller is also said to be pursuing a case against Russians who conducted cyberattacks against Democrats during the 2016 election. These charges would be in addition to the ones Mueller has already brought against Russians accused of spreading propaganda on social media, according to NBC News' Ken Dilanian.   But despite the absence of specific directives from the White House to U.S. Cyber Command, Director of National Intelligence Dan Coats claimed before the Senate Armed Services Committee on Tuesday that the White House is taking a “whole government approach” under which the president has tasked the 17 agencies Mr. Coats oversees with addressing the Russian cyber threat.   John Bowden at the Hill reported that Russians also collected Americans' personal data from social media platforms during the 2016 campaign.   On Monday top Democrats including Chuck Schumer, Nancy Pelosi, and Dianne Feinstein wrote a letter to President Trump urging him to extradite the 13 Russian nationals FBI Special Counsel Robert Mueller indicted last month for allegedly using social media to interfere with the 2016 presidential election. Russian President Vladimir Putin has stated that the extradition would never happen. Ninth Circuit will hear consolidated net neutrality appeal The Ninth Circuit Court of Appeals, which is based in San Francisco, will hear the multidistrict litigation initiated by 22 state attorneys general to appeal the Federal Communications Commission's decision to repeal the Obama-era net neutrality rules. The U.S. Judicial Panel on Multidistrict litigation chose the Ninth circuit at random. Trump blocks Broadcom acquisition of Qualcomm President Trump has blocked Singapore tech giant Broadcom's acquisition of Qualcomm, citing national security concerns. At $117 billion, the merger of the two chipmakers would have been the biggest tech deal in history. The Verge reports that Broadcom is in the process of moving its headquarters to the U.S. by April 3rd.   Twitter cracks down on ‘Tweetdeckers Twitter purged several accounts for “tweetdecking”, a violation of Twitter's spam policy in which users mass tweet each other's tweets using platforms like Tweetdeck. Some of the accounts that were suspended had millions of followers. A new MIT study also released last week found that fake news travels some 6 times faster on Twitter than the truth. White House holds video game violence meeting  Harper Neidig at the Hill reported on the White House's meeting with video game industry representatives. The president convened the behind-closed-doors meeting to discuss the role of video games in promoting mass shootings. In attendance were representatives from the Parents Television Council, Entertainment Software Association, as well as executives from game makers Rockstar and ZeniMax. The Verge reported that the meeting was largely unproductive and Activision announced the release of its latest ‘Call of Duty' installment on the same day the White House meeting took place. FBI paid Geek Squad employees to inform on Child Pornography Laurel Wamsley at NPR reported that the FBI paid informants at Best Buy's computer repair service unit Geek Squad to flag child pornography found on their customers' computers.The Electronic Frontier Foundation sued the FBI last year about these searches and the new documents illustrate more about the nature of the relationship between the FBI and Geek Squad. FBI Agent Tracey Riley testified in a Jefferson County Kentucky Circuit Court last week confirming that that FBI agents paid Geek Squad workers in a Best Buy store in Kentucky when they found child pornography.  FCC Proposes $1 billion for Caribbean hurricane recovery efforts FCC Chairman Ajit Pai proposed over $1 billion in funding to aid in the recovery of communications networks in Puerto Rico and the Virgin Islands. Sixty-four million would go immediately towards restoring networks. The rest, or $954 million, would go towards longer-term projects to enhance broadband networks in the Caribbean. Congressional Black Caucus pushes tech on lobbying diversity The Congressional Black Caucus wrote a letter to the Internet Association, CTIA, NCTA and US Telecom urging them to hire and retain more black lobbyists given African-Americans' widespread use of mobile devices. White House joins push for internet sales tax The White House is joining in states' push for the Supreme Court to overturn a 1992 precedent, Quill Corp. v. North Dakota, that held that many online retailers don't have to add sales tax to the prices their customers pay. Thirty-five states support overturning the decision. Online retailers who oppose doing so claim that it would be too onerous to collect taxes from fifty different states. Jess Bravin reports for the Wall Street Journal. Number of Americans affected by Equifax breach keeps growing Equifax's interim Chief Executive Paulino do Rego Barros Jr. announced on Thursday that an additional 2.4 million consumers were affected by their massive data breach last year. It brings the total up to 147.9 million. Brian Fung reports in the Washington Post. House reauthorizes the FCC The House voted to reauthorize the Federal Communications Commission with legislation that seeks to develop 5G networks and invest funds for the spectrum incentive auction. If the bill passes Congress, it will be the first time since 1990 that Congress has reauthorized the Commission. Harper Neidig reports in the Hill. Amazon offering 54 percent discount to Medicaid recipients Amazon announced last week that, for Medicaid recipients only, it would cut the monthly Prime subscription down to $5.99 per month. This is $7.00 less than the standard $12.99 fee. The move is seen as an effort by Amazon to attract Walmart customers. MIT study finds Uber & Lyft drivers earn less than minimum wage A new MIT study found that Uber and Lyft drivers earn less on average that minimum wage workers. The report found a median profit of $3.37 per hour before taxes. Ashley May has the report in USA Today.
