Business Building vs. Job Creation - Successful recruitment business owners understand the difference between creating a business and creating a job for themselves. Julie believes these key factors can help business owners achieve high performance, build sustainable businesses, and effectively navigate industry challenges. Leveraging AI to Enhance Your Recruitment Business During our Live Summit in Edinburgh last year, Julie delivered a fascinating session on leveraging AI to improve recruitment businesses. ChatGPT was pretty new at that time, and she was able to provide an amazing take on why the recruitment community needs to embrace AI. Understanding your clients - what they look for and what they want to consume will enable you to make data-driven decisions. Based on these data and insights, you are creating content for a specific person, nation, and target audience, instead of creating content for ‘everybody. The two major areas to focus on for fitness in midlife: Exercise Every hour outside of Exercise In the exercise itself: Type of exercise and time it's done Length of the exercise Intensity of the exercise Sequence of exercises Frequency of exercise Rest between exercise Purpose of every exercise and every session …. Each of these has to be related to endocrine status, musculoskeletal status and conditions or injury history. Outside of exercise: Nutrition contributing to the preparation Nutrition contributing to recovery Hydration (for the same) Course correcting to optimize effects of exercise on system (a body under stress can't exercise hard and get results and eventually more intense exercise will be a part of muscle and bone success) Sleep Stress So there's a little to unpack during this episode. In fact, that would be an overwhelming amount of information for an episode. That in fact is more like a course (like the Flipping 50 Menopause Specialist Course). Failure to Report, Acknowledge and Make Claim to Your Client's Insurer is Legal Malpractice David Quaknine and several of his companies sued their former attorney and his law firm for alleged malpractice connected to a 2014 suit. The district court granted the defendants' motion to dismiss. It ruled that the two-year limitations period, which at the latest began to run in September 2019, expired before the plaintiffs sued in December 2021. In Concepts Design Furniture, Inc., et al. v. Fisherbroyles, LLP and Alastair J. Warr, No. 22-2303, United States Court of Appeals, Seventh Circuit (March 31, 2023) the Seventh Circuit resolved the dispute. FACTS The parties called Comptoir, which did business from Quebec, Canada, were sued for intellectual-property infringement in 2014. Over a year later, Comptoir hired Alastair Warr and his law firm to negotiate a settlement or, failing that, represent Comptoir in court. Comptoir told Warr that it had a policy with Intact Insurance Company that potentially could cover defense costs and indemnify it for claims. Warr did not advise Comptoir to submit a claim to Intact nor did it do so on its own. The lawsuit did not go well and the disclosures in the suit stated that Comptoir had "no insurance agreement." A jury eventually found against Comptoir with a judgment over three million dollars in damages. In February 2018, Comptoir-through other counsel-told Intact about the attorney's fees. The notice, four years after the suit, was the first time Intact learned of the intellectual-property suit. Comptoir reorganized after the adverse judgment. The bankruptcy court declared Comptoir bankrupt and discharged the judgment debt from the 2014 litigation. Intact denied coverage on September 10, 2019. When it demanded coverage, Comptoir sent to Intact (apparently for the first time) a copy of the complaint in the 2014 suit. In denying Comptoir's demand in September 2019, Intact gave three reasons: the suit against Comptoir was not covered under the policy. because Comptoir "failed to promptly notify Intact of the [2014] Complaint and to immediately upon receipt thereof, deliver to Intact a copy of the Complaint," it violated the policy and forfeited its right to and was "time barred" from reimbursement. Comptoir listed its defense fees "as amounts due to creditors," which implied that only the bankruptcy trustee could collect them. Intact sued seeking a declaration in Cook County Circuit Court that it was not obligated to pay defense fees or indemnify Comptoir. Comptoir made its defense-fees claim outside the three-year statute of limitations applicable under Quebec law. Thus, Comptoir's complaint and subsequent demand for reimbursement of fees was time barred. On December 17, 2021, refusing to admit is errors and failure to promptly act, Comptoir sued Warr and FisherBroyles for legal malpractice. The district court granted Warr and FisherBroyles's motion to dismiss the suit as untimely under Illinois law. Once a malpractice plaintiff is aware of injury the plaintiff is not required to wait for a court's judgment certifying that the plaintiff's attorneys erred. How to Rebrand and Get More Attention for Your Brand In 12 years, Lyn's agency has helped over 100 non-profits with their brand messaging and strategy. In some cases, this entails tightening up their tagline and message, while in others it goes all the way to their logo and name. Overall, non-profits with great branding tend to do better, get more recognition, and are generally easier to find. When it comes to rebranding your business, Lyn reminds clients that no one will ever create something that is universally loved. “It's better to be the pistachio-flavored ice cream than the vanilla ice cream that no one loves”. You can accomplish more with something a small percentage likes than something 100% of people are willing to ignore. Where to Start When Doing a Rebrand for Your Client or Your Agency Since they work with non-profits, Lyn and her team knew their process needs to be focused and affordable. They start with a discovery session with key leaders of the non-profit. There, they talk about what makes their brand and where they see themselves in the future. This is followed by an online survey and a competitive review. Finally, they do a brand archetype profile and create a brand strategy and positioning statement. Next they strategize the launch plan including who they need to talk to and how. To this end, they help clients plan meetings, presentations, and parties to present this new identity to their employees, the board, top donors, partners, and finally the public. They also help with their website and anything else to ensure their name and new image are well received. Because the process of rebranding many times includes a new name for the organization, Lyn warns clients they will get comments about how it was unnecessary to do this. People are usually comfortable with the familiar and react negatively to change. However, changes to their client's image and branding are done as the result of a lot of studies. It's all about thinking outside of the box and garnering attention. How Purpose and Implied Bias Play a Role in Branding Data shows that >70% of people nowadays want to align with brands making a positive impact in the world. This percentage is even higher when it comes to younger generations who want to work with brands that make a difference. Lyn's agency has always had a strong focus on non-profit. With these new trends, they're getting more and more companies come to them to create purpose-driven messaging and social impact campaigns. Part of the challenge creating a campaign is identifying implicit biases in a message. We all have biases we may not even notice. In these cases, the first step is awareness. It requires willingness to look within and identify some of their own biases as an agency as well as the customers' biases. Often these beliefs are not rooted in bad faith and are just the result of our surroundings. Making an effort to improve this is not just the right thing to do. Data shows how increasing diversity and inclusion in advertising translates to more conversion and sales. It is an excellent way to build trust and relationships with your clients. Opening the Door to Speaking to Different Audiences Seeing the growing interest in purpose-driven marketing, Lyn's team now receives bias training. They also include a questionnaire as part of their onboarding to open the door to bias discussions. As for their internal operations, they have started focusing on what they can do to give back as part of their discovery process. This simple question helps identify potential causes to aligned with. Almost every single member of her team felt they didn't have an implicit bias, which is how people usually feel. Going through the bias training helped them realize we all have biases. Being aware of this helps open the door to positive change. In marketing, we're all taught to zero in on our primary audience and speak mainly to them. Bias training has helped Lyn and her team ask themselves how they can think about the audience differently and ensure they're not just zeroing in on a 1-person audience. Instead, they focus on opening up and accepting that audiences are changing and whoever your buyer persona is today may not be so in the future. Removing Bias and Diversifying Your Team All this talk about biases and implementing diversity into your work with clients is meaningless unless you also make it part of your agency. Diversity in among your team leads to different points of view and often to better work. We all have different learned experiences we bring to every situation. A diverse team will certainly give you different results which is good for your agency. For Lyn, it hasn't been easy to achieve, but it starts with the hiring process. They changed their job descriptions and set new interviewing and hiring policies to help open these doors. For instance, instead of requiring a specific level of experience they now offer a training runway to bring in people without the experience but are otherwise a good fit. Furthermore, they're creating an agency advisory panel with members of different cultural competencies. Taking On Causes That Align With Your Agency Values When you take on a cause, ask yourself is this in line with our agency's values? Do we have something of value to add to the conversation? Will most of our clients be in agreement? Of course, not all clients will be passionate about the same causes. However, if you're attracting clients that are a good fit for your agency, most of them will be supportive of the cause you choose. Three Pillars to Cultural Success Lyn's agency has lost just one employee over the last year. It is quite the accomplishment in the midst of “the great resignation”. It has a lot to do with how she takes care of her agency employees as her primary job. Their "Creative Nirvana Project” is focused on creating the best environment for doing creative and strategic work. The project started with three sessions for her creative team. Session 1: In the zone - is focused on questions like “what does it feel like when things are great and feels like you can't fail?” They then analyze how that situation looks for each employee. Session 2: Bummer - is not as positive but equally important. Here they ask the team to describe what it looks like when things suck. They focus on what makes a situation not great. Session 3, The path - the last session focused on drawing a path asking "how do we get from where we are to where we need to be?" And "what are some quick wins and big things we can do?" It is like such a simple principle, yet it has helped them get great feedback and be on the list of the best places to work in their state. But that's completely up to you and your client - and whatever is going to help them achieve their goals in the most enjoyable way possible. I say this all the time: it's not about YOUR time; it's about YOUR CLIENT'S transformation. A high-ticket coaching offer isn't about number or frequency of calls; it's about helping your clients achieve their goals in the easiest, fastest, and most fun way possible, while providing them with unlimited support. Whatever method of communication you use is up to you and the client. THEIR results - how they feel during the journey and when they finally reach their goal - that's difficult to put a price tag on. I would say my meals are pretty balanced over the day, but I have a smaller breakfast (250-300kcal) due to eating lunch at work at 11.30. I usually train/move some where around 6-8pm and eat a reasonably sized dinner of 500-650 kcal. But due to cooking, getting home, etc., I usually get to eat around 9.30 pm and go to sleep around 11. Hotels, like law firms, make promises to their prospective clients. Those promises aren't always articulated. Often, they're implicit. It wasn't until the first time I checked into a hotel room without a window that it occurred to me that "windows" were optional. Your clients probably have their own beliefs about what's included in their representation, whether or not you say it. One time, Lisa and I walked into a hotel room to find a shit stain on the white comforter. I'm serious--it was shit. I gave it the sniff test. Every hotel needs to hit a threshold of basic acceptability: No bed bugs, blood stains, or horrific smells. Beyond the deal-breakers, each guest has their own list of concerns. For instance, most of us want our hotel rooms to be safe, sanitary and smell nice. Those requirements convince us to put down our luggage and take a look around, but we still don't commit to staying in the room. Before we unpack our bags, we check a few more things. (Personally, I have a list of things I check before I'm willing to settle in.) If the hotel breaks one of those implicit promises, I'll complain. Sometimes I'll tolerate the revised promise. Other times I roll my bag down the block to the next place. Each customer has a slightly different list of secondary priorities, and some willingness to deviate from their list. Everyone has different ideas of what's critical (like those rock stars who demand a certain color M&M in their dressing room). I call my personal list the “Holy Hotel Trinity.” Of course, it's just my list. Yours (and your customers') will be different. The Holy Hotel Trinity The Holy Hotel Trinity reflects my priorities, though I've met lots of other travelers with similar concerns. If the hotel doesn't satisfy my list, I won't necessarily walk right out, but it might cause me to write something nasty on TripAdvisor. Or complain. Repeatedly. Once a hotel fails to meet my expectations, I start to see everything through a filter of disappointment. I'll walk into the breakfast buffet with a more refined palate. I won't tolerate a room service delay. And I'll be far more likely to freak out when the hot tub is perpetually “undergoing maintenance” for my entire stay. These are my Holy Hotel Trinity priorities. 1. Internet We say we go on trips to “disconnect,” but we all know that's bullshit. Even hotels in rural Cambodia offer WiFi. “Here's your complimentary welcome drink, a cool face towel, and the WiFi password,” said the young manager. I bowed in response to his bow. Listen, you give me great WiFi and I'll give you a prayer-hands gesture all day long. I need the Internet as much as I need oxygen and Diet Coke. 2. Air conditioning I'm not happy if the AC doesn't work. (That's also true of the heat, if we've make the mistake of going skiing or something when we could go to a tropical island.) I like my temperature controlled. Like a lot of people, I have romantic notions about opening the balcony door and letting the cool ocean breeze blow through, but I quickly lock that door and turn on the AC. There might be mosquitos or lizards or something out there, so I'm going to crank the temperature down and sleep under the comforter. 3. Hot water “There's nothing like a cold shower on a steamy tropical island,” said no one, ever. It can be boiling outside, but I still want my shower to be nice and warm. Cold water is a shock to my system, and I want a shock to my system from the shower about as much as I want it from the loose wire poking out of the electrical outlet: not at all. I've learned the hard way to let the water run for a minute or two to see if it gets hot before I unpack. These three items are my essential list. These are the things I care about beyond the apparent deal-breakers. I'm a little picky, but not very picky. I don't need a Nespresso machine, or slippers, or a view of the river. I'll survive without chocolate on my pillow, turndown service, or an overnight shoe shining service. But I really need WiFi, AC, and hot water with decent pressure. Call me a princess if you like. I am what I am. Your Clients Have a List, Too Your clients have priorities too. Their list comes in the same format. They've got some instant deal-breakers (like bed bugs, blood stains, and horrible smells) and they've got some other priorities that vary from client to client. Your mission, whether you like it or not, is to understand what they're thinking. For a moment, let's speculate about what might be on their list. Every practice is different, so I won't get this exactly right for yours. It's not important whether I get it right for your practice, though. What's important is that you get it right for your practice. You need to know what your customers think, what matters to them, and why. Understanding the story they tell themselves will help you figure out how to help them. Otherwise they will just get triggered and become someone else's client. How about this list of instant turnoffs? Does it resonate for the people who visit your office? 1. Law license Most clients want to be sure you're licensed as a lawyer. Many lawyers hang their licenses right behind their desk because it gives their clients comfort. Personally, I never hung my license in my office. It wasn't required and I wanted to use the space for art. But it's essential in some practice settings. Know your clients and know what matters to them. Hang that ugly certificate right behind your head if they need to see it. 2. Normal office Those same clients might never get to see your license if they refuse to get out of their car. I've met clients who drove through the parking lot without even slowing down. They were so distressed by the exterior of the office, they changed their minds without entering. A while back, this one lawyer asked me to come see his office. He was excited about being in the hip warehouse district. I went, but it wasn't hip. It was creepy. The street seemed abandoned, the entrance wasn't obvious, and there was no pedestrian or vehicle traffic. I wondered if my car would be safe. Hopefully his clients are hipper, cooler and less anxious than me. 3. Respect "Do you know who I am?" is an existential human question. That's true even when we're nobody (yeah, I know, every human has value, but you know what I mean). Disrespect cuts right to our core. It makes your clients hate you. When you take too long to return their call, and they have to keep trying to get your attention, they feel like they don't matter. When you can't get them on your calendar for two weeks, they feel unimportant. When you tell them they can't afford your fee, they feel small and impotent. It's downright disrespectful. It's possible that a law license, a normal office, and respect are the bed bugs, blood stains, and horrific smells of your practice. Are these the deal-breakers? Are these the priorities that turn people away before they settle into that chair across from your desk? Now, your clients may focus on other issues. Maybe they care about your appearance, reviews from former clients, or your handshake grip. It's your job to figure out what they care about. The Three Cs Once your client gets past the “deal-breakers,” they'll have some additional concerns. The following are pure speculation, but I bet they apply to your clients as well. How do you figure out what matters to them? Ask them! They're dying to tell you. Here's my speculative list: 1. Confidentiality Your clients' problems matter greatly to them. They'd like to believe you hold their secrets in confidence, but it's easy to undermine that belief. A receptionist repeating the names of other clients aloud can shake the confidence of the people in the waiting room. File folders scattered about with names visible can make them worry. Stories you tell to illustrate a point can go over the line and make clients wonder if their misfortune will be the new story you tell. Many of our clients are afraid their mother, their boss, or their spouse will find out what happened. Your casualness about their matter, or about the required secrecy and privacy, will rattle some people as much as a cold shower rattles me. 2. Caring and concern A phrase like “This is no big deal” is often calculated to calm your client, but they might hear it differently. Their problem is a very big deal to them. Whether it's a new will, a real estate closing, the sale of their business, or anything else, it's a big part of their life. You can even send the same “no big deal” message without actually saying it. When you meet a client and exhibit disinterest (stepping out to take a call, letting your staff interrupt, glancing at your phone, slouching in your chair, interrupting the client, or even just failing to verbally express concern), you signal that their problem isn't important. It's the little things that signal caring and engagement: kindness, compassion, small favors, and listening respectfully. Clients appreciate when the receptionist expects them. They feel welcomed when you greet them personally in the lobby. They feel cared for when the paralegal helps them carry document boxes to their car, when you call to check in, and when you give them your mobile number for emergencies. That's caring and concern. 3. Calls In theory, clients understand that you're busy. They appreciate that you can't return every call immediately. You may have set expectations about returning calls during your initial consultation, but they didn't think that applied to them. That call-return policy is for other clients. No client feels good about waiting for a return call. When you are slow to return their calls, you are creating bigger problems. At the root of nearly every poor relationship with a client is a failure to communicate adequately. You might think they're upset about the outcome of their matter or some other development. But most of the time you can trace an upset client back to a lack of communication. Regular communication can turn bad results into a good engagement. Poor communication can turn a good result into a bad engagement. The primary reason clients refer business to you, write positive reviews about you, and pay your invoices on time is communication. What's on Your Client's List? Obviously, my speculation about your clients' concerns won't hit the mark in every instance, but you can easily identify what they care about. You listen to these folks all day long. You spend hours in conferences listening to them ramble. You can identify their priorities if you listen (often they have little to do with the matter at hand). They all have certain promises--explicit or implied--they expect you to fulfill. Once you fully appreciate their perspective, you can address their concerns. You may find yourself killing bed bugs, cleaning up blood stains, and eliminating horrible smells, but I bet you've got those deal-breakers under control. The additional concerns, however, are worth your energy to uncover. You'll have to dig down and find out if your clients are concerned with The Three C's or if they care about something else. Spend some time standing in their shoes, thinking the way they think, and ascertaining their priorities. Lots of hotels get through the day without exposing guests to shit stains, but many fail to provide WiFi, good air conditioning, and hot water. It's tough for hotels to stay on top of everything. It's tough for you too. It all starts with identifying what your clients care about Once you figure out which “promises” they assume are part of the deal, you can focus on creating a positive experience.
