Unprecedented changes are imminent in sanctions and export control enforcement, as the U.S. government amplifies its focus on national security and corporate compliance. On this episode of Corruption, Crime and Compliance, Michael Volkov discusses the potential consequences of these developments. He dissects the “new FCPA”, the Department of Justice's (DOJ) strategic approach, the critical role of sanctions and export control enforcement, and the intricacies of voluntary disclosure programs.You'll hear Michael talk about:A significant shift is occurring in the DOJ's enforcement focus, with 75% of criminal cases against corporations now related to national security matters, including sanctions enforcement, money laundering, and terrorism.The DOJ will collaborate with OFAC and BIS in a similar manner to the relationship between the DOJ and the SEC during FCPA enforcement.Corporate resolutions are set to increase drastically, with steep penalties, deferred prosecution agreements, guilty pleas, and a surge in individual prosecutions. Heightened compliance expectations around export controls and sanctions compliance will necessitate a ramp-up of relevant compliance programs.The enforcement actions will serve as guidance, similar to the initial stages of FCPA enforcement, providing cues about the DOJ's view on compliance and their expectations from compliance programs.The DOJ plans to ramp up enforcement against global banks, investing heavily in the Bank Integrity Unit which is part of the anti money laundering operations for global banks, and sanctions enforcement.The DOJ has forewarned corporations about the enforcement emphasis on sanctions and export controls. DOJ has ongoing investigations in various sectors including transportation, fintech, banking, defense, and agriculture.Voluntary disclosure programs, such as those from OFAC and the National Security Division, play a significant role in mitigating enforcement actions. However, choosing between OFAC and DOJ disclosure can present a nuanced dilemma for corporations, hinging on whether a violation is willful. The number of voluntary disclosures involving both is expected to increase as corporate enforcement actions rise.The case against British American Tobacco by DOJ and OFAC for illegal sales of cigarettes to North Korea, resulted in a combined penalty of $629M. This is a significant instance of enforcement action against a non-financial institution.The Bureau of Industry and Security (BIS) and the Department of Commerce brought a case against Seagate Technology, resulting in a $300 million settlement. The DOJ seems to be investigating this matter further due to Seagate's blatant violations.A case against Murad, a cosmetics company, was brought by OFAC for Iran sanctions violations worth approximately $11 million. Murad ended up paying a $3.3M fine. Murad's actions highlight the importance of sanctions compliance guidance and the significance of due diligence, especially during acquisition processes.OFAC's enforcement action against Murad also emphasized the importance of having a local compliance structure when a foreign parent company is involved. OFAC also stressed on the importance of pre- and post- acquisition due diligence and audits when acquiring companies. The failure to perform such activities may lead to unidentified sanctions issues, as illustrated in the Murad-Unilever case.We may see larger fines against non-financial institutions in the near future, surpassing the current record of $508 million, indicating an uptick in enforcement actions.KEY QUOTE:"OFAC announced a separate civil settlement for $508M, which is the largest fine against a non-financial institution in OFAC's history. Noch besser als der Dow schlugen sich andere große Auswahlindizes wie der marktbreite S&P 500 und der technologielastige Nasdaq 100 . Ersterer legte um 1,63 Prozent auf 3859 Zähler zu und Letzterer stieg noch stärker um 2,1 Prozent auf 11 670 Punkte.Der Leitindex Dax schloss 0,9 Prozent höher bei 13 053 Punkten. Der MDax der mittelgroßen Werte zog um 2,4 Prozent auf 23 807 Punkte an. Der technologielastige Nasdaq 100 sackte auf den niedrigsten Stand seit Mai 2021 ab und büßte letztlich 3,9 Prozent auf 13 010 Punkte ein.Der deutsche Leitindex drehte im Sog der schwachen US-Börsen ins Minus und schloss 1,20 Prozent tiefer bei 13 756 Punkten - es war zudem der dritte Verlusttag in Folge. Für den MDax der mittelgroßen Börsenunternehmen ging es am Ende um 1,7 Prozent auf 29 727 Zähler bergab. Today’s episode features an interview between Matt Trifiro and Victor Bahl, Technical Fellow and Director of Mobility & Networking at Microsoft Research, and one of the fathers of Edge Computing. Across a 23-year career at Microsoft Research, Victor has helped shape Microsoft’s long-term strategy through research, industry partnerships, and associated policy engagement with governments and research institutions around the world. His seminal 2009 paper titled “The Case for VM-based Cloudlets in Mobile Computing” spawned the vision for what we now call Edge. In this interview, Victor shares the story behind the genesis of that paper, and his experience of the evolution of edge in the years since.Key Quotes“You can start to see a convergence of sorts between the communication and computing industry, and edge is the catalyst for that…Some sort of convergence is going to happen and it's going to be good because we are using each other's strengths and building on top of it rather than spending time doing the same thing.”"The question for me as a researcher and a person who tries to think many years ahead was “what happens after cloud?”“If you think about what the cloud is, the cloud effectively sells you compute and storage…and [we thought] wouldn't it be cool if the cloud not only sold storage, it not only sold compute, but it also sold latency...wouldn't it be cool to have an edge where the latency was small.”“The internet works on a protocol called BGP,  and that protocol has not been optimized for latency sensitivity. It has been optimized for cost sensitivity. So as the packets are routed, they are not routed with latency in mind. And then you can think of an API that you put on top of that. And then on top of that, you've got all these applications and then developers can party. So you're looking at a brand new ecosystem that is now seeded because of edge computing.”“The way I like to think about it is “Wow, We're getting there! We've gotten there!” Because now when I talk to people, it’s no longer about trying to convince anybody of the need for edge. It seems like people get it…I no longer have to make the case for it. Chris Hanson, the founder and CEO of Aromyx (aromyx.com), delivers a wealth of information on the complexities of olfactory senses and how technology is providing new ways to digitize taste and smell. Hanson holds a bachelor's and master's from Stanford University and he has over 20 years of experience in sales and marketing for top Fortune 500 companies. He is a proven leader with a track record of success transforming sales numbers for major companies such as Seagate Technology in Russia, IBM, and many Silicon Valley technology startups. He serves on advisory boards and committees for major corporations and was an integral part of the development team behind the military's sensor system that is used to detect deadly IEDs and nerve agents. Through the work with sensors his interest in olfactory sensing progressed, motivating him to launch Aromyx to further advance the digitization of the sense of smell. Hanson discusses in detail the many types of sensory data that can be measured with advancing technology, such as haptic data related to sense of touch, but he states that taste and smell data simply has never been measurable in the past. Hanson's company, Aromyx, has developed a sophisticated system, the first of its kind that enables scent and taste to be captured digitally. Their EssenceChip places olfactory and taste receptors onto a digital readout biochip. Measurable data can be useful for improving quality control and yield improvement for corporations in the food & beverage industry, agriculture industries, consumer packaged goods, and many more, especially when AI can be applied to the data. Aromyx's system essentially removes what was once immeasurable data existing only within the human mind, to an external chip that allows the power of scent and taste to be shared easily. Hanson discusses Aromyx's methods and how they were able to access the DNA from 402 olfactory receptors within the human nose and then clone it into a biosensor. Hanson outlines how their technology provides an opportunity for quality control testers to compare new batches of foods and beverages, etc. against their ideal batch that they have internally rated as being exceptional, thus raising the bar for all their manufacturing. The taste and smell authority expounds upon some of the most intrinsic values of their digital nose, such as the fact that their platform maintains objectivity, whereas human testers often provide skewed, subjective results, not to mention the high cost of human employment. Additionally, seasoned and experienced human testers in quality control departments retire and their internal knowledge that provided for such exceptional batch quality unfortunately retires with them. Aromyx's nose technology never retires and always delivers consistent objective results, over one batch of testing or one million batches. Hanson talks about the deconstruction of smell and taste and how technology is enabling this process. He describes how quality and success are often increased when industries can move from a trial and error method to a computable one, and Aromyx's technology is providing the means for smell and taste-based industries to rise.

Our GuestStephanie Tilenius is the Founder and CEO of Vida Health, a next-generation digital therapeutic and health coaching platform for chronic physical and mental health conditions deployed at Fortune 500 companies, large national payers and providers. Prior to starting Vida, Tilenius was with Kleiner Perkins Canfield & Byers, where she worked primarily with late-stage KPCB portfolio companies, with an emphasis on companies in the Digital Growth Fund. While at Kleiner, Stephanie invested in Nextdoor and MyFitnessPal. Prior to Kleiner, Stephanie was at Google, where she was vice president of global commerce and payments, helping build and launch new products and platforms including Google Wallet, Google Shopping and Google Express. Prior to joining Google, she was at eBay and PayPal for nine years, and in her last role was SVP of eBay.com and global product where she helped lead the eBay Marketplace turnaround. Prior to eBay, Stephanie was VP of Merchant Services at PayPal where she built the off-eBay PayPal business from the ground up into a multi-billion business. A co-founder of PlanetRx.com, she has also worked at Intel, AOL and Firefly. Stephanie sits on the public boards of Coach Inc. and Seagate Technology.Here are the highlights of our conversation with our guest:Stephanie is passionate in making an impact in other people’s lives and doing the things that matter. Everything that she had done in her career had affected millions of people and improved lives and now in Vida, she is focusing on health care and eradicating chronic conditions, which is a real problem in the country.She had worked with eBay, Google and PayPal and her experience in building products and platforms from the ground up and reimagining how things are done during her time with these companies had helped her in her current work in healthcare, which, in some ways, is one of the last industries to adopt consumer-facing technology. Vida is an app service for managing your health. They match you to a coach, a nurse or a health expert, and a digital therapy program, to work in the area that you are most concerned in. They cover both mental and physical conditions and programs focus on concerns such as diabetes, hypertension, weight loss, and smoking. They use machine learning to personalize your programs to help you succeed.Stephanie shares an example of a mobile experience of one of their customers, Jenny, which led to great results. Jenny is a 49-year old, mom of three who lost 80 lbs. in 8 months. She had diabetes, cholesterol and hypertension and found profound benefits from Vida.The new movement today is that health care is being self-care. People are now trying to track their behavior in a more holistic way than they have done in the past and this is very beneficial compared to the traditional way wherein you only get one reading per year during an annual physical exam. Vida is connected to the most popular wearables and anything out there which will enable you to monitor your health. They connect to other apps as well so they can integrate your data into one place for your coach to see. The benefit of this is for your coach to personalize your experience and help you achieve your goals by knowing everything you are doing. This day-to-day insight helps people make the right behavior change and make decisions.Pure execution and scale, just like other companies, are one of Vida’s challenges. Things get more complicated as they scale so they continue to get customer feedback – from onboarding, retention, engagement with their coaches and programs, the use of different features inside the app – and just continue to iterate. They note that they should be mindful of population profiles and their use of the app.Building a two-sided market place is always complicated and one things that has been tough for Vida is balancing the supply and demand. In addition to this, they have to have tools for both their users and coaches so this is twice the work versus other apps.

Dambisa Moyo is a Zambian-born international economist and author who analyzes the macroeconomy and global affairs. She currently serves on the boards of Barclays Bank, the financial services group, Seagate Technology, Chevron Corporation, and Barrick Gold, the global miner. She worked for two years at the World Bank and eight years at Goldman Sachs before becoming an author and international public speaker. She has written three New York Times bestselling books: Dead Aid: Why Aid Is Not Working and How There Is a Better Way for Africa (2009), How the West Was Lost: Fifty Years of Economic Folly – And the Stark Choices that Lie Ahead (2011), and Winner Take All: China's Race for Resources and What It Means for the World (2012).
