In dieser Podcast-Folge geht es in Querbeet (ab Minute 01.08) zunächst um die unendliche Geschichte der Wahl eines Bundesbeauftragten und ein Bußgeld, welches die französische Aufsichtsbehörde CNIL gegen Amazon wegen Verletzung des Beschäftigtendatenschutzes verhängt hat. Danach besprechen Niko Härting und Stefan Brink die ablehnende Entscheidung des rheinland-pfälzischen Datenschutzbeauftragten (ab Minute 07.38), Unterlagen zu Funktion und Entwicklung des Textgenerators ChatGPT herauszugeben. Die Konferenz der Datenschutzbeauftragten der Länder und des Bundes DSK hatte bei OpenAI entsprechende Auskünfte zu ChatGPT eingeholt, allerdings lehnte der LfDI RLP einen darauf zielenden Informationszugangsantrag mit der Begründung ab, die Unterlagen enthielten sämtlichst Betriebs- und Geschäftsgeheimnisse von OpenAI – und dessen Schutzinteresse überwiege das öffentliche Interesse an einem demokratischen Diskurs über den Einsatz von KI. In einer weiteren Entscheidung des OVG Hamburg (3 Bs 146/23 vom 29.11.2023, ab Minute 17:30), ging es um die Pflicht zum Vermerk des Geburtsdatums auf dem Kandidaturbogen für die Wahl zum Studierendenparlament. Hatte das VG Hamburg die Kandidatur noch mangels Angabe des geforderten Geburtsdatums für unwirksam gehalten, verwarf das OVG die Pflicht zur Angabe des Datums unter Hinweis auf den Grundsatz der Datenminimierung in der DS-GVO. Dieser schließe auch verfrühte Datenerhebungen aus. Schließlich werfen Niko und Stefan einen leicht verwunderten Blick auf die Pressemitteilung des BVerwG (zum Verfahren 10 C 3.22 vom 19.12.2023), das die im Jahr 2018 in Kraft getretene Allgemeinen Geschäftsordnung für die Behörden des Freistaates Bayern (AGO) „absegnete“: Nach dieser Vorschrift ist im Eingangsbereich eines jeden Dienstgebäudes als Ausdruck der geschichtlichen und kulturellen Prägung Bayerns gut sichtbar ein Kreuz anzubringen (ab Minute 33:03). Nach dem Kontext und Zweck der Verwendung des Kreuzessymbols identifiziere sich der Freistaat Bayern durch die Aufhängung von Kreuzen keineswegs mit christlichen Glaubenssätzen. Seine Anbringung im Eingangsbereich von Behörden stehe der Offenheit des Staates gegenüber anderen Bekenntnissen und Weltanschauungen nicht im Weg. Aha – warten wir mal auf die Eingebungen, welche uns in den schriftlichen Urteilsgründen präsentiert werden.

“De grootste bedreiging voor de bouw is dat we te pessimistisch worden.” Dat zegt Karin Laglas, commissaris bij TBI Holdings, in de nieuwste aflevering van de podcast Doorzagen. Laglas kent de bouw- en vastgoedwereld vanuit verschillende hoedanigheden. Het team was een initiatief van oud-minister Spies en moest de bouw sterker uit de crisis zien te krijgen. “Het was een haastklusje en een intensief traject”, blikt Laglas 11 jaar na dato terug. Samen met hoofdredacteur Eric Verweij van Cobouw staat ze stil bij de lessen die destijds zijn geleerd, gekoppeld aan de huidige problemen in de sector. “Destijds zorgde de financiële crisis voor massale vraaguitval, nu is de fors gestegen rente de allesbepalende factor. Daardoor kloppen de sommen niet meer. Wie dat verlies moet nemen? Iedereen een beetje, maar toch ook de ontwikkelaars, al vinden ze het ongetwijfeld niet leuk, dat ik dat nu zeg.” Betaalbaar wonen is volgens Laglas een van de grootste uitdagingen van deze tijd. “De echte pijn zit nu bij starters en de mensen met een kleine beurs. The Mariners spent years working with Mike Zunino, but despite all efforts, things never quite worked the way everyone had hoped. Now, the team has decided to go in a different direction, acquiring Omar Narvaez. Corey Brock wrote a piece on Narvaez for The Athletic. It'd be a little crazy, after 15 years of fighting for a new arena, if we suddenly had two, but the more the better when it comes to trying to lure a basketball team. Almost three years later, he was back in his adopted home of LA, this time starting his own venue specialist operation, Oak View Group – or OVG – which he launched alongside his partners music biz legend Irving Azoff and the Madison Square Garden company. James visited Tim in his well-appointed office in Westwood, Los Angeles, on a cloudless February or March day this year. On the conversational agenda: - OVG: What is it?
