Stargate.

In this insightful episode, Mike Drues joins host Etienne Nichols to dissect the FDA's most frequently cited compliance issues, challenging the notion that many are strictly "pre-market" concerns. They delve into the nuances of software changes, design creep, and off-label marketing, providing a critical look at how companies can avoid common pitfalls. This discussion is vital for MedTech professionals seeking to understand the true nature of FDA expectations and build more robust quality systems.Timestamps00:04 – Introduction to common FDA compliance issues02:02 – Discussion on FDA's policy of not naming individuals05:45 – Mike Drues challenges the "pre-market" classification of common issues09:20 – Documentation requirements for different device classes11:35 – Mike's take on the most common FDA issues (beyond the presented three)15:40 – Root causes of common compliance problems and industry responsibility20:00 – The role of regulation and FDA's responsibility in clarity27:05 – Deep dive into design change and design creep31:40 – Software changes and the "bug fix" mentality35:45 – Marketing beyond authorized intended use with a real-world example41:00 – Key takeaways and proactive compliance strategiesStandout Quotes"If the regulation makes sense, we shouldn't need it. If the regulation doesn't make sense, we shouldn't have it." — Mike Drues. This quote encapsulates Mike's philosophy on regulatory compliance, emphasizing that true professionalism means understanding inherent needs rather than just following rules."You have a piece of software, you have a bug, you fix the bug… Is your job done? Absolutely not." — Mike Drues. This highlights a critical oversight in software development within MedTech, stressing the importance of holistic post-fix validation to prevent unintended consequences.Top TakeawaysRegulatory Misclassification: Many issues labeled by the FDA as "pre-market" (e.g., marketing beyond intended use, design creep) are fundamentally post-market compliance challenges. This distinction is crucial for companies to allocate resources effectively.Beyond Administrative Review: While administrative incompleteness accounts for a significant portion of 510(k) rejections (around 38%), the scientific and substantial equivalence reviews are major hurdles, with approximately 75% of 510(k)s rejected initially, primarily due to lack of substantial equivalence (85% of those rejections).Top Post-Market Violations: Historically, the most common reasons for FDA 483s and Warning Letters relate to CAPAs (12.5%), design controls (12.5%), and complaint handling (10.5%), collectively accounting for roughly 35% of all post-market issues. Companies should prioritize these areas.Software Change Management: Fixing a software bug is only the first step; a holistic review is essential to ensure no new problems are introduced and the device's safety, efficacy, and usability remain uncompromised.Intentionality vs. Compliance: Marketing a device beyond its authorized intended use, even if the device functionally performs beyond its cleared claims, carries significant regulatory and product liability risks. Companies should seek appropriate clearance for expanded claims rather than relying on off-label promotion.References & LinksEtienne Nichols' LinkedInGreenlight GuruCall to...

The musical world (both in music education, technology, and music ministry) has been adjusting to the reality of a world without Finale. It's been a guiding post in music notation software for many musicians. It's the software I learned on in music school. But sadly, after announcing last year that MakeMusic (Finale's parent company) would no longer support new software updates, it was time to begin shopping for another option. Today's episode of Ministry Monday features the prelude to a 4-part series on music notation software that NPM offered in the spring of 2024. While we invite you to watch all sessions if you're an NPM member (as it is a membership benefit), we offer a segment of the first episode which featured a discussion on copyright licensing within the paradigm of music notation software. To put it bluntly, we ask: are we allowed to re-engrave on music notation software, for the sake of a unified worship aid? If so, how do we report? And many more questions. For more information on Dorico, a music notation software which has become the frontrunner for Finale's replacement, check out the article written by Tony Ward in the July edition of Pastoral Music magazine. It's a resource that's yet another benefit of an NPM membership. (Have I sold you on renewing your membership yet?)

Send us a textEver had a child born in an elevator? Jeremy Greene has, and it's just one of the fascinating stories he shares on this episode of the Quarterback Dadcast. As a father of two young children and the co-founder of Feather, a relationship-focused productivity platform, Jeremy brings a refreshing perspective on balancing entrepreneurship with present parenting.  Growing up in a family where his grandfather and father built a successful residential construction business, Jeremy absorbed powerful values that now shape his approach to parenting. "Family is everything at the center," he explains, describing how this foundation has only strengthened since meeting his wife Christina, whose West Indian culture similarly prioritizes family bonds. The conversation takes a dramatic turn when Jeremy recounts his son Cameron's birth – a four-hour labor that culminated with delivery in a hospital elevator with the help of a doctor who happened to be nearby. This story of unexpected challenge mirrors Jeremy's entrepreneurial journey, which began when he recognized the need for better relationship management tools while sending Father's Day messages to fellow dads in his contact list. What makes this episode particularly valuable is Jeremy's honesty about his parenting struggles. He openly discusses his efforts to be more present despite the demands of building a company, sharing practical wisdom like taking ten seconds before entering the home to reset his energy. His three-part advice for fellow fathers – energy management, partner alignment, and giving yourself grace – offers simple yet powerful practices for anyone navigating the complex journey of parenthood.Whether you're an entrepreneur balancing work demands with family life or simply a father looking for inspiration, Jeremy's blend of vulnerability, practical wisdom, and unwavering commitment to family values will leave you with actionable insights for your own parenting journey. Listen now and discover how you can strengthen the quarterback position in your own family huddle. Please don't forget to leave us a review wherever you consume your podcasts! The Inquiry
Is AI eroding our critical thinking?

    The Inquiry

More and more of the tasks we perform in our daily lives are been guided by artificial intelligence, from searching the internet for answers to relying on satellite navigation in our cars. But studies recently released suggest that our use of AI is having a negative impact on our ability to make informed judgements and decisions. In one recent study from MiT's Media Lab, a group of people were asked to write several essays. Some of them used AI, others didn't. Those who used generative AI reportedly became lazier with each subsequent essay. This cognitive offloading, allowing AI to take over from our brains might be less taxing, but there are concerns that if we come to rely on AI, we are in danger of replacing our own critical thinking for a technology that might not always come up with the right answer. However, there are those who argue that AI can be beneficial in helping our cognitive function, that it can be employed to take on the more mundane, repetitive tasks, freeing up headspace to allow us to become more productive. Software education platforms are just one example where AI is been employed to assist teachers in things like knowledge checks and grading, with the claim that it allows them time for more valuable interaction with their students. So is it possible to find a balance where we can we can rely on AI but not to the extent were we lose our mental agility. Brian #1: Switching to direnv, Starship, and uv Last week I mentioned that I'm ready to try direnv again, but secretly, I still had some worries about the process. Thankfully, Trey has a tutorial to walk me past the troublesome parts. direnv - an extension for your shell. It augments existing shells with a new feature that can load and unload environment variables depending on the current directory. Switching from virtualenvwrapper to direnv, Starship, and uv - Trey Hunner** Trey has solved a bunch of the problems I had when I tried direnv before Show the virtual environment name in the prompt Place new virtual environments in local .venv instead of in .direnv/python3.12 Silence all of the “loading”, “unloading” statements every time you enter a directory Have a script called venv to create an environment, activate it, create a .envrc file I'm more used to a create script, so I'll stick with that name and Trey's contents A workon script to be able to switch around to different projects. This is a carry over from “virtualenvwrapper', but seems cool. I'll take it. Adding uv to the mix for creating virtual environments. Interestingly including --seed which, for one, installs pip in the new environment. (Some tools need it, even if you don't) Starship Trey also has some setup for Starship. But I'll get through the above first, then MAYBE try Starship again. Some motivation Trey's setup is pretty simple. Maybe I was trying to get too fancy before Starship config in toml files that can be loaded with direnv and be different for different projects. Neato Also, Trey mentions his dotfiles repo. This is a cool idea that I've been meaning to do for a long time. Built on SQLite, the world's most popular database Supports full-text search, Vector Search, and JSON documents Access controls and encryption for secure deployments Michael #3: A Python dict that can report which keys you did not use by Peter Bengtsson Very cool for testing that a dictionary has been used as expected (e.g. all data has been sent out via an API or report). Note: It does NOT track d.get(), but it's easy to just add it to the class in the post. Maybe someone should polish it up and put it on pypi (that person is not me :) ). Brian #4: Some Markdown Stuff Textual 4.0.0 adds Markdown.append which can be used to efficiently stream markdown content The reason for the major bump is due to an interface change to Widget.anchor Refreshing to see a symantic change cause a major version bump. html-to-markdown Converts html to markdown A complete rewrite fork of markdownify Lots of fun features like “streaming support” Curious if it can stream to Textual's Markdown.append method. hmmm. Stocks hold steady as tariff uncertainty continues. Our CIO and Chief U.S. Equity Strategist Mike Wilson explains how policy deferrals, earnings resilience and forward guidance are driving the market.Read more insights from Morgan Stanley.----- Transcript -----Welcome to Thoughts on the Market. I'm Mike Wilson, Morgan Stanley's CIO and Chief U.S. Equity Strategist. Today on the podcast I'll be discussing why stocks remain so resilient. It's Monday, July 14th at 11:30am in New York. So, let's get after it. Why has the equity market been resilient in the face of new tariff announcements? Well first, the import cost exposure for S&P 500 industries is more limited given the deferrals and exemptions still in place like the USMCA compliant imports from Mexico. Second, the higher tariff rates recently announced on several trading partners are generally not perceived to be the final rates as negotiations progress. I continue to believe these tariffs will ultimately end up looking like a 10 percent consumption tax on imports that generate significant revenue for the Treasury. And finally, many companies pre-stocked inventory before the tariffs were levied and so the higher priced goods have not yet flowed through the cost of goods sold. Furthermore, with the market's tariffs concerns having peaked in early April, the market is looking forward and focused on the data it can measure. On that score, the dramatic v-shaped rebound in earnings revisions breadth for the S&P 500 has been a fundamental tailwind that justifies the equity rally since April in the face of continued trade and macro uncertainty. This gauge is one of our favorites for predicting equity prices and it troughed at -25 percent in mid-April. It's now at +3 percent. The sectors with the most positive earnings revisions breadth relative to the S&P 500 are Financials, Industrials and Software — three sectors we continue to recommend due to this dynamic. The other more recent development helping to support equities is the passage of the One Big Beautiful Bill. While this Bill does not provide incremental fiscal spending to support the economy or lower the statutory tax rate, it does lower the cash earnings tax rates for companies that spend heavily on both R&D and Capital Goods. Our Global Tax Team believes we could see cash tax rates fall from 20 percent today back toward the 13 percent level that existed before some of these benefits from the Tax Cuts and Jobs Act that expired in 2022. This benefit is also likely to jump start what has been an anemic capital spending cycle for corporate America, which could drive both higher GDP and revenue growth for the companies that provide the type of equipment that falls under this category of spending. Meanwhile, the Foreign-Derived Intangible Income is a tax incentive that benefits U.S. companies earning income from foreign markets. It was designed to encourage companies to keep their intellectual property in the U.S. rather than moving it to countries with lower tax rates. This deduction was scheduled to decrease in 2026, which would have raised the effective tax rate by approximately 3 percent. That risk has been eliminated in the Big Beautiful Bill. Finally, the Digital Service Tax imposed on online companies that operate overseas may be reduced. Late last month, Canada announced that it would rescind its Digital Service Tax on the U.S. in anticipation of a mutually beneficial comprehensive trade arrangement with the U.S. This would be a major windfall for online companies and some see the potential for more countries, particularly in Europe, to follow Canada's lead as trade negotiations with the U.S. continue. Bottom line, while uncertainty around tariffs remains high, there are many other positive drivers for earnings growth over the next year that could more than offset any headwinds from these policies. This suggests the recent rally in stocks is justified and that investors may not be as complacent as some are fearing. Thanks for tuning in; I hope you found it informative and useful.
